As noted in the memo, the Council is asked to adopted the enclosed Resolution; the resolution is largely a narrative of the history and restates key elements as required under Statute, but there are two vital items to mention: Sec 3.04 requires that the Fiscal Disparities (FD) tax revenue that would be captured by the District will be applied to the Fiscal Disparities Pool so that other off-site taxpayers are not asked to further subsidize this contribution to fund tax distributions to the FD pool outside of the City. Sec 5.03 outlines that the City is seeking that the Original Tax Capacity is to be certified as of 1/1/18. (Estimated to be $32,530 +/- as of 1/1/17. This is based on a taxable valuation of$2,035,000). Based on this estimate, if$5,000,000 in NEW TAXABLE VALUATION was added to the District, it would repay the City costs incurred to date of$407,067 by near Year 11. At$5,000,000 in new tax base,this leaves $200,000 for other projects—if the Council was so inclined to apply such costs to other projects aspects if they should appear. However, the County may seek a portion of these revenues for possible roadway impacts if there are any such impacts. If more or less than $5,000,000 in new value is constructed - these figures would vary of course, but at this time it is unknown and the data on the following pages is a very rough estimate. 1 of 8 a _ EHLERS Memo + LEADERS IN PUBLIC FINANCE To: City Council,City of Oak Park Heights From: Rebecca Kurtz Date: August 28,2017 Subject: Certification of Tax Increment Financing District No. 1-2 Background On November 12,2014,the City Council held a public hearing and adopted Tax Increment Financing(TIF)District No. 1-2,a renewal and renovation district.The District consists of eight parcels located along Osgood Avenue and State Highway 36,and it has a maximum term of 16 years of tax increment.The District was established to assist with land acquisition costs,utility replacement,street construction/reconstruction and other related expenses. To date,the City has acquired two parcels and demolished the existing buildings in the District. These actions assisted with the realignment of 60`x'Street and prepared the area for future redevelopment.To date,the City has outlaid$407,067.20.The City paid for the expenses with funds on hand and adopted an interfund loan to preserve its ability to reimburse itself.It is the City's intent to use future land sale proceeds and/or tax increment to reimburse the expenses to date. The above figure does not include the$166,000 the EDA paid for the 6180 Osgood Ave parcel in 2010; if this amount is recoverable the above figure would increase,however if not the City could view a contribution of this parcel for a future development as a pond area,public roadway etc. Certification of the District was delayed after redevelopment plans from a private entity were put on hold.Delaying the request for certification of the District allowed for additional time prior to starting the first year of increment;and therefore,maximizing the potential increment.The City has three years to complete this request for certification,and completing the request of certification does not require an additional public hearing or information from the City Council. Proposed Action While additional action from the Council is not legally required,a resolution has been prepared to ratify the Council's actions from November 12,2014, and its demonstration of intent to certify the District. Recitals 1.01. The Council has heretofore established Development District No. 1 and adopted the Development Program therefor.The Council has also adopted a Modification to the Development Program for Development District No. 1 (the"Development Program Modification")and established Tax Increment Financing District No. 1-2(the"District")therein and adopted a Tax Increment Financing Plan (the"TIF Plan")therefor(the Development Program Modification and the TIF Plan are referred to collectively herein as the"Program and Plan");all pursuant to and in conformity with applicable law, including Minnesota Statutes,Sections 469.124 to 469.133 and Sections 469.174 to 469.1794,all inclusive,as amended,(the"Act")all as reflected in the Program and Plan,and presented for the Council's consideration on November 12,2014. 1.02. The Council hereby ratifies the finding that the District is in the public interest and is a "renewal and renovation district"under Section 459.174, Subd. 10a of the Act. 3.02. The Council ratifies the finding that the proposed redevelopment would not occur solely through private investment within the reasonably foreseeable future and that the increased market value of the site that could reasonably be expected to occur without the use of tax increment financing would be less than the increase in the market value estimated to result from the proposed development after subtracting the present value of the projected tax increments for the maximum duration of the District permitted by the TIF Plan,that the Program and Plan conform to the general plan for the development or redevelopment of the City as a whole;and that the Program and Plan will afford maximum opportunity consistent with the sound needs of the City as a whole,for the development or redevelopment of the District by private enterprise. 3.03. The Council ratifies the findings,declares and determines that the City made the above findings stated in this Section and ratifies the reasons and supporting facts for each determination in writing,as included in Exhibit A of the November 12,2014 adopting resolution. 3.04. The City ratifies that it elects to calculate fiscal disparities for the District in accordance with Section 459.177, Subd.3,clause b of the Act,which means the fiscal disparities contribution would be taken from inside the District. Section 4. Public Purpose 4.01. The adoption of the Program and Plan conforms in all respects to the requirements of the Act and will help fulfill a need to develop an area of the City which is already built up,to provide employment opportunities,to improve the tax base and to improve the general economy of the State and thereby serves a public purpose. For the reasons described in the November 12,2014 resolution to establish the District,the City believes these benefits directly derive from the tax increment assistance provided under the TIF Plan.A private developer will receive only the assistance needed to make any proposed development financially feasible.As such,any private benefits received by a developer are incidental and do not outweigh the primary public benefits. Section 5. Ratifying Approval and Adoption of the Program and Plan 5.01. The Program and Plan,as presented to the Council on this date,including without limitation the findings and statements of objectives contained therein,are hereby approved,ratified, established,and adopted and shall be placed on file in the office of the City Administrator. 5 of 8 5.02. The staff of the City,the City's advisors and legal counsel are authorized and directed to proceed with the implementation of the Program and Plan and to negotiate,draft,prepare and present to this Council for its consideration all further plans,resolutions,documents and contracts necessary for this purpose. 5.03.
