Commission Liaison: McComber informed the Commission that the Hwy. 36 Advisory Committee was to resume meeting soon regarding the roadway mapping and environmental impact. McComber discussed the estimated timing for the mapping and addressed questions from the Commission as to process. B. Other: None. Visitors /Public Comment: None. CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Thursday, August 14, 2003 ENCLOSURE Public Hearings: A. Continued: Midas - Multi-tenant Retail Building: To consider requests for site plan review and conditional use permit for a one-story, multi- tenant retail building located between Applebee's and Jerry's Auto Detail at 60` St. N. City Planner Richards noted that the City Council acted to deny change to the Central Business District zoning that would allow minor auto. He stated that the City, has received correspondence, on behalf of the applicant, requesting a continuance to August 26, 2003. Richards pointed out that a regular scheduled meeting of the Commission was not scheduled until September and discussed additional information needed to the site plan that would not include a Midas in order for a proposed project at this site to be considered. Chair Dwyer opened the hearing for public comment. There being no visitors to the public hearing Commissioner Powell, seconded by Vice Chair Runk, moved to close the public hearing. Carried 4 • Chair Dwyer, seconded by Vice Chair Runk, moved to recommend City Council denial of the applicant's request for site plan review and conditional use permit. Snyder's PUD Amendment: To consider a request for planned unit development amendment for redevelopment of existing strip mall, located at the corner of Osgood Ave. N. and 60t St. N., for a one-story, multi- tenant retail building. City Planner Richards reviewed his report, discussing some of the site history and providing an issue analysis. Richards discussed issues related to the project, including parking, drive through, hours of operation, design guidelines, signage, lighting and such. The Commission is being asked to consider approval subject to the conditions within the planning report. Chair Dwyer opened the hearing for public comment. Roland Swenson of JSSH Architects, Mpls. introduced himself as working on behalf of the applicant with respect to design and planning of the proposed project. Mr. Swenson provided a brief overview of the proposed project, discussing building and landscape elements as well as providing a sample of the proposed exterior building material. Mr. Swenson also addressed questions as to the existing pylon sign and alterations to it. Dave Leonard of Snyder's Drug discussed the sign in relation to the former St. Croix Mall lease agreements of tenants still operating at the site. He stated that they would work with the City to find a mutually satisfying design for the signage. Chair Dwyer, seconded by Commissioner Powell, moved to .close the public hearing. Carried 4 -0. Discussion ensued as to the pylon sign and what would be required to bring it into conformance with City Ordinance requirement and still service its businesses. Hwy. 36 and the 60t St. frontage road modification potentials were noted as an issue to be considered. Vice Chair Runk, seconded by Chair Dwyer, moved to recommend City Council approval subject to conditions of the August 5, 2003 Planning Report, specifically: 1. Proof of ownership by C & H Properties must be provided, or SC Mall LLC must provide written authorization for the application. 2. The applicant must provide color elevations and building material samples for Planning Commission review and approval. 3. Details of the existing freestanding sign must be provided and plans for bringing the sign into conformance with Section 401.15.G of the Zoning Ordinance must be submitted for City review and approval. The freestanding sign shall not exceed 100 square feet and a height of 20 feet. The freestanding sign base shall be surrounded with a landscape planter at least three feet in height and constructed of materials to match the principal building. The planter shall contain decorative shrubbery and/or flower materials. • • Planning Commission Minutes August 14, 2003 Page 3 of 7 4. A revised wall sign plan must be submitted for City review and approval. The plan must include a maximum of two wall signs. In addition, on- premises directional signs, each not exceeding four square feet in area, may be allowed to identify the pharmacy drive through. 5. The total cumulative sign area of wall and freestanding signs, except for on- premises directional signs, shall not exceed 300 square feet. 6. The landscape plan is subject to City Arborist review and approval. 7. The two proposed pole lights next to the east parking lot must be relocated to be no closer than ten feet from the property line. 8. A photometric plan must be submitted that complies with Section 401.15.B.7.d. of the Zoning Ordinance. 9. Light standards may not exceed 25 feet from the parking lot surface to the top of the light fixture. The lenses must be revised to be flat. The proposed wall lights must be revised so that the luminare contains a cutoff that directs and cuts off the light at an angle of 90 degrees or less. 110 10. The exterior wall treatment of the proposed dumpster enclosure shall be similar and /or complement the principal building. Details must be submitted for. City staff review and approval. 11. The location of the sanitary sewer line in relation to the proposed building addition is subject to review and approval by the Building Official. 12. Grading and drainage issues are subject to review and approval by the City Engineer and the Middle St. Croix Watershed District. Carried 4 C. Kohl's PUD - General Plan: To consider a request for planned unit development: general plan for construction of a Kohl's department store and four retail tenant spaces and rezoning from 0, Open Space to B -2, General Business, located East of Menard's at 60 St. N. City Planner Richards reviewed his report, provided an issue analysis and discussed the conditions within his report for the request. The Commission is being asked to consider approval subject to the conditions within the planning report. . Brief discussion ensued as to signage, parking and possibilities of a bus stop /unloading area. Chair Dwyer opened the hearing for public comment. Planning Commission Minutes August 14, 2003 Page 4 of 7 Jay Scott of North American Properties introduced himself as the project developer for the proposed project. Mr. Scott shared a materials board with the Commission and addressed the subject of a transit hub. Mr. Scott stated that they generally do not plan a transit hub as part of a project but have coordinated such stops with the transit authority at other locations. He stated that he would be willing to follow through with a communication to this end if desired. He addressed Commission questions and discussed 58t Street truck traffic, access to the site off of 58t St. and trail access to the retail center. Vice Chair Runk, seconded by Chair Dwyer, moved to close the public hearing. Carried 4-0. Discussion ensued as to planning report conditions, pedestrian travel and safety to retail center area and across from 58 St. The Commission stated that they would like to see staff work with the applicant on this and noted that they endorse looking at a Norell Ave. access as opposed to Krueger Lane. Chair Dwyer, seconded by Commissioner Oswald, moved to recommend City Council approval of requests for final plat and rezoning to B - 2, subject to the amended conditions of the August 7, 2003 Planning Report, specifically: A. Approval of the rezoning of the subject property from 0, Open Space Conservation to B - 2, General Business District. B. Approval of the "Shoppes of Oak Park Heights" final plat subject to the following conditions: 1. The City approve the PUD General Plan. 2. The City Engineer, City Attorney and MnDot find the final plat to be acceptable. 3. An access easement be acquired from the City to accommodate the proposed northerly Norell Avenue access to the property. C. Approval of the PUD General Plan subject to the following conditions: 1. The City approve the rezoning of the property to a B -2, General Business designation with a planned unit development overlay. 2. The City approve the proposed final plat. 3. The submitted traffic analysis is found to be acceptable by the City Engineer. 4. The six handicap stalls located along the east /west drive aisle directly north of the building be relocated to the interior of the parking lot. 5. A snow storage plan shall be submitted for City staff review and approval. Planning Commission Minutes August 14, 2003 Page 5 of 7 6. The grading and drainage plan shall be subject to review and approval of the Browns Creek Watershed District and the City Engineer. All required storm water improvements and /or payments shall be outlined in the development contract. 7. The utility plan is subject to review and approval of the City Engineer. 8. The Parks Commission provide comment on the need for additional trails and sidewalks within the right -of -way of Krueger Lane and marked crosswalks on 58` Street at Krueger Lane. If a sidewalk is required by the City, it shall be constructed at the applicant's expense and subject to review and approval of the City Engineer. 9. The applicant provide color building elevations and building material samples for Planning Commission and City Council review and approval. 10. The grading and placement of a retaining wall adjacent to the transmission line towers shall be subject to written approval of Xcel Energy. 11. City staff and the applicant shall determine if the truck access to 58th Street North shall be removed. 12. -. Seasonal planters be provided directly north of -the four retail stores within: the sidewalk area. 13. A landscape planter containing decorative shrubbery and/or flower materials be provided at the base of the proposed freestanding sign. 14. The landscape plan be subject to review and approval by the City Arborist. 15. Trash handling locations shall be indicated on the site plan. Trash receptacles shall be located within enclosures and not be visible to surrounding public streets subject to review and approval of City staff. 16. Outside storage on the property (including trailers) shall be prohibited. 17. All wall signs not exceed 15 percent of the area of an applicable facade or 300 square feet in size. 18. The proposed freestanding sign be reduced in size from 150 to 100 square feet. 4111 19. The City finds the percentage of glass illustrated upon the proposed building elevations (approximately 9 percent) to be acceptable. Carried 4 -0. Planning Commission Minutes August 14, 2003 Page 6 of 7 20. The future Kohl's expansion of 19,200 square feet is found to be acceptable with this approval. The expansion plans shall be submitted to City staff for review and approval subject to compliance with the Zoning Ordinance and this general plan approval. 21. The applicant enter into a development contract with the City subject to review and approval of the City Attorney and City Council All cross easements and other easement documents required for this development shall be subject to review and approval of the City Attorney. D. Dvorak Rear Yard Setback Variance: To consider a request for a variance for a rear yard setback at 5989 Olinda Ave. N. City Planner Richards reviewed his report and provided an issue analysis for the request, noting that there is no hardship shown. He added that the zoning ordinance would permit a free standing screen porch to be constructed as an accessory building. He briefly discussed that the accessory building could be connected to the deck as long as there were no breezeway or roof cover constructed that would attach it to the main house. Due to the lack of hardship shown, the Commission is being asked to consider denial of the request. Chair Dwyer opened the hearing for public comment. Mike Dvorak introduced himself as the applicant and a 2'8)-year resident of the community: He inquired as to whether or not the City received any objections to his request. It was noted that none had been received. Mr. Dvorak stated that he could not understand the logic of being able to build a free standing screen porch, which would bring him closer to his property line versus that of one connected to his home which would be further away from the property line. He discussed how access to the porch would occur from the home if built off the home. He added that he spoke with one of his neighbors, who is a property appraiser, about the concept of building a freestanding porch versus one off the home. He stated his neighbor did not see the logic in building a separate structure. Discussion ensued as to the original placement of the home on the property, similar placement throughout the neighborhood, hardship possibility based upon location of home on lot, setback issues and possibilities of other locations for a screen porch or room for growth. Discussion was also had as to the concept of deck design and a screen porch structure attached to it. Chair Dwyer expressed that he is interested in looking at a hardship versus having a deck with a screen porch but prior to creating precedence he would like more information about the neighboring lots. Chair Dwyer noted that based upon the Commission's charter requirements, they are forced to deny the request based on lack of a hardship being shown. However if there is a case for hardship he expressed his willingness to look at the neighborhood as a whole. • Commissioner Powell, seconded by Vice Chair Runk, moved to continue the public hearing to September to allow time for additional information to be provided. Carried 4-0. Discussion ensued as to information the Commission would like to see in September, including that of setbacks of neighboring homes, zoning regulations in place at time home was constructed. The Commissioners will take a closer look at neighborhood prior to the September meeting. New Business: A. Central Business District: Request for joint work session with City Council. McComber stated that the City Council would like to meet with the Planning Commission to discuss the Central Business District development and discussed possible meeting dates and times. Commission consensus was to schedule the work session for 5:30 p.m., August 28, 2003. Carried 4 -0. Old Business: A. Routson Motors /Denny Hecker - 14702 60t St. N.: Status of former Amoco site and signage issues. Richards informed the Commission that Hecker has been conducting business operations at the former Amoco site that signage has been installed and office space created within the building structure. Operating such as they are requires a conditional use permit as well as permits for work done to the site. Richards will prepare a letter to Mr. Hecker regarding_the violations of City Ordinance requirements. Informational: ➢ McComber noted the Hwy. 36 "prepare to stop" flashers were removed and that she is working to learn why. ➢ City Administrator Johnson provided an update on the former Rainbow Foods store vacancy. ➢ It was noted that Dollar Tree store has left the Oak Park Ponds retail center. The house was constructed in 1957 when this neighborhood was still a part of Baytown Township and under Washington County regulations. At the time of construction, the County/Township did not have zoning regulations. In fact, the County's first zoning ordinance was not adopted until 1967..... Before that time, there were no setback :requirements. . • The first Village of Oak Park Heights Zoning Ordinance was .adopted in � November of g g 1964. The area that included the Olinda Avenue neighborhood was zoned residential. The residential standards of that ordinance specified a minimum lot size of 6,000 square feet and a front yard setback of 25 feet. The first City of Oak Park Heights Zoning Ordinance, adopted in March of 1972, zoned the area along Olinda Avenue as SFU, Single Family Urban. The current single family standards which include a minimum lot size of 10,400 square feet and a front yard setback of 30 feet were established at that time. All of the updates to the Zoning Ordinance have continued these base single family standards. 1 have also obtained copies of the section maps and aerials that include the subject properties. The Dvoraks own the properties located at the corner of 59 Street and p P ro p Olinda labeled as 0010 and 0047. The house is on lot 0010. If combined, both lots would be 13,000 square feet which would make the lot conforming in terms of lot size. The public right -of -way of Olinda Avenue varies in width and is approximately 30 feet wide adjacent to the subject property. The aerial photo indicates that the front yard setbacks of properties on the west side of _ Olinda vary .from 25 feetto 40 feet: - Most - -ef- the -he s- en- thatside -of- the-- b-Iook -w constructed with a 30 foot front yard setback. The Dvorak house was setback the greatest distance. Two other homes have 35 foot setbacks. Based upon this new background information, staff has not changed its original position that the variance for this property should be denied. Alternatives exist for an addition onto the house that will meet setback requirements. Additionally, a three season porch could be added to the property as an accessory building with required setbacks of eight feet from the rear yard, six feet from the principal structure, and five feet from side lot lines. In previous variance cases where there has been no hardship, the Planning Commission has recommended denial and the City Council has affirmed that decision. The City should avoid setting a precedence on setback issues that would not be favorable in all cases. The Dvoraks have a reasonable use of their property. They are not being denied its reasonable use, especially in light of the fact that the house can be added onto on the south or east sides and a porch could be constructed as an accessory structure in the rear yard. Thanks Gang - • PLANNING REPORT TO: Eric Johnson FROM: Cynthia Putz -Yang / Scott Richards DATE: September 4, 2003 RE: Oak Park Heights — Menards - Rezoning, Preliminary Plat, CUP Amendment, Variances and Site Plan Review FILE NO: 798.02 — 03.07 BACKGROUND The City of Oak Park Heights has received a request for rezoning, preliminary plat, conditional use permit (CUP) amendment for open and outdoor storage, variances, and site plan review to allow site and building changes at the Menards site located at the corner of 58 Street North and Krueger Lane. The existing Menards site is 11.9 'acres in size - and ItHzoned B -2, General Business District. A conditional use permit was approved for the Menards store in 1995. The applicant is proposing to add 2 % acres of land to the site. The proposed land addition was zoned Open Space Conservation District when it was annexed by the City; therefore, rezoning to B -2 is requested. The applicant is proposing to the move the lumberyard entrance to the east side of the building, construct a new garden center area, expand the outside lumberyard area, and construct a new warehouse. Variances are being requested to allow the lumberyard entrance canopy and parking to encroach into the front yard setback from Krueger Lane and to allow expansion of a screening fence that exceeds six feet in height. The Comprehensive Plan guides the subject property for a commercial use; therefore, the proposed rezoning to B -2, General Business District, is consistent with the Comprehensive Plan. Open and outdoor storage is a conditional use in the B -2 District. Preliminary Plat. The Menards expansion shall be contingent upon the applicant submitting a revised preliminary plat and a final plat that combines the proposed expansion area with the existing Menards property. Conditional Use Permit. Within the B -2 District, open and outdoor storage, such as associated with the proposed Menards store, is allowed as a conditional use provided that: a. The area is fenced and screened from view of neighboring residential uses or if abutting a residential district in compliance with Section 401.15.E. of this Ordinance. Storage is screened from view from public right -of -way in compliance with Section 401.15.E' of this Ordinance. c. Storage area is grassed or surfaced to control dust. d. All lighting shall be hooded and so directed that the light source shall not be visible from the public right -of -way or from neighboring residences and shall be in compliance with Section 401.15.B.7 of this Ordinance. e. The provisions of Section 401.03.A.8 of this Ordinance are considered and satisfactorily met. Each of these conditions is discussed in greater detail below. Generally speaking, however, the submitted plans are generally in compliance with these conditions. Access. The Menards site is accessed from two existing curb cuts on Krueger Lane. The preliminary plat includes a cul -de -sac off of 58 Street North to serve future commercial development west of the Menards site. A condition of the Rainbow service station approval was that a road easement be provided across Oak Park Ponds (Rainbow site) to connect the subject site with Neal Road to the west. Bob Brackey, the 2 owner of the property to the west of Menards, has contacted the current Oak Park Ponds owner, Prudential insurance, regarding the potential access. As of the date of this report, Prudential Insurance has not responded to Mr. Brackey's inquiry. • The Menards expansion will not require any new accesses and the amount of land left to be developed in the future is not large; therefore, City staff feels comfortable with the proposed cul -de -sac from 58 Street and do not see a need for an easement to direct traffic to Neal Road. The City Engineer addresses the issue of the cul -de -sac in his memo attached in Exhibit K. Lumberyard Entrance. The required front yard (Krueger Lane) setback in the B -2 District is 40 feet. The lumberyard entrance canopy is proposed to be located approximately 28 feet from front lot line; therefore, a setback variance has been requested. The City Engineer initially had concerns about the relocation; however, the site plan has been redesigned to include adequate stacking space. City staff now view the relocation favorably provided that signage is installed to direct delivery trucks to use the north entrance on Krueger Lane, which will allow adequate truck maneuvering space. The variance may be granted based on a finding that the proposed lumberyard entrance location is the best location on the site due to physical constraints caused by the existing storm water pond, building design and location, and required truck maneuvering space. Fence. The applicant has requested a variance to extend the existing screening fence structure along the south and north ends of the outside lumberyard area. The height and design of the proposed fence is consistent with the existing fence conditions, for which a variance was previously granted. This structure serves a dual purpose in that it functions as a storage rack for materials on the.. interior side of:.the fence. Section 401.15.E.4.a of. the Zoning Ordinance states that fences or.. walls located on or adjacent to any property line bordering a public road or street shall 'not exceed six feet in height. Plans submitted by the applicant indicate that the screening' fence will be approximately ten feet in height along the south property line and approximately 14 feet in height adjacent to the storm water pond. The fence will be finished with 2' x 8' vertical wood siding. City staff believes that the height of the proposed screening structure is appropriate and necessary to ensure that the outdoor storage area is properly screened from adjacent uses; therefore, approval of the variance request is recommended. In order to ensure the proposed screening is effective, the applicant shall be restricted from storing materials in a manner that they extend above the height of the screening fence /storage racks. Landscaping /Screening. The applicant is proposing to transplant trees and shrubs into the areas surrounding the new construction. The proposed landscaping is consistent with the existing landscaping and serves to provide screening of structures and parking. Tree replacement and the landscape plan are subject to review and approval by the City Arborist. City Arborist comments are attached in Exhibit K. 3 Lighting. The proposed lighting plan appears to be a continuation of the existing lighting pattern. A photometric plan was submitted that illustrates zero illumination at lot lines. We recommend that lighting be required to be dimmed after 11:00 p.m. Parking. A variance was approved in 1995 to allow 405 parking spaces. The current plan shows 406 existing spaces and a proposed increase of 16 spaces to 422 spaces. As many as 607 parking spaces could be required based on current parking regulations and the size of retail and warehouse floor area in the principal building. In the past, the parking supply has been very adequate; therefore, staff finds the limited increase in parking spaces to be acceptable and in proportion to the expected limited increase in parking demand due to the new warehouse and enlarged lumberyard area. The new parking on the east side of the building encroaches into the required ten -foot property line setback; therefore, a variance has been requested. Staff does not expect the proposed encroachment to have a negative impact on any property or the public. The City may find the parking arrangement acceptable due to the lack of negative impact and the hardship created by the existing site arrangement and limited options for expansion. Signage. Signs are proposed on the new entrance gate canopy. Directional signs are allowed provided they do not exceed four square feet each. In 1998 a variance was approved to allow one "lumber yard entrance" sign that exceeded four square feet in size; therefore, the size of the "lumber yard entrance" sign currently proposed on the front of the canopy is consistent with past approvals. The sizes of the signs on the south side of the canopy are acceptable because they are located on the interior of the lumberyard and will be screened from outside view. The canopy elevation notes that all of the signs _. will be lighted, but does not provide details of the method of lighting. It appears that the signs do not comply with lighting requirements. If external lighting is proposed, there shall be no exposed light sources or fixtures unless decorative fixtures are utilized and the light source is fully concealed and diffused. If the sign is internally illuminated, there shall be illumination of the text only. The proposed "in" and "out" signs are directional and allowed, but must be revised because they are six square feet in size and appear to include lighting of the entire sign. One option would be to have lighted channel lettering with the canopy as a background. That option would reduce the size of the signs without reducing the size of the lettering and comply with lighting requirements. Two red flag -like banners are proposed on the lumberyard entrance gate. The sign ordinance prohibits the use of more than two banners on a property. Banners are defined as attention getting devices that resemble flags and are of a paper, cloth or plastic -like consistency. Four red flag -like banners already exist on the principal building; therefore, no additional banners are allowed. 4 • Public Address System. As with the original CUP application, the City reserves the right to require the applicant to reduce the output volume of the public address system or require the implementation of a radio pager system for all employees should the proposed public address system become a public nuisance. Hours of Operation. As with the original CUP application, in order to protect adjacent uses from negative impacts resulting from increased traffic and noise, the Menards store shall be required to maintain hours of operation within the period from 8:00 a.m. to 9:00 p.m., Monday through Saturday, and 10:00 a.m. to 8:00 p.m. on Sundays. Delivery, unloading, and movement of goods and materials shall be limited to these times as well. Grading and Drainage. Grading and utility plans are subject to review and approval by the City Engineer. We recommend that slopes be graded where the screening structure and storm water pond meet to avoid any potential flooding of the lumberyard area. Storm water management is subject to review and approval by the City Engineer and Browns Creek Watershed District. The adjacent storm water pond was designed to accommodate future development of the surrounding area. Building Materials. The submitted elevations illustrate that the garden center addition on the west side of the building and the lumberyard entrance canopy on the east side of the building are both compatible with the existing building and are acceptable. The new 10 warehouse building will be visible from both 58 Street and the newly platted cul -de- sac; therefore, its appearance is important. The south and west sides of the proposed warehouse building will be sided with vertical wood siding that matches the screening structures. Staff recommends that the roof be a dark green or dark brown color to blend with the surroundings. The applicant shall provide elevation.. drawings of the south and west sides of the warehouse building and provide building ..material . samples for Planning Commission and City Council review and approval. 1 CONCLUSION AND RECOMMENDATION The proposed rezoning from Open Space Conservation to B -2, General Business is consistent with the Comprehensive plan and adjacent land uses. The proposed subdivision and platting of a cul -de -sac street west of the Menards site provides for future development and associated traffic. The proposed relocation of the lumberyard entrance, construction of a garden center area, expansion of outside yard area, and construction of a new warehouse are all generally consistent with the previously approved conditional use permit and variances for the site. New variances are being requested to allow the lumberyard entrance canopy and parking to encroach into the front yard setback from Krueger Lane and to allow expansion of a screening fence that exceeds six feet in height. Based on the preceding analysis, our office recommends approval of the following: A. Rezoning from Open Space Conservation to B -2, General Business District. B. Preliminary Plat to divide property and add to the existing Mendards site. 5 C. Amended conditional use permit to allow expansion of open and outdoor storage. D. Variance from 40 -foot front yard setback requirement to allow the lumberyard entrance canopy as close as 28 feet from the east property line. E. Variance from the 10 -foot parking setback requirement to allow parking as close as three feet from the east property line. F. Variance from the fence height regulations to allow expansion of a 14- foot -high fence /storage rack surrounding the outdoor storage area. Approval of the amended conditional use permit and variances shall be contingent upon all the conditions of previous approvals and the following conditions: 1. The applicant must submit a revised preliminary plat and a final plat that combines the proposed expansion area with the existing Menards property. 2. Signage must be installed to direct delivery trucks to use the north entrance on Krueger Lane, which will allow adequate truck maneuvering space. 3. No materials stored or stacked in the storage yard may exceed a height of 14 feet, or be visible from outside of the storage yard. 4. I confirmed the tree inventory and noted that a number of the trees are in fair -poor condition and do not have good form, 2. The landscape plan shows existing landscaping and areas where evergreens currently on site will be transplanted and also areas where evergreens from the acquired property will apparently be transplanted. Not all of these trees are in good condition or form; therefore some of them would not be acceptable as landscape trees for the new project. I propose that a representative of Menard's and I walk the area and choose which trees will be transplanted. For any trees which are not acceptable as transplants to the new landscape, Menard's would need to purchase planting stock of an appropriate species and size. 3. As part of the site and plan review, I inspected the existing landscape. Some of the evergreens originally planted on the south and east sides of the existing building are dead, dying or missing. Altogether there are 6 trees which need to be replaced (these will be marked 9/2 with orange paint (stumps/locations) or flagging (trees)). These should be replaced with 8 -10 ft. 'Black Hills' white spruce. The flowering crabapple tree ('B') which is indicated to be moved to a new position in the median at the NE comer of the parking lot, is not there. A new one (2 in. diameter) should be planted. 4. In addition, all existing evergreens should be re- mulched with 4 inches of wood chip mulch from trunk out to branch spread. Vines and volunteer trees and shrubs should be removed from around and underneath existing evergreens. 5. Until it is clear how many of the trees will actually be transplanted from the acquired property to the new project, I cannot calculate the tree replacement required. The revised site plan dated September 8, 2003, includes lighting in the building overhangs in the garden center area and behind the building. It also includes a four - foot -high concrete wall topped by a wrought iron fence with decorative lighting. This is located in the former yard entrance area. The top of the fence is approximately 13 feet above the ground level. Because it is more than eight feet in height, it is included in the fence height variance request for the site. j (, • We recommend that the decorative lighting be eliminated because it is not necessary and is not a hooded style. The warehouse elevations dated September 8, 2003, illustrate that the sides of the building that will be visible from adjacent properties, which are the south and west sides, will be finished with wood siding to match the adjacent screening structures. The siding is oriented vertically on the screening structures and south side of the warehouse. The siding is oriented horizontally on the west (rear) side of the warehouse to provide structural rigidity for the storage system on the interior of the building. • We recommend that the west (rear) side of the warehouse be sided with vertical wood siding to match the screening structures and south side of the warehouse. Lighting details have been submitted for all exterior lights. • Yard and soffit lights must be mounted horizontally (at a 90 degree angle to the wall or pole) and must be a full cutoff design (the lens must not extend below the fixture). The applicant has questioned the need for condition #10 in the planning report limiting hours of operation. Our concern is generally with the noise created by truck traffic and the beeping sound that is created by yard equipment when it backs up. • We recommend revising condition CO to read as follows: "Delivery, unloading, and movement of goods shall be limited to 8:00 a.m. to 9:00 p.m., Monday through Saturday, and 10:00 a.m. to 8:00 p.m. on Sundays." The applicant has also inquired regarding whether the City's sign regulations apply to the signs on the entrance gate canopy because they are relocated signs rather than new sig ns. Section 401.15.A.4 states that no non - conforming building, structure or use shall be moved to another lot or to any other part of the parcel of land upon which the same was constructed or was conducted at the time of this Ordinance adoption unless such movement shall bring the non - conforming into compliance with the requirements of this Ordinance. • We continue to recommend that the "in" and "out" sings on the lumberyard entrance canopy be revised to each not exceed four square feet in area.
