Oak Park Heights Request for Council Action March 12, 2002 Walgreen s: Conditional Use Permit and Site Plan Review 5 Minutes New Business Planning Commission/Community Development A pproval with wiih Planning Commission Recommendations Please be advised that the Planning Commission conducted a re-opening of the public hearing for Walgreen's pharmacy at their meeting of 2/21/02. The Planning Commission voted to recommend approval of the Walgreen's proposal subject to the conditions outlined in the enclosed resolutions. Please note that the applicant withdrew their application for a variance at the Planning Commission meeting. The proposed building location has been revised so that this variance request is not necessary. WHEREAS, the City of Oak Park Heights has received a request from Semper Development representing Walgreens for a conditional use permit (CUP) to allow a reduction in required parking and site plan review to allow the redevelopment of 6061 Osgood Avenue North as a Walgreens; and after having conducted a public hearing relative thereto, the Planning n i Park Commission ni ssion of Oak 1 ark leights recommended that the application be approved with conditions. The City Council of the City of Oak Park Iieights makes the following findings gs of fact: follows, to wit: and 2. The applicant has submitted an application and supporting documentation to the Community Development Dc artment consisting of the following g items: p � � and RESOLUTION NO. CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST FOR A CONDITIONAL USE PERMIT AND SITE PLAN REVIEW FOR A WALGREENS AT 6061 OSGOOD AVENUE NORTH BE APPROVED WITH CONDITIONS 1. The real property affected by said application is legally described as SEE ATTACIIMENT A SEE ATTAC HMENT 13 3. The subject site is zoned B -2, General Business District in which retail sales operations are a permitted use; and 4. The City staff prepared memorandums dated May 3, 2001, September 7, 2001, and February 15, 2002 reviewing the request; and 5. The memorandum dated May 3. 2001 recommended that the application not be approved for the CUP and site plan until access issues with the property area to the north were resolved, additional information ation was received, and comments were received from the Middle St. Croix Watershed Districts on storm water issues, and the Minnesota Department of Transportation (MnDOT) and Washington County Department of Transportation on access issues and; 6. The applicant has revised the plans to address the access issues, additional information was presented to the satisfaction of City staff and Planning Commission and written comments were received from the Middle St. Croix Watershed District, MnDOT, and Washington County; and 7. The Planning Commission held a public hearing at their May 10, 2001 meeting and continued the hearing on a monthly basis until the October 11, 2001 Planning Commission meeting; and 8. At the October 11, 2001 Planning Commission meeting, the Planning Commission recommended approval of the Walgreens and the applicant requested the City Council hold on any review of the application pending resolution of an access easement issue; and 9. At the February 12, 2002 City Council meeting, the City Council voted to reopen the public hearing at the February 21, 2002 Planning Commission meeting; and 10. The Planning Commission held a public hearing at their February 21, 2002 meeting, took comments from the applicants and public, reviewed a revised site plan, closed the public hearing, and recommended the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Semper Development for a Walgreens at 6061 Osgood Avenue North for a CUP for a reduction in required parking and site plan review and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights for approval subject to the following conditions: 44 1. The northerly access onto Osgood Avenue North be reduced to 24 feet in width in conformance with the Zoning Ordinance. 2. Access permits from Washington County are required for Osgood Avenue. 3. Access onto 60 Street is subject to the conditions imposed by NINDOT including the applicant closing 60 Street west of the access to their property as shown on the submitted plans. 4. The applicant must provide a trail easement along Osgood Avenue and install a concrete sidewalk or bituminous trail. The applicant should work with Washington County because part of the sidewalk ma need to be within the right-of-way. 1 - LAtettlig‘li : 5. The project is subject to review and approval of the City Engineer and review by the Middle St. Croix Watershed Management Organization. 6. Grading, drainage, and utility plans are subject to the approval of the City Engineer. 7. The proposed retaining wall must be designed by an engineer and is subject to review and approval of the City Engineer. 8. The landscaping at the base of the retaining wall must be maintained by Walgreens even though it is at a lower elevation than the rest of the property. 9. The landscape plan must include the following revisions: a slight adjustment of landscaping along the west property line if necessary to allow space for a sidewalk, planters at the building entrance, and landscaping on the north property line. The applicant is responsible for all proposed landscaping. The landscape plan is subject to City Arborist review and approval. 10. The submitted tree replacement plan is subject to City Arborist review and approval. 11. A deed restriction must be put in place stating that a change in use of the property requires City review and approval and the use must comply with the City parking standards in place at the time the use changes. 19. Snow must either be stored within the green space of the site or be removed from the property. 13. Pilasters must be added to the north and east sides of the building. 14. The lighting plan must be revised to comply with the City's foot-candle requirements. The maximum height of the light fixtures is 25 feet. The style of the light fixtures must be bronze, shoebox, full-cut-off, and 90 degree angle. The proposed fixtures are not acceptable. 15. The electronic reader board is not allowed to have flashing or intermittent lights or animation, the text shall be in a white light, and the message must not change more often than every six hours. 16. Project approval will become null and void after 18 months unless the property owner or applicant has substantially started construction. 17. The building is not allowed neon lighting surroundin the corporate symbol in the atrium of the building. 3 2002. This plan is acceptable to Washington County, however it shows a northerly access to Osgood Avenue that is separate from the dental office to the north. Every effort should be made to consolidate these two driveways into a single access point. If it is not possible to do so, we will allow two separate driveways. if the frontage road to the west of Osgood is ever revised to connect to Osgood at this location, as planned, two driveways will be problematic. A single access point that lines up with the future frontage road would preserve safer and more convenient access for both properties. A single access point would also be safer under present conditions. If a meeting with Dr. Kalinoff and the developers is necessary, please include us. It is my understanding that the only change made to these plans (from those we reviewed previously) is the size of the building footprint and that these plans were sent to us as a courtesy to keep us informed. We appreciate this information. Please note that all comments from our letters dated May 29, 2001 and October 17, 2001 continue to apply to the Walgreens site plan.
