PAUL,MINNESOTA • 55155-40 • DNR INFORMATION (612)296-4157 October 6,1994 City of Oak Park Heights The Honorable Barbara O'Neal P.O.Box 2700 Oak Park Heights,MN 55082-2700 Dear Mayor O'Neal: RE: Port of Sunnyside Club,Inc.,Variance Request,St.Croix River The Department of Natural Resources has reviewed the information submitted relative to the variance request for the Port of Sunnyside Club,Inc.structure modifications. Minutes and a Resolution of Approval from the August 22 hearing were received on September 6, 1994. The Club is seeking a variance for the extension and enlargement of an existing substandard structure that will not meet the setback standards of the St.Croix Rules. The Club is proposing to construct a 600 square foot, 2-story expansion containing a toilets/showers facility, meeting room,office,and decks. Department staff have inspected the site and provided testimony at the hearing. After consideration of the issues and the Resolution of the City Council,the Commissioner of Natural Resources hereby certifies the variance with conditions as complying with the intent of the National Wild&Scenic Rivers Act,the federal and state Lower St.Croix River Acts, and the Master Plan adopted thereunder, and Minnesota Rules, parts 6105.0351 to 6105.0550. The following conditions shall apply: 1. No portion of the structure, including decks,shall encroach closer than 50 feet to any point of the ordinary high water level of the St. Croix River, nor shall the structural additions increase the extent to which the existing structure violates the setback standard currently. 2. Since no plans to scale or plat of survey,as required by MN Rules,part 6105.0530, subp.2,were received by this office,plans which show the proposal complying with the above variance condition shall be submitted to mc for approval prior to any action on this variance. The plans shall include the location of existing and proposed structures,including setback dimensions from the St.Croix,to scale; the location of the ordinary high water level; height dimensions; and the length and width dimensions of the existing and proposed structure components to scale for each story. 3. Additional landscaping will he provided in accordance with the plan received September 27,1994. • 4. The exterior color of the new and renovated portions of the structure shall he earth tone in color. The addition must be floodproo(ed in accordance with the City's Floodplain Ordinance and the State Building Code. 6. All portable toilets shall he removed from the property.
