A RESOLUTION ACCEPTING THE BID FROM ABRAHAMSON NURSERIES
IN THE AMOUNT OF $1,095.99 FOR THE PLANTING OF 17
3' AND 4' COLORADO SPRUCE TREES IN BRERRE PARR
WHEREAS, the City Engineer and the City Forester have
recommended to the City Council that a planting schedule be
implemented for the planting of certain Colorado spruce trees in
Brekke Park;
and,
WHEREAS, written quotations have been received by the
City of Oak Park Heights from persons desiring to supply 17
3 -foot to 4 -foot Colorado spruce trees, planting same in the
manner recommended by the City Forester, under his supervision
and pursuant to his specifications;
and,
WHEREAS, the low quote received was from Abrahamson
Nurseries in the amount of $1,095.99;
and,
WHEREAS, the City of Oak Park Heights finds same to be
an acceptable and reasonable quote by a responsible bidder.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the low bid of Abrahamson
Nurseries in the amount of $1,095.99 for the planting of 17
3 -foot to 4 -foot Colorado spruce trees in Brekke Park is herewith
accepted.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION SETTING THE ANNUAL LICENSE FEE FOR DOGS
WITHIN THE CITY OF OAK PARK HEIGHTS,
WASHINGTON COUNTY, MINNESOTA
WHEREAS, Chapter 601 of the Code of Ordinances of the
City of Oak Park Heights regulates the control of dogs; and
WHEREAS, it is necessary for the City Council, pursuant
to said Ordinance, to establish the annual license fee for each
dog.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
That the annual license fee for dogs within the
City of Oak Park Heights shall be $5.00 per year
per dog effective January 1, 1990.

A RESOLUTION AMENDING ORDINANCE CHAPTER 502
SECTION 502.03(3) AND SECTION 502.045
AFFECTING GARBAGE AND REFUSE COLLECTION
WHEREAS, the City Council for the City of Oak Park
Heights, has considered an amendment to Chapter 502, Section
502.03(3) and Section 502.045, providing for the amendment to the
definition of refuse as regulated and provided for within the
Code of Ordinances of the City of Oak Park Heights and setting
forth a method of removal and disposition of such recyclable
materials;
and,
• WHEREAS, public comment has been received with regard to
the proposed ordinance;
and,
WHEREAS, the City Council for the City of Oak Park
Heights recognizes the need for separation of certain items from
the waste stream and collection of recyclables to be implemented
on a city -wide basis;
and,
WHEREAS, a copy of the proposed ordinance has been on
file and available for public review and comment.
NOW, THEREFORE, DE IT RESOLVED by the City Council for
the City of Oak Park Heights that Ordinance No. 89 -502- is
• herewith approved and the Mayor and the Clerk are herewith
• authorized to execute same and provide for publication as
required by law.

WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING ORDINANCE AMENDMENT TO
CHAPTER 401.03.B.14.f AFFECTING STORAGE OF FIREWOOD
WHEREAS, the City Council for the City of Oak Park
Heights, Washington County, Minnesota, has duly conducted a
public hearing with regard to a proposed amendment to the zoning
ordinance;
and,
WHEREAS, staff recommendation on the proposed amendment
to the appropriate section of the zoning ordinance would amend
provisions regarding the storage of firewood on residential
• properties, requiring the same to be stored on the side yard or
rear yard and stacked neatly;
and,
WHEREAS, no adverse public comment was received at the
time of the public hearing;
and,
WHEREAS, the City Council for the City of Oak Park
Heights deems it to be in the best interests of its residents to
amend the ordinance in the manner recommended by its City staff.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the draft of the proposed
ordinance, as submitted by City staff, is herewith approved and
Chapter 401.03.B.14.f shall be amended within the text of the
• zoning code to require that all firewood to be stored upon
residential properties shall be stored in the side yard or rear
yard and stacked neatly.

A RESOLUTION AUTHORIZING THE ORDINANNCE ADOPTION
AMENDING CHAPTER 1202 LIMITING AND REGULATING THE SALE
OF INTOXICATING LIQUOR AND PROVIDING PENALTY THEREFOR
WITHIN THE CITY OF OAR PARR HEIGHTS
WHEREAS, the City Council for the City of Oak Park
Heights has been made aware of amendments to the Minnesota
Statutes affecting the sale and distribution of intoxicating
liquors within the state of Minnesota;
and,
WHEREAS, the requirements for bonding have been deleted
from the statutory scheme of security to municipalities and
• potentially injured parties within the framework of the Minnesota
Statutes;
and,
WHEREAS, the City staff has prepared an amending
ordinance updating and revising the ordinance regulation of the
sale and distribution of intoxicating liquors within the City of
Oak Park Heights, a true and correct copy of which has been on
file and open to public inspection within the City of Oak Park
Heights;
and,
WHEREAS, the City has received no adverse comment from
the public or from distributors, retailers or wholesalers of
intoxicating liquor affecting the proposed ordinance amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the proposed ordinance amending

• Chapter 1202 of the Code of Ordinances of the City of Oak Park
Heights providing for amendments to Section 1202.01, 1202.03.B,
1202.05.A., and 1202.08 are herewith adopted and the Mayor and
the Clerk are herewith authorized to execute said ordinance as
prepared by City staff and to publish same in the manner and form
required by law.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
RESOLUTION VACATING A DRAINAGE EASEMENT
WHEREAS, Mary E. Senkus, of the law firm of Oppenheimer,
Wolff & Donnelly, on behalf of First Trust National Association,
the current owners of Oak Ridge Place Project within the City of
Oak Park Heights, seeking to vacate all that part of a certain
drainage easement previously dedicated to the City of Oak Park
Heights within the plat of Oak Park Heights Garden, being
specifically described as follows, to -wit:
The north 3.20 feet of the south 60 feet of the
west 62 feet of the east 178.85 feet of Lot 1,
Block 1, OAK PARK HEIGHTS GARDEN, according to the
plat of record on file and of record in the office
of the County Recorder in and for Washington
County, Minnesota
and,
• WHEREAS, said Petitioner is the owner of all property
abutting the proposed drainage easement; and,
WHEREAS, the portion proposed for vacation has never
been utilized and will never be utilized as and for drainage
easement on behalf of the City of Oak Park Heights, and there
will never be any public need for that part of the drainage
easement sought to be vacated; and,
WHEREAS, the property thereof would be returned to the
tax rolls and would enhance the taxable value of all lands
abutting thereon or affected thereby; and,
WHEREAS, for the foregoing reasons it appears to be in
the public interest to vacate that portion of the drainage
easement above - described; and,
WHEREAS, the City Council has determined that the
Petitioner's payment of the costs incurred by the City with
respect to these proceedings is sufficient consideration for the
vacation thereof.
NOW, THEREFORE, BE IT RESOLVED that all that part of the
drainage easement previously dedicated to the City of Oak Park
Heights within the plat of Oak Park Heights Garden, described as
• follows, to -wit:
. The north 3.20 feet of the south 60 feet of the
west 52 feet of the east 178.85 feet of Lot 1,
Block 1, OAK PARK HEIGHTS GARDEN, according to the
plat of record on file and of record in the office
of the County Recorder in and for Washington
County, Minnesota
be and the same is hereby vacated.
BE IT FURTHER RESOLVED, that the City Clerk shall
prepare a Notice of Completion of these which shal
contain the name of the City, the identification l of s the v ca ion,
a statement of the time of completion thereof, and a description
of the real estate and the land affected thereby. Such notice
shall be presented to the County Auditor, who shall enter the
same in his transfer records and note upon the instrument, over
his official signature, the words, "Entered in the tranitfer
records." The notice shall then be filed with the County
Recorder, all as required by statute in such case made and
provided.

vacated as it affects the drainage easement is described as

west 62 feet of the east 178.85 feet of Lot 1,

WHEREAS, the City staff has prepared and submitted to
the City Council the proposed budget for calendar year 1990; and
WHEREAS, public notice has been duly given as provided
by law with public hearings being conducted by the City Council
with regard to the proposed budget, receiving no adverse comment
from the public with regard thereto; and,
WHEREAS, the City Council for the City of Oak Park
Heights has determined that the proposed budget as submitted by
City staff is in the best interests of the citizens of the City
of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights as follows:
1. That the 1990 . budget is hereby approved as presented
by the City Auditor in the total general fund amount of
$1,156,993.
2. That the City Clerk is hereby duly authorized and
directed to certify to the same to Washington County
Auditor /Treasurer as required by law.
3. That the scheduled payments on the 1971 general
obligation bonds in the amount of $6,000 and the 1982 general
obligation bonds in the amount of $14,000 are also hereby
• approved for collection in calendar year 1990.

4. That the City Clerk be and the same is hereby
authorized and directed to certify collections on the 1971
general obligation bonds in the amount of $6,000 and the 1982
general obligation bonds in the amount of $14,000 to the
Washington County Auditor /Treasurer's office for purposes of
collection with the 1990 taxes on the affected properties.

A RESOLUTION AUTHORIZING THE AMENDMENT OF CHAPTER 401
OF THE CODE OF ORDINANCES OF THE CITY OF OAR PARR HEIGHTS
AFFECTING NONCONFORMING USES IN NEWLY ANNEXED AREAS
WHEREAS, a public hearing has been duly held before the
City Council for the City of Oak Park Heights, affecting the
zoning code in Chapter 401 of the Code of Ordinances of the City
of Oak Park Heights, specifically proposing an amendment to
Section 401.03 of the Code of Ordinances to add a paragraph 14
under 401.03A, dealing with the treatment of pre- existing uses in
newly annexed territories;
and,
WHEREAS, no adverse public comment has been received as
• it affects the amendment of the zoning code in the manner
proposed by the city planner.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the ordinance amendments
proposed by the City staff affecting Chapter 401, Section 401.3A
to add a paragraph 14 dealing with newly annexed
territories -- continuation of previously permitted uses is
herewith adopted, and the Mayor and the Clerk are authorized to
execute said ordinance and provide for publication of same as
required by law.

A RESOLUTION APPROVING THE AMENDMENT TO THE
ST. CROIX MALL PUD TO ALLOW THE MOVING OF
THE CANELAKES RESTAURANT BUILDING FROM
ITS PRESENT SITE
WHEREAS, the City of Oak Park Heights has previously
entered into a St. Croix Mall PUD agreement with the owners of
the St. Croix Mall affecting the location and utilization of
certain buildings within the St. Croix Mall PUD;
and,
• WHEREAS, as a result of the sale in the redevelopment of
the St. Croix Mall, it is proposed to move the location of the
current Canelakes building from its site on the eastern section
of the St. Croix Mall PUD to an alternate site on the western
section of the St. Croix Mall PUD, located to the west of the K-
Mart and to the south of the St. Croix Bowl;
and,
WHEREAS, the City Council has received the comments of
the building official and the city planner affecting the move of
the Canelakes building and has received no adverse public comment
thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, that the City herewith consents to
• an amendment of the St. Croix Mall PUD, in conjunction with the
owner and developer, to allow the move of the Canelakes

• restaurant building from its present location to a location to be
specifically approved by the building official for the City of
Oak Park Heights, which will be located to the west of the K -Mart
building and to the south of the St. Croix Bowl.

A RESOLUTION AUTHORIZING THE AMENDMENT OF CHAPTER 401
OF THE CODE OF ORDINANCES OF THE CITY OF OAR PARR HEIGHTS
AS IT AFFECTS DAY CARE CENTERS IN B -2 DISTRICTS OF THE CITY
WHEREAS, the City Council for the City of Oak Park
Heights, Washington County, Minnesota has conducted public
hearings on the amendment to the zoning code of the City of Oak
Park Heights affecting Chapter 401 and the location of day care
facilities in B -2 districts of the City pursuant to said zoning
code;
• and,
WHEREAS, copies of the proposed ordinance have been on
file and available for public review;
and,
WHEREAS, public hearings have been conducted by the City
Council for the City of Oak Park Heights and no adverse public
comment has been received thereon;
and,
WHEREAS, City staff comments are on file and of record
within the office of the City Clerk recommending the proposed
amendment to the zoning code affecting day care within the B -2
districts.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights as follows: That the proposed
ordinance approved by the staff and on file with the City Clerk

• be and the same is hereby authorized to be executed by the Mayor
and the Clerk of the City of Oak Park Heights and published
hereafter according to statute. Said ordinance amends Chapter
401 at Section 401.11B of the Code of Ordinances of the City of
Oak Park Heights to add as a permitted use day care -group nursery
(with single occupancy .free standing building) in the B -2
district, pursuant to the provisions, conditions and requirements
set forth therein.

RESOLUTION DIRECTING THE OAK PARR HEIGHTS
HOUSING AND REDEVELOPMENT AU'T'HORITY TO IMPLEMENT
A COMPREHENSIVE STUDY ON CURRENT AND PROJECTED
POPULATION /HOUSING NEEDS AND DEMANDS;
CURRENT AND PROJECTED LOW AND MODERATE INCOME
POPULATION HOUSING NEEDS AND DEMANDS;
SENIOR AND ELDERLY CURRENT AND PROJECTED HOUSING
NEEDS AND DEMANDS; AND FURTHER TO STUDY ALL AVAILABLE
CITY, COUNTY, STATE AND FEDERAL GOVERNMENT PROGRAMS
AND GRANTS AVAILABLE THAT MAY IMPACT THE PROVISION OF
HOUSING THROUGH ALL ELEMENTS OF THE POPULATION BASE
REGARDLESS OF THEIR SOCIOECONOMIC STATUS
WHEREAS, the City Council for the City of Oak Park
Heights, has provided subsidized housing to low and moderate
income individuals, senior citizens, and elderly population
• elements within the community through the sponsorship and
construction of the Raymie Johnson Estates, Raymie Johnson
Townhomes, Oakridge Apartments and other developments; and,
WHEREAS, the City of Oak Park Heights has determined
that there is a need to study the current and projected
Population demands of the City of Oak Park Heights as it affects
housing for all aspects of the population despite their
socioeconomic status; and,
WHEREAS, a reasoned, well planned housing program
implemented on a City -wide basis is envisioned to have the
greatest impact on all citizens and on beneficial municipal
• planning within the City of Oak Park Heights; and,
• WHEREAS, the City of Oak Park Heights wishes to
implement meaningful and comprehensive assistance programs in the
provision of housing to all aspects of the population so as to
better provide for municipal planning and the needs of all
aspects and socioeconomic groups within the populations that now
exist within the City of Oak Park Heights and those which are to
be anticipated to be established within the City of Oak Park
Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, as follows:
1. That the Oak Park Heights Housing and Redevelopment
• Authority is herewith directed to implement a comprehensive study
to determine the current and projected population housing needs
within the City of Oak Park Heights presently and for the next
projected 10 -year period.
2. Within the study to be conducted by the Housing and
Redevelopment Authority, focus shall be made on all socioeconomic
groups that form the population of the City of Oak Park Heights
both presently and as will be projected to exist within the next
10 years.
3. That the Housing and Redevelopment Authority is
directed to study, research, and discover all current programs
• maintained by the state, county, metropolitan government, or city

• as may be utilized to impact housing needs within the City of Oak
Park Heights. Further, that the Housing and Redevelopment
Authority shall study each program to determine its potential
impact on the providing of safe, code - compliant, and affordable
housing within the City of Oak Park Heights.
Further, be it resolved that all programs to be examined
by the Oak Park Heights Redevelopment Authority shall be divided
into groupings to distinguish the various benefits that are
provided. The Housing and Redevelopment Authority shall
specifically focus on which programs offer the opportunity for
home ownership, as opposed to mere rental of housing within the
community. The Housing and Redevelopment Authority shall also
• focus on which programs encourage housing renovation and building
code compliance; the Housing and Redevelopment Authority shall
also focus on which programs involve actual inspections of homes
proposed to be used for the senior, the elderly, low and moderate
income, and other socioeconomic groups that may be available to
utilize such subsidized or program- sponsored housing.
4. The Housing and Redevelopment Authority shall
further, with regard to the study to be completed, project and
make recommendations as to future housing demands for senior,
elderly, low and moderate income, and other disadvantaged
socioeconomic groups and, specifically, provide for
recommendations as to future developments of residential housing

• within the City of Oak Park Heights to address the needs of those
individuals and groups.
5. The Housing and Redevelopment Authority is
specifically authorized to engage and enlist the services of city
staff as may be necessary or desirable to implement the study.
6.. The Housing and Redevelopment Authority of the City
of Oak Park Heights shall upon conclusion of its study provide
recommendations to the City Council as it affects the present and
future projected housing needs within the City of Oak Park
Heights both for the population in general as well as other
socioeconomic groups such as the senior, elderly, and low and
moderate income individuals.
7. The Oak Park Heights Housing and Redevelopment
Authority shall also forward its recommendations to the City
Council prioritizing the available programs maintained on a
state, metropolitan, county or city basis that are of assistance
in providing for housing needs within the framework of the City's
Comprehensive Plan and zoning and subdivision ordinances.
8. The City of Oak Park Heights Housing and
Redevelopment Authority shall also examine opportunities within
the City Housing and Redevelopment Authority to actively sponsor
and implement housing renovation and assistance programs to
• affirmatively encourage the removal of substandard housing within

• the City and the provision of safe, code- compliant, efficient and
suitable housing for all elements of the population.

A RESOLUTION APPROVING THE AMENDMENT OF THE

WHEREAS, the City Council for the City of Oak Park
Heights has conducted public hearings on the proposed amendment
of the City zoning code as it affects Section 401.03B.5.f, as it
affects accessory structures;
and,
WHEREAS, a copy of said ordinance has been on file and
of record and open to the public for inspection prior to said
hearing;
and,
• WHEREAS, no adverse public comment was received from the
public as it affects the said proposed ordinance;
and,
WHEREAS, the City has received the recommendation of its
city planner dated October 16, 1989, recommending the amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, that the proposed ordinance be and
the same are hereby directed to be executed by the Mayor and the
Clerk, with publication thereof to be provided as required by
law, and that said amendment, as recommended by the city planner,
is in all aspects approved.

A RESOLUTION AMENDING THE APPLICATION FEE FOR
HOME OCCUPATION LICENSES WITHIN THE
CITY OF OAR PARR HEIGHTS TO $100
WHEREAS, the City zoning code regulates home occupations
utilized within the residential districts of the City of Oak Park
Heights and requires a licensing system therefor;
and,
WHEREAS, the City Clerk has recommended an amendment to
the application fee and /or renewal fee for home occupation
licenses within the City of Oak Park Heights to increase same to
the amount of $100.00 annually;
• and,
WHEREAS, the City has received no adverse comment with
regard to the amendment of home occupation licenses to $100.00
for fees to be paid to the City for the administrative processing
of such licenses and supervision thereof.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the annual fee for home
occupation license within the City of Oak Park Heights is hereby
established to be $100.00 effective January 1, 1990.

WHEREAS, it appears that uniformity is desirable in

A RESOLUTION ACCEPTING THE LOW BID SUBMITTED BY
ST. CROIX TREE SERVICE IN THE AMOUNT OF $5,362
FOR THE REMOVAL OF 35 TREES
WHEREAS, the City Council has previously directed the
City Forester to prepare bids and specifications for the removal
of 35 trees within the City which are diseased and in need of
removal, pursuant to the City's ordinances and the statutes of
the State of Minnesota;
and,
WHEREAS, bids have been received from various suppliers
• and laborers proposing to do such services;
and,
WHEREAS, the lowest responsible bidder on said project
is St. Croix Tree Service, which has submitted a. low bid in the
amount of $5,362.00, pursuant to the specifications provided for
by the City Forester.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, that St. Croix Tree Service, having
provided the low bid in the amount of $5,362.00, is hereby
approved with said bid being accepted by the City of Oak Park
Heights with such work to be performed pursuant to the plans and
specifications provided by the City Forester and under his direct
supervision.
• BE IT FURTHER RESOLVED, that the City shall retain the
second low bid until all necessary contracts have been executed

RESOLUTION RELATING TO BOAT LANDING
WHEREAS, the Department of Natural Resources of the
State of Minnesota is interested in establishing a boat landing
within the limits of the City of Oak Park Heights; and
WHEREAS, the City of Oak Park Heights is not opposed to
said boat landing; and
WHEREAS, there appear to be certain conditions and
obligations that may be imposed upon the City in the event said
boat landing established within the City; and
WHEREAS, the City would be involved in the policing of
said area, possible maintenance thereof, and any other
supervision required to operate said boat landing and, as a
result, the City could become liable for injuries to persons or
property which may occur on said premises.
• NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Oak Park Heights, as follows:
1. That the City of Oak Park Heights does not oppose
the creation of a boat landing within the City.
2. That the City will accept no responsibility for
policing, maintaining or supervising the proposed boat landing,
nor assume any liability for the operation thereof.
3. That the City does not have the financial means to
furnish police and maintenance services to the area, nor is it in
a position to assume the financial burden required to carry the
necessary liability insurance thereon.

A RESOLUTION APPROVING $28,563 LEVY FOR 1982 BONDS
WHEREAS, the City of Oak Park Heights annually certifies
to the office of the County Treasurer /Auditor levies for bonds
and improvement projects incurred in previous years;
and,
WHEREAS, the City has previously approved the 1982
projects for City improvements with resulting bonds therefor;
and,
WHEREAS, pursuant to said projects and bonding
requirements passed and authorized by the City Council attendant
thereto, this year's levy, pursuant to the 1982 bonds, is in the
amount of $28,563 to be levied against the appropriate properties
previously identified in resolutions affecting that project.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the City Clerk is herewith
authorized and directed to certify to the County Auditor the sum

DEPOSIT FEES TO $5,000
WHEREAS, the City Council for the City of Oak Park
Heights has adopted a Tax Increment Financing policy;
and,
WHEREAS, applications for Tax Increment Financing to the
City of Oak Park Heights are generally regarded as staff
intensive matters, requiring great detail and large volumes of
hours and time of City staff;
and,
WHEREAS, utilization of City staff for Tax Increment
Financing should be a cost passed back to the developer of the
applicant of Tax Increment Financing;
and,
WHEREAS, it is reasonable for the City of Oak Park
Heights to establish requirements to assure that the tax payers
are not burdened by such applications.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that all applications for Tax
Increment Financing for the City of Oak Park Heights shall be
accompanied by a deposit of $5,000, to be maintained in the
offices of the City Clerk, with such fees being available to
offset City staff expense incurred in the review and analysis of
• such applications. That this resolution shall be effective
immediately.

A RESOLUTION APPROVING THE
INCREASE IN REFUSE RATES TO $9.00 PER QUARTER
WHEREAS, the City Council for the City of Oak Park
Heights, has received a request from the City's garbage
contractor requesting an increase in the quarterly rates for
garbage collection from residential properties within the City of
Oak Park Heights; and
WHEREAS, the City Council for the City of Oak Park
Heights is well aware of the efforts being made to recycle
certain household wastes and to keep out of the waste stream
• certain items consisting of cans, aluminum, glass, leaves,
newspaper and grass clippings; and
WHEREAS, the City Council for the City of Oak Park
Heights recognizes that the City's exclusive garbage hauler from
residential properties has incurred and will continue to incur
expenses in the recycling efforts that are being made to comply
with the State statute which requires separation of certain
collectables from the waste stream from residential properties by
calendar year 1990; and
WHEREAS, the City Council for the City of Oak Park
Heights deems it to be in the best interest of its citizens to
promote and encourage recycling and to compensate the contractor
to some degree for the recycling costs that it has incurred in
• dealing with the separation and recycling of residential refuse
and garbage.

• NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, that the allowable rate per quarter
per household, effective October 1, 1989, within the City of Oak
Park Heights for garbage collection shall be increased to $9.00
per quarter.

A RESOLUTION APPROVING POWER WASH OF WATER TOWER
WHEREAS, the City Utility Department has obtained
written quotations for services to provide for the power wash of
the water tower of the City of Oak Park Heights;
and,
WHEREAS, quotations indicate a maximum expense to be
incurred for that service to be approximately $3,600;
and,
WHEREAS, disbursement of such an expense is appropriate
to be made from the City water fund, as it directly relates to
the maintenance of a public utility.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the City Clerk is herewith
authorized to disburse from the City water funds an amount not to
exceed $3,600 for the power washing of the water tower of the
City of Oak Park Heights. The City Utility Director is directed
to obtain written quotations, pursuant to statute, to identify
the provider of the service and the maximum cost therefor, not to
exceed $3,600.

WHEREAS, the Department of Natural Resources maintains a
wildlife area adjacent to the City of Oak Park Heights,
designated as the Bayport Wildlife Management Area;
and,
WHEREAS, said area has been infested with a species of
vegetation known as "purple loostrife ", which is a noxious weed;
• and,
WHEREAS, Bayport Wildlife Management Area is utilized by
the citizens of the City of Oak Park Heights from time to time;
and,
WHEREAS, uncontrolled growth of purple loostrife within
the Bayport Wildlife Management Area may impact properties within
the City of Oak Park Heights and spread the growth of that
noxious weed within the community.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, that the City Council be and is
authorized to expend up to $2,000.00 by direct grant of the
Department of Natural Resources for the State of Minnesota to
control purple loostrife within the Bayport Wildlife Management

ESTABLISHING AN ECONOMIC DEVELOPMENT TAX INCREMENT
FINANCING DISTRICT
BE IT RESOLVED by the City Council of the City of Oak Park
Heights, Minnesota (City) as follows:
Section 1. Backaround
1.01. This Council initiated and referred to its staff
and consultants a proposal for an economic development project in
the City, providing ssistance to expand and rehabilitate the St.
Croix Mall shopping center.
1.02. The proposal, referred to as the St. Croix Mall
Tax Increment Project, has been studied and reviewed by the City
with the assistance of its consultants, Northwest Associated
Consultants: Voto, Tautges, Redpath and Company, Ltd.; and the
law office of Eckberg, Lammers, Briggs, Wolff & Vierling.

1.03. The City has, on the basis of such study and
• review, prepared an economic development plan for the project
area in accordance with Minnesota Statutes, Section 469.001 to
469.047 and has prepared a tax increment financing plan (TIF
plan) for the project in accordance with Sections 469.174 to
469.179 of Minnesota Statutes (TIP Act).
1.04. The tax increment financing plan is contained in a
document entitled " Tax Increment Financing Plan for St. Croix
Mall TIP project, dated August 7, 1909, now on file with the City
Clerk - Treasurer.
1.05. The City Council acts as the Planning Commission
for the City. Therefore, the City Council finds that St. Croix
Mall TIF Plan conforms to and is not in conflict with the general
plan for the development or redevelopment of the City as a whole.
1.06. This Council has this date conducted the regular
public hearing at which the views of all interested parties were
heard. Copies of the TIF Plan have been forwarded to
Independent School Districts No. 634 and #916 and Washington
County as required by the TIF Act, The City has received no
response to the notifications.
1.07. This Council has fully reviewed the contents of
the St. Croix Mall Tax Increment Financing Plan.
• Section 2. Findinass Tax Increment Plan
2.01. It is hereby found and determined that within the
Project Area there exist conditions of economic obsolescence,
physical deterioration, and under - utilization and inappropriate
uses of land.
2.02. It is further found and determined that within the
Project Area there are deficiencies in economic viability.

available for development without the public
intervention and financial aid described in the St.
Croix Mall TIP Plan.
b) The Redevelopment Plan, as previously approved, for
the Project Area will afford maximum opportunity,
consistent with the sound needs of the City as a whole,
for the redevelopment of the Project Area by private
enterprise.

c) The carrying out of the Redevelopment Plan continues
• to be essential to the economic well -being of the City
and its citizens.
2.04. The findings in this section are made to show the
City's intent to use the powers granted by the Housing and
Redevelopment Act to establish an economic development project as
defined in the TIF Act and the City's intent to exercise the
powers granted to it by those Acts to achieve the objectives of
the Acts.
Section 3. Findinas. Economic Development District
3.01. It is found and determined that it is necessary
and desirable to the sound and orderly development and
redevelopment of the Project Area and of the City as a whole, and
for the protection and preservation of the public health, safety,
and general welfare, that the authority of the TIF Act be
exercised by the City to provide public financial assistance to
the Project.
3.02. It is further found and determined that the TIF
District is an economic development district, and that the City
Council finds it to be in the public interest because:
a) It will result in increased employment in the
• municipality, or
b) It will result in preservation and enhancement of the
tax base of the municipality.
3.03. It is further found and determined, and it is the
reasoned opinion of this Council, that the development proposed
by the St. Croix Mall TIF Plan and the Project could not
reasonably be expected to occur solefy through private investment
within the reasonably foreseeable future and that therefore the
use of tax increment financing is necessary.
3.04. The St. Croix Mall Tax Increment Financing Plan
conforms to the general plan of development of the City as a
whole.
3.05. The St. Croix Mall Tax Increment Financing Plan
will afford maximum opportunity, consistent with the sound needs
of the City as a whole, for the economic development of the TIF
District by private enterprise= the carrying out of the Project
will substantially assist the City in the establishment of
reasonable and defensible assessing policies.

1989. 4.01. The Redevelopment Plan was approved March 17,

is approved. The St. Croix Mall Tax increment District is
established.
4.03. The geographic boundaries of the Pro ect Area,
Redevelopment Area, and the St. Croix Mall TIP District are as
described in the Redevelopment Plan and St. Croix Mall TIF Plan
which document is adopted herein by reference subject to such
minor modifications as are necessary to conform to the TIF Act
and the Municipal Housing Authority Act.
4.04. The Cityy Clerk Treasurer is requested to transmit
a certified coy of th3.s resolution together with a certified
copy of the S Croix Mall Tax Increment Financing Plan to the
County Auditor of Washington County with a request that the
original tax capacity of the St. Croix Mall TIF District be
certified to the Cit pursuant to Section 273.76, Subdivision 1
of the TIF Act. Te City Clerk Treasurer is further authorized
and directed to file a cop of the St. Croix Mall TIF Plan with
the Minnesota Department of Revenue as required by the TIF Act.

REDEVELOPMENT AUTHORITY
WASHINGTON COUNTY, MINNESOTA
WHEREAS, the City of Oak Park Heights Housing and
Redevelopment Authority has conducted public hearings as it
affects the creation of the St. Croix Mall Tax Increment
Financing District and the proposed acceptance of the Tax
Increment Financing Plan for the St. Croix Mall Tax Increment
Financing Project;
and,
WHEREAS, all said public hearings have been conducted,
• with positive results being received in comment from the public;
and,
WHEREAS, the City staff recommends the approval and
creation of the proposed district and Tax Increment Financing
Project;
and,
WHEREAS, it is deemed to be in the best interests of the
City of Oak Park Heights to adopt same.
NOW, THEREFORE, BE IT RESOLVED by the City of Oak Park
Heights Housing and Redevelopment Authority as follows:
1. That the City of Oak Park Heights Housing and
Redevelopment Authority herewith creates a St. Croix Mall Tax
• Increment Financing District and accepts the Tax Increment
Financing Plan for the St. Croix Mall Tax Increment Financing
• Project, as authorized, directed and identified by the City
Planner within his report.
2. That the Chairman of the Housing and Redevelopment
Authority and City Clerk are herewith authorized and directed to
execute all necessary documents as it affects the creation of the
formal district and ratification of the project herewith
approved.

RESOLUTION APPROVING THE DEVELOPMENT AGREEMENT
BY AND BETWEEN THE HOUSING AND REDEVELOPMENT AU4'HORITY
OF THE CITY OF OAR PARR HEIGHTS AND
OAR PARK PARTNERS
WHEREAS, the City Housing and Redevelopment Authority
and Oak Park Partners have reached a tentative agreement to
implement Tax Increment Financing on a project affecting the St.
Croix Mall; and,
WHEREAS, the same has also met with the approval of the
City of Oak Park Heights; and,
WHEREAS, a Development Agreement has been drafted by
• special- consulting attorneys Briggs and Morgan on behalf of the
City of Oak Park Heights in conjunction with City staff; and,
WHEREAS, the Development Agreement has been executed by
Oak Park Partners on behalf of the developing entity; and,
WHEREAS,. the Development Agreement meets the terms and
conditions previously specified by this City Council and the
Housing and Redevelopment Authority for approval; and,
WHEREAS, approval of this Development Agreement and
execution thereof is contingent upon the satisfactory payment to
the City of Oak Park Heights of all outstanding assessments due
the City of Oak Park Heights which have been transferred to the
St. Croix Mall from Swager Bros. 9th Addition.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
• the City of Oak Park Heights, that the Development Agreement in
• the manner and form presented by Mary Ippel of Briggs and Morgan,
dated September 6, 1989, be and the same is hereby approved; and
the Mayor and the Clerk are authorized to execute same on behalf
of the City Council for the City of Oak Park Heights as well as
the Housing and Redevelopment Authority.
BE IT FURTHER RESOLVED that the authorization granted
within this resolution and the execution of the signatures of the
Mayor and the Clerk are contingent upon satisfactory payment in
full at the date of closing and transfer of the St. Croix Mall
from Oak Park Development Company and Swager Bros., Inc. to Oak
Park Partners to satisfy the outstanding obligations owed to the
City of Oak Park Heights on the assessments which have been
transferred to the St. Croix Mall from Swager Bros. 9th Addition.

A RESOLUTION AUTHORIZING AND IMPLEMENTING A
RECYCLING PROGRAM IN THE CITY OF OAR PARR HEIGHTS,
WASHINGTON COUNTY, MINNESOTA
WHEREAS, the County of Washington has encouraged and
urges the support of residential recycling to reduce the County's
reliance on land fills; and,
WHEREAS, the Board of Commissioners of the County of
Washington, State of Minnesota, has budgeted funds for 1989 to be
used to further develop recycling services in the County; and,
WHEREAS, the City of Oak Park Heights, Washington
County, Minnesota is also interested in reducing the use of land
fills and, is also interested in participating in the County
program.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights, as follows:
1. That the City of Oak Park Heights shall enter into a
• Joint Powers Agreement with the City of Stillwater, Washington
County, Minnesota to implement the County of Washington plan.
2. That the City of Oak Park Heights shall enter into a
contract with Junker Recycling, Inc. to carry out the intent of
the County of Washington and the City of Oak Park Heights.
3. That the program shall be implemented immediately.
4. That the Mayor and Clerk of the City of Oak Park
Heights are authorized to execute the proposed contract as drawn.

CITY OF OAR PARR HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION APPROVING CHANGE ORDER FOR
CITY HALL EXPANSION AND REMODELING PROJECT
WHEREAS, the City Council has received a proposed change
order recommended by the City Engineer regarding the placing of
acoustical tiles in the ceiling, which change order would amount
to a $1,808.00 increase to the established bids for said project;
and,
WHEREAS, the City desires acoustical tiles to be placed
within the ceiling of the City Hall structure, and finds same to
be in the best interests of the City;
and,
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the change order, as
recommended by the City Engineer, providing for the acoustical
tiles to be placed within the ceiling of the City Hall, with an
increased amount in the projected contract in the sum of
$1,808.00 is herewith approved.

CITY OF OAR PARR HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION AUTHORIZING THE REVISING OF THE
PLUMBING CODE FEE SCHEDULE
WHEREAS, the City Building Inspector has requested the
City of Oak Park Heights to amend its plumbing code fez structure
to $5.00 per fixture, with a $10.00 minimum, and a 1% valuation
per job on commercial property;
and,
WHEREAS, the City has received no adverse public comment
with regard thereto;
and,
• WHEREAS, the existing fee schedule, within the plumbing
code for the City of Oak Park Heights, has not been amended for
several years;
and,
WHEREAS, the City Council finds it reasonable that the
plumbing inspection services be subsidized and paid for by
plumbing code fees.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the fee schedule recommended by
the building official for the City of Oak Park Heights is
herewith adopted, to be implemented immediately, consisting of
plumbing code fees to $5.00 per fixture, with a $10.00 minimum,
and a 1% valuation per job on commercial property.

WASHINGTON COUNTY, MINNESOTA
RESOLUTION DETERMINING INTEREST RATE
ON DEFERRED ASSESSMENTS
WHEREAS, the City of Oak Park Heights has heretofore
deferred assessments for storm sewer and utility improvements on
several parcels of land within said City, which deferments were
made pursuant to Minnesota Statutes.
NOW, THEREFORE, BE IT RESOLVED that assessments
heretofore deferred, and any future deferment of assessments,
shall bear the same rate of interest as the bonds issued by the
City to pay for said improvements.
In the event no bonds were /are issued, the interest rate
for the deferred assessments shall be established by the City
Council.

RESOLUTION AUTHORIZING THE MAYOR AND THE CLERK TO
EXECUTE THE JOINT POWERS AGREEMENT WITH THE
CITY OF STILLWATER ESTABLISHING A JOINT RECYCLING PROGRAM
BETWEEN THE TWO COMMUNITIES AND DESIGNATING THE
CITY OF STILLWATER AS THE LEAD COMMUNITY FOR
RECEIVING AND DISTRIBUTING GRANT FUNDS
WHEREAS, the City Council for the City of Oak Park
Heights recognizes the need to establish recycling programs
within the City of Oak Park Heights and surrounding communities;
and,
WHEREAS, the City of Oak Park Heights has determined
that it is mutually advantageous to both the cities of Oak Park
Heights and Stillwater to enter into a joint recycling program
for the purpose of receipt of County recycling funds and
coordination of programs with common haulers;
and,
WHEREAS, the City of Oak Park Heights has received a
Joint Powers Agreement, which has been recommended by City staff
from both cities, allowing the City of Stillwater to act as the
lead city for receiving and distributing grant funds received
from the County as it affects recycling programs.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights as follows:
1. That the Joint Powers Agreement on file with the
• City Clerk is herewith approved, and the Mayor and the Clerk are
' authorized to execute same on behalf of the City of Oak Park
Heights.
2. That pursuant to said Agreement, the City of
Stillwater shall act as the lead city for receiving and
distributing grant funds received pursuant to said recycling
programs.

WHEREAS, the City of Oak Park Heights has received a
request for payment No. 1 from Gartzke Construction, Inc.
pursuant to the contract existing between Gartzke Construction,
Inc. and the City of Oak Park Heights;
and,
WHEREAS, said amount to be paid is $34,085.90;
and,
WHEREAS, the City Engineer certifies that Gartzke has
completed its performance to date, as required pursuant to said
contract.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that payment No. 1 to Gartzke
Construction, Inc. in the amount of $34,085.90 is herewith
approved, and the City Clerk /Treasurer is authorized to make same
directly.

COUNTY SEAT ESTATES STREET PROJECT TO
TOWER ASPHALT COMPANY IN THE AMOUNT OF $18,221
WHEREAS, the City Council for the City of Oak Park
Heights has previously approved a public street improvement
project relating to the County Seat Estates Street Project;
and,
WHEREAS, the City Engineer for the City of Oak Park
Heights has prepared bids and specifications as it affects the
construction of streets within the County Seat Estates Project;
• and,
WHEREAS, said bids and spec's were submitted for public
inspection and bidding in the manner provided for by law, and
Tower Asphalt Company has submitted the low bid in the amount of
$18,221.00;
and,
WHEREAS, the City Council finds that Tower Asphalt's bid
is the lowest bid, and that Tower Asphalt is a responsible bidder
on the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the bid submitted by Tower
Asphalt in the amount of $18,221.00, relating to the County Seat
Estates Street Project, is herewith accepted.

auditor to be made;

WHEREAS, the City Council for the City of Oak Park
Heights has received the written recommendation of the City
Auditor contained within his letter bearing the date of June 22,
1989;
and,
WHEREAS, said recommendations are based upon accounting
principles and reasonable fiscal management;
and,
WHEREAS, the City Clerk /Treasurer concurs with same.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the 1989 General Fund Budget
shall be amended to conform to the recommendations contained
within the letter of the City Auditor dated June 22, 1989. That,

the City of Oak Park Heights that the County Seat Estates Project
is herewith awarded to Gartzke Construction. That the owner of
the property shall sign an agreement with Gartzke Construction
and be fully responsible to pay all necessary deposits prior to
contract signage.

MILLER EXCAVATING FOR MISCELLANEOUS CONSTRUCTION
SERVICES AND EQUIPMENT
WHEREAS, the City Council for the City of Oak Park
Heights has put out for public bid miscellaneous construction
services and equipment to be provided to the City of Oak Park
Heights from time to time;
and,
WHEREAS, said public bids have been reviewed by the City
Engineer;
and,
WHEREAS, Miller Excavating Company is determined to be
• the lowest responsible bidder for the providing of miscellaneous
construction services and equipment to the City of Oak Park
Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the bid of Miller Excavating
Company for miscellaneous construction services and equipment,
for a two year period of time, is herewith accepted; and the
Mayor and the Clerk are authorized to enter into the contract
with Miller Excavation Company for said miscellaneous
construction services and equipment.

A RESOLUTION AUTHORIZING THE MAYOR AND THE CLERK TO
EXECUTE AN ORDINANCE AMENDING ORDINANCE 1202 AFFECTING
PERMISSIBLE HOURS OF SALE OF INTOXICATING LIQUOR AND
REPEALING SURETY BOND PROVISIONS
WHEREAS, the State Legislature has modified the statutes
as it affects the hours of permissible sale of intoxicating
liquor and has repealed surety bond provisions previously
container) within the statutes;
and,
WHEREAS, the City of Oak Park Heights' current
ordinances contain the former restrictions on hours of sale and
• surety bond requirements;
and,
WHEREAS, the City Council determines that it is
appropriate for the City of Oak Park Heights to have its
ordinances in conformity with the State Statutes and not adopt
more restrictive provisions than that which prevail in the
surrounding communities as it affects the sale of intoxicating
liquor.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the Mayor and the Clerk are
herewith authorized and directed to execute an ordinance
amendment in the manner and form prepared by the City Attorney,
amending Ordinance 1202 to correct and amend the permissible
• hours of sale of intoxicating liquor to those which are now
contained within the statutes and to repeal surety bond
• Provisions, which have also been deleted in the statutory
requirements.

A RESOLUTION AWARDING THE BID FOR THE
HALL EXPANSION PROJECT TO THE LOWEST RESPONSIBLE BIDDER
GEORGE W. OLSEN CONSTRUCTION COMPANY
IN THE AMOUNT OF $379,100
WHEREAS, the City Engineer has prepared bids and
specifications as it affects the City Hall Expansion Project;
and,
WHEREAS, the City has received the bid of George W.
Olsen Construction Company in the amount of $379,100.00, as and
for a bid on said project;
and,
WHEREAS, The City Council determines George W. Olsen
Construction Company to be the lowest responsible bidder on the
project.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the bid for the City Hall
Expansion Project is herewith awarded to the lowest responsible
bidder, George W. Olsen Construction Company, in the amount of
$379,100.
BE IT FURTHER RESOLVED, that the City Clerk is herewith
directed to return the bid bonds except for the two lowest
responsible bidders until such time as the contracts have been
signed and approved by the City and George W. Olsen Construction
Company.

Heights has authorized the preparation of bids and specifications
for seal coat projects within the City of Oak Park Heights;
and,
WHEREAS, the City Engineer has supervised the
preparation of said bids and specifications and has received the
bids from various contractors seeking the job;
and,
• WHEREAS, the City Council has determined that the lowest
responsible bidder on said project is Allied Blacktop, who has
submitted a bid in the amount of $17,691.90.

WHEREAS, the City has received a proposed draft for a
Joint Powers Agreement to be executed between the City and other
governmental agencies as it affects the construction and
improvements to 65th Street;
and,
WHEREAS, the said agreement has been reviewed by the
City Engineer and is recommended;
and,
• WHEREAS, the said agreement needs review by the office
of the City Attorney prior to final adoption by the City.
NOW, THEREFORE, HE IT RESOLVED by the City Council for
the City of Oak Park Heights that the Mayor and the Clerk are
herewith conditionally authorized to execute the Joint Powers
Agreement as to the 65th Street improvements, contingent upon
final approval by the City Attorney's office.

freight charges, in the amount of $9,423.10;
and,

WHEREAS, the lowest responsible quote received by the

proposing to provide equipment specified by the City in the

A RESOLUTION ESTABLISHING A 30 MPH SPEED LIMIT
ON OARGREEN AVENUE
WHEREAS, the City Council for the City of Oak Park
Heights has received the review of the City Engineer and City
Police Department as it affects the proposed establishing of a 30
mph speed limit on Oakgreen Avenue North and South from 36th to
the southern City limit of the City of Oak Park Heights;
and,
WHEREAS, the City Council has also received the report
from the Commissioner of Transportation and Public Safety for the
• State of Minnesota concurring with the establishment of said
district and reduced speed limit to a 30 mph speed limit.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the speed limit on Oakgreen
Avenue, north and south from 36th to the southern limits of the
City of Oak Park Heights, is herewith reduced and established to
be 30 mph.
BE IT FURTHER RESOLVED, that the City utility personnel
are also instructed to post appropriate street signs, as required
by law, to notify traffic and pedestrians of the reduced speed
limit.

FULL TIME EMPLOYEE WITH THE CITY OF OAR PARR HEIGHTS
EFFECTIVE MAY 1, 1989
WHEREAS, the City staff has recommended establishing
Rollie Staberg as a full time employee with the City of Oak Park
Heights commencing May 1, 1989, and recommended his salary to be
established at the rate of $7.50 per hour, to be expended from
the water and sewer and park funds;
and,
WHEREAS, Rollie Staberg will be under the direct
supervision of the City's Utility Director within the Water and
Sewer Department.
• NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that Rollie Staberg is herewith
established, effective May 1, 1989, as a full time employee with
the City of Oak Park Heights. Mr. Staberg's salary shall be
commencing at the rate of $7.50 per hour with his salary to be
paid from water and sewer and park funds. An increase of $.50
per hour shall be paid to him, with completion of the sewer
license requirements by Mr. Staberg, and the same amount for
water license upon completion.

A RESOLUTION AWARDING STREET SWEEPING BID TO
ST. CROIX SWEEPING
WHEREAS, the City Council for the City of Oak Park
Heights had previously advertised bids for street sweeping
services;
and,
WHEREAS, the lowest responsible bidder on said project
is determined to be St. Croix Sweeping, which submitted a bid at
the rate of $42.00 per hour with an estimated 50 hours of
sweeping time.
• NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the street sweeping contract
for 1989 is awarded to St. Croix Sweeping at the rate of $42.00
per hour, with an estimate of 50 hours of sweeping time. The
first sweeping must be completed no later than May 13, 1989, and
a second sweeping be completed no later than September 1, 1989.

A RESOLUTION AUTHORIZING EXECUTION OF AN ORDINANCE
IMPLEMENTING REZONING PURSUANT TO PLANNER'S REPORT
WHEREAS, the City Council for the City of Oak Park
Heights has received recommendations contained within the City
Planner's Report dated February 27, 1989;
and,
WHEREAS, said report recommends changes in zoning from
Open Space Conservation District to B -2, General Business
District, in the area designated as Exhibit B within said report;
and,
WHEREAS, a public hearing has been conducted by the City
Council and has received no adverse public comment thereto;
• and,
WHEREAS, the City Council finds that rezoning is
consistent with the City's Comprehensive Plan and planning goals
of the City of Oak Park Heights.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the Mayor and the Clerk are
herewith authorized and directed to execute an ordinance
implementing the recommended zoning changes as set forth within
Exhibit B of the Planner's Report dated February 27, 1989.

AND POLICIES FOR REDEVELOPMENT AND TAX INCREMENT FINANCING
WITHIN THE CITY OF OAR PARR HEIGHTS
WHEREAS, the City Planner, Auditor, Attorney and Fiscal
Consultant have prepared a Redevelopment Plan and Tax Increment
Financing Policy to be implemented within the City of Oak Park
Heights;
and,
WHEREAS, the City Council for the City of Oak Park
Heights has reviewed said plan over a period of months;
• and,
WHEREAS, its appears to be in the best interests of the
City of Oak Park Heights to adopt a Redevelopment Plan and Tax
Increment Financing Policy at this time.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the plan formally prepared and
authored by the City Planner dated March, 1989, is herewith
adopted as the official Redevelopment Plan and Tax Increment
Financing Policy of the City of Oak Park Heights.

RESOLUTION DIRECTING CITY ENGINEER
TO CONDUCT STREET IMPROVEMENT AND STORM SEWER
FEASIBILITY STUDY
WHEREAS, the County of Washington has determined that
certain reconstruction of 65th Street North, also known as
Orleans Street, is in need of repair and rebuilding, and also to
install storm sewer improvements along with said improvements,
from Osgood Avenue North to Paris Avenue North; and
WHEREAS, the cost thereof will be apportioned between
the County of Washington, Minnesota Department of Transportation,
City of Stillwater and City of Oak Park Heights; and
WHEREAS, it appears necessary that a preliminary study
be made by the City Engineer of the City of Oak Park Heights to
determine the feasibility of said improvement.
• NOW, THEREFORE, BE IT RESOLVED that the City neer,
Bonestroo, Rosene, Anderlik & Associates y en g
proceed with a
feasibility study and determine the costs to repair, rebuild and
improve the aforesaid street with installation of storm sewer
improvements.

A RESOLUTION ESTABLISHING A $500 NON - REFUNDABLE
APPLICATION FEE TO BE COLLECTED BY THE HOUSING AND
REDEVELOPMENT AUTHORITY FOR TAR INCREMENT FINANCING PROJECTS
WHEREAS, the City Council for the City of Oak Park
Heights has received the recommendation from the City Planner and
Auditor as it affects expenses of processing applications for Tax
Increment Financing projects from private developers;
and,
WHEREAS, the City staff is recommending the
establishment of a fee structure which would include a $500.00
• non- refundable fee for an application for a Tax Increment
Financing project, together with a $2,000.00 escrow deposit to be
applied to professional service expenses incurred by the City in
reviewing said applications;
and,
WHEREAS, said recommendations of City staff are found by
the City Council. to be reasonable.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that in all applications for Tax
Increment Financing projects within the City of Oak Park Heights,
the proponent of said application shall be required to deposit
with the City a $500.00 non - refundable application fee. The
proponent of the application shall also be required to escrow
• with the City an amount equal to $2,000.00 to be applied to
professional service expenses incurred by the City in having its
• planner, auditor, attorney and others review the proposed Tax
Increment Financing project.

AND AMENDING THE CITY OF OAK PARR HEIGHTS REDEVELOP14ENT PLAN
WHEREAS, pursuant to motion duly adopted by the City
Council of the City of Oak Park Heights at its regular meeting on
March 13, 1989, a public hearing was held before the Housing
and Redevelopment Authority for the City of Oak Park Heights at
the Oak Park Heights Municipal Building within the City of Oak
Park Heights, Washington County, Minnesota to reaffirm the need
for a housing and redevelopment authority within the City of Oak
Park Heights and to review and adopt a Redevelopment Plan
prepared and dated March, 1989; and
WHEREAS, public comment was duly received at the public
hearing on the proposed Redevelopment Plan and relating to the
continuing need for a Housing and Redevelopment Authority within
the City of Oak Park Heights all being in favor thereof; and
WHEREAS, the Redevelopment Plan has been prepared by
city staff consisting of the offices of the City Planner, City
Attorney, City Auditor, and Bond Consultant, being presented in a
formal Redevelopment Plan dated Parch, 1989 copies of which are
on file with the office of the City Clerk and are available to
public inspection.

WHEREAS, the City Council for the City of Oak Park
Heights has received a recommendation from the Chief of Police
and acting in accordance thereof has hired Desmond L. Pepin as a
part -time police officer within the City of Oak Park Heights
Police Department; and
WHEREAS, the City has received notice from the Public
Employees Retirement Association, PERA. Unit No. 6674 -00,
• affecting Desmond L. Pepin, No. 064728, confirming that Desmond
L. Pepin has been reported as a member of the Public Employees
Retirement Association Police and Fire Fund; and
WHEREAS, that department has requested that the City of
Oak Park Heights pass a resolution declaring that the position
held by Desmond L. Pepin is that of a police officer pursuant to
which said employee will then become a member of the Police and
Fire Fund.
NOW, THEREFORE, BE IT RESOLVED by the City of Oak Park
Heights that the position held by Desmond L. Pepin within the
Police Department of the City of Oak Park Heights is herewith
declared to be a position of police officer pursuant to which
Desmond L. Pepin shall be a member of the Police and Fire Fund as
• maintained and managed by the Public Employees Retirement
Association thereby allowing Desmond L. Pepin, as a part -time
• police officer, to pay deductions into the special fund, i.e.,
Police and Fire Fund, as maintained by the Public Employees
Retirement Association.
BE IT FURTHER RESOLVED that the declarations contained
within this resolution shall be effective from the date that
employment commenced for Desmond L. Pepin within the Police
Department of the City of Oak Park Heights which would be
effective January 9, 1989.

installation of water and sanitary sewer facilities to said area.

A RESOLUTION ESTABLISHING OFFICE PERSONNEL HOURS
WHEREAS, the City Council for the City of Oak Park
Heights has reviewed the establishment of appropriate business
hours for offices to be opened within the City of Oak Park
Heights and be available for public access;
and,
WHEREAS, it appears that office hours to be established
from 8:00 a.m. to 4:30 p.m. every day, Monday through Friday,
will appropriately meet the needs of the public in getting access
to City .records and having access to City personnel;
• and,
WHEREAS, the City personnel have also requested that
they be allowed to take compensation time, in lieu of overtime,
for attending Council meetings.
NOW, THEREFORE, BE IT RESOLVED by the City Council for
the City of Oak Park Heights that the official office hours for
the City of Oak Park Heights' offices and personnel shall be from
8:00 a.m. to 4:30 p.m., Monday through Friday. That,
additionally, employees who wish to elect compensatory time may
take same at the overtime rate for attending evening meetings
with the City Council that they may be required to attend as a
part of their job. That, in lieu of taking compensatory time,
is the employee may take pay at time and one -half if they so choose.
• In either event, the decision of taking compensatory time or time
and one -half pay shall be solely that of the employee.
