Staff Present: Community Development Director Danielson, City Planner Richards Community Development Secretary Hultman, and Planning Intern Hoel. City Council Liaison Swenson. Absent: Commissioners Dwyer and Vogt. Approval of Agenda: Commissioner Dahlquist, seconded by Commissioner Wasescha moved to approve the Agenda as presented. Carried 3 -0. Approval of Minutes,: Commissioner Wasescha, seconded by Commissioner Dahlquist, moved to approve the Minutes of December 16, 1999 with a minor clerical correction to Circle of Friends hours of operation ending at 11 p.m. and not 11 a.m. as indicated. Carried 3 -0. Introduction of Planning Intern: Community Development Director Danielson introduced Matt Hoel to the Commission. She informed them that in the capacity of Planning Intern, Matt would be workin g with the Community Development Department 20 hours each week. The Commission welcomed Matt. Visitors: None. PUBLIC HEARINGS: A. Northern States Power - Conditional Use Permit Request: City Planner Richards informed the Commission that Northern States Power had contacted the City and requested a continuance of their hearing, allowing them time to reconsider their plans and specifications regarding the location and maintenance facility at their fly ash landfill facility. Due to the public hearing having been advertised Chair Hedlund opened the public hearing for comment at 7:06 p.m. Being no visitors to the public hearing, Commissioner Wasescha, seconded by Commissioner Dahlquist moved to continue the public hearing to 7:00 p.m., February 10, 2000. Carried 3 -0. PW# a - Planning Commission Minutes January 20, 2000 Page 2 of 3 Old Business: A. Post Office Update: Community Development Director Danielson that the City Council, at its January 11, 2000 meeting approved a development agreement with the U.S. Postal Service for construction of the Oak Park Heights Carrier Annex at the corner of 55 St. N. and Memorial Ave. N., within the Kern Center. Danielson displayed the concept drawing of the project, noting special criteria existing due to the Postal Service's federal agency status. She also outlined the agreement reached between the City and the Postal Service, noting that through the agreement significant improvements were negotiated resulting in an attractive addition to the Kern Center. Brief discussion ensued as to design, employment opportunities, and regulation of the project. Swenson complimented City Staff as having worked very well with the project. B. Planning Commission Meetinsz Day Chansze: Community Development Director Danielson advised the Commission that their recommendation to the City Council for amendment to the Planning Commission By -Laws to change the meeting date from the third Thursday of each month to the second Thursday of each month was approved. Accordingly, the next meeting of the Planning Commission will be February 10, 2000. C. Capital Improvement Budszet: Community Development Director Danielson reviewed, with the Commission, budgetary goals and breakdown per her enclosure to the meeting packet. Brief discussion was held as to project items. The Commission was pleased with the opportunity revitalization of the area known as Lower Oak Park Heights and expressed that they were looking forward to working on the project. Danielson also informed them that the Parks Commission would be meeting January 31, 2000 at 6:30 p.m. for the purpose of a Capital Improvement Budget workshop and extended an invitation to the Planning Commission to participate in the workshop. New Business: A. 2000 Goal Setting Meeting: Community Development Director Danielson informed the Commission that the date of March 10, 2000 has been tentatively set to discuss the goals for the City in 2000. She advised them that she would notify them of firm information as she received it. Danielson also indicated that the Planning Commission should begin thinking of goals for the Commission and suggested that discussion of possible goals take place at their meeting of February 10, 2000. Informational/Uodate : A. Citv Council /Commission Meetinia Follow Uv Agenda(s): Receipt acknowledged by the Commission. Danielson noted that beginning with the February agenda, this item would no longer be placed on the Agenda. The Follow Up Agendas will be distributed to the Commissions with their weekly mailing. Y2k and New Years Eve: Community Development Director Danielson reviewed packet enclosure memo regarding the preparations and activity that took place during the hours prior to the New Year coming in. She noted that preparation by the City for this event, resulted in better understanding the City's civil defense needs and added that the Civil Defense Director will be holding an meeting later this Spring and that she would update them as to this as she received information. C. Communication.: Community Development Director Danielson noted that requests for increased e-mail communication. She asked the Commission to review the Planning Commission Member List and update it as needed and provide their e-mail address if they would like it included as a tool to communicate with them. D. Other: 1). Northern States Power Park: City Council has approved moving forward to receive proposals for a park master plan. 2). Lower Oak Park Heights (Calthorpe Studv): Metropolitan Council will be holding a luncheon meeting at the Washington County Government Center to discuss their study and its implications to included communities. She indicated that she would provide them with more information upon her receiving it. Hultman Community Development Secretary Enclosure 2 NORTHWEST ASSOCIATED CONSULTANTS t4 F1 COMMUNITY PLANNING - DESIGN - MARKET RESEARCH PLANNING REPORT TO: Tom Melena FROM: Scott Richards DATE: February 3, 2000 RE: Oak Park Heights - NSP Fly Ash Disposal Facility: Building Relocation FILE NO: 798.02 - 99.23 BACKGROUND NSP has submitted revised plans as part of the request for a conditional use permit for • relocation of the existing storage building at their fly ash disposal facility located at 59th Street North and Peller Avenue. The building is to be relocated approximately 700 feet west of the intersection of 59th Street and Peller Avenue in a location more central to the active area of the ash landfill. The construction trailer is to be moved off of the ash landfill site and is not part of the current request. The Oak Park Heights Zoning Ordinance, under Section 401.15.C.8 does not allow for pole buildings unless they are to be utilized for farming operations or in highly unique or special cases requiring a conditional use permit. Additionally, Section 401.15.) requires a conditional use permit for relocation of any structure over 120 square feet on a lot or onto another lot in the City. Any new or relocated building would also be subject to the Design Guidelines of the City. The City recognizes this building as a unique situation in that it has existed on the ash facility for a number of years and that it is regarded as a temporary structure. The revised, proposed location of the storage building is in an area of the site that is considerably less visible than what is originally proposed. The building will be set to the west of Beach Road and the existing bed and breakfast. The structure will be approximately 38 feet below the elevation of the bed and breakfast and 45 feet below the elevation of the previously proposed location. In that the building is 20 feet in height, it is highly unlikely that it will be visible from the adjacent roadways or from . Y the bed and breakfast. Additionally, the landscaped area separating the residential area from the landfill facility will further screen any of the activities on the site. NSP indicates that the proposed location is temporary and the building will remain there only until future landfill development causes relocation. It is estimated that relocation or rebuilding will be required again in 2004 to 2005, if current landfill development rates continue. NSP has not indicated where a new or rebuilt building would be located, but they acknowledge that a structure would be needed to serve some post landfill and park related uses. Comprehensive Plan. As indicated in the previous planning report, the Comprehensive Plan discusses the recreational reuse of portions of the ash facility and the importance of its relation to Valley View Park. Concern was expressed with the previous location and its adverse impact to the neighborhood and park areas. If the building is located on the site so that it is not visible, there are no comprehensive planning issues. Zoning /Conditional Use Permits, The NSP building will be treated as a temporary structure with a definite date by which it will need to be removed or rebuilt. The City will require NSP to remove or destroy the building by December 31, 2005 or apply for an amended conditional use permit for its relocation and /or reconstruction on the site. The City will require the building to comply with Uniform Building Code and Design Guideline requirements when it is rebuilt, reconstructed, or replaced with a new structure. Health and Environmental Impacts. Moving the building to a new location on the site should not have any negative health and environmental impacts. The continuing operation of the ash facility does raise questions in regards to health and environmental safety. As part of this conditional use permit request, the City will require NSP to provide its health reports on fly ash including air quality monitoring reports. Additionally, it is recognized that the ash facility contributes to the runoff into the Perro Creek system. NSP has provided its storm water plans for the site as a part of this request. NSP will also be required to contribute its fair share of the costs related to improvements required to Perro Creek Pond to eliminate flooding issues. In that the ash facility, especially those portions that are "capped ", contribute to the runoff and flooding problems along Perro Creek, NSP will need to be a participant in the solutions to the problem. It is suggested that a development agreement between NSP and the City outline the required information and the cost sharing for the storm water improvements. 2 Design Guidelines. The Design Guidelines indicate that industrial and warehouse buildings must use at least two different Grade I or II materials of which at least 65 percent will be Grade I and II, and not more than 35 percent Grade III and IV materials. The building is a typical pole barn with steel siding, no windows and two doors one large access and one entry door. The building is comprised of almost 100 percent Grade II materials (exterior finish installation system) and would in no way a of the other y design requirements related to composition and detailing, especially the blank g p y wall surfaces. Variations to the Design Guidelines can be permitted b the City Council. In Y ty that the building is recognized as temporary and that it will be out of sight from g the neighborhood and adjacent roadways, staff recommends that the building be allowed . g d without major upgrades to comply with the Design Guidelines. Once the conditional g use permit, if approved, has expired, any new or relocated building ould need to be upgraded g pg ed to Design Guidelines standards. Fencing, Screening, and Landscaping. The natural elevation of the ro osed building P p g site should satisfy any screening requirements of the Zoning rdinance. NSP has g proposed the installation of security fencing and signage related to landfill operations to commence this Summer. The City would request that NSP add landscaping aloe the p 9 g northerly berm area of the ash facility and provide required landscape and prairie seeding a p p g plans subject to City Arborist approval. The site plan, labeled Exhibit A indicates the ar for 2000 construction activity. NSP will meet with City taff within coming months Y g the to discuss landfill development plans and landscaping. g Building Code Requirements. The building will be required to meet all Uniform Buildin Code requirements once it is placed on the site, includin g an adequate foundation. The plans shall be subject to review and approval of the Building ... .. pp g Inspector. Restroom facilities and utility connections will not be required for the building g i in that t will not be used for office or meeting space. If any portable toilets are to be used on the site, they shall be located within the building. Billboard. A non - conforming billboard exists on the NSP roe adjacent to Highway p p ttY J g Y 36. As a part of the conditional use permit, the City require uire the billboard to be removed a within six months after the conditional use permit is approved. The terms of the billboard removal will need to be agreed to by the City and NSP as part of an overall development agreement. Fly Ash Facility Access. The site plan indicates the access driveway nto the fl ash Y Y facility along Beach Road. A short asphalt apron is in place to facilitate tire cleaning efore g trucks enter City streets. City staff recommends that the asphalt driveway be extended at least 120 feet to facilitate tire cleaning. Additionally, the City will re . ... i Y �v re quire that all tire a washing act as required in previously approved conditional use permits for the site . p , be utilized. NSP will also be required to add a stop sign at Beach Road so that trucks come to a complete stop before leaving the property. 3 Trails. To provide access through the NSP property and provide connections with existing ng and proposed trails, the City will require the construction of trails on the fly ash site and along the power line easement area within lower Oak Park Heights. The City has g tY plans p to construct a trail system within lower Oak Park Heights and Valle View Park in the • .. Y Summer of 2000. Linkages with the fly ash facility and along the power line corridors will . g p be critical to completing the overall connections between east and west Oak Park Heights. Additionally, the trails will be necessary for completing the links between the planned ark p p areas on the fly ash facility to Valley View Park. The specifications and locations of the trails shall be outlined in the development agreement. Conditional Use Permit Criteria. The judgement of the Planning ommission and City tY Council regarding the application is to be based upon, but not limited to, the followin factors outlined in Section 401.03.A.7 of the Zoning Ordinance: a. Relationship to the specific policies and provisions of the municipal Comprehensive Plan. b. The conformity with present and future land uses in the area. C. The environmental issues and geographic area involved. d. Whether the use will tend to or actually depreciate the area in which it is ro osed. p p e. The impact on the character of the surrounding area. f. The demonstrated need for such use. g. Traffic generation by the use in relation to capabilities of streets servin g the property. h. The impact upon existing public services and facilities including arks schools streets, and utilities, and the City's service capacity. i. The proposed use conforms with all performance standards contained herein i.e. parking, loading, noise, etc.). Based upon the previous analysis, the revised, proposed location could be approved. The pp building will be located on the site such that it will not be seen from the surrounding neighborhood and adjacent roadways. In that the structure will be temporary, it will not have long term consequences for future land uses in and around the site. Additionally, the building should not change the character of the area or have a negative impact on traffic • .. g p generation or public services or facilities. The City Council will need to determine if the Design Guidelines are to be enforced for this structure. 4 Section 401.15.C.8 specifies criteria for conditional use permit approval related to pole building exceptions and other building type and construction standards. These criteria are as follows: C. Exceptions to the provisions of Section 401.15.C.8 of this Ordinance may be granted as a conditional use permit pursuant to Section 401.03 of this Ordinance, provided that: 1) The proposed building maintains the quality and value intended by the Ordinance. 2) The proposed building is compatible and in harmony with other existing structures within the district and immediate geographic areas. 3) The provisions of Section 401.03.A.8 of this Ordinance are considered and determined to be satisfied. The building is considered a temporary structure that will be totally screened by the natural elevation and existing vegetation. City staff suggests that the building be allowed with no major exterior upgrades but any relocation, reconstruction, or new construction of a building after 2005 be required to comply with all Design Guidelines. Section 401.15.J.2 of the Zoning Ordinance specifies performance standards relating to conditional use permits for relocating buildings within Oak Park Heights. The standards are as follows: a. Upon relocation, the building shall comply with the applicable requirements of the Uniform Building Code in effect in Oak Park Heights. b. The proposed relocated building shall comply with the character of the neighborhood in which it is being relocated as determined by the City Council. C. The relocated use will not result in a depreciation of neighborhood or adjacent property values. d. The relocated structure shall be similar to the market valuation of adjacent principal structures as determined by the City Assessor. Again, because of its isolated location, the building should not adversely affect the character of the area or result in depreciation of property values. The Building Official will review the building plans to assure compliance with all Uniform Building Code provisions. • 5 RECOMMENDATION Based upon review of the conditional use permit criteria specified in this re ort our p p u office recommends that the revised, proposed building location be approved. We would further recommend that the City Council allow the existing structure to be relocated without strict conformance to the Design Guidelines. Details related to erosion control health reportin � p g on fly ash, storm water issues, funding of Perro Creek imp rovements , and billboar removal will need to be discussed with NSP and finalized in a development agreement. The approval of this conditional use permit is subject to the followin g conditions: 1. NSP shall destroy or remove the building from the ash landfill roe and the C property rtY CUP shall expire by December 31, 2005 or NSP shall apply for an amended conditional use permit for its relocation and /or reconstruction. NSP shall contribute a proportionate share of the costs related to storm water runoff improvements required for Perro Creek Pond. A g development agreement shall be p executed between NSP and the City outlining the cost sharing or storm water i g improvements. 4. The building shall be required to comply with all Uniform Buildin g requirements uirements q as approved by the Building Inspector, including an adequate foundation once its replaced on the proposed site. Any portable toilets to be placed on site shall be within the building. 5. Landscaping shall be placed on the northerly berm area of the ash facility. All tY plans p for landscaping, including areas that have been seeded as prairie and the berm p area shall be subject to City Arborist review and approval. 6. The access from Beach Road shall be paved by NSP with an asphalt surface and extended at least 120 feet to facilitate tire cleaning. A stop sign shall be installed at the intersection by NSP. 7. Trails shall be constructed within the fly ash site and along NSP power line corridors to provide connections with existing and proposed City trails. The trail locations and specifications shall be subject to approval of City staff and included in the development agreement with NSP. 6 8. The City will require the non - conforming billboard on the ash landfill site to be removed within six months after the conditional use permit is approved. 9. The construction trailer shall be removed within ten days following approval of the conditional use permit. Relocation of the trailer on the ash landfill site shall require conditional use permit consideration. 10. Since the pole building will be moved to a less prominent location on the site, which will be screened in part by topography, it does not appear that NSP will need to put in landscaping to screen that structure. Regarding other landscaping for the site, I would like to see planting detail for the long berm which runs NE -SW through the site and which will serve a screening function for the still active portion of the landfill. I would also like a list of the plant species which were seeded in the "prairie" area in the SE portion of the site. Plans for other site landscaping would also be helpful. The reason for this continuation request is to provide time to assess p ermit conditions recommended in Scott Richards Planner's Report. This Report was submitted to Tom Melena on February 3 and was forwarded to NSP on February 7 Recommended permit conditions that NSP believes need clarification include the following: g • "NSP shall contribute a proportionate share of the costs related to storm water runoff improvements required for the Perro Creek Pond." While NSP recognizes there are storm water management problems associated with the Perro Creek Watershed, NSP has not been directly involved in developing improvements nor assessing the Landfill's role. • "Landscaping shall be placed on the northerly berm area ..... subject to the City Arborist review and approval. Landscaping requirements are influenced by MPCA Permit conditions, site security needs, possible future use of closed areas, and other factors. The division of Lot 1, Block 2 into Parcel A and Parcel B would separate the 104 unit assisted living facility from the other building sections only by legal description. VSSA has made this request to facilitate financing of the Boufinrell's Landing campus. City staff has determined that an amended PUD will also be required to process this request. The subdivision would result in a change to the lot lines of the development and those lines would pass directly through the building. The City Attorney has also raised issues that must be agreed to by VSSA and the mortgagee before the City will approve the subdivision and PUD amendment. The Oak Park Heights Subdivision Ordinance allows for minor subdivision of previously platted lots if no more than two lots are created and they conform to the Zoning Ordinance lot size minimum standards. The property is zoned PUD but the lot area and setback standards of the R -B, Residential Business District have been used in the past to evaluate this project. Parcels A and B are over 7 acres in size each; the R -B District requires a lot size of at least 15,000 square' feet or .34 acres. q The Zoning Administrator (City Administrator) can approve the subdivision, provided that it complies p with applicable provisions of the Subdivision Ordinance. The subdivision complies with all ordinance requirements although a PUD amendment is also required in this case. As a result, City staff suggests that the Planning Commission make a recommendation on the subdivision and the City Council include the subdivision request with the PUD amendment as part of the action they will take on this matter. PUD Amendment. The PUD amendment is required in that an additional p arcel has been added to the development and the lot lines would be changed as they relate to the proposed building location. The PUD section of the Zoning Ordinance requires that front rear, and side yard restrictions on the periphery of the site be imposed, but interior setbacks are not required due to the flexibility provisions of the PUD section of the Zonin Ordinance. As a result, no variance will be required to accommodate the zero lot line situation that results from this subdivision. Sidewalks. To encourage a pedestrian friendly environment, City staff has reviewed the development plans for the Phase 1 development of the VSSA campus relating to sidewalks and has identified additional locations for pedestrian access. The City Engineer has reviewed the potential of adding sidewalks to Norwich Circle North (the northwest development area) and along Norwich Avenue North (the easterly twinhomes ) and has determined that adequate area exists o construct sidewalks. As . t t art of this PUD p amendment, the City will require that these sidewalks be constructed this Summer as art p of the continuing development of the VSSA campus. Additionally, the City will require Y Y q sidewalks along the access roadways as part of the Phase II development review. City staff is also requesting that VSSA consider upgrades of the asphalt trails to concrete sidewalks in those areas outside of the park and open areas. Specifications and locations for the sidewalks would be subject to review and approval of the City Engineer. Clean Up of VSSA Property. Staff has recognized that property owned by VSSA, south of 58th Street and within the former Ritzer property contains a building, structures and debris that are hazardous and should be removed. As a condition of approval of this PUD amendment, staff recommends that the building, structures and debris be removed prior to May 1, 2000. 2 City Attorney Requirements. Upon review of the subdivision request and considering . the impact on the established development agreements and permits, the City Attorney has developed a list of conditions to be applied to the request consideration. A summary of these conditions is as follows. The letter from the City Attorney is found as Exhibit B. 1. An amendment to the PUD is applied for and secured. 2. A written consent from the proposed mortgagee acknowledging the priority of the City's development control and agreement as it affects the VSSA project. 3. The mortgagee will also need to acknowledge the easements that are due to the City of Oak Park Heights in the form of roadway, trails, and potentially other park easements. 4. Trail easement conveyance as it affects established roadways should be completed before any subdivision will be allowed. 5. Impacts on the building that will be constructed across the property line will need to be addressed by the Building Official upon permit application. RECOMMENDATION Based upon the previous analysis, City staff recommends approval of the PUD amendment and minor subdivision based upon the following conditions: 1. An amendment to the planned unit development must be applied for and secured. 2. That a written consent will have to be received from the City of Oak Park Heights by the proposed mortgagee acknowledging the priority of the City's development contract and agreement as it affects the VSSA project. Specifically, the mortgagee should be required to execute a consent and acknowledgment that the obligations of the developer to the City of Oak Park Heights have priority over the mortgage as proposed to be placed upon the property by the developer and the mortgagee, and that the mortgagee shall not do any act to obstruct, impair or otherwise limit the ability of the developer to fully perform all of its obligations to the City of Oak Park Heights under the terms and conditions of the development agreement as originally executed and as may be subsequently amended between the City and the developer. 3. That the mortgagee will also have to acknowledge that there are easements yet due to be conveyed to the City of Oak Park Heights in the form of roadway and some trail easements and potentially other park easements. That we will need the commitment from the proposed mortgagee that they understand that releases as against the mortgage or deed of indenture will be freely granted by that mortgagee on behalf of the property to release same to the City of Oak Park Heights so that proper recording of easements unencumbered by the mortgage can be implemented. Further, it must be understood that there will be no fees or costs assessed to the City of Oak Park Heights by the mortgagee for those releases. 3 4. Further, it should be noted that final easement conveyance as it affects the established roadways should be completed before any subdivision shall be allowed. 5. The nature of the subdivision will have an impact on the building to be constructed across the property line. Those impacts will be addressed by the Building Inspector upon permit application. 6. VSSA shall construct all bicycle and pedestrian trails as sidewalks on those properties that will comprise the main campus and adjacent residential development. The specifications for sidewalk construction and exact locations shall be subject to City Engineer approval. 7. Sidewalks shall be added by VSSA to Norwich Circle North and along Norwich Avenue North subject to City Engineer approval of specifications and locations. 8. VSSA shall remove the building, structures and debris on the former Ritrer property, south of 58th Street, prior to May 1, 2000. 9. Residents within the lower Oak Park Heights neighborhood have requested a rezoning from R -2 to R -1. Business owner involvement on this process will be necessary. • Park and Trail Plan. The Parks Commission is beginning work on a Comprehensive Park and Trail Plan beginning in January.
