The City has sent out an enforcement letter to Wal-Mart to correct a lighting issue and a
curbing issue. See letter to Curt Olson of Weis Builders. Similarly, Wal-Mart has applied to
the City to construct fencing around their ponding that lies on the west side of the
development. Their application was deemed incomplete as it lacked certain items such as a
survey and a legible signature.
WATE Enterprises (Will Zintl) will need to address some BCWD concerns before the City
may issue a building permit. Enclosed is the BCWD review letter asking for additional
information. It appears that they a concern with the percentage of impervious surface and
amounts and the drainage that may not enter the Kern Center Pond.
Councilmember McComber provided to my attention a notice from MNDOT that they will be
hosting an OPEN HOUSE on the Visual Quality Manual that is now apparently completed.
That OPEN HOUSE will be on 1/18/07 from 4 to 7 pm at the Washington County Gov.
Center. Also please see enclosed article from the RiverTown News.
On Thursday, Councilmember McComber brought to our attention a press release from the
American Road and Transportation Builders Association that discusses the possibility of a
reduction of funds from the 2005 SAFETEA-LU (Transportation bill) as a result of the 2006
Congress failing to pass an appropriations bill and that the new Congress may not fully
fund the SAFETEA-LU. Per her request, 1 have prepared a letter to our representatives
asking that they full fund such bill, and which will hopefully fully fund our allocations —
please see enclosed to Coleman, Klobuchar and Bachmann.
1 had contacted Cheryl Martin to determine if the Federal Highway Admn. did actually
publish the Record of Decision in the Federal Register. On Dec 5 2006 a legal notice was
place in the Register that met their notice requirements. For you files 1 have enclosed such
notice for you. Generally, should the City have a disagreement with the many documents
related to the Federal review of the proposal, such as the EIS or its findings, we would have
until June 6 , 2007 to file our complaints.
The City is in receipt of a short article from Kath Cinnamon of the Cable Commission that
discusses the current situation with the Cable Franchising action taken by the FCC as it
relates to earlier action on other FCC rulings. It is an interesting background and a
definitive shift of power to the Federal Gov.
