JOINT RESOLUTION OF THE CITIES OF OAK PARK
HEIGHTS, LAKE ELMO, AND TOWNSHIP OF BAYTOWN
SUPPORTING A NO BUILD OPTION FOR FUTURE PLANNING ON
MANNING AVENUE LOCATED TO THE SOUTH OF TRUNK HIGHWAY 36
WHEREAS, the Washington County Department of Public Works
has had meetings with the Manning Avenue Connection Study Task
Force outlining various options and alternatives to determine
impacts of a proposed Manning Avenue connection located south of
Trunk Highway 36; and,
WHEREAS, each of the communities of Oak Park Heights,
Lake Elmo, and Baytown have participated in that task force and
have reviewed the materials prepared thereby; and,
WHEREAS, all three communities have determined that it is
not feasible nor prudent to consider Alternatives 1, 2 or 3 as
• proposed by the Washington County Highway Department and favor a no
build option as it affects the proposed Manning Avenue connection;
and,
WHEREAS, all three communities are of the opinion that
the cost of connection of Manning Avenue with its detrimental
impact on adjoining lands, excessive cost, and minimal traffic use
is not supported by the benefit that is perceived to occur by such
connection.
NOW, THEREFORE, BE IT JOINTLY RESOLVED by the communities
of Oak Park Heights, Lake Elmo, and Baytown Township that all three
communities favor a no build option as it affects the proposed
Manning Avenue connection and recommend that no right -of -way
acquisition or preservation occur.

BE IT FURTHER RESOLVED, that all three communities will
• jointly execute this resolution and forward a copy thereof to the
Washington County Board of Commissioners as well as the Washington
County Highway Department.

RESOLUTION NO. 97- 12 -49
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING POLICIES
FOR THE USE OF COVER PARK HOCKEY RINK
FROM DECEMBER 1, 1997 THROUGH MARCH 31, 1998
WHEREAS, the City of Oak Park Heights owns and manages
the use of the various hockey rinks throughout the City of Oak Park
Heights for the benefit of the public; and,
WHEREAS, the City of Oak Park Heights has attempted to
balance the use of the hockey rinks with the needs of the
neighborhoods, youth hockey associations, and the public in
general.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
1. That the Cover Park hockey rink shall be allowed to
be used by the St. Croix Valley Hockey Association on Monday
through Friday at 6:00 p . m . to 9:00 p . m . and on Saturday and Sunday
morning from 9:00 a.m. to noon.
• 2. That the St. Croix Valley Hockey Association has
been informed and understands that there will be no hockey
attendant on duty at that time and that they shall
remain
responsible for any damage to the building that occurs while their
association has access to the building and the grounds. That the
St. Croix Hockey Association has agreed to be responsible for any
damage to the building or grounds occurring at that time.
3. That the St. Croix Valley Hockey Association shall
coordinate details with the Department of Public Works on the
opening and closing of the buildings related to the periods of its
use. The Department of Public Works shall maintain exclusive
control over rink flooding to maintain quality of ice. St. Croix
Valley Hockey Association shall be responsible for snow removal
should it be required on weekends.

• RESOLUTION NO. 97-
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING A POLICY FOR
LIGHTING STRUCTURES WITHIN ALL NEW DEVELOPMENTS
LOCATED WEST OF OAKGREEN AVENUE WITHIN
THE CITY OF OAK PARK HEIGHTS
WHEREAS, the City of Oak Park Heights anticipates
development within the vacated areas of the City of Oak Park
Heights located to the west of Oakgreen Avenue in the immediate
future; and,
WHEREAS, an existing lighting structure plan has been
implemented by the Minnesota Department of Transportation along
Trunk Highway 36 and the frontage road that will utilize a shoebox
type construction lighting structure supported by a prepainted
pole; and,
WHEREAS, it is the desire of the City Council to
implement a uniform lighting structure throughout the area to be
improved so as to bring same in conformity for planning and
aesthetic purposes.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
1. That City staff shall monitor all future
developments to be located within the areas of the City of Oak Park
Heights located to the west of Oakgreen Avenue and as to all
lighting structures located therein, assure that the same are
complimentary to and compatible with the lighting structures
selected by the City of Oak Park Heights for frontage road design
purposes in conjunction with the Minnesota Department of
Transportation.
2. As to all existing lighting structures as may
require replacement in the future, that the office of the Building
Inspector shall advise all applicants seeking permits for lighting
structure replacement that the lighting structure to be selected as
and for replacement to any existing lighting structure shall be in
conformity with the MnDOT specified shoebox -type structure being
implemented within the area.

RESOLUTION NO. 97 -12 -46
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING WATER USAGE RATES
WITHIN THE CITY OF OAK PARK HEIGHTS
EFFECTIVE JANUARY 1, 1998
WHEREAS, the City of Oak Park Heights by resolution and
ordinance in such case made and provided regulates water usage
rates within the City for all users; and,
WHEREAS, a rate study has been conducted and completed by
the office of the City Engineer recommending water rate increases
to accommodate the cost for administrating, managing, and providing
municipal water resources to the citizens of the City of Oak Park
Heights and all properties connected thereto; and,
WHEREAS the City Council has reviewed said rate study
and determined the same to be fair and equitable.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
1. That effective January 1, 1998 the residential water
• rate shall be established as follows: $19.20 per quarter for up to
15,000 gallons per water with a surcharge of $1.00 per 1,000
gallons for usage over 15,000 gallons per quarter. Commercial,
industrial, and institutional water rates shall be the same as
residential rates.
2. That effective January 1, 1998 the City of Oak Park
Heights shall establish a sanitary sewer rate for all users as
follows: $31.50 per quarter minimum charge for up to 15,000
gallons of sanitary sewage per quarter with a surcharge of $1.95
per 1,000 gallons of sanitary sewer usage over 15,000 gallons.
3. All sewer rates on commercial, industrial and
institutional shall be the same as residential and shall be based
on actual usage.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION IMPLEMENTING RATE INCREASES FOR
RESIDENTIAL WASTE /REFUSE COLLECTION WITHIN THE CITY
OF OAK PARK HEIGHTS EFFECTIVE JANUARY 1, 1998
WHEREAS, the City of Oak Park Heights, pursuant to
contract with Junker Sanitation, Inc., currently collects and
administers city residential refuse and garbage collection and
establishes the rates therefor; and,
WHEREAS, the City of Oak Park Heights has incurred
substantial fees and expenses as a part of the Junker Landfill
lawsuit, which fees and expenses exceeded $140,000.00; and,
WHEREAS, said expenses were directly related as a result
of the City's contract with Junker Sanitation, Inc. and the
collection of residential refuse by the City of Oak Park Heights
under said contract; and,
WHEREAS, the City Council has determined that it is fair
and equitable to apportion the costs of said lawsuit among its
residential property owners, increasing the quarterly garbage and
refuse rates for a period of five (5) years.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for
the City of Oak Park Heights as follows:
1. That effective January 1, 1998 the quarterly
residential garbage /refuse rate shall be increased by $6.50 per
quarter for a period of five (5) years with said increase
terminating December 31, 2002.

RESOLUTION
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION GRANTING THE APPLICATION
OF PHILIP B. BARBATSIS D /B /A PHIL'S
TARA HIDEAWAY FOR "ON SALE" LIQUOR
AND SUNDAY LIQUOR LICENSE
WHEREAS, Philip B. Barbatsis, on behalf of Phil's Tara
Hideaway, Inc. has applied to the City of Oak Park Heights for "on
sale" liquor and Sunday liquor licenses; and,
WHEREAS, the applicant has provided to the City of Oak
Park Heights proof of corporate organization indicating that Phil's
Tara Hideaway, Inc. is a Minnesota corporation organized by Philip
B. Barbatsis as its sole and exclusive shareholder; and,
WHEREAS, the applicant has provided a Certificate of
Insurance as required by ordinances and statutes in such case made
and provided; and,
• WHEREAS, the Chief of Police for the City of Oak Park
Heights has completed criminal history and background checks as
required by ordinance and statute and has recommended approval of
the application.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR
THE CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City Clerk be and is hereby authorized to
issue to Phil's Tara Hideaway, Inc. an on sale liquor and Sunday
liquor license in the manner and form prescribed by ordinance.
That such issuance of licenses to Phil's Tara Hideaway, Inc. are
conditioned on the following:
a. That Phil's Tara Hideaway, Inc. maintain
compliance with the ordinances of the City of Oak Park Heights and
statutes of the State of Minnesota requiring appropriate insurance
coverage to be maintained throughout the license period and in the
amounts specified by statute.
b. That Philip B. Barbatsis remain as the sole and
exclusive shareholder of Phil's Tara Hideaway, Inc. That should
there be any transfer of stock from Philip B. Barbatsis, the
licenses as issued and authorized under this resolution shall cease
and be ineffective as of the time of transfer of ownership or stock
• from Philip B. Barbatsis to any other individual or entity.

WHEREAS, Randall W. Urtel, on behalf of Letru, Inc. has
applied to the City of Oak Park Heights for an "on sale" liquor
license; and,
WHEREAS, the applicant has provided to the City of Oak
Park Heights proof of corporate organization indicating that Letru,
Inc. is a Minnesota corporation organized by Randall W. Urtel and
Victoria Urtel as its sole and exclusive shareholders; and,
WHEREAS, the applicant has provided a Certificate of
Insurance as required by ordinances and statutes in such case made
and provided; and,
WHEREAS, the Chief of Police for the City of Oak Park

A RESOLUTION APPROVING THE 1998 BUDGET
WHEREAS, the City Staff has prepared and submitted to the City
Council the proposed budget for calendar year 1998; and,
WHEREAS, public notice has been duly given as provided by law
with public hearings being conducted by the City Council with
regard to the proposed budget, receiving no adverse comment from
the public with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park Heights has
determined that the proposed budget as submitted by the City Staff
is in the best interests of the citizens of the City of Oak Park
Heights.
• NOW, THEREFORE, BE IT RESOLVED, by the City Council for the
City of Oak Park Heights:
That the 1998 budget is hereby approved as presented by the
City Finance Director in the total General Fund amount of
$2,052,778.00.

A RESOLUTION APPROVING THE 1998 GENERAL FUND LEVY
WHEREAS, the City Staff has prepared and submitted to the City
Council the proposed general fund levy for calendar year 1998; and,
WHEREAS, public notice has been duly given as provided by law
with public hearings being conducted by the City Council with
regard to the proposed general fund levy, receiving no adverse
comment from the public and with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park Heights has
determined that the proposed general fund levy as submitted by the
City Staff is in the best interests of the citizens of the City of
Oak Park Heights.
• NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights:
1. That the Interim City Administrator is hereby authorized
and directed to certify to the Washington County Auditor -
Treasurer the General Fund levy for the City of Oak Park
Heights for calendar year 1998 in the amount of
$1,440,637.00.
2. That the Interim City Administrator is also authorized
and directed to certify to the County Auditor - Treasurer
the Bonded Indebtedness levy for 1995 Street
Reconstruction Bonds in the amount of $58,410.00 to be
collected in calendar year 1998.
3. That the Interim City Administrator is also authorized
and directed to certify to the County Auditor - Treasurer
the sum of $25,000.00 for improvements to Storm Sewer
Improvement Tax District No. 1, to be collected in
calendar year 1998 with real estate taxes on the affected
• properties.

RESOLUTION APPROVING CONTINUED SUPPORT
FOR THE METROPOLITAN LIVABLE COMMUNITIES ACT FOR
CALENDER YEAR 1998
WHEREAS, the Metropolitan Livable Communities Act (1995 Minnesota Laws Chapter
255) establishes a Metropolitan Livable Communities Fund which is intended to address
housing and other development issues facing the metropolitan area defined by Minnesota
Statues section 473.121; and
WHEREAS, the Oak Park Heights City Council adopted Resolution No. 95 -10-45 electing
to participate in the Local Housing Incentives Account Program under the Metropolitan
Livable Communities Act; and,
WHEREAS, the Oak Park Heights City Council adopted Resolution No. 95 -12 -54
establishing housing goals through the Housing Goals Agreement negotiated with
Metropolitan Council; and,
• WHEREAS, the Oak Park Heights City Council, in 1996, adopted a Housing Policy Action
Plan to guide the City's Housing related activities through the year 2010, in conjunction
with the Local Housing Incentives Account Program under the Metropolitan Livable
Communities Act.
NOW, THEREFORE BE IT RESOLVED, that the City of Oak Park Heights hereby elects
to continue artici ation in the Local Housing Incentives Account Program under the

RESOLUTION APPROVING THE JOINT AND COOPERATIVE AGREEMENT
BETWEEN THE MINNESOTA DEPARTMENT OF TRANSPORTATION, CITY
OF STILLWATER, BAYTOWN TOWNSHIP AND CITY OF OAK PARK
HEIGHTS WITH REGARD TO MAINTENANCE OF SEMAPHORES ON TRUNK
HIGHWAY 5 AND 36 AT THE INTERSECTIONS OF WASHINGTON/
NORELL AVENUES AND TRUNK HIGHWAY 36; TRUNK HIGHWAY 5 AND
TRUNK HIGHWAY 36; AND, TRUNK HIGHWAY 5 AT 58TH STREET.
WHEREAS, the City Council for the City of Oak Park Heights has
received the proposed Joint and Cooperative Agreement as drafted by
the Minnesota Department of Transportation assigning responsibility
for utility sharing costs for the maintenance of semaphores along
Trunk Highway 5 and 36 at the locations referenced above; and,
WHEREAS, said agreement apportions responsibilities for those
various semaphores between the jurisdictions directly affected
thereby implementing a shared cost at the Nore11 /Washington Avenues
semaphore at Highway 36, and the Trunk Highway 5 /Trunk Highway 36
semaphores to be shared between the City of Stillwater and the City
of Oak Park Heights; and,
WHEREAS, further shared costs to be implemented between the
City of Oak Park Heights and Baytown Township at Trunk Highway 5 at
58th Street; and,
WHEREAS, said agreement has been reviewed by City Staff; and,
WHEREAS, the City Council determines same to be reasonable.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the
City of Oak Park Heights:
1. That the proposed Joint and Cooperative Agreement be and
the same is hereby approved and the Mayor and the City
Administrator are hereby authorized to execute same on behalf of
the City of Oak Park Heights forwarding same on to the other local
jurisdictions for their approval and execution.
BE IT FURTHER RESOLVED:
2. That this approval is conditioned upon City of Stillwater
and Baytown Township executing on behalf of their respective
jurisdictions of the agreement as prepared by the Minnesota
Department of Transportation.

Pursuant to due call and notice thereof, a regular meeting of
the City Council for the City of Oak Park Heights, Washington
County, Minnesota was duly held at the City within said City on the
23rd day of September, 1997, at 7:00 o'clock p.m.

RESOLUTION RECEIVING BIDS AND AWARDING
CONTRACT ON BRACKEY WEST /STILLWATER FORD
UTILITY IMPROVEMENTS OF 1997.
BE IT RESOLVED, by the City Council for the City of Oak Park
Heights as follows:
1. All bids on the construction of the Brackey West/
Stillwater Ford Utility Improvements of 1997 are hereby received
• and tabulated.

2 . That the bid of Richard Knutson, Ind,. Minnesota in the amount
• of $ 340.907.98 for the construction of said improvements in
accordance with the plans and specifications and the advertisement
for bids is the lowest responsible bid and shall be and is hereby
accepted.
3. That the Mayor and the Administrator are hereby
authorized and directed to enter into a contract with said bidder
for the construction of said improvements on behalf of the City of
Oak Park Heights.
4. That the City Administrator is hereby authorized and
directed to return to all bidders, deposits made with their bids,
except that the deposit of the successful bidder and the next
lowest bidder shall be retained until such time as that contract
has been executed.
The Motion for the adoption of the foregoing Resolution was
duly seconded by member S wenaon and upon a vote being taken
thereon, the following voted in favor thereof:

The City Administrator presented the Affidavit showing the
publication and mailing of notices of hearing and the Mayor

IMPROVEMENTS OF 1997
WHEREAS, after due call and notice of public hearing on the
construction of said improvements within the City of Oak Park
Heights, Minnesota, hearing on said improvements was duly held and
Council heard all persons desiring to be heard on the matter and
fully considered same;
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights, Washington County, Minnesota as follows:
1. It is advisable, expedient and necessary that said
improvements as described in the Notice of Public Hearing thereon
be constructed, and that the same are hereby ordered made.
2. That the said improvements described in said hearing
notice are hereby designated and shall be known as the Brackey
West /Stillwater Ford Utility Improvements of 1997.
3. That the City's Consulting Engineer, Bonestroo, Rosene,
Anderlik & Associates have been directed by the City Council to
prepare final plans and specifications for said improvements. Said
final plans and specifications have been presented by the Council
and have been approved.
4. The City Council shall let the contract for all or part
of the work for said improvements or order all or part of the work
done by day labor or otherwise as authorized by Minn. Stat.
§429.041 subd. 2 within one year of the date of this Resolution
ordering said improvements.
The Motion for the adoption of the foregoing Resolution was
duly seconded by member Turnquist and upon a vote being taken
thereon, the following voted in favor thereof:

A RESOLUTION APPROVING THE 1998 PROPOSED BUDGET
WHEREAS, the City Staff has prepared and submitted to the
Council it's proposed budget for calendar year 1998; and,
WHEREAS, the City Council for the City of Oak Park Heights
has determined that the proposed budget as submitted by the City
Staff is in the best interests of citizens of the City of Oak
Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of oak Park Heights as follows:
1. That the 1998 proposed budget is hereby approved as
presented by City Administration in the total General
Fund amount of $2,162,435.00.
2. That the City Administrator is hereby authorized and
directed to certify to the Washington County Auditor -
Treasurer the Proposed General Fund levy for the City
of Oak Park Heights for the calendar year 1998 in the
amount of $1,440,637.
3. That the City Administrator is also authorized and
directed to certify to the County Auditor- Treasuuer for
collection the proposed sum of $25,000.00 for
improvements to Storm Sewer Improvement Tax District
No. 1, to be collected in calendar year 1998 with real
estates taxes on the affected properties.
4. The City Administrator is also authorized and
directed to certify to the County Auditor - Treasurer for
collection the proposed sum of $58,410.00 for General
Obligation Bonds of 1995, to be collected in calendar
year 1998.

RESOLUTION 97 -08 -31
PERRO CREEK RESOLUTION
WHEREAS, the City of Oak Park Heights has participated in
the Middle St. Croix Watershed Management Organization for the
past 13 years; and,
WHEREAS, the City of Oak Park Heights would like to work
with the members of the Middle St. Croix Watershed Management
Organization to solve the summer flooding in the City of Bayport
and work with the Minnesota Correction facility so that the State
of Minnesota funds replacement of the existing piping system that
currently maintains the winter water flow of Perro Creek to the
St. Croix River; and,
WHEREAS, the City of Oak Park Heights has provided funds to
study the Perro Creek Subwatershed; and,
WHEREAS, the Middle St. Croix Watershed Management
Organization at its July 16, 1997 meeting adopted a plan of
action that will not solve flooding problems in Perro Creek as it
flows through the City of Bayport; and,
. WHEREAS, the Middle St. Croix Watershed Management
Organization would not support working with the Minnesota
Department of Corrections and our Legislative Representatives to
identify funding to replace the worn out prison piping systems;
and,
WHEREAS, detailed in a 1994 Perro Creek study indicates that
the water flow from a 100 year storm event from Prison Pond
outlet structure is 65 cubic feet per second, this represents
water flow from 70 % of the land area in Perro Creek
Subwatershed, additional water flow into the creek below Prison
Pond is 164 cubic feet per second, this represents 30 of the
Perro Creek Subwatershed land area, total flow of water near the
river is 229 cubic feet per second; and,
WHEREAS, the current proposed funding formula is unfair to
the upstream areas above Prison Pond as these areas will have to
contribute disproportionate funding to prevent flooding in the
Perro Creek Subwatershed; and,
NOW, THEREFORE, BE IT RESOLVED, the City of Oak Park Heights
will not participate in funding the Perro Creek route B study
directed at the July 16, 1997 meeting of the Middle St. Croix
Watershed Management Organization.
• BE IT FURTHER RESOLVED, the City of Oak Park Heights does
not support the existing Perro Creek Subwatershed funding
formula.

RESOLUTION RECEIVING PRELIMINARY REPORT AND
CALLING FOR PUBLIC HEARING ON BRACKEY WEST/
STILLWATER FORD UTILITY IMPROVEMENTS OF 1997
WHEREAS, the City Council deems it necessary and expedient
that the City of Oak Park Heights construct certain improvements
to -wit: municipal water, sanitary sewer and street improvements, in
the City of Oak Park Heights as described and in accordance with
the preliminary plans and report prepared by Bonestroo, Rosene,
Anderlik and Associates dated May 30, 1997 and amended on June 11,
1997, the City's consulting engineers; and,
WHEREAS, the City Council has been advised by the consulting
engineers that said Brackey West /Stillwater Ford improvements of
1997 are feasible and should best be made as proposed, and that the
consulting engineer's report to this affect as heretofore been
received by the City Council and filed with the City Clerk; and,
•
• WHEREAS, the statute provides that no such improvement shall
be made until the Council shall have held a public hearing on such
improvements following mailed notice and two publications thereof
in the official newspaper stating the time and place of the
hearing, the general nature of the improvement, the estimated cost
thereof, and the area proposed to be assessed, in accordance with
law.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights, Washington County, Minnesota as follows:
1. A public hearing will be held at the time and place set
forth in the Notice of Hearing attached hereto as Exhibit A to
consider the proposed improvements.
2. The nature of the improvements, the estimated cost of
each major portion thereof, and the areas proposed to be assessed
therefore are described in the form of Notice of Hearing hereto
attached.
3. The Notice of said public hearing shall be in
substantially the form contained in the notice hereto attached.
4. The City Administrator is hereby authorized and directed
to cause notice of said hearing to be given two publications in the
. official newspaper. Said publications shall one week apart, and at
least three days shall elapse between the last publication and the
hearing. Not less than 10 days before the hearing, the clerk shall
mail notice of the hearing to the owner of each parcel of land
within the area proposed to be assessed as described in the Notice.
For the purpose of giving such mailed notice, owners shall be shown
to be such on the records of the County Auditor or, if the tax
statements in the County are mailed by the County Treasurer, on the
records of the County Treasurer. As to properties not listed on
the records of the County Auditor or County Treasurer, the Clerk
shall ascertain such ownership by any practicable means and give
mailed notice to such owners.

RESOLUTION AUTHORIZING APPLICATION
FOR A METROPOLITAN COUNCIL
PLANNING ASSISTANCE GRANT
WHEREAS, Minnesota Statutes Section 473.851 requires local units of government
to prepare local comprehensive plans with land use controls that are consistent with
planned, orderly and staged development and with metropolitan system plans; and
WHEREAS, Minnesota Statutes Sections 473.854 and 473.867 authorize the
Metropolitan Council to prepare and adopt guidelines establishing uniform procedures for
the award and disbursement of planning assistance grants and loans; and
WHEREAS, Minnesota Statutes Section 473.867 authorizes the Metropolitan
Council to give funding to local units of government to review and amend their local
comprehensive plans, fiscal devices and official controls, and
WHEREAS, the City of Oak Park Heights requires a planned assistance grant to
complete comprehensive planning activities, specifically the Comprehensive Plan Update
and engineering studies.
NOW, THEREFORE, BE IT RESOLVED that the City dministrator is hereby

grant to update and revise the City's Comprehensive Plan; and

A RESOLUTION REVOKING ONSALE LIQUOR LICENSE PREVIOUSLY
ISSUED TO DOYLE'S BOWLING CENTER AND PUB, INC.
WHEREAS, the City of Oak Park Heights has previously received
an application from Doyle's Bowling Center and Pub, Inc. to issue
an onsale liquor license within the City of Oak Park Heights; and,
WHEREAS, the City Council for the City of Oak Park Heights did
grant the onsale application to Doyle's Bowling Center and Pub,
Inc. effective January 1, 1997; and,
WHEREAS, the City of Oak Park Heights has received notice from
the Commissioner of Revenue for the State of Minnesota pursuant to
Minn. Stat. §270.72 and /or §16D.08 subd. 2 to revoke the above
named license for non - compliance with the statutory provisions
• contained therein; and,
WHEREAS, the City Council for the City of Oak Park Heights has
received Notice of Cancellation of the insurance policy required
for the operation of an onsale liquor license within the City of
Oak Park Heights as well; and,
WHEREAS, the City Council for the City of Oak Park Heights
acting pursuant to statute and the directive of the Commissioner of
Revenue is required to revoke the onsale liquor license previously
issued to the Applicant; and,
WHEREAS, the Applicant is currently in non - compliance with
insurance requirements otherwise specified by the ordinances and
the statutes in such case made and provided.
NOW THEREFORE, IT IS RESOLVED, by the City Council of the City
of Oak Park Heights that the onsale liquor license previously
• issued to Doyle's Bowling Center and Pub, Inc., by the City of Oak
Park Heights be in the same is hereby revoked.

A RESOLUTION SUPPORTING THE LOWER ST. CROIX RIVER
ACT OF THE 92ND CONGRESS PUBLIC LAW NO. 92 -560 AND
THE PRESERVATION AND ADMINISTRATION OF THE LOWER ST
CROIX RIVER AS A WILD AND SCENIC RIVER
WHEREAS, the City of Oak Park Heights has consistently
supported the protection of the St. Croix River under the Wild and
Scenic Rivers Act recognized under Public Law No. 92 -560 as passed
by the 92nd Congress; and,
WHEREAS, the City of Oak Park Heights has worked consistently
with the Dept. of the Interior and the National Park Service and
the Minn. Dept. of Natural Resources to protect the St. Croix River
for the past 25 years; and,
WHEREAS, the Minn. Dept. of Transportation now proposes
modifications and amendments to the Wild and Scenic Rivers Act in
order to build a bridge which has been determined to violate the
• Wild and Scenic Rivers Act by the Dept. of the Interior and the
National Park Service; and,
WHEREAS, neither the Dept. of the Interior nor the National
Park Service has ever approved the proposed St. Croix River
Crossing Bridge as proposed by the Minn. Dept. of Transportation
and has consistently advised the Minn. Dept. of Transportation for
a period of years that its proposals were not consistent with the
provisions of the Wild and Scenic Rivers Act which protect the
lower St. Croix; and,
WHEREAS, the City of Stillwater, the City of New Richmond, the
Minn. Dept. of Transportation, the Wis. Dept. of Transportation and
the St. Croix Alliance for the Interstate Bridge are now before
Congress of the United States proposing to exempt the Minn. Dept.
of Transportation freeway style bridge from the Wild and Scenic
Rivers Act in order to circumvent and obstruct the purposes of the
Wild and Scenic Rivers Act; and,
WHEREAS, the Minnesota Wisconsin Boundary Area Commission,
specifically created under the auspices of the Wild and Scenic
Rivers Act has issued its report dated April 17, 1997 finding that
the current impasses between the Dept. of the Interior and the
Minn. Dept. of Transportation has occurred over the past twelve
years, "because the states of Minnesota and Wisconsin have failed
to develop a plan that balances their public policy goals and
• objectives (...protection of scenic, recreational and geologic
values of the ... St. Croix River... and... save, efficient highway
• traffic management systems...) and leaving the responsibility to
determine its acceptability up to the United States Dept. of the
Interior as an overall Federal administrating agency for the Lower
St. Croix National Scenic Riverway." and,
WHEREAS, the National Park Service has indicated that it would
consider the placement of an appropriate replacement bridge within
the central corridor of the St. Croix River under the regulations
of the Wild and Scenic Rivers Act in the same manner as other
replacement bridges have been located within the Wild and Scenic
Riverways; and,
WHEREAS, the City of Oak Park Heights is opposed to any
attempts to circumvent the established principles and protections
contained within the Lower St. Croix Valley River Act of the 92nd
Congress Public Law No. 92 -560 and further opposes legislation in
congress in a further attempt to circumvent existing Federal Court
litigation which is now present within the District of Minnesota -
Federal Courts as filed by the Sierra Club against the Minn. Dept.
of Transportation and others.
NOW, THEREFORE, BE IS RESOLVED, BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City of Oak Park Heights hereby affirms its
support of the protection of the Lower St. Croix River under the
• Wild and Scenic Rivers Act as adopted by the 92nd Congress Public
Law No. 92 -560.
2. That the City of Oak Park Heights is opposed to attempts
to adopt legislation within congress to create a special exemption
for bridge projects, and specifically those proposed by the Minn.
Dept. of Transportation as the same violate the Wild and Scenic
Rivers Act as it now exists.
3. That the City of Oak Park Heights does hereby authorize
preparation of documents and /or exhibits, not to exceed $2,000.00,
to be distributed to the members of Congress of the United States
and the general public in a manner to be prescribed by the City
Council.
4. That the City Council for the City of Oak Park Heights
does hereby retain the law firm of O'Connor and Hannon to represent
the City of Oak Park Heights in providing services on these issues
before Congress with such retention and services to be determined
and provided for within a separate Retainer Agreement to be entered
into between the City of Oak Park Heights and said law firm.

WHEREAS, there is adjacent to the City of Oak Park Heights a
• tract of land containing approximately 240 acres, of which more
than 20% of the owners have petitioned the City of Oak Park Heights
for annexation of said property to the City of Oak Park Heights;
WHEREAS, the boundaries of said territory proposed for
annexation are described as:
All that part of Section 6, Township 29 North, Range 20
West lying westerly of the centerline of Stillwater Blvd.
also known as State Highway 5, Washington County;
WHEREAS, the names of all parties entitled to notice under
section 414.09 are included in Exhibit "A" hereto attached;
WHEREAS, the City of Oak Park Heights and petitioning property
owners recognize that the area continues to develop as an urban
industrial /commercial area with the potential for commercial and
• WHEREAS, it appears that Baytown Township is not interested in
negotiating an orderly annexation of the subject property to
address the interests of affected property owners of the Township
and the City.
NOW THEREFORE, IT IS RESOLVED, by the City Council of the City
of Oak Park Heights that the boundaries of the City of Oak Park
Heights, State of Minnesota, be extended so as to include and
incorporate within the city limits of the City of Oak Park Heights
the above described property, the same being a logical extension of
the City of Oak Park Heights for the purposes of land use control,
planning, providing municipal services, and assuring orderly
development.

NOW THEREFORE, IT IS FURTHER RESOLVED, that the City of Oak
Park Heights hereby supports the petition of property owners
seeking annexation of the affected lands as described above to the
City of Oak Park Heights.

RESOLUTION AUTHORIZING THE OAK PARK HEIGHTS
POLICE DEPARTMENT TO MAKE APPLICATION IN CONJUNCTION
WITH THE FOREST LAKE POLICE DEPARTMENT TO THE
MINNESOTA DEPARTMENT OF PUBLIC SAFETY OFFICE OF
TRAFFIC SAFETY FOR ENROLLMENT WITHIN THE SAFE AND
SOBER COMMUNITY PROJECT FOR THE PERIOD OF TIME
OF OCTOBER 1, 1997 THROUGH SEPTEMBER 30, 1998
WHEREAS, Safe and Sober is a National Traffic Safety Campaign designed by the
National Highway Traffic Safety Administration seeking to unite national, state and local efforts
to reduce impaired driving crashes and increase safety belt and child seat use with enhanced and
enforcement efforts in public information and educational activities; and
WHEREAS, the Chief of Police for the City of Oak Park Heights has recommended to
• the City Council that the City of Oak Park Heights coordinate and enter into a Grant application
with the Washington County Sheriffs Department, the Stillwater Police Department and the
Forest Lake Police Department to be submitted to the Minnesota Department of Public Safety,
Office of Traffic Safety for Grand funds, which would enable the City of Oak Park Heights and
the City of Forest Lake to enter the Safe and Sober Community's Project for the period of time
of October 1, 1997 through September 20, 1998; and
WHEREAS, the Office of Traffic Safety where the Minnesota Department of Public
Safety currently has funds available to establish safe and sober programs within local
communities, which funds are issued on a competitive Grant basis; and
WHEREAS, the implementation of the Safe and Sober Program within the Oak Park
Heights community could have a significant effect on public safety by increasing public
awareness of the risks associated with highway travel and educating the public as to what can be
done to manage those risks by use of seat belts and sober driving and to publicly communicate to
the community a special enforcement efforts that are about to be implemented within the
community effecting the safe and sober program and also providing a report back to the

WHEREAS, the City Council for the City of Oak Park Heights feels that the best interest
and public safety of its citizens could be furthered by applying for the Grant Application in
conjunction with the Washington County Sheriffs Department, the Stillwater Police Department
. and the Forest Lake Police Department.
• NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the Oak Park Heights Police Department enter into a Grant Agreement with the
Minnesota Department of Public Safety, Office of Traffic Safety for the project entitled " Safe
and Sober Communities" during the period of time from October 1, 1997 through September 20,
1998.
BE IT FURTHER RESOLVED, that Chief of Police, Lindy Swanson of the Oak Park
Heights Police Department is hereby authorized and directed to execute such agreements as may
be necessary to implement the project on behalf of the City of Oak Park Heights Police
Department.
BE IT FURTHER RESOLVED, that the Chief of Police, Dave Schwartz of the Forest
Lake Police Department is hereby authorized to be the fiscal agent and administer this grant on
behalf of the City of Oak Park Heights Police Department.

improbable that there will ever be a public need for any part of
said right -of -way for street purposes; and,
WHEREAS, the public interest is served by placing the same
back on the tax rolls to enhance a taxable value of abutting lands
thereon and affected thereby.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the

WHEREAS, the On -Sale Liquor License was issued in conjunction
with Resolution 1996- 11 -39, a true and correct copy of which is

Tara Supper Club, Inc. was issued on an application of Ryszard
Biernacki dated January 3, 1996, in which Mr. Biernacki identified

WHEREAS, Ryszard Biernacki at all times relevant to these
proceedings remains as the sole owner and shareholder of Club Tara
Supper Club, Inc.; and,
WHEREAS, City of Oak Park Heights Ordinance No. 1202.06E
defines eligibility to hold a liquor license requiring compliance
with State law; and,
WHEREAS, City Ordinance 1202.09B requires owners of premises
to be responsible for the conduct of his or her place of business
and the conditions of sobriety and the order of the premises; and,
WHEREAS, Minnesota Statute §340A.402(3) prohibits the issuance
of liquor licenses to persons "not of good moral character and
repute;" and,
WHEREAS, Ryszard Biernacki was duly charged by a Formal
Complaint on April 23, 1996, with four (4) counts of violations of
Minnesota law as follows:

counts for the selling, bartering, furnishing or giving of alcohol
to persons under the age of twenty -one (21) years, and permitting
a person under the age of twenty -one (21) years to drink alcoholic
beverages on the licensed premises of Club Tara Supper Club, Inc.,
and the said matter is currently pending trial; and,

WHEREAS, the City of Oak Park Heights did issue its Order to
• Show Cause requiring and allowing Ryszard Biernacki and Club Tara
Supper Club, Inc. to make appearance before the City Council at
7:00 p.m. on June 10, 1997, to show cause, if any they have, why
the liquor licenses issued to the Club Tara Supper Club, Inc. by
the City of Oak Park Heights should not be suspended or revoked as
a result of the criminal convictions and the findings of the jury
in Washington County District Court referenced above, and further
to show cause and respond as to whether or not owner Ryszard
Biernacki is a disqualified individual ineligible to hold a license
for on -sale and off -sale liquor within the City of Oak Park Heights
for non - compliance with the Ordinances of the City of Oak Park
Heights and the provisions of Minnesota Statutes §340A.01, et seq.;
and,
WHEREAS, the City Council for the City of Oak Park Heights,
having heard the testimony and statements of Mr. Biernacki through
his representatives, and after having received the public comment
thereon and afforded him ample opportunity to provide a statement
or explanation as to his conduct on the business premises which is
licensed by the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. The City Council does determine that there has been an
• infraction and violation of the provisions of the City Ordinance
and the State Statute in such case made and provided in that the
behavior that was participated in and /or allowed to be conducted on
the premises of Club Tara Supper Club, Inc. by the person of
Ryszard Biernacki demonstrates behavior of a person not of good
moral character and repute, thus rendering Ryszard Biernacki as the
sole owner and shareholder of Club Tara Supper Club, Inc. to be
ineligible to hold a retail license for the sale and distribution
of liquor within the City of Oak Park Heights.
2. That the City Council determines that it takes no action
at this time with regard to the provisions of alleged infraction as
reflected within Washington County District Court File No. K4 -96-
2103 as that matter is pending affecting the issue of whether or
not Ryszard Biernacki and Club Tara Supper Club, Inc. allowed or
provided liquor and /or alcoholic beverages to person or persons
under the age of twenty -one (21) years, and the Council reserves
the right for further action by the Council to determine status of
license eligibility or suspension thereof following the completion
of that proceeding before the District Court.
3. That it is the determination of the City Council for the
City of Oak Park Heights that liquor licenses now in force and
issued to Club Tara Supper Club, Inc. and its owner, Ryszard
Biernacki, be and the same are hereby ordered:

already granted concept in general of plan approval for the
development plan proposed by Oppidan Investment Company as it
affects Lot 1, Block 1, Brackey West Addition; and,
WHEREAS, Oppidan Investment Company has submitted a general
plan of development pursuant to the Ordinance; and,
WHEREAS, the City Council has conducted appropriate Public
Hearings as required by Ordinance and statute in such case made and
provided and is prepared to determine final plat approval subject
to staff recommendations and compliance conditions to be imposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE

WHEREAS, the City Council for the City of Oak Park Heights has
already granted concept approval to the development plan proposed
by Oppidan Investment Company as it affects Lot 1, Block 1, Brackey
West Addition; and,
WHEREAS, Oppidan Investment Company has submitted a general
plan of development pursuant to the Ordinance; and,
WHEREAS, the Planner has submitted his report dated April 4,
1997 recommending approval of same; and,
WHEREAS, the City Council having conducted a Public Hearing
thereon and having received the benefit of public comment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE

RESOLUTION APPROVING THE DECERTIFICATION OF HOUSING
TAX INCREMENT FINANCING DISTRICT NO. 1
OF THE CITY OF OAK PARK HEIGHTS
WHEREAS, on June 10, 1996 the City of Oak Park Heights (the
"City ") created its Housing Tax Increment Financing District No.
1 (the "District ") within its Development District No. 1 (the
"Project ") ; and
WHEREAS, the proposed housing project to be constructed
within the District will not proceed; and
WHEREAS, since the creation of the District, the City
Council has rezoned the land therein so that housing is no longer
an allowable use; and
WHEREAS, the City desires by this resolution to cause the
decertification of the District after which all property taxes
generated within the District will be distributed in the same
manner as all other property taxes.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of Oak Park Heights that the City's staff shall take such
action as is necessary to cause the County Auditor of Washington
County to decertify the District as a tax increment district and
to no longer remit tax increment from the Distri4ttothe City.

A RESOLUTION APPROVING COMPREHENSIVE PLAN
AMENDMENT FOR DISTRICT 15 OF
THE CITY OF OAK PARK HEIGHTS
WHEREAS, the City of Oak Park Heights has previously adopted
a comprehensive plan as provided by statute and, pursuant thereto,
has divided the City into several districts for purposes of future
planning; and,
WHEREAS, it is appropriate for the City of Oak Park Heights to
amend its comprehensive plan to note the adjustment in the various
aspects of the comprehensive land use plan for District 15; and,
WHEREAS, the City of Oak Park Heights has received the report
from Northwest Associated Consultants suggesting amendments to the
comprehensive plan as it affects Planning District 15, which
planning report has been received at public hearing and the City
Council having reviewed public comment and the report and in
furtherance of the interests of the citizens of the City of Oak
Park Heights;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City of Oak Park Heights does hereby amend its
comprehensive plan and approve the comprehensive plan amendment as
prepared by the office of Northwest Associated Consultants, the
City's professional planner, as the same is annexed hereto as
Exhibit " A " and the same being incorporated by reference herein.
2. That the City Administrator shall forward a true and
correct copy of the comprehensive plan amendment to the
Metropolitan Council.

INTRODUCTION
The City of Oak Park Heights is proposing an amendment to its current Comprehensive
Plan for the purpose of amending the proposed land use plan for property located south
of 60th Street, east of Oakgreen Avenue and north of future 58th Street (See maps on
pages 3 -4). The subject area is 53.80 acres in size and includes the following uses:
existing commercial development along 60th Street ranging from U -Haul rental to a multi -
tenant office complex, a multiple family development on 60th Street, six single family
residential homes on Oakgreen Avenue, and a legal non - conforming salvage yard.
The land on which the salvage yard exists, is zoned 0, Open Space Conservation and is
designated for mid /high density residential use within the Comprehensive Plan. The single
family homes are located within Baytown Township, however, shall be designated for
future annexation into the City of Oak Park Heights. This amendment proposes changes
in the land use designation of this area from mid /high density residential to
business /warehousing. The commercial land is zoned B -2 General Business, however a
portion of the B -2 District is designated within the Comprehensive Plan for mid /high density
residential use. This amendment proposes a land use change in this area to highway
commercial to coincide with the existing land uses. The land on which the multiple family
residential development exists will remain the same.

The purpose of the requested land use amendment is to provide Oak Park Heights with
land available for business /warehousing. Currently the City has no vacant land available
for these types of uses.
This report is divided into five sections, the first four sections include the impact of the
proposed land use amendment on the City's housing opportunities, land absorption,
transportation system and sewer flow allocations. The final section is an amendment to
Planning District 15, in which the subject land is located. This Section may be inserted
within the proposed Oak Park Heights Comprehensive Plan and it includes a description
of the entire Planning District.

Livable Communities Act
In 1996, the City of Oak Park Heights elected to participate in the Metropolitan Livable
Communities Program which encourages the development and maintenance of affordable
and life -cycle housing in the Twin Cities. The Metropolitan Livable Communities Act
requires participating communities to negotiate goals for affordable and life -cycle housing
based upon current indexes and regional benchmark goals.
The City of Oak Park Heights has established future housing goals for affordable and life -
cycle housing through negotiations with the Metropolitan Council. The City's current
Metropolitan Council indexes, regional benchmarks and negotiated housing goals are
provided below for reference:

METROPOLITAN COUNCIL
As illustrated by the above table, Oak Park Heights' indexes are currently within or exceed
all of the Metropolitan Council's regional benchmarks for affordable and life -cycle housing.
Currently 90% of the City's owner - occupied housing is considered affordable, and 55% of
its rental housing is considered affordable. The City's future housing goals are to
maintain the current benchmarks for affordable and life -cycle housing.
The City's indexes for the measures of life -cycle housing are also illustrated above.
Currently 50% of the City's life -cycle housing is non - single family detached housing. The

benchmark for this type of housing is 29 -36 %. In terms of owner /renter life -cycle housing,
56% of the life -cycle housing stock is owner occupied, which is below the benchmark.
Conversely, 44% of the City's life -cycle housing is renter occupied, which exceeds the
benchmark of 23 -32 %. These figures are explained by the large number of multiple family
structures within the City.
The City should work, as market factors and resources allow, to improve the ratio of owner
occupied versus renter occupied life -cycle housing in the City. The best means of
accomplishing this goal is to promote increased availability of single family detached,
medium density townhouse units, and condominiums. The City is currently in the process
of amending its Comprehensive Plan. The amendment will suggest annexation of portions
of Baytown Township. Designated land uses in these areas will include single family and
medium density, therefore, the proposed land use amendment will not negatively impact
on the accomplishment of this goal with new areas to be annexed.
In regard to housing densities, the City of Oak Park Heights is within or exceeds the
Metropolitan Council's regional benchmark. The density of single family homes in the
community is currently 2.3 units per acre, which is within the benchmark range established
by the Metropolitan Council. The density of multiple family housing is 15 units per acre,
while the established benchmark is 13 -14 units per acre.
Based upon household projections developed by the Metropolitan Council for the year
2010, the City will need to maintain its existing renter and owner occupied housing supply
and as a goal, will work to provide an additional 150 owner- occupied housing units which
are considered affordable, in order to maintain the established housing goals.

Therefore, as demonstrated above, and in the City's Livable Communities Action Plan
(approved by the Metropolitan Council), the elimination of 10.83 acres of available high
density residential development, will positively affect the negotiated LCA goals.

HOUSING
• Housing Goals and Policies
The City of Oak Park Heights is in the process of updating its Comprehensive Plan,
therefore, specific housing goals and policies shall be revised and updated. The housing
goals and policies listed below, are from the existing Comprehensive Plan, adopted in
December of 1979, and additional goals and policies that will be incorporated within the
Comprehensive Plan update. These goals and policies shall be used as a guide by City
decision makers to identify the needs to evaluate housing related applications.
Goals:
• Maintain the current City of Oak Park Heights benchmarks for affordable life cycle
housing.
• Provide sufficient housing and sufficient housing sizes, types and styles to meet the
needs of all segments of the population, notedly groups with specialized housing
needs, such as the elderly.
• Provide housing in cost ranges affordable to low and moderate income households
(as regionally defined).
• Provide safe, healthy and attractive residential environment which offer a broad and
full choice of housing types.
Policies:
1. Maintain the existing renter and owner occupied housing supply, except for the
units to be purchased and removed by the Minnesota Department of Transportation
for the St. Croix Bridge.
2. Promote the development of an additional 150 owner occupied affordable housing
units by the year 2010 to maintain the established housing goals.
3. Allow, on a case by case basis, the addition of affordable rental units within the
City.
4. Ensure that all new housing, including rental housing and housing for persons of
low and moderate income, adheres to the highest possible standards of planning,
design and construction.
5. Concentrate higher density, apartment -type housing in proximity to areas which
offer a wide range of existing supportive service, commercial and recreational

6. Plan and develop residential neighborhoods according to determined
planning /development district boundaries.
7. Protect residential neighborhoods from penetration by through traffic.
8. Provide for access to major streets on the periphery of residential neighborhoods.
9. Provide high density development with reasonable, but not necessarily direct,
access to major thoroughfares.
10. Preserve and maintain the existing density character of residential neighborhoods.
11. Achieve and maintain a high quality residential environment through rehabilitation
or where necessary, redevelopment, of substandard units. Undertake such actions
through private means or if necessary, public action.
12. Protect low density residential neighborhoods from encroachment or intrusion of
incompatible higher use types and by adequate buffering and separation from other
residential as well as non - residential use categories.
13. Provide sufficient housing options to meet the needs of all segments of the
population, including the elderly and those of low and moderate income.
14. Encourage and promote adequate living space and fully utilized housing through
the provision of a range of choice among housing types and options.
15. Existing undeveloped single family residential lands shall be developed in a manner
responsive to determined needs and compatible with surrounding development.
16. Ensure that all new housing, including housing affordable to low and moderate
income families and individuals, adheres to the highest community design, planning
and construction standards.
17. Encourage design and planning innovations in both housing units and land
development.
18. Encourage innovation in subdivision design and housing development through the
use of devices such as the cluster and planned unit development concepts.
19. Encourage the development of patio homes, townhouses, quadraminiums and
condominiums to supplement conventional single family homes and apartments,
giving due consideration to local market demands.

20. From a cost per unit perspective, planned unit development shall be promoted in
order to: (a) reduce unit land costs, (b) lessen the amount of new dedicated streets
(thereby reducing on -going repair and snow removal costs), (c) lower utility costs
(through reduced footage and hence lower maintenance costs), and (d) reduce
additional run -off resulting from development.
21. From a revenue per unit perspective, planned unit development shall be promoted
based upon the higher revenue contribution to the City in comparison with
conventional comparable density subdivision.
22. Density incentives shall be offered for the development of mid - density owner -type
units, such as townhouses, quadraminiums, patio homes and cluster housing.
23. Mid - density development shall be encouraged on a planned unit basis and shall
specifically include provisions for traffic circulation that would mitigate any adverse
affects on existing single family residential neighborhoods.
24. Prohibit residential development on wetlands, floodplains and other natural features
that perform important protection functions in their natural state.
25. Locate multiple family housing in areas not inferior to those generally used for
conventional single family housing.

Due to the City's proximity to State Highway 36, Oak Park Heights over the past few years
has received several inquiries for development of light industrial uses or
business /warehousing. Unfortunately, the City of Oak Park Heights, does not have any
vacant land available for these types of uses, and as a result has not had any new
industrial development since 1990 (see building permit data below). This section shall
demonstrate the City's shortage of vacant land available for anticipated development over
the next 25 years.
Recent Development within the City
Commercial development had been limited as there was no large parcels available for
development before utility service was provided to the 1991 Stillwater Area High School
annexation area. This trend has reversed as the annexation area included land that is
available for commercial development along Highway 36 (the annexation area did not
include land available for industrial development).
New single family residential development has remained steady over the past eight years
as demonstrated below. This is due in part to the infill development and the additional
land available within the annexation area for single family residential development. This
trend is anticipated to continue as vacant land remains available. As demonstrated below,
the City has seen a total of 33 multiple family residential housing units constructed in the
. last eight years.

The land absorption rates (the conversion of rural /vacant land to an urban use) for multiple
family residential, commercial and public uses are found below. Single family residential
absorption rates are not calculated as they are not effected by the proposed amendment.
Additionally, because of the lack of industrial development over the past eight years (only
two new construction starts), industrial absorption rates are not calculated, as past
development trends would not provide an accurate estimate for future development.
It should be noted that these projections may be influenced by trends beyond the City's
control, such as regional growth trends and mortgage rates. In consideration of this, the
projections contain an inherent degree of uncertainty. The following projections are based
upon the building permit data on the previous page. These projections reflect current
development trends and current land use policies in the City.

Based upon the above, it is projected that the City can anticipate a multiple family
residential land absorption of 107 acres by the year 2020. These projections include land
necessary for public buildings/facilities, streets, and parks. This calculation is based upon
the amount of land necessary to accommodate and provide services for the projected
growth (30 percent).
While the City does have available vacant land for development of multiple family
residential uses, it does not have the necessary 107 acres, as anticipated for growth
through the year 2020. However, Oak Park Heights is anticipating an expansion of its
boundaries within the next 25 years into Baytown Township. This expansion will include
provision for multiple family residential development, which will accommodate the
anticipated growth.
The City of Oak Park Heights is currently in the process of updating its Comprhehensive
Plan, a portion of the update will include the potential of annexation of Baytown Township.

The commercial land demand has been increased, based upon the large lot commercial
development (a large grocery store and a Menards) that is expected to occur within the
next few years. Therefore, based upon the building permit data and the expected large
lot development that will occur, it is anticipated that 285 acres of land is to be absorbed
by commercial development by the year 2020. While there is a large supply of commercial
land that is vacant at the current time, there is not 285 acres of land that is designated for
commercial uses. In total the City of Oak Park Heights has 296.7 acres of vacant land,
therefore, the 285 necessary for commercial development and 107 necessary for multiple
family in addition to the land necessary for anticipated single family residential and
industrial cannot be accommodated by the 296.7 acres of current vacant land within the
City.

TRANSPORTATION
Road and Highway Network
The subject area is served
J by Highway 36, the Highway 36 frontage road (60th Street),
Oakgreen Avenue, State Highway 5 and 58th Street. Access is available off of Oakgreen
Avenue, 60th Street and future 58th Street. Development of this site will generate the
need for the construction of the connection of 58th Street (a collector street) with Oakgreen
Avenue. These roads are defined by the Metropolitan Council's functional classification
of roadways as follows:
► Highway 36 - Principal Arterial
► Highway 5 - Minor Arterial
► Oakgreen Avenue - Major Collector
► 58th Street - Minor Collector
► 60th Street - Local Roadway
The purpose of this section is to determine the impact on the proposed land use
amendment on the existing and future roadways in the area.

Based upon the above trip generation rates developed by the Institute of Transportation
Engineers, the land uses at full development, under the proposed land use amendment
will generate less trips than would the full development under the existing land use plan.
As shown above, the land uses under the current plan potentially will generate 17,152 trips
. per day, while the land uses under the proposed amendment will generate 8,747 trips per
day. Therefore, the proposed amendment will lessen the impact on the local and regional
transportation system.
Traffic Volumes
The growth of population within the City of Oak Park Heights and Stillwater in recent years
has been accompanied by a slight increase in traffic volumes carried by the streets and
highways. The map on the following page shows a comparison of average traffic volumes
on Highway 36, Highway 5 and Oakgreen Avenue for the years 1990 and 1994. In general
the traffic volumes have remained steady on the adjacent roadways. Highway 5 and
Highway 36 east of Oakgreen have experienced increased traffic volumes, while Oakgreen
Avenue and the intersection of Highway 36 and Norell Avenue show a decrease in traffic
volume. Overall there has been a.7 percent decrease in traffic on the adjacent roadways.

• Improvement Plans
Improvements for Highway 36 and the St. Croix River bridge were . programmed by the
Minnesota Department of Transportation to begin construction in 1997. Highway 36 is to
be reconstructed through Oak Park Heights (to a limited access highway) with intersection
improvements at Norell, Oakgreen, Osgood, and Highway 95. Highway 36 will be lowered
at Osgood Avenue to accommodate the new bridge. Highway 36 will continue east across
the St. Croix River and touch down on the Wisconsin side. However, recent events
involving the construction of the bridge over the St. Croix River may delay the timing of this
construction project.

SEWER FLOW ALLOCATIONS
• Within the proposed land use amendment area it must be determined if the change in the
land uses can be handled within the existing system and sewer flows projected for the City
by the Metropolitan Waste and Control Commission.
Total sewage flow rates within the amendment area have been determined for the uses
under the current land use plan and the proposed land use plan. The two rates are
compared to determined the effect of the proposed land use amendment on the system.

• Capacity of the System
In 1991, when the land surrounding the Stillwater Area High School was annexed into the
City of Oak Park Heights, the land west of Oakgreen Avenue was estimated to contribute
sewage flows shown in the following tabulation at saturation development:

The wastewater flows from the land west of Oakgreen Avenue, south of Highway 36 are
to be conveyed through an existing trunk sewer located along the south side of Highway
36. The trunk sewer was designed to accept the flow from the Oak Park Heights area east
of Oakgreen Avenue plus an average daily flow of 1.035 MGD. As shown, this area only
utilizes one -third of the available capacity.

• District 15, annexed in July of 1988, is located immediately west of District 5. It is
bordered by Highway 36 on the north, Oakgreen Avenue and the City limits on the east,
the center line of Section 5 on the south and a line extending south approximately from the
McCormack Furniture property on the west.
Existing land uses within the District consist of several commercial uses, single family
residential, medium density residential and an auto salvage yard. Other land uses consist
of an NSP easement with overhead power lines that run east -west through the District with
the remainder of the District being vacant.
The intended land uses for the District include highway commercial along the Highway 36
frontage road, a small mid /high density residential area just west of Oakgreen Avenue,
business /warehousing immediately to the south of the highway commercial area, and
single family residential south of 58th Street. These uses are illustrated in the Planning
District 15 Conceptual Land Use Plan on the preceding page.
The auto salvage yard shall be encouraged for redevelopment as it exists as a non-
conforming and incompatible land use. The property on which it is located is intended for
business /warehousing. Such redevelopment will allow the property to be utilized at a
higher and more efficient level of use. The single family residential homes, which are
located within Baytown Township, are also designated as future business /warehousing.
At the time the property comprising Planning District 15 was annexed, the owners of these
properties along Oakgreen chose not to be included. It is recognized that eventually these
properties will be brought into the City's corporate boundaries to provide them with
municipal service.
A community park facility is also to be located within the District. The proposed site is
located in the southwest corner of the District and was determined through a report
identifying potential park site areas for this part of the City. The park will encompass some
environmentally sensitive land consisting of wetlands and a mature tree stand. The park
will include both active and passive activity areas.
The zoning that is to correspond to these land uses will consist of existing districts within
the current City Zoning Ordinance. While the specific zoning may vary per individual land
use, i.e., single family residential may be zoned "R -1 ", or "R -2, the recommended zoning
per designated land use is illustrated below:

• Due to the size and intended uses within the District, development of a traffic circulation
network must be carefully planned and include collector streets to route traffic onto
Oakgreen Avenue and the Highway 36 frontage road. The collector streets must also
provide access to future areas of annexation to the west and to the south.
Collector streets in Planning District 15 include 58th Street which connects Oakgreen
Avenue with County Road 5, and Norell Avenue which connects Highway 36 and 58th
Street. Currently 58th Street has been constructed from Highway 5 to Norell Avenue. The
final connection of 58th Street, from Norell to Oakgreen Avenue, shall occur in conjunction
with development of the area.
As a means of facilitating pedestrian circulation, the City has proposed an overland trail
west of Oakgreen to 58th Street, a grade separated trail along future 58th Street to the
Park Search Area, an on- street trail along Highway 36, a grade separated trail along Norell
Avenue, and overland trails within the Park Search Area.

A RESOLUTION APPROVING COMPREHENSIVE PLAN
AMENDMENT FOR DISTRICT 13 OF
THE CITY OF OAK PARK HEIGHTS
WHEREAS, the City of Oak Park Heights has previously adopted
a comprehensive plan as provided by statute and, pursuant thereto,
has divided the City into several districts for purposes of future
planning; and,
WHEREAS, the City of Oak Park Heights has recently approved a
rezoning within District 13 resulting from the decision of the
Minnesota Department of Transportation to alter Trunk Highway 36,
impacting the Allan S. King Ash Disposal Facility; and,
WHEREAS, after having conducted full public hearings on
rezoning and conditional use permit issues affecting the ash
disposal facility and issues of rezoning, all as provided for under
• the ordinances of the City of Oak Park Heights, the City Council
has previously approved the proposal for rezoning and conditional
use permit as otherwise applied for by Northern States Power; and,
WHEREAS, it is appropriate for the City of Oak Park Heights to
amend its comprehensive plan to note the adjustment in the various
aspects of the comprehensive land use plan for District 13
involving the project; and,.
WHEREAS, the City of Oak Park Heights has received the report
from Northwest Associated Consultants suggesting amendments to the
comprehensive plan as it affects Planning District 13, which
planning report has been received at public hearing and the City
Council having reviewed public comment and the report and in
furtherance of the interests of the citizens of the City of Oak
Park Heights;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the City of Oak Park Heights does hereby amend its
comprehensive plan and approve the comprehensive plan amendment as
prepared by the office of Northwest Associated Consultants, the
City's professional planner, as the same is annexed hereto as
Exhibit " A " and the same being incorporated by reference herein.

2. That the City Administrator shall forward a true and
correct copy of the comprehensive plan amendment to the
Metropolitan Council.

INTRODUCTION
The City of Oak Park Heights is proposing an amendment to its Comprehensive Plan for
the purpose of amending the City's land use plan for property located north and south of
59th Street and east of Beach Road (See map on page 2). The subject area is 2.2 acres
in size, 1.9 acres of which has been utilized as part of the A.S. King Ash Disposal Facility.
The property north of 59th Street (1.9 acres), is owned by Northern States Power
Company (NSP) and is utilized as an entrance /exit for the A.S. King Ash Disposal Facility
(operated by NSP). This site is largely vacant and contains a small utility shed used by
NSP. The property is also utilized as a soccer field and parking area for Cover Park. The
land south of 59th Street (.3 acres) was recently purchased by NSP and had a small single
family home which has been removed. The 1.9 acres located north of 59th Street is
proposed to be part of the Highway 36 and 95 realignment, frontage road extension and
construction of the St. Croix Bridge.
This amendment proposes changes in the land use designation of the 2.2 acre area from
low to mid - density residential to industrial. The purpose of the requested land use
amendment is to provide for an expansion of the existing industrial area (A.S. King Ash
Disposal Facility). Much of the proposed expansion area is to be utilized for landscaping
and screening to provide for a buffer between the A.S. King Ash Disposal Facility and the
• single family residential uses to the south.
This report is divided into four sections, the first three sections include the impact of the
proposed land use amendment on the City's housing opportunities, transportation system
and sewer flow allocations. The final section is an amendment to Planning District 13, in
which the subject land is located. This Section may be inserted within the proposed Oak
Park Heights Comprehensive Plan and it includes a description of the entire Planning
District.

The proposed land use amendment eliminates 2.2 acres of land that is currently
designated for low /mid density residential development within the City's Comprehensive
Plan.
However, 1.9 acres of this land has been utilized for industrial uses as part of the A.S.
King Ash Disposal Facility, and will eventually be part of the construction area for the
MnDOT Highway 36 and 95 realignment. Therefore, the majority of this area will never be
utilized for any type of residential development, no matter what the proposed land use is.
The City is a participant in the Metropolitan Livable Communities Program which
encourages the development and maintenance of affordable and life -cycle housing in the
Twin Cities.
The City of Oak Park Heights has established future housing goals for affordable and life -
cycle housing through negotiations with the Metropolitan Council. The City's current
Metropolitan Council indexes, regional benchmarks and negotiated housing goals are
currently within or exceed all of the Metropolitan Council's regional benchmarks for
affordable and life -cycle housing.
The City is currently in the process of amending its Comprehensive Plan, a portion of that
amendment will include annexation of portions of Baytown Township. Designated land
uses in these areas will include single family and medium density, therefore, the potential
for additional residential housing within the City will be available.
Because of the pending roadway improvements and future annexation potential, the
proposed land use amendment to reduce the potential acreage for medium density
housing by 2.2 acres will not impact on the accomplishment of the City's established goals
for housing.

Road and Highway Network
The subject area is served by State Highway 36, Beach Road (County Road 23) and 59th
Street. Direct access is available off of both Beach Road and 59th Street. These roads
are defined by the Metropolitan Council's functional classification of roadways as follows:

located within the Highway 36 &95 improvement area. Improvements for Highway 36 &
95 and the St. Croix River bridge were programmed by the Minnesota Department of
Transportation to begin construction in 1997. Highway 36 is to be reconstructed through
Oak Park Heights (to a limited access highway) with intersection improvements at Norell,
Oakgreen, Osgood, and Highway 95. Highway 36 will continue east across the St. Croix
River and touch down on the Wisconsin side. Highway 95 and Stagecoach Trail are to be
realigned within Oak Park Heights, and an east -west frontage road is to be constructed to
connect Highway 95 and Stagecoach Trail with Osgood Avenue. The extension of the
frontage road to Highway 95 will create the most impact to the area affected by this
Comprehensive plan. As shown on the map on the following page, this roadway will run
through the 1.9 acres of land located north of 59th Street.
However, recent events involving the construction of the bridge over the St. Croix River

SEWER FLOW ALLOCATIONS
. Within the proposed land use amendment area it must be determined if the change in the
land uses can be handled within the existing system and sewer flows projected for the City
by the Metropolitan Waste and Control Commission.
Total sewage flow rates within the amendment area have been determined for the uses
under the current land use plan and the proposed land use plan. The two rates are
compared to determined the effect of the proposed land use amendment on the system.

No development is proposed on the site at this time, the land is to be utilized
as an ash disposal site. However, general industrial development would
generate the following flowage:
2.2 acres x 1,500 gal /acres /day = 3,300 gal /day
As demonstrated above, the total projected flow under the proposed land use plan is 2,200
gallons per day less than under the existing land use plan (assuming complete lot
occupancy under both development scenarios). It is unlikely that this property will ever be
developed with an industrial use that will generate sewer or water flow due to the fact that
this site is located within the future construction area for the Highway 36/95 improvements
and the St. Croix Bridge. Therefore, the proposed land use amendment will not have a
negative impact on the projected sewer flow in the area.

DISTRICT 13
District 13 is an older neighborhood consisting of single family homes, several industrial
type uses, a bar, and a small neighborhood park (Cover Park). Considerable land is
devoted to the street system and NSP easement. Significant topography variations are
also characteristic of the district.
The neighborhood is linked to the rest of the community by means of Beach Road across
Highway 36. Zoning within the district is as varied as the land use itself. The majority of
the neighborhood is zoned low and medium density residential, and there is a scattering
of land zoned Industrial, Residential Business Transitional, Open Space and General
Business.
Several significant problems have been identified as occurring in the neighborhood. Most
significant is the advanced state of deterioration evident in many of the district's single
family homes. However, as part of the Highway 36 & 95 improvement plan and
construction of the St. Croix Bridge, many of these homes have been purchased by the
Minnesota Department of Transportation for road right -of -way, and have been demolished.
It is estimated that 37 percent of this district is devoted to street right -of -way, and with the
potential for construction of the St. Croix Bridge, this percentage will increase. Many of
the district's streets are relatively steep and narrow.
This district has traffic and circulation problems due to the lack of a connection between
Stage Coach Trail and Highway 36. Stage Coach Trail carries nearly all of the area's
heavy truck traffic generated from NSP. As part of the MnDOT Highway 36 & 95
Realignment, a connection between Highway 95, Stagecoach Trail and Osgood Avenue
will be constructed.
Incompatible land uses, such as industrial uses located adjacent to single family
residential, have been sited as an issue within District 13. Landscaping and screening
must also be maintained in order to provide a continuing buffer between these land uses.
The expansion of the A.S. King Ash Disposal Facility required considerable screening and
landscaping along the southeastern property lines in order to provide a buffer between the
residential uses located south of site.
As a means of facilitating pedestrian circulation, the City has proposed an overland trail
in the location of existing Highway 95. This trail would be constructed following the
realignment of Highway 95, and continue to the north and south along Highway 95.
Additionally, on- street trails (paved shoulders) are proposed along realigned Highway 95,
realigned Stagecoach Trail, and the Highway 36 Frontage Road.

• Planning recommendations for the district call for a vigorous program of housing
rehabilitation and redevelopment. Creative design approaches and innovative street
system redesign would create a favorable opportunity to provide new housing. A mixture
of new single family homes as well as mid - density owner occupied clustering housing
would be desirable.

RESOLUTION AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR
TO ENTER INTO A CONTRACT WITH O'CONNOR AND HANNON, L.L.P.
ATTORNEYS AT LAW, TO PROVIDE PROFESSIONAL LOBBYIST
SERVICES FOR THE CITY OF OAK PARK HEIGHTS AS IT AFFECTS
THE ST. CROIX RIVER CROSSING AND RELATED ISSUES
WHEREAS, the City of Oak Park Heights has received a proposal
from the law firm of O'Connor and Hannon, L.L.P. to provide
professional services within Washington D. C. as it affects
representation of the City of Oak Park Heights on the issues
related to the proposed St. Croix River Bridge Crossing; and,
WHEREAS, the Departments of Transportation for both the
States of Wisconsin and Minnesota have engaged in lobbying services
to review the impact of the proposed construction of a new crossing
at Oak Park Heights over the St. Croix River, vis a vis the effect
of the Wild Scenic Rivers Act and the recent actions of the
Department of the Interior and the National Park Service
prohibiting the issuance of permits with regard thereto; and,
• WHEREAS, the City of Stillwater has engaged in professional
lobbyist services to represent its interest in Washington D. C.
with regard to proposed amendments to the Wild Scenic Rivers Act
and to otherwise potentially influence the Department of Interior
and the National Park Service to change its position on the
project; and,
WHEREAS, it is imperative that the interests of the residents
and businesses of the City of Oak Park Heights be represented
before the Department of the Interior, the National Park Service
and Congress with regard to attempts that may be made by other
agencies and departments on these issues.
NOW, THEREFORE, BE IS RESOLVED, BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
1. That the firm of O'Connor and Hannon, L.L.P., Suite 800,
706 South Second Ave, 700 Baker Building Minneapolis, MN 55402,
be and the same is hereby hired pursuant to a retainer agreement to
be executed by the Mayor and the City Administrator.
2. That the Mayor and the City Administrator are hereby
authorized and directed to direct the performance of that law firm
in the provisions of services on behalf of the City of Oak Park
Heights and shall keep in contact with said firm with regard to the
pursuit of the City's interests and activities as requested.
•
3. That the work of a law firm shall focus in the following
areas:
1. Within the State of Minnesota, (a) to secure
commitment of the existing priority of funding for
a bridge project across the St. Croix River so that
such funding need not be lost during this period of
time when the St. Croix River crossing is in
dispute; (b) to request and obtain commitments from
the Minnesota Legislature and to call for agency
participation in a mediation process as may be
desirable to resolve the dispute.
2. Within Washington, D.C., (a) to obtain from the
Department of Interior or other relevant agencies
of government, commitments to call for mediation to
resolve disputes relating to the site and location
of the proposed St. Croix River Crossing; (b) to
work to prevent special legislation from being
passed to exempt the St. Croix River bridge from
the Wild and Scenic Rivers Act.
4. The City of Oak Park Heights shall be authorized through
the Office of the City Administrator to issue a check to the law
firm of O'Connor and Hannon for $15,000.00 as and for a retainer
for the services with all such services to be performed as directed
by the Mayor and the City Administrator up to the point when the
retainer has been exhausted, then thereafter to cease until
additional funding is authorized by the City Council.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION DIRECTING INTERVENTION INTO THE
SIERRA CLUB V. PENA ACTION PENDING IN FEDERAL COURT
WHEREAS, the City of Oak Park Heights is aware of recent
action taken by the Department of the Interior and the National
Park Service with regard to the proposal to build a new St. Croix
River Bridge as advocated by the Minnesota Department of
Transportation; and,
WHEREAS, the City Council is aware of the action which is
pending within the United States District Court, District of
Minnesota being Case No. 4 -96 -547 entitled Sierra Club, Northstar
Chapter and Voyagers Regional National Park Association as
Plaintiff vs. Frederico Pena, Secretary of the United States,
Department of Transportation, et al Defendants; and,
WHEREAS, the City Council is aware that both Minnesota and
Wisconsin Departments of Transportation have intervened in that
action; and,
• WHEREAS, the City Council is aware of that action challenging
the determination and the decision of the Federal and State
Departments of Transportation to construct a new bridge across the
St. Croix River at Oak Park Heights; and,
WHEREAS, the City Council is aware that the City of Stillwater
has petitioned for permission to intervene within those
proceedings, claiming an interest on behalf of its citizens; and,
WHEREAS, the proposed river crossing would begin within the
City of Oak Park Heights and not the City of Stillwater; and,
WHEREAS, substantial land acquisitions, displacements of
residents and businesses has occurred predominantly within the City
of Oak Park Heights and it is the City of Oak Park Heights who has
been primarily burdened with this project from the standpoint of
its residents, businesses, environmental impact and tax base; and,
WHEREAS, the City Council for the City of Oak Park Heights
does not believe that there is any other municipality in the State
of Minnesota or Wisconsin that is more impacted by this project
than is the City of Oak Park Heights; and,
WHEREAS, if municipalities are to be allowed to intervene
within the Federal Court action and for the purposes of protecting
. the interests of their residents, it would be in the best interests
of the Citizens of Oak Park Heights for the City to intervene
within said action.
NOW, THEREFORE, BE IS RESOLVED, BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS AS FOLLOWS:
That the City Council herewith determines that should the City
of Stillwater be granted permission by the Federal District Court
to intervene on behalf of its Citizens within the District Court
action now pending as part of Court File No. 4 -96 -547 within the
United States District Court, District of Minnesota Fourth
Division, that it is appropriate that the City of Oak Park Heights
also seek intervention within said action as the City of Oak Park
Heights is the most impacted municipal community of this proposed
construction project inasmuch as the vast majority of the
construction project will occur within the City of Oak Park Heights
impacting its residents, business community, environment, traffic,
property tax values and related concerns.

TO PARTICIPATE IN MEDIATION CONDUCTED THROUGH THE FEDERAL
MEDIATION AND CONCILIATION SERVICE ON ISSUES AFFECTING
A PROPOSED ST. CROIX RIVER CROSSING AND INVITING ALL
FEDERAL, STATE AND LOCAL GOVERNMENT AGENCIES AND ALL
OTHER INTERESTED PARTIES TO JOIN IN THE MEDIATION PROCESS
TO ADDRESS RELATED ISSUES AND PURSUE A MEDIATED SOLUTION.
WHEREAS, communities in the St. Croix Valley, including the
City of Oak Park Heights have previously received proposals from
the Commissioner of Transportation from the State of Minnesota for
a corridor proposal and a new St. Croix River Bridge; and,
WHEREAS, the Departments of Transportation for the State of
Minnesota and Wisconsin in conjunction with the Federal Department
of Highways have proposed a new St. Croix River Crossing /Bridge to
be constructed across the St. Croix River linking the State of
Minnesota with the State of Wisconsin; and,
. WHEREAS, the National Park Service has raised objections with
regard to the proposals by the State Departments of Transportation
to construct such a new St. Croix River Crossing /Bridge; and,
WHEREAS, litigation has been commenced by the Sierra Club as
against the affected Departments of Transportation raising issues
with regard to regulatory and statutory compliance, environmental
impact and others; and,
WHEREAS, the issues presented by the respective Departments of
Transportation, National Park Service and a multitude of interested
agencies, political subdivisions, interested parties and others
need to be addressed in a form that will promote, compromise and
conciliation as opposed to conflict in litigation; and,
WHEREAS, the City of Oak Park Heights is convinced that the
interests of the taxpayers, the affected communities on both sides
of the St. Croix River, and the multitude of state and federal
agencies that are involved in the issues presented by the new St.
Croix River Crossing are best served by participation in the
mediation process conducted under the authority of the Federal
Mediation and Conciliation Service.
