The outlot contains a City before Mr. Gehrman purchase stormwater pond and sanitary sewer lift station and does not have enough room on which to build aand has applied to the Cityhouse. Mr. Gehrman would like to place a personal garden on the outlot to hook up to the City water line located in 53rd Street . because it would involve I have denied Mr. Gehrman' s request digging up a section of 53rd Streetei10ordarstolhook iitoiCityod water. 53rd Street is approximately shape. Under current conditions it wouldprobably not be of quality reconstructed for at least 15 years . Regardlessthe after of the patch work that is done, a street is never as g it is dug up. Mr. Gehrman is appealing my decision, and I have placed him on the Council agenda. There was discussion about how the retreat should be formatted. Mayor Schaaf said that he did not want to do the same format and that the Council could save some money and do the retreat on their own. Councilmember Turnquist stated that he would like to have someone facilitate to assist the Council in staying on task during the retreat . Councilmember Swenson, seconded by Turnquist, moved to table this issue until the next Council meeting. Figure No. 1 illustrates the project location and limits. SUMMARY OF PROPOSED IMPROVEMENTS The proposed improvements consist of the following. 1.) Pavement reconstruction consistent with the policies established by the 1995 reconstruction project consisting of District A which include: • full depth recycling of the existing bituminous pavement(grinding it up to create aggregate base), • installation of concrete curb and gutter, • installation of concrete driveway aprons, and • paving a 3" bituminous mixture surface. 2.) Storm sewer improvements. RECOMMENDED STAGING OF THE WORK • If the improvements are ordered, we recommend that the work be accomplished under one construction contract. The proposed schedule for bidding and execution of the work is outlined in the report. The work is intended to be completed in Fall, 1997. SUMMARY OF COSTS The following table summarizes the estimated costs of the proposed projects. The streets are Panama, Osman,and Paris south of Beach Road. The condition of these streets are such that they require reconstruction. Since Oak Park Heights residents do live on one side of the road it would be appropriate for the city to attempt to arrange the reconstruction of the street and ask the city of Stillwater to fund their half of the roadway either through their general fund or through assessments. The following summarizes the financing implications that will result from implementing these projects. Total Project Cost $1,378,830 Residential Assessment Revenue $392,000 OPH Commercial Assessment Revenue $53,470 Stillwater Revenue $121,210 County Turnback Reimbursement General Fund $812,150 • SPECIAL ISSUES Council will need to consider the information provided in this report and the information that will be obtained from the residents at the neighborhood meetings and public hearing to decide whether to accept the recommendations of this report or to modify the proposed project. In essence, the project as proposed follows previous policy decisions concerning the pavement management program and precedent set from the 1995 reconstruction project. There is, however, one previously established policy that Council should note would not be followed under these proposed improvements. The city's standard street width in new developments is 34 feet from face of curb to face of curb. The previous street capital improvement plan that was adopted by council recommended a minimum street width of 30 feet. However, the existing street width in Area D is only 24 feet wide. In many cases on this project it is not practical to widen the street several feet due to existing trees, landscaping etc. Therefore we recommend most streets in this area to be reconstructed to a width of 28 feet. • 4 • �► • INTRODUCTION PURPOSE This report provides information concerning the proposed Area D Reconstruction Project. PROJECT DESCRIPTION The area to be reconstructed under this project lies north of Highway 36, south of east 65th Street, and east of Panama Avenue as well as a segment of Osman Avenue. The project includes all residential streets in this area. BACKGROUND The first area of the Comprehensive Street Plan was constructed during the 1995 season and included area A. The project described in this report includes area D as shown in figure no. 1. Area D was inspected in the late fall of 1996. The inspection concluded that crack sealing would not benefit this area, and that a sealcoat should be applied to the area if Area D is not reconstructed in the 1997 construction season. This sealcoat would not add life to the existing pavement, but would rather slow the rate of the pavement breaking up. The digging of test holes to determine the soil characteristics was also scheduled for the fall of 1996. The snow and frost prevented test holes from being dug on all streets except Paris Avenue/Beach • Road. Therefore, the exact soil type of all other streets is not known at this time. Prior records of this area indicate the natural soils in this area are silty, and that bedrock exists at varying depths below the surface. These are fairly poor soil conditions to build a roadway on,and the quantities and costs for subgrade correction have been included in this report. The results of the test holes on Paris Avenue/Beach Road show a 6" bituminous pavement and 9" gravel base. There is much value in this amount of bituminous and gravel, and both of these materials would be salvaged and reused on the project which will provide cost savings to the project. The condition of the existing pavements in Area D was last rated in 1987. The rankings are as follows: Maintenance Recommended Pavement Condition Seal Coat 50-100 Overlay 30-60 Reconstruct 0-40 Area A was also ranked in 1987 as well as in 1993. The results showed that the pavement condition indexes dropped from an average of 75 to an average of 50. The lowest rankings dropped below 30, 411/ and with several of these low ranking streets requiring reconstruction, and the rest getting close to that point,the decision was made to reconstruct Area A. Based on these results and the expense of 5 i performing this type of deflection testing,the pavement condition in Area D was not retested. Rather iwe feel confident in predicting that the pavement condition indexes in Area D have deteriorated similarly to Area A. The costs for the 1997 Reconstruction Project are slightly higher than the costs stated previously in the 1993 Comprehensive Plan: 1993 Comprehensive 1997 Reconstruction • Street Plan Feasibility Report Difference Total Project Cost $1,080,000 $1,378,830 $298,830 The increase in the project cost from the 1993 Comprehensive Street Plan is due to the addition of the following: • Storm sewer- the 1993 Comprehensive Street Plan did not include storm sewer costs and stated that these numbers would be evaluated with each individual project. • ParisAvenue/Beach Road-this is a county roadway. At the time the 1993 Comprehensive Street Plan was prepared the fate of this roadway was not certain. However, it is now the intention of the county to negotiate the tumback of this roadway to the city. As a part of this negotiation, an agreement will have to be reached regarding the amount of money the county will reimburse the city for the reconstruction of this street. It is important that Paris Avenue/Beach Road is reconstructed at the same time as the rest of the residential streets in Area D. Most residential streets in this area intersect this roadway, and the reconstruction of these intersections in conjunction with the rest of the streets will allow the new design to correct drainage problems. Also the residential streets can be designed to correctly tie into Paris Avenue/Beach Road which does not have curb and gutter but will have concrete curb and gutter when it is reconstructed. An additional benefit to reconstructing these roadways at the same time is the excess ground up bituminous from Paris Avenue/Beach Road can be used as aggregate base on other residential streets. 7 • • • DESIGN RECOMMENDATIONS The following are the design standards recommended for this project. Street Section: The existing bituminous surface would be reclaimed (ground up) and recycled by using it as an aggregate base. Three inches of new bituminous would then be placed over an average aggregate base depth of 8 inches. This street section is illustrated in Figure No. 3. Street Width: The existing streets in Area D are 24' wide. The city's standard street width is 34', and the streets in Area A were reconstructed to this width. However, several of the streets in Area D have mature trees in close proximity to the street. Widening the street to 34' would require the removal of some of the trees and landscaping. Therefore, it is our recommendation that the majority of the streets be widened only to a width of 28'. This would provide for a minimum of an 8 foot parking lane on both sides of the road and a 12 foot driving lane. Please refer to page 6 of this report for the streets recommended to have widths of 24' or 32'instead of 28'. Curb: All curb will be concrete bather curb (MNDOT B618). Storm Sewer: It is recommended that new storm sewer be installed where it will eliminate existing drainage problems and prolong pavement life by reducing ponding on the pavement surface. Figure 4 shows the proposed storm sewer for Area D. . Driveways: All existing driveways will have concrete aprons installed. EXISTING UTILITIES Sanitary Sewer: The sanitary lines will be televised during the plan and specification phase of this project. The condition of the existing lines will not be known until that report is received. Water main: Leak tests will be performed on the existing system to determine the condition of the existing lines. Storm Sewer: Visual inspections will be done on the existing system to determine if any repairs need to be made. None are anticipated at this time. • 8 • S ASSESSMENTS / REVENUE • The assessment policy as established by the city council for the 1995 Reconstruction Project was based on the following: • Each residential property will be assessed the same amount • This amount is based on the amount to be paid by the average size lot on this project • Commercial properties will be assessed on a front footage basis • The city of Stillwater should pay for half of the cost of the streets that lie half in Stillwater's city limits and half in Oak Park Heights city limits The assessment amounts are as follows: Residential Property in Oak Park Heights $2800/each Commercial Property in Oak Park Heights $33.80/front foot Stillwater Properties $56.50/front foot • There are 140 residential properties in Oak Park Heights to be assessed as part of this project. Based on this information, the expected cost to the city's general fund taking into account storm sewer and inflation is $721,400. There is a $90,750 difference between the expected burden on the city's general fund and what this report proposes. This difference is due to the addition of Paris Avenue/Beach Road reconstruction. Unfinished Business Review of Street Reconstruction Plan - Council reviewed a memo from City Engineer Carol Caron regarding soils in reconstruction Area D. Caron was present and said that there have been no soil borings taken in Area D. Without soil boring information it is difficult to determine the types of soils that would be encountered in the reconstruction of the streets . • • Page 5 - Minutes 10/22/96 Council questioned Caron regarding the utility of seal coating and crack sealing Area D if the streets are not reconstructed. Caron said she thought that should be done if Area D was not reconstructed within the next two years. Caron also stated that there is minimal cracking of the streets so far in reconstruction Area A, which was reconstructed last year. She recommended waiting until next year to look at crack sealing Area A along with any other crack sealing that might be necessary in the City. Proposed Educational Reimbursement Policy - Council reviewed an Educational Expenses Reimbursement Policy drafted by Administrator Robertson. Councilmember Robert requested that the statement "the education must be job related" be added as a condition for tuition reimbursement . Public Hearings: Continuation of Proposed Rezoning & Conditional Use Permit - Arbys/Sbarro - Mayor O'Neal re-opened the Public Hearing at 7 : 36 p.m. City Planner Richards reviewed a memo summarizing issues that were discussed at the October 8, 1996 City Council meeting along with revised conditions of approval . Richards recommended the approval of the proposed rezoning of the property from 0, Open Space to B-2, General Business, and approval of the proposed Conditional Use Permit (CUP) with the conditions based on information contained in the September 26, 1996 and October 14, 1996 memos . City Attorney Vierling reviewed concerns related to stormwater ponding and utility connections in a letter to the City dated October 16, 1996 . Vierling recommended that the City Council not approve the rezoning and CUP until the issues were resolved. . • Enclosure 4 MEMO Date : October 16, 1996 To: Mayor & Council From: Mike Robertson, City Administrator Re: Street Reconstruction, Area D I have enclosed (Enclosure 4B) a memo from Carol Caron giving an overview of the soil conditions in the Area D neighborhood. I spoke with Don Theissen of Washington County Public Works to find out their intentions regarding the County Roads located in the Area D neighborhood. He said he thought those roads were in good shape and that it would be the County' s intent to turn them back to the City without any improvements over their present condition. I noted in the minutes of the October 8 City Council meeting that Council wished me to contact residents of Area D about the possible reconstruction of their streets. When I spoke to various staff members who were at the meeting each of them had slightly different thoughts as to what the Council wanted to me to say to the area residents . Consequently I did not write any letter to Area D residents . I would suggest that we not contact residents until we have more information to give them. It has been my experience that the first two questions people would ask if they were told the City was considering reconstructing their roads would be "What will it cost me?" and "When will it be done?". Right now we can' t answer either of those questions . I suggest that before we move ahead that the City Engineer be directed to provide a more firm cost estimate for street reconstruction of Area D which would include storm sewer costs and that the City Engineer also make a recommendation regarding the amount property owners would be assessed for reconstruction. The comprehensive street plan that was written in 1993 gave general information about all designated street rehabilitation areas. However,the only soils information given was for Area A since it was the first area scheduled to be reconstructed. This information came from actual soil borings that were taken in Area A just prior to the writing of the report. No soil borings have been taken in Area D. Without this information it is difficult to determine the types of soils that would be encountered in the reconstruction of the streets. Soil borings for Arca D were done in 1967 just prior to the sewer and water main installation project in that area. They show that the top few feet of material consist of a fine plastic type material. This material is typically not suitable for building streets on and would possibly need a sand subgrade installed below the gravel base. The soil borings also indicate that a better quality sandy material exists below this top few feet of poor material. These two types of material would have been mixed to some extent as the trenches were excavated during the 1967 water and sewer project. Depending on the extent of the mixing, the resulting top few feet of poor material could have been improved,possibly significantly. We are fairly confident,however,that the areas in the existing streets not disturbed by the sewer and water trenches as well as the boulevard areas which will be affected should the decision be made to widen any of the roads, will have poor subgrade soils that need to be addressed. • • Page 4 - Minutes 10/8/96 Review of Grants Status - Council reviewed a memo from Administrator Robertson regarding Chamber grants . Public Hearings: Proposed Conditional Use Permit - Arbys/Sbarro - Mayor O'Neal opened the Public Hearing at 7 :35 p.m. Cary Teague of the City Planner' s office reviewed the staff report regarding the proposed Conditional Use Permit and Rezoning for Arbys/Sbarro. Conditions that were discussed at length were landscaping and the overall development of the area. Jim McGovern, representative for landowner Bob Brackey, stated that he understood that the area development plan submitted should be considered a conceptual plan and was not considered to be a final plat . City Planner Richards stated that his office was in agreement that the plat was only a conceptual plan and not a final plat . I have also spoken to MNDOT Engineer Jeff Gibbons regarding MNDOT' s estimated road reconstruction schedule for Area D. Gibbons said that all of the streets in the Area D section that MNDOT intends to reconstruct will be done in 1999 . He said that the frontage road will probably be done first, and there is no specific schedule yet for the order in which the other streets will be done. Gibbons stressed that the official signed detour for the Beach Road overpass will be 5th Street in Bayport to Osgood Avenue. Caron stated that the next area scheduled for reconstruction is Area D, the residential area north of Highway 36 consisting of 2 . 27 miles of streets . She noted that many of the streets do not meet the city' s minimal width standards and should be widened where practical . Most roads in the area average 28 years old. Caron also noted that these roads were last seal coated seven years ago and that if they are not reconstructed they should be seal coated in the next two years. Councilmember Robert stated that she lives in Area D, and is concerned that the neighborhood have too much construction activity due to bridge and highway related construction. She is in favor waiting to reconstruct the roads until further information is available regarding how the bridge reconstruction will affect the area. This work is being undertaken in conformance with the Comprehensive Street Plan which was prepared and adopted in 1993. In accordance with that plan,the City should consider undertaking the second phase of this reconstruction activity in the near future. The City's Comprehensive Street Plan divided all of the older streets within the city into 5 areas labeled A through E as shown on Figure 1. The 3.18 miles of streets within Area A did not have concrete curb and gutter and at 26 years old were the most deteriorated of any of the areas. These streets were reconstructed under the 1995 reconstruct project that was originally planned for the 1994 construction season. The next area scheduled for reconstruction is Area D, a residential area north of Highway 36 consisting of 2.27 miles of streets. The streets in this area are now 28 years old and also do not have concrete curb and gutter. In addition,many of these streets in this area do not meet the city's minimal width standards and should be widened where practical. The last seal coat application in this area took place 7 years ago in 1989. Typical seal coat application takes place every 4-8 years. Therefore,this would be the appropriate time to analyze which street rehabilitation method would best suit the needs of this area. In the first Street Capital Improvement report written by Bonestroo & Associates in 1987, it was recommended that the City's street reconstruction program be implemented in a phased manner over a fifteen year period. With 5 areas to be reconstructed, one reconstruct project every 3 years would complete the reconstruction program in the recommended fifteen year period. Following this schedule, the first project was slated for 1994, and the second project would be slated for construction in 1997. In order to progress through the various stages of a complex project such as the reconstruction of streets in Area D,proper time must be allowed to involve city council and staff as well as residents in the decision making process. These stages would include holding informational meetings, preparing a feasibility report, scheduling a public hearing,and addressing design issues. It is wise to bid a project such as this one very early in the spring in order to take advantage of lower bids by contractors at this time of year and to allow adequate time during the construction season for clean-up and restoration. In order to bid the project in March or April, the process detailed above should begin very shortly. Should the City Council decide to proceed with the next phase of the Comprehensive Street Plan and consider the reconstruction of Area D streets to take place in 1997;it is our recommendation that the Council order the feasibility report be prepared. Whichever reconstruction method is deemed appropriate,we are confident that the project can be carried out during the 1997 construction season without interruption by MNDOT's Highway 36 project and without placing the newly rehabilitated streets in jeopardy of experiencing heavy traffic loads due to detoured Highway 36 traffic.
