ENTERPRISES FOR A PLANNED UNIT DEVELOPMENT AMENDMENT TO ALLOW FOR SITE PLAN CHANGES FOR THE PROPERTY AT 5610 MEMORIAL AVENUE NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the Cit of Oak Park Hei has received a re from W.A.T.E. Enterprises for a planned unit development amendment to allow for site plan chan for the propert at 5 610 Memorial Avenue North and after havin conducted a public hearin relative thereto, the Plannin Commission of Oak Park Hei makes the followin findin of fact: follows, to wit: I . The real propert affected b said application is le described as Lot 4,1 Block 2, Kern Center 2nd Addition and 2. The applicant has submitted an application and supportin documentation to the Communit Development Department consistin of the followin items: and SEE ATTACHMENT A 3. On Ma 13, 2003 ), the Cit Council approved a Planned Unit Development for W.A.T.E. Enterprises, Inc. to allow the construction of a 12,800 s foot office/warehouse buildin and 4,127 s foot cold stora buildin upon a 2.3 -acre site located west of Memorial Avenue North between Hi 36 and 55th Street North. 4. The proposed site plan chan include relocatin the loadin area to the southeast side of the buildin and shiftin parkin to the northwest side of the buildin and 5. While the orientation of the principal buildin and the parkin has chan no chan to the plan in terms of area or g eneral la have been proposed and 6. The Cit staff prepared a plannin report dated Jul 2, 2003 reviewin the re q uest and recommendin that the re be approved with conditions and 7. The Plannin Commission held a public hearin at their Jul I 0th, 2003 meetin took comments from the applicants and public, closed the public hearin and made the followin recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. Enterprises for a planned unit development amendment to allow for site plan chan for the propert at 5610 Memorial Avenue North and affectin the real propert as follows: Lot 4, Block 2, Kern Center 2nd Addition Be and the same as hereb recommended to the Cit Council of the Cit of Oak Park Hei for approval subject to the followin conditions: 1. The access and circulation plan is subject to the review and approval of the Cit En and Fire Chief. 2. The applicant should identif the location of snow stora within the site plan. 3. The four off-street parkin stalls located within the loadin area be eliminated and the ad row of parkin ( to the northwest be extended to the southeast. 4. The landscapin plan is subject to review and approval b the Cit Arborist. 5. The applicant shall pa a tree replacement fee set b the Cit Arborist. 6. The draina and g radin g plan is subject to the review and approval of the Cit En 7. The utilit plan is subject to the review and approval of the Cit En and Fire Chief. 8. The location of fire h and sprinkler s within both buildin shall be subject to the review and approval of the Fire Chief and/or buildin official. 9. PUD Amendment City council 415 ,Planned Unit Development Permit - Lapse of Approval: Unless the City Council specifically approves a different time when action is officially taken on the request, the conditional use permit shall become null and void twelve (12) months after the date of approval, unless the property owner or applicant has substantially started the construction of any building, structure, addition or alteration, or use requested as part of the conditional use. An application to extend the approval of a conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30) days before the expiration of said approval.
