HomeMy WebLinkAbout1989 Resolutions RESOLUTION 89 -12 -72 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ACCEPTING THE BID FROM ABRAHAMSON NURSERIES IN THE AMOUNT OF $1,095.99 FOR THE PLANTING OF 17 3' AND 4' COLORADO SPRUCE TREES IN BRERRE PARR WHEREAS, the City Engineer and the City Forester have recommended to the City Council that a planting schedule be implemented for the planting of certain Colorado spruce trees in Brekke Park; and, WHEREAS, written quotations have been received by the City of Oak Park Heights from persons desiring to supply 17 3 -foot to 4 -foot Colorado spruce trees, planting same in the manner recommended by the City Forester, under his supervision and pursuant to his specifications; and, WHEREAS, the low quote received was from Abrahamson Nurseries in the amount of $1,095.99; and, WHEREAS, the City of Oak Park Heights finds same to be an acceptable and reasonable quote by a responsible bidder. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the low bid of Abrahamson Nurseries in the amount of $1,095.99 for the planting of 17 3 -foot to 4 -foot Colorado spruce trees in Brekke Park is herewith accepted. Sommerfel , Mayor LaVonne Wi sson Administrator /Treasurer L • RESOLUTION NO. 89 -12 -71 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA RESOLUTION SETTING THE ANNUAL LICENSE FEE FOR DOGS WITHIN THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA WHEREAS, Chapter 601 of the Code of Ordinances of the City of Oak Park Heights regulates the control of dogs; and WHEREAS, it is necessary for the City Council, pursuant to said Ordinance, to establish the annual license fee for each dog. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, as follows: That the annual license fee for dogs within the City of Oak Park Heights shall be $5.00 per year per dog effective January 1, 1990. Somm feldt, Mayor d Vonne Wilson - - '� City Clerk /Administrator • • RESOLUTION 89 -12 -70 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AMENDING ORDINANCE CHAPTER 502 SECTION 502.03(3) AND SECTION 502.045 AFFECTING GARBAGE AND REFUSE COLLECTION WHEREAS, the City Council for the City of Oak Park Heights, has considered an amendment to Chapter 502, Section 502.03(3) and Section 502.045, providing for the amendment to the definition of refuse as regulated and provided for within the Code of Ordinances of the City of Oak Park Heights and setting forth a method of removal and disposition of such recyclable materials; and, • WHEREAS, public comment has been received with regard to the proposed ordinance; and, WHEREAS, the City Council for the City of Oak Park Heights recognizes the need for separation of certain items from the waste stream and collection of recyclables to be implemented on a city -wide basis; and, WHEREAS, a copy of the proposed ordinance has been on file and available for public review and comment. Sommerfe t, Mayor Attest: LaVonne Wilson Administrator /Treasurer • • • RESOLUTION 89 -12 -69 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING ORDINANCE AMENDMENT TO CHAPTER 401.03.B.14.f AFFECTING STORAGE OF FIREWOOD WHEREAS, the City Council for the City of Oak Park Heights, Washington County, Minnesota, has duly conducted a public hearing with regard to a proposed amendment to the zoning ordinance; and, WHEREAS, staff recommendation on the proposed amendment to the appropriate section of the zoning ordinance would amend provisions regarding the storage of firewood on residential • properties, requiring the same to be stored on the side yard or rear yard and stacked neatly; and, WHEREAS, no adverse public comment was received at the time of the public hearing; and, WHEREAS, the City Council for the City of Oak Park Heights deems it to be in the best interests of its residents to amend the ordinance in the manner recommended by its City staff. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the draft of the proposed ordinance, as submitted by City staff, is herewith approved and Chapter 401.03.B.14.f shall be amended within the text of the • zoning code to require that all firewood to be stored upon residential properties shall be stored in the side yard or rear yard and stacked neatly. RESOLUTION 89 -12 -68 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE ORDINANNCE ADOPTION AMENDING CHAPTER 1202 LIMITING AND REGULATING THE SALE OF INTOXICATING LIQUOR AND PROVIDING PENALTY THEREFOR WITHIN THE CITY OF OAR PARR HEIGHTS WHEREAS, the City Council for the City of Oak Park Heights has been made aware of amendments to the Minnesota Statutes affecting the sale and distribution of intoxicating liquors within the state of Minnesota; and, WHEREAS, the requirements for bonding have been deleted from the statutory scheme of security to municipalities and • potentially injured parties within the framework of the Minnesota Statutes; and, WHEREAS, the City staff has prepared an amending ordinance updating and revising the ordinance regulation of the sale and distribution of intoxicating liquors within the City of Oak Park Heights, a true and correct copy of which has been on file and open to public inspection within the City of Oak Park Heights; and, WHEREAS, the City has received no adverse comment from the public or from distributors, retailers or wholesalers of intoxicating liquor affecting the proposed ordinance amendment. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the proposed ordinance amending r � • Chapter 1202 of the Code of Ordinances of the City of Oak Park Heights providing for amendments to Section 1202.01, 1202.03.B, 1202.05.A., and 1202.08 are herewith adopted and the Mayor and the Clerk are herewith authorized to execute said ordinance as prepared by City staff and to publish same in the manner and form required by law. Senkus, of the law firm of Oppenheimer, Wolff & Donnelly, on behalf of First Trust National Association, the current owners of Oak Ridge Place Project within the City of Oak Park Heights, seeking to vacate all that part of a certain drainage easement previously dedicated to the City of Oak Park Heights within the plat of Oak Park Heights Garden, being specifically described as follows, to -wit: The north 3.20 feet of the south 60 feet of the west 62 feet of the east 178.85 feet of Lot 1, Block 1, OAK PARK HEIGHTS GARDEN, according to the plat of record on file and of record in the office of the County Recorder in and for Washington County, Minnesota and, • WHEREAS, said Petitioner is the owner of all property abutting the proposed drainage easement; and, WHEREAS, the portion proposed for vacation has never been utilized and will never be utilized as and for drainage easement on behalf of the City of Oak Park Heights, and there will never be any public need for that part of the drainage easement sought to be vacated; and, WHEREAS, the property thereof would be returned to the tax rolls and would enhance the taxable value of all lands abutting thereon or affected thereby; and, WHEREAS, for the foregoing reasons it appears to be in the public interest to vacate that portion of the drainage easement above - described; and, WHEREAS, the City Council has determined that the Petitioner's payment of the costs incurred by the City with respect to these proceedings is sufficient consideration for the vacation thereof. NOW, THEREFORE, BE IT RESOLVED that all that part of the drainage easement previously dedicated to the City of Oak Park Heights within the plat of Oak Park Heights Garden, described as • follows, to -wit: . Sommerfeldt, /ayor Attest: La Vonne Wilson Administrator /Treasurer • RESOLUTION 89 -11 -65 • CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE AMENDMENT OF CHAPTER 401 OF THE CODE OF ORDINANCES OF THE CITY OF OAR PARR HEIGHTS AFFECTING NONCONFORMING USES IN NEWLY ANNEXED AREAS WHEREAS, a public hearing has been duly held before the City Council for the City of Oak Park Heights, affecting the zoning code in Chapter 401 of the Code of Ordinances of the City of Oak Park Heights, specifically proposing an amendment to Section 401.03 of the Code of Ordinances to add a paragraph 14 under 401.03A, dealing with the treatment of pre- existing uses in newly annexed territories; and, WHEREAS, no adverse public comment has been received as • it affects the amendment of the zoning code in the manner proposed by the city planner. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the ordinance amendments proposed by the City staff affecting Chapter 401, Section 401.3A to add a paragraph 14 dealing with newly annexed territories -- continuation of previously permitted uses is herewith adopted, and the Mayor and the Clerk are authorized to execute said ordinance and provide for publication of same as required by law. CROIX MALL PUD TO ALLOW THE MOVING OF THE CANELAKES RESTAURANT BUILDING FROM ITS PRESENT SITE WHEREAS, the City of Oak Park Heights has previously entered into a St. Croix Mall PUD agreement with the owners of the St. Croix Mall affecting the location and utilization of certain buildings within the St. Croix Mall PUD; and, • WHEREAS, as a result of the sale in the redevelopment of the St. Croix Mall, it is proposed to move the location of the current Canelakes building from its site on the eastern section of the St. Croix Mall PUD to an alternate site on the western section of the St. Croix Mall PUD, located to the west of the K- Mart and to the south of the St. Croix Bowl; and, WHEREAS, the City Council has received the comments of the building official and the city planner affecting the move of the Canelakes building and has received no adverse public comment thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights, that the City herewith consents to • an amendment of the St. Croix Mall PUD, in conjunction with the owner and developer, to allow the move of the Canelakes J • restaurant building from its present location to a location to be specifically approved by the building official for the City of Oak Park Heights, which will be located to the west of the K -Mart building and to the south of the St. Croix Bowl. Sommerfel, Mayor Attest: r --'�Lonne Wi son, Administrator /Treasurer • r •- r RESOLUTION 89-10-62 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA RESOLUTION DIRECTING THE OAK PARR HEIGHTS HOUSING AND REDEVELOPMENT AU'T'HORITY TO IMPLEMENT A COMPREHENSIVE STUDY ON CURRENT AND PROJECTED POPULATION /HOUSING NEEDS AND DEMANDS; CURRENT AND PROJECTED LOW AND MODERATE INCOME POPULATION HOUSING NEEDS AND DEMANDS; SENIOR AND ELDERLY CURRENT AND PROJECTED HOUSING NEEDS AND DEMANDS; AND FURTHER TO STUDY ALL AVAILABLE CITY, COUNTY, STATE AND FEDERAL GOVERNMENT PROGRAMS AND GRANTS AVAILABLE THAT MAY IMPACT THE PROVISION OF HOUSING THROUGH ALL ELEMENTS OF THE POPULATION BASE REGARDLESS OF THEIR SOCIOECONOMIC STATUS WHEREAS, the City Council for the City of Oak Park Heights, has provided subsidized housing to low and moderate income individuals, senior citizens, and elderly population • elements within the community through the sponsorship and construction of the Raymie Johnson Estates, Raymie Johnson Townhomes, Oakridge Apartments and other developments; and, WHEREAS, the City of Oak Park Heights has determined that there is a need to study the current and projected Population demands of the City of Oak Park Heights as it affects housing for all aspects of the population despite their socioeconomic status; and, WHEREAS, a reasoned, well planned housing program implemented on a City -wide basis is envisioned to have the greatest impact on all citizens and on beneficial municipal • planning within the City of Oak Park Heights; and, • WHEREAS, the City of Oak Park Heights wishes to implement meaningful and comprehensive assistance programs in the provision of housing to all aspects of the population so as to better provide for municipal planning and the needs of all aspects and socioeconomic groups within the populations that now exist within the City of Oak Park Heights and those which are to be anticipated to be established within the City of Oak Park Heights. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights, as follows: 1. That the Oak Park Heights Housing and Redevelopment • Authority is herewith directed to implement a comprehensive study to determine the current and projected population housing needs within the City of Oak Park Heights presently and for the next projected 10 -year period. 2. Within the study to be conducted by the Housing and Redevelopment Authority, focus shall be made on all socioeconomic groups that form the population of the City of Oak Park Heights both presently and as will be projected to exist within the next 10 years. 3. That the Housing and Redevelopment Authority is directed to study, research, and discover all current programs • maintained by the state, county, metropolitan government, or city L d r • as may be utilized to impact housing needs within the City of Oak Park Heights. Further, that the Housing and Redevelopment Authority shall study each program to determine its potential impact on the providing of safe, code - compliant, and affordable housing within the City of Oak Park Heights. Further, be it resolved that all programs to be examined by the Oak Park Heights Redevelopment Authority shall be divided into groupings to distinguish the various benefits that are provided. The Housing and Redevelopment Authority shall specifically focus on which programs offer the opportunity for home ownership, as opposed to mere rental of housing within the community. The Housing and Redevelopment Authority shall also • focus on which programs encourage housing renovation and building code compliance; the Housing and Redevelopment Authority shall also focus on which programs involve actual inspections of homes proposed to be used for the senior, the elderly, low and moderate income, and other socioeconomic groups that may be available to utilize such subsidized or program- sponsored housing. 4. The Housing and Redevelopment Authority shall further, with regard to the study to be completed, project and make recommendations as to future housing demands for senior, elderly, low and moderate income, and other disadvantaged socioeconomic groups and, specifically, provide for recommendations as to future developments of residential housing • • within the City of Oak Park Heights to address the needs of those individuals and groups. 5. The Housing and Redevelopment Authority is specifically authorized to engage and enlist the services of city staff as may be necessary or desirable to implement the study. 6.. The Housing and Redevelopment Authority of the City of Oak Park Heights shall upon conclusion of its study provide recommendations to the City Council as it affects the present and future projected housing needs within the City of Oak Park Heights both for the population in general as well as other socioeconomic groups such as the senior, elderly, and low and moderate income individuals. 7. The Oak Park Heights Housing and Redevelopment Authority shall also forward its recommendations to the City Council prioritizing the available programs maintained on a state, metropolitan, county or city basis that are of assistance in providing for housing needs within the framework of the City's Comprehensive Plan and zoning and subdivision ordinances. 8. The City of Oak Park Heights Housing and Redevelopment Authority shall also examine opportunities within the City Housing and Redevelopment Authority to actively sponsor and implement housing renovation and assistance programs to • affirmatively encourage the removal of substandard housing within If • the City and the provision of safe, code- compliant, efficient and suitable housing for all elements of the population. SommerfeIdt, Mayor L) (- - Vonne Wilson, Admi nistrator /Treasurer • RESOLUTION 89 -10 -61 • CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION APPROVING THE AMENDMENT OF THE CITY ZONING CODE IN CHAPTER 401, SECTION 401.03B.5.f WHEREAS, the City Council for the City of Oak Park Heights has conducted public hearings on the proposed amendment of the City zoning code as it affects Section 401.03B.5.f, as it affects accessory structures; and, WHEREAS, a copy of said ordinance has been on file and of record and open to the public for inspection prior to said hearing; and, • WHEREAS, no adverse public comment was received from the public as it affects the said proposed ordinance; and, WHEREAS, the City has received the recommendation of its city planner dated October 16, 1989, recommending the amendment. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights, that the proposed ordinance be and the same are hereby directed to be executed by the Mayor and the Clerk, with publication thereof to be provided as required by law, and that said amendment, as recommended by the city planner, is in all aspects approved. Backaround 1.01. This Council initiated and referred to its staff and consultants a proposal for an economic development project in the City, providing ssistance to expand and rehabilitate the St. Croix Mall shopping center. 1.02. The proposal, referred to as the St. Croix Mall Tax Increment Project, has been studied and reviewed by the City with the assistance of its consultants, Northwest Associated Consultants: Voto, Tautges, Redpath and Company, Ltd.; and the law office of Eckberg, Lammers, Briggs, Wolff & Vierling. 0 d S� 8 n"-L 468 -Q -100 1.03. The City has, on the basis of such study and • review, prepared an economic development plan for the project area in accordance with Minnesota Statutes, Section 469.001 to 469.047 and has prepared a tax increment financing plan (TIF plan) for the project in accordance with Sections 469.174 to 469.179 of Minnesota Statutes (TIP Act). 1.04. The tax increment financing plan is contained in a document entitled " Tax Increment Financing Plan for St. Croix Mall TIP project, dated August 7, 1909, now on file with the City Clerk - Treasurer. 1.05. The City Council acts as the Planning Commission for the City. Therefore, the City Council finds that St. Croix Mall TIF Plan conforms to and is not in conflict with the general plan for the development or redevelopment of the City as a whole. 1.06. This Council has this date conducted the regular public hearing at which the views of all interested parties were heard. Copies of the TIF Plan have been forwarded to Independent School Districts No. 634 and #916 and Washington County as required by the TIF Act, The City has received no response to the notifications. 1.07. This Council has fully reviewed the contents of the St. Croix Mall Tax Increment Financing Plan. • Section 2. Findinass Tax Increment Plan 2.01. It is hereby found and determined that within the Project Area there exist conditions of economic obsolescence, physical deterioration, and under - utilization and inappropriate uses of land. 2.02. It is further found and determined that within the Project Area there are deficiencies in economic viability. that: 2.03. It is further specifically found and determined a) The land in the Project Area would not be made available for development without the public intervention and financial aid described in the St. Croix Mall TIP Plan. b) The Redevelopment Plan, as previously approved, for the Project Area will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the redevelopment of the Project Area by private enterprise. The findings in this section are made to show the City's intent to use the powers granted by the Housing and Redevelopment Act to establish an economic development project as defined in the TIF Act and the City's intent to exercise the powers granted to it by those Acts to achieve the objectives of the Acts. Section 3. Findinas. Economic Development District 3.01. It is found and determined that it is necessary and desirable to the sound and orderly development and redevelopment of the Project Area and of the City as a whole, and for the protection and preservation of the public health, safety, and general welfare, that the authority of the TIF Act be exercised by the City to provide public financial assistance to the Project. 3.02. It is further found and determined that the TIF District is an economic development district, and that the City Council finds it to be in the public interest because: a) It will result in increased employment in the • municipality, or b) It will result in preservation and enhancement of the tax base of the municipality. 3.03. It is further found and determined, and it is the reasoned opinion of this Council, that the development proposed by the St. Croix Mall TIF Plan and the Project could not reasonably be expected to occur solefy through private investment within the reasonably foreseeable future and that therefore the use of tax increment financing is necessary. 3.04. The St. Croix Mall Tax Increment Financing Plan conforms to the general plan of development of the City as a whole. 3.05. The St. Croix Mall Tax Increment Financing Plan will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the economic development of the TIF District by private enterprise= the carrying out of the Project will substantially assist the City in the establishment of reasonable and defensible assessing policies. NOW, THEREFORE, BE IT RESOLVED by the City Council for • the City of Oak Park Heights, that the Development Agreement in • the manner and form presented by Mary Ippel of Briggs and Morgan, dated September 6, 1989, be and the same is hereby approved; and the Mayor and the Clerk are authorized to execute same on behalf of the City Council for the City of Oak Park Heights as well as the Housing and Redevelopment Authority. Sommerfel Mayor Attest: L Vonne son Administrator /Treasurer L • RESOLUTION NO. 89 -3 -6 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA RESOLUTION DIRECTING CITY ENGINEER TO CONDUCT STREET IMPROVEMENT AND STORM SEWER FEASIBILITY STUDY WHEREAS, the County of Washington has determined that certain reconstruction of 65th Street North, also known as Orleans Street, is in need of repair and rebuilding, and also to install storm sewer improvements along with said improvements, from Osgood Avenue North to Paris Avenue North; and WHEREAS, the cost thereof will be apportioned between the County of Washington, Minnesota Department of Transportation, City of Stillwater and City of Oak Park Heights; and WHEREAS, it appears necessary that a preliminary study be made by the City Engineer of the City of Oak Park Heights to determine the feasibility of said improvement. • NOW, THEREFORE, BE IT RESOLVED that the City neer, Bonestroo, Rosene, Anderlik & Associates y en g proceed with a feasibility study and determine the costs to repair, rebuild and improve the aforesaid street with installation of storm sewer improvements. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that in all applications for Tax Increment Financing projects within the City of Oak Park Heights, the proponent of said application shall be required to deposit with the City a $500.00 non - refundable application fee. The proponent of the application shall also be required to escrow • with the City an amount equal to $2,000.00 to be applied to professional service expenses incurred by the City in having its • planner, auditor, attorney and others review the proposed Tax Increment Financing project. Sommerfeldt /Mayor Attest: LaVonne Wilson Administrator /Treasurer • i RESOLUTION 839 -3 -4 CITY OF OAK PARK' HEIGHTS HOUSING AND REDEVELOPMENT AUTHORITY WASHINGTON COUNTY, TRINNESOTA A RESOLUTION REAFFIRMING THE NEED FOR HOUSING AND REDEVELOPMENT AUTHORITY WITHIN THE CITY OF OAK PARR HEIGHTS AND AMENDING THE CITY OF OAK PARR HEIGHTS REDEVELOP14ENT PLAN WHEREAS, pursuant to motion duly adopted by the City Council of the City of Oak Park Heights at its regular meeting on March 13, 1989, a public hearing was held before the Housing and Redevelopment Authority for the City of Oak Park Heights at the Oak Park Heights Municipal Building within the City of Oak Park Heights, Washington County, Minnesota to reaffirm the need for a housing and redevelopment authority within the City of Oak Park Heights and to review and adopt a Redevelopment Plan prepared and dated March, 1989; and WHEREAS, public comment was duly received at the public hearing on the proposed Redevelopment Plan and relating to the continuing need for a Housing and Redevelopment Authority within the City of Oak Park Heights all being in favor thereof; and WHEREAS, the Redevelopment Plan has been prepared by city staff consisting of the offices of the City Planner, City Attorney, City Auditor, and Bond Consultant, being presented in a formal Redevelopment Plan dated Parch, 1989 copies of which are on file with the office of the City Clerk and are available to public inspection. • RESOLUTION 89 -2 - 3 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESO'T'A A RESOLUTION ESTABLISHING THAT THE POSITION HELD BY DE!SMOND PEPIN WITHIN THE OFFICE OF THE POLICE DEPARTMENT OF THE CITY OF OAK PARK HEIGHTS SHALL BE AS A PART —TIME POLICE OFFICER WHEREAS, the City Council for the City of Oak Park Heights has received a recommendation from the Chief of Police and acting in accordance thereof has hired Desmond L. Pepin as a part -time police officer within the City of Oak Park Heights Police Department; and WHEREAS, the City has received notice from the Public Employees Retirement Association, PERA. Unit No. 6674 -00, • affecting Desmond L. Pepin, No. 064728, confirming that Desmond L. Pepin has been reported as a member of the Public Employees Retirement Association Police and Fire Fund; and WHEREAS, that department has requested that the City of Oak Park Heights pass a resolution declaring that the position held by Desmond L. Pepin is that of a police officer pursuant to which said employee will then become a member of the Police and Fire Fund. NOW, THEREFORE, BE IT RESOLVED by the City of Oak Park Heights that the position held by Desmond L. Pepin within the Police Department of the City of Oak Park Heights is herewith declared to be a position of police officer pursuant to which Desmond L. Pepin shall be a member of the Police and Fire Fund as • maintained and managed by the Public Employees Retirement Association thereby allowing Desmond L. Pepin, as a part -time • police officer, to pay deductions into the special fund, i.e., Police and Fire Fund, as maintained by the Public Employees Retirement Association. BE IT FURTHER RESOLVED that the declarations contained within this resolution shall be effective from the date that employment commenced for Desmond L. CITY OF OAR PARK HEIGHTS By Frank 0. omm feldt, Mayor Attest: LA Vonne ii City Clerk /Administrator • • RESOLUTION 89 -1 -1 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING OFFICE PERSONNEL HOURS WHEREAS, the City Council for the City of Oak Park Heights has reviewed the establishment of appropriate business hours for offices to be opened within the City of Oak Park Heights and be available for public access; and, WHEREAS, it appears that office hours to be established from 8:00 a.m. to 4:30 p.m. every day, Monday through Friday, will appropriately meet the needs of the public in getting access to City .records and having access to City personnel; • and, WHEREAS, the City personnel have also requested that they be allowed to take compensation time, in lieu of overtime, for attending Council meetings. NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Oak Park Heights that the official office hours for the City of Oak Park Heights' offices and personnel shall be from 8:00 a.m. to 4:30 p.m., Monday through Friday. That, additionally, employees who wish to elect compensatory time may take same at the overtime rate for attending evening meetings with the City Council that they may be required to attend as a part of their job. That, in lieu of taking compensatory time, is the employee may take pay at time and one -half if they so choose. • In either event, the decision of taking compensatory time or time and one -half pay shall be solely that of the employee.
