Dear Mr. Schulz:
As the City Planners for Oak Park Heights, we have made a preliminary review of the
materials submitted by Port of Sunnyside Marina for a bath/shower house. The subject
property is currently zoned R-3, Multiple Family Residential. Public and private marinas
are allowed as a conditional use within this district.
A partial site survey submitted in 1994 for a variance application, as well as a site
inspection, indicates that there are currently four buildings on the site. The Zoning
Ordinance limits property to one principal structure and one accessory structure per lot,
except by planned unit development. As such,the site currently exists as a legal non-
conformity. The site inspection also identified zoning issues related to trash storage and
portable toilets. Our files also indicate that Port of Sunnyside received a special use
permit to allow installation of a 10,000 gallon underground gasoline storage tank.
Due to the multiple structures on the site and other site issues,we recommend that the
Port of Sunnyside apply for a conditional use permit/planned unit development and site
plan review to pursue approval of the proposed bathhouse.
An application will need to be submitted in accordance with Section 401.06.0 of the Oak
Park Heights Zoning Ordinance. The specific informational requirements to be submitted
with an application are outlined in Section 401.06.C.3 of the Zoning Ordinance. A site
survey is required as part of the information submission. The site survey is necessary in
order to allow City staff an opportunity to evaluate the proposed development in a
comprehensive manner and ensure compliance with all applicable Ordinance provisions.
We have attached Section 401.06 of the Zoning Ordinance for your reference.

A partial site survey was submitted as part of the 1994 variance request. A footnote on the
partial site plan notes that the information was derived from an as-built survey completed
by Milner W. Carley and Associates Inc.dated 19 July 1995.
