AU3-23-1999 15:05 NAC 612 595 9837 P.04/06 Stillwater Area High School Conditional Use Permit Consideration for Parking Lot Reconfiguration/Addition The Planning Commission, at their August 19, 1999 meeting, recommended approval of the parking lot reconfiguration to allow for 30 additional stalls on the existing paved surface with the following conditions: 1. The curbed island near the west entrance must extend the length of the parking stalls at the north and south ends of the island. 2. Two van accessible parking stalls should be provided with the new parking at a location to be approved by City staff. 3. Staff and visitor parking areas must be properly signed. 4. The additional 67 stalls and changes to the median areas to be created by the addition of paved surface shall be allowed only upon approval by the Valley Branch Watershed District and the City Engineer. 5. The School District establish and enforce a plan for administrative measures to reduce the parking demand at the high school. Reconfiguring the parking lot by adding pavement area and changing curbing would create 67 parking stalls. Another 30 stalls would be created by restriping the bus loading area. • When the site plan was approved in 1991 our office recommended a parking ratio of one student per two parking spaces. A projected enrollment of 2,000 students yielded a requirement of 1,000 stalls. The City Council agreed to allow the school to install at least 800 stalls and add the additional 200 stalls at a time deemed necessary by the School District and the City. Existing at the school currently are 809 parking stalls. With the 97 proposed additional stalls, 906 parking stalls will exist on the site. Attached for reference: Exhibit A: Site Plan Exhibit B: Memo from School Staff ANALYSIS Parking Demand. The school has stated in a letter attached as Exhibit B that enrollment increases have created a need for additional parking. In addition to providing additional parking, the school plans to lessen demand for parking by limiting the number of daily passes available and by requiring students that attend classes for part of the day at Intermediate District 916 to use school-provided transportation. The striping for the bus parking stalls on the east side of the building is • proposed to be shortened to allow parallel parking across from the bus parking. The bus stalls are proposed to be reduced from 55 feet to 40 feet in length from the curb to the drive aisle. This length should continue to provide sufficient maneuvering space. The curbed island on the west side of the building is proposed to be reduced to allow nine additional stalls. The design should be revised so that the curbed island extends the length of the parking stalls at the north and south ends of the island. This revised design will eliminate the need for diagonal striping at both ends of the curbed island and will better control traffic circulation. Disability Accessible Parking. Sixteen disability accessible parking stalls currently exist on the site. With the addition of 97 stalls, a total of 18 disability accessible parking stalls will be required, and two of those stalls must be van accessible. Van accessible stalls must have an adjacent eight foot wide access aisle. The van accessible stalls should be provided with the new parking at the west entrance of the building. The access aisle should be centered at the middle of the island. Curb ramps and sidewalk should be provided as necessary to create an accessible route to the west entrance. Signage. The school is proposing that the parking areas created on the north, east, and south sides of the building are for staff parking only. This will limit the amount of traffic around the school and minimize the amount of conflict with bus circulation. The parking created near the west entrance of the building is proposed to be for visitors only. Staff and • visitor parking areas must be properly signed. Landscaping. No additional landscaping is proposed and existing landscaping is minimally affected. A couple of juniper shrubs will be removed from the landscaped island at the west entrance. Lighting. Lighting will be minimally affected. One light standard will be relocated behind the new curb north of the school. Other lighting will remain as it is. RECOMMENDATION Based upon the preceding review, our office recommends approval of a CUP to allow additional parking at Stillwater Area High School subject to the following conditions: 1. This memo offers information to help you understand those needs and the steps we are taking to resolve some of the parking concerns on the Stillwater Area High School Campus. The proposed plan would bring us to a total of 887 parking spaces. Current Capacity.We presently have 809 designated parking spaces on our campus to accommodate • staff,students, and visitors. Current Population: We have a student population of approximately 2200 students and over 165 staff (including teachers, administrators, counselors, custodians, cooks, paraprofessionals and secretaries) who service these students. Needs:We need additional parking for staff and visitors. Creating additional parking for these groups will free up spaces that can be made available for students who drive to school. Allowing staff to park along the perimeter of the building would make available nearly 70 additional parking spaces in the -Student/Staff Lot" for student parking. An additional eight (8) visitor parking spaces should help eliminate short term parking in the fire lane in front of the Administration entrance to the school. These changes require a modification of our current CUP. Administrative Changes Several administrative changes should help reduce the number of students driving to school. (1) The number of daily parking passes will now be limited to 25. In the past anywhere from 50 to 100 passes were being issued on a daily basis. (2) Students who attend classes for part of the day at intermediate District 916 will be required to use school-provided transportation. This should reduce the number of students who want to drive to school so as to transport themselves and others to 916. They will not have that option. Lone-term Plans: At this lime,there are no plans for adding a significant area to our present parking lot. District budget priorities require funds be allocated for more urgent needs Next summer,the lot will be resealed and new lines painted. We will look to make the best use of existing space when relining the los We will continue to encourage students to car pool;we will continue work with our student parking lot committee to develop policies and procedures that are fair and reasonable in governing our parking lot;and we will cooperate with Oak Park Heights Police in maintaining a safe parking and driving area around our school. Because taxpayers, via Independent School District 834, • provide free transportation to and from Stillwater Area High School and Intermediate School District 916, driving to school is a privilege, not a right. Students who desire to take advantage of the privilege must abide by all State of Minnesota, City of Oak Park Heights, and Stillwater Area High School regulations. GENERAL INFORMATION Availability: The number of requests for parking permits exceeds the space available; therefore, we cannot guarantee a parking permit for every student who requests one. If a student has purchased a permit to park on campus, we guarantee space will be available. Seniors will have first priority in purchasing permits, then juniors. If there are any annual permits available after juniors and seniors have had an opportunity to purchase their permits, sales will be open to sophomores. (Availability to sophomores is new this year and based on the recommendation of the Student Parking Lot Committee.) Daily Permits: A daily permit is available to students who do not drive to school on a regular basis, but may need to drive to school.on a specific day because of an appointment, etc. These permits must be purchased in advance in the Junior Center for a fee of$1.00. Only 25 permits will be available for daily parking, and students must park in the area designated for daily parking. Cost,: Students may purchase an annual permit for $100.00. This will assure students have a parking spot for the 1999-2000 school year. When permits sell out, a waiting list will be formed and students may purchase permits, as space becomes available during the school year. • Purchase Dates: August 19, 1999 from 7:30 a.m. to 3:30 p.m. - SENIORS ONLY (Please have August 20, 1999 from 7: 30 a.m. to 3: 30 p.m.-Juniors and Seniors Picture ID) August 23, 1999 from 7: 30 a.m. to 3: 30 p.m. - Open to all students Refunds: Students who purchase an annual permit, but discontinue driving to school during the year, may receive a refund by removing their annual permit and turning it in to the Junior Center. A refund will be issued according to the following schedule: • Students turning in their permit any time during first quarter will receive a refund of$75.00. • Students turning in their permit any time during second quarter will receive a refund of$50.00. • Students turning in their permit any time during the third quarter will receive a refund of$25.00. • No refund will be issued for permits returned during fourth quarter. Non-transferable: Permits may not be transferred from one student to another nor may a student sell his/her permit to another student. Replacement: Lost or stolen permits may be replaced according to the schedule below: • Replacement cost during the first quarter - full price of$100.00. • Replacement cost during the second quarter -$75.00. • Replacement cost during the third quarter - $50.00. • Replacement cost during the fourth quarter - $25.00. Car Pools: Special permits for car pools will be issued from Ms. Kruse in the Junior Center. Students II/ requesting a car pool permit must have the makes and license numbers of each car used in the car pool. One permit per car pool will be issued and may be used only for those cars listed on the car pool application. Students who begin the year in a car pool. but decide not to continue in the car pool, would.have to purchase a separate permit if spaces were available. KA'17,1.I N MACY,SUPII.RIN I NDINT AND MIKE IIRA13ENDI11,D1ItI;C1'C)R OF OPERATIONS Please be aware that the high school is in violation of the original Conditional Use Permit (CUP) issued by the City of Oak Park Heights at the time of the construction of the new high school. These violations relate to,parking lot configuration and compliance issues. ;he administration has been working to correct these violations since last spring. Issue: Over the years, the high school has painted over yellow lines, taken down "no parking" signs, striped areas for parking that were originally designated "no parking," and reconfigured fire lanes. Although "permission" for some of these changes was granted,any change had to go through a process requiring a modification of our CUP with the City of Oak Park Heights. That was not done. Consequently, the City of Oak Park Ileights has ordered District 834 to correct all noncompliance issues or be prepared for the City Council to impose civil sanctions. Effect on Staff Parking: Returning to the configuration of the Conditional Use Permit means the following areas return to "No Parking": the curb along the ELC, the striped areas along the north side of the building by the Oindustrial technology wing, and the striped areas along the south side of the building by the practice fields and loading ock. (In addition, the "10 Minute Parking" zone in the circle area in front of the school must be removed; it is part of the fire lane.) Parking Availability: "No Parking" in the above areas means eliminating approximately 80 parking spaces that have been used by staff for at least the last two years. There are 117 spaces designated in the"Staff Only"lot by the tennis courts. There are 208 spaces marked in the "Student/Staff Lot." These two areas are available for staff to park as we begin the 1999-2000 school year. Please note: All vehicles parked on campus must have a parking permit. These are available to staff, free of charge. If you are a new staff member or if you :rave a different vehicle from last year, please see Vicki in the Junior Center and she will give you the form and issue you a staff permit. These permits are for STAFF USE ONLY. If you are a staff member whose son or daughter attends SAHS and who will be driving a separate vehicle to school, that student must purchase an annual permit and park in the student lot. What's Being Done: First, the school district is taking immediate action to assure the parking lot is in compliance with the CUP before school begins. Second, the administration is working with Central Services and the City of Oak Park Heights to modify the CUP. Our goal is to make the chinges necessary in restoring the parking spaces lost when the conditions of the original CUP had to be reinstated. This process has been on-going since last spring and involves approval and cooperation of the City Council of Oak Park Heights, the Planing Commission,and the School Board of District 834. If approval of the engineer's plans occurs at all levels, work will begin as soon as possible to accommodate parking in the areas identified above. The Baytown Board of Supervisors believe that the expansion of the parking area would cause more flooding problems for residences to the North of 53rd. Consideration should be given to the containment of aft surface run off, by possibly creating a ponding area or other method to ensure surface run off would be collected on Stillwater High-School- property. The history of Stillwater High School students utilizing our residential neighborhood as overflow student parking, creates a safety issue as well as a public nuisance to the residents affected. Past occurrences have included blocked driveways, blocked mail boxes prohibiting mail delivery and disrespectfulness from students. Increased traffic also adds to an already tenuous blind entrance issue, a continuing safety problem. This memo offers information to help you understand those needs and the steps we are taking to resolve some of the parking concerns on the Sthtwater Area High School Campus. The proposed plan would bring us to a total of 887 parking spaces. Current Capacity We presently have 809 designated parking spaces on our campus to accommodate staff,students, and visitors. • Current PQoulation: We have a student population of approximately 2200 students and over 165 staff (including teachers, administrators, counselors, custodians, cooks, paraprofessionals and secretaries) who service these students. Needs:We need additional parking for staff and visitors. Creating additional parking for these groups will free up spaces that can be made available for students who drive to school. Allowing staff to park along the perimeter of the building would make available nearly 70 additional parking spaces in the "Student/Staff Lot" for student parking. An additional eight (8) visitor parking spaces should help eliminate short term parking in the fire lane in front of the Administration entrance to the school. These changes require a modification of our current CUP. Administrative Changes Several administrative changes should help reduce the number of students driving to school. (1) The number of daily parking passes will now be limited to 25. In the past anywhere from 50 to 100 passes were being issued on a daily basis. (2) Students who attend classes for part of the day at Intermediate District 916 will be required to use school-provided transportation. This should reduce the number of students who want to drive to school so as to transport themselves and others to 916. They will not have that option. Lone-term Plans: At this time, there are no plans for adding a significant area to our present parking lot. District budget priorities require funds be allocated for more urgent needs. Next summer,the lot will be resealed and new lines painted. We will look to make the best use of existing space when relining the lot We will continue to encourage students to car pool;we will continue work with our student parking lot committee to develop policies and procedures that arc fair and reasonable in governing our parking lot;and we will cooperate with Oak Park Heights Police in maintaining a safe parking and driving area around our school. • CHUCK BRISCOE. Because taxpayers, via Independent School District 834, • provide free transportation to and from Stillwater Area High School and Intermediate School District 916, driving to school is a privilege, not a right. Students who desire to take advantage of the privilege must abide by all State of Minnesota, City of Oak Park Heights, and Stillwater Area High School regulations. GENERAL INFORMATION Availability: The number of requests for parking permits exceeds the space available; therefore, we cannot guarantee a parking permit for every student who requests one. If a student has purchased a permit to park on campus, we guarantee space will be available. Seniors will have first priority in purchasing permits, then juniors. If there are any annual permits available after juniors and seniors have had an opportunity to purchase their permits, sales will be open to sophomores. (Availability to sophomores is new this year and based on the recommendation of the Student Parking Lot Committee.) Daily Permits: A daily permit is available to students who do not drive to school on a regular basis, but may need to drive to school,on a specific day because of an appointment, etc. These permits must be purchased in advance in the Junior Center for a fee of$1.00. Only 25 permits will be available for daily parking, and students must park in the area designated for daily parking. Cost: Students may purchase an annual permit for$100.00. This will assure students have a parking spot for the 1999-2000 school year. When permits sell out, a waiting list will be formed and students may purchase permits, as space becomes available during the school year. • Purchase Dates: August 19, 1999 from 7:30 a.m. to 3:30 p.m. -SENIORS ONLY (Please have August 20, 1999 from 7: 30 a.m. to 3: 30 p.m.- Juniors and Seniors Picture ID) August 23, 1999 from 7: 30 a.m. to 3: 30 p.m. - Open to all students Refunds: Students who purchase an annual permit, but discontinue driving to school during the year, may receive a refund by removing their annual permit and turning it in to the Junior Center. A refund will be issued according to the following schedule: • Students turning in their permit any time during first quarter will receive a refund of$75.00. • Students turning in their permit any time during second quarter will receive a refund of$50.00. • Students turning in their permit any time during the third quarter will receive a refund of$25.00. • No refund will be issued for permits returned during fourth quarter. Non-transferable: Permits may not be transferred from one student to another nor may a student sell his/her permit to another student. These violations relate to parking lot configuration and compliance issues. ',Ile administration has been working to correct these violations since last spring. Issue: Over the years, the high school has painted over yellow lines, taken down "no parking" signs, striped areas for parking that were originally designated "no parking,"and reconfigured fire lanes. Although "permission" for some of these changes was granted,any change had to go through a process requiring a modification of our CUP with the City of Oak Park Heights. That was not done. Consequently, the City of Oak Park Ileights has ordered District 834 to correct all noncompliance issues or be prepared for the City Council to impose civil sanctions. Effect on Staff Parking. Returning to the configuration of the Conditional Use Permit means the following areas return to "No Parking": the curb along the ELC, the striped areas along the north side of the building by the lindustrial technology wing, and the striped areas along the south side of the building by the practice fields and loading ock. (In addition, the "10 Minute Parking" zone in the circle area in front of the school must be removed;it is part of the fire lane.) Parking Availability: "No Parking" in the above areas means eliminating approximately 80 parking spaces that have been used by staff for at least the last two years. There are 117 spaces designated in the"Staff Only"lot by the tennis courts. There are 208 spaces marked in the"Student/Staff Lot." These two areas are available for staff to park as we begin the 1999-2000 school year. Please note: All vehicles parked on campus must have a parking permit. These are available to staff, free of charge. If you are a new staff member or if you 'lave a different vehicle from last year, please see Vicki in the Junior Center and she will give you the form and issue you a staff permit. These permits are for STAFF USE ONLY. If you are a staff member whose son or daughter atttnds SAHS and who will be driving a separate vehicle to school, that student must purchase an annual permit and park in the student lot. What's Being Done; First, the school district is taking immediate action to assure the parking lot is in compliance with the CUP before school begins. Second, the administration is working with Central Services and the City of Oak Park Heights to modify the CUP. Our goal is to make the chinges necessary in restoring the parking spaces lost when the conditions of the original CUP had to be reinstated. This process has been on-going since last spring and involves approval and cooperation of the City Council of Oak Park Heights, the Planing Commission, and the School Board of District 834. If approval of the engineer's plans occurs at all levels, work will begin as soon as possible to accomodate parking in the areas identified above. This memo offers information to help you understand those needs and the steps we are taking to resolve some of the parking concerns on the Stillwater Area High School Campus. The proposed plan would bring us to a total of 887 parking spaces. Current Capacity We presently have 809 designated parking spaces on our campus to accommodate 40 staff,students, and visitors. Current Population: We have a student population of approximately 2200 students and over 165 staff (inducing teachers, administrators, counselors, custodians, cooks, paraprofessionals and secretaries) who service these students. Needs:We need additional parking for staff and visitors. Creating additional parking for these groups will free up spaces that can be made available for students who drive to school. Allowing staff to park along the perimeter of the building would make available nearly 70 additional parking spaces in the °Student/Staff Lot" for student parking. An additional eight (8) visitor parking spaces should help eliminate short term parking in the fire lane in front of the Administration entrance to the school. These changes require a modification of our current CUP. Administrative Changes Several administrative changes should help reduce the number of students • driving to school. (1) The number of daily parking passes will now be limited to 25. In the past anywhere from 50 to 100 passes were being issued on a daily basis. (2) Students who attend lasses for part of the day at Intermediate District 916 will be required to use school-provided transportation. This should reduce the number of students who want to drive to school so as to transport themselves and others to 916. They will not have that option. Long-term Plans: At this time,there are no plans for adding a significant area to our present parking lot. District budget priorities require funds be allocated for more urgent needs- Next summa,the lot will be resealed and new lines painted. We will look to make the best use of existing space when relining the lot. Because taxpayers, via Independent School District 834, provide free transportation to and from Stillwater Area High School and Intermediate School District 916, driving to school is a privilege, not a right. Students who desire to take advantage of the privilege must abide by all State of Minnesota, City of Oak Park Heights, and Stillwater Area High School regulations. GENERAL INFORMATION Availability: The number of requests for parking permits exceeds the space available; therefore, we cannot guarantee a parking permit for every student who requests one. If a student has purchased a permit to park on campus, we guarantee space will be available. Seniors will have first priority in purchasing permits, then juniors. If there are any annual permits available after juniors and seniors have had an opportunity to purchase their permits, sales will be open to sophomores. (Availability to sophomores is new this year and based on the recommendation of the Student Parking Lot Committee.) Daily Permits: A daily permit is available to students who do not drive to school on a regular basis, but may need to drive to school on a specific day because of an appointment, etc. These permits must be purchased in advance in the Junior Center for a fee of$1.00. Only 25 permits will be available for daily parking, and students must park in the area designated for daily parking. Cost: Students may purchase an annual permit for$100.00. This will assure students have a parking spot for the 1999-2000 school year. When permits sell out, a waiting list will be formed and students may purchase permits, as space becomes available during the school year. 410 Purchase Dates: August 19, 1999 from 7:30 a.m. to 3:30 p.m. - SENIORS ONLY (Please have August 20, 1999 from 7: 30 a.m. to 3: 30 p.m.-Juniors and Seniors Picture ID) August 23, 1999 from 7: 30 a.m. to 3: 30 p.m. - Open to all students Refunds: Students who purchase an annual permit, but discontinue driving to school during the year, may receive a refund by removing their annual permit and turning it in to the Junior Center. A refund will be issued according to the following schedule: • Students turning in their permit any time during first quarter will receive a refund of$75.00. • Students turning in their permit any time during second quarter will receive a refund of$50.00. • Students turning in their permit any time during the third quarter will receive a refund of$25.00. • No refund will be issued for permits returned during fourth quarter. Non-transferable: Permits may not be transferred from one student to another nor may a student sell his/her permit to another student. Replacement: Lost or stolen permits may be replaced according to the schedule below: • Replacement cost during the first quarter - full price of$100.00. • Replacement cost during the second quarter -$75.00. • Replacement cost during the third quarter - $50.00. • Replacement cost during the fourth quarter - $25.00. Car Pools: Special permits for car pools will be issued from Ms. Kruse in the Junior Center. Students • requesting a car pool permit must have the makes and license numbers of each car used in the car pool. One permit per car pool will be issued and may be used only for those cars listed on the car pool application. Students who begin the year in a car pool, but decide not to continue in the car pool, would.have to purchase a separate permit if spaces were available. KATLEIN MACY,SUPI?RIN ENDINT ANI)MIKE BRABI:NDFR,DIRECTOR OF OPERATIONS Please be aware that the high school is in violation of the original Conditional Use Permit (CUP)issued by the City of Oak Park Heights at the time of the construction of the new high school. These violations relate to parking lot configuration and compliance issues. ',Ile administration has been working to correct these violations since last spring. Issue: Over the years, the high school has painted over yellow lines, taken down "no parking" signs, striped areas for parking that were originally designated"no parking,"and reconfigured fire lanes. Although "permission" for some of these changes was granted,any change had to go through a process requiring a modification of our CUP with the City of Oak Park Heights. That was not done. Consequently, the City of Oak Park Heights has ordered District 834 to correct all noncompliance issues or be prepared for the City Council to impose civil sanctions. Effect on Staff Parking: Returning to the configuration of the Conditional Use Permit means the following areas return to "No Parking": the curb along the ELC, the striped areas along the north side of the building by the feindustrial technology wing,and the striped areas along the south side of the building by the practice fields and loading dock. (In addition, the "10 Minute Parking" zone in the circle area in front of the school must be removed;it is part of the fire lane.) Parking Availability: "No Parking" in the above areas means eliminating approximately 80 parking spaces that have been used by staff for at least the last two years. There are 117 spaces designated in the"Staff Only" lot by the tennis courts. There are 208 spaces marked in the"Student/Staff Lot." These two areas are available for staff to park as we begin the 1999-2000 school year. Please note: All vehicles parked on campus must have a parking permit. These are available to staff, free of charge. If you are a new staff member or if you Nave a different vehicle from last year, please see Vicki in the Junior Center and she will give you the form and issue you a staff permit. These permits are for STAFF USE ONLY. If you are a staff member whose son or daughter attends SAHS and who will be driving a separate vehicle to school, that student must purchase an annual permit and park in the student lot. What's Being Done: First, the school district is taking immediate action to assure the parking lot is in compliance with the CUP before school begins. Second, the administration is working with Central Services and the City of Oak Park Heights to modify the CUP. Our goal is to make the ch.•rnges necessary in restoring the parking spaces lost when the conditions of the original CUP had to be reinstated. This process has been on-going since last spring and involves approval and cooperation of the City Council of Oak Park Heights, the Planing Commission,and the School Board of • District 834. If approval of the engineer's plans occurs at all levels, work will begin as soon as possible to accommodate parking in the areas identified above. I do this inasmuch as it has been several years since the high school was completed and since there appears to be, from time to time, a number of different proposals with regard to utilization of the lands of the high school site, I thought it might be beneficial for those councilpersons that were not present at the time that the City negotiated the development agreement with the high school to be aware of this provision, which would require the high school to pay all development fees, charges and otherwise comply with the City Ordinances as it affects any further development on the high school site . For the purposes of the City' s collection of its connection fees now assessed for the annexation area as extended, those fees 411 MAYOR AND COUNCIL Page Two January 19, 1996 were calculated only as to the high school site that was actually developed by the high school at the time of construction. Special pedestrian traffic control devices shall be inclusive of but not necessary limited to school crossing flashing warning devices, lighted walkways, special signage, etc. E. The provisions of this Section affecting police and fire protection services may be annually reviewed by the City Council on request of the Developer. VI. VARIANCE AS TO HEIGHT RESTRICTION. The Developer shall have received from the City of Oak Park Heights its variance as to the height of the principal structure to be constructed upon the property prior to the execution of this Agreement. VII. VARIANCE AS TO SIGNAGE. The Developer shall have received from the City of Oak Park Heights its variance as to signage for the development to be constructed upon the property prior to the execution of this Agreement. VIII.FUTURE SITE IMPROVEMENTS AND CONSTRUCTION. The terms and conditions of this Development Agreement apply only to those structures as are proposed to be built and identified within the annexed exhibits. Any future construction of additional buildings, appurtenances, facilities, or structures of any nature shall require a separate building permit and amended Conditional Use Permit from the City of Oak Park Heights and shall not be served by utility services from the City of Oak Park Heights unless utility fees and connection charges are specifically calculated and collected as part of any application for a permit process. Certain areas set forth upon the subject property on which the high school will be built have been deleted for computation purposes from the existing computations for utility charges and connection charges and any use of those areas by way of construction of buildings, structures or appurtenances thereto shall require payment of all appropriate connection and area charges as are then set forth by the ordinances of the City of Oak Park Heights. IX. MNDOT/HIGHWAY 5 IMPROVEMENTS. All improvements to be constructed adjacent to Developer's property along Trunk Highway 5 consisting of Highway 5 bypass construction costs and other related expenses, are not provided for nor intend to be provided for within this Agreement, but shall be separately negotiated between Independent School District 834 and Minnesota Department of Transportation and to the extent necessary, the City of Oak Park Heights at the time that such construction is proposed by the Minnesota Department of Transportation of such improvements. IN WITNESS WHEREOF, the City and Developer have caused this Agreement to be duly executed on the day and year first above written. 13
