PLANNING COMMISSION MEETING MINUTES
Thursday,April 13,2017—Oak Park Heights City Hall
Call to Order/Pledge of Allegiance: Welcome New Planning Commissioner Tim Freeman.
Chair Kremer called the meeting to order and welcomed new Planning Commissioner Tim
Freeman. Present: Commissioners Kremer,Freeman&Quale;City Administrator Johnson,
City Planner Richards,and City Councilmember Dougherty. Absent: Commissioners Anthony
&Nelson.
II. Approval of Agenda: Commissioner Quale,seconded by Commissioner Freeman,moved to
approve the Agenda as presented. Carried 3 —0.
III. Approval of Mrch 16,2017 Meeting Minutes: Commissioner Quale, seconded by
Commissioner Freeman,moved to approved the Minutes as presented. Carried 3 -0.
IV. Department/Commission Liaison/Other Reports: None.
V. Visitors/Public Comment: None.
VI. Public Hearings:
A. Timothy Bockman Garage Addition CUP: Review request for conditional use
permits to allow an increase in area size,location and height related to a proposed
garage addition to be located at 14151 60th St.N
City Planner Richards reviewed and discussed the April 5,2017 Planning Report as to
the request,noting issues related to the odd shape of Mr.Bockman's lot and the
placement of the garage to the side yard as a result of the same,adding that the location
was likely the best selection for placement.
Chair Kremer opened the public hearing and invited comment.
Tim Bockman— 14151 60th St.N. introduced himself as the applicant and discussed
the scope of the proposed project and the existing conditions of the property. Chair
Kremer inquired if any of his property was lost to the roadway project. Mr.Bockman
responded that some of his property was taken as part of the project.
Discussion ensued as to the information submitted and that which was required by the
City for the request,the open space conservation district zoning classification of the
parcel and what could occur if the property were rezoned to something otherwise,the
proposed garage size area and height,driveway access and the sites current grade.
There being no further public comment,Chair Kremer closed the public hearing.

Commissioner Freeman, seconded by Commissioner Quale,moved to recommend
that the City Council approve the request,subject to the conditions of the April 5,
2017 Planning Report as amended; specifically,that:
1. The City Engineer shall review the drainage for the site. The final grading for
the proposed structure shall be subject to approval the City Engineer.
2. Any exterior mechanical equipment associated with the garage shall be
screened.
3. The exterior of the proposed garage shall be finished with siding to match the
current home exterior.
4. The applicant shall apply for and receive a building permit for the structure.
5. Any other conditions of the Planning Commission,City Council and City
Staff.
Carried 3 -0.
B. Midstate Landscaping&Excavating CUP: Review request for a conditional
use permit to allow a landscaping business and outside storage of landscaping
materials and equipment at 5750 Memorial Ave.N
City Planner Richards reviewed the April 5,2017 Planning Report and provided an
issue analysis of the proposed request and discuss the same.
Chair Kremer opened the public hearing and invited comment.
Jason Anderson—5750 Memorial Ave.N. introduced himself as the applicant and
made himself available for questions.
There being no further public comment or discussion from the Commission,Chair
Kremer closed the public hearing.
Commissioner Quale,seconded by Commissioner Freeman,moved to recommend that
the City Council approve the request, subject to the conditions of the April 5,2017
Planning Report as amended; specifically,that:
1. The City Engineer shall approve any grading and berm work to contain the
storage of materials on site. Any grading and drainage plans shall be subject to
review and approval of the City Engineer and the Brown's Creek Watershed
District.
2. Landscape material bins shall be placed on the north side of the site by
September 30,2017.

3. Any freestanding or wall lighting placed on the site shall be in compliance
with the Zoning Ordinance and be subject to review and approval of City
Staff.
4. The storage and fueling of vehicles shall be compliant with all Washington
County and State of Minnesota rules and requirements.
5. All signage proposed for the site shall be compliant with Section 401.15.G of
the Zoning Ordinance and shall be subject to receiving a sign permit.
6. Trash and recycling containers shall be stored inside the building.
Carried 3-0
VII. New Business: None.
VIII. Old Business:
A. Oak Park Heights—Comprehensive Plan 2040:
City Planner Richards reviewed his April 6,2017 Memorandum noting that the April
meeting will focus on review of the issued and existing land uses identified during the
2008 Comprehensive Plan process and then discussing potential changes to these areas.
Discussion ensued related to traffic/transportation,park related items,the
Comprehensive Planning process,the relationship between Metropolitan Council and
communities in the planning process,and the desire to see the preparation of the
Comprehensive Plan be more meaningful as a planning function and to that
end it was suggested that rather than a lump sum review and update of the plan,the
process be more continuous and consistent conversation.
Existing Land Use was discussed. It was noted that land use zoning is
important in creating a healthy mix of development,which will provide community
stability and economy.
Chair Kremer expressed that he didn't see the Comprehensive Plan as an effective
planning tool because so much change occurs in the short term.
City Planner Richards stated that he will be meeting with the City Council to review
these same issues and also hopes to address them with the Parks Commission. He
asked the Commission to give some thought to issues they may want to include in the
plan for the next meeting and to also review the existing land use map and to suggest
any changes they feel should be made. May discussion will be a wrap up of the
issues and land use discussion. Richards indicated that he hopes to assemble
inventory information with the updated census numbers and begin the inventory
discussion with the Commission as well.

IX. Informational:
A. 2017 Commission Liaison Calendar Review/Update: Chair Kremer noted that he
would not be able to attend the July 13th meeting and asked if anyone had an issue for
rescheduling that meeting to July 201. No issue was expressed. No other changes
were recommended for the calendar or the Commission Liaison Schedule.
