CITY OF OAK PARK HEIGHTS r : PLANNING COMMISSION MINUTES Wednesday, February 16, 2000 — 7 :00 PM Call To Order: Vice Chair Dahlquist called the meeting to order at 7:00 p.m. Present: Commissioners Dwyer and Wasescha. Staff Present: City Planner Richards, Planning Intern Hoel. Others Present: City Council Liaison Swenson. Absent: Commissioners Hedlund and Vogt, Community Development Director Danielson and Community Development Secretary Hultman. Approval of Agenda: Commissioner Wasescha, seconded by Commissioner Dwyer moved to approve the Agenda as presented. Carried 3 -0. Approval of Minutes,: Commissioner Wasescha, seconded by Commissioner Dwyer, moved to approve the Minutes of January 20, 2000 as presented. Carried 3 -0. Visitors: None. PUBLIC HEARINGS: A. Continued: Northern States Power - Conditional Use Permit Request: Vice Chair Dahlquist noted correspondence received from the applicant requesting a continuance of public hearing to March 9, 2000. City Planner Richards informed the Commission that Northern States Power had contacted the City and requested a continuance of their hearing to allow them time to assess the permit conditions recommended within the City Planners report of February 3, 2000. Commissioner Wasescha reminded the Commission of her conflict of interest in the matter, noting her inability to participate in the discussion or recommendations on the same. Commissioner Dwyer, seconded by Commissioner Dahlquist moved to continue the public hearing to March 9, 2000. Carried 2 -0, Wasescha abstained. It was noted that April 10, 2000 is the expiration date for this matter to remain active and that the applicant must appear at the March 9 public hearing in order to move forward with their application request. B. VSSA - PUD Amendment/Minor Subdivision Request: City Planner Richards provided the Commission with an overview of the request and outlined his report of February 3, 2000. Vice Chair Dahlquist opened the public hearing for comments. Peter Sajevic of Leonard, O'Brien, Wilford, Spencer & Gale, representing VSSA informed the Commission the request being made was to facilitate financing of the Boutwell's Landing Campus with the best bond rating possible. Planning Commission Minutes February 16, 2000 Page 2 of 3 There being no other visitors to the public hearing, Commissioner Wasescha, seconded by Commissioner Dwyer moved to close the public hearing. Carried 3 -0. Brief discussion ensued among the Commission as the conditions recommended within the City Planner's report, dated ,February 3, 2000. Commissioner Wasescha, seconded by Commissioner Dwyer moved to approve the PUD Amendment and Minor Subdivision Request based upon the following conditions: 1. An amendment to the planned unit development must be applied for and secured. 2. That a written consent will have to be received by the City of Oak Park Heights from the p ro ip osed mortgagee acknowledging the priority of the City's development contract and agreement as t affects the VSSA project. Specifically, the mortgagee should be required to execute a consent and acknowledgement that the obligations of the developer to the City of Oak Park Heights have priority over the mortgage as proposed to be placed upon the property by the developer and the mortgagee, and that the mortgagee shall not do any act to obstruct, impair or otherwise limit the ability of the developer to fully perform all of its obligations to the City of Oak Park Heights under the terms and conditions of the development agreement as originally executed and as may be subsequently amended between the City and the developer. 3. That the mortgagee will also have to acknowledge that there are easements yet due to be conveyed to the City of Oak Park Heights in the form of roadway and some trail easements and potentiall other park easements. That the City will need the commitment from the proposed mortgagee that they understand that releases as against the mortgage or deed of indenture will be freely granted by that mortgagee on behalf of the property to release same to the City of Oak Park Heights so that proper recording of easements unencumbered by the mortgage can be implemented. Further, it must be understood that there will be no fees or costs assessed to the City of Oak Park Heights by the mortgagee for those releases. 4. Further, it should be noted that final easement conveyance as it affects the established roadways should be completed before any subdivision shall be allowed. 5. The nature of the subdivision will have an impact on the building to be constructed across the property line. Those impacts will be addressed by the Building Inspector upon permit application. 6. VSSA shall construct all bicycle and pedestrian trails as sidewalks on those properties that will comprise the main campus and adjacent residential development. The specifications for sidewalk construction and exact locations shall be subject to City Engineer approval. 7. Sidewalks shall be added by VSSA to both sides of Norwich Circle North and along the east side of Norwich Avenue North subject to City Engineer approval of specifications and locations. Sidewalks shall be added by VSSA along both sides of Nolan Avenue North at the time of development of the second phase of Boutwell's Landing subject to the City Engineer approval of specifications and locations. VSSA shall move or destroy the building and remove the structures and debris on the former Ritzer property, south of 58`" Street subject to City staff approval. VSSA shall work with Cit staff to determine the disposition of the building prior to May 1, 2000. All action related to the disposition of the building shall be completed by July 1, 2000. 9. Any other conditions as required by the City Council, Planning Commission and/or City staff. Carried 3 -0. Old Business: A. Capital Improvement Budget Update: City Planner Richards provided the Commission with an Update, noting that the City Council had passed the budget as noted in the Commission's p acket enclosure. B. 2000 Goal Setting: Meeting Date and Commission Goals: City lanner Richards reviewed ty the Commission packet enclosure and discussed the timeline for goal setting and discussion. Vice Chair Dahlquist noted that the Commission had agreed at an earlier meeting to discuss their g oal setting in a workshop format. Brief discussion was held by the Commission pertaining to the goals of the Commission and the City Council as well to other items and their status in relation to goal setting. New Business: A. Stillwater Area High School - Ropes Course: City Planner Richards reviewed the Commission packet enclosure and noting that an extension of the ropes course hours of operation would require p q an amendment to the conditional use permit. Informational/Update : A. Lower Oak Park Heights: City Planner Richards provided the Commission with an update of activity for the area. B. Other: Commissioner Wasescha, seconded by Commissioner Dwyer moved to request that the Commission be provided with a summary listing of all applications for commercial development projects as to provide the Commission with an awareness of upcoming projects. NSP had expressed concern with some of the conditions listed in the February 3, 2000 planning report. Revised language has been discussed and it is recommended that the following conditions be considered for the building relocation CUP: 1. NSP shall relocate the storage building to the proposed location within the lower portion of the ash disposal facility site. The CUP for the storage building shall expire by December 31, 2005 or NSP shall apply for an amended conditional use permit for its relocation or reconstruction, whichever occurs first. 2. NSP shall provide health reports on fly ash including air quality monitoring reports as required by City staff. 3. NSP recognizes that it contributes storm water runoff into the Perro Creek watershed area. The City is in the process of developing plans for resolving storm water management issues for this watershed. NSP acknowledges that it will use its best efforts to work with the City on these issues and contribute its fair share of any expense to be incurred by the City in implementing any storm water management solution. 4. The building shall be required to comply with all Uniform Building Code requirements as approved by the Building Inspector, including an adequate foundation once it is replaced on the proposed site. NSP recognizes that the City has committed to a master planning process for the site and that NSP is willing o assist in the planning g p 9 process and dedicate the necessary land, easements and resources in order to facilitate the development of the ultimate park, trail and recreational facility. 8. NSP recognizes that a non - conforming billboard exists on the ash landfill site. With the implementation of roadway, park, or trail improvements on the ro e p p rty, NSP agrees to remove the billboard. 9. NSP shall be allowed to retain the construction trailer on the lower portion of the ash disposal facility until, but no later than, September 30, 2000. King Plant: Cooling Tower Expansion Variance FILE NO: 798.02 — 00.05 BACKGROUND NSP Company has made an application for a variance, site plan, and Design Guideline review for the addition of cooling towers at the A.S. King Plant, located at 1103 High Plant Road. Four towers are proposed directly to the north of the existing cooling towers. Additionally, NSP is proposing the construction of a 17 foot by 48 foot electrical equipment building. The subject site is zoned I, Industrial District in which power generating stations are a permitted use. A variance is being requested in that the cooling towers are proposed to be 60 feet in height. The building height maximum for the I, Industrial District is 45 feet. Site plan and Design Guidelines review is also required for any major project requiring a building permit. The Comprehensive Plan designates this area as industrial land use. The power plant and its accessory structures are recognized as industrial land uses consistent with the maps and policies of the plan. Zoning Ordinance. The site is zoned I, Industrial District in which power plants and p p accessory structures are a permitted use. Cooling Tower Variance Request. The power plant requires cooling towers to reduce the temperature of water utilized in the plant before it is returned to the St. Croix River. The State requires NSP to cool its discharged water to a temperature of 86° F. The existing cooling towers are at capacity on those days that the air temperature is high and the plant is at maximum output to supply peak demand. If the water discharge g exceeds 86° F, the power plant must reduce its output of heated water and thus reduce its electrical generation capacity. For this reason, NSP has requested additional cooling tower capacity. NSP has designed the new cooling towers to the same height as the existing towers. g g This height is required to provide the surface area and to catch the breezes to effectively provide cooling capacity. The towers would not work at a shorter height as g based on the current plant design and construction. Section 401.04.A.4 of the Zoning Ordinance states that a variance from the terms of this Ordinance shall not be granted unless it can be demonstrated that: 1. Undue hardship will result if the variance is denied due to the existence of special conditions and circumstances which are peculiar to the land, structure, or building involved and which are not applicable to other lands structures or buildings in the same district. a. Special conditions may include exceptional topographic or water conditions or, in the case of an existing lot or parcel of record, narrowness, shallowness, insufficient area or shape of the roe p property. ttY . b. Undue hardship caused by the special conditions and circumstances may not be solely economic in nature, if a reasonable use of the property exists under the terms of this Title. C. Special conditions and circumstances causing undue hardship shall not be a result of lot size or building location when the lot qualifies as a a buildable parcel. 2. Literal interpretation of the provisions of this Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district 2 f s under the terms of this Ordinance or deny the applicant the ability to put the property in question to a reasonable use. 3. The special conditions and circumstances causing the undue hardshi p do not result from the actions of the applicant. 4. Granting the variance requested will not confer on the applicant any special privilege that is denied by this Ordinance to other lands, structures or buildings in the same district under the same conditions. 5. The request is not a result of non - conforming lands, structures or buildings in the 9 same district. 6. The request is not a use variance. 7. The variance requested is the minimum variance necessary to accomplish the intended purpose of the applicant. 8. The request does not create an inconvenience to neighboring properties and uses. The hardship in this case would be the necessity to design the cooling towers to this height so that they effectively work to maintain a lower water discharge temperature. g p The design of the power plant determines the height of the cooling towers. A cooling tower of a lower height will not catch the amount of surface air required for efficient operation. Simply adding more cooling towers at a lower height will not work for this particular plant. The design of the power plant mandates the higher tower, which is determined as the special condition that necessitates approval of the variance. Electrical Equipment Building. The electrical building is to be added to the project site to provide the electrical service to the cooling towers. The plant and its accessor buildings are considered a permitted use and only require site plan and design review 9 consideration. Screening. The proposed cooling towers and the electrical equipment building are not . g visible from Highway 95 or from any residential area in Oak Park Heights. An existing grove of trees serves to partially screen the existing and proposed towers from the St. Croix River. It is suggested that additional trees be added in that area between the new cooling towers and the man -made channel to further screen the towers from the St. Croix River. Federal and State Approvals. The site plans for the cooling towers have been submitted to the Corps of Engineers, Minnesota Pollution Control Agency, and the Department of Natural Resources. The new towers will be no closer to the river than the existing towers and are to be constructed at an elevation that is acceptable to the 3 DNR. NSP has indicated that the agencies have given preliminary approval of h p rY pp the towers and will provide written approval to the City. Design Guidelines. The Design Guidelines specify that all structures requiring a building permit require design review. The power plant and the existing accessory ry structures were not built subject to the Design Guidelines standards. The coolin towers are to be constructed almost entirely of a fiberglass type of material in an off - white color. This material is not a listed grade material as specified in the Design Guidelines. Additionally, the electrical building s to be built of putty colored steel � tty panels p which is considered a Grade III material. Variations to the Design Guidelines may be allowed by the City ouncil. Due to the ty unique construction required for the cooling towers and the location of the electrical building that is almost surrounded by existing NSP buildings, the Design Guidelines should not be enforced for the proposed structures. If the City ouncil requires uires q compliance with the Design Guidelines, it could only apply to the electrical building. Enforcement of Design Guidelines for the cooling tower would likely prevent NSP from constructing additional towers. Building Code. The proposed NSP structures will require compliance with the Uniform Building Code. The plans are subject to review and approval of the Buildin Official, especially as it relates to fire suppression equipment. CONCLUSION AND RECOMMENDATION Based upon the preceding review, City staff recommends approval of the variance and site plans for the cooling towers and the electrical equipment building. Further, staff recommends that the Design Guidelines be waived for the new structures proposed on the site. The approvals are subject to the following: 1. A variance is granted to allow construction of the towers to not more than 61 feet in height. 2. Additional trees and landscaping is provided between the cooling towers and the man - made channel subject to review and approval of the City Arborist. 3. Written approvals are received from the Corps of Engineers, Minnesota Pollution Control Agency, and the Department of Natural Resources for the proposed NSP structures. 4. The City will not require conformance with the Design Guidelines for the cooling towers and electrical equipment building. 5. The cooling towers and electrical equipment building shall comply with all Uniform Building Code requirements subject to Building Official approval. - 4 6. The Comprehensive Plan generally identifies the area for commercial uses. Rezoning. The site is currently zoned O, Open Space and is proposed to be rezoned p to B -2, General Business. When considering a zoning amendment, the Plannin Commission and City Council shall consider possible adverse effects of the proposed p p amendment and their judgement shall be based upon, but not limited to, the following: g a) Relationship to the specific policies and provisions of the municipal comprehensive plan. p p b) The conformity with present and future land uses in the area. c) The environmental issues and geographic area involved. d) Whether the use will tend to or actually depreciate the area in which it is ro osed. p p e) The impact on character of the surrounding area. f) The demonstrated need for such use. g) Traffic generation by the use in relation to capabilities of streets serving he property. g . p p Y h) The impact upon existing public services and facilities including parks, schools streets, and utilities, and the City's service capacity. i) The proposed use's conformity with all performance standards contained in the zoning ordinance. The rezoning of the site to B -2 is consistent with other zoning in the area and will not adversely impact the area or the systems in place. The Super America site is zoned B- 2 and the Oppidan development to the east is zoned PUD with an underlying B -2 District. Y g Preliminary /Final Plat. Robert L. Brackey has submitted an application for Preliminary/ Final Plat. The request is to plat one lot 1.593 acres in size and an outlot for future development. Both Lot 1 and the remaining outlot exceed the minimum lot requirements for the B -2 District which is 15,000 square feet in area and minimum width of 100 feet. Ten (10) foot drainage and utility easements are provided on three sides of both lots with a larger easement provided adjacent to Highway 5 for ponding. Development Agreement. A development agreement that incorporates conditions of approval, site issues, and site connection fees shall drafted by the City Attorney for execution by the developer prior to issuance of a building permit. All required connection fees shall be paid before a building permit will be issued. Design Guidelines /Site Plan. The site plan is for a 4,400 square foot bank facility with parking and drive up service. Exterior Elevations The Design Guidelines require that office and commercial buildings must use at least three Grade I material and must be composed of at least 65% Grade I or Grade II materials. Glass must make up 30% of this 65 %. Not more than 35% of the building 2 shall be Grade II or III material and not more than 10% of the materials. e building shall be IV The building is proposed to include a combination of Grade I materials ' e als as outlined in the Design Guidelines. Brick is the main material with different colors ' proposed. The main color is "Colorado Rose" with "Coral Blend" as an accent. Smooth white concrete stone is proposed as accent under windows to match the columns r p oposed on two elevations. Glass is also used extensive! on the elevations. The roof oof is proposed to be a 6:12 pitch with shingles. The color has not been identified. The canopy consists of white metal soffit and trim and will be supported ' pp by white metal posts. A pitched roof is proposed to match the roof on the bank. The building, as designed, will comply with the Design Guidelines. Screening/Trash & Recycling Enclosure There is an area on the front -right side of the building that appears to provide . , g identified. pp p de screening of HVAC units. The materials for this are not identified. it is recommended that matching brick be used for screening. The trash enclosure is proposed to be located in the parking area and p g constructed of brick with a vinyl gate material. Staff recommends that the trash enclosure be located adjacent to the building and not as a freestandin g unit. Signs The sign information provided with the site plan depicts two freestanding i p g s gns. Only one location is identified on the site plan for the sign. Section 401.15 G (8) g (d) of the Zoning Ordinance regulates signs an • g g d the ordinance only permits one freestanding sign. Either of the signs meets the ordinance requirements but only on a y e may be installed on the site. One wall sign is proposed on the elevation that faces Highway g ay 5, this is consistent with the ordinance, which allows u to 150 square feet of wall p q i signage. There are directional and regulatory signs ro osed to assist with circulation • p p non the site, these signs also meet the ordinance regulations. Access/Parking Access to the site is proposed to be provided via two curb cuts off of Neal Avenue. Each curb cut is shown at 24 feet in width, which is consistent with the ordinance. Staff has discussed possible modifications to the site access in order to limit the total curb u b cuts onto Neal Avenue. Staff would prefer one access to serve the site. The Zoning Ordinance requires a 40 foot separation of curb cuts and allows only ne access cess fo r each 125 feet of street frontage. The Engineer is reviewing he proposed access points g p p p s in relation to the existing driveways on the Op idan and Su erAmerica sites. T p p he applicant is willing to explore alternative access and circulation on the site an ' d will provide alternative solutions prior to the Plannin g Commission. 3 t Neal Avenue is under MNDOT jurisdiction. A permit will be required from the State of Minnesota for access. The Zoning Ordinance requires one parking space for each 250 square feet of floor area and two spaces for each drive -in unit plus 180 feet of stacking space. There are 18 stalls required and 29 provided in general parking. The drive -in has been designed to provide 180 feet of stacking. Lighting Section 401.15-B (7)(f)(2) regulates outdoor lighting in commercial areas. The ordinance requires that light sources be shielded and that the intensity when measured at the property line not exceed 0.4 foot- candles. The lighting on the plan consists of three twenty -foot tall fixtures for the parking and drive aisle. There is also lighting proposed under the drive -up canopy and under the two building entryways. The fixtures to be used in the canopy shall be recessed into the roof to avoid glare. A plan depicting the anticipated foot - candle levels has been submitted and the plan meets the ordinance regarding lighting at the property lines. Landscaping Plan A landscaping plan has been submitted for the site. Plantings have been concentrated in areas to maximize screening of headlights for the drive -in service. A variety of trees and shrubs are proposed to be planted on the site. The final planting list and design is subject to the review and approval of the City Arborist. Drainage and Utilities Drainage on the site will be directed to catch basins in the parking areas and directed to an existing pond on the site. Sanitary sewer and water service will be p rovided via existing pipes adjacent to Neal Avenue. The hydrant design detail and the storm water outlet detail shall be provided and shall be consistent with City requirements. The plans are subject to the review and approval of the City Engineer. RECOMMENDATION Staff recommends approval of the Preliminary/Final Plat for Brackey West 2 nd Addition and the rezoning of the site to B -2, General Business and further recommends approval of the Site Plan for TCF National Bank Minnesota with the following conditions: 1. A development agreement shall be executed prior to issuance of the building permit. 2. All required connection fees shall be paid before a building permit will be issued. 4 I The trash enclosure shall be relocated to be adjacent to the building and shall be . screened with brick to match the building. 4. The HVAC equipment screening shall consist of brick to match the building. 5. Only one freestanding sign, compliant with all Zoning Ordinance requirements shall be allowed on site. 6. The City Council has authorized Mr. Johnson to move forward with plans to drill the well and to prepare specifications for the well house. The CUP is required in the O, Open Space Conservation District primarily for review of utility buildings and structures but it is necessary to first approve the location of the well and then review the structure and associated site plans once they are completed. It is expected that test borings for the well could, begin in March and if the site is acceptable, the production well will then be drilled. The design of the well house should be completed in May or June. Complete plans for the well house and associated site improvements, including landscaping, would be reviewed by the Planning Commission and approved by the City Council at that time. The Comprehensive Plan identifies this area for g overnmental facility land use. The well site would be consistent with the Correctional Facility and not have an impact on planned residential and recreation uses west of Osgood Avenue. Zoning. The subject site is zoned 0, Open Space Conservation District. Governmental and public regulation utility buildings and structures are a listed conditional use in this district. Site Analysis, The Oak Park. Heights 1996 Water Supply Stud prepared b pp Y Y� p p y Bonestroo and Associates, stated that a third well was necessar o provide adequate ry p q water supply during high use periods and for a back up well. Locations for wells were analyzed and it was determined that the central location along Osgood Avenue on the . 9 Correctional Facility property would best suit the City's needs for a well. Mr. Johnson has detailed the site analysis issues in his February 17, 2000 memo which is attached. Conditional Use Permit. The application for a CUP was made to coincide with the process of authorization and testing for a well. The CUP will reinforce the decision to locate the well at the preferred location and provide for an opportunity to review and consider the building and site plans. Authorization to provide detailed building nd site 9 plans was approved by the City Council at their February 22, 2000 meeting. Once the plans are completed, they will be reviewed by the Planning Commission and approved pp by the City Council. Review of the CUP criteria, as found in Section 401.03.A.7 of the Zoning Ordinance, is as follows: a) Relationship to the specific policies and provisions of the municipal Comprehensive Plan. b) The conformity with present and future land uses in the area. c) The environmental issues and geographic area involved. d) Whether the use will tend to or actually depreciate the area in which it is proposed. e) The impact on character of the surrounding area. f) The demonstrated need for such use. g) Traffic generation by the use in relation to capabilities of streets servin g the property. h) The impact upon existing public services and facilities including parks, schools, streets, and utilities, and the City's service capacity. i) The proposed use's conformity with all performance standards contained herein (i.e., parking, loading, noise, etc.). The well location and the associated building should not have a negative impact on the future land uses or impact the character of the surrounding area. Mr. Johnson, in his memo, has demonstrated the need for the well and why the proposed location was chosen. Future review of the building and detailed site and landscape plans will hel ensure that the facilities will blend into the area in which it is proposed. 2 The Zoning Ordinance, in the 0, Open Space District, lists criteria for approval of a CUP for utility structures. The criteria are as follows: a. When abutting a residential use in a residential use district, the property is screened and landscaped in compliance with Section 401.15.E of this Ordinance. The Comprehensive Plan programs the area to the west of Osgood Avenue as future residential use. When developing the building and site plans, the City will need to adequately screen and landscape the site. b. The provisions of Section 401.03.A.7 of this Ordinance are considered and satisfactorily met. The criteria have been reviewed above. Building and Site Plans. Upon completion of the building and site plans, they will be forwarded for Planning Commission review and City Council approval. The building is proposed to be 20 feet by 40 feet and constructed of materials consistent with the Design Guidelines. Mr. Johnson has provided pictures (see attached) of a well house found in the City of Chanhassen that will be similar to what is proposed for Oak Park Heights. As a condition of approval of the CUP, review of the building and site plans by the Planning Commission and City Council will be required. CONCLUSION AND RECOMMMENDATOIN Based upon the preceding review, City staff recommends approval of the CUP for the City's Well #3. Approval of the CUP is subject to the following conditions and the future submittal and approval of building and site plans. 1. Acquisition of an easement from the Department of Corrections for the well site. 2. Successful test boring results resulting in the drilling of the Municipal Well #3 at the central site of the Oak Park Heights Correctional Facility. 3. Submission of building and detailed site and landscape plans for review by the Planning Commission and approval by the City Council. The building shall comply with all City Design Guidelines. Approvals should be granted before issuance of a building permit for the well house structure. 4. The attached is the Conditional Use Permit Application for a municipal well to be located along Osgood Avenue in front of the Oak Park Heights Correctional Facility. The well is several years overdue and is on a fast track design and construction. Pending approval by the City Council, we will start a test boring at the site in March and if the boring indicates that the site is acceptable for a well we will start drilling the production well in April. The drilling process will require 5 months to complete. The design of the well house will be completed in June or early July. The actual well house construction will not start until the well is complete in late September or early October. The enclosed permit application is for locating the well only with the condition that the well house and landscaping designs will require separate approval. The current application does not have the owner's signature or property description. We cannot obtain their signature or the property description until after the City Council approves the resolution to permit formal negotiations for the easement and approves surveying of the land at their February 22 meeting. Well #3 is required to provide adequate water supply during high use periods and have a back- up well. A three well system is required whenever the maximum daily demand requires two wells to pump simultaneously in order to meet demand and maintain a reserve for fire fighting. Oak Park Heights 1996 Water Supply Study prepared by Bonestroo and Associates .stated that Well #3 was needed and recommended that it be built in 1997. The Water Supply Study was updated in 1998 and again recommended that Well #3 be constructed. Based on a review of pumping records it appears that both of our wells were required to maintain the water towers at adequate fire fighting reserve levels for short periods of time during the summers of 1993, 1.. If one of our wells had failed during these periods of time � P our fire fighting reserves would have been threatened. At the February 3, 1999 City Counc rY y 1 meeting the Council authorized the City Engineer to prepare P lans and specification for Well #3. Figure 1 shows the actual average daily water demand from 1991 through 1999 and three predictions for future demand. Based on the actual demand a three wells stem was required Y q d in 1992. The predicted average daily demand from the 1998 Water Sup Stud is shown f PP Y Y or 1996 through 2020. These predictions were based on past growth of 100 ear ersons per P P Y through 2010 and a slight increase after. Through 1999 these predictions are in agreement wi th the actual demand. Since the Water Supply Study was completed several specific projects have P P J e been proposed which will increase the rate of population growth. The line labeled "Predicted Demand W/O Prison" is based on past growth and takes into account predicted growth due t P b o VSSA, Central Business District, properties along Oakgreen Avenue, the Caltho e Study Y Area, and Lower Oak Park Heights Redevelopment. It does not include the possible sale of water to the Stillwater Correctional Facility in Bayport. The line labeled "Predicted Demand With Prison" considers the predicted growth and includes a population of 1,000 people for the p P sale of water to the Stillwater Correctional Facility. Based on current growth predictions and g P if we supply water to the Stillwater Correctional Facility we may need tooperate a four well system as early. as 2006. The recommended location for Well 93 is the tY central site at the OPH Correctional Facility. The attached aerial photograph shows the three sites under consideration for wells. The northern site is predicted to be located at an underground valley in which the Prairie du Chen limestone has been eroded away by an ancient river. Without the limestone to form a roof above the Jordan sandstone, a Jordan well cannot be formed. The southern well site is located closest to the Baytown Plume. While it is not considered to be in danger of contamination (based on the current Wenk plume boundary), it is prudent to wait for additional data to be collected prior to this site being used. The central site is located near the underground valley Y effecting the northern site. To be sure that adequate limestone exist at this site a test borin g is recommended prior to drilling the production well. The advantages of the OPH Correctional Facility site includes that it is within the current cit . . i limits, it s large enough to accommodate up to three wells without overlapping of their draw p a areas, and the draw area for the wells is primarily rural large lot residential versus urban, commercial or industrial. The northern well site could be developed as a glacial drift well or drilled below the Jordan aquifer. In either case it may not be as productive as the current 850 gallons per minute Jordan aquifer wells. With two Jordan wells producing and one in reserve a 400 gallon per minute drift well could satisfy the year 2020 maximum daily demand of 2022 gallons per minute. The southern site is shown as a location for a `yell, a future storage facility and possibly a future treatment facility. The future storage facility is not anticipated to be required until after 2 004. The treatment facility hopefully will never be required. The Environmental Protection Agency has recently announced that it is modifying the groundwater treatment and disinfection rules. The attached map shows the draw area of our existing wells, the possible draw area of the new well field if all three wells were operated at the same time and the Baytown Plume. r TREE CITY U.S.A. 1 s ' a Memo to City Council; Authorization to Proceed with Well 4� 02/ 17/00 The Baytown Plume is the area in which detectable quantities of trichloroethylene have been detected in the groundwater. Trichloroethylene has been used as a degreaser solvent, metal cleaner, and carburetor cleaner. Someone spilled or otherwise illegally disposed of it g Y p somewhere in the vicinity of the Lake Elmo Airport. The actual source has not been discovered. The plume has been investigated since 1988. Both the Prairie Du Chen limestone and the Jordan sandstone aquifers have been contaminated. The edge of the plume as defined by the October 1999 sampling results is approximately three tenths of a mile south of the southern well site. The Minnesota Department of Health has established a well advisory zone in which special precautions must be taken when drilling new wells. The edge of the well advisory zone is approximately 750 feet south of the southern well site. After reviewing the available data on the plume, consulting with Northern Environmental, the Minnesota Department of Health and the Washington County Department of Health I believe that it is unlikely that detectable quantities of trichloroethylene would ever be drawn into the southern well or will migrate to any of the wells. The Health Risk Limit (HRL) established by the Minnesota Department of Health is 30 micrograms of trichloroethylene per liter of water. The HRL is 80 times the current detectable limit for testing for trichloroethylene in water. The primary weakness in the current sampling is the lack of sampling north of the confirmed location of the plume. To provide additional assurances that the northern edge of the plume is well defined I recommend that the City initiate the sampling of selected Jordan aquifer wells which are located north of the Baytown Plume study area. A few samples located along Osgood Avenue between 47 Street and 50 Street and some along Northbook Boulevard within the draw area for our wells. The initial sampling would consist of approximately 10 wells with a laboratory cost of approximately $100 to $125 per sample and an additional $1000 for sampling, data analysis, and report writing. If trichloroethylene is detected in these samples an additional round of confirmation sampling would be necessary. The total cost for sampling if two rounds of sampling are necessary is estimate to be less than $5,000. A meeting has been held with the warden and his staff at OPH Correctional Facility to inform them of our interest in placing up to three wells across the front of their property, a future storage facility, a possible future treatment facility if necessary, looping of water mains, future road right -of -ways being considered and park/trail improvements. They have provided us with verbal permission to perform surveys of the sites and their tentative approval for Well #3 on the central site with access from their patrol road and the understanding that the building is designed to blend' with their facility. The Department of Administration is the land agent for the State and will be the agency to execute the easement agreements. The attached draft easement agreement was prepared last year with the cooperation of the Department of Administration and our City Attorney. Other than adding the legal description of the property and some minor additions to make the document recordable this is the recommended easement agreement. TREE CITY U.S.A. The Industrial District and specifically Section 401.32.E of the Zoning Ordinance, requires a conditional use permit (CUR) and fencing of outside storage areas to screen the view from neighboring residential areas and from the public right -of- way. The storage area at the front of the building is clearly in full view of the right -of- way and will need to be screened. Although an application has been filed, a site plan has not been provided that indicates . the fence location and details required to adequately consider the CUP. Additionally, the applicant will be required to address location of parking stalls, the agreement or easement created to provide access to the leased building and site, and a plan to screen the trash enclosure. The Building Official, in the attached memo, has addressed the site plan requirements. Until a complete site plan is submitted by the applicant, the City cannot process a CUP. The site plan and any required information requested by the City will need to be submitted to the Community Development Department and least 20 days prior to the next Planning Commission meeting. The 120 day timeline for review of the development application will not commence until a complete application is submitted. The City goals for 1999 -2000 were discussed as well as the list developed early in 1999 for the Planning Commission. Many of the Planning Commission items targeted for 1999 were completed. The Planning Commission also felt that the 2000 goals session, set for March 31, would help define the projects to be completed in 2000. The Planning Commission's new list, which should be discussed further when more members will be present in March is as follows. Commercial Zoning District Review. Although amendments were made in 1999 to clarify the commercial districts, the Planning Commission members felt that additional review was required. Staff pointed out that changes will be made to the CBD zone with the assistance of BRW to better define and direct development in the district. The review of the districts could occur at the same time as the CBD amendments. Sign Ordinance. Consideration of the sign provisions of the Zoning Ordinance should be completed in 2000. Lower Oak Park Heights. The City will be conducting public hearings and plan for improvements in the Lower Oak Park Heights neighborhood. The project may involve specific area plans and changes to the Zoning Ordinance requiring Planning Commission review and recommendations.
