City Planner Richards provided a summary of the • report `� applicants request and an overview of his re p regarding the same and also reviewed overheads of the • proposed project. Chair Hedlund invited discussion from the audience. Frank Matschina introduced himself as the President of Board of Sunnyside Club. He noted that he was in agreement with the Planner's Report p rt and noted that the construction will enhance the area significantly as the quality • design is improved, Y q ty of the materials and p , as well as better designed for the environment. Terry and Christine Mandt, 14210 Upper 54th St. N. - Variance p anance Request for a 5- foot, Side -yard Variance for Porch Addition: City Planner on report Richards provided an over view of his re p the matter, noting that the i request being made is for a 4 -foot side -yard setback for the construction of a 3- season porch. Chair Hedlund opened the hearing for public comment. Terry Anderson, 14220 Upper 54th St. N. indicated that he was a neighbor, to the east of the applicant and that he was opposed to the variance being • g requested due to his concern of building in the area all becoming too congested. Bob Maietta of Panelcraft of MN, Inc. and the applicants were present. p sent. Mr. Maietta informed the Commission that he was assisting the applicant in his effort to construct a 3- season porch to their home and noted that other alternative had been explored and that the proposed design best configures with the interior of the house. He added that he believed the addition would add value to the home and enhance the value of surrounding homes. Commissioner Wasescha, seconded by Commissioner Dahlquist moved hearin q owed to close the public hearing. Carried 4 -0. Discussion ensued as to variance granting criteria and issues of hardship and found the applicant to have reasonable use of their property. No special circumstances rt3' p stances or conditions to justify a hardship were able to be determined. Commissioner Dwyer, seconded by Commissioner Wasescha moved to recommend deny � ommend that the City y the request for setback variance. Continued: P -I, Public /Institutional District Establishment: City Planner Richards provided an overview of his report, p rt, noting changes made as a result of the information compiled from previous meetings and further noted how other sections of the ordinance would be affected by establishment of the district. He also distributed land use maps and discussed the design of gn them with the Commission. Chair Hedlund opened the hearing for ublic comment. As visitors there were no visitors to the public hearing, Commissioner Dahlquist, seconded by Commissioner q y mmissloner Wasescha moved to close the public hearing. Carried 4 -0. Commission discussion ensued as to various issues and clarification anfication of the proposed ordinance. • Commissioner Dahlquist, seconded by Commissioner Wasescha moved to recommend approval of the draft ordinance as presented by the City Planner. Y y Carried 4 -0. New Business: A. Ordinance Regulating the Placement of Public Utilities: Community Development Director Danielson provided an overview ervlew of the matter, issues relevant ssues and considerations such as developable property and requirements for new development to install underground utilities necessary to � as well as the proceeding ary o implement such a change. Commission discussion ensued as to clarification of subdivision • ion 3 as it relates to right- of -way and easement as well as overhead ' erce ower lines, percentages of replacement, and other related issues. Commissioner Dahlquist, seconded by Commissioner Dwyer, Cou moved to recommend that the City Council approve the ordinance and that the City Council move forward the ordinance hearing � and through the public heang process. Carried 4 -0. Old Business: A. Boutwell's Landing Update: City Planner Richards and Community Development Director Danielson reviewed revised lighting and signage plans with the Commission. Discussion ensued as to size and scale of light canopy, pedestrian scale lighting, color options and the parks name suggestion as well as other related issues. It was the consensus of the Commission to recommend City Council approval of (1) signage and encouraged a more distinctive name for the park and /or city log placement on the design and (2) 14 -foot pole design for lighting and encouraged the luminaries design with lens not extending below the fixture. Party-in-the-Park Thank -you: Community Development Director Danielson extended a big thank you to everyone who was able to participate in the event which was held at Brekke Park on Sunday, August 13th. She noted that the event had a great turn out and proved to be a great opportunity to spend time with the community. B. Valley View Park Wetland Bridge Ribbon Cutting: Community nity Development Director Danielson reminded the Commission that there would • ould be a ribbon cutting at the west end of the Valley View Wetland Bridge to commemorate • g orate its construction and connection to the trail system. She noted that all who would like like to attend are invited to do so at 10:00 a.m., Saturday, September 23, 2000. • p 000. The event will take place rain or shine and refreshments will be served. The first addition is approximately 300 square feet in size and q dwillbe constructed on the east side of their building. The criteria used to review a site plan and staff's findings are outlined below. Comprehensive Plan. The expansion of a commercial use on this site is consistent with the City Comprehensive Plan. According to the Proposed Land Use Map, site p p, in question is guided for commercial use. It requires that the office portion of this business r v' p o ide three stalls plus one stall for each 200 square feet of office floor area. Given the office portion of the building (900 square feet), this business must rovide eight off-street parking g eet parking stalls. In addition, the site must provide one parking stall for each 1 5 9 00 square feet of warehouse. This site has approximately 1,500 square feet of warehouse arehouse area. Therefore, this site must provide a total of nine off - street arkin p g stalls. Currently, the site has a bituminous surfaced arkin area. According p g ccord�ng to Section 401.15. F.4. h.14, all parking stalls shall be marked with white or yellow lines w painted Imes not inches than four nches wide. RECOMMENDATION Staff recommends approval of the site plan to allow one office and storage addition to the property located at 14520 North 61 Street Court. This recommendation is based on the findings contained in this report and subject to the conditions outlined below. 1. The applicant must stripe their existing bituminous parking area to show nine (9) off - street parking stalls. This striping must be white or yellow and four (4) inches wide. All stalls must be nine (9) feet wide and twenty (20) feet long. 2. The off - street parking area shall be provided with a concrete curb and perimeter subject to review and approval of the City Engineer. 3. The applicant must submit a landscape plan illustrating the number, size and species of plantings. This plan will be subject to the review and approval of the City Arborist. 4. The proposed building includes a combination of Grade I materials consistent with the requirements of the Design Guidelines. The ' building facade's primary material will be brick. The majority of the brick will be colored Colorado Rose with Coral Blend accent brick. Smooth white concretes stone will be used to accent the window and will match the columns on the front of the building. The building will have a • g 6:12 pitch shingled roof and a white metal canopy. The trash enclosure shall be made of • the same materials as the principal building p g and all rooftop and ground equipment shall be screened from view. Parking. This design will force customers who can't find a arkin stall in the first g first row or need to go inside the bank after using the drive through to exit the site before re-entering eentering at the northerly access. To eliminate this circulation issue, the applicant � pp has agreed to redesign the parking lot with 90 degree parking and provide proper directional p p p tionai signage. Landscaping. The applicant has submitted a detailed landscape This pe plan. This plan shows intense planting along the northwestern side of the site adjacent cent to the drive - through area. These plantings should provide effective screening of the drive- through. It should be noted that the City will work with TCF and adjoining property g p operty owners to maintain the landscaping along Highway 5. The overall plan is subject to the subject e review and approval of the City Arborist. Lighting. The applicant's lighting plan is in conformance with the exterior lighting standards outlined in Section 401.15.B.7.f. These standards are: no light source or combination thereof which casts light on a public street shall exceed one (1) foot candle meter reading as measured from the centerline of said street nor shall any light source or combination thereof which casts light on adjacent property exceed four - tenths (0.4) foot candles as measured at the property line, per the method outlined in Section 401.15.B.7e. According to the applicant's lighting plan, the amount of light produced from the exterior lights falls below 0.0 foot candles meter before reaching any of the property lines or the public street. Signage. According to Section 401.15.G.8.d, ro erties in the B -2 District p District are allowed two signs: one free standing sign not more than 150 square feet or 1 q 15 percent of the front building facade, whichever is less, and one wall sign not more g than 150 square feet or 15 percent of the front building facade, whichever is less. According to the applicant's plans, the front building facade amounts g � to a total of 832 square feet. Fifteen percent of 832 is 125 square feet. The sign plan calls g p s for one freestanding sign that is 62 square feet. This sign will be located on g the north side of the site adjacent to Highway 5. In addition, the applicant proposes one wall sign p p sign that is 30 square feet and will be located on the southeastern side of the building facing facing Neal Avenue. These signs meet the standards outlines above. Grading, Drainage, and Utility Plans. According to the Utility and Pavement ty ent P Ian, the site's run off will run to catch basins which will pipe the water to a retention and t p to the northwest. Sanitary sewer and water will be provided from existing services ces in Neal Avenue. Applicant must secure a permit from MNDOT permitting them to drain g ain runoff into MNOT's retention pond along Highway 5. All grading, drainage, and utility g ty plans are subject to the review and approval of the City Engineer. Trash Enclosure. Section 401.15.D.12 outlines the standard for exterior trash receptacles. According to the applicant's plans, the proposed trash enclosure meets these standards with the exception of item b, which prohibits locating the trash g sh i enclosure in the front yard area. Therefore, staff recommends that a condition of 4 • • • approval require the applicant to relocate the trash enclosure along the northeast side of the building and that the enclosure is constructed of the same materials as the principal building. l al p p RECOMMENDATION Staff recommends approval of a rezoning, site plan, and final plat to allow the construction of a 4,400 square foot branch bank ' with drive -up service. This recommendation is based on the findings contained in this . g s report and subject to the conditions list below. 1. A development agreement shatl be executed prior to issuance of a building permit. 2. All required connection fees shall be paid prior to the issuance of a building permit. 3. The applicant shall submit revised plans showing 90 degree parking and proof of parking for the row adjacent to 'Neal Avenue prior to final action by the City Council. 4. The applicant shall submit a revised plan illustrating the trash enclosure relocated adjacent to the northeast side of the building and that the enclosure will be made of the same brick material as the principal building prior to final action by the City Council. 5. The applicant shall secure permits from MNDOT to allow access to the site from Neal Avenue and to allow the site to drain runoff into the MNDOT retention pond along Highway 5. 6. All light fixtures in the drive through canopy shall be recessed into the roof and comply with all requirements of the Zoning Ordinance. 7. All exterior lighting shall comply with the requirements of the Zoning Ordinance. 8. The landscape plan is subject to the review and approval of the City Arborist. 9. The drainage and utility plans are subject to the review and approval of the City Engineer. 10. The City Council requested that staff notify all the affected parties such as churches, the School District, cemetery owners, the State of Minnesota (correctional facilit a facility) and the Metropolitan Council (wastewater facility) regarding the proposed zoning text changes. es. g Further, the City Council requested that once notification has been completed, the Planning Commission hold a meeting with the representatives of the affected land uses. The City Council wanted assurance before the Zoning Ordinance is revised and especially p Y before an actual zoning change affects the properties in question, that all of the p arties understand the zoning amendments. As you are aware, the changes that have been proposed by staff and recommended by the Planning Commission include amendments only to the Zoning Ordinance text. Rezoning parcels to the Public/Institutional District would be done by a separate action including a public hearing of the Planning Commission and City Council action. City Council members commented on the proposed setback standards for the Public/Institutional District. The primary concern of the Council was if certain uses, such as churches would meet the standards as proposed. Staff indicated that the existin g uses are grandfathered and they would be allowed to remain and expand, as long as the nonconformity was not increased. Further, staff has not proposed a rezonin g of the two churches in the City. Calvary Assembly and First Presbyterian Church are both currently zoned residential in which churches are and would remain an allowable conditional use. Mr. Vierling felt that the same uses should be treated in a similar manner no matter what organization or jurisdiction is their sponsor. He suggested that parks be made a conditional use within the Public /institutional District. Staff has recommended, as attached, to add parks, recreational facilities, structures or buildings as a conditional use under Section 401.320.E of the proposed district. The language has been drafted with the intent that minor changes to parks would not require a conditional use permit, but that all major facilities, buildings and parking areas would. The City Council discussed the plans and viewed a sample light fixture provided by VSSA. As part of the review, the City Council considered the recommendations made by the Planning Commission and Parks Commission at their meetings in September. Specifically, the City Council requested the following: Signage: 1. The Parks Commission had asked VSSA to come back to their October meeting with additional ideas on park signage. The City Council will consider these recommendations when the Parks Commission forwards its final recommendation. The Council also indicated that all signage must comply with City ordinance requirements. Lighting: NORTHWEST ASSOCIATED CONSULTANTS COMMUNITY PLANNING - DESIGN - MARKET RESEARCH ENCLOSURE 1. The City Council determined that the 14 foot pole option is appropriate for the street lighting within Boutwells Landing. The Council wanted the Planning Commission to consider the VSSA request to place 24 foot pole lighting in the parking lots. Additionally, the Planning Commission should further consider the lens style for the proposed light fixtures. Although all of the fixtures will comply with the ordinance requirement of 90° cut off, the lens preferred by VSSA will extend below the body of the fixture. The City Council also asked the Planning Commission to comment on the trail lighting fixtures and locations. The Parks Commission, at their September meeting, recommended that the Boutwells lighting plan should include bollard lighting throughout the park for the bike paths and trails. The Parks Commission will be asked if they have any additional comments on the lighting plan at their October meeting. Mark Vierling, the City Attorney, provided the City correspondence highlighting the language of the Development Agreement related to lighting. A copy of the letter is attached.
