February -- Commissioner Dwyer March - Commissoner Lil, jgren ENCLOSURE 1 CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday, January 16, 2003 Call To Order /Approval of Agenda: Chair Vogt called the meeting to order at 7:00 p.m. Present: Commissioners Dwyer, Liljegren, Powell and Runk; Acting City Administrator Holst, City Planner Richards and Council Liaison McComber. Commissioner Dwyer, seconded by Commissioner Liljegren, moved to approve the Agenda as presented. Carried 5 -0. Approve Minutes: Commissioner Runk, seconded by Commissioner Liljegren, moved to approve the Minutes of November 14, 2002 as amended. Carried 5 -0. Department /Commission Liaison Reports /Other Reports: A. Hwy. 36 Partnership Study: Mary McComber reported that a joint meeting is to be held with the Oak Park Heights and Stillwater City Councils and community at 6:30 p.m., February26, 2003 at Stillwater City Hall. B. Commission Liaison: Nothing to report. C. Other: Nothing to report. Visitors /Public Comment: There were no visitors to the meeting or, public comment other than to items on the Agenda. Public Hearings; A. Nolan Ave. N. Vacation(s): To consider requests of Valley Senior Services Alliance Housing and Community Services, LLC for vacation of a portion of Nolan Ave. N. at Lot 1, Block 4, Boutwells Landing and vacation of drainage and utility easements over Lot 1, Block 5, Boutwells Landing. City Planner Richards provided an overview of the project and reviewed the planning report for the same. Chair Vogt opened the hearing for public comment. There being no visitors to the public hearing, Commissioner Runk, seconded by Commissioner Dwyer, moved to close the public hearing. Carried 5 -0. Discussion ensued as to clarification of what was needed in way of recommendation from Commission, and easement area locations. Commissioner Runk, seconded by Chair Vogt, moved to recommend City Council approval, subject to review and approval of the City Attorney and City Engineer. Carried 5 -0. Planning Commission Minutes January 16, 2003 Page 2 of 3 B. Oakgreen Village: To consider requests of Valley Senior Services Alliance Housing and Community Services, LLC for site plan review, conditional use permit, subdivision, planned unit development: concept plan for office condos, commercial and retail use known as Oakgreen Village to be located at 58` St. N. and Novak Ave. N. City Planner Richards provided an overview of the project and reviewed the planning report regarding the. same. He noted that the project has been developed to coordinate with Kohl's concept plan and that overall staff has been receptive to plans for the area and that it appears to fit within the overall design plans. Richards further noted that staff has asked that the Commission consider holding recommendation on request, due to the need for a variety of information, but that they provide comment on the overall plan and discuss potential roadway locations within the proposed development. Chair Vogt opened the hearing for public comment. Kirk Velett, VSSA Architect - provided an overview of the site plan and its proposed amenities. He discussed roadway issues and address questions of the Commission, including that as to working partnerships with surrounding property owners /developers for blend of sites, traffic flow, potential square footage of units, rental rates, potential uses of commercial dwellings and phasing plan from build start through 2006. Alan Black, VSSA - discussed some of the specific guidelines they have had to work with in preparing the concept and indicated that they have focused on the townhomes in their planning at this point. He expressed that it was critical for them to work through route and comprehensive plan issues that can be lived with, long term, in their relationship to Kohl's planning. It is VSSA's intent to receive a concept plan approval and move forward with their design planning. The idea is to be able to view the project as part of the larger project with Kohl's and the area as a whole. Discussion ensued as to roadways, power lines, townhomes and other related issues to the project and its concept plan proposal. Commissioner Runk, seconded by Commissioner Dwyer, moved to continue the public hearing to February meeting of the Planning Commission. Carried 5 -0. City Planner Richards asked the Commission if there was anything specific the Commission wished from the applicant, to which they responded that they would like further discussion as to 59` St. and how expenses to that area are being covered. t Planning Commission Minutes January 16, 2003 Page 3 of 3 New Business: A. Council Meeting Representation Schedule: Chair Vogt discussed the general process of one commissioner attending a City Council meeting each month and asked for a recommendation on the schedule as prepared by Community Development Secretary Hultman and provided to them. Commissioner Dwyer, seconded by Chair Vogt, moved to adopt the schedule as provided. Carried 5 -0. Old Business: There was no old business for discussion. Informational /Update: A. 2002 Letter of Representation: Chair Vogt .explained what the document was about and stated that the Commission should submit their letter back to Acting City Administrator Judy Hoist as quickly as possible. Hoist provided duplicate copies to Commissioners needing them. B. Andersen Corporation Udpate: City Planner Richards provided an update as to activity by SC Mall, LLC for the former St. Croix Mall Area. They will be holding neighborhood meetings to discuss changes to the area and will be contacting the neighbors directly. City staff continues to work with them on trail connections. Richards suggested that SC Mall LLC might be addressing the Planning Commission in March for additional improvements to their building. C. Renton Homes Update: Nothing for discussion. D. The subject site is zoned and guided CBD Central Business District. The PUD approvals will be applied to the CBD as a conditional use. The revised plans reflect some of the suggestions made by staff in the previous planning report dated January 9, 2003. A review of the changes to the plans follows: Attached for reference: Exhibit 1: Concept Plan Exhibit 2: Preliminary Plat Exhibit 3: Concept Drainage and Utility Plan Exhibit 4: Phasing Plan Exhibit 5: Townhome Images Exhibit 6: Apartment Images Exhibit 7: Project Narrative Exhibit 8: Preliminary Plat Legal Descriptions ISSUES ANALYSIS Subdivision. A preliminary plat has been submitted. The preliminary plat needs to be revised to include lot and block numbers and keep storm water ponds on the same lots as adjacent buildings. Drainage areas should be dedicated with easements with ownership retained by the property owner. City staff recommends that the applicant dedicate 40 feet of right -of -way from the centerline of Oakgreen Avenue North. This is seven feet wider than the existing easement along Oakgreen Avenue North to allow for future improvements. City staff anticipates that the future right -of -way width required for Oakgreen Avenue North adjacent to this project is 80 feet. Proposed Project. The project was developed to coordinate with the proposed Kohl's project to the northwest. The Kohl's project is no longer going forward, and the applicant needs to examine how Novak Avenue North can be constructed without depending on construction on the adjacent property. Alternatively, the applicant could pursue an agreement with the adjacent property owner to allow Novak Avenue North to be constructed as proposed, with part of the street on the adjacent property. Phasing. A phasing plan has been submitted that shows the project developing from 2003 through 2006. The phasing plan shows the area along Oakgreen Avenue North, where single family homes and lots exist, developing last. To avoid potential conflicts with construction noise, access, and other activities between the closely spaced townhomes, staff recommends that the area along Oakgreen Avenue, which is designated "E" on the phasing plan, be developed at the same time as the adjacent area designated "Cl." Depending on how quickly the remaining properties along Oakgreen Avenue can be acquired, development in the area labeled C1 may be delayed. To clarify the phasing plan, streets and ponding areas should be made part of the shaded phasing areas, which should simply be labeled Phase 1, Phase 2, etc. 59 Street North and the two ponds proposed along 59 Street North also need to be included in the phasing plan. Setbacks and Building Spacing. The PUD section of the Zoning Ordinance specifies that buildings should be located at least 20 feet from the back of the curb line of roadways that are part of the internal street pattern. The proposed townhomes are only 35 feet apart from face to face. This is a closer spacing and denser arrangement than is normally allowed. The Fire Marshal has indicated that the close spacing may result in difficulty in maneuvering equipment in parts of the development. Additionally, the Ordinance specifies that no building within the project shall be nearer to another building than one -half the sum of the building heights of the two buildings. Building heights have not yet been provided. Pedestrian Access /Open Areas. The concept plan shows an extensive system of trails that would interconnect with the Boutwells Landing development to the south and future retail development to the north. A playground is proposed near the apartment and townhome development. .It is assumed that this will be privately developed and maintained for the residents of this area. The trail and landscaping shown south of 59 Street should extend all the way to Oakgreen Avenue to allow a connection to the trail that begins east of Oakgreen Avenue. The Parks Commission should review the plans and provide comment regarding open space, park land needs, and sidewalks /trails. 2 c ? • 7 The Parks Commission /City Council should determine if any of the park dedication would be in the form of land, or if only a cash dedication would be required. Parking. Analysis of the project data provided on the concept plan indicates that a sufficient number of parking spaces are provided for each of the uses. The townhomes would have two garage spaces per unit, and the apartments would have one underground. garage space per unit in addition to surface parking. Townhome developments usually provide for additional parking in front of garages. The proposed concept plan does not provide space for parking in front of the garages, but instead provides 82 guest parking spaces in small parking lots. There appears to be a sufficient amount of guest parking. Drainage and Utilities. A revised conceptual drainage and utility plan has been submitted and is subject to review and approval by the City Engineer. Other Documents. Detailed building elevations and floor, lighting, signage, and landscape plans need to be submitted and considered as part of the general plan review. If a concept plan and general plan of development are approved, the applicant will be required to enter into a development contract with the City. RECOMMENDATION / CONCLUSION Based upon the preceding review, it is recommended that the Planning Commission hold on a recommendation related to concept plan approvals for this development. The Planning Commission should comment on the project, and the applicant should work to resolve the following issues and submit revised plans: 1. The preliminary plat needs to be revised to include lot and block numbers and keep storm water ponds on the same lots as adjacent buildings. 2. Forty feet of right -of -way should be dedicated from the centerline of Oakgreen Avenue North to allow space for future improvements. 3. The extension of Novak Avenue North must be redesigned to be completely on the subject property, or the applicant must reach an agreement with the adjacent property owner for the street to be partly on the adjacent property consistent with the submitted plans. 4. The phasing plan must be revised to include all areas of the development including ponds and streets. 5. The phasing plan must put the areas along Oakgreen Avenue labeled C1 and E in the same phase. 3 i 6. The applicant must address concerns regarding the close spacing of buildings and potential difficulty in maneuvering fire equipment. 7. The Parks Commission should make preliminary comments regarding open space, park land needs, and sidewalk/trail locations. 8. The trail and landscaping south of 59 Street should extend all the way to Oakgreen Avenue North. 9. Information related to land market value should be provided to calculate park dedication requirements. 10. The applicant should respond to any comments from the City Engineer regarding drainage and utility plans. 11. The area under consideration is south of Norwich Parkway and Nolan Avenue North. This area is the continuation of development within approximately 40 acres of property that had been envisioned for low, medium and higher density residential development when the Boutwells Landing project was first presented. The project received concept plan approvals at the November 26, 2002 City Council meeting. This project is separate from the eight unit Boutwells development on Nolan Avenue that received final approvals from the City Council in January 2003. The applicants have provided submittal information suitable to City staff to review the McKean Square project. The 1998 Comprehensive Plan designated the subject area p g J for the Boutwells Landing development. The Proposed Land Use Plan Map indicates that most of the 37 acres has been designated as low density residential. A portion of the subject site, where open space and part of the 46 unit brownstone unit is proposed, is designated in the Land Use Plan Map as high density residential. The Comprehensive Plan anticipated the second phase of the Boutwells Landing project, and the land use designations are compliant with the general plan proposal. Zoning. The subject site is currently zoned O, Open Space Conservation. Consistent with the other phases of the Boutwells Landing development, the applicants have proposed a rezoning to PUD. The Planning Commission shall make a recommendation and the City ouncil consider the rezoning y to PUD part of the general plan review. Subdivision. A plat of McKean Square has been presented for consideration as part of the general plan review. The plat designates each of the blocks within the project as outlots. The Subdivision Ordinance requires that areas of development must be platted as lots and blocks. The applicants have agreed to this requirement and will make the revision to the plat. The right -of -way for Nolan Parkway is directly adjacent to the east ro ert line that p p Y adjoins Baytown Township. City staff recommends that the right -of -way for the development be dedicated to the City. The plat combines both the preliminary and final platting stages anticipated within the Subdivision Ordinance. Approval of a plat revised to the requirements of the Subdivision Ordinance and City staff recommendations would be processed as part of general plan review. Proposed Project. The unit configurations proposed as part of general plan have not changed significantly from what is approved by the City Council for concept plan review. The total number of units approved by the City Council in the concept plan was 152, in a variety of unit styles. The numbers of each type of unit has been shifted slightly, but 151 units is now proposed for general plan approval. VSSA will maintain ownership of the complete development and be responsible for all maintenance except for the City streets. The concept plan included approvals for a historic church and school off of Norwich Parkway. The applicants have pulled consideration of this aspect of the Ian from p p general plan review. VSSA has indicated that additional research will be required to develop plans to replicate and restore the buildings. As such, a general plan application will be submitted separately for this aspect of the overall plan. Access through the site is provided by an extension of Nolan Avenue that would loop back to Norwich Parkway. That roadway would be named Nolan Parkway North. A loop roadway within the development is referred to as Nolan Lane. The p Ian has included a future access road location from Nolan Avenue to the Environmental Learning Center. That roadway was dedicated as part of the McKean west p lat that was previously approved by the City Council A second access point at the Environmental Learning Center is not planned as part of the current development proposal. The Planning Commission and City Council should comment whether an additional access roadway would be required at this time. Streets. All of the roadways within the development are proposed to be public. The site plans indicate that the streets would be 28 feet in width with a 50 foot right-of-way. Y In addition, 10 foot utility easements will be placed on either side of the roadway. Y Consistent with the concept plan approvals, the right -of -way and roadway design is Y 9 acceptable to the City Engineer and the Public works Director. The plans indicate that Nolan Parkway would be set 10 feet off of the east ro ert line p p Y adjacent to Baytown Township as recommended by staff and consistent with the approved concept plan. The intersection of Nolan Avenue and Nolan Parkway has been redesigned to a 90 degree intersection, as recommended by the City Engineer. Staff has suggested that the landscape island within Nolan Parkway in the southwest corner of the site be removed. The island interferes with access for two driveways and would result in one -way traffic on either side of the barrier. The applicants have agreed to remove the island and lessen the width of the roadway at this corner. Setbacks. The plan indicates that the buildings maintain at least a 20 foot separation from the curb line of the street network. Additionally, the building to building separation is maintained at 20 feet. The plan also reflects a 20 foot setback between the sidewalks McKean Square PUD Planning Report Page 4 1 1 1 and the front of the garages. This will allow vehicles to be parked in front of the garage doors without blocking the sidewalks. All of the single and duplex townhome units maintain at least a 50 foot setback to the property lines which is also the boundary of Baytown Township. The grouping of five townhomes in the southeast corner of the development maintains a 35 foot separation to the property /boundary line. The 12 unit brownstone flat north of Nolan Parkway as i Y been moved so that t maintains a 20 foot separation to the sidewalk and is 30 feet to the curb line. All of the parking areas are set back at least 10 feet from the property line and 20 feet from the curb line. Adequate setbacks have also been provided to the wetland areas within the development. The revisions to the site plans satisfactorily address the setback issues raised during the concept plan review. The development has achieved adequate setbacks while maintaining as many of the natural features and tree resources of the site as possible. Trails /Sidewalks. The plans indicate sidewalks on one side of Nolan Parkway and the connecting loop roadway. This is consistent with the concept plan. Additionally, trail connections are provided between the roadways and the major wetlands of the development. The sidewalks and trails are shown at a five foot width. As part of the development agreement, the City Attorney has suggested that VSSA take over maintenance responsibilities for all of the trail systems and the sidewalks along Nolan Parkway and Nolan Lane in this development, as well as the first phase. The City does not have the equipment or the personnel to adequately maintain the trails and sidewalks, especially snow clearing. The plans do not indicate a sidewalk/trail connection on the east side of the development to Norwich Parkway. The plans should be revised to include this connection either along Nolan Parkway or on the east side of the parking lot. The Parks Commission and City Council should comment on the specific trail and sidewalk locations within the development. Park Dedication. As part of the development agreement for the first phase, all of the park dedication requirements were satisfied by VSSA for the area south of 58 Street. Although the overall densities of this development have decreased from previous concept plan approvals, it is recommended by the City Attorney and City staff that the park dedication not be recalculated for this development. Grading and Drainage. Grading and drainage plans, as well as drainage calculations have been submitted to the City Engineer for review. The City Engineer has not indicated any major issues with the drainage plans as submitted. The plans include a stream feature and preserving the existing wetland areas. The City will not take an easement over the stream for maintenance purposes, but will take easements and provide maintenance over the wetlands and ponds. The applicants shall revise the McKean Square plat to label areas as blocks and lots. The McKean Square plat shall be subject to review and approval of the City Y Engineer and City Attorney. The pro as approved in 2001, allowed the development to be constructed in two phases. A revised plan to' allow a sli lar Buildin 2 and redesi parkin lot was approved in the fall of 2002. The trash handlin area in Buildin 2 that was approved in the fall of 2002 has been retained in the revised plans. The size of Buildin 2 has s been reduced from 13,672 square feet to 7,604 square feet. The total number of parking spaces has been increased from 68 to 99, which is an increase of 31 spaces. The applicant also approached the City with a concept that would extend the parking lot to the east property line and eliminate the ten -foot parking setback. This would require approval of a setback variance. Staff cannot support a setback variance because no physical hardship exists, and all parking requirements are met without a variance. If the City is interested in reviewing a variance request, a public hearing would need to be scheduled to receive comment on that request. Parking. Based on the information the applicant has provided, Building 1 contains approximately 7,050 square feet of office floor area and 10,150 square feet of warehouse flooring. There is a mezzanine level in one of the units that increases the office area within the building by approximately 2,700 square feet compared to the information originally submitted (3,000 sq. ft. gross minus 10% = 2,700 sq. ft. floor area). This results in a parking requirement of 46 spaces for Building 1. The site plan indicates that Building 2 would contain 2,280 square feet of office floor area and 5,324 square feet of warehouse floor area. This results in 21 required spaces for Building 2 or a total of 67 spaces for the entire site. A total of 99 parking spaces are proposed, resulting in a surplus of 32 spaces. The applicant has indicated that they would like to supply this additional parking to allow more flexibility in case there is more demand for office space in the future. If all of Building 2 was occupied by office uses, a total of 87 parking spaces would be required for the entire site, and there would still be a surplus of parking spaces. Building Design. Revised elevations of Building 2 have been submitted. The revised plans show that one of the entrances to Building 2 has been eliminated. Also, rather than the facade being stepped back once in the middle of the building, the facade is articulated on both sides of the single entrance. The facade areas on either side of the entrance are both sixty -two feet long. The City Design Guidelines state that a building more than 30 feet in width should be divided into increments of no more than 30 feet through articulation of the facade. The Design Guidelines recommend achieving this through combinations of the following techniques: divisions or breaks in materials, window bays, separate entrances and entry treatments, variation in roof lines, awnings, and building setbacks. We recommend that the applicant explore incorporating one or more of these features in the design of Building 2. Grading, Drainage, and Utility Plans. Grading, drainage, and utility plans have been submitted and are subject to review and approval by the City Engineer. Lighting. A revised lighting plan has been submitted that indicates that all lights will be shielded /directed away from adjacent properties and street rights -of -way.
