Call to Order/Pledge of Alle 'ance:
Following the conclusion of the 6:00 p.m. Planning Commissioner Interview Worksession,
Chair Kremer called the meeting to order @ 7:15 p.m. Present: Commissioners Kremer,
Bye & Freeman; City Administrator Johnson, City Planner Richards, and City
Councilmember Dougherty. Absent: Commissioner Anthony.
Ajuroval of Agenda:
Commissioner Bye, seconded by Commissioner Freeman, moved to approve the Agenda as
presented. Carried 3 — 0.
Approval of July 20, 2017 Meeting Minutes: Commissioner Freeman, seconded by
Commissioner Bye, moved to approved the Minutes as presented. Carried 3 - 0.

New Business:
A. Commission Appointment Recommendation: Discuss and make recommendation for
appointment to Planning Commission vacancies.
Chair Kremer explained the process of recommendation to the City Council for
appointment and noted that five candidates were interviewed and that all of the
candidates were great. The sitting Commission commented on how nice it was to
have so many interested and willing individuals to express interest and hoped that
those who were not appointed will continue to remain interested and come back
again when there are openings.
Commissioner Freeman, seconded by Commissioner Bye moved that City Council
appoint Jennifer Giovinazzo and Jennifer VanDyke to the Planning Commission.
Carried 3-0.
B. Accessory Structure Ordinance
City Planner Richards reviewed his August 2, 2017 .Planning Memorandum
regarding accessory structures and noted that the issues of focus are whether the
current allowances for height and size are appropriate and also whether temporary
structures such as fabric carports and shelters should be allowed.

The current regulations were reviewed and discussion was had as to how an
accessory structure is defined and sizing requirements. It was noted that the current
ordinance is working more or less and whether there is a simple change that might
work to allow people more space. It was expressed that a simple change that allowed
for a larger area would be desired as would be having people place their vehicles,
boats, etc. inside a storage area and a preference to not see accessory buildings to
exceed the height of the house.
Discussion was had as to the height criteria for accessory structures and how roof
pitches from different construction time periods can change things, how size of a lot
could be considered for regulation, and whether or not there were problems with
accessory structure regulations now or if it is the differences being looked at.
Council Liaison noted that the increased number of vehicles, boats and similar
needing to be stored are part of the conversation. Chair Kremer suggested that 20
foot height and 1,200 square feet sizing allowance as a start for public hearing
conversation.
City Planner Richards noted that the additional part of this issue is for carport and
temporary structure allowance in residential neighborhoods and discussed the same
in relation to possible permitting and enforcement utilized in other communities.
Discussion ensued as to situation where a temporary tent may be used such as a
graduation party and whether or not it is desirable to have a covered car parked in a
driveway. Campers being parked in the driveway year round was noted and
discussed. City Administrator noted that the City strives to create ordinances that
balance the needs of its community and that the bulk of temporary structure permit
requests that come in are from commercial properties and that tents for things such as
graduation parties at homes have not required a permit. City Planner Richards
clarified that the temporary structures of inquiry are those that are placed next to a
garage for a longer duration. Discussion continued as to possible permitting for
temporary structures, how permitting of those used by commercial structures is done.
Consensus was to include the conversation at a public hearing and see what kind of
feedback is received on the issue.
VIII. Old Business:
A. Oak Park Heights — Com rehensive Plan 2018:
City Planner Richards noted that community survey results are being collected and
reviewed and discussed feedback collected to date. He noted that surveys will be
collected until August 25, 2017. Final results will be shared at the September meeting.
Richards noted to the viewing audience the August 2511, timeline to get surveys in and
noted where the survey could be found.
Richards reviewed his August 3, 2017 memorandum and discussed the same
with the Commission. Discussion ensued as to land use, potential annexation areas
shown on map, showing bridge element on maps, land uses shown on proposed land
use map with regard to current use and proposed use classifications, and projected
residential density of land uses up to 2040.

Discussion was had as to the Commission Liaison to the City Council meetings and
whether or not it was needed given that there are several people in attendance at the
Planning Commission meetings who are also in attendance at the City Council meetings.
Chair Kremer noted that he found the Council Worksession's more informative than the
City Council meetings in that you get a feel where the Council is corning at things from.

The City Council, its May 9, 2017 meeting, authorized Staff to review Section 401.15.D.
Accessory Buildings and Section 401.15.C.8 Building Type and Construction of the
Zoning Ordinance as it relates to accessory building regulations. There are two
concerns, whether the allowances for height and size are appropriate and secondly if
temporary structures such as fabric carports and shelters should be allowed in the City.
At their August 10, 2017 meeting, the Planning Commission reviewed the issues and
provided direction to Staff on the accessory building regulations. They directed Staff to
schedule a public hearing for the September 14, 2017 meeting. A public hearing by the
Planning Commission is required to amend the Zoning Ordinance.

ANALYSIS
Discussion Points
The focus of this review is on Section 3, Height/Setbacks, as it relates to the height of
accessory buildings, Section 6 and 9, as it relates to size, and Section 11 as it relates to
compatibility of exterior material. Currently, through this section, the City does not allow
fabric carports and shelters.
Discussion points on this topic are as follows:
1. Height: The Planning Commission recommended that the maximum height
of an accessory structure should not be more than 20 feet. Note that the
building height would be to the parapet of a flat roof building and to the
midpoint of the roof of a gable or hip roof building. They also recommended
that the height not exceed an existing principal structure.
2. Size: There are two Sections, 6 and 9 that regulate size of structures. As to
size in Section 6, the Planning Commission asked Staff to discuss with the
Julie Hultman, the Building Official, what method would be easier for
implementation and enforcement; establishing the maximum size of
accessory buildings by a square foot amount or by a percentage of the lot
area. For instance, the ordinance could simply say the accessory building
size shall not exceed 1,200 square feet. Or it could say it shall not exceed 30
percent of the lot area. Ms. Hultman indicated that establishing a maximum
size number such as 1,200 square feet would be the easiest method.
Section 9, that provides a limit of 30 percent of the gross floor area of
principal buildings, should be eliminated if the Planning Commission
recommends a maximum size at 1,200 square feet.
3. Fabric Carports and Shelters: The Planning Commission discussed
whether fabric carports and shelters, should be allowed. The current
language in Section 11 and in Section 401.15.C.8 as found below does not
allow for this type of structure.
The recommendation of the Planning Commission was to allow temporary
accessory buildings such as fabric carports and shelters as a special event
for a maximum of 50 days in a calendar year. The rational was that people
sometimes need temporary storage, especially during construction on the lot.
The provision already applies to commercial and industrial districts, mostly for
tents or signage.
The temporary structure would require a special event permit, issued by the
City and would be subject to the following conditions
a. The structure shall be securely fastened to the ground, subject to the
safety requirements specified by the manufacturer.
b. The structure shall be kept in good condition and its appearance shall not
be detrimental to the area or adjacent properties.
c. The temporary use does not involve the erection of a substantial structure
or require any other permanent commitment of the land.
d. The temporary structure shall be removed at the end of the permit period.
If not removed within 10 days thereafter, the permittee shall have forfeited

any rights to the structure and the City shall have the right to remove the
structure at the permittee's expense.
A definition of temporary structure should also be included in Section
401.02.13. A suggested definition is as follows:
Temporary Structure: Any structure that is designed, constructed and
intended to be used on a short-term basis.
Revised Ordinance:
Deleted language is struck, new language is in bold.
Section 401.15.13. Accessory Buildings, Uses and Equipment
1. Connection with Principal Building. An accessory building shall be
considered an integral part of the principal building if it is connected to the
principal building by a covered passageway.
2. Location. No accessory buildings shall be erected or located within any
required yard other than the rear yard except by approval of a conditional use
permit according to the provisions of Section 409.03 and Section 409.15. D. 13 of
this Ordinance.
3. Height(Setbacks. Accessory buildings shall not exceed hweW (1 2) twenty
(20) feet in height or exceed the height of the principal structure on the lot
Accessory buildings shall be rive (5) feet or more from side lot lines, eight (8)
feet from the rear lot line, and shall be six (6) feet or more from any other building
or structure on the same lot. Accessory buildings shall not be located within a
utility and/or drainage easement unless written approval is obtained from the
easement holder. Accessory buildings may be closer than six (6) feet to other
buildings or structures providing the requirements of the Building Code are met.

varied by approval of a conditional use permit as provided for in Section 409.03
and Section 401.15.D.13 of this Ordinance.
4. Lot Coverage. No accessory building or detached garage or combination
thereof within a residential district shall occupy more than twenty -rive (25)
percent of the area of the rear yard except by approval of a conditional use
permit according to the provisions of Section 409.03 and Section 401.15.D.13 of
this Ordinance.

5. Number of Structures. No building permit shall be issued for the construction
of more than one (1) private garage or storage structure for each detached single
family dwelling, commercial, industrial, public or institutional building except by
approval of a conditional use permit according to the provisions of Section
409.03 and 401.15.D.13 of this Ordinance. Every detached single family
dwelling unit erected after the effective date of this Ordinance shall be so located
on the lot so that at least a two (2) car garage, either attached or detached, can
be located on said lot.
6. Size. No accessory building for single family dwellings or combination of
attached and detached accessory buildings shall exceed(1,000)
one thousand two hundred (9,200) square feet of floor area, except by
conditional use permit as provided for in Section 409.03 and Section 401.15.D.13
of this Ordinance.
7. Administrative Approvals. Storage buildings one hundred twenty (920) square
feet or less and in conformance with the provisions of this Ordinance may be
approved by the Building Official without a building permit, and may be in excess
of the number of structures allowable in Section 401.15.D.5. above.
8. Building Permit. No building permit shall be issued for the construction of an
accessory building in a residential district when an existing detached garage or
other accessory building is located on the same lot, except by conditional use
permit as provided for in Section 409.03 and Section 401.15.D.13 of this
Ordinance.

9. Accessory Uses. No accessory uses or equipment such as air conditioning
cooling structures or condensers, swimming pools, and the like which generate
noise may be located in a side yard except for side yards abutting streets where
equipment is fully screened from view.
10. Compatibility. The same or similar quality exterior material shall be used in the
accessory building and in the principal building except as allowed as a
temporary structure in Section 409.95.D. 99. of this Ordinance. All
accessory buildings shall also be compatible with the principal building on the lot.
"Compatible" means that the exterior appearance of the accessory building
including roof pitch and style is not at variance with the principal building from an
aesthetic and architectural standpoint as to cause:
a. A difference to a degree to cause incongruity.

b. A depreciation of neighborhood values or adjacent property values.
C. A nuisance. Types of nuisance characteristics include unsightly building
exterior.
11. Temporary Accessory Structures. Temporary accessory structures shall
be allowed in all zoning districts with the issuance of a special event permit
for a maximum of 50 days in a calendar year subject to the following:
a. The structure shall be securely fastened to the ground, subject to
the safety requirements specified by the manufacturer.
b. The structure shall be kept in good condition and its appearance
shall not be detrimental to the area or adjacent properties.
C. The temporary use does not involve the erection of a substantial
structure or require any other permanent commitment of the land.
d. The temporary structure shall be removed at the end of the permit
period. If not removed within 10 days thereafter, the permittee shall
have forfeited any rights to the structure and the City shall have the
right to remove the structure at the permittee's expense.
Section 401.15.C.8 Building Type and Construction also restricts the types of building
materials and construction types for structures. That section is as follows:
8. Building Type and Construction.
a. General Provisions.
25 1) Compatibility. Buildings in all zoning districts shall maintain a high
standard of architectural and aesthetic compatibility with
surrounding properties. Compatibility means that the exterior
appearance of the building, including design, architectural style,
quality of exterior building materials, and roof type and pitch are
complementary with surrounding properties.
25 2) Maintenance. All buildings in the City shall be maintained so as not
to adversely impact the community's public health, safety, and
general welfare or violate the provisions of the Nuisance or
Hazardous Building provisions of the Oak Park Heights Code of
Ordinances.

25 3) Metal Building Finishes. No unfinished steel or unfinished
aluminum buildings shall be permitted in any zoning district. High
quality, non -corrosive steel, aluminum, or other finished metal shall
be allowed for walls or roofs.
25 4) Prohibited Materials and Structures.
a. Pole buildings and Quonset structures.
b. Wood or metal poles as principal structure support where
such supports are not affixed to a floor slab but inserted
directly into the ground to achieve alignment and bearing
capacity.
25 5) Accessory Buildings. All accessory buildings to residential dwelling
units and non-residential uses shall be constructed with a design
and materials consistent with the general character of the principal
structure on the lot as specified in Section 401.15.D of this
Ordinance except as allowed for temporary accessory
structures specified In Section 401.15.D.11.
b. Exterior Building Finishes — Residential. • The primary exterior building
facade finishes for residential uses shall consist of materials comparable
in grade to the following:
9) Brick
2) Stone (natural or artificial).
3) Integral colored split face (rock face) concrete block.
4) Wood, natural or composite, provided the surfaces are
finished for exterior use or wood of proven exterior durability
is used, such as cedar, redwood or cypress.
5) Stucco (natural or artificial).
6) High quality and ecologically sustainable grades of vinyl,
steel and aluminum. Vinyl shall be a solid colored plastic
siding material.
7) Fiber cement board.
8) Exterior insulation and finish systems.
9) Energy generation panels and devices affixed to a roof or
wall. If not in use, the panels or devices should be removed
and building surface restored to the original condition.
C. Exterior Building Finishes — Commercial. The exterior architectural
elements and finishes for all buildings in the business zoning districts shall
be subject to Section 401.96 of this Ordinance known as the Design
Guidelines.

Conclusion/Recommendations
The Planning Commission should review the draft regulations and provide direction to
Staff on any revisions. The Planning Commission should open the public hearing and
receive any comments.

SECTION 401.02.13 DEFINITIONS
Add the following definition:
Temporary Structure: Any structure that is designed, constructed and intended to be
used on a short-term basis.

Section 401.15.C.8 of the Ordinance also restricts the types of building materials and
construction types for structures. That section is as follows:

Eric Bjelland of Midwest Retail Ventures LLC has made application for Design
Guidelines/Site Plan Review for the building at 5988 Osgood Avenue North. The
application consists of requests for Design Guideline and site plan review for an exterior

PROJECT DESCRIPTION
The applicant's narrative for the project is found as Exhibit 1.
Background. Stillwater Crossing has been on the south west corner of Highway 36
and Osgood since the 1960's. The property serves local businesses that need vehicle
access to these thoroughfares and benefit from the visibility to the North and East.
Fagade Renovation: The fagade renovation will enhance the visibility from Highway
36, improve the building sign visibility, and upgrade the overall look while preserving the
rock features in the lower fagade.
Smoking Area: As the smoking cliental is primarily from Carbone's pub, we are
requesting to move the bike rack further east and create a screened smoking area with
access from both the sidewalk and Carbon's pub.
Trash/Recyciing Enclosure: The center currently uses 2 to 8 -yard bins for recycling
and refuse. We propose to build an enclosure behind Liquor Time to the south of the
transformer. This location will not take up any parking stalls. The design is to have it
open on the back so Carbon's and Liquor Times's employees can access the bins
without opening gates, thereby keeping the bins screened except when the trucks come
to remove the trash/recycling.
ISSUES ANALYSIS
Comprehensive Plan. The property is designated as Commercial on the Proposed
Land Use Map. The continued use of the site as a mixed-use shopping center is
consistent with the Comprehensive Plan.
Zoning. The property is zoned B-2 General Business District. The retail and restaurant
uses are permitted use in the B-2 Limited Business District. Changes to the exterior of
the building and the site improvements require Design Guidelines and Site Plan review.
Setbacks. The building setbacks are not changing with the upgrades. No changes are
proposed to the parking lot.
Parking. Section 401.151.9 of the Zoning Ordinance requires six spaces per each
1,000 square feet of gross floor area for a shopping center. The parking calculation for
this site is as follows:

The building requires 77 parking stalls. The shopping center currently has 94 parking
spaces, four of which are disability accessible. There is a surplus of parking.
Landscaping. No changes to the landscaping for the site have been proposed. If
changes are proposed, a landscape plan will need to be submitted for City Arborist
review and approval.

Lighting. No lighting plans were included as part of the application. The Applicant has
indicated that the wall light fixtures may be changed, but not at this time. If new wall
light fixtures are to be installed, lighting specifications will need to be submitted, the
fixtures shall be full cut off, and be consistent with Section 401.15.13.7 of the Zoning
Ordinance as it relates to lighting requirements.
Trash Storage. Currently, the dumpsters for the building are placed on the west side of
the building and are not screened. A plan has been submitted for dumpster screening
on the west and south sides. The other two sides of the enclosure are screened by the
building.
Smoking Area. A designated smoking area has been proposed for a comer of the
building. The area will be fenced and accessed only from sidewalk. No alcohol
consumption shall be allowed on the smoking area in that the license for Carbone's will
not allow it. The area should be signed to prohibit alcohol consumption in this area.
Grading, Drainage, Erosion Control and Utilities. No changes are proposed to the
parking lot or site that would require review and approval.
Signage. The elevation diagrams indicate the signage locations for the tenants. The
signs will be required to comply with the Zoning Ordinance size and lighting
requirements. Staff will approve the sizes and lighting specifications for the signs at the
time of permitting.

Facade Treatments
The building after renovation will have a definite base, middle and top. The
facades will feature differences in materials, horizontal and vertical lines, and a
varied roof line to provide architectural interest.
Ground Level Expression
This is a one-story building with excellent visibility to Highway 36. The entrances
to the building will be clearly visible.
Transparency
The existing windows and door locations are not changing with this renovation
and the transparency will not change.
Entries
The building features a raised parapet for the door entry points.
Roof Design
The roofline is broken with varying parapet heights giving interest to the building
appearance.

The applicant has provided color elevations for review. The building features the
existing rock at the lower fagade, varied paint colors at the upper fagade and a
prefinished metal coping at the roof line. The Applicant has been requested to
provide building material samples for the Planning Commission meeting.

revisions of the Land Use section and will provide it to the Planning Commission when
completed.

INTRODUCTION
The Planning Commission and City council nave eacn aiscussea community issues as
part of the planning process. The representation of these City leaders and officials has
provided the insight and initial direction for the process. The community involvement will
continue throughout the comprehensive planning process with public meetings at the end
of each stage. Additionally, as an initial means of shaping the Comprehensive Plan, a
Community Survey was developed to gain insight from residents of the community.
This report provides a summary of the issues and directions which community officials
and residents have identified. As such, it will be utilized in conjunction with the technical
data compiled in the data collection process to formulate the policies as well as physical
layout of the community. Throughout the issues identification process, it was realized
that there is agreement on most of the issues but also differences in the philosophy and
details of the approaches to be taken. An additional purpose of this report is therefore to
highlight these matters so that they can be addressed as part of the planning process.
PLANNING PROCESS
The community-based information and directives summarized in this section serve to set
the stage for the completion of the Comprehensive Plan. Complementing the issues
identification stage of the process will be the technical inventory of the community that is
found in each of the subsections of the plan. This information will provide decision -
makers with a basis from which problems and issues can be identified, objectives
discussed and corrective actions implemented. The results of this effort will be goals and
policies, as well as plans that are developed on a City-wide basis and for specific
neighborhoods.
It should be noted that the issues identification study is only an initial forum for community
input into the planning process. As draft material is prepared, meetings will be held with
the Planning Commission, which will be the primary group to hold public hearings and
discussion on the plan. The Mayor, City Council, staff, general citizenry and business
interests will also be provided ample opportunity for review and discussion through
meetings and public hearings. While such involvement will be demanding, it is essential
for completion of a Comprehensive Plan which is truly reflective of Oak Park Height's
goals and objectives.

COMMUNITY SURVEY
As an initial means of shaping the Comprehensive Plan, a Community Survey was
developed to gain insight from residents of the community. The Community Survey was
made available on the City website and distributed at the Party in the Park event on June
8, 2017. There were 96 respondents to the survey, 83 were residents of the community.
While the survey is recognized as not being statistically accurate, the results provided the
basis for the discussion of issues for this section. The respondents to the survey identified
themselves into these general categories:

Most of the resident respondents (48.3 percent) nave lived in Oak Park Heights more
than 10 years. Another 32.2 percent have lived in the City less than five years. The
respondents to the survey generally reflect the demographic makeup of the City, although
a majority (31.0 percent) were 55 years and over. Most of the respondents (43.7 percent)
did not have children currently living in the household. A summary of the key findings of
the survey are as follows:

respondents, is found in the Appendix of this plan. The Community Attitude section, as
follows was partially shaped by the results of the survey.
COMMUNITY ATTITUDE
The overriding attitude that was expressed by the residents of Oak Park Heights during
the issue gathering process was the positive attitude about the community and the long-
term prospects for continued growth and improvement. Residents cited the quality of life
in the area, the amenities of the nearby rivers, lakes, and wetlands, the City parks and
trails, the small-town feel, and the school systems and the retail businesses that
contribute to making Oak Park Heights an attractive place to live. Those persons who
took the survey and were involved in the opportunities and issues discussions as part of
the Comprehensive Plan process listed the following as the positive aspects of the
community:

The City is situated in such a way that it is close to the St. Croix River Valley, rural
areas and open space.
2. Excellent access to the freeway system which provides connections to the entire
Minneapolis St. Paul area.

4. Excellent City park and trail system.
5. The community provides an adequate land use density with residential,
commercial, and industrial/business warehouse uses.
6. The community has several shopping, recreational and entertainment options for
its residents.
7. There are excellent housing options with two premier senior living complexs in the
City.
8. The school system is excellent and the high school is located within the City.
9. The City has a good government structure with a high level of long term
participation on City boards and commissions.
10. The taxes are relatively low in comparison to other area cities.
There were few negative comments made by residents and most dealt with issues related
to the Highway 36 transportation corridor and the intersections that access the Oak Park
Heights frontage roads and street network. Residents question what impact the St. Croix
River Crossing will have on the community related to traffic and development.
LAND USE ISSUES
The community recognizes the following land use issues:
• Preservation of the high quality of life in the City neighborhoods.
• A balance of housing types for all age groups.
• Buildings and property in the City kept in a good state of repair and maintenance.
• Preservation of affordable housing, improvement of low income housing and
affordability of living.

• Impact of the St. Crossing River Crossing on the community and future

development regulations are kept current, code enforcement is continued, and public
improvements are of the highest quality.
Protect Oak Park Heights' Natural Resources. The St. Croix River, as well as the
wetlands, ground water, surface water resources, and trees provide natural amenities
and add significant aesthetic recreational and economic value to the community.
Preserve and protect these resources by incorporating sustainable development
principles into public and private projects.

that accommodates all residents is desired to provide continuity and connections

especially problematic. Other cities like Stillwater pave, then come back to adjust sewer covers to
just below street grade (to avoid snow plow issues)..... but ours are like landmines to jolt cars and
passengers inside. If there is ONE thing you can do to make this a more livable city please get
rid of these problem sewer.covers, thank you.

I LOVE that Oak Park Heights residents are always in walking distance of a park) Plus, their are

tons of amazing trails to walk or bike on! In addition, I love that some of the city parks (Autumn
Hills, Brekke, Oak Park Crossing, formally Valley View) offer Art In The Park Programs as well as
Family Fun Nights. However, I do wish that these would be expanded to now include Swager Park,
Cover Park, slid once again include Valley View for next summer. This is a way you could also
bring more people to those parks.
Skating rinks need to be fixed up.....all boards need to be replaced..... concrete needs to be

later in the season. Poor lawn care in parks and ball fields a,e !n very poor shape and should be
renovated. Trails look pretty good for the most part.

Just one specific issue that 1 think should have been addressed long ago and that is the stoplight in

front of the highschool (58th Street North and Neai). While I understand the reed for the light to be
timed/programmed accordingly for the beginning and end of the school day, I think that it should
be programmed/timed to make traffic more efficient outside the school day, weekends, and
summer. I thought they would change It with the road improvements last year at Vie high school,
but was shocked when it was not.

Please consider extending the trail from frontage road to 58th. tt is unsafe for pedestrians and

bikers.the cars come so fast down that read and they have to come around a blind comer from
frontage rd. Stagecoach has a lot of bike and pedestrian traffic including biking events. It is a
saftey issue.

Stagecoach Trail needs a sidewalk. It is dangerous to walk with our young children on that road.

to maintaining 1 trimming them down or provide a cost effective arbor service to help shape them

reduce the "road rage" I see at this intersection on a daily basis as frontage road drivers and
cross-intersectlon travelers jockey for position before the light turns green. Know this is MNDot
territory..... but would be great to have for staging purposes..... two left turn lanes, two right tum
lanes, and two "travel across" lanes to aiieviate this problem. Doable.... I think......
