RE: Refund Escrow - Occupancy Permit
Dear Mr. Hawkinson:
Enclosed is a check in the amount of $7,500.00 and is the final amount as held by the
City initially received to secure full compliance with deficient conditions at the WaI -Mart
site relative to the issuance of an occupancy permit. At this time the listed items are
believed to be fully completed and must remain in compliance.
This letter does not release other conditions or requirements not intended to be secured
under these funds. The city will continue to hold the Plan A - Letter of credit.

Provide a cash deposit of $5,000 to secure the removal of the asphalt curbing at the north property line and install a concrete curb. Reinstall such curb within
90 days. When complete and is satisfactory the City will return such funds.
The Development Agreement between al -Mart and the City did not specifically provide an approval for the provision of any form of outdoor kiosk, (now
;painted black and white) as adjacent to your tire & lube area. The City could have such kiosk removed at anytime, at this time the City will allow the kiosk to
remain at its current location , but must be painted brown.
/Ail chain link fencing must be removed from the site.
,Replace the chain link fencing surround on the outdoor gas storage tanks. This must be the wrought iron type and compliant with the City's design standards.
You must provide a cash deposit of $ 1,000 prior to any occupancies being provided, securing that this is accomplished in 90 days. When complete and is
[satisfactory the City will return such farads.
All site lighting must be compliant, including lighting in the garden center
1 The current fencing located at the south property line has several breaks and does not run the full length of the site. You must provide a $6,000 cash deposit
securing that this is completed. No occupancies will be provided until this deposit is made. When complete and is satisfactory the City will return such funds.
There has been som additional discussion relating to one of the breaks being necessary for access to a hydrant. At this time the City will require that this be
screed in som alternative format, but will also be checking building and fire codes for this clearance
