PLANNING COMMISSION
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY SEMPER DEVELOPMENT FOR A
CONDITIONAL USE PERMIT, VARIANCE AND SITE PLAN
FOR WALGREENS AT 6061 OSGOOD AVENUE NORTH
BE APPROVED WITH CONDITIONS
WHEREAS, the City of oak Park Heights has received a request for conditional
use permit (CUP), variance, and site plan review to allow the redevelopment of 6061 Osgood
Avenue North as a Walgreens; and after having conducted a public hearing relative thereto the
Planning Commission of oak Parr Heights makes the followin g findings ndin s of fact:
1. The real property affected by said application is legally described as
follows, to wit:

The applicant has submitted an application and supporting documentation to the
Community Development Department consisting of the followin g items:

and
2. The subject site is zoned B -2, General Business District in which retail
sales operations are a permitted use; and
3, The City staff prepared a memorandum dated May 3, 2001 reviewing the
requests; and said memorandum recommended that the application not be approved for the CUP,
site plan and variance until certain issues were resolved, additional information was received and
comments were received from the Middle St. Croix Watershed Districts on storm water issues
and the Minnesota Department of Transportation (MnDOT) and 'Washington County Department
of Transportation on access issues; and
4. The Planning Commission held a public hearing at their May 10, 2001
meeting, took comments from the applicant and the public, and continued the public hearing to
the June 14, 2001 meeting after requesting the applicant provide the information, as outlined in
the May 3, 2001 staff memorandum; and comments from MnDOT the Middle St. Croix
Watershed District, and the Washington County Department of Transportation regarding the
prof ect; and
5. The Planning Commission further continued the public hearing to the July
12, August 9, September 13, and October 11 meetings; and
6. The Minnesota Soil and Water Conservation Districts on behalf of the
Middle St. Croix Watershed District in a letter dated May 10, 2001 recommended the applicant
provide Water quality /quantity ponding on site or provide in -line storm facilities; and
7. The Washington County Department of Transportation in a letter dated
May 7, 2001 recommended specific changes to the site plan related to access and right -of -Way on
Osgood Avenue; and
8. Representatives of the Washington County Department of Transportation,
the Minnesota Department of Transportation, the applicant, and the City net on October 2, 2001
to discuss access issues; and
9. The applicant revised the plans to address the issues raised by the
Minnesota Soil and Water Conservation District, the Washington. County Department of
Transportation, the Minnesota Department of Transportation, City staff, and adjacent property
owners; and
10. The Planning Commission, at their October 11, 2001 meeting, took
comments from the applicant and public, closed the public hearing, and made the following
recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The conditional use permit, variance and site plan application submitted by Semper
Development for a Walgreens at 6061 Osgood Avenue North and affecting the real property as
follows:

Be and the same is hereby recommended to the City Council of the City of oak Park heights for
approval with conditions as follows:
1. An access permit from Washington County is required for the access onto Osgood
Avenue.

2. Access onto 60 "' Street is subject to the conditions imposed by MNDOT including the
applicant closing 60 Street west of the access to their property as shown on the
submitted plans.
3. The applicant must provide a trail easement along Osgood Avenue and install a five-foot-
wide sidewalk. The applicant should work with Washington County in that part of the
sidewalk may need to be within the right -of -way.
4. Access easements to the benefit of the subject property and the property directly to the
north shall be recorded against both properties.
5. Grading, drainage, and utility plans are subject to the approval of the city Engineer.
6. The proposed retaining wall must be designed by an engineer and is subject to review and
approval of the City Engineer.
7. The landscaping at the base of the retaining wall must be maintained by Walgreens.
S. The landscape plan must include the following revisions: vegetative screening on the
adjacent property to the north, a slight adjustment of landscaping along the west property
line to allow space for a sidewalk, planters at the building entrance, and two curbed and
landscaped islands in the south parking lot. The applicant is responsible for all proposed
landscaping. The landscape plan is subject to City Arborist review and approval.
9. The submitted tree replacement plan is subject to City Arborist review and approval.
10. A deed restriction must be put in place stating that a change in use of the property
requires City review and approval and the use must comply with the City parking
standards in place at the time the use changes.
11. Snow must either be stored within the green space of the site or be removed from the
property.
12. The lighting plan must be revised to comply with the City's foot- candle requirements.
The maximum height of the light fixtures and pole is 25 feet. The fixtures must be a
bronze, shoebox, full- cut -off style.
13. The electronic reader board is not allowed to have flashing or intermittent lights or
animation, and the message must not change more often than every six hours.
14. The proposed pylon sign must not exceed 20 feet in height, and the two proposed wall
signs must be reviewed for compliance with the City's sign regulations.
15. Details of the trash enclosures must be submitted. The enclosure materials must be
consistent with the principal building materials.

16. Project approval will become null and void after 18 months unless the propert owner or
applicant has substantiall started construction.
