HomeMy WebLinkAbout2003-07-22 CC Resolution #03-07-38RESOLUTION NO. 03-07-38 0 OF THE CO� CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE RE BY W.A.T.E. ENTERPRISES FOR A PLANNED UNIT DEVELOPMENT AMENDMENT TO ALLOW FOR SITE PLAN CHANGES FOR THE PROPERTY AT 5610 MEMORIAL AVENUE NORTH IS APPROVED WITH CONDITIONS WHEREAS, the Cit of Oak Park Hei has received a re from W.A.T.E. Enterprises for a planned unit development amendment to allow for site plan chan for the propert at 5610 Memorial Avenue North and after havin conducted a public hearin relative thereto, the Plannin Commission of Oak Park Hei recommended that the application be approved with conditions. The Cit Council of the Cit of Oak Park Hei makes the followin findin of fact: 1. The real propert affected b said application is le described as follows, to wit: Lot 4 ., Block 2, Kern Center 2n Addition and 2. The applicant has submitted an application and supportin documentation to the Communit Development Department consistin of the followin items: SEE ATTACHMENT A and 3. On Ma 13, 2003, the Cit Council approved a Planned Unit Development for W.A.T.E. Enterprises, Inc. to allow the construction of a 12,800 s foot office/warehouse buildin and 4,127 s foot cold stora buildin upon a 2.3-acre site located west of Memorial Avenue North between Hi 36 and 55hStreet North. 4. The proposed site plan chan include relocatin the loadin area to the southeast side of the buildin and shifting -parkin to the northwest side of the buildin and 5. While the orientation of the principal buildin and the parkin has chan no chan to the plan in terms of area or g eneral la have been proposed; and 6. The Cit staff prepared a plannin report dated Jul 2, 2003 reviewin the re and recommendin that the re be approved with conditions. and 7. The Planning Commission held a public hearing at their July 10 2003 meeting, took conents from the applicants and public, closed the public hearing, and mu recommended that the application be approved subject to conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CI'T'Y COUNCIL APPROVES THE FOLLOWING: A. The application submitted by w.A.T.E. Enterprises for a planned unit development amendment to allow for site plan changes for the prop erty at 5 610 Memorial Avenue North and affecting the real property as follows: Lot 4, Block 2, fern Center 2nd Addition Be and the same as hereby approved by the City Council of the City of Oak Park Heights subj ect to the following conditions: 1. The access and circulation plan is subject to the review and approval of the City Engineer and Fire Chief. 2. The applicant should identify the location of snow storage within the site plan. 3. The four off-street parking stalls located within the loading area be eliminated and the adjacent row of parking (to the northwest) be extended to the southeast. 4. The landscaping plan is subject to review and approval by the City Arborist. 5. The applicant shall pay a tree replacement fee set by the City Arborist. 6. The drainage and grading plan is subject to the review and approval of the City Engineer. 7. The utility plan is subject to the review and approval of the City Engineer and Fire Chief. 8. The location of fire hydrant and sprinkler systems within both buildings shall be subject to the review and approval of the Fire Chief and/or building official. 9. An application to extend the approval of a g p conditional use permit shall be submitted to the Zoning Administrator not less than thirty (30 ) days s before the expiration of said approval.
