CITY COUNCIL MEETING MINUTES
I. Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber
called the meeting to order at 6:00 p.m. Present: Councilmembers Dougherty,
Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson, City
Attorney Vierling, Finance Director Caruso, and City Engineer Mann. Absent:
City Planner Richards.
Councilmember Swenson, seconded by Councilmember Liljegren, moved to
approve the Agenda. Carried 5-0.
II. Council/Staff Reports:
A. Mayor McComber: She reported she would be attending a meeting at City
Hall on December 13 regarding safety and a conference call on December
14 regarding the long-range plans surrounding the closing of the King
Plant. She also reported she received a call from MNDOT regarding the
ice and snow on the lights on Highway 36, and they were going to
continue to work on it. McComber also reminded residents of the winter
parking regulations.
B. Councilmember DoughertX: He reported the next Planning Commission
meeting was set for December 14 at 6:00 p.m.
C. Councilmember Liljegren: He reported the next Parks Commission
meeting was set for December 18 at 6:00 p.m.
D. Councilmember Runk: He reported the next Middle St. Croix Watershed
Management Organization meeting was set for December 14.
E. Councilmember Swenson: He reported the Cable Commission was
seeking a citizen representative.
F. Staff: City Clerk Pinski reported that Neil and Susan Swenson of 13205
56th Street North and Clark and Vicki Nyberg of 14566 57th Street North
were chosen as the recycling award winners.
III. Visitors/Public Comment:
A. Mountain Bike Team—Presentation of Sign: Councilmember Runk
presented representatives of the Stillwater Area High School Mountain
Bike Team with a sign to be placed at the mountain bike trail in Oak Park
Heights.

A RESOLUTION AUTHORIZING ALTERNATE NEWSPAPER
FOR PUBLICATION IN 2018
WHEREAS,the City of Oak Park Heights designated the Stillwater Gazette as
the official newspaper for publications in 2018 in Resolution 18-01-02; and
WHEREAS,the Stillwater Gazette is published and circulated one time per
week; and
WHEREAS, the City Council recognizes that there may be instances in which
the Stillwater Gazette, as a one-time per week publication, is unable to meet the time
limitations imposed upon any required publication of the City so that an alternative
publication may be required; and
WHEREAS, the Pioneer Press is a newspaper circulated on a daily basis in the
City and meets the publication requirements set forth by state law;
NOW THEREFORE,BE IT RESOLVED,that the City Council for the City of
Oak Park Heights authorizes the Pioneer Press as an alternative publication in any
instances in which publication on other than a weekly basis is required to comply with
the requirements of the City.

Currently there is a provision in City Ordinance 1202.05.A. that does not allow the City Council
to make a decision on a liquor license approval until the meeting following the required Public
Hearing. City staff recommends removing that provision.
1202.05 Granting of Licenses.
A. The City Council shall investigate all facts set out in the application. The
Council shall instruct the City Administrator to cause to be published in the
official newspaper,ten(10)days in advance,a notice of hearing to be held by
the City Council,setting forth the day,time,and place when the hearing will
be held,the name of the applicant,the premises where the business is located
and such other information as the City Council may direct. At the hearing,
the opportunity shall be given to any person to be heard, for or against the

RELATING TO INTOXICATING LIQUOR
THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY,
MINNESOTA,DOES ORDAIN:
Section 1. Amendment. That Section 1202.05 A. of Chapter 1202 of the Code of Ordinances of the
City of Oak Park Heights is hereby amended to delete the same in its entirety and to substitute the
following therefor:
1202.05 Granting of Licenses.
A. The City Council shall investigate all facts set out in the application. The
Council shall instruct the City Administrator to cause to be published in
the official newspaper, ten (10) days in advance, a notice of hearing to be
held by the City Council, setting forth the day, time, and place when the
hearing will be held, the name of the applicant, the premises where the
business is located and such other information as the City Council may
direct. At the hearing, the opportunity shall be given to any person to be
heard, for or against the granting of the license. No license shall become
effective until said application has been approved by the Commissioner of
Public Safety.
Section 2. Effective Date. This ordinance shall be in full force and effect from and after its passage
and publication according to law.

The City is required to comply with the Municipal Storm Sewer System(MS4)requirements as issued by the
Minnesota Pollution Control Agency.For this compliance two ACTIONS must be completed
• ACTION 1: Being the submission of the MS4 Permit application to discharge water to the State/Federal
waterways.Action 1 was approved by the City Council in Oct 2015.This ACTION 1 work has been
completed and has been submitted to the State.and has been approved by the MPCA.
• ACTION 2: The City is now required to IMPLEMENT certain elements of the MS4 requirements(as
outlined in the SWPPP).These implementation steps are outlined herein(see STANTEC memo dated
12/6/2017)and are required to be completed and maintained to maintain the permit.
These costs for Action 2-is estimated to be$23,000 and would be funded from the City's Storm Water Fund-
which carries a balance of$188,000 as of 12/31/18.The revenues to this fund generally come from quarterly storm-
water charges applied to all lands in the City.
NOTE: There will very likely be ongoing reporting and certification costs associated with this MS4 permit;
however,these are generally unknown at this stage but will likely be+/-$10,000 annually if I had to speculate.
These costs would be add-ons to City construction projects,on-going reporting and certifications and additional
public outreach requirements.

Reference:MPCA MS4 Permit—Tasks to Complete SWPPP Implementation
Oak Park Heights has recently become a Municipal Separate Storm Sewer System(MS4)City in June of
2017,as determined by the Minnesota Pollution Control Agency(MPGA).This allows the City to be covered
under the current the MS4 General Permit by the MPCA.The NPDES/SDS MS4 Permit requires the City to
develop,implement,and enforce their Stormwater Prevention Program(SWPPP)as part of the MS4
process.The purpose of this letter is to provide Oak Park Heights with a scope and associated costs for
Stantec to assist the City with developing their MS4 Permit implementation items identified in its approved
SWPPP Document.
1.Scope of Services:MS4 Permit Implementation
This scope of services follows the commitments the City made in its approved SWPPP Document.However,
this is not a complete list of actions necessary to fully implement the SWPPP Document,rather only those
tasks for which Stantec can assist the City in completing.Each commitment,or group of commitments(if
multiple commitments can be completed together),is presented as a separate task Each detailed task
description outlines the task scope,necessary actions of the City,and the Stantec deliverables.
Task is Regulatory Mechanism Updates to Meet MS4 Permit Requirements
The City's approved SWPPP Document identifies the need for modifications to these regulatory
mechanisms to be consistent with the MS4 Permit.
Regulatory mechanisms(outlined in Part II.D.2 of the SWPPP)that must be modified are those relating
to i)illicit discharges,2)construction site stormwater runoff control,and g)post-construction
stormwater management.Regarding illicit discharges,the city currently has ordinances allowing them
to inspect properties if illicit discharges are occurring,but the City will need to supplement their current
regulatory mechanisms to specifically address illicit discharges(for example,clearly defining illicit
discharges and defining exemptions to the discharge prohibition).To address construction stormwater
runoff control,the City will have to update its Stormwater Drainage and Soil Erosion Ordinances as well
as other stormwater runoff control regulatory mechanisms to be at least as stringent as the MPCA's
Construction Stormwater(CSW)Permit.To address post-construction stormwater management,the
City's Code of Ordinances will be updated,as well as sections of the Local Surface Water Management
Plan.

Reference: MPCA MS4 Permit-Tasks to Complete SWPPP Implementafion
Stantec proposes redlining the City's regulatory mechanisms with the proposed update,and adding a
Stormwater Management chapter to the existing City Code.Stantec will then submit these to the city
for review.
City Responsibilities:Review and provide feedback on proposed ordinances,and adopt into City Code
of Ordinances
Stantec Deliverable(s):Suggested Illicit Discharge,Construction Site Stormwater Runoff control,and
Post-Construction Management ordinance or stormwater management updates to existing Code.
Task 2:Develop Enforcement Response Procedures
The MS4 Permit requires that the City develop Enforcement Response Procedures(ERPs),which will
describe the enforcement,implementation,and documentation procedures related to the City's:
• Illicit discharge requirements,
• Construction site stormwater runoff control requirements,and
• Pond-construction stormwater management requirements
These three focus areas encompass the City's stormwater related regulatory mechanisms.We will work
with the appropriate City staff members to review the City's existing enforcement procedures and
provide a list of recommendations for improvements to these procedures to adequately meet the MS4
Permit requirements.
The end product in developing ERPs will include three stand-alone documents,one for each regulatory
mechanism mentioned above.These documents will provide the City with a method of tracking
enforcement actions,will provide procedural action steps,and will document tasks performed to
address the action.Additionally,Stantec will add Storm Water Illicit Discharge and Illicit Connection
sections to the existing City Ordinances,and include information in the most recent Local Surface
Water Management Plan that identifies ERPs for Post-Construction Stormwater Management.
We propose one meeting with City staff(2 Stantec staff members will attend)to review and discuss the
city's existing enforcement procedures to prepare the draft ERP documents.The draft ERP documents
and final ERP documents will be transferred between Stantec and the City via email,with no face-to-
face meetings proposed.
City Responsibilities:Compile and review existing enforcement procedures,review and comment on
draft ERP documents,implement ERPs,provide feedback on proposed ordinances,and adoption of
proposed ordinances
Stantec Deliverable(s):Draft ERP documents,final ERP documents,draft new ordinances,update
LSWMP to include information on Post-Construction Stormwater Management
Task 3:Stormwater Webpage Content Development
The MS4 Permit requires that a public education and outreach program be developed and
implemented.This includes the need to update the City's stormwater webpage.Stantec will provide the
City with stormwater webpage content recommendations.The website will provide stormwater related

Task 4:Potential Illicit Discharge Prioritization
As part of the Minimum Control Measures section of the City's SWPPP Document(Part II.D.5),the City
must identify priority areas for potential illicit discharges and the outfalls in these areas.We will review
the City's existing outfalls and provide the City with a list of priority outfalls.The MS4 Permit requires

Task 6:Facilities Inventory
As part of the Minimum Control Measures section of the City's SWPPP Document(Part II.D.S.),the
MS4 Permit requires that the City develop a facilities inventory for all facilities owned or operated by
the City.This inventory should include a map of the facility locations,along with a list of inventoried
facilities that includes information required by the MS4 Permit.Our scope of services to perform this
task includes the following elements:
• Work with the City to identify all facilities owned or operated by the City.Locate these facilities
on a map.
• Prepare a matrix identifying the facility type,pollutant(s)of concern potentially generated by
the facility,current maintenance practices,and BMPs necessary to prevent or reduce pollutants
from these facilities.
• A field evaluation of specific City facilities that warrant a more in-depth review to develop site
specific BMPs.The facilities included in this field evaluation will be limited to facilities with a
higher potential for pollutant runoff(e.g.stockpile areas,vehicle service locations,outdoor
storage yards,etc.).The field evaluation will involve one site inspection of the identified
facilities,which would include meeting with appropriate City staff to discuss practices,and a
site-specific BMP write-up.
In addition to the field assessment,we propose one additional meeting with City staff(2 Stantec staff
members to attend)to present a draft facilities inventory and receive input.
City Responsibilities:Provide Stantec with the location and description of all facilities owned or
operated by the City,along with the City's current maintenance practices

Task 7:Pond Assessment
The MS4 Permit requires that the City"develop procedures and a schedule for the purpose of
determining the TSS and TP treatment effectiveness of all permittee owned/operated ponds constructed
and used for the collection and treatment of stormwater"(Part III.D.6.d).We propose to address this
requirement by performing a desk analysis to estimate pond treatment effectiveness,and use this
analysis to prioritize a field assessment of ponds.The desktop analysis will include an evaluation of
parameters such as:pond age,pond size vs.drainage area,pond design drainage area vs.current
drainage area,previous pond maintenance actions,and land use tributary to the pond.We do not
propose any water quality modeling associated with this task.
We do not propose any field work or face-to-face meetings with the city to complete this task,but will
coordinate the assessment with City staff via email and phone.

Task 8:Staff Training
The MS4 Permit requires that the City improve the existing employee stormwater training program to
include the following elements:
• Illicit discharge inspection,recognition,and tracking
• Address the importance of water quality
• Cover the requirements of the permit relevant to the duties of the employee
• Include a schedule that establishes initial training for new and/or seasonal employees and
recurring training intervals for existing employees to address changes in procedures,practices,
techniques,or requirements
Two other areas that may be helpful to train staff in are:
• Conducting MS4 inspections(we will provide MS4 inspection documentation forms)
• Conducting construction site inspections(we will provide a construction site inspection
checklist)
We propose to one staff training session in 2oi8 that will cover all of the elements described above.
Additional staff training in subsequent years will be discussed with the City at that time.

Task 9:MS4 Mapper
The MS4 Permit(Part II.D.4)requires that MS4s have a stormwater system map that includes the

• Structural Stormwater BMPs
• All receiving waters(MS4 Ponds,wetlands,lakes,rivers,streams,etc.)
Stantec has GIS information of the City's stormwater system.This task includes a review of this GIS
information and modifications to the map to incorporate all the MS4 information has been identified,
per the MS4 permit.We will continue to work with the City to perform the mapping updates and map
production.
We do not propose any face-to-face meetings with the City to complete this task,but will coordinate the
mapping updates with City staff via email and phone.
City Responsibilities:Review and provide feedback about this City's stormwater system and MS4 Map

3.Modifications to the Scope of Services
Any additions,including any of the exclusions listed,above,or reductions to the Scope of Services(Tasks

The City of Oak Park Heights is excited by the opportunity to support Twin Cities Habitat for Humanity(TCHFH)in its
efforts here in the County. As the region grows and expands,communities such as ours are seeing an increase in the
need for quality units of affordable workforce housing.
However,as is the case with many Metro Area communities,our area often struggles to meet housing goals. The City
believes strongly that TCHFH is a good partner to provide housing opportunities and fully support its application for
HOME/CDBG funds to assist with acquisition-rehab-resale project in our community. We understand that TCHFH is
looking to purchase 4 existing homes to rehab in Washington County. TCHFH plans to remodel these properties in
order to provide affordable homeownership opportunities to low-to-moderate income households.
TCHFH has sold homes to over 1,100 households since 1985 and will serve an important role in our community by
providing affordable homeownership opportunities for low-to-moderate income households. Providing homeownership
opportunities for this income group is extremely difficult in our region, but with the support of the Washington County
CDA,these new housing opportunities can be better realized.

Hi Eric: TCHFH is again this year submitting to Washington County an application for HOME/CDBG funding for the
acquisition/rehab of existing homes in the County. In past years we have successfully secured funding for new
construction lots in the County. This funding round we are pursuing$250,000 for purchase of existing housing stock that
is in need of$40,000-$50,000 of rehab work. We feel those types of opportunities exist in the City of Oak Park Heights.
We are asking if you would support our application by providing a Letter or Support to Washington County. To be clear
we are not asking for financial support from the City,we have reserved spots in our upcoming 50 unit build season for
these projects. If successful with Washington County funding,we have the capacity to proceed with the projects with

Phoenix LLC DBA Fiesta Cancun Stillwater has applied for a new on-sale intoxicating liquor

All application materials have been investigated by the City Attorney and found to be in
compliance with the City Ordinance requirements for liquor license issuance. The investigation
fee has been paid.
As of January 5, 2018, the criminal history background had not yet been completed by the Oak
Park Heights Police Department.
Notice of this Public Hearing was published in the St. Paul Pioneer Press on December 31, 2017
and has been posted at City Hall since December 29, 2017.
Pending passage of the criminal history background being conducted by the Police Department,
City staff recommends approval of the on-sale intoxicating liquor license including Sunday sales
for Phoenix LLC DBA Fiesta Cancun Stillwater contingent on approval from the Minnesota

Warren Wasescha, representing First Presbyterian Church has made application for a
Conditional Use Permit and Variance application for Signage at 6201 Osgood Avenue.
The application consists of requests for a Conditional Use Permit to allow for number of
signs and aggregate square footage of sign area on site and Variance to allow for the
proposed setback to property line. The existing monument sign on Osgood Avenue
must be replaced to accommodate the additional right of way required by Washington

ISSUES ANALYSIS
Project Narrative. Mr. Wasescha has provided the following narrative that is also
found within Exhibit 3.
In order to provide traffic and pedestrian safety, Washington County is widening Osgood
Avenue to add a center lane, right tum lane, and sidewalk in front of our church. While
good for safety, the project will take 15 feet of our front face to Osgood Avenue, leaving
only 13 feet of land between the new sidewalk and existing parking lot, less width than
our current sign takes now. We are asking for a variance to the current R-3 signage
ordinance to construct a new sign with similar sign square footage as the original, and
also a variance to the setback ordinance of 5 feet, due to the restricted size of the
remaining land. The new sign will be just under 8 feet wide, leaving approximately 2
fleet of space between the new sidewalk and the sign, and 2 Y feet of space between
our existing parking lot curb and the sign. The overall monument sign itself will be
significantly smaller, due to the removal of the two large pillars that exist today. The
sign with itself will shrink from the current 96-inch width to 88-inch width. Overall the
height of 6.67 feet will be similar to the existing monument sign height, and within
ordinance guidelines.
Comprehensive Plan. The Comprehensive Plan designates this area as quasi-public,
which includes churches, on the Proposed Land Use Map. The use of the property for a
church is consistent under this land use.
Zoning Ordinance. The property is zoned R-3, Multiple Family Residential in which
churches are a Conditional Use. The Applicant has applied for a Conditional Use
Permit to allow for number of signs and aggregate square footage of sign area on site
and Variance to allow for the proposed setback to property line. Review of the criteria
for Conditional Use Permits and Variances is found later in this report.
Signage. The R-3 District, in Section 401.15.G.8.b. allows for uses such as churches,
one monument sign, not to exceed eight feet in height and one wail sign. The
aggregate square footage of sign space shall not exceed 40 square feet. The church
signage was installed before the current sign regulations, and exceeds the allowances.

Conditional Use Permit
The proposed new sign is to replace the monument sign on Osgood Avenue. The new
sign will be built Into a substantially smaller support structure and the sign face will be
reduced from the existing 35.2 square feet to 34.2 square feet. There is no increase in
numbers of sign, just the replacement of the Osgood Avenue sign and replacement of
the sign face of the 62nd Street sign. With a total of four signs and 127 square feet of
signage with the replaced sign, a Conditional Use Permit is required. The height of the
new sign, at 6.6 square feet is less than the eight-foot height limit.
The sign regulations allow for exceptions in numbers of, height, or size of signs by
Conditional Use Permit.
Variance
Additlonaliy, Section 401.15:0.4.m of the sign reguWAkm Mates Wo part of a sign
or sign structure shall be placed closer to the property line than five (5) feet." The new
sign will be 2.5 feet from the property line/sidewalk and 2.5 feet from the edge of the
church's parking lot. The proposed sign is 7 feet 10 inches wide, and will be placed in
the 13 foot distance from the sidewalk and the curb of the parking lot. Washington
County has indicated that the new right of way line will be adjacent to the sidewalk in
this section of roadway. A survey of the new property line has not been provided by the
County at this time. The Public Works Director has indicated that the City will maintain
this sidewalk and confirmed that the 2.5-foot setback would be adequate for sidewalk
snow clearing and maintenance purposes.
A variance is required to vary from the sign setback requirement.
Sign Illumination
The proposed sign will be a back lit LED with panels that are opaque except for lettering
and logos. The black letters will glow white at night and the logo will remain the same
color as daylight. The sign will have changeable message panels that will also be lit at
night. The proposed sign lighting, as presented, appears to comply with the Zoning
Ordinance lighting requirements. Staff will approve the lighting specifications for the
signs at the time of permitting.
Conditional Use Permit. The Planning Commission and City Council should consider
the following issues and impacts of the proposed project in making its recommendation.
The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning
Ordinance, are found as follows:
1. Relationship to the specific policies and provisions of the municipal
comprehensive plan.
2. The conformity with present and future land uses in the area.
3. The environmental issues and geographic area involved.

4. Whether the use will tend to or actually depreciate the area in which it is
proposed.
5. The impact on character of the surrounding area.
6. The demonstrated need for such use.
7. Traffic generation by the use in relation to capabilities of streets serving the
property.
8. The impact upon existing public services and facilities including parks,
schools, streets, and utilities, and the City's service capacity.
9. The proposed use's conformity with all performance standards contained
herein (i.e.,parking, loading, noise, etc.).
Comment: The replacement of the monument sign should not create an issue for
neighboring properties and is a substantially smaller structure overall than what exists.
The sign will be placed far enough from the intersection of Osgood Avenue and 62nd
Street North that there will be no visibility issues at the intersection. The overall number
of signs onsite has not created issues for the neighborhood or the City. The request is
minor and not out of nature with other requests that have been granted to vary from the
sign regulations. City Staff sees no issues with the request as proposed.
Sign Variance. Variance criteria are provided in Section 401.04 of the Oak Park
Heights Zoning Ordinance. The Planning Commission and the City Council should
review the following criteria and conditions to determine if the sign variance is justified.
Review Criteria. The Planning Commission and City Council should make a finding of fact that
the proposed action will not.
a. Impair an adequate supply of light and air to adjacent property.
b. Unreasonably increase the congestion in the public street.
c. Have the effect of allowing any district uses prohibited therein, permit a lesser degree of
flood protection than the flood protection elevation for the particular area or permit
standards which are lower than those required by State law.
d. Increase the danger of fire or endanger the public safety.
e. Unreasonably diminish or impair established property values within the neighborhood, or
in any way be contrary to the intent of this Ordinance.
f. Violate the intent and purpose of the Comprehensive Plan.
g. Violate any of the terms or conditions of Item 5, below.
h. Conditions for Approval. A variance from the terms of this Ordinance shall not be
granted unless it can be demonstrated that:
a. Undue hardship will result if the variance is denied due to the existence of special
conditions and circumstances which are peculiar to the land, structure, or building
involved and which are not applicable to other lands, structures or buildings in the same
district.
1) Special cases may include exceptional topographic or water conditions or, in the
case of an existing lot or parcel of record, narrowness, shallowness, insufficient area
or shape of the property.
2) Undue hardship caused by the special conditions and circumstances may not be
solely economic in nature, if a reasonable use of the property exists under the terms
of this Title.
3) Special conditions and circumstances causing undue hardship shall not be a result of
lot size or building location when the lot qualifies as a buildable parcel.

b. Literal interpretation of the provisions of this Ordinance would deprive the applicant of
rights commonly enjoyed by other properties in the same district under the terms of this
ordinance or deny the applicant the ability to put the property in question to a reasonable
use.
c. The special conditions and circumstances causing the undue hardship does not result
from the actions of the applicant.
d. Granting the variance requested will not confer on the applicant any special privilege that
is denied by this Ordinance to other lands, structure or buildings in the same district
under the same conditions.
e. The request is not a result of non-conforming lands, structures or buildings in the same
district.
f. The request is not a use variance.
g. The variance requested is the minimum variance necessary to accomplish the intended
purpose of the applicant.
h. The request does not create an inconvenience to neighboring properties and uses.
Comment: The sign should not have any neighborhood impact and will not endanger
the public safety. The sign replacement has not been initiated by the Church, but is
required by Washington County to make roadway improvements to Osgood Avenue.
The sign structure has been reduced substantially, and the sign face is smaller than the
existing sign. The Church has indicated that a sign of this size is necessary for visibility
along Osgood Avenue. The Public Works Director has indicated there should be no
issues with maintaining the sidewalk with a 2.5-foot setback. The 2.5-foot setback on
the parking lot side is also necessary for maintenance purposes.
City Staff does not have an issue with allowing the sign setback variance.
CONCLUSION AND RECOMMENDATION
If the Planning Commission agrees to recommend the requests for the Conditional Use
Permit and Variances, they should consider the conditions that follow: City Staff
recommends the Conditional Use Permit and Variance request.
• Conditional Use Permit - To allow for a total of four signs where two are allowed
and an aggregate square footage of sign area on site of 127 square feet where a
maximum of 40 square feet are allowed.
• Variance—To allow a 2.5-foot setback where a five-foot setback is required from
the Osgood Avenue right of way.
1. The monument sign shall be placed no less than 2.5 feet from the right of way
line of Osgood Avenue. The Applicant provide an as built survey of the sign
once installed. The survey shall show the setback distances from the property
line to the sign and the parking lot curb to the sign.
2. The sign specifications and methods of illumination shall be subject to review and
approval of the City at the time of permitting.

I have reviewed the landscape plan submitted dated 11/20/17 from Abrahamson Nurseries for
the First Presbyterian Church of Stillwater. The following Includes my comments and/or
recommendations:
Landscape Plan
The overall landscape plan submitted includes a satisfactory selection of shade trees, shrubs,
perennials and grasses to be planted. The design is acceptable and will complement the site
well. Most plants chosen are hardy under local growing conditions, tolerant or resistant to
major insect and disease problems and fairly low maintenance.
I would however like to make a recommendation in regards to substituting the trees on the
plan. The Autumn Blaze Maple is a tree that can be fast growing and is a large shade tree. In
this area there are overhead utility lines, a sidewalk that will require maintenance with snow
removal equipment and also traffic visibility from the road and your parking lot in which large
trees can obstruct,therefore I would like to recommend substituting the Autumn Blaze Maples
with an ornamental tree species such as a Japanese lilac 'Ivory Silk' or a scab resistant
variety of crabapple such as Malus'Prairifire'crabapple and/or Malus'Royal Raindrops'.
Plant List, Landscape (dotes &Details
The Plant Schedule/Plant List was not submitted. This must include Plant Names(Common &
Botanical), Plant Quantities to be planted, Root Condition/Containter Class, and Size. A plant
legend should also be included on the plant and In the Plant Schedule/Plant List. The
landscaping notes, landscape requirements and planting details were not submitted. These
items must be submitted. The planting detail for trees, shrub and perennial plants, and steel
edging must also include a diagram for each. The landscape contractor is required to plant

trees and shrubs according to the final approved planting detail submitted with the final
approved landscape plan. This will be checked after planting and any deviations from the
plan will need to be corrected before the landscaping will be approved by the City, this needs

should also be followed and noted in the landscaping notes.

Church to allow a Conditional Use Permit for number of signs and aggregate square
footage of sign area on site, and Variance to allow for a proposed setback to the property
line,located at 6201 Osgood Avenue; and after having conducted a public hearing
relative thereto,the Planning Commission of Oak Park Heights makes the following
findings of fact:
1. The real property affected by said application is legally described as

that has a sign face of 34.2 square feet, a reduction from 35.2 square feet and set on a
smaller support structure than what exists; and
8. The Applicant has proposed to replace the sign face of the existing
monument sign on 62nd Street with a sign face of the same size; and
9. A Conditional Use Permit is required to vary from the number of signs
and allowable sign area for the site; and
10. A Variance is required to vary from the setback to the property line on
Osgood Avenue; and
11. City staff prepared a planning report dated December 6,2017 reviewing
the request; and
12. Said report recommended approval of the request,based upon a review of
the Conditional Use Permit criteria found in Section 401.03.A.7, and Variance criteria
found in Section 401.04 of the Zoning Ordinance, as well as the fulfillment of conditions;
and
13. The Planning Commission held a public hearing at their December 14,
2017 meeting, took comments from the Applicants and public, closed the public hearing,
and made the following recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE

The Central St. Croix Valley Joint Cable Commission is a joint powers entity representing the cities of
Bayport,Oak Park Heights,Stillwater,and the townships of Baytown and Stillwater. The cities each have
one elected and one citizen representative that attend regular meetings.The City has been seeking a Citizen
Rep.for some time since the departure of Mr.Guy Sederski.The City has recently received an application
of interest from Mr.Graham Arntzen of 5670 Negate Circle.His information is enclosed.
As there is no clear committee for vetting applicants to the Commission,I(along with City Administrator
Eric Johnson)did meet with Mr.Arntzen and believe he would be a good fit for the appointment—which
is made annually by the Council.His letter of interest and resume is enclosed.
I would recommend his appointment.
Background. The commission meets every other month on the third Wednesday at 7:00 p.m. The commission is
the franchising authority for cable television in our area. They are in charge of making sure that the franchise with
the cable company is beingfollowed and negotiating a new franchise,when appropriate. At meetings,the commission
takes action on several issues such as approving budget expenditures,joining telecommunications organizations,
keeping informed on legislative cable franchise issues and handling complaints regarding cable services.

Park Heights in July of 2017 and I've been xNaiting for an opportunity to become engaged in our local
governance. I believe this position is a great fit with my wgxmience and i would welcome the chance to
a Tresent the citizens of Oak Park Heights an the Joint Cable Communicatioms Commission
Regarding my experience,I have worked in regulated amronments since 2010 and understand the
nuance of these working arrangements. NiUe I have not directly negotiated fianchise agreements,I have
supported the customer rrpacentatives that have done so and I am familiar with the process. In addition,
I have led trams that monitored state legislative dnvlopments and set strategies for responding to those
developments. Finally,i have prior board experience and can embsace the responsibilities of the
CoMmissiom.
