CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ACCEPTING THE DONATION OF CERTAIN
LANDS NECESSARY TO THE 58TH STREET UTILITY
CONSTRUCTION PROJECT FROM ALVIN J. AND ELAINE K. KRUEGER
WHEREAS, the City of Oak Park Heights has determined the
feasibility and ordered certain improvements consisting of
construction of trunk water and sanitary sewer mains and 58th
Street improvements as is outlined within the Notice of Improvement
annexed hereto as Exhibit A and incorporated by reference herein;
and,
WHEREAS, Alvin J. and Elaine K. Krueger own property from
which the City would be required to acquire lands for purposes of
making said public improvements; and,
WHEREAS, the City of Oak Park Heights has received a copy of
the appraisal of Eldon Robey dated September, 1992, appraising the
value of the lands and real estate interest that the City would
• have to acquire in order to make said improvements; and,
WHEREAS, Alvin J. and Elaine K. Krueger have indicated their
willingness to donate said lands to the City of Oak Park Heights;
and,
WHEREAS, the City of Oak Park Heights has conducted a public
hearing pursuant to Minnesota Statute 429.031, Subd. 2, which was
duly conducted before and on December 14, 1992; and,
WHEREAS, the City of Oak Park Heights recognizes the
substantial value of the donated land made to it by Alvin J. and
Elaine K. Krueger in order to make said project feasible; and,
WHEREAS, the City of Oak Park Heights has determined that said
improvements as it affects the Krueger project as referenced within
the annexed Notice of Improvement, can be made without special of
assessments against the Krueger lands as it affects this
improvement project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OAK PARK HEIGHTS THAT:
1. That the City of Oak Park Heights herewith gratefully
accepts the donation of lands made to it my Alvin J. and Elaine K.
Krueger in the manner and form annexed hereto as Exhibit B, C and
• D.
2. That the City of Oak Park Heights herewith is resolved
• that the improvements as outlined within the annexed Notice of
Public Hearing attached hereto as Exhibit A and incorporated by
reference herein can be made without special assessments against
the remaining lands of Alvin J. and Elaine K. Krueger pursuant to
the provisions of Minnesota Statute 429.061 as it affects this
particular project.
3. The City Council for the City of Oak Park Heights agrees
not to assess the Krueger property as a result of this particular
project.
4. This Resolution shall not impact the authority of the
City of Oak Park Heights to collect development charges including,
but not limited to connection charges, building permits, lateral
extension charges or other development permits and charges and
subsequent construction projects or other improvements not
presently being physically constructed as a result of the project
as outlined within Exhibit A and incorporated by reference herein.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING MINIMUM TWO HOUR
CALL OUT TIME FOR MAINTENANCE UTILITY
DEPARTMENT FOR WEEKEND AND HOLIDAY WORK
WHEREAS, the City of Oak Park Heights did authorize by
Resolution 82 -58 passed on January 25, 1982 an authorization
allowing members of the utility department a two -hour minimum call
out time at time and a half compensation rate when they were called
out to monitor pumps and lift stations on weekends and holidays;
and,
WHEREAS, the City of Oak Park Heights continues to have
a need to call out employees within the utility department on
weekends and holidays to monitor lift stations and pumps within the
City; and,
WHEREAS, the City Council feels that it is equitable to
compensate City employees who are so called upon on weekends and
• holidays to perform the service to be granted at least a two -hour
minimum call out time and compensated at the rate of one and one -
half times their hourly rate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Oak Park that the former Resolution 82 -58 is herewith
reaffirmed in all respects and until otherwise modified by the City
Council, all members of the utility department that are called out
on weekends and holidays to monitor pumps and lift stations within
the City of Oak Park Heights shall be granted pay for such service
at a minimum of two (2) hours per event to be compensated at time
and a half.

EXTRACT OF THE MINUTES OF THE MEETING OF THE
CITY COUNCIL OF THE CITY OF OAR PARR HEIGHTS
WASHINGTON COUNTY, MINNESOTA
HELD: DECEMBER 14, 1992
Pursuant to due call and notice thereof, a regular meeting of
the City Council of the City of Oak Park Heights, Washington
County, Minnesota, was duly called and duly held at the City Hall
within said City on the 14th day of December, 1992, at 7:00 o'clock
p.m.
The following members were present:
Mayor Barbara O'Neal
Councilperson Jack Doerr
Councilperson Richard Seggelke
Councilperson Dean Kern
Councilperson Joe Carufel
and the following were absent:
None.
The meeting was held pursuant to Resolution adopted November
• 9, 1992 calling for a public hearing on the proposed 58th Street
improvements within said City as more particularly described in
the Notice of Public Hearing ordered at said November 9, 1992
meeting, a copy of which is attached hereto. The Clerk presented
affidavits showing that due publication and mailing of notices of
the hearing and the Mayor announced that the Council would hear all
persons who cared to be heard for or against the improvements as
outlined within the Notice of Hearing. All persons present were
afforded an opportunity to present their views and objections to
the making of said improvements, and no objections were presented
except as follows:

RESOLUTION OF THE CITY OF OAK PARR HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, ORDERING IMPROVEMENTS AND DIRECTING
PREPARATION OF FINAL PLANS AND SPECIFICATIONS
WHEREAS, after due notice of public hearing on the
construction of improvements for the City Oak Park Heights,
Washington County, Minnesota, hearing on said improvements having
been duly held and the Council having heard all persons desiring
to be heard on the matter and having fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS FOLLOWS:
1. It is advisable, expedient and necessary that said
improvements as described in the Notice of Hearing thereon be
constructed, and that the same are hereby ordered made.
2. The improvements described in the said Notice of Hearing
• are hereby designated and shall be known as the 58th Street
Improvements of 1993.
3. Consulting engineers, Bonestroo, Rosene, Anderlik &
Associates are hereby directed to prepare final plans and
specifications for said improvements.
4. The City Council shall let the contract for all or part
of the work for said improvements or order all or part of the work
done by day labor or otherwise authorized under Minnesota Statute
§ 429.041, Subd. 2 within one (1) year of the date of this
Resolution ordering the said improvements.
The motion for the adoption of the foregoing Resolution
was duly seconded by Member Kern; and upon a vote being taken
thereon the following voted in favor thereof:

TIME AND PLACE: Notice is hereby given that the City
Council of the City of Oak Park
Heights, Minnesota, will meet at the
City Hall within said of Oak Park
Heights, Minnesota at 7:00 o'clock

5 to Norell Avenue, bituminous

the high school entrance with

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING THE 1993 GENERAL FUND LEVY
WHEREAS, the City Staff has prepared and submitted to the
City Council the proposed general fund levy for calendar year
1993; and,
WHEREAS, public notice has been duly given as provided by
law with public hearings being conducted by the City Council with
regard to the proposed general fund levy, receiving no adverse
comment from the public with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park Heights
has determined that the proposed general fund levy as submitted
by the City Staff is in the best interests of the citizens of the
City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights:
. 1. That the City Clerk is hereby authorized and directed
to certify to the Washington County Auditor - Treasurer
the General Fund levy for the City of Oak Park Heights
for calendar year 1993 in the amount of $1,278,310.00.
2. That the City Clerk is also authorized and directed to
certify to the County Auditor - Treasurer for collection
the sum of $24,000 for improvements to Storm Sewer
Improvement Tax District No. 1, the same to be
collected in calendar year 1993 with the real estate
taxes on the affected properties.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING THE 1993 BUDGET
WHEREAS, the City Staff has prepared and submitted to the
City Council the proposed budget for calendar year 1993; and,
WHEREAS, public notice has been duly given as provided by
law with public hearings being conducted by the City Council with
regard to the proposed budget, receiving no adverse comment from
the public with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park Heights
has determined that the proposed budget as submitted by the City
Staff is in the best interests of the citizens of the City of Oak
Park Heights.
NOW, THEREFORE, BE IT RESOLVED, by the City Council for the
City of Oak Park Heights:
• That the 1993 budget is hereby approved as presented by
the City Auditor in the total General Fund amount of
$1,680,470.00.

RESOLUTION NO. 92 -11 -50
RESOLUTION OF THE CITY OF OAR PARK HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, RECEIVING PRELIMINARY REPORT
AND CALLING FOR PUBLIC HEARING ON 58TH STREET
IMPROVEMENTS OF 1993
WHEREAS, the City Council deems it necessary and expedient
that the City of Oak Park Heights, Washington County, Minnesota,
construct certain improvements, to -wit: 58th Street and utility
improvements, within said City as described and in accordance with
the preliminary plans and specifications report prepared by
Bonestroo, Rosene, Anderlik & Associates, consulting engineers,
and,
WHEREAS, the City Council has been advised by the consulting
engineers that said 58th Street Improvements of 1993 are feasible
and should best be made as proposed, and the consulting engineers
report to this effect has heretofore been received by the City
Council and filed with the City Clerk, and,
• WHEREAS, the statute provides that no such improvement shall
be made until the Council shall have held a public hearing on such
improvements following a mailed notice and two publications thereof
in the official newspaper stating the time and place of the
hearing, the general nature of the improvement, and the estimated
cost therefore and the area proposed to be assessed, in accordance
with the law;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OAR PARR HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS FOLLOWS:
1. A public hearing will be held at the time and place set
forth in the Notice of Hearing attached hereto as Exhibit A to
consider said proposed improvements.
2. The nature of the improvements, the estimated cost of
each portion thereof, and the areas proposed to be assessed
therefore, described in the form of Notice of Hearing hereto
attached.
3. The Notice of Public Hearing shall be in substantially
the form contained in the notice hereto attached.
4. The City Clerk is hereby authorized and directed to cause
said Notice of Hearing to be given two publications in the official
• newspaper. Said publications shall be one week apart, and at least
three days shall elapse between the last date of publication and
the date of hearing. Not less than 10 days before the hearing the
Clerk shall mail notice of the hearing to the owner of each parcel
of land within the area proposed to be assessed as described in the
notice. For the purpose of giving such mailed notice, owners shall
be those as to be shown on the records of the County Auditor or,
if the tax statements of the County are mailed by the County
Treasurer, on the record with the County Treasurer. As to
properties not listed on the records of the Auditor or County
Treasurer the Clerk shall ascertain such ownership by any
practicable means and give mail notice to such owners.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION DESIGNATING ADDITIONAL OFFICIAL
DEPOSITORIES FOR THE CITY OF OAK PARK HEIGHTS
WHEREAS, the City of Oak Park Heights is required by law to
designate official depositories; and,
WHEREAS, the office of the finance director of the City of Oak
Park Heights has recommended that we add the State Bank of Lake
Elmo as an additional authorized depository to the list of official
depositories for the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the First State Bank of Lake Elmo is
hereby designated as an additional official depository of the City
of Oak Park Heights.

Member Carufel introduced the following Resolution and moved

RESOLUTION NO. 92- 11 -48
RESOLUTION OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, ADOPTING ASSESSMENT ROLL AS
PREPARED BY THE CITY ENGINEER AS IT AFFECTS VALLEY POINT II
WHEREAS, pursuant to a notice duly given as required by law,
and further pursuant to the terms of the Development Agreement
entered into between the City of Oak Park Heights and Krongard
Construction Company as it affects the development of Valley
Point II, the City Council has met, heard and passed, upon all
objections to the proposed assessment for Valley Point II and the
improvements thereto for the calendar year 1992.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS
FOLLOWS:
1. Such proposed assessment, a copy of which is attached
hereto and made part hereof by reference, is hereby adopted and
shall constitute the special assessment against the lands named
therein, and each tract of land therein is hereby found to be
benefitted by the proposed improvement.

• 2. Such assessments shall be as follows:
a. The assessment shall be payable in equal annual
installments extending over a period of one (1)
year, the first of said installment shall be
payable with the general taxes for calendar year
1993 collectible with such taxes during the
calendar year 1993.
b. To the first installment shall be added interest
at the rate of 7.5% per annum on the entire
principal amount of the assessment from the date
of this resolution until December 31st of the year
in which such installment is payable.
C. The owner of the property so assessed may at any
time prior to the certification of the assessment
or the first installment thereof to the County
Auditor, pay the whole of such principal amount of
the assessment on such property with interest
accrued to the date of payment to the City
Treasurer, except that no interest shall be
charged if the entire assessment is paid within
thirty (30) days from the date hereof.
3. The City Clerk shall forthwith transmit a certified
• duplicate copy of this assessment to the County Auditor to be
extended on the tax list at the County.
The motion for the adoption of the foregoing Resolution
was duly seconded by Member Kern; and upon a voice vote being
taken thereon the following voted in favor thereof:

Whereupon said Resolution was declared duly passed and

Pursuant to due call and notice thereof, a regular meeting
of the City Council of the City of Oak Park Heights, Washington
County, Minnesota, was duly called and duly held at the City Hall
within said City on the 9th day of November, 1992, at 7:00
o'clock p.m.
The following members were present:

RESOLUTION NO. 92 - 11 -47
RESOLUTION OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, ADOPTING ASSESSMENT ROLL AS
PREPARED BY THE CITY ENGINEER AS IT AFFECTS ASSESSMENTS
FOR THE CONSTRUCTION OF WATER MAINS AND LATERAL SANITARY
SEWER AND LIFT STATION, FORCED MAIN TRUNKS AND
LATERALS AND APPURTENANCES THERETO
WHEREAS, pursuant to a notice duly given as required by law,
the City Council has met, heard and passed, upon all objections
to the proposed assessment for the construction of water mains,
laterals, sanitary sewer, lift station, forced main trunks and
laterals and appurtenances thereto as the same were constructed
in the calendar year 1991.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS
FOLLOWS:
1. Such proposed assessment, a copy of which is attached
hereto and made part hereof by reference, is hereby adopted and
shall constitute the special assessment against the lands named
• therein, and each tract of land therein is hereby found to be
benefitted by the proposed improvement.
2. Such assessments shall be as follows:
a. The assessment shall be payable in equal annual
• installments extending over a period of five (5)
years, the first of said installments shall be
payable with the general taxes for calendar year
1993 collectible with such taxes during the year
1993.

b. To the first installment shall be added interest
at the rate of 7.5% per annum on the entire
principal amount of the assessment from the date
of this resolution until December 31st of the year
in which such installment is payable. To each
subsequent installment, when due, there shall be
added interest for one year at said rate on the
unpaid principal amount of the assessment.
C. The owner of any property so assessed may at any
time prior to the certification of the assessment
or the first installment thereof to the County
Auditor, pay the whole of the principal amount of
the assessment on any such property with interest
accrued to the date of payment to the City
Treasurer, except that no interest shall be
charged if the entire assessment is paid within
thirty (30) days from the date hereof; and such
property owner may, at any time prior to November
• 15th of any year, pay to the County Auditor the
entire principal amount of the assessment
remaining due with interest accrued to December
31st of the year in which said payment is made.
3. The City Clerk shall forthwith transmit a certified
duplicate copy of this assessment to the County Auditor to be
extended on the tax list at the County.
The motion for the adoption of the foregoing Resolution
was duly seconded by Member Carufel; and upon a voice vote being
taken thereon the following voted in favor thereof:

A RESOLUTION APPROVING ASSESSMENTS FOR SPECIAL
CHARGE /JUDGMENTS AS PRESENTED BY CITY ADMINISTRATOR
WHEREAS, the City Council for the City of Oak Park Heights
has received from the office of the City Clerk /Administrator
assessments to be certified to Washington County for delinquent
utility charges and other fees owed the City of Oak Park Heights;
and,
WHEREAS, said list has been reviewed by the City Council.

CITY OF OAK PARK HEIGHTS

A RESOLUTION RESETTING THE PUBLIC HEARING DATE
FOR THE HIGHWAY 36 /NORELL AVENUE
PUBLIC UTILITY EXTENSION PROJECT OF 1991
WHEREAS, the City Council for the City of Oak Park Heights
previously established a public hearing for the Highway 36 and
Norell Avenue utility project establishing a public hearing for the
assessments to be heard as of October 26, 1992; and,
WHEREAS, the City Council desires to reset said such public
hearing to a later date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the public hearing on the assessments for
the Highway 36 and Norell Avenue utility extension project shall
be re- established for Monday, November 9, 1992 at 7:00 p.m.

NOVEMBER 3RD GENERAL ELECTION
WHEREAS, the City Clerk has provided to the City Council a
list of election judges to be approved for the November 3rd general
election; and,
WHEREAS, all such proposed election judges have been duly
qualified and are authorized to act in that capacity pursuant to
law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the election judges as set forth within
the list prepared by the City Clerk be and the same are hereby
approved to act as election judges for the November 3rd general
election within the City of Oak Park Heights.

A RESOLUTION CALLING FOR HEARING ON
ASSESSMENTS FOR HIGHWAY 36 /NORELL AVENUE UTILITY
EXTENSION, IMPROVEMENTS OF 1991
WHEREAS, the City Clerk with the assistance of the City
consulting engineers prepared an assessment roll for the Highway
36 /Norell Avenue utility extensions improvements of 1991, a copy
of which is on file and of record with the City Clerk and open to
public inspection.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS FOLLOWS:
1. The Clerk shall publish a notice that this Council will
meet to consider the proposed assessments on October 26, 1992 at
7:00 p.m. at the City Hall within the City of Oak Park Heights,
Washington County, Minnesota. The published notice shall be
substantially in the form set forth on Exhibit A attached hereto.
2. A copy of the notice in substantially the form set forth
in Exhibit B attached hereto shall be mailed to the owners of each
parcel of property described in the assessment roll.

• 3. Said notice attached as Exhibit A hereto shall be
published by the City Clerk in the official newspaper at least two
weeks prior to the hearing and the notice attached hereto as
Exhibit B shall be mailed by the City Clerk to owners of each
parcel described in the assessment roll.
4. If the adopted assessment differs from the proposed
assessment as to any particular lot, piece or parcel of land, the
Clerk shall mail to the owner a notice stating the amount of the
adopted assessment. Owners must also be notified by mail of any
changes adopted by the Council and interest rates for prepayment
requirements from those contained in the mailed notice of the
proposed assessment.

was duly seconded by Member Carufel and upon a vote being taken

RESOLUTION OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON
COUNTY, MINNESOTA, AUTHORIZING THE PREPARATION AND
NEGOTIATION OF STREET AND PUBLIC UTILITY EASEMENT
AGREEMENTS, THE INITIATION OF CONDEMNATION PROCEEDINGS
FOR STREET AND PUBLIC UTILITIES NECESSARY FOR THE
DEVELOPMENT OF 58TH STREET, AND FURTHER AUTHORIZING THE
QUICK -TAKE OF THE SUBJECT PROPERTIES
WHEREAS, it is necessary for the City of Oak Park Heights to
obtain street easements and public utility easements for the
development of 58th Street to be located within the City of Oak
Park Heights; and,
WHEREAS, legal descriptions, easements, agreements, and
appraisals must be obtained for the necessary easements; and,
WHEREAS, it may be possible to negotiate the acquisition of
said easements; and,
WHEREAS, it is necessary to take possession of the subject
properties prior to the filing of the Court Appointed
• Commissioners' Award; and,

• WHEREAS, the City will cause the subject properties to be
appraised.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE
CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AS
FOLLOWS:
1. The Mayor and the City Clerk are hereby authorized to
execute storm water ponding, drainage, utility and street
improvements for the development of 58th Street.
2. Staff and legal counsel are hereby authorized to
initiate condemnation proceedings for the parcels for which
negotiated settlements could not be reasonably reached for the
acquisition of said easements.
3. That the appraisal of damages for the subject takings is
hereby authorized as the official appraisal of the City.
4. That the staff and legal counsel are hereby authorized
to take all necessary steps to acquire possession of the subject
property pursuant to the quick -take provisions of Minnesota
Statutes Chapter 117.042.
• The motion for the adoption of the foregoing Resolution
was duly seconded by Member Seggelke; and upon a roll call being

A RESOLUTION APPROVING CHANGE ORDER NUMBER
ONE WAL -MART ADDITION UTILITY AND STREET
IMPROVEMENTS ENGINEERING FILE 55102
WHEREAS, the City Engineers Office has prepared pursuant
to instruction by the City Council a Change Order to the Wal -Mart
Addition Utility and Street Improvements Contract to provide for
the construction of a detached frontage road in the area of Trunk
Highway 36 with its intersection with Norell Avenue within the City
of Oak Park Heights; and,
WHEREAS, the intersection of Trunk Highway 36 and
Washington Avenue /Norell Avenue is located within the City of Oak
Park Heights has been experiencing increasing traffic loads; and
WHEREAS, extensive meetings have been conducted since May
of 1992 between representatives of the Minnesota Department of
• Transportation, Wal -Mart Stores, Inc. and affected property owners
that are served by the intersection in question; and
WHEREAS, all parties desire to promote the public safety
and good by the construction of a detached frontage road in the
area of Norell Avenue with its intersection with Trunk Highway 36;
and,
WHEREAS, the Minnesota Department of Transportation is
willing to execute a Memorandum of Understanding and Supplemental
Construction Agreement with the City of Oak Park Heights affecting
the construction of the detached frontage road as it affects Trunk
Highway 36 and its intersection with Norell Avenue providing for
the reimbursement to the City of Oak Park Heights for its
construction and further reimbursement to the City as it affects
land acquisition costs to be more fully provided for in a
Memorandum of Understanding to be executed between the affected
property owners, the City of Oak Park Heights, Wal -Mart Stores,
Inc. and the Minnesota Department of Transportation; and
WHEREAS, the City has previously issued by Resolution 92-
08-35 , its intention to enter into a Supplemental Agreement
to its existing Norell Avenue Construction Agreement /Wal -Mart
Improvements Contract with the Minnesota Department of
Transportation to affect the construction of this project in a
• timely manner so as to serve public safety and the interests of the

Heights in this area.

City of Oak Park Heights that Change Order Number 1 in the manner
and form annexed hereto is hereby approved and the Mayor and the

A RESOLUTION APPROVING BUDGET TRANSFERS AS RECOMMENDED
BY THE FINANCE DIRECTOR
WHEREAS, the City Council has received a recommendation from
the finance director recommending the transfer of funds so as to
allow the purchase of Optech III -P voting machines as recommended
by Washington County; and,
WHEREAS, the purchase of the voting machines will be necessary
to provide for efficient services to the voters of the City of Oak
Park Heights on election day and during the primaries; and,
WHEREAS, the finance director has recommended the transfer of
funds so as to implement the purchase.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the recommendation of the finance director
approving the transfer of funds so as to allow the purchase of the

A RESOLUTION APPROVING BUDGET TRANSFERS
WHEREAS, the City Council for the City of Oak Park Heights has
received a report from its finance director recommending the
transfer of $4,400.00 for the purposes of providing for tree
pruning expenses with $2,250.00 being transferred from the
municipal building utilities fund to the tree and weed removal and
other contractual services fund and $2,150.00 from the fire
protection and other contractual services fund to the tree and weed
removal fund; and,
WHEREAS, said budget transfers are in line with existing
budgets as adopted by the City of Oak Park Heights and shall not
increase any tax burden to the residents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the finance director for the City is
herewith directed to make the following budget transfers
• immediately:
1. From municipal building utilities the sum of $2,250.00
to be transferred to tree and weed removal other contractual
services.

A RESOLUTION REQUESTING THE DEVELOPMENT OF A
COOPERATIVE CONSTRUCTION AGREEMENT BETWEEN THE
CITY OF OAK PARK HEIGHTS AND MINNESOTA DEPARTMENT
OF TRANSPORTATION FOR IMPROVEMENTS AT TRUNK
HIGHWAY 36 /NORELL AVENUE INTERSECTION
WHEREAS, the intersection of Trunk Highway 36 and
Washington Avenue /Norell Avenue as located within the City of Oak
Park Heights has been experiencing increasing traffic loads; and,
WHEREAS, the surface of the Frontage Road between
Oakgreen Avenue and Trunk Highway Number 5 is deteriorating,
narrow, and in need of upgrade to handle increasing traffic loads
that have been experienced within the past years; and,
WHEREAS, the planned intersection improvements affecting
the Frontage Road for the Norell Avenue extension into the City of
Oak Park Heights are inadequate for projected volumes and traffic
types as determined by the Minnesota Department of Transportation;
and,
WHEREAS, a Wal -Mart Department Store located adjacent to
Norell Avenue is expected to open in the Fall of 1992; and
WHEREAS, the Wal -Mart Department Store was given a permit
by the Minnesota Department of Transportation to construct an
access driveway onto the Frontage Road in close proximity to the
Norell Avenue intersection which application was granted on or
about April 20, 1992; and
WHEREAS, the City of Oak Park Heights has made
application for access permit for Norell Avenue to the intersection
of the Frontage Road at TH36 as of April 1, 1992; and
WHEREAS, both the Department of Transportation and the
City of Oak Park Heights agree that a reconstruction of the
Frontage Road at the Norell Avenue intersection with Trunk Highway
36 is in the best interest of the public safety; and
WHEREAS, through a series of meetings that have been
conducted since May of 1992 to the present date between affected
property owners, the City of Oak Park Heights, the Minnesota
Department of Transportation, and others, the affected property
owners are in agreement with the Minnesota Department of
Transportation and the City of Oak Park Heights to cooperate
affecting the construction of a detached Frontage Road at the

Norell Avenue intersection with Trunk Highway 36 which would
involve the dedication by the affected property owners of the
necessary right -of -way in order to construct said detached Frontage
Road; and
WHEREAS, the present circumstances existing in the area
provide a unique opportunity for the City of Oak Park Heights, the
Minnesota Department of Transportation and the affected property
owners to make a substantial improvement in traffic circulation and
public safety in the area of Norell Avenue at its intersection with
the south Frontage Road of Trunk Highway 36; and
WHEREAS, there is an immediate need to acquire the
necessary right -of -way and construct the improvements to implement
a detached Frontage Road system at the intersection of Norell
Avenue and Trunk'Highway 36; and,
WHEREAS, the Minnesota Department of Transportation has
in the past entered into a Joint Cooperative Construction Agreement
with the City of Stillwater affecting a construction of a detached
Frontage Road on Washington Avenue which is located immediately to
the North of the Norell Avenue /Trunk Highway 36 intersection; and,
WHEREAS, the intersection that would be constructed by
the City of Oak Park Heights under such joint agreement with the
• Minnesota Department of Transportation would be compatible with
that which has been constructed within the City of Stillwater on
the other side of Trunk Highway 36 located immediately across from
the Norell Avenue intersection; and
WHEREAS, the Wal -Mart Department Store opening now
scheduled for the Fall of 1992 will further increase traffic and
congestion levels given the planned intersection geometrics; and
WHEREAS, the City of Oak Park Heights fully supports the
improvement of Norell Avenue /South Frontage Road /Trunk Highway 36
intersection in a coordinated effort with Minnesota Department of
Transportation.
NOW, THEREFORE, IT IS RESOLVED as follows:
1. That the City of Oak Park Heights in order to
facilitate needs of the public, promote the public safety and take
advantage of opportunities that will effect a public cost savings
at this time to both the State of Minnesota and the City of Oak
Park Heights herewith requests the immediate development of a
cooperative construction agreement between the City of Oak Park
Heights and the Minnesota Department of Transportation for
improvements to the Trunk Highway 36 /Frontage Road /Norell Avenue
intersection;

IN GENERAL OBLIGATION REFUNDING BONDS
WHEREAS, the City Council for the City of Oak Park Heights has
received the report from its financial consultants, Juran & Moody,
as it affects the issuance of $150,000.00 general obligation
refunding bonds; and,
WHEREAS, the City Council for the City of Oak Park Heights
determines it to be in the best interest of its residents to
refinance the general obligation sewer bonds of 1982 to take
advantage of a lower interest rate.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that:
1. The City herewith authorizes the issuance of $150,000.00
in general obligation refunding bonds to be purchased by Juran &
• Moody so as to refinance the general obligation sewer bonds of
1982.

City's financial consultants to implement the issuance of the

BOUND SIDE OF 55TH STREET AT OAKGREEN AVENUE
WHEREAS, the City Council for the City of Oak Park Heights has
received a report from the office of the police department
recommending the placement of a stop sign at the intersection of
55th Street and Oakgreen Avenue so as to control the east bound
traffic exiting or entering onto Oakgreen Avenue; and,
WHEREAS, public safety would best be served by placing a stop
sign at that location as recommended by the Chief of Police.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the Office of the Chief of Police and the
Public Utility Department of the City of Oak Park Heights are
herewith directed to establish and place a stop sign controlling
the east bound traffic of 55th Street at its point of intersection
• with Oakgreen Avenue with a stop sign being placed to require the

A RESOLUTION APPROVING THE REQUEST FROM PAPER
WAREHOUSE FOR A VARIANCE AND AMENDMENT TO THE
PLANNED UNIT DEVELOPMENT, ST. CROIX MALL SO AS TO
AFFECT THE PLACEMENT OF A FREE STANDING SIGN
WHEREAS, Paper Warehouse and the St. Croix Mall have applied
for an amendment to the PUD that now serves the St. Croix Mall to
add a variance so that they should be allowed to erect a free
standing sign along Osgood Avenue; and,
WHEREAS, said sign is to have a 150 square foot sign face and
be approximately 10' x 15' in size; and,
WHEREAS, Paper Warehouse does not have a connection to the
Mall and its sign is not readily visible with existing signage for
the Mall; and,
WHEREAS, Paper Warehouse itself is not accessible from the
• general mall area and is isolated and requires separate signage;
and,
WHEREAS, Paper Warehouse's business would be impaired if the
variance were not granted; and,
WHEREAS, due to Paper Warehouse's location within the Mall on
the lower entrance east side which is detached from the rest of the
Mall, there is a typographical location hardship which is created
to that business as a result of that location.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the request for variance amendment to the
Planned Unit Development as submitted by the St. Croix Mall to
erect a free standing monument sign along Osgood Avenue is hereby
adopted and approved.

114; and,
WHEREAS, the office of the surveyor for the property owner has
requested a correction to Registered Land Survey No. 114 to correct
certain typographical errors; and,
WHEREAS, the office of the city attorney concurs with the
correction.

NO PARKING ZONES AND POSTING OF SIGNS AT
THE ENTRANCE DRIVE TO OAK RIDGE PLACE
WHEREAS, the office of the Chief of Police of the City of Oak
Park Heights has conducted a study as to public safety and parking
issues in the area of Oak Ridge Place as the same is located within
the City of Oak Park Heights; and,
WHEREAS, the Chief of Police recommends the extension of the
no parking zones in the area of the existing driveway and the
posting of signage to mark the extension of the no- parking zone to
be established; and,
WHEREAS, the residents and management of Oak Ridge Place have
concurred with the recommendation of the Chief of Police to extend
the no- parking zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
• of Oak Park Heights that the Chief of Police and the office of the
Public Utility Director are herewith directed and authorized to
post additional no- parking zone and area in the area of the
driveway entrances of Oak Ridge Place in the manner and form
depicted within the report provided to the City of Oak Park Heights
by the office of the Chief of Police.

A RESOLUTION APPROVING BUDGET AMENDMENTS
PURSUANT TO THE FINANCE DIRECTOR'S RECOMMENDATION
WHEREAS, the City Council for the City of Oak Park Heights has
received a written memorandum and recommendation from the office
of the finance director implementing certain budget amendments as
it affects the building inspection department; and,
WHEREAS, said memorandum has been approved by the city
auditor; and,
WHEREAS, the Council determined said recommendations of the
finance director to be in the best interest of the community and
the citizens of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the recommendations of the finance
director as contained within their presented to the City Council
• at this meeting of June 22, 1992 be and the same is hereby adopted
and the finance director is authorized to make said amendments

AN ORDINANCE ADOPTING AN AMENDMENT TO CHAPTER 401,
SECTION 401.03I.1.g. RELATING TO TEMPORARY SIGNS
WHEREAS, the City Council for the City of Oak Park Heights has
received a recommendation from the office of the building inspector
and the city attorney proposing an amendment to Chapter 401,
Section 401.03I.1.g. relating to temporary signs; and,
WHEREAS, the City Council duly conducted a public hearing on
same; and,
WHEREAS, there has bee no adverse public comment received as
a result of said public hearing; and,
WHEREAS, the City Council determines that the amendment as
proposed by the offices of the building inspector and the city
attorney provides for the public interest of the citizens of the
City of Oak Park Heights.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that:
1. Chapter 401 at Section 401.03I.1.g. is hereby amended as
proposed by the office of the building inspector and the city
attorney.
2. That the City Clerk is herewith authorized and directed
to amend the City Code Book to incorporate said ordinance and
amendments therein and to publish a true and correct copy thereof
in the official newspaper of the City of Oak Park Heights as is
required by law.

A RESOLUTION ADOPTING WATER MANAGEMENT PLAN
WHEREAS, the laws of the State of Minnesota require
municipalities to adopt and enforce within their respective
jurisdictions a water management plan affecting surface water,
drainage on wetland management provisions; and,
WHEREAS, the City Council for the City of Oak Park Heights
previously prepared a water management plan through the offices of
the Middle St. Croix Valley Water Management Organization; and,
WHEREAS, the water management plan is proposed to be adopted
by the City of Oak Park Heights has been approved by the offices
of the Middle St. Croix Valley Water Management Organization; and,
WHEREAS, the City staff recommends the adoption of said water
management plan; and,
WHEREAS, public hearings have been duly held on said water
management plan and there have been no adverse public comments
• related thereto.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that the water management plan on file and of
record in the office of the City Clerk as of this date shall be
adopted by the City as its official Water Management Plan.

AND 403 AFFECTING SOIL EROSION AND RESTRICTIVE
SOILS AND AUTHORIZING THERE INCLUSION INTO THE CITY CODE
WHEREAS, the City Council for the City of Oak Park Heights has
received proposed Ordinances affecting soil erosion and restrictive
soils to be implemented at Chapters 310 and 403 of the City Code
respectively; and,
WHEREAS, said Ordinances as proposes have been reviewed by the
Middle St. Croix Valley Water Management Organization and they
recommend same; and,
WHEREAS, City Staff has recommended the adoption of these
Ordinance and inclusion within the City Code; and,
WHEREAS, the City Council has conducted public hearings on
said Ordinances and has received no adverse public comment thereon.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights as follows:
1. That the proposed Ordinances on Soil Erosion and
Restrictive Soils as prepared by the office of the City Attorney
are herewith adopted.
2. That the Ordinances on Soil Erosion shall be inserted
into the City Code at Chapter 310 and the provisions on Restrictive
Soils shall be inserted within the Code at Chapter 403.
3. That the City Clerk is herewith authorized and directed
to publish a summary of said Ordinances in the manner and form
provided by law.

A RESOLUTION REAFFIRMING THE CITY'S POSITION AS
CONTAINED WITHIN RESOLUTION 92 -3 -15 AND FURTHER
CLARIFYING THE CITY OF OAK PARK HEIGHTS' CONSENSUS
WITH THE CITY OF STILLWATER AFFECTING POSITION ON
NEW BRIDGE ACROSS ST. CROIX RIVER AND TRUNK
HIGHWAY 36 IMPROVEMENT
WHEREAS, the City Council for the City of Oak Park Heights has
previously approved Resolution 92 -3 -15 stating its position as it
affects the proposal of the Minnesota Department of Transportation
for reconstruction of Trunk Highway 36 corridor improvements and
construction of a new bridge across the St. Croix River; and,
WHEREAS, the City of Oak Park Heights has consulted with the
City of Stillwater as it affects issues effecting the
reconstruction of Minnesota Trunk Highway 36 and the proposal to
• construct the new bridge and the various impacts on both of the
communities; and,
WHEREAS, both cities have expressed a common need to be
sensitive to the various impacts on adjoining neighborhoods, the
business community, and the needs of both cities and their
residents; and,
WHEREAS, both cities wish to clarify their common interest and
resolve to work cooperatively on issues as it affects Minnesota
Trunk Highway 36 and the proposed new bridge.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
city of Oak Park Heights:
1. That the position adopted by the City of Oak Park
Heights within its Resolution 92 -3 -15 is herewith reaffirmed.
2. That the City of Oak Park Heights continues to
prefer the central corridor as set forth within the above
referenced Resolution, but does agree with the City of
Stillwater to consider and evaluate either the central or
southern alignment within the proposed southern corridor as
it affects the Highway 36 /Bridge Improvements proposed by
MNDOT so as to further determine and resolve issues as it
affects economic and environmental feasibility of those
• respective options.
• 3. That the City of Oak Park Heights agrees that Trunk
Highway 36 Improvements should be staged with upgrades of
frontage road systems on both sides of Minnesota Trunk Highway
36 to be completed along with the bridge construction.
4. The City of Oak Park Heights concurs with the City
of Stillwater that Highway 36 Improvement Plan should minimize
the impact on business and not lower the highway grade of
Minnesota Trunk Highway 36.

A RESOLUTION INCREASING EXTERIOR
SEWER AND WATER INSPECTION FEES
WHEREAS, the Utility Department for the City of Oak Park
Heights has recommended to the City Council that expenses incurred
in providing services for inspections of exterior sewer and water
inspection fees; and,
WHEREAS, said Department has recommended an increase of
inspection fees for exterior sewer and water inspection fees from
$8.00 to $15.00 each effective July 1, 1992; and,
WHEREAS, the City Council determines it to be in the public
interest to have the expenses actually incurred for such
inspections be paid by those individuals requesting same.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that exterior sewer and water inspection fees
• are herewith authorized within the Utility Department from $8.00
to $15.00 each effective July 1, 1992.

WHEREAS, the City has fulfilled the reserve requirements of
the General Fund at December 31, 1991; and
WHEREAS, there remains approximately $175,000 of
undesignated fund balance in the General Fund at December 31,
1991; and
WHEREAS, the City desires to transfer $100,000 to the
Capital Improvements Fund.
NOW, THEREFORE BE IT RESOLVED, that the City transfer of
$100,000 from the General Fund to the Capital Improvements Fund
(unallocated sub - account) effective December 31, 1991.

gambling license submitted on behalf of Ducks Unlimited by Michael
J. Dvorak proposing that the gambling site would be the VFW Post
323 requesting permission to run a raffle in the month of June 1992
on a single event on behalf of Ducks Unlimited; and,
WHEREAS, Ducks Unlimited is a non - profit organization;
and,
WHEREAS, the City Council for the City of Oak Park
Heights received no adverse comment with regard to the application

A RESOLUTION INCREASING WATER UTILITY
RATES TO BE BILLED WITHIN THE CITY OF
OAK PARK HEIGHTS TO COMPENSATE FOR THE
STATUTORILY MANDATED ANNUAL FEE TO BE
COLLECTED AND PAID TO THE DEPARTMENT
OF REVENUE FOR TESTING OF WATER SUPPLIES
WHEREAS, the 1992 Legislature has mandated an annual fee
of $5.21 be collected from each service connection to a public
water system and forwarded to the Department of Revenue for testing
of certain elements within water supplies; and,
WHEREAS, the City of Oak Park Heights provides a public
water system and is obligated to collect said fee and return it to
the Department of Revenue; and,
WHEREAS, the City of Oak Park Heights has determined that
it is reasonable to collect said fee from the water users for each
connection.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights that the city water billings now billed
on a quarterly basis will be increased by the rate of $1.30 per
quarter commencing as of the next billing cycle so as to recoup for
the City the expense and cost to be collected as required by law
for public testing of water supplies.
BE IT FURTHER RESOLVED that the office of the City
Clerk/ Administrator is hereby authorized to increase quarterly
water billings accordingly by the rate of $1.30 per quarter and to
comply with the statutory mandate forwarding on to the Department
of Revenue the revenue so collected in compliance with said
statute.

VFW POST 323 COMMENCING MAY 6, 1992
WHEREAS, the City of Oak Park Heights has received the
application on behalf of Ducks Unlimited filed by J. Michael Dvorak
requesting permission of the City of Oak Park Heights pursuant to
the Minnesota lawful gambling law to allow Ducks Unlimited to
conduct raffles at the sight of the VFW Post 323, 5880 Omaha
Avenue, Oak Park Heights, MN 55032 commencing May 6, 1992; and,
WHEREAS, all proceeds received from said operations will
be dedicated to public /civil use in the manner and form authorized
under the statutes of the State of Minnesota in such case made and
provided for; and,
WHEREAS, Ducks Unlimited provides a valuable civic
function and purpose within this community within the State of
Minnesota; and,
• WHEREAS, it appears that Ducks Unlimited qualifies under
the statute allowing charitable gambling with all proceeds to be
expended in the manner provided for by law for such civic and
charitable uses.
NOW, THEREFORE, BE IT RESOLVED and recommended by the City

MALL PUD TO ALLOW FOR THE EXPANSION OF MALL THEATERS
WHEREAS, the City of Oak Park Heights has received an
application from the Mann Theaters and from the St. Croix Mall
providing for the construction of addition to the Mann Theaters now
located in the St. Croix Mall; and,
WHEREAS, the related improvements for parking, lighting
signage and theater additions all appear to be in accordance with
building plans and specifications and have been approved by the
office of the City Building Inspector and City Engineer and
Planner.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights as follows:
1. That the St. Croix Mall PUD is herewith amended to allow
• the expansion of the Mall Theaters and additions thereto.
2. That the plans and specifications for the addition to the
St. Croix Mall in the area of the Mall Theaters and related parking
lot signage and lighting improvements as are outlined within the
plans and specifications which have been provided and are annexed

Heights and Wal -Mart Stores, Inc. pursuant to the terms of the
Development Agreement; and,

within the City of Oak Park Heights as well as plat of Wal -Mart
Addition; and,
WHEREAS, pursuant to the terms of the Development Agreement
made and entered into between the City of Oak Park Heights with
Wal -Mart, Inc., Wal -Mart is requesting that certain municipal
utilities and streets be constructed; and,
WHEREAS, it is necessary to prepare certain bids and
specifications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION PROVIDING THE POSITION OF THE CITY
OF OAK PARK HEIGHTS AS IT AFFECTS THE PROPOSAL
OF THE MINNESOTA DEPARTMENT OF TRANSPORTATION
FOR RECONSTRUCTION OF TRUNK HIGHWAY 36 CORRIDOR
IMPROVEMENTS AND THE CONSTRUCTION OF A NEW
BRIDGE ACROSS THE ST. CROIX RIVER
WHEREAS, the City Council for the City of Oak Park Heights
has had the opportunity to receive public comment from its citizens
as it affects.plans by the Minnesota Department of Transportation
effecting the reconstruction of Trunk Highway 36 and Corridor
Improvements related thereto as well as the current plans of the
Department of Transportation to construct a bridge across the St.
Croix River utilizing "the southern corridor" proposal; and,
WHEREAS, the City Council for the City of Oak Park Heights
has received the staff report of its planner, Northwest Associated
Consultants, Inc., as well as the staff reports from its City
Auditor, Tautges, Redpath & Co., Ltd., and reports from its
Consulting Engineers, Bonestroo, Anderlik & Associates; and,
• Based upon the foregoing, the City Council determines that
the following negative impacts will occur within the City of Oak
Park Heights if the currently proposed Trunk Highway 36 corridor
improvements and currently proposed St. Croix Riverway Bridge are
constructed as currently proposed by the Minnesota Department of
Transportation:
1. The south corridor bridge will require the removal
of significant portions of the City of Oak Park Heights
neighborhoods in the area of the bridge construction and also
result in an adverse and long term impact to adjacent
neighborhoods.
2. That the south corridor bridge will have an adverse
impact on the elderly, moderate and low income families within
the City of Oak Park Heights who predominately occupy the
impacted neighborhoods that will be lost if the south corridor
bridge is constructed.
3. That the south corridor bridge if constructed would
result in a loss of affordable housing stock within the City
of Oak Park Heights for which there is insufficient
replacement housing stock now existing within the City of Oak
Park Heights to replace same.
4. Removal of the major portion of the residences in
• the area of Cover Park will adversely impact the park and its
value to the City.
• 5. That the south corridor bridge will seriously
disrupt the City's established grid type street system and
traffic distribution network.
6. That the southern corridor construction will result
in a loss of Beach Road which provides an important connection
between two significant areas of the City.
7. That the south corridor bridge will result in the
disruption of the municipal utilities and expense to the City
for the replacement and reconnection of same which has not
been budgeted for nor is projected as an expense of the City
at the present time.
8. That the south corridor construction will result in
a significant financial loss to the City of Oak Park Heights
of tax base and market value of homes and properties.
9. That the south corridor bridge construction will
result in a disruption of school enrollment for Oak Park
Heights students.
10. That the south corridor bridge construction will
result in disruption of emergency vehicle access and increase
response time of emergency vehicles into the areas disrupted
• by that construction.
11. That the south corridor bridge construction project
will create significant environmental impacts, most notably
bluff cuts on the Wisconsin side as well as bluff cuts and
bridge visual impacts to Oak Park Heights residents on the
Minnesota side.
12. That the proposed reconstruction project for Trunk
Highway 36 which includes the lowering of the roadway and
limiting of access will result in a removal of businesses
within the City of Oak Park Heights with a corresponding loss
of employment.
13. That the proposed Trunk Highway 36 reconstruction
project will limit access within the Trunk Highway 36 corridor
requiring the removal of residences within the corridor and
adverse affects to residential areas adjacent to the corridor.
14. That the Trunk Highway 36 limited access corridor
will result in a loss of visibility and direct access for
existing and undeveloped commercial property with the City of
Oak Park Heights, including, but not limited to, the St. Croix
Mall and other business located along Trunk Highway 36.

• 15. That the limited access Trunk Highway 36 corridor
would result in short term construction impacts affecting the
degree to which people will shop in the area during
construction and, probably impact a significant loss of
business revenue during the period of time of construction for
those business located on or around the Trunk Highway 36
corridor.
The City Council for the City of Oak Park Heights further
finds that as it affects the existing proposal for the central
corridor option that the City advocates additional study on the
alternative by MnDot for the central corridor for the following
reasons:
A. - The central corridor option will result in less of
an impact to the City of Oak Park Heights neighborhoods which
currently under the southern corridor proposal bear the
primary negative impact of all construction within the
southern corridor proposal. Within the central corridor
proposal, fewer people would be required to be displaced or
adversely affected.
B. The central corridor option would have less of an
impact to elderly, moderate and low income individuals and
families with children than does the southern corridor option.
• C. The central corridor bridge option would not have
a negative impact on Cover Park and the related public
facilities as are impacted by the southern corridor bridge
option.
D. That the central corridor bridge option would result
in less disruption to transportation utility systems within
the City of Oak Park Heights and less cost and expense to the
City of Oak Park Heights necessitated by the relocation and
reconnection to municipal utilities.
E. That the central corridor bridge option which have
less of a financial impact on the City of Oak Park Heights
most notably on its tax base.
F. That the central corridor bridge option results in
fewer environmental concerns as voiced by the Department of
the Interior and Sierra Club which have gone on record
preferring the central bridge corridor to the southern
corridor.
G. The central bridge corridor will result in less of
a visual impact to the City of Oak Park Heights residents and
not result in a significant cut in the bluff lands on the
Wisconsin side of the river.

' NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
i OF OAK PARR HEIGHTS that based upon the foregoing studies and
recommendations and findings of the City Council for the City of
Oak Park Heights, the following recommendations are made:
1. The City of Oak Park Heights requests the Minnesota
Department of Transportation to extend the time for its decision
and agree to work with governmental jurisdiction and environmental
groups and local communities in addressing concerns and reviewing
alternatives to the bridge corridor and the Trunk Highway 36
improvements. That the City of Oak Park Heights is of the opinion
that insufficient time has been dedicated by the Minnesota
Department of Transportation to examining the reality of a central
corridor option. The Council recognizes that even the central
corridor option does have significant impacts on the City of Oak
Park Heights, but as opposed to the southern corridor option,
provides the best alternative overall from the standpoint of
social, economic and environmental concerns addressing the City.
2. That the Council finds and concludes that the draft and
environmental impact statement as provided by the Minnesota
Department of Transportation was drafted with a definite slant
toward to the selection of the southern corridor. The Council
further finds that the central corridor option and the facts to
support its selection were never fully analyzed as part of the
draft environmental impact statement.
3. That the City of Oak Park Heights herewith goes on record
as opposing the "southern corridor" construction proposals as an
impact of reconstruction of Trunk Highway 36 and the construction
of a new interstate bridge across the St. Croix River.
4. That the City of Oak Park Heights herewith formally
disapproves of the plans that it has received from the Minnesota
Department of Transportation illustrating the southern corridor
construction project affecting the reconstruction of Trunk Highway
36 and the construction of an interstate bridge utilizing the
proposed "southern corridor ". That the City's disapproval of these
plans is made in conformance with Minn. Stat. §161.17, Subd. 2 and
requests referral of the plans to the Twin Cities Metropolitan Area
Planning Commission pursuant to the aforementioned statute.

WHEREAS, a Development Agreement has been prepared to be
reviewed and entered into between Independent School District
Number 834 and the City of Oak Park Heights; and,
WHEREAS, the input of all City staff has been received and
implemented within the text and terms and conditions of the
Development Agreement; and,
WHEREAS, the Development Agreement has been approved by the
School Board of the Independent School District Number 834; and,
WHEREAS, the City Council for the City of Oak Park Heights has
reviewed the terms and conditions of the Development Agreement and
find same to be in conformance with the agreements and discussions
entered into between the City of Oak Park Heights and Independent
School District Number 834 at public meetings duly called for that

Conditional Use Permit as drafted by the office of the City

WHEREAS, said Conditional Use Permit conforms the terms and
conditions of the Development Agreement executed between the City
of Oak Park Heights and Independent School District Number 834;
and,
WHEREAS, the Conditional Use Permit has been approved by City
Staff; and,
WHEREAS, the City Council has reviewed the terms and
conditions of the Conditional Use Permit and finds them to be in
conformance with the discussions and agreements between the City

ST. CROIX VALLEY HOCKEY ASSOCIATION FOR
CHARITABLE GAMBLING /PULL TAB OPERATION AT THE MILLROAD INN
WHEREAS, the City has received a request from Mr. Mitchell
T. McKenzie, representing the St. Croix Valley Hockey
Association, requesting approval of the City pursuant to statute
to operate a charitable gambling /pull tab operation at the
Millroad Inn located in the City of Oak Park Heights; and,
WHEREAS, all proceeds received from said pull tab operation
will be dedicated to a public /civic use in the manner and form
authorized under the statutes in such case made and provided for;
and,
WHEREAS, the St. Croix Valley Hockey Association provides a
valuable civic and athletic opportunity to the youth of the City
• of Oak Park Heights and surrounding area; and,
WHEREAS, it appears that the St. Croix Valley Hockey
Association, as a nonprofit entity, qualifies under the statute
allowing charitable gambling with all proceeds to be expended in
the manner provided for by law for such civic and charitable
uses.
NOW, THEREFORE, BE IT RESOLVED and recommended by the City
Council for the City of Oak Park Heights that the application of
Mr. Mitchell T. McKenzie on behalf of the St. Croix Valley Hockey
Association to operate a charitable gambling /pull tab operation

A RESOLUTION ESTABLISHING ELECTION PRECINCTS AND POLLING
PLACES FOR THE CITY OF OAK PARK HEIGHTS PURSUANT TO
MINNESOTA STATUTE 204B.01 ET SEQ
WHEREAS, the City Council for the City of Oak Park Heights
currently maintains a single primary polling center for election
purposes; and,
WHEREAS, the City of Oak Park Heights' election officials
have experienced considerable congestion at that polling place
given the City's current population and number of registered
voters; and,
WHEREAS, the City Clerk /Treasurer has recommended that the
City Council establish two polling centers and two precincts
within the City of Oak Park Heights for election purposes; and,
WHEREAS, Minnesota Statute 204B.14 directs that each city
shall constitute at least one election precinct; and,
• WHEREAS, Minnesota Statute 204B.16 allows the establishment
of one polling place for each election precinct; and,
WHEREAS, Minnesota Statute 204B.16 allows the City to
designate by resolution additional polling places to serve each
election precinct; and,
WHEREAS, it is the intent of the City of Oak Park Heights to
maintain an at large electoral method and yet allow its residents
the opportunity to vote at an election precinct without
unnecessary delay and congestion; and,
WHEREAS, the City Council for the City of Oak Park Heights
believes it to be in the best interests of the City and its
residents to establish two election precincts within the City of
Oak Park Heights and have a separate polling place for each
election district.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OAR PART( HEIGHTS:
1. That by adoption of this resolution and unless and until
subsequently amended, the following precinct boundaries and
Polling places are hereby established for the City of Oak Park
Heights election precincts:

• PRECINCT NO. IA:
Pollina Place: The polling place will be the Calvary
Assembly of God Church, 5805 Osgood Avenue North, Oak Park
Heights, Minnesota.
Precinct Boundary: All of that portion of the City of Oak
Park Heights contained within the municipal boundaries of
the City of Oak Park Heights lying east of the centerline of
Osgood /4th Street as that line is extended in a north and
southerly direction to its intersection with the boundaries

WHEREAS, the City Council for the City of Oak Park Heights has
received the 1992 Agreement with the City of Bayport providing for
fire protection within the City of Oak Park Heights by the Bayport
Fire Department; and,
WHEREAS, the annual cost of same is at $15,333.33; and,
WHEREAS, the same has been reviewed by the City Council and
determined to be a reasonable expenditure for the public safety and
welfare of the citizens of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights as follows:
1. That the 1992 Fire Protection Agreement with the City of
Bayport, Minnesota be and the same is hereby approved.

A RESOLUTION DIRECTING THE CITY CLERK TO
DIRECT ALL UTILITY BILLINGS FOR MUNICIPAL SERVICES
TO THE PROPERTY OWNERS AS OPPOSED TO PROPERTY OCCUPANT
WHEREAS, pursuant to the ordinances of the City of Oak Park
Heights and the statutes in such case made and provided, all
municipal utility services are a service which is provided to the
property by the City of Oak Park Heights for which it becomes a
basis for a lien against the real estate in the event such
utility services are unpaid; and,
• WHEREAS, the City of Oak Park Heights reserves its right
pursuant to its ordinances to cease providing all utility
services to any residential or commercial property that does not
pay for municipal utility services provided it; and,
WHEREAS, any billing done at the request of a property owner
to an occupant as opposed to the owner is merely done as a
convenience to the property owner, but does not absolve the
property owner from the responsibility or liability for the
underlying payment; and,
WHEREAS, the bill for utility services rendered to a
property is appropriately to be addressed to the owner of the
property as opposed to its occupant.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the
City of Oak Park Heights that the City Clerk shall direct all
future billings for municipal services provided to residential
and commercial properties to the owner of the property as opposed
to the occupant.
BE IF FURTHER RESOLVED that a billing may be made in the
discretion of the City Clerk to the property occupant if the City
Clerk has on file a written direction from the property owner to
provide such billings directly to the property occupant provided
• further, however, that the written direction must acknowledge the
responsibility of the owner for the underlying bill in the event
of nonpayment.

DEVELOPMENT AGREEMENT WITH WAL -MART STORES, INC.
WHEREAS, the City Council for the City of Oak Park Heights has
received a draft of the Development Agreement proposed to be
executed between Wal -Mart Stores, Inc. and the City of Oak Park
Heights providing for the development of their property within the
City of Oak Park Heights; and,
WHEREAS, the City attorney has recommended submission of final
draft to Wal -Mart Stores, Inc. for its execution and return to the
City of Oak Park Heights; and,
WHEREAS, the Agreement calls for certain deferred assessments
on the outlots of the plat of Wal -Mart Addition; and,
WHEREAS, the Council has reviewed the Development Agreement
and finds the same to be in conformance with their discussions and
agreement with Wal -Mart Stores, Inc. affecting the development of
• a retail center within the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights as follows:
1. That the form and content of the Development Agreement
with Wal -Mart Stores, Inc. be and the same is hereby approved.
2. The City Attorney is herewith directed to submit a final
draft to Wal -Mart Stores, Inc. for its execution and return to the
City.
3. That the provisions calling for deferred assessments on
certain Outlots within the provisions of the Development Agreement
are herewith approved.

PROJECT ON CONSTRUCTION OF UTILITIES
WHEREAS, the City of Oak Park Heights has entered into a
Development Contract with Independent School District No. 834 as
it affects the development of and construction of a Senior High
School facility within the City of Oak Park Heights; and,
WHEREAS, Independent School District No. 834 requires the
installation of city utilities to serve the project; and,
WHEREAS, it is necessary to provide the necessary bids and
specifications for those utilities to be completed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights as follows:
1. The City Engineer is herewith authorized and directed to
prepare bids and specifications for providing utilities as
requested by Independent School District No. 834.
2. That upon preparation of the necessary bids and
specifications, the Engineer shall return and provide a report to
the City Council affecting same.
3. That the cost of preparing bids and specifications shall
be charged to the School District pursuant to the terms of the
Development Contract.

Deputy Clerk recommending certain budget transfers be made as

$3,700.00 from the Mayor and Council category;
$1,400.00 from the Animal Control and other
contractual services category; and,
$5,900.00 from Public Works and Snow Removal,
all to be forwarded to and transferred into the contingency fund
for the O'Brien Avenue Storm Sewer Project as of December 31, 1991;
and
WHEREAS, said budget transfers have been reviewed and approved
by the City Auditor; and
WHEREAS, the Council finds that the budget transfers are in
accordance with the overall budget plans of the City of Oak Park
Heights as adopted.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Oak Park Heights that budget transfers are approved as follows:
