HomeMy WebLinkAbout1988 Resolutions RESOLUTION 88 -12 -33 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING A PARR AND RECREATION DEVELOPMENT FUND WHEREAS, the City of Oak Park Heights has determined that it is in the best interests of city planning to develop its parks and recreational areas to establish a city park and recreational development fund; and WHEREAS, the City Council of the City of Oak Park Heights has received the input and advice of the City Auditor with regard to the establishment of such a fund; and WHEREAS, the City Administrator /Treasurer shall maintain said fund pursuant to the directive and instruction of the City . Auditor to receive funds to be dedicated to the use of the city's parks and recreational area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota that there shall be, and is hereby established, a city, park and recreation development fund which shall be maintained in the Office of the City Administrator and supervised by the City Auditor from time to time. That the City Administrator /Treasurer shall report to the City Council from time to time the fund balance, disbursements, additions and expenditures from said fund in accordance with the established procedures now set forth for the Office of the City Administrator /Treasurer. • • Passed by the City Council of the City of Oak Park Heights this 12th day of December, 1988. j l � o � 0. Sommerfelt, ayor Attest• c� onne W 1 Z n, Administrator /Treasurer • 2 - • RESOLUTION 88 -11 -32 CITY OF OAR PARR HEIGH'T'S WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING A $7.00 CHARGE PER ACRE FOR CONTOUR MAPS WHEREAS, the Office of the City Clerk- Administrator maintains contour maps for the City of Oak Park Heights affecting all properties within said city; and WHEREAS, from time to time the City Clerk- Administrator is requested to provide copies of such contour maps; and WHEREAS, the city has incurred significant expense in the acquisition of contour maps for the City of Oak Park Heights; • and WHEREAS, the City Council has received the recommendation from the City Clerk- .Administrator affecting the cost of reproduction of such contour maps, staff time, and other administrative expense related thereto. JAMES BEYER WHEREAS, Mr. James Beyer has applied to the City of Oak Park Heights for a home occupations license pursuant to the ordinances of the City of Oak Park Heights; and WHEREAS, the City Council at public hearing on November 28, 1988 conducted a public hearing as required pursuant to said ordinance requesting public comment from neighboring adjoining property owners and other interested individuals in and too such application; and WHEREAS, the City Council received the comment from the public affecting such application; and WHEREAS, the City Council has also received staff review and reports affecting such application. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota that the home occupations license as applied for by Mr. James Beyer be and the same is hereby granted. WHEREAS, the City Council for the City of Oak Park Heights has reviewed recommendation from the City Planner to amend the sign ordinance affecting awnings with the proposed amendment being as follows: Awnings that convey a message via alphabetic, numeric or symbolic character shall be included in calculating the overall signage of the property. The outline of such character shall be used to determine the area of the awning signage. All awnings are subject to the provisions of Section 401.03.I.2.B.4. and, WHEREAS, the City Council for the City of Oak Park Heights determines such modification and amendment to the zoning ordinance to be consistent with the purposes and intents of the zoning ordinance affecting signage providing it consistent plan for dealing with signage throughout the business community of the City of Oak Park Heights. WHEREAS, Heritage Development, Inc. has filed application with the City of Oak Park Heights requesting subdivision and variance approval affecting their real property located within the City of Oak Park Heights, Washington County, Minnesota; and WHEREAS, public hearing was duly held as required by law on October 24, 1988 and the city received no adverse public comment therefrom; and • WHEREAS, the City Staff, Engineering and Planning has reviewed such applications and have made recommendations to the city; and WHEREAS, the City Council for the City of Oak Park Heights determines it to be appropriate to grant preliminary plat subdivision and variance request. SommerfeAdt, Mayor �aon `ne Wilson, Administrator /Treasurer L RESOLUTION 88 -10 -24 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINUESOTA A RESOLUTION APPROVING JURAN & MOODY AS A CITY FUND DEPOSITORY WHEREAS, the City Council of the City of Oak Park Heights has received correspondence from the City Bond Consultants, Juran & Moody, requesting consideration that they be considered as a city fund depository with Juran & Moody now being authorized by law to be a bonded and secured fund depository for municipal corporations; and WHEREAS, the statute requires the city adopt resolutions nominating all city fund depositories prior to deposits being made therewith; and WHEREAS, Juran & Moody will provide proper security to the City of Oak Park Heights as collateral for all deposits to be located therein. RESOLUTION) 88 -10 -23 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ADOPTING AN AMENDMENT TO CHAPTER 401 OF THE CODE OF ORDINANCES OF THE CITY OF OAK PARK HEIGHTS TO CREATE A PLANNED UNIT DEVELOPMENT DISTRICT WHEREAS, the City Council of the City of Oak Park Heights has received a report and recommendation from the City Planner as it affects the creation of a planned unit development district and modifications of the city zoning ordinance to accomplish same; and WHEREAS, the city has duly conducted a public hearing after publication of notice with said public hearing being conducted on October 11, 1988 at which time no adverse comments were received from the public affecting the creation of such a district; and WHEREAS, the City Council feels it is in the best interest of its citizens to amend the zoning code so as to create a planned unit development district pursuant to the recommendation of the City Planner on file and of record in the City of Oak Park Heights. Sommer , Mayor Attest: Ta onne Wilson, Administrator /Treasurer i 2 _ • RESOLUTION 88 -9 -22 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINN A RESOLUTION APPROVING THE 1989 CONTRACT WITH MIDWEST ANIMAL SERVICES WHEREAS, the City Council for the City of Oak Park Heights has received a proposed contract from Midwest Animal Services for calendar year 1989; and WHEREAS, said contract has been reviewed by city staff and the council has received the recommendations thereof; and WHEREAS, said contract appears to be in conformance with the existing agreements with Midwest ?animal Services, Inc. and conforms to the needs of the city as outlined within the city's animal control ordinances. Passed by the City Council of the City of Oak Park Heights this 26th day of September, 1988. -4AA Attest Frank 0. ommerfeldt, ayor : �J • La onne Wilson, Administrator /Treasurer L 0 0 • RESOLUTION NO. 88 -9 -21 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AMENDING ORDINANCE NO. 202 INCREASING MAYOR AND COUNCIL SALARIES FOR THE CALENDAR YEAR 1989 WHEREAS, the City Council of the City of Oak Park Heights has reviewed existing salary and fee structures within the City of Oak Park Heights inclusive of those relating to Council and Mayorial positions; and, WHEREAS, the City Council of the City of Oak Park Heights has determined that it is appropriate to increase Mayor and Council salaries effective January 1, 1989 to follow the November, 1988 elections; and, WHEREAS, the Mayor and Council have determined that an appropriate raise for both Mayor and Council positions shall be an increase of $25.00 over that which is presently set forth in the City's ordinances. • NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: 1. That Ordinance 202 to be effective January 1, 1989 is herewith amended, which amends Section 202.02 of the Code of Ordinances of the City of Oak Park Heights to increase the 1989 salary of the Mayor of the City of Oak Park Heights to the rate of $250.00 per month, and to increase the salaries of the respective Council members of the City of Oak Park Heights to $200.00 per month. Member O'Neal introduced the following resolution and moved its adoption: RESOLUTION NO. 88 -9 -20A RESOLUTION OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, FOR STORM SEWER BONDS OF 1982 WHEREAS, the City of Oak Park Heights did previously issue Storm Sewer Bonds of 1982 for Storm Sewer District #1; and WHEREAS, the sum of $29,508.00 to cover the bond payment is necessary to be levied against the land located in said Storm Sewer District #1, collectible with the real estate taxes in the year 1989. • -U. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota, as follows: That the sum of $29,508.00 be and hereby is levied against Storm Sewer District #1 within the City of Oak Park Heights, County of Washington, State of tinnesota, to be collected with the real estate taxes payable in the year 1989. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota that the following sums of money be levied for the current year collectible in calendar year 1989 upon taxable properties within the City of Oak Park Heights for the amounts and in the manner annexed hereto within the proposed 1989 city budget, a copy of which is annexed hereto and incorporated by reference herein. Such proposed assessment, a copy of which is attached hereto and made a part hereof is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein is hereby found to be benefited by the proposed improvement. 2. Such assessments shall be as follows: a. The assessments shall be payable in equal annual installments including principal and interest extending over a period of five (5) years, with interest at the rate of eight and one -half percent (8W per annum, in the amount annually required to pay the principal over such period at such rate, the first of said installments to be payable with general taxes for the year 1988, collectible with such taxes during the year 1989. b. The owner of the property so assessed may at any time prior to the certification of the assessment to the County Auditor, pay to the City Treasurer, and thereafter at any time prior to November 15 of any year pay to the County Auditor, the whole of the principal amount of the assessment on such property provided that no such prepayment shall be accepted • without payment of all installments due to and including December 31 of the year of prepayment, and the original principal amount reduced only by the amounts of principal included in such installments computed on an annual amortization basis. 3. The City Clerk shall forthwith transmit a certified duplicate copy of this assessment to the County Auditor to be extended on the tax list of the County. NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the citizens and residents of the City of Oak Park Heights use every effort to reduce water usage during the present drought. 2. That a lawn sprinkling ban is hereby imposed with the following exceptions, to -wit: a. Sprinkling of lawns for even - numbered residences and businesses is permitted on even - numbered days between 6:00 P.M. and 8:00 A.M. the following day; b. CITY OF OAK PARK HEIGHTS BY Frank 0. ommerfeld , Mayor Attest: �aon,e Wilson City Clerk /Administrator d ♦ ' RESOLUTION #88 -1 -3 CITY OF OAR PARR HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING ADMINISTRATIVE PROCEDURE AND AUTHORIZING THE CITY ADMINISTRATOR TO MARE FUND TRANSFERS FROM VARIOUS ACCOUNTS OF THE CITY OF OAR PARR HEIGHTS FOR PURPOSES OF ADMINISTRATIVE CONVENIENCE WITH THE CONSENT OF THE CITY AUDITOR AND SUMMARY REVIEW AND APPROVAL OF THE CITY COUNCIL The City Council for the City of Oak Park Heights, Washington County, does ordain: WHEREAS, the City Council has determined that there is an administrative convenience to the staff and personnel of the City of Oak Park Heights to allow the City Administrator to transfer fund accounts when those fund balances have dropped below a $500.00 level to other funds as recommended by the City Auditor; and, WHEREAS, the City Council for the City of Oak Park Heights has determined that adequate review of such procedures can be made within a Clerk's report presented to the City Council monthly following such transfers; and, WHEREAS, the City Council for the City of Oak Park Heights is assured that all such fund transfers are for bookkeeping purposes and will be monitored by the City Administrator and City Auditor and presented for ratification at the City Council from time to time; and, WHEREAS, simplification of fund transfer procedures shall be a more effective and efficient way of maintaining bookkeeping and administrative needs of the City of Oak Park Heights. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: 1. That following review and approval of the City Auditor's Office, the City Administrator shall be allowed to transfer fund balances in any City account which drop below a level of $500.00 to such other funds as are established within the City of Oak Park Heights without prior approval of the City Council. 2. That all such fund transfers shall be reported to qb� the Council on a regular basis within the report of the City RESOLUTION 88 -1 -2 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MIILZESOTA A RESOLUTION COMMENDING KEN KAISER FOR HIS YEARS OF OU4'STANDING SERVICE AS A CITY ARBORIST. WHEREAS, Ken Kaiser has served in the capacity of City Arborist for the City of Oak Park Heights preparing plans and making recommendations and supervising the planting of shrubs, trees and other vegetation landscaping within the City of Oak Park Heights; and WHEREAS, Ken Kaiser's work on behalf of the City of Oak Park Heights as the City Arborist has helped to landscape, plan and beautify the city of the planting of trees, shrubs and other • vegetation, all of which will inhere to the benefit of the City of Oak Park Heights and its residents; and WHEREAS, the City of Oak Park Heights is grateful to Ken Kaiser for the many hours of work that he has devoted to his position as City Arborist and for his concern and care in the planning and growth of the City of Oak Park Heights; and WHEREAS, the work performed by Ken Kaiser as City Arborist will inhere to the benefit of the cities residents and generations of future residents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota that Ken Kaiser be, and is, hereby commended for his many years of outstanding service to the citizens and residents of the City of Oak Park Heights as the City Arborist. Attest: Frank O ayor �nne Wilson, Administrator /Treasurer i - 2 - • RESOLUTION 88 -1 -1 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE MAYOR AND THE CLERK TO EXECUTE THE CONTRACT BETWEEN THE CITY OF OAK PARK HEIGHTS AND THE CENTRAL ST. CROIX VALLEY C014MUNITY ACCESS CORPORATION. WHEREAS, the City of Oak Park Heights has been presented a contract to be executed between the city and the Central St. Croix Valley Community Access Corporation, Inc., a non - profit corporation dedicated to the provision of public access over cable television to the community; and WHEREAS, said contract has been reviewed by city staff and recommended for approval; and WHEREAS, the City of Oak Park Heights has received no adverse comment as it affects the contract and its proposed terms and conditions; and WHEREAS, the City Council has determined that execution of the contract between the City of Oak Park Heights and the Central St. Croix Valley Community Access Corporation, Inc. is in the best interests of its residents and serves a public purpose for the benefit of the Middle St. Croix Valley.
