A RESOLUTION DESIGNATING THE COURIER AS THE OFFICIAL
NEWSPAPER FOR THE CITY OF OAK PARK HEIGHTS FOR
CALENDAR YEAR 1991
WHEREAS, Minnesota Statute requires that cities
designate the official publication for the City annually; and,
WHEREAS, the City has been approached by "The Courier"
requesting to be designated as the official newspaper for the
City of Oak Park Heights within calendar year 1991; and,
WHEREAS, the City Council has conducted a comparison of
the various publishing rates, effective coverage, readership of
the respective newspapers within the community and other factors
to determine which publication would best serve the interests of
the residents of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
for the City of Oak Park Heights, that "The Courier" is herewith
designated to be the official newspaper for the City of Oak Park
Heights for calendar year 1991 and shall be the source of all
publications that are required by statute to be officially
published by the City of Oak Park Heights within calendar year
1991.

WHEREAS, the Washington County Court Administrator, in
the interest of providing standardized fines
throughout Washington County, has requested
that all townships and municipalities in
Washington County adopt a uniform fine schedule
as to parking violations. This fine schedule
excludes handicapped parking violations, and
other fines set by statute.
NOW THEREFORE, IT IS HEREBY RESOLVED THAT the following

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING THE 1991 BUDGET
WHEREAS, the City staff has prepared and submitted to
the City Council the proposed budget for calendar year 1991; and,
WHYS, public notice has been duly given as provided
by law with public hearings being conducted by the City Council
from the public to the proposed budget, receiving no adverse comment
public with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park
Heights has determined that the proposed budget as submitted by
the City staff is in the best interests of the citizens of the
City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights as follows:
• I. That the 1991 budget is hereby approved as presented
by the City Auditor in the total General Fund amount of
$1,518,735.
2. That the City Clerk is hereby authorized and
directed to certify to the Washington County Auditor - Treasurer
the General Fund levy for the City of Oak Park Heights for
calendar year 1991 in the amount of $1,107,962.
3. That the scheduled payments on the 1982 General
Obligation Bonds in the amount of $16,000 and the scheduled
payments on the 1987 General Obligation Bonds in the amount of
$48,000 are hereby also approved for collection in calendar year
1991 and are to be certified to the County Auditor - Treasurer for
collection purposes by the City Clerk.
4. That the City Clerk is also authorized and directed
to certify to the County Auditor - Treasurer for collection the sum
Of $27,592 for improvements to Storm Sewer Improvement Tax
District No. 1, the same to be collectable in calendar year 1991
with the real estate taxes on the affected properties.

A RESOLUTION ACKNOWLEDGING AGREELIENT WITH THE
CITIES OF STILLWATER AND BAYPORT IN THE HIRING OF
BRIGGS & MORGAN TO REPRESENT THE REPRESENTATIVES OF THE
CITIES OF STILLWATER, BAYPORT AND OAK PARK HEIGHTS AS IT AFFECTS

COMMUNICATIONS ACTION
alle WHEREAS, an action has been commenced by Anne T. Davis
ging a cause of action against certain defendants who are
members of the Central St. Croix Valley Joint Cable
Communications Commission; and,
WHEREAS, the cities of Bayport, Oak Park Heights and
Stillwater have appointed representatives to serve on that
Commission on behalf of the cities; and,
• WHEREAS, the City of Oak Park Heights finds it advisable
and desirable to advance funds as may be necessary to the Central
St. Croix Valley Joint Cable Communications Commission to secure
the timely payment of legal fees representing all parties
defendant in this matter; and,
WHEREAS, the cities of Bayport, Stillwater and Oak Park
Heights are in agreement to pro rata share the expenses of legal
fees incurred in the defense of the representatives of the member
cities and the Central St. Croix Valley Joint Cable
Communications Commission.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the City ratifies the action of
the Central St. Croix Valley Joint Cable Communications
Commission in hiring the law firm of Briggs and Morgan to tender
defense on behalf of the various city representatives in the
Central St. Croix Valley Joint Cable Communications Commission to
the action commenced as above referenced.
Be it further resolved that the City of Oak Park Heights
shall advance sums as may be necessary to the Central St. Croix
Valley Joint Cable Communications Commission to pay for legal
fees that are not provided for within the Central St. Croix
Valley Joint Cable Communication Commission budget, subject to
reimbursement agreement to be negotiated and agreed to between
• the cities of Bayport and Stillwater as has been agreed to
between counsel for the various cities.

• EXTRACT OF MINUTES OF A MEETING OF THE
CITY COUNCIL OF THE CITY OF
OAK PARK HEIGHTS, MINNESOTA
HELD: October 9, 1990
Pursuant to due call and notice thereof, a special
meeting of the City Council of the City of Oak Park Heights,
Washington County, Minnesota, was duly called and held at the
City Hall in said City on Tuesday, the 9th day of October, 1990,
at 7:00 o'clock — M., for the purpose of authorizing the
issuance of, and awarding the sale of, $300,000 General
Obligation Improvement Bonds of 1990 of the City.
The following members were present: Mayor Frank Sommerfeldt,
Council Members Dean Kern, Barbara O'Neal and Richard Seggelke
and the following were absent: Jack Doerr

BONDS OF 1990,
AND LEVYING A TAX FOR THE PAYMENT THEREOF
A. WHEREAS, the City Council of the City of Oak Park
Heights, Minnesota (the "City "), has heretofore determined and
declared that it is necessary and expedient to issue $300,000
General Obligation Improvement Bonds of 1990 of the City,
pursuant to Minnesota Statutes, Chapters 429 and 475, to finance
the construction of various improvements in the City (the
"Improvements "); and
B. WHEREAS, the Improvements and all their components
have been ordered prior to the date hereof, after a hearing
thereon for which notice was given describing the Improvements or
all their components by general nature, estimated cost, and area
to be assessed; and

• C. WHEREAS, no other obligations have been sold
pursuant to a private sale within the last twelve (12) calendar
months of the date hereof which when combined with this issue
would exceed the $1,200,000 limitation on negotiated sales as
required by Minnesota Statutes, Section 475.60, Subdivision 2(2);
and
NOW, THEREFORE, BE IT RESOLVED by the Council of the
City of Oak Park Heights, Minnesota, as follows:
1. Acceptance of Offer,. The offer of Juran & Moody,
Inc. (the "Purchaser "), to purchase $300,000 General Obligation
Improvement Bonds of 1990 of the City (the "Bonds ", or
individually a "Bond "), in accordance with the terms and at the
rates of interest hereinafter set forth, and to pay therefor the
sum of $294,120, plus interest accrued to settlement, is hereby
accepted.
2. Title; Oriainal Issue Date; Denominations;
Maturities. The Bonds shall be titled "General Obligation
Improvement Bonds of 1990 ", shall be dated October 1, 1990, as
the date of original issue and shall be issued forthwith on or
after such date as fully registered bonds. The Bonds shall be
numbered from R -1 upward in the denomination of $5,000 each or in
any integral multiple thereof of a single maturity. The Bonds
• shall mature, without option of prepayment, on December 1 in the
years and amounts as follows:

3. Purpose. The Bonds shall provide funds to finance
the Improvements. The total cost of the Improvements, which
shall include all costs enumerated in Minnesota Statutes, Section
475.65, is estimated to be at least equal to the amount of the
Bonds. Work on the Improvements shall proceed with due diligence
to completion. The City covenants that it shall do all things
and perform all acts required of it to assure that work on the
Improvements proceeds with due diligence to completion and that
any and all permits and studies required under law for the
Improvements are obtained.
4. Interest. The Bonds shall bear interest payable
semiannually on June 1 and December 1 of each year (each, an
"Interest Payment Date "), commencing June 1, 1991, calculated on
the basis of a 360 -day year of twelve 30 -day months, at the
respective rates per annum set forth opposite the maturity years
as follows:

5. No Redemption. The Bonds shall not be subject to
redemption and prepayment prior to their maturity.
6. Bond Registrar. First Trust National Association,
in St. Paul, Minnesota, is appointed to act as bond registrar and
transfer agent with respect to the Bonds (the "Bond Registrar "),
and shall do so unless and until a successor Bond Registrar is
duly appointed, all pursuant to any contract the City and Bond
Registrar shall execute which is consistent herewith. The Bond
Registrar shall also serve as paying agent unless and until a
successor paying agent is duly appointed. Principal and interest
on the Bonds shall be paid to the registered holders (or record
holders) of the Bonds in the manner set forth in the form of Bond
and paragraph 12 of this resolution.
7. Form of Bond. The Bonds, together with the Bond
Registrar's Certificate of Authentication, the form of Assignment
and the registration information thereon, shall be in
substantially the following form:

KNOW ALL PERSONS BY THESE PRESENTS that the City of Oak
Park Heights, Washington County, Minnesota (the "Issuer ") ,
certifies that it is indebted and for value received promises to
pay to the registered owner specified above, or registered
assigns, without option of prepayment, in the manner hereinafter
set forth, the principal amount specified above, on the maturity
date specified above, and to pay interest thereon semiannually on
June 1 and December 1 of each year (each, an "Interest Payment
Date "), commencing June 1, 1991, at the rate per annum specified
above (calculated on the basis of a 360 -day year of twelve 30 -day
months) until the principal sum is paid or has been provided for.
This Bond will bear interest from the most recent Interest
Payment Date to which interest has been paid or, if no interest
has been paid, from the date of original issue hereof. The
principal of and premium, if any, on this Bond are payable upon
presentation and surrender hereof at the principal office of
First Trust National Association, in St. Paul, Minnesota (the
"Bond Registrar ") , acting as paying agent, or any successor
paying agent duly appointed by the Issuer. Interest on this Bond
will be paid on each Interest Payment Date by check or draft
mailed to the person in whose name this Bond is registered (the
"Holder" or "Bondholder ") on the registration books of the Issuer
maintained by the Bond Registrar and at the address appearing
thereon at the close of business on the fifteenth day of the
calendar month next preceding such Interest Payment Date (the
"Regular Record Date ") . Any interest not so timely paid shall
cease to be payable to the person who is the Holder hereof as of
the Regular Record Date, and shall be payable to the person who

• is the Holder hereof at the close of business on a date (the
"Special Record Date ") fixed by the Bond Registrar whenever money
becomes available for payment of the defaulted interest. Notice
of the Special Record Date shall be given to Bondholders not less
than ten days prior to the Special Record Date. The principal of
and premium, if any, and interest on this Bond are payable in
lawful money of the United States of America.
REFERENCE IS HEREBY MADE TO THE FURTHER PROVISIONS OF
THIS BOND SET FORTH ON THE REVERSE HEREOF, WHICH PROVISIONS SHALL
FOR ALL PURPOSES HAVE THE SAME EFFECT AS IF SET FORTH HERE.
IT IS HEREBY CERTIFIED AND RECITED that all acts,
conditions and things required by the Constitution and laws of
the State of Minnesota to be done, to happen and to be performed,
precedent to and in the issuance of this Bond, have been done,
have happened and have been performed, in regular and due form,
time and manner as required by law, and that this Bond, together
with all other debts of the Issuer outstanding on the date of
original issue hereof and the date of its issuance and delivery

• ON REVERSE OF BOND
No Redemption,. The Bonds of this issue (the "Bonds ")
are not subject to redemption and prepayment prior to their
maturity.
Issuance; Purbose; General Obliaation. This Bond is
one of an issue in the total principal amount of $300,000, all of
like date of original issue and tenor, except as to number,
maturity, interest rate and denomination, which Bond has been
issued pursuant to and in full conformity with the Constitution
and laws of the State of Minnesota and pursuant to a resolution
adopted by the City Council of the Issuer on October 9, 1990 (the
"Resolution "), for the purpose of providing money to finance the
construction of various improvements within the jurisdiction of
the Issuer. This Bond is payable out of the General Obligation
Improvement Bonds of 1990 Fund of the Issuer. This Bond
constitutes a general obligation of the Issuer, and to provide
moneys for the prompt and full payment of its principal, premium,
if any, and interest when the same become due, the full faith and
credit and taxing powers of the Issuer have been and are hereby
irrevocably pledged.
Denominations; Exchanae; Resolution,. The Bonds are
• issuable solely as fully registered bonds in the denominations of
$5,000 and integral multiples thereof of a single maturity and
are exchangeable for fully registered Bonds of other authorized
denominations in equal aggregate principal amounts at the
principal office of the Bond Registrar, but only in the manner
and subject to the limitations provided in the Resolution.
Reference is hereby made to the Resolution for a description of
the rights and duties of the Bond Registrar. Copies of the
Resolution are on file in the principal office of the Bond
Registrar.
Transfer. This Bond is transferable by the Holder in
person or by his, her or its attorney duly authorized in writing
at the principal office of the Bond Registrar upon presentation
and surrender hereof to the Bond Registrar, all subject to the
terms and conditions provided in the Resolution and to reasonable
regulations of the Issuer contained in any agreement with the
Bond Registrar. Thereupon the Issuer shall execute and the Bond
Registrar shall authenticate and deliver, in exchange for this
Bond, one or more new fully registered Bonds in the name of the
transferee (but not registered in blank or to "bearer" or similar
designation) , of an authorized denomination or denominations, in
aggregate principal amount equal to the principal amount of this
Bond, of the same maturity and bearing interest at the same rate.

• Fees upon Transfer or Loss,. The Bond Registrar may
require payment of a sum sufficient to cover any tax or other
governmental charge payable in connection with the transfer or
exchange of this Bond and any legal or unusual costs regarding
transfers and lost Bonds.
Treatment of Reaistered Owners,. The Issuer and Bond
Registrar may treat the person in whose name this Bond is
registered as the owner hereof for the purpose of receiving
payment as herein provided (except as otherwise provided on the
reverse side hereof with respect to the Record Date) and for all
other purposes, whether or not this Bond shall be overdue, and
neither the Issuer nor the Bond Registrar shall be affected by
notice to the contrary.
Authentication,. This Bond shall not be valid or become
obligatory for any purpose or be entitled to any security unless
the Certificate of Authentication hereon shall have been executed
by the Bond Registrar.
Qualified Tax - Exemot Obligation,. This Bond has been
designated by the Issuer as a "qualified tax - exempt obligation"
for purposes of Section 265(b)(3) of the Internal Revenue Code of
1986, as amended.

• 8. Execution; Temaorary Bonds. The Bonds shall be
executed on behalf of the City by the signatures of its Mayor and
Administrator - Treasurer and be sealed with the seal of the City;
provided, however, that the seal of the City may be a printed
facsimile; and provided further that both of such signatures may
be printed facsimiles and the corporate seal may be omitted on
the Bonds as permitted by law. In the event of disability or
resignation or other absence of either such officer, the Bonds
may be signed by the manual or facsimile signature of that
officer who may act on behalf of such absent or disabled officer.
In case either such officer whose signature or facsimile of whose
signature shall appear on the Bonds shall cease to be such
officer before the delivery of the Bonds, such signature or
facsimile shall nevertheless be valid and sufficient for all
purposes, the same as if he or she had remained in office until
delivery. The City may elect to deliver, in lieu of printed
definitive bonds, one or more typewritten temporary bonds in
substantially the form set forth above, with such changes as may
be necessary to reflect more than one maturity in a single
temporary bond. Such temporary bonds may be executed with
photocopied facsimile signatures of the Mayor and Administrator -
Treasurer. Such temporary bonds shall, upon the printing of the
definitive bonds and the execution thereof, be exchanged therefor
and cancelled.
• 9. Authentication,. No Bond shall be valid or
obligatory for any purpose or be entitled to any security or
benefit under this resolution unless a Certificate of
Authentication on such Bond, substantially in the form
hereinabove set forth, shall have been duly executed by an
authorized representative of the Bond Registrar. Certificates of
Authentication on different Bonds need not be signed by the same
person. The Bond Registrar shall authenticate the signatures of
officers of the City on each Bond by execution of the Certificate
of Authentication on the Bond and by inserting as the date of
registration in the space provided the date on which the Bond is
authenticated, except that for purposes of delivering the
original Bonds to the Purchaser, the Bond Registrar shall insert
as a date of registration the date of original issue, which date
is October 1, 1990. The Certificate of Authentication so
executed on each Bond shall be conclusive evidence that it has
been authenticated and delivered under this resolution.
10. Registration; Transfer; Exchanae. The City will
cause to be kept at the principal office of the Bond Registrar a
bond register in which, subject to such reasonable regulations as-
the Bond Registrar may prescribe, the Bond Registrar shall
provide for the registration of Bonds and the registration of

• transfers of Bonds entitled to be registered or transferred as
herein provided.
Upon surrender for transfer of any Bond at the
principal office of the Bond Registrar, the City shall execute
(if necessary), and the Bond Registrar shall authenticate, insert
the date of registration (as provided in paragraph 9) of, and
deliver, in the name of the designated transferee or transferees,
one or more new Bonds of any authorized denomination or
denominations of a like aggregate principal amount, having the
same stated maturity and interest rate, as requested by the
transferor; provided, however, that no Bond may be registered in
blank or in the name of "bearer" or similar designation.
At the option of the Holder, Bonds may be exchanged for
Bonds of any authorized denomination or denominations of a like
aggregate principal amount and stated maturity, upon surrender of
the Bonds to be exchanged at the principal office of the Bond
Registrar. Whenever any Bonds are so surrendered for exchange,
the City shall execute (if necessary), and the Bond Registrar
shall authenticate, insert the date of registration of, and
deliver the Bonds which the Holder making the exchange is
entitled to receive.
All Bonds surrendered upon any exchange or transfer
• provided for in this resolution shall be promptly cancelled by
the Bond Registrar and thereafter disposed of as directed by the
City.
All Bonds delivered in exchange for or upon transfer of
Bonds shall be valid general obligations of the City evidencing
the same debt, and entitled to the same benefits under this
resolution, as the Bonds surrendered for such exchange or
transfer.
Every Bond presented or surrendered for transfer or
exchange shall be duly endorsed or be accompanied by a written
instrument of transfer, in form satisfactory to the Bond
Registrar, duly executed by the Holder thereof or his, her or its
attorney duly authorized in writing.
The Bond Registrar may require payment of a sum
sufficient to cover any tax or other governmental charge payable
in connection with the transfer or exchange of any Bond and any
legal or unusual costs regarding transfers and lost Bonds.
Transfers shall also be subject to reasonable
regulations of the City contained in any agreement with the Bond
Registrar, including regulations which permit the Bond Registrar

to close its transfer books between record dates and payment
dates. The Administrator - Treasurer is hereby authorized to
negotiate and execute the terms of said agreement.
11. Riahts Upon Transfer or Exchanae. Each Bond
delivered upon transfer of or in exchange for or in lieu of any
other Bond shall carry all the rights to interest accrued and
unpaid, and to accrue, which were carried by such other Bond.
12. Interest Payment: Record Date. Interest on any
Bond shall be paid on each Interest Payment Date by check or
draft mailed to the person in whose name the Bond is registered
(the "Holder ") on the registration books of the City maintained
by the Bond Registrar and at the address appearing thereon at the
close of business on the fifteenth (15th) day of the calendar
month next preceding such Interest Payment Date (the "Regular
Record Date "). Any such interest not so timely paid shall cease
to be payable to the person who is the Holder thereof as of the
Regular Record Date, and shall be payable to the person who is
the Holder thereof at the close of business on a date (the
"Special Record Date ") fixed by the Bond Registrar whenever money
becomes available for payment of the defaulted interest. Notice
of the Special Record Date shall be given by the Bond Registrar
to the Holders not less than ten (10) days prior to the Special
Record Date.
• 13. Treatment of Reaistered Owner,. The City and Bond
Registrar may treat the person in whose name any Bond is
registered as the owner of such Bond for the purpose of receiving
payment of principal of and premium, if any, and interest
(subject to the payment provisions in paragraph 12 above) on,
such Bond and for all other purposes whatsoever whether or not
such Bond shall be overdue, and neither the City nor the Bond
Registrar shall be affected by notice to the contrary.
14. Deliverv: Application of Proceeds. The Bonds when
so prepared and executed shall be delivered by the Administrator -
Treasurer to the Purchaser upon receipt of the purchase price,
and the Purchaser shall not be obliged to see to the proper
application thereof.
15. Fund and Accounts,. There is hereby created a
special fund to be designated the "General Obligation Improvement
Bonds of 1990 Fund" (the "Fund ") to be administered and
maintained by the Administrator - Treasurer as a bookkeeping
account separate and apart from all other funds maintained in the'
official financial records of the City. The Fund shall be
maintained in the manner herein specified until all of the Bonds
and the interest thereon have been fully paid. There shall be

• maintained in the Fund two (2) separate accounts, to be
designated the "Construction Account" and "Debt Service Account ",
respectively.
(i) Construction Account. To the Construction Account
there shall be credited the proceeds of the sale of the Bonds,
less accrued interest received thereon, and less capitalized
interest in the amount of $38.062.50 (together with interest
earnings thereon and subject to such other adjustments as are
appropriate to provide sufficient funds to pay interest due on
the Bonds on or before June 1, 1992), plus any special
assessments levied with respect to the Improvements and collected
prior to completion of the Improvements and payment of the costs
thereof. From the Construction Account there shall be paid all
costs and expenses of making the Improvements listed in paragraph
16, including the cost of any construction contracts heretofore
let and all other costs incurred and to be incurred of the kind
authorized in Minnesota Statutes, Section 475.65; and the moneys
in said account shall be used for no other purpose except as
otherwise provided by law; provided that the proceeds of the
Bonds may also be used to the extent necessary to pay interest on
the Bonds due prior to the anticipated date of commencement of
the collection of taxes or special assessments herein levied or
covenanted to be levied; and provided further that if upon
completion of the Improvements there shall remain any unexpended
• balance in the Construction Account, the balance (other than any
special assessments) may be transferred by the Council to the
fund of any other improvement instituted pursuant to Minnesota
Statutes, Chapter 429, and provided further that any special
assessments credited to the Construction Account shall only be
applied towards payment of the costs of the Improvements upon
adoption of a resolution by the City Council determining that the
application of the special assessments for such purpose will not
cause the City to no longer be in compliance with Minnesota
Statutes, Section 475.61, Subdivision 1.
(ii) Debt Service Account. There are hereby irrevocably
appropriated and pledged to, and there shall be credited to, the
Debt Service Account: (a) all collections of special assessments
herein covenanted to be levied with respect to the Improvements
and either initially credited to the Construction Account and not
already spent as permitted above and required to pay any
principal and interest due on the Bonds or collected subsequent
to the completion of the Improvements and payment of the costs
thereof; (b) all accrued interest received upon delivery of the
Bonds; (c) capitalized interest in the amount of $ 38,062.50
(together with interest earnings thereon and subject to such
other adjustments as are appropriate to provide sufficient funds
to pay interest due on the Bonds on or before June 1, 1992); (d)

• any collections of all taxes herein or hereafter levied for the
payment of the Bonds and interest thereon; (e) all funds
remaining in the Construction Account after completion of the
Improvements and payment of the costs thereof, not so transferred
to the account of another improvement; (f) all investment
earnings on funds held in the Debt Service Account; and (g) any
and all other moneys which are properly available and are
appropriated by the governing body of the City to the Debt
Service Account. The Debt Service Account shall be used solely
to pay the principal and interest and any premiums for redemption
of the Bonds and any other general obligation bonds of the City
hereafter issued by the City and made payable from said account
as provided by law.
No portion of the proceeds of the Bonds shall be used
directly or indirectly to acquire higher yielding investments or
to replace funds which were used directly or indirectly to
acquire higher yielding investments, except (1) for a reasonable
temporary period until such proceeds are needed for the purpose
for which the Bonds were issued and (2) in addition to the above
in an amount not greater than the lesser of five percent (5%) of
the proceeds of the Bonds or $100,000. To this effect, any
proceeds of the Bonds and any sums from time to time held in the
Construction Account or Debt Service Account (or any other City
account which will be used to pay principal or interest to become
due on the bonds payable therefrom) in excess of amounts which
• under then - applicable federal arbitrage regulations may be
invested without regard to yield shall not be invested at a yield
in excess of the applicable yield restrictions imposed by said
arbitrage regulations on such investments after taking into
account any applicable "temporary periods" or "minor portion"
made available under the federal arbitrage regulations. Money in
the Fund shall not be invested in obligations or deposits issued
by, guaranteed by or insured by the United States or any agency
or instrumentality thereof if and to the extent that such
investment would cause the Bonds to be "federally guaranteed"
within the meaning of Section 149(b) of the Internal Revenue Code
of 1986, as amended (the "Code ").
16. Assessments. It is hereby determined that no less
than twenty percent (20%) of the cost to the City of each
Improvement financed hereunder within the meaning of Minnesota
Statutes, Section 475.58, Subdivision 1(3), shall be paid by
special assessments to be levied against every assessable lot,
piece and parcel of land benefited by any of the Improvements.
The City hereby covenants and agrees that it will let all
construction contracts not heretofore let within one (1) year
after ordering each Improvement financed hereunder unless the
resolution ordering the Improvement specifies a different time

• limit for the letting of construction contracts. The City hereby
further covenants and agrees that it will do and perform as soon
as they may be done all acts and things necessary for the final
and valid levy of such special assessments, and in the event that
any such assessment be at any time held invalid with respect to
any lot, piece or parcel of land due to any error, defect, or
irregularity in any action or proceedings taken or to be taken by
the City or the City Council or any of the City officers or
employees, either in the making of the assessments or in the
performance of any condition precedent thereto, the City and the
City Council will forthwith do all further acts and take all
further proceedings as may be required by law to make the
assessments a valid and binding lien upon such property. The
special assessments have not heretofore been authorized, and
accordingly, for purposes of Minnesota Statutes, Section 475.55,
Subdivision 3, the special assessments are hereby authorized.
Subject to such adjustments as are required by conditions in
existence at the time the assessments are levied, the assessments
are hereby authorized and it is hereby determined that the
assessments shall be payable in equal, consecutive, annual
installments, with general taxes for the years shown below and
with interest on the declining balance of all such assessments at
a rate per annum not greater than the maximum permitted by law
and not less than 8.00 per annum:

At the time the assessments are in fact levied the City
Council shall, based on the then - current estimated collections of
the assessments, make any adjustments in any ad valorem taxes
required to be levied in order to assure that the City continues
to be in compliance with Minnesota Statutes, Section 475.61,
Subdivision 1.
17. Tax Lew: Coveraae Test,. To provide moneys for
payment of the principal and interest on the Bonds there is
hereby levied upon all of the taxable property in the City a
direct annual ad valorem tax which shall be spread upon the tax
rolls and collected with and as part of other general property
taxes in the City for the years and in the amounts as follows:

The tax levies are such that if collected in full they,
together with estimated collections of special assessments and
other revenues herein pledged for the payment of the Bonds, will
produce at least five percent (5%) in excess of the amount needed
to meet when due the principal and interest payments on the
Bonds. The tax levies shall be irrepealable so long as any of
the Bonds are outstanding and unpaid, provided that the City
reserves the right and power to reduce the levies in the manner
and to the extent permitted by Minnesota Statutes, Section
475.61, Subdivision 3.
18. General Obliaation Pledae,. For the prompt and
full payment of the principal and interest on the Bonds, as the
same respectively become due, the full faith, credit and taxing
powers of the City shall be and are hereby irrevocably pledged.
If the balance in the Debt Service Account is ever insufficient
to pay all principal and interest then due on the Bonds and any
other bonds payable therefrom, the deficiency shall be promptly
paid out of any other funds of the City which are available for
such purpose, and such other funds may be reimbursed with or
• without interest from the Debt Service Account when a sufficient
balance is available therein.
19. Certificate of Reaistration,. The Administrator -
Treasurer is hereby directed to file a certified copy of this
resolution with the County Auditor of Washington County,
Minnesota, together with such other information as he or she
shall require, and to obtain the County Auditor's certificate
that the Bonds have been entered in the County Auditor's Bond
Register, and that the tax levy required by law has been made.
20. Records and Certificates,. The officers of the
City are hereby authorized and directed to prepare and furnish to
the Purchaser, and to the attorneys approving the legality of the
issuance of the Bonds, certified copies of all proceedings and
records of the City relating to the Bonds and to the financial
condition and affairs of the City, and such other affidavits,
certificates and information as are required to show the facts
relating to the legality and marketability of the Bonds as the
same appear from the books and records under their custody and
control or as otherwise known to them, and all such certified
copies, certificates and affidavits, including any heretofore
furnished, shall be deemed representations of the City as to the
facts recited therein.

• 21. Neaative Covenant as to Use of Proceeds and,
Improvements. The City hereby covenants not to use the proceeds
of the Bonds or to use the Improvements, or to cause or permit
them to be used, or to enter into any deferred payment
arrangements for the cost of the Improvements, in such a manner
as to cause the Bonds to be "private activity bonds" within the
meaning of Sections 103 and 141 through 150 of the Code.
22. Tax - Exempt Status of the Bonds: Rebate. The City
shall comply with requirements necessary under the Code to
establish and maintain the exclusion from gross income under
Section 103 of the Code of the interest on the Bonds, including
without limitation (1) requirements relating to temporary periods
for investments, (2) limitations on amounts invested at a yield
greater than the yield on the Bonds, and (3) the rebate of excess
investment earnings to the United States if the Bonds (together
with other obligations reasonably expected to be issued and
outstanding at one time in this calendar year) exceed the
small- issuer exception amount of $5,000,000.
For purposes of qualifying for the exception to the
federal arbitrage rebate requirements for governmental units
issuing $5,000,000 or less of bonds, the City hereby finds,
determines and declares that (1) the Bonds are issued by a
governmental unit with general taxing powers, (2) no Bond is a
• private activity bond, (3) ninety -five percent (95 %) or more of
the net proceeds of the Bonds are to be used for local
governmental activities of the City (or of a governmental unit
the jurisdiction of which is entirely within the jurisdiction of
the City), and (4) the aggregate face amount of all tax - exempt
bonds (other than private activity bonds) issued by the City (and
all subordinate entities thereof, and all entities treated as one
issuer with the City) during the calendar year in which the Bonds
are issued and outstanding at one time is not reasonably expected
to exceed $5,000,000, all within the meaning of Section
148 (f) (4) (C) of the Code.
23. Desianation of oualified Tax - Exempt Obliaations.
In order to qualify the Bonds as "qualified tax - exempt obliga-
tions" within the meaning of Section 265(b)(3) of the Code, the
City hereby makes the following factual statements and
representations:
(a) the Bonds are issued after August 7, 1986;
(b) the Bonds are not "private activity bonds" as
defined in Section 141 of the Code, treating "qualified
501(c)(3) bonds as not being private activity bonds;

• (c) the City hereby designates the Bonds as
"qualified tax - exempt obligations" for purposes of
Section 265(b)(3) of the Code;
(d) the reasonably anticipated amount of
tax - exempt obligations (other than private activity
bonds, treating qualified 501(c)(3) bonds as not being
private activity bonds) which will be issued by the
City (and all entities treated as one issuer with the
City, and all subordinate entities whose obligations
are treated as issued by the City) during this calendar
year 1990 will not exceed $10,000,000; and
(e) not more than $10,000,000 of obligations
issued by the City during this calendar year 1990 have
been designated for purposes of Section 265(b)(3) of
the Code.
The City shall use its best efforts to comply with any federal
procedural requirements which may apply in order to effectuate
the designation made by this paragraph.
24. Severabilitv. If any section, paragraph or
provision of this resolution shall be held to be invalid or
unenforceable for any reason, the invalidity or unenforceability
of such section, paragraph or provision shall not affect any of
the remaining provisions of this resolution.
25. Headinas. Headings in this resolution are
included for convenience of reference only and are not a part
hereof, and shall not limit or define the meaning of any
provision hereof.
The motion for the adoption of the foregoing resolution

WHEREAS, the City Council for the City of Oak Park
Heights has long advocated improvement of traffic control devices
along Highway 36 bordering the City of Oak Park Heights and the
City of Stillwater; and,
omL6r iSd -iS, the Minnesota Department of Transportation has
agreed to install traffic control signal devices at Oak Green and
Highway 36 and Osgood and Highway 36 to assist in traffic control
and public safety; and,
WHEREAS, the Minnesota Department of Transportation is
• requesting that the City enter into an agreement between it and
the City of Stillwater and the State of Minnesota as it affects
the maintenance, control and repair of those traffic control
devices.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the Minnesota Department of

WHEREAS, the City Council for the City of Oak Park
Heights have received a report from Junker Sanitation detailing
the expenses incurred by the City's residents in recycling
household wastes of paper, glass and metal and tin cans
throughout the year; and,
WHEREAS, the recycling contractor has identified the
increases of expenses that have been incurred by the company for
purposes of providing such recycling services; and,
U u rsk -tS, the recycling contractor is requesting a $.50
per household increase; and,
WHEREAS, the City Council for the City of Oak Park
Heights determines said increase to be reasonable.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the recycling charges are
herewith increased by $.50 per household with all costs to come
from the 1990 Sanitation Waste and Removal Fund, which has been
established for that purpose.

for themselves from their monthly compensation; and,
WHEREAS, said program does not create any expense for
the City of Oak Park Heights other than nominal administrative
expense and record keeping; and,
• WHEREAS, the City Council determines that it is a
reasonable benefit to be provided to the employees of the City of
Oak Park Heights that they should be allowed to join into a form
of deferred compensation program.

A RESOLUTION AGREEING TO A STIPULATION WITH THE

WHEREAS, the City Auditors for the City of Oak Park
Heights have advised the City that the 1990 tax levy as adopted
inadvertently exceeded the levy limits established by the state
of Minnesota; and,
WHEREAS, the City Auditor has determined that the 1991
tax levy as proposed could be established at $1,199,544.00, being
a .5% decrease over the prior year which would satisfy the
requirements of the Commissioner of Revenue to compensate for the
excess levy in calendar year 1990.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the recommendations of the City
Auditor is herewith adopted and that the stipulation is herewith
entered into with the Commissioner of Revenue for the state of
Minnesota reducing the payable 1991 tax levy to a level of
$1,199,554.00, the same representing a .5% decrease over calendar
year 1990.

WHEREAS, the City Council deems it necessary and
expedient that the City of Oak Park Heights, Minnesota, construct
certain improvements, to -wit: street, storm sewer, sanitary
sewer, and water service improvements and appurtenances thereto,
in the City as described in and in accordance with the
preliminary plans and report prepared by Bonestroo, Rosene,
Anderlik & Associates, consulting engineers; and
WHEREAS, the City Council has been advised by the
consulting engineers that said Valley Point 2nd Addition
Improvements of 1990 are feasible and should best be made as
proposed, and the consulting engineers' report to this effect has
heretofore been received by the Council, and filed with the City
• Administrator /Treasurer; and
• WHEREAS, the statute provides that no

shall be made until the Council shall have held s a public o hearing
on such improvements following mailed notice and two publications
thereof in the official newspaper stating time and place of the
hearing, the general nature of the improvement, the estimated
costs thereof, an the area proposed to be assessed, in accordance
with law.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, Minnesota, as follows:
1. A public hearing will be held at the time and place
set forth in the Notice of Public Hearing attached hereto as
Exhibit " A" to consider said proposed improvements.
2. The nature of the improvements, the estimated cost
of each major portion thereof, and the areas proposed to be
assessed therefor are described in the form of Notice of Public
Hearing hereto attached.
3. The notice of said public hearing shall be in
substantially the form contained in the notice hereto attached.
• 4. The City Administrator /Treasurer is hereby
authorized and directed to cause notice of said hearing to be
given two publications in the official newspaper. Said
publications shall be one week apart, and at least three days
shall elapse between the last publication and the hearing. Not
less than ten days before the hearing the Administrator /Treasurer
shall mail notice of the hearing to the owner of each parcel of
land within the area proposed to be assessed as described in the
notice. For the purpose of giving such mailed notice, owners
shall be those shown to be such on the records of the County
Auditor or, if the tax statements in the County are mailed by the
County Treasurer, on the records of the County Treasurer. As to
properties not listed on the records of the County Auditor or the
County Treasurer, the Administrator /Treasurer shall ascertain
such ownership by any practicable means and give mailed notice to
such owners.
The motion for the adoption of the foregoing resolution

additional accesses to be provided to the Mall at the area of
57th /58th Street; and,
WHEREAS, property owners Brekke and Olson have agreed
with the City to provide for said improvement and realignment of
roads facilitating the movement of traffic in and about the area;

WHEREAS, an agreement has been prepared by the office of
the City Attorney and is submitted for recommendation; and,
WHEREAS, the City Council for the City of Oak Park
Heights finds said agreement to be in conformance with the needs

WHEREAS, the City Council for the City of Oak Park
Heights has received a report from the Independent School
District 834 and from its representatives Mr. Kenneth Peterson
and Mr. Daniel Parker anticipating the location of a new senior
high school in Baytown Township and seeking annexation of the
lands thereto to the City of Oak Park Heights; and,
WHEREAS, it appears it is necessary to supply municipal
water and sewer services to the new senior high school in order
to allow it to be occupied and built in the manner provided; and,
WHEREAS, it appears to be in the best interests of the
School District of the City of Oak Park Heights and Baytown
Township that the City of Oak Park Heights annex lands necessary
for the location of the new senior high school.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the City herewith grants
concept approval to the request for the annexation of lands to
the City of Oak Park Heights from Baytown Township necessary to
annex those lands into the City for the preparation and building

13523 60th Street North, Oak Park Heights, Minnesota, has applied
for a Class B gambling license to the State of Minnesota
Department of Gaming to lease space at the St. Croix Bowl, 5862
Omaha Avenue North, Oak Park Heights, Minnesota, and operate
• Class B gambling at that location; and
WHEREAS, the Fraternal Order of Eagles #94 has operated
under a Class A license at its main location, and said
• organization has observed the regulations and operated such

gambling in a commendable manner.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, Washington County, Minnesota, as
follows:
1. That the application of the Fraternal Order of
Eagles #94 to operate under a Class B gambling license at the St.

2. That said organization shall file a monthly report
with the City of Oak Park Heights as to the income and

3. That the 60 -day waiting period for such gambling

furnished to the State of Minesota Department of Gaming.
The motion for the adoption of the foregoing resolution

A RESOLUTION RECOMMENDING THE CENTRAL CORRIDOR BRIDGE
AL'T'ERNATIVE AS THE PREFERRED LOCATION FOR THE
NEW ST. CROIX RIVER BRIDGE
WHEREAS, the City Council for the City of Oak Park
Heights has received the Planner's review dated May 24, 1990,
recognizing the regional and local need to improve the traffic,
access and mobility through the St. Croix Valley; and,
WHEREAS, the City of Oak Park Heights has studied the
various options that have been presented to improving existing
traffic patterns, as well as the "no build" options that are also
presented within said report; and,
WHEREAS, the City of Oak Park Heights has received the
input from its citizens and staff affecting the various options
that are available to the community affecting the rebuilding of
• Trunk Highway 36/212 and the location of a new bridge across the
St. Croix River.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, Washington County, Minnesota that
the City of Oak Park Heights herewith goes on record as
recommending the Central Corridor bridge alternative as the
preferred location for a new St. Croix River bridge. This
alternative will maintain the necessary traffic and land use
patterns in sustaining successful business along Trunk Highway 36
while minimizing the acquisition and relocation impacts of
residents within the City.
BE IT FURTHER RESOLVED that the City Council finds that
the various environmental, social, economic, visual and physical
impacts of the Central Corridor are the least adverse in
comparison to all other options being considered at the present
time.
BE IT FURTHER RESOLVED that the City of Oak Park Heights
herewith continues to request MN DOT and WI DOT to continue to
explore all possible access locations to Trunk Highway 36 in its
conversion to a limited access highway. Of critical importance
is the access to Osgood Avenue within the City of Oak Park
Heights. The City would expect that the final Environment Impact
• Statement will provide an alternative design for public comment,
establishing a highway access at Osgood Avenue in addition to
those preliminary access locations already provided for within
the draft Environmental Impact Statement.

• BE IT FURTHER RESOLVED that the City herewith goes on
record as opposing both the North Corridor option and the South
Corridor option otherwise being considered by the Minnesota
Department of Transportation and the Wisconsin Department of
Transportation. The Council finds that the North Corridor option
of the Stillwater - Houlton draft EIS will severely impact the
City's existing commercial businesses and the City's capacity to
attract new development and growth. This option also ignores the
significant expenditures to maintain and foster a success of
business along Trunk Highway 36 and the commercial district that
the City has undertaken in recent years. The North Corridor
option, if implemented, would make these measures useless as it
would take away the basic life line of these businesses and have
a severe impact on the City's economy.
BE IT FURTHER RESOLVED that the City finds that the
South Corridor options present great adverse impacts. First,
there would be an adverse affect upon the City's primary
residential neighborhoods, requiring relocations of approximately
50 homes and imposing severe social and financial hardship upon
relocated residents and those remaining within the disrupted
neighborhoods. Secondly, there would be an adverse fiscal impact
upon the City's tax base as well. While the impact upon the
balance of the community would not be as significant as other
options, the impact upon the eastern section of the City of Oak
• Park Heights outweighs all other potential benefits making this
corridor unacceptable.

in and working with the Stillwater Area Economic Development
Corporation to provide Star City status for the cities of
Stillwater, Bayport and Oak Park Heights as it relates to matters
of industrial and commercial planning and land use; and,
WHEREAS, the City of Oak Park Heights and its
professional consultants and planners recommend continuation of
the city's relationship with that organization as the Star City
Commission on matters relating to planning and land use; and,
WHEREAS, the City Council for the City of Oak Park
Heights deems it to be in the best interest of the city to
continue that relationship.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, Washington County, Minnesota that
until further resolution or order of the City Council to the
contrary, the City of Oak Park Heights shall continue to work
with and support the Stillwater Area Economic Development
Corporation as the Star City Commission and work with same on
matters relating to industrial and commercial planning and land
use within the City of Oak Park Heights, the City of Stillwater,
the City of Bayport and surrounding communities.

City of Oak Park Heights and the St. Croix Land Co., Inc.; and,
WHEREAS, the City has received the input of City staff
as it affects that Development Agreement; and,
WHEREAS, the St. Croix Land Co., Inc. owes the City of
Oak Park Heights fees for park dedication and sewer and water
hookup and approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that contingent approval is herewith
• granted the Development Agreement to be executed by the City of
Oak Park Heights and the St. Croix Land Co., Inc. That the
approval is contingent upon the payment of all necessary fees
inclusive of application, park dedication fees, sewer and water
hookup fees and approval by the Public Works Department.
That upon certification by the City Administrator/
Treasurer that all fees required under the ordinances and
resolutions of the City of Oak Park Heights have been paid by St.

RESOLUTION APPOINTING DIRECTOR OF PUBLIC WORKS AND
SUPERVISOR OF PUBLIC PARKS FOR THE
CITY OF OAK PARK HEIGHTS
WHEREAS, Roger Benson has been for many years in charge
of the Department of Public Works for the City of Oak Park
Heights, Minnesota; and
WHEREAS, Jeff Kellogg has been and now is performing
the duties of Supervisor of Public Parks under the supervision
of the Director of Public Works.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
1. That Roger Benson is hereby appointed Director of
Public Works for the City of Oak Park Heights.
2. That Jeff Kellogg is hereby appointed Supervisor
of Public Parks for the City of Oak Park Heights, under the
supervision of the Director of Public Works.
3. That the above job descriptions shall become
effective upon passage of this Resolution.

A RESOLUTION APPROVING THE CONDITIONAL USE PERMIT
FOR THE METROPOLITAN WASTE CONTROL PROJECT
WHEREAS, the City of Oak Park Heights has received an
application for Conditional Use Permit from the Metropolitan
Waste Control Commission affecting the project and the
development of their property with the City of Oak Park Heights;
and,
WHEREAS, public meetings have been duly held in the
manner required by law in said project.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the Conditional Use Permit
applied for by the Metropolitan Waste Control Commission be and
the same is herewith granted.

A RESOLUTION APPROVING THE VARIANCE REQUEST FROM THE
METROPOLITAN WASTE COMNIISSION CONTINGENT UPON THE
PLANNER'S RECOMMENDATIONS CONTAINED WITHIN ITS
CORRESPONDENCE OF MARCH 7, 1990
WHEREAS, the City of Oak Park Heights has received a
request for variance from the Metropolitan Waste Control
Commission affecting its facilities within the City of Oak Park
Heights; and,
WHEREAS, the City has received much public comment from
the residents of Sunnyside on the St. Croix Development affecting
said request; and,
WHEREAS, said request has been studied by the office of
the City Planner, and he has filed his report with the City
Council for the City of Oak Park Heights making recommendations
thereon, which report is dated, of file and is of record as of
March 7, 1990; and,
WHEREAS, the City Council for the City of Oak Park
Heights has duly conducted public meetings and hearings on the
request in the manner required by law.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the variance request submitted
by the Metropolitan Waste Control Commission is herewith approved
contingent upon full compliance with the recommendations of the
City Planner contained within its letter of March 7, 1990 and
also being met and approved by the residents of the Sunnyside on
the St. Croix Condominiums before the Building Permit is to be
issued.

RESOLUTION 90 -3 -14
CITY OF OAR PARR HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING THE ASSESSMENT ROLL
INCLUDING INTEREST AS IT AFFECTS THE
59TH AND OSGOOD AVENUE IMPROVEMENTS PROJECT
WHEREAS, pursuant to notice duly given as required by
law, the City Council has met, heard and passed upon any and all
objections to the proposed assessment for the 59th and Osgood
Avenue Improvements Project of 1990 and has received from the
Engineer the proposed assessment as it deems just; and,
WHEREAS, the City Council has determined that the
assessments proposed, as prepared by the office of the City
Engineer, are just and equitable.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
• the City of Oak Park Heights as follows:
1. Such proposed assessment, a copy of which is
attached hereto and made a part hereof, is hereby accepted and
shall constitute the special assessment against lands named
therein and each tract of land therein is hereby found to be
benefited by the proposed improvement.
2. Such assessments shall be as follows:
A. The assessment shall be payable in equal
installments including principle and interest extending over a
period of three years with interest to be paid at the rate of
8.5% per annum in the amount annually required to pay the
principle over such a period at such rate, the first of said
installments to be payable and collectable with the general taxes
for the year 1991 and collectable with such taxes during the year
1991.
B. The owner of the property so assessed may at any
time prior to the certification of the assessment to the County
Auditor pay to the City Treasurer and, thereafter, at any time
prior to November 15 of any year to the County Auditor the whole
of the principle amount of the assessment on such property
provided that no such prepayment shall be accepted without
payment of all installments due to and including December 31 of
• the year of prepayment, and the original principle amount reduced
only by the amounts of principle included in such installments
computed on an annual amortization basis.
• 3. The City Clerk shall forthwith transmit a certified
duplicate copy of the assessment roll through the County Auditor
to be extended on the tax list of the County.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION APPROVING SEWER AND WATER
RATE INCREASES EFFECTIVE APRIL 1, 1990
WHEREAS, Chapter 1001 of the Code of Ordinances of the
City of Oak Park Heights regulates the use of municipal water and
certain charges related thereto; and
WHEREAS, Chapter 1007 of the Code of Ordinances of the
City of Oak Park Heights regulates the use of permissible fees
and charges relating to the municipal sewer system owned by the
City of Oak Park Heights; and
WHEREAS, the City Council of the City of Oak Park
Heights has received the recommendation from the City Engineer
and City Administrator with regard to the establishment of sewer
and water rates for 1990; and
WHEREAS, in reviewing the projected expenses and other
increases that the City will experience with regard to the
. maintenance of the water and sewer system, the City Council has
determined that it is in the best interest of the City of Oak
Park Heights to increase water and sewer rates effective April 1,
1990.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
1. Effective April 1, 1990, sewer rates within the City
of Oak Park Heights shall be at the rate of $23.00 per quarter
for usage of up to 15,000 gallons, and thereafter a surcharge of
$1.53 per thousand gallons for utilization of water over the
15,000 gallon limit.
2. That effective April 1, 1990, as and for water rates
within the City of Oak Park Heights there shall be a minimum
charge of $14.00 per quarter up to 15,000 gallons of water
utilized by any individual or entity, and thereafter a surcharge
of $.90 per thousand gallons for usage over the 15,000 gallon
limit.
3. That all other charges related to water and sewer
connection shall remain in effect for 1990 as they were in 1989.

A RESOLUTION DESIGNATING THE COURIER AS THE
OFFICIAL NEWSPAPER FOR THE CITY OF OAK PARK HEIGHTS
WHEREAS, state law requires all municipalities to
designate an official newspaper to receive all official
publications and notices to be published as required by law
within the municipality; and,
WHEREAS, the City Council for the City of Oak Park
Heights has reviewed the applications by various newspapers to
provide said service; and,
WHEREAS, the City Council for the City of Oak Park
Heights has determined that The Courier provides the most
reasonable service to provide said service to the citizens of the
• City of Oak Park Heights at an economical cost and also to assure
reasonable notice being received by the residents.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that "The Courier" is designated to
be the official newspaper for the City of Oak Park Heights to
receive all publications within calendar year 1990.

A RESOLUTION ADOPTING A CONCEPT PLAN AND POLICY FOR THE
CONSTRUCTION OF MUNICIPAL IIKPROVE14ENTS ALONG HIGHWAY 36
WHEREAS, the City Council for the City of Oak Park
Heights has received a report and direction from the City
Engineer, Auditor and Planner as it affects providing utility
services along newly annexed territories along Highway 36 within
the City of Oak Park Heights; and,
WHEREAS, said plan as proposed appears reasonable to
provide utility services to the properties in that area.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that in concept, the
Engineer /Auditor's plan and policy to provide utility services
• along Highway 36 to newly annexed areas and, further, providing
for the construction of a second water tower, second well,
additional water main and additional sanitary sewer and lift
stations is herewith conditionally approved.

RESOLUTION DIRECTING CLOSING
OF CENTER MEDIAN
AT MINNESOTA HIGHWAY 36 AND OMAHA AVENUE
WHEREAS, Minnesota Trunk Highway 36 which serves the
City of Oak Park Heights has experienced a considerable increase
in traffic in the last few years; and
WHEREAS, the accident rate of motor vehicles has also
increased considerably as a result of increased traffic; and
WHEREAS, in the last several years many deaths have
occurred on said highway as it borders and disects the City; and
WHEREAS, there are several dangerous intersections and
turn -offs, and it appears they contribute greatly to the
confusion of drivers.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
That the turn -off in the center median of Minnesota
Trunk Highway 36 located between the east and west traffic lanes
of said highway which is located opposite Omaha Avenue be closed.
BE IT FURTHER RESOLVED that a copy of this Resolution be
sent to the Minnesota Department of Transportation, State Senator
Gary Laidig, State Representative Harriet McPherson, the County
of Washington, the City of Stillwater, and any other interested
persons.

RESOLUTION LOWERING SPEED LIMIT
FROM MINNESOTA HIGHWAY 5
THROUGH THE CITY OF OAK PARK HEIGHTS
WHEREAS, Minnesota Trunk Highway 36, which borders and
disects the City of Oak Park Heights, Washington County,
Minnesota, has experienced a considerable increase in traffic in
the last few years; and
WHEREAS, the vehicular traffic generally appears to
exceed the speed limit; and
WHEREAS, as a result of the increase in speed and
traffic volume, the accident rate in the area from Minnesota
Trunk Highway 5 east on Highway 36 has increased and has resulted
in a considerable number of fatal accidents as well as many non-
fatal accidents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
1. That a lower speed limit of 40 miles per hour be
established on Minnesota Trunk Highway 36 east from Minnesota
Trunk Highway 5.
2. That a study by conducted by the Minnesota
Department of Transportation to determine the necessity of
adjusting the arterial traffic lights as they exist on Minnesota
Trunk Highway 36 east of Minnesota Trunk Highway 5 so that the
traffic be slowed.
3. That stricter enforcement of the speed limit be
conducted by the Minnesota Highway Patrol and the local police
departments.
4. That a copy of this Resolution be sent to the
Minnesota Department of Transportation, State Senator Gary
Laidig, State Representative Harriet McPherson, the County of
Washington, the City of Stillwater, and any other interested
persons.

A RESOLUTION AUTHORIZING AND DIRECTING PAYMENT OF
$23,553.37 TO GREAT LAKES BUILDING SYSTEMS, INC.
WHEREAS, the City has previously entered into a contract
with Great Lakes Building Systems, Inc. to provide for
improvements on the 59th Street and Osgood Avenue Improvement
Project within the City of Oak Park Heights; and,
WHEREAS, the contractor has submitted a bill for payment
in the amount of $23,553.37; and,
WHEREAS, the City Engineer has approved the payment of
this bill certifying compliance by the contractor to the contract
between the contractor and the City of Oak Park Heights.
• NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the City Clerk be and the same
is hereby authorized and directed to make payment in the amount
of $23,553.37 to Great Lakes Building Systems, Inc. relating to
the 59th Street and Osgood Avenue Improvement Project.

RESOLUTION AUTHORIZING HIRING OF
FULL -TIME CLERK - TYPIST
WHEREAS, the City Council of the City of Oak Park
Heights has determined that it is necessary to employ a full -time
clerk - typist due to the greater work load in the City Admini-
strator's office.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
1. That the City of Oak Park Heights proceed to hire
Julie Dietzmann as a qualified full -time person to be employed as
a clerk - typist in the City offices.
• 2. That such employee shall be entitled to all full -
time benefits furnished by the City to its employees.
3. That the salary for such employee shall be deter-
mined to be $7.25 per hour with a further salary increase at 3
month review if deemed advisable.
4. That such employee shall be required to serve a
probationary period of 3 months, after which time said employee
shall be condisered permanent.

willingness to perform same or similar services for 1990.

WHEREAS, the Personnel Committee for the City of Oak
Park Heights has reviewed a request of non -union employees for
salaries in 1990; and,
WHEREAS, the Committee has recommended the City Council
for the City of Oak Park Heights that a 4% salary increase for
non -union employees be implemented for calendar year 1990.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that within calendar year 1990 the
non -union employees of the City of Oak Park Heights shall be
granted a 4% salary increase.

WHEREAS, the City Council of the City of Oak Park
Heights has been duly advised by the Chief of Police, other
administrative staff and personnel with regard to the hiring
of a full -time police officer for the City of Oak Park Heights;
and,
WHEREAS, the City Council of the City of Oak Park
Heights has duly considered all of the reports, recommendations
of staff and other relevant data regarding such hiring,
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of _Oak Park Heights - as follows:
1. That Kenneth Ray Anderson is hereby hired as a
full -time police officer for the City of Oak Park Heights.
• 2. That a certified copy of this Resolution shall be
forwarded by the City Clerk to the Public Employees Retirement
Association verifying that the position to be held by Mr. Anderson
is that of a police officer thereby enabling payment into the
special fund as opposed to the coordinated fund.
