No new applications have been received.Staff did meet with the owner of the mall where Carbone's is located to discuss a possible fagade project this fall.-rough concept sketch enclosed. 2. An enforcement letter has been mailed to Wayne Hellerman regarding the length of grass and weeds-see enclosed. 3. A letter has been provided to the State in regards to Tim Nolde's$16,000,000 bond issuance.See enclosed-the matter relates to a statement by the City that there is not a restriction of age 55 or older at the site-Phase V.Staff will be working on the development agreement language that will seek to embed tighter assurances of this development being compatible to senior use only and or harmoniously with the previous four phases. SCRCP&Bridge Ooenino: A few event updates: The Mayor has participated in a number of meeting and organized many items;Staff has ordered the Port a pot units for the ice cream social; ice cream has been ordered and deposit paid; Council Member Liljegren has secured the banner it is here at City hall;the newspaper advertisements have been processed, Public works will be placing no parking signage and garbage cans on Tuesday and the Police have also worked out a number of logistical issues. I suspect there will be a few more moving pieces,but as more is known I will certainly share. I suspect all are looking forward to this being concluded. The Mayor has also indicated that...As it relates to the specific ribbon cutting;there are planned to be three separate ribbon"cuttings" 1. Governors,Congressmen,Mayor of Oak Park Heights;Town Chair of St.Joseph 2. Mayors,Senators,Representatives,etc. 3. All city councils,town supervisors,county board. And that during the program,she will say"now we will have the ribbon cutting".-NOT calling names,but rather"can Group 3 come forward",which will be the OPH City Council. Presently the yard in violation of City Nuisance Ordinance 1109 as it relates to noxious weeds and grasses, and accumulations of debris. Additionally, there are two vehicles that have remained on site which need to comply with City Ordinance in that they be operable, registered with current tabs and be placed upon the parking area at the property. At my request,the City Arborist has visited the property,to verify the presence of weeds versus plant and has found that there is largely weeds with a few plants among them. The grass has largely remained long and unattended until recently when path areas were cut. > The weeds need to be fully removed from the yard and the yard mowed in full. All vegetation and earth that has been piled against the adjacent neighbors fencing is to be removed. Once done this needs to be maintained regularly. Since the removal of the house at the property there has been a tent regularly at the site and picnic visiting activity. The tent has not been kept in good condition and food and beverage items have not been cleaned up from the property. > The tent and all items to the yard, including coolers,food, beverage cans and other debris are to be collected from the property and removed. At no such time is transient residency in a tent permitted at the property and items used while visiting the site are to be cleaned up from the site prior to leaving the site at the time of visit. 7 of 31 City of Oak Park Heights 14168 Oak Park Blvd.N.—P.O. He did indicate that the vehicle belonging to the friend was not operable and was asked to contact the friend to remove it from the property. Storage upon the property is not permitted. Vehicles belonging to the property owner may be on site, as long as they are upon the driveway, operable and currently registered > Any vehicles that are not owned by the owner are to be removed. Vehicles owned by the property owner are to be operable and display current registration. This letter serves as the City's first written request to garner Code compliance to City Ordinances and demands that: (1) Weeds be removed from the yard; (2) The grass at the yard be fully mowed; (3) Vegetation and earth be removed from areas located against adjacent neighbor's fences; (4) All items in the yard (tent, food, coolers, lawn chairs, beverage containers, etc.) be collected and removed from the yard; (5) All vehicles not belonging to the property owner be removed from the property; and (6) All vehicles belonging to the property owner be properly placed upon the driveway, be in operable condition and display current registration. The Beach Road bridge will be closed to vehicle and pedestrian traffic at 9:30 a.m. on Aug. 2 until after the ceremony ends. No public parking will be available at the dedication site. Parking will be available at nearby locations in Minnesota and Wisconsin and shuttles will take guests to the location of the ceremony. Visit the St. Croix Crossing events page for more information. Please note that the project office will close after Friday,Aug. 4, and the project webcams will shut down on Sunday,Aug. 6. During chip sealing, an epoxy resin is poured and evenly spread. Small, aggregate gravel is then broadcast on top of it. The gravel sticks to the epoxy, creating a water-tight surface that is smooth and more durable. Looking forward to hearing backs -Rebecca 1 16 of 31 1 MAOSC July Federal Legislative Update CONGRESSIONAL SCHEDULE: During the months of June and July,the U.S. House spent much of its time discussing the annual budget and spending bills, despite the continued absence of a budget resolution. The U.S. Senate focused on negotiating their version of healthcare legislation designed to repeal large portions of the Affordable Care Act. The Senate Majority has released its latest in a series of healthcare legislation,which Majority Leader Mitch McConnell would like to have Members consider before the end of July. UNITED STATES SENATE: Affordable Care Act Repeal:Negotiations continue in the Senate over legislation designed to repeal and replace the Affordable Care Act(ACA). Over the past month, a number of revisions have been made to the legislation after it became apparent that a majority of Members opposed the legislation. These revisions have been unable, however,to garner a majority of support and so the bill's future remains unclear as leaders in the Senate continue to make changes to the legislation. The Senate leadership has also proposed voting on legislation that would only repeal the ACA without replacing it. This approach has also met resistance. Appropriations: The Senate Appropriations Committee approved funding allocations for its 12 subcommittees, setting up different levels of spending with the House over a number of allocations including defense,homeland security,transportation and the Department of Health and Human Services (HHS). While the House is using spending levels from its draft budget resolution,the Senate has decided to work from current-year levels in the hope of a bipartisan budget deal in the fall. The Senate allocations total $1.07 trillion in base discretionary funding and$103.7 billion in Overseas Contingency Operations funds,which do not count against the spending caps under the 2011 Budget Control Act(BCA). Senate appropriators allocated less for defense spending than the House but more for the Labor-HHS-Education and Transportation- Housing and Urban Development bills. The Senate Budget Committee used the same topline funding level as Fiscal Year 2017 (FY17)which is$62 billion less that the top number used by the House and $5 billion above the caps set in the 2011 BCA. UNITED STATES HOUSE: Budget: The House budget for Fiscal Year 2018 (FYI 8) cleared the Budget Committee on July 19, 2017. The budget,which calls for more than $200 billion in spending cuts,has been designated as the intended vehicle for moving tax reform legislation through Congress that would not require bipartisan support to pass. It may face tough opposition to passage on the floor of the House of Representatives as some Republicans have raised concerns. The proposal seeks to balance the budget. The resolution,which is largely a blueprint for future spending, assumes the House-passed Affordable Care Act repeal bill and its $800 billion in Medicaid cuts will become law. It also assumes that Congress will reshape Medicare by converting some of the program to a premium support model,where seniors are given a flat amount to pay for medical services.Altogether, the budget resolution looks to cut$1.5 trillion in Medicaid spending and 17 of 31 2 $487 billion in Medicare spending over the next 10 years. The budget also assumes billions of dollars in cuts to domestic spending,which would reduce the federal medical research investment. But because of the delay in finalizing the FYI funding, lawmakers only now have less than three months until FYI begins. Tax Reform: The House Budget Resolution is one step in the House Leadership's plans to overhaul the tax code this year.An instruction included in the budget resolution to use budget reconciliation to pass a tax bill means that legislation would be able to pass both chambers with only a simple majority. But it also constrains the bill, requiring that it be deficit-neutral and that its provisions relate directly to the budget. There is already a fair amount of disagreement, however, among the majority as two members of the conservative House Freedom Caucus announced their opposition to a border adjustment, a cornerstone of the House tax plan. The provision,which would tax imports and exempt exports, is one of the main ways House leaders hope to generate the revenue needed to make desired tax cuts. House Ways and Means Chairman Kevin Brady(R-TX)has acknowledged that changes need to be made to the proposal, but he continues to advocate for the idea. FAA Reauthorization: The House Transportation and Infrastructure Committee approved a bill, H.R. 2997,on June 27, 2017 to reauthorize the Federal Aviation Administration(FAA)by a vote of 32-25, and now the measure has been sent to the full House of Representatives for consideration. The bill has faced a series of delays, however, due to a controversial proposal to shift air traffic control (ATC) into a nongovernmental entity. In fact, House Transportation and Infrastructure Chairman Bill Shuster(R-PA)proposed a similar measure in the last Congress to rework ATC,but the legislation never received a floor vote in the House of Representatives. The legislation has remained controversial in this Congress. The House Appropriations Committee approved a spending bill for Fiscal Year 2018 on July 17,2017 by a vote of 31-20 that opposes the ATC privatization position taken by the House Transportation and Infrastructure Committee. WHITE HOUSE: Infrastructure Approval Process: On June 9, 2017, President Trump called for major changes to the infrastructure approval process,vowing to ease the wait time for federally funded projects. This announcement came as the President was speaking at the Department of Transportation (DOT),where he called on all federal agencies to streamline review processes and said his Administration may penalize agencies that consistently delay projects by missing deadlines. The President also announced the creation of a council to help infrastructure project managers navigate the bureaucracy, in part by creating an online dashboard for project tracking. Transportation Secretary Elaine Chao,as she introduced the President at the DOT, said her agency issued a notice in the Federal Register seeking suggestions to help her agency improve permitting. Prior to this speech,the President met with about a dozen heads of state transportation departments and U.S. DOT leaders for a discussion on how the federal government can shift responsibility for review processes to the states. Water Rule: Environmental Protection Agency(EPA)Administrator Scott Pruitt initiated the repeal of the previous Administration's water jurisdiction regulation by issuing a proposal that would reinstate the 1986 jurisdiction rule and related guidance that the EPA had in place on what 18 of 31 3 waters are subject to federal protections. The proposed repeal, once in final form,will be the first step the current Administration takes in a two-step process to undo the 2015 Clean Water Rule, also known as the Waters of the U.S. rule(WOTUS). The second step,which Administrator Pruitt has said will be completed as early as the end of the year,will involve a rewrite of the 2015 regulation. The significance of this first step is that it removes the 2015 water rule, ending all outstanding federal legal challenges against the regulation. In addition to Speaker Paul Ryan endorsing the newly released proposal, Chairman of the House Transportation and.Infrastructure Committee Bill Shuster(R-PA)and House Water Resources and Environment Subcommittee Chairman Garret Graves (R-LA)welcomed the announcement in a joint statement. Federal Debt Ceiling: The Congressional Budget Office (CBO) released a report on June 29, 2017 that indicates the Treasury Department will be able to continue borrowing under the current $19.809 trillion debt limit into October. This revised CBO report is more specific than their previous projections and in line with what private sector experts had been predicting. This gives lawmakers additional time to wrestle with the issue. Treasury Secretary Steven Mnuchin has been pushing lawmakers to deal with the debt ceiling before they leave for the five-week August break to avoid the potential for any last minute problems,but the extended timeline given by the CBO will likely diminish that effort. Metropolitan Council Approves MCES Follow us on TwRterl Rates and Charges The Metropolitan Council approved the Council's Environment Services(MCES) budget and 2018 Wastewater(MWC) rates at their meeting this week. The MCES budget will be $280.9 million for !� 2018. Revenue sources for the budget come from Municipal Wastewater Charges, the Sewer Availability Charge(SAC), and Industrial Waste Charges. Overall, the MCES wastewater charge is set to increase by 3.7 percent. Individual cities' rates will % vary depending on their share of the region's wastewater flow. SAC fees will be held flat, as they have been for the last several years. The Industrial Strength Charge will be increased by 6.8 percent and the industrial permit fee In CurrentlArchived will increase to 3.7 percent. Met Council Votes to Increase Transit Fares The Metropolitan Council on Wednesday approved an increase to transit fares. All transit fares for buses, light rail and commuter rail will increase 25 cents. Metro Mobility will see an increase of 50 cents. These increases together will generate$7.8 million in 2018. The fare increases will begin October 1 of this year. The Council also approved the creation of a Transit Assistance Pass(TAP), which will set fares at$1.00 for qualifying low-income riders. This program will cost an estimated $3.5 million in 2018. Council staff are now directed to update the Council on the new TAP program every six months. Metro Transit has not increased fares since 2008. The current farebox recovery ratio is 24 percent.A 25-cent increase will increase that ratio to 27 percent. Metro Transit has used a 30 percent fare box recovery ratio as its goal. Included in this fare increase action is a directive to Met Council staff to develop transit fare policy recommendation by the end of this year. This policy will inform the council on when and how future fare increases should be made. The Council also directed staff to develop a report to look at how travel distances could be considered as part of fare policy and identify opportunities to implement reverse commute fares.
