CONDITIONAL USE PERMIT FOR: All uses shall be subject to the following conditions and/or restrictions imposed by the City Council of the City of Oak Park Heights. General Description Conditional Use Permits have been granted to allow the parking space reductions, curb cuts and driveway widths as proposed by the applicant associated with the construction of a Walgreen's Pharmacy Store at the site identified. Site plans are attached hereto as Exhibit B and are incorporated by reference herein. II. ADDITIONAL RESTRICTIONS AND PROVISIONS. The following additional restrictions and provisions being part of the Conditional Use Permit to be issued herein affecting the following matters shall be: 1. A conditional use permit to allow the northerly access onto Osgood Avenue North at 36 feet in width is approved. Z. Access permits from Washington County are r equired for Osgood Avenue 3. Access onto 60 Street is subject to the conditions imposed b MNDOT includin the applicant closing �� p Y g pp g 60 � Street west of the access to their property as shown on the submitted plans. 4. The applicant must convey to the City a trail easement along Osgood Avenue and install a concrete sidewalk or bituminous trail. The applicant shall work with Washington County because part of the sidewalk may need to be within the County right-of-way. 5. The project is subject to review and approval by the Middle St. Croix Watershed Management Organization. 6. Grading, drainage, and utility plans are subject to the approval of the City Engineer. 7. The proposed retaining wall must be designed by an engineer and is subject to review and approval of the City Engineer. 8. The landscaping at the base of the retaining wall must be maintained by Walgreens even though it is at a lower elevation than the rest of the property. 9. The landscape plan must include the following revisions: a slight adjustment of landscaping along the west property line if necessary to allow space for a sidewalk, planters at the building entrance, and landscaping on the north proper line. The applicant is responsible for all proposed landscaping. The landscape plan is subject to City Arborist review and approval. 10. The submitted tree replacement plan is subject to City Arborist review and approval. 11. This Conditional Use Permit requires that any change in use of the property requires review and approval of the use by The City of Oak Park Heights and the proposed use must comply with the City Ordinances and parking standards in place at the time the use changes. 12. The following comments and./or recommendations pertain to the latest revised plans and drainage calcul ations ( previous coi�n7erits still applicable, or meant to serve as a reminder, are shown in italics): Site I.1ayo ut/Access Locations: 1. Washington County and MnI.DOT have previously approved the right - in only access, as long as the frontage road will be closet/. A retaining wall up to 13' in height is proposed along the majority of the east side of the site. A design for this wall, stamped by a registered engineer in the state of Minnesota, will need g to be submitted for our review and approval prior to construction (Landform notes this in their September 5, tool memorandum). Sanitary Sewer: 6. The plans do indicate to "Coordinate the abandonment of all existing utilities and services with the City of oak Park Heights ",, but we recommend the locations of any existing utilities be shown on the plans so the City has a record of this data. The revised drainage area map & calculations are acceptable as submitted. The tributary area was revised/expanded to more accurately reflect the actual existing area tributary to the existing storm sewer structures on Osgood Avenue. Proposed storm sewer through the wal g reens parking area has been upsized from 18" to 21 pipe to account for this increase in tributary storm water runoff.
