Thursday, December 13, 2001 DRAFT
Call To Order: Chair Vogt called the meeting to order at 7:00 p.m. Present:
Commissioners Dwyer, Hedlund, Powell and Runk; City Planner Richards and Council
Liaison McComber. Absent: Community Development Director Danielson.
Approval of Agenda: Commissioner Runk, seconded by Commissioner Dwyer, moved to
approve the Agenda with 24 -Hour Gas Station Operation added as item A. to Old
Business. Carried 5 -0.
Approval of November 8, 2001 Minutes: Commissioner Hedlund, seconded by
Commissioner Dwyer, moved to approve the minutes as amended. Carried 5 -00
Visitors: None.
Public Hearings:
A. Continued - Stillwater Ford,: To consider request for Conditional Use Permit
Amendment and Variance for lighting setback and fixture height requirements.
City Planner Richards provided a review the of the applicants request for a cond,ixiQnal
use permit amendment and variance and reviewed his report regarding the same. He
also noted a correspondence received from a resident of Autumn Hills neighborhood,
expressing opposition in making exceptions to the lighting standards established by
the City.
Chair Vogt opened the hearing for public comment.
The applicant was present and addressed issues noted in the planner's report and
responded to questions from the Commission.
Discussion ensued as to matters related to the request and concerns of voiced
regarding the same.
Commissioner Hedlund, seconded by Commissioner Powell, moved to close the public
hearing. Carried 5 -0.
Commissioner Runk, seconded by Commissioner Powell, moved to recommend that the
City Council approve the applicants request for Amended Conditional Use Permit and
lighting variance, subject to the following conditions:
1. All freestanding light fixtures shall be replaced with fixtures and light sources
that do not exceed a total height of 25 feet.
2. The five floodlights shall be removed. No additional flood lighting of the building
• facade or sales lot shall be allowed.

3. The lighting plan shall be revised to reflect a light intensity in compliance with
the Zoning Ordinance requirements. All fixtures shall be installed such that the
light intensity is compliant with the Zoning Ordinance requirements. The
applicant shall provide proof of compliance once all of the lighting fixtures are
installed on site.
4. The Planning Commission recommended and the City Council approve a
variance and amended CUP to allow the eight freestanding fixtures to remain at
less than the 10 -foot setback requirement.
5. Any other conditions of the Planning Commission, City Council and City staff.
Carried 5 -0.
B. Oapidan / Oak Park Ponds: To consider request for Signage Variance.
City Planner Richards provided a review the of the applicants request for a sign
variance and reviewed his report regarding the same.
Chair Vogt opened the hearing for public comment.
The applicant was present and expressed tenants concern for visibility of their
business signage. He stated that he felt the Pony Express Auto Wash signage
obstructs the visibility of the signage at Oak Park Ponds and is seeking to do whatever
possible to increase their visibility.
Commissioner Runk, seconded by Commissioner Dwyer, moved to close the public
hearing. Carried 5 -0.
Discussion ensued as to ordinance requirements regarding signage in the front and/or
rear of buildings, visibility of business signage in Oak Park Heights and neighboring
communities, site -line issues, lighting and related issues.
Commissioner Runk moved to recommend variance approval, subject to conditions of
Planner's report. Motion died for lack of a second.
Continued discussion ensued as to larger signs being requested for rear of building in
comparison to those of business front signage, pre - maturity of allowing deviance from
ordinance requirements without thorough review of the ordinance itself, amounts of
signage technically feasible to other business if approved, and potential size limitations
for rear building signage.

Commissioner Runk, seconded by Commissioner Dwyer, moved to approve variance
request, subject to the following conditions:
1. The pylon sign shall be allowed to be increased in size to a maximum of 310.
square feet and contain individual tenant identification.
2. The pylon sign must remain a *maxim,um of 30 feet in heights.
3. A 150 square foot Rainbow sign be allowed on the northeast corner of the
Rainbow Foods building.
4. One added wall sign not to exceed 65 square feet shall be allowed for each
tenant space on the building which backs up to 58th Street.
5. The wall light fixtures on the north side of the Rainbow Foods building shall be
retrofitted to be compliant with Zoning Ordinance lighting requirements.
6. All other conditions of the Planning Commission, City Council and City staff.
Carried 4 -1, Commissioner Hedlund opposed.
C. Montanari Homes: To consider requests for Site Plan Review and. Planned Unit
Development: Concept Plan for 9 -unit office complex at 13481 60th St. N.
City Planner Richards reviewed applicant's requested and provided an overview of his
report regarding the same, noting issues of concern and his recommendation that the
Commission comment on the site plan and issued but hold any consideration of the
request until additional information is received from the applicant.
Chair Vogt opened the hearing for public comment.
Bart Montanari- Montanari Homes addressed issues presented within the planning
report and addressed questions from the Commission and p rovided information to
them for their use.
Doug Peterson - Eagles 94 Club, stated that he was in attendance to learn what was
taking place and expressed that the Eagles 94 Club was open to working with Mr.
Montanari twoard finding a mutually workable resolution.
Commissioner Dwyer, seconded by Commissioner Runk, moved to continue this matter
to January 10, 2001 to allow applicant to work through issues. Carried 5 -0.

A. Commissioner Resignation:
Chair Vogt read and presented Resolution of Recognition to Chuck Hedlund and thanked him for
he contribution to the Commission.
B. Commission Vacancy: Schedule Interview Time and Date
Commissioner Runk, seconded by Chair Vogt, moved to recommend that the City
Council approve January 3, 2002 - 6:00 p.m. as the date and time for interview of
Planning Commission applicants. Carried 5 -0
Old Business:
A. 24 -Hour Gas Station Operation:
Commissioner Runk noted that the gasoline pumps at Superamerica on 60th Street
appear to be 24 hour operational and suggested that the Commission should take a
look at the whether or not 24 hours gasoline service, without attendants, is permitted.
Brief discussion on the matter was held, wherein it was noted that staff should bring
this to the City Council if they deemed. it to be appropriate.

A. 2002 Parks & Planning Meeting / Representation Schedule:
The Commission acknowledged receipt of schedule and made not changes to the same.

BACKGROUND
Mike Lawrence of Si representin the owner, OPH Investment LLD, has
made application for a si variance to add one reader board si on the south wall of
the Arb restaurant at 5990 Neal Avenue. The proposed si is a four foot b ei
foot reader board si with up to four text lines. The Cit g ranted a conditional use
permit in 1998 to allow for the Arb restaurant and drive-throu At that time, a si
variance was also g ranted to allow for two wall si on the front buildin facade. In
that the propert is a corner lot, the ordinance allowed a maximum of two wall si not
to exceed a total of 150 s feet.
The Arb restaurant is located in the B-2, General Business District which allows drive
in and convenience food establishments throu the issuance of a conditional use
permit.

ISSUES ANALYSIS

Proposed Sign. The proposed sign is a lighted changeable message board of 32
square feet that will be placed on the south facade of the building. Currently, the
building does not have a sign on that facade. The message board will be visible from
Neal Avenue and Highway 5.
The building currently has 106 square feet of signage with the three wall signs, if the
reader board sign is allowed, the total wall signage will be 138 square feet, which is less
than the 150 foot maximum sign allowance of the ordinance.
Variance Criteria. Section 401.15.G.11 of the Zoning Ordinance specifies criteria for
the granting of sign variances. The criteria and analysis for the Arby's request is as
follows:
1. That particular physical surroundings, shape or topographical conditions of the
specific parcel of land involved exist.
2. That the condition involved is unique to the particular parcel of land involved.
3. That the purpose of the variation is not based exclusively upon a desire to
increase the value of income potential of the business involved.
4. That the alleged difficulty or hardship is caused by this Ordinance and has not
been created by any persons presently having an interest in the parcel.
5. That the granting of the variation will not be detrimental to the public welfare of
injurious to other land or improvements in the neighborhood.
6. That the proposed variation will not impair an adequate supply of light and air to
adjacent property, or substantially increase the congestion of the public streets or
interfere with the function of the police and fire departments of the City.

The applicants have indicated that with the increasing number of buildings in the area,
the visibility of their restaurant has been decreased. The building does not have a sign
on the south facade and the visibility of the pylon sign is not favorable from the south.
Staff finds that the additional reader board signage is justifiable. Other restaurants in
the area have been allowed additional wall signage for identification and reader boards.
The overall amount of wall signage, even with the proposed wall sign, will be less than
the 150 square feet allowed in total wall signage for this property.
The City will begin its work on revising the sign requirements in January. At that time,
the committee will likely discuss more flexibility in numbers of wall signs under a
maximum square feet of sign area.
RECOMMENDATIONS AND CONCLUSION
City staff recommends that a variance be granted to allow for a reader board to be
installed on the south elevation of the Arby's restaurant at 5990 Neal Avenue. Approval
of the request is conditioned on the following:
1. One illuminated reader board sign, not to exceed 32 square feet, shall be allowed
on the south elevation of the Arby's building.
2. Any other conditions of the Planning Commission, City Council, and City staff.

BACKGROUND
Denn Hecker, representin Jacob Holdin of 60th Street LLC, has made application for
a si variance to allow for four si on the front facade of the Routson Motor
automobile dealership at 14702 North 60th Street. *The si will be individuall placed
on the racewa above the window/door area of the front facade. The text of the si
include "Denn Hecker's", "Cadillac", "Pontiac", and "GMC". Total s foota of the
four si is 148.7 s feet. The Zonin Ordinance. allows one wall si not to
exceed 150 s feet in this district.
The car dealership is located in the B-2, General Business District which allows outdoor
vehicle sales areas as a conditional use.

ISSUES ANALYSIS
Existin Site Si The existin si locations are shown on the site plan,
attached as Exhibit 1, and in the pictures attached as Exhibit 4. The size and hei of
each of these si are as follows:

on site have been grandfathered and will remain. Sign 4 is also an existing

conformity in that it is a projecting sign that is not allowed in the Zoning rdinance. This

sign will also be allowed to remain through its useful life or until it is replaced.
Proposed Signage. The wall signage has been removed from the front facade of the
dealership and replaced with a temporary banner until the City makes a determination
on the sign request. The four signs will be placed on a raceway painted to match the
gray color of the building. The total square footage of the four signs is proposed at

148.7 square feet. The Zoning Ordinance allows one wall sign of 150 square feet. The
signs are designed such that the letters will be back lit with light appearing on fi g Y as a
" halo effect outlining the letter or logos. The raceway and background of the letters will
not be lit. In that each of the names or logos are individual signs, a variance will be
re- quire to -allow four. -i n stead -of one -sign .

The applicant has indicated that the previous Routson Motors sign was significantly
larger than what is proposed with the four signs. Additionally, General Motors requires
brand identification not only on the freestanding signs but also the building. The design
of the signs will result in a limited amount of back lighting and accentuate only the text
and logos as opposed to an entire lit raceway sign.
Staff finds that the request for four individual signs is justifiable. The dealership is
required to display all of its vehicle brands. This type of signage with four separate
label /logos and limited back light is appropriate for a business with multiple product
lines.
The City will begin its work on the sign requirements in January. At that time, the
committee will likely discuss more flexibility in numbers of wall signs under a maximum
square feet of sign area.
RECOMMENDATIONS AND CONCLUSIONS
City staff recommends that a variance be granted to allow for four wall signs not to
exceed 150 square feet in total size to be installed on the south facade of the Routson
Motors automobile dealership at 14702 North 60 Street.
Approval of the request is conditioned on the following: _
1. Four illuminated signs, not to exceed 150 square feet shall be allowed on the
south elevation of the Routson Motors dealership.
2. The four signs shall provide outlined back lighting of the letters and logos. The
entire raceway or sign cabinets shall not be back lit.
3. Any other conditions of the Planning Commission, City Council and City staff.

Re: Sign Ordinance Subcommittee Meeting Schedule
The Sign Ordinance Subcommittee Membership has recently been finalized and now
that January has arrived, the City Council's authorization to proceed with the review is
now in effect. A list of the committee members is enclosed with this schedule.
Through the course of three meetings, the group will evaluate the current sign
ordinance and compare it with those of other cities. Signs for businesses both large
and small will be discussed with the goal to balance their signage needs with the
City's goals for our business areas. A recommendation to amend the Sign Ordinance
will then be proposed to the Planning Commission and the City Council.
The subcommittee will meet at City Hall on the following dates:
Wednesday, January 23 3:00 PM —4:00 PM
Wednesday, February 6th 3:00 PM — 4:00 PM
Wednesday, February 20 3:00 PM — 4:00 PM
Please do not hesitate to call me with any questions you may have or with topics for
discussion at these meetings. Additional meetings will be scheduled as the need
arises.
