The Planning Commission, at its April 12, 2018 meeting, continued the public hearing and recommended the Applicant provide additional information on the project before making a recommendation. The primary issue discussed by the Planning Commission was the request to exceed the 35-foot height limit. The building as proposed is 47 feet, 10 inches with four stories, which requires a Conditional Use Permit. They requested that the applicant provide perspective diagrams showing the Holiday Inn Express building with the adjacent Stillwater Motors and Century Power building elevations. The Applicant provided the perspective diagrams as attached. At the May 10, 2018 meeting, the Planning Commission discussed the building height and reviewed the perspective diagrams. There were four members present at the meeting. The Planning Commission recommended each of the following items on a unanimous vote: • Conditional Use Permit for Reduced Front Yard Setback • Conditional Use Permit for Reduction in Number of Parking Stalls • Conditional Use Permit for Number of Wall Signs • Design Guidelines/Site Plan Review Page 56 of 220 A motion to recommend the Conditional Use Permit to exceed the building height requirements and allow a four-story building at 47 feet 10 inches failed on a two/two vote. The members opposed to the motion expressed concern that the structure was too tall and out of context with the surround buildings. They cited the criteria for approval of Conditional Use Permits, Section 401.02.;.A.7.e which states 'The impact on character of the surrounding area." CONCLUSION/ RECOMMENDATION A resolution is attached that reflects approval of the proposed Holiday Inn Express including the request for the building height Conditional Use Permit. Drainage calculations for the site. 2. Perspective diagrams showing the Holiday Inn Express building with the adjacent Stillwater Motors and Century Motors building elevations. This should be shown from Highway 38 as well as the corner of 58w'Street and Memorial Avenue North. 3. A revised site plan that shows proof of parking stalls to meet the required number by ordinance, or a plan that indicates how parking will be addressed during high occupancy times. Exhibit 1 outlines the response from Ramaker and Associates, the Project Engineer. 1. The.Engineer is working on the drainage calculations and it is eXpected they will be completed before the Planning Commission meeting, The City Engineer does not anticipate any engineering issues that will impact the site pian. 2. The perspective diagrams are'attached. For reference the highest Stillwater-Motors building is 35 feet The hi st a f parapet of the �eP :of the Century Power building is 28 feet 'The hotel.is proposed at 47 feet, 10 inches. 3. The site plan has been reviewed by the Fire Chief with recommendations on fire equipment access. A revised site plan is attached with 105 parking stalls and seven additionai,proof of parking stalls for a total of 112: The site requires 115 pprldng stalls by Zoning Ordinance standards. The� Applicant IS requesting• a 'Conditional Use Permit to vary from the requirement and has indicated in the narrative the justification for the lesser number of stalls. Based upon"other hotels of this size, the proposed_parking will .adequately serve the site. CONCLUSION I RECOMMENDATiCN Subject to the preceding review,. City staff recommends the Planning Commission consider the following listed.requests subject tortheconditions that follow Conditional Use Permit for Reduced Front Yard Setback • Conditional Use Pemmit for Reduction in Number of Parking Stalls • Conditional Use Permit to Exceed the Building Height Requirements Conditional Use Permit for Number of Wail Signs Design Guidelines/Site Plan Review 2 Page 64 of 220 1. The Applicant shall agree to escrow sufficient funds, as specified by the City Engineer, to complete the improvement of Memorial Avenue North to an urban section, including all trails or sidewalks or agree that the City will complete the work and petition for the public improvement, waiving notice of public hearing and assessments, as required under Minnesota Statute 429. 2. The sidewalk from the main entrance to the hotel should be extended at this time to the roadway pavement When Memorial Avenue North is reconstructed, a sidewalk will be added along this roadway. 3. All grading, drainage, erosion control, and utility plans are subject to review and approval of the City Engineer. Storm water plans are also subject to review and approval of the Browns Creek Watershed District 4. All light fbdures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.8.7 of the Zoning Ordinance as it relates to lighting requirements. 5. The Planning Commission shall comment on the lighting of the building's architectural features and the proposed light fixtures. O. All signs shall be designed to comply with the Zoning Ordinance requirements for Internal Illumination. 7. The Planning Commission shall comment on the building design and building materials. The applicant shall provide building material samples for Planning Commission review. 8. All mechanical equipment on the roof or on the site shall be fully screened In accordance with the provisions of the Zoning Ordinance. 9. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. No parking stalls shall be used for snow storage. 10. The Planning Commission should consider whether to allow the Conditional Use Permit for a forth wail sign. 11. The landscape plan shall be subject to the review and approval of the City Arborist. 12. A bike rack should be identified on the site plan and placed on site. 13. Responses to 4/2012018 CUP Application Letter 3 Staff Comments: 1. Drainage calculations for the site: a. Calculations are still in progress currently and are not complete. We do have results of the soil borings,which did not reveal anything detrimental to the storm water drainage calculations. Our struggle has been with the watershed district. We have reached out numerous times to gather information necessary to complete our calculations. We are finally scheduled for a call with the district on Friday,April 27ffi. If we can get the information needed during the call,we can work on the calculations the week of April 30 and have the report to you soon after that. 2. Perspective diagrams: a. As an attachment to this response,we have included several views of the hotel from different viewpoints. The views show that the due to the location of the hotel on our site,the 4-story height does not adversely impact the neighboring properties. We also included an aerial view of the area to display the relationship of the hotel building to the neighboring properties. As you can see there is no impact from Highway 36 due to the height of the hotel. b. One other item for thought regarding the building height. Some of the other buildings mentioned that are 2 or 3 story hotels currently operating in Oak Park Heights. Of note is that most of these buildings have a pitched roof that when compared to the height of our parapet(flat roof)are not that much different 3. Revised Site Plan: a. Immediately after the PIanning Commission meeting on April 12,we took to the task of refining the site plan. At that time,we were able to get 2 additional parking stalls plus 7 proof of parking stalls achieve the code required 115 stalls. We then received notification on April 171 from the Fire Chief with the requirements for routing a fire truck through the site with access to all four sides of the building. Needless to say,this threw us off with the site layout. We ran several scenarios to get the truck access as required. We were able to achieve the truck routing and access to all four sides of the building(see attached diagram with truck routing). Unfortunately,we did lose a few stalls in this process. The revised site plan now has 105 parking stalls plus 7 proof of parking stalls for a total of 112. It should be noted that 5 of the proof of parking stalls would require a parking setback variance. These arc located on the north end of the property,adjacent to HWY 36 so there is a large ROW beyond our property boundary.As stated previously,based on our years of experience with numerous hotels of this size,we still firmly believe this is a sufficient amount of parking for 98 hotel units. The property is zoned B-3 Highway Business and Warehousing District Motels/hotels are a Conditional Use provided that the lot area contains not less than five hundred(500)square feet of lot area per unit.With a 2.4-acre(104,599 square foot) site, and 93 units proposed, there is more than adequate lot area. Requests for a reduced front yard setback,reduction in number of parking stalls,allowance for number of wall signs, and request to exceed the building height requirement have also been made. A discussion of each of these requests will be made as follows in this report. Comment: The project narrative addresses in detail how the project will comply with the Minnesota Sustainable Building 2030 energy standards. There are some aspects of those standards that the project will not be able to comply. Additionally,the hotel w0 utilize the Green Engage program that will help the hotel"monitor,reduce,and manage waste,water and energy consumption and carbon emissions. The Impact upon existing public services and faculties Including parks, schools, stets, and utilities,and the City's service capacity, 9, The proposed use's conformity with all performance standards contained herein(l.e.,parking,loading, noise,etc.). Comment The Planning Commission and City Council should review the above criteria regarding the request for Conditional Use Permits. City Staff sees no Issues with the requests as proposed, except for the fourth wall sign. As discussion of that request is as follows in this report. Paring. The Zoning Ordinance, in Section 401.15.F, requires one space for each rental unit plus one additional space for each 10 units, plus one space for each employee shift for hotels. Per this requirement, the site would require 115 parking spaces. The site plan Indicates 106 parking spaces on site. The Applicant Is requesting a Conditional Use Permit to vary from the requirement and has indicated in the narrative the Justification for the lesser number of stalls. Based upon other hotels of this size, the proposed parking will adequately serve the site. The site will also accommodate five disability accessible stalls in compliance with requirements. All the parking stall end driveway dimensioning is within the requirements of the Zoning Ordinance. Traffic Circulation/Curb Cuts. The site will be accessed by Memorial Avenue North with two curb cuts. The Zoning Ordinance indicates that driveway access curb openings on a public street shall not be located less than 40 feet from each other for commercial properties. The two curb cuts are significantly more than 40 feet apart As development continues In this area, it Is expected that Memorial Avenue North will be reconstructed as an urban section of roadway with curb and gutter as welt as sidewalks. The City will condition approval of the project on the Applicant agreeing to escrow sufficient funds, as specified by the City Engineer, to complete the Improvement or agree that the City will complete the work and petition for the public Improvement, waiving notice of public hearing and assessments, as required under Minnesota Statute 429. Pedestrian Access. The site plan indicates a connection to a futiure sidewalk on Memorial Avenue North. The sidewalk should be extended at this time to the existing roadway pavement When Memorial Avenue is reconstructed, a sidewalk will be added 7 Page 80 of 220 along mms roadway. Having the connection on the hotel properly at this time will assure pedestrian access to the site. Snow Storage. The plans do not Indicate an area for snow storage. The applicant shall provide a plan or indicate If snow will be hauled off the site. Landscaping. The submitted landscape plan Is subject to City Arborist review and approval, City Arborist comments are found as an Exhibit to this report Lighting. The submitted photometric plan Illustrates light levels are within the maximum requirements of the lighting standards found in Section 401.15.B.7 of the Zoning Ordinance. Light standards may not exceed 25 feet from the ground surface to the top of the light fbcture. The lighting plans indictee pole heights at 30 feet, but the nanativve indicates the pole height at 15 feet. The plans wiI need to be revised to reflect a compliant pole height. The freestanding light fixtures, as provided in the application Materials, are to be a LED fixture that will be full cut off, including the bollard lights at the front of the building. There are several wall fixtures proposed for the structure. The architectural accent lights are proposed to provide up, side and dawnlighting. The City has only allowed down or up architectural lighting. The plans should be revised to reflect his change. The Zoning Ordinance allows for decorative fixtures and lighting of architectural features, subject to approval of the City Council. The Planning Commission should comment on the use of the architectural.fighting. Ail light fixtures will need to Comply with Section 401.1.5.B.7 of the Zoning Ordinance as it relates to lighting requirements. Trash Storage. The plans show the location and design of the trash enclosure. The structure will be constructed of brick to match the hotel and the gates will be metal. Mechanical Screening. The plans indicate that the roof top mechanical units are provided with screening enclosures. All mechanical equipment shall be required to be screened as provided in accordance with the Zoning Ordinance requirements. Grading. Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and Witty plans are subject to review and approval by the City Engem. There are additional engineering details tad have bin requested by the City Engineer. These items will need to be provided prior to approval by the City Council. Storm water issues are also subject to review and approval by the Brown's Creek Watershed District. Signage. Freestanding Sign, The applicant has proposed one monument sign at the southerly entrance to the site. The proposed monument sign would be 20 square feet In size and six feet In height. The sign regulations allow for the monument sign as proposed. 8 Page 81 of 220 Wall ace. Staff would recommend that three signs be allowed, in that it Is consistent with most of the signage allowed on the Highway 36 corridor. The total allowable wall sign area, would be 500 square feet in that the site is within the Destination Retail Highway District With the monument sign the proposed sign area is 508 square feet, which is allowable. Sion Ilurninatlon, The monument sign is proposed to be internally lit. The wall signs are internally lit and will be compliant with the Ordinance. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines Sustainable Guidelines. The project narroaiive addresses how the project will comply and not comply with the Minnesota Sustainable Building 2030 energy standards. Additionally, the hotel will utilize the Green Engage program, that will help the hotel "monitor, reduce, and manage its consumption and emissions. An explanation of that program is found as Exhibit 19. Architectural Guidelines. Facade Treatments The building will have a definite base, middle and top. The facades feature different materials, textures and colors. There Is also a prominent entrance canopy and a varied parapet height to provide architectural interest 9 Page 82 of 220 Ground Level Expression This is a four-story building with excellent visibility to Highway 3e. The main entrance is well defined by different building materials and the entrance canopy. Transparency The building uses glass on all the facades. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The ground floor of the facade facing Memorial Avenue is 23 percent transparent, The building features a prominent entry with an entrance canopy. Roof islan The roolllne is broken by a raised parapet at the front entrance. The rflofbop mechanical equipment will be completely screened, except that one box is shown as not being saeened. The Applicant should provide more Information. Building Materials and Colors The applicant has provided color elevations for review. The primary building materials of brick, stOne and glass will comply with the guidelines except that the east and wast facades fall a few percentage points from the recommended amount of primary building materials. The Planning Commission should comment. None of the prohibited building materials will be used, Bulldkng material samples will be available at the Planning Commission meeting. Franchise Architecture The building i$ a 'franchise design, but the design and materials comply with the Design Standards. This should bediscussed by the Planning Commission. G?c e. ta 00 VNO Of0 .. t; . • Ii t II arrow.- tittilitti 1 Z Illtilittttt"11 �` engage I 3 Page 134 of 220 A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RECOMMENDING TO THE CITY COUNCIL THAT THE REQUEST BY MADISON HOSPITALITY GROUP FOR CONDITIONAL USE PERMITS AND DESIGN GUIDELINES/SITE PLAN REVIEW TO CONSTRUCT A HOLIDAY INN EXPRESS AT 5921 MEMORIAL AVENUE NORTH SHOULD BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Madison Hospitality for a Conditional Use Permit for a reduced front yard setback, a Conditional Use Permit for a reduction in the number of parking stalls, a Conditional Use Permit to exceed the building height limit, a Conditional Use Permit for number of wall signs, and Design Standards/Site Plan review to construct a Holiday Inn F,xpress at 5921 Memorial Avenue North and after having conducted a public hearing relative thereto, the Planning Commission of the City of Oak Park Heights makes the following findings of fact: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT and 2. The applicant has submitted an application and supporting documentation to the Comity Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property is zoned B-3, Highway Business and Warehouse District which allows hotels as a permitted use; and 4. A Conditional Use Permit shall be required to allow a reduction in the front yard setback to 25 feet from the property line to the canopy structure; and 5. A Conditional Use Permit shall be required to allow a reduction ofparking stalls to 105 and seven additional proof of parking stalls fora total of 112; and 6. A Conditional Use Permit shall be required to exceed the building height limit to a maximum of 48 feet; and 7. A Conditional Use Permit shall be required to allow one additional wall sign for a total of four wall signs, each on a separate facade of the building; and Page 135 of 220 8. Design Guideline/Site Plan approval is required for the new building and site improvements; and 9. City staff prepared planning reports dated April 5,2018 and May 2,2018 reviewing the request; and 10. Said report recommended approval of the request for Conditional Use Permits and Design Guideline/Site Plan review with conditions; and 11. The Planning Comnission held a public hearing at their April 12,2018 and May 10,2018 meeting, took comments from the applicants and public, closed the public hearing, and made the fallowing recommendation: NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted from Madison Hospitality for a Conditional Use Permit for a reduced front yard setback, a Conditional Use Permit fur a reduction in the number of parking stalls, a Conditional Use Permit for mmrber of wall signs and Design Standards/Site Plan review to construct a Holiday Inn Express at 5921 Memorial Avenue North ahecting the real property as follows: SEE ATTACHMENT A The Planning Commission recommends to the City Council of the City of Oak Park Heights approval of the following: • Conditional Use Permit far Reduced Front Yard Setback • Conditional Use Permit for Reduction in Number of Parking Stalls • Conditional Use Permit for Number of Wall Signs • Design Guidelines/Site Plan Review The Planning Commission did not make a recommendation on the request to exceed the building height to a maximum of 48 fleet. A notion to recommend allowing the building height as proposed failed on a two/two vote. The members opposed to the motion expressed concern that the structure was too tall and out of context with the surrounding buildings. They cited the criteria for approval of Conditional Use Permits, Section 401.03.A.7.e,which states "The impact on character of the surrounding area." Be and the same is hereby recommended by the Planning Commission of the City of Oak Park Heights subject to the conditions as follows: 1. The Applicant shall agree to escrow sufficient funds, as specified by the City FnpjnPer, to complete the improvement of Memorial Avenue North to an urban section, including all 2 Page 136 of 220 tray or sidewalks or agree that the City will complete the work and petition for the public improvement, waiving notice ofpublic hearing and assessments, as required under Minnesota Statute 429. 2. The sidewalk from the main entrance to the hotel should be extended at this time to the roadway pavement. When Memorial Avenue North is reconstructed, a sidewalk will be added along this roadway. 3. All grading, drainage, erosion control, and utility plans are subject to review and approval of the City Fngineer. Storm water plans are also subject to review and approval of the Browns Creek Watershed District. 4. All light fixtures shall be full cut og compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. 5. The Planning Commission was favorable to the proposed lighting of the building's architectural features and the proposed light fixtures. 6. All signs shall be designed to comply with the Zoning Ordinance requirements for internal rumination. 7. The Planning Commission was favorable the building design and building materials. 8. All mechanical equipment on the roof or on the site shall be fully screened in accordance with the provisions of the Zoning Ordinance. 9. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. No parking stalls shall be used for snow storage. 10. The landscape plan shall be subject to the review and approval of the City Arborist. 11. A bike rack should be identified on the site plan and placed on site.
