Commissioner Liljegren arrived at 7:48 p.m. Absent: Chair Vogt. Commissioner Dwyer, seconded by Commissioner Runk, moved to approve the Agenda with Informational Item A amended to ready March 13th. Carried 3 -0. Approve Minutes: Commissioner Powell, seconded by Commissioner Runk, moved to approve the Minutes of January 16, 2003 as presented. Carried 3 -0. Department /Commission Liaison Reports /Other Reports: A. Hwy. 36 Partnership Study: Acting City Administrator Holst reported that a joint meeting is being held with the Oak Park Heights and Stillwater City Councils at 6:30 p.m., February 26, 2003 at Stillwater City Hall. B. Commission Liaison: None. C. Other: None. Visitors /Public Comment: There were no visitors to the meeting or public comment other than to items on the Agenda. Public Hearings: A. City Planner Richards provided an overview of the project and reviewed the planning report regarding the same. He noted that the revised plans reflect some of the suggestions made by staff in the January 9, 2003 planning report. Richards provided an issue analysis and discussed specifics of each. Vice Chair Dwyer inquired what impact to the project would be if Kohl's development were not tied into it. Planning Commission Minutes February 13, 2003 Page 2 of 5 Ken Hooke - VSSA addressed the question and stated that Kohl's was the original reason for their initial interest in proposing a full comprehensive plan and to work on something that was complimentary to both projects. He stated that they feel the plan for Oakgreen Village can stand on its own and indicated that they would like to move forward. Mr. Hooge addressed the conditions noted within the planning report, noting that most had already been met or were not of concern in being met. He discussed several of the conditions in detail and provided the applicant's perspective to each and stated that they are working with an appraiser to determine land values and that they hope to have a report with those figures available prior to the City Council's February meeting. Brief discussion ensued as to building proximity to existing residential dwellings, neighbors, phasing plans and Novak Ave. N. extension. Vice Chair Dwyer opened the hearing for public comment. There was none. Commissioner Runk, seconded by Vice Chair Dwyer, moved to continue the public hearing to March. Carried 3 -0 City Planner Richards commenced continued discussion on various issues related to land elevation, parking, roadway impact, and application status. B. McKean Square: To consider requests of Valley Senior Services Alliance Housing and Community Services LLC for zoning district amendment and planned unit development: general plan approval for Phase II, Boutwells Landing, known as McKean Square and located south of Norwich Parkway N. and east of Nolan Ave. N. City Planner Richards provided an overview of the project and reviewed the planning report regarding the same. Richards provided an issue analysis and discussed specifics of each and noted the process required for voting on a recommendation for the matter. Vice Chair Dwyer called afive- minute recess after which the meeting reconvened with Commissioner Liljegren's arrival and continued with City Planner Richard's report and issue analysis regarding the application request. Vice Chair Dwyer opened the hearing for public comment. Ken Hooke - VSSA addressed the conditions of the planners report and discussed in some detail the issues of the historic school house and church, request for second access, street lighting, sidewalks, trail connections and address questions from the Commission regarding timing of school and church and parking lot lighting to being on all night. Planning Commission Minutes February 13, 2003 Page 3 of 5 Kirk Velett, VSSA Architect provided information as to building elements and colors that they anticipate to use in the project. He explained that planning for a varied, patterned scheme of color for the project is being developed and that it will be in place prior to construction commencement. He indicated that the stone coloring will be similar to Boutwells Landing but a bit darker and proceeded to discuss several schemes possible with trim, stone and vinyl. Commissioner Runk, seconded by Vice Chair Dwyer moved to close the public hearing. Carried 4 -0. Discussion ensued as to the planning report conditions. Commissioner Runk, seconded by Vice Chair Dwyer moved to recommend City Council approval, subject to the following conditions: 1. The applicants shall revise the McKean Square plat to label areas as blocks and lots. The McKean Square plat shall be subject to review and approval of the City Engineer and City Attorney. All street, utility, and drainage easements dedicated for the project shall be subject to review and approval of the City Engineer. 2. The general plan approvals do not include consideration of the area identified for a historic church and school. The plat and site plans reflect that area to be excluded from general plan approval. 3. The Planning Commission recommends that the one access point that is already provided by the McKean West plat shall provide adequate access to the Stillwater High School Environmental Learning Center. 4. The landscape island within Nolan Parkway shall be removed and the curb lines shall be reconfigured subject to review and approval of the City Engineer. 5. VSSA shall accept maintenance responsibilities for all trail systems in the development and the sidewalks within the Nolan Parkway and Nolan Lane right -of- way. The City shall work with VSSA to revise the existing development agreement to require maintenance of all sidewalks and trails in the entire Boutwells Landing development. 6. A sidewalk /trail connection shall be provided on the east side of the development to Norwich Parkway. 7. The Parks Commission and City Council should comment and recommend the specific trail and sidewalk locations within the development. 8. Grading and drainage plans shall be subject to review and approval of the City Engineer and review of the applicable watershed authority. The Planning Commission has reviewed proposed building material samples and recommends approval of the materials presented. 11. The applicants shall provide lighting details including pole /fixture heights and examples of fixture style. Plans for all lighting attached to the buildings shall be submitted to the City. All final lighting plans shall be consistent with Zoning Ordinance lighting standards and subject to review and approval of City staff. 12. VSSA shall accept maintenance and operational responsibilities for all lighting fixtures in the development. The City shall work with VSSA to revise the existing development agreement to require VSSA to accept operation and maintenance expense for all lighting fixtures in the Boutwells Landing development. 13. The applicant shall provide material samples for the signs and plans if /how they will be lit subject to review and approval of City staff. 14. The final landscape plans, tree inventory, and tree preservation plans are subject to review and approval of the City Arborist. 15. The applicant shall enter into a development agreement with the City specifying conditions of approval subject to review and approval of the City Attorney and City Council. 16. Any other conditions of City staff, Planning Commission, Parks Commission, and City Council. Carrie 4 -0. C. DDD, LLC: To consider request of DDD, LLC for planned unit development amendment allowing site plan changes at 5525 Memorial Ave. N. City Planner Richards provided an overview of the project and reviewed the planning report regarding the same. Richards provided an issue analysis and discussed specifics of each. Vice Chair Dwyer opened the hearing for public comment. Steve Continenza - introduced himself as the applicant and addressed the conditions within the planning report. Brief discussion ensued as to parking, building occupancy, lighting and related. The applicant should explore incorporating additional vertical features in the facade of Building 2. 2. The grading, drainage, and utility plans are subject to review and approval of the City Engineer. 3. The landscape plan is subject to review and approval of the City Arborist. 4. The Plannin Commission, at their Februar 13, 2003 meetin continued the public hearin to the March Plannin Commission meetin pendin the submittal of additional information. The Februar 6, 2003 plannin report outlined the unresolved issues and information re to complete a concept plan review. The pro architect has provided a revised plan indicatin chan to that area east of Novak Avenue North. The plan addresses some of the issues, but not all that were identified in the Februar 6, 2003 report. Attached for reference: Exhibit 1: Revised Concept Plan ANALYSIS Plan Details. The revised plan indicates a chan in the number of units in the apartments (labeled as 17 on the site plan) from 50 units in each to 45. As a result, the two apartment buildin east of Novak Avenue will have a total of 90 units, instead of 100 units. The configuration of townhomes has also changed. The townhomes of Phase 1 now total 87 units in 12 buildings. Phase 2, near Oakgreen Avenue, has a total of 23 units in four buildings. The total number of townhome units is now planned at 110 units, instead of 100 units. The townhome units have also been reconfigured to provide 65 feet from building to building and a 23 foot drive aisle. Adequate space is now provided to allow parking in front of the townhome garages. Staff comments on the revised plans include: • The access roadway between Novak Avenue and 58 Street is proposed to be a public street. The plans indicate the driveways of townhomes 9 and 10 accessing directly on the street, which is regarded as a traffic issue and not allowed by the Zoning Ordinance. • The City Engineer has indicated that too many access points for the townhomes and apartments are provided to the public street. The plan should be revised to address the access issue. • The townhomes on Oakgreen Avenue as part of Phase 2 have been pulled further west to allow for additional separation to the roadway. The plat will need to be revised so at least 40 feet of right -of -way can be retained from the centerline of Oakgreen Avenue North. • Townhome 6 in Phase 1 is set back 25 feet from the boundary line of Phase 1 and 2. At least a 30 foot separation should be provided if the project is constructed in phases. • Staff has previously recommended that the Oakgreen Avenue townhomes be constructed in the same phase as the other townhome development. The Planning Commission and City Council should comment on this issue. • Staff recommends that VSSA obtain written approval from Xcel Energy on the construction of a roadway and the ponds within the power line easement. • The City Engineer has indicated that stormwater will be redirected into a different watershed district from where it currently drains. Written approval from the affected watershed districts should be obtained by the applicant. Issues /Recommendations from February 6, 2003 Memo. Following is a list of issues and recommendations from the February 6, 2003 memo with a response to each: 1. The preliminary plat needs to be revised to include lot and block numbers and keep stormwater ponds on the same lots as adjacent buildings. 2 Response: A revised preliminary plat has not been submitted. 2. Forty feet of right -of -way should be dedicated from the centerline of Oakgreen Avenue North to allow space for future improvements. Response: The preliminary plat will need to be revised to address this issue. 3. The extension of Novak Avenue North must be redesigned to be completely on the subject property, or the applicant must reach an agreement with the adjacent property owner for the street to be partly on the adjacent property consistent with the submitted plans. Response: A preliminary plat has not been submitted to address this issue. VSSA representatives have indicated that they will address this issue. 4. The phasing plan must be revised to include all areas of the development including ponds and streets. Response: A revised phasing plan has not been submitted. 5. The phasing plan must put the areas along Oakgreen Avenue labeled C1 and E in the same phase. Response: The revised plan indicates the townhome project will still be completed in two phases. The Planning Commission and City Council should comment on this issue. 6. The applicant must address concerns regarding the close spacing of buildings and potential difficulty in maneuvering fire equipment. Response: The revised plan addresses this issue but the plan should be subject to review and approval of the Fire Marshal. 7. The Parks Commission should make preliminary comments regarding open space, park land needs, and sidewalk/trail locations. Response: Minutes of the February Parks Commission meeting will be provided to the Planning Commission and City Council. 8. The trail and landscaping south of 59 Street should extend all the way to Oakgreen Avenue North. Response: The revised plans indicate a trail to Oakgreen. 3 9. Information related to land market value should be provided to calculate park dedication requirements. Response: Representatives of VSSA have indicated that they would prefer to submit the information as part of General Plan review. The Parks Commission would like an indication at this time of the potential cash park dedication for this development. 10. The applicant should respond to any comments from the City Engineer regarding drainage and utility plans. Response: The City engineer has made preliminary comments and will issue a separate report. 11. Any other comments from City staff, Planning Commission, Parks Commission, and City Council. Approval Timing. The initial application for this development was submitted in December 20, 2002. The City sent the applicant a letter indicating that the timeline for review would be 120 days. The project will need to be acted upon by the City Council at their April 8, 2003 meeting, thus not allowing for another review by the Planning Commission in April. An additional 30 day extension has been requested from the applicant to address the timeline issue. RECOMMENDATION I CONCLUSION Numerous issues that were raised by the City staff and Planning Commission have not been adequately addressed by the applicant. In addition, the new site plan raises additional issues, primarily with the direct access from garages to a public street and the overall number of driveways along this roadway. The current Concept Plans and supplemental information is not adequate to recommend favorably for Concept Plan approval. While Herber and limited retail tenants remain, the ma of the mall is used b Andersen Corporation for office uses. Retail and office uses are permitted within the B-2 District. The St. Croix Mail was ori approved as a Planned Unit Development in 1979 therefore, a PUD amendment is re before an site or buildin chan can be made to t propert Proposed Improvements. The applicant is also proposin to close Oren Avenue North at its north terminus and is re a variance to allow parkin five feet from the ri of Omaha Avenue North. Schedule for Improvements. The proposed improvements would be completed se Completion of all proposed improvements is scheduled for Au of 2003. The proposed improvements, in con with interior renovations that are pro are expected to satisf the re of Andersen Corporation for the foreseeable future. No additional site or buildin chan are anticipated at this time. Oren Avenue North. Oren Avenue North is a private road that provides access to two homes south of the St. Croix Mall. The applicant is proposin to close the north end of the road to vehicular traffic. Access will remain to Oren Avenue and 57th Street from the south. Because the road is private, there is no ri to vacate. Private access easements will remain in place. Cit staff has determined that a traffic stud is not needed for this closure. The Cit and Andersen Corporation will work out issues on 2 r y snow clearing and maintenance subject to approval of the City Public Works Director. The topography slopes down from the St. Croix Mall site to the residential area, which may be a potential hazard for someone on a skateboard or bicycle. Also, people moving north would be entering a drive aisle. Therefore, the City may wish to require a sign be placed on the north side of the adjacent fence to inform people about the slope ahead and a sign be placed on the south side of the adjacent fence to inform people about the traffic ahead. Parking. The applicant is proposing to complete seal - coating and striping of the parking lot and move some traffic islands. The applicant has requested a variance to allow parking five feet from the right -of -way of Omaha Avenue North, which is west of the site. The required parking setback is 10 feet. The area where parking is proposed is currently paved and used as a drive aisle. The proposed change includes widening the island along Omaha Avenue North from four feet to almost 13 feet and installing new landscaping. City staff supports the variance request because the proposal results in increased green space, increased landscaping, greater separation between parking lot vehicles and the public right -of -way, and results in no negative impact to the public or adjacent properties. Trail Connection, The City Trail Plan shows a need for a trail along the southern boundary of the subject property. This trail would be a segment of an important east/west trail corridor that will eventually connect Valley View Park on the east to Swager Park on the west. From Swager Park a trail already exists extending to the west past City Halt and along 58 Street all the way to State Highway 5 (Stillwater Boulevard). City staff recommends that the submitted site plan be revised to include a trail designated with markings along the south side of the southern drive aisle. To accommodate this, some parking islands will need to be moved approximately 10 feet further north, resulting in a loss of approximately 50 parking spaces. This should not be a problem because the site has an oversupply of parking. City staff does not recommend an overland trail south of the existing curb line because there are mature trees in that area and the ground slopes to the south. Building Materials. The plans indicate replacement of most of the exterior building finish, not including the Snyder's or Herberger's facades. The application narrative 3 r • explains that proposed exterior building finishes are a mix of materials selected to reduce the mass of the existing structure and to complement the existing rockface masonry. Proposed materials are illustrated on the elevations and include pre - finished corrugated metal and Andersen "Fibrex" pre - finished cladding. Maintenance Shed. Improvements to the maintenance shed on the west side of the mall include new exterior materials. This area was originally used as a garden center. Signage. The existing monument sign along Osgood Avenue is proposed to be removed. No new signage is proposed. Landscaping. Landscaping is required to comply with Section 401.15.E of the oak Park Heights Code. The City Arborist has stated that the submitted planting schedule and planting detail are acceptable. The proposed plant species are acceptable, being winter hardy and relatively free of insect and disease problems. She has suggested that the applicant consider using more plant varieties in the outdoor seating area on the southwest side of the building. She has recommended that the two medians that are proposed to be moved at the southeast corner of the site be planted with disease - resistant flowering crab trees because the trees in the existing islands are diseased. The plan had been to transplant the existing trees, which area a Prunus species that are badly infected with black knot fungus. Lighting. A lighting plan, photometric plan, and fixture details have been submitted. The photometric plan shows that light levels exceed the maximum light level of .4 foot candies along the south property line, which is adjacent to a residential neighborhood. The lighting plan should be revised to reduce the lighting impact to a maximum of .4 foot candles along the south property line. Light standards may not exceed 25 feet from the parking lot surface to the top of the light fixture. The light fixtures must have flat lenses. Refuse. A trash area is currently in place and no changes are proposed. Additional dumpsters may be placed on site temporarily for construction purposes. Utilities. Any changes to existing utilities or construction over existing utility service lines is subject to review and approval of the City Engineer. Placement of all fire hydrants and fire connections must be approved by the City Fire Marshal. CONCLUSION / RECOMMENDATION The application generally complies with City regulations and is a reinvestment in an existing development, which is consistent with City goals. We recommend approval of the PUD amendment and variance to allow parking five feet from the right -of -way of Omaha Avenue North subject to the following conditions: 4 c r 1. The site plan must be revised to include a trail constructed by SC Mall LLC along the south boundary of the site subject to approval of the Parks Commission and City staff. 2. The City and Andersen Corporation will work out issues of snow clearing and maintenance of Oren Avenue North and the sidewalk connecting the road to the subject site subject to approval of the City Public Works Director. 3. A sign must be placed on the north side of the adjacent fence to inform people about the slope ahead, and a sign must be placed on the south side of the adjacent fence to inform people about the traffic ahead. 4. The lighting plan must be revised so light levels do not exceed .4 foot candles along the south property line. 5. Background. Facing an urgent need for office space, Andersen Corporation commissioned MS &R to "reinvent" an existing Kmart retail store at the St. Croix Mall converting it for office use . in 1999. SC Mall LLC subsequently purchased the entire retail Mall. They are currently I designing the remainder of the facility for Andersen office use, creating improvements. in efficiency, collaboration and identity in an Administrative Office center. Over 600 Andersen employees are currently located at the site; several retail tenants will remain at the Mall for the foreseeable future. Previous improvements include a computer deployment/receivig area; exterior courtyards, parking and walkway canopies, new entry and maintenance area canopies; select site demolition, patching and sealcoat/restriping and revised site lighting within the NW parking. quadrant; and-demolition of the original Kmart entrance canopy. ■ Current Zoning: Planned Unit Development, (PUD). B -2 zone. ■ Allowable use: Office and Retail are both allowed under the PUD. ■ PUD Requirements: Requirements are the same as those in zone B -2 and City of Oak Park Heights general zoning code and design guidelines. ■ Acreage: 22.79 acres not including the Kmart parcel (3.88 acres) SC Mall LLC PUD Amendment 2/21/03 Page 2 Proposed. Improvements Exterior improvements to the site and building exterior, including: Miscellaneous roadway island, parking island and sidewalk improvements ■ Select revisions to surface parking (accepting the existing parking stall layout in our retopping, lighting proposal) • Select electrical/utility relocation • Site and facade lighting improvements • Select exterior facade improvements • Site security upgrades • Landscape improvements Special considerations for this work include the following: ■ Closure of Oren Avenue North at its north terminus ■ Variance for NW boulevard island along Omaha Avenue North These improvements, in conjunction with interior renovation currently ongoing, are expected to satisfy the requirements of Andersen Corporation for the foreseeable future. No additional modifications or changes to site, vehicular circulation or amenity are anticipated at this time. Construction. Schedule. The above improvements will be completed sequentially; completion of all proposed improvements is scheduled for August 2003. Proposed. Building. Finishes. New exterior building finishes are selected as a mix of materials to reduce the mass of the existing structure and to complement the existing rockface masonry, consisting of: ■ EIFS surfacing ■ Prefinished corrugated metal ■ Andersen "Fibrex" Prefinished cladding See building elevations for distribution of materials. Proposed. Landscaping Emphasis of the plan remains the perimeter of the site. Landscape criteria shall meet OPH zoning code section 401.15.E.10 for plant size and spacing requirements.
