Background/Justification:
The City Council considered this item at its meeting of January 23, 2001 and voted to table the
discussion until additional information was provided including information regarding the drainage to
the stormwater pond and noise decibel levels from the vacuum area. Please refer to the attached
enclosures.
As you will recall, the Planning Commission considered this application at their 12/14/2000 and
1/11/2001 meetings and voted unanimously to recommend that the City Council approve this
application.

MEMORANDUM

Following the January 23, 2001 City Council meeting, the applicant has provided revised plans
to address the setback issues with the proposed Pony Express Auto Wash on Neal Avenue
(see attached). The car wash as proposed can be accommodated on Lot 2, Block 1 of the
Jacob 2nd Addition plat presented at the January 23, 2001 meeting.
Please find the following comments regarding the revised plans for the Pony Express Auto
Wash:
1 . The building has been redesigned and reconfigured on the lot so that all setback
requirements have been meet. The building is more than 40 feet from the Neal Avenue
frontage, and is 40 feet from the Highway 5 right-of-way consistent with Section
401 .15.B.4.c of the Zoning Ordinance. The parking and driveway areas are all within
the 10 foot setback requirement of the ordinance.
2. More than adequate parking stalls (27) have been proposed on the revised site plan.
The parking requirement for this project is 16 parking stalls. The applicant has the
option of reducing the numbers of stalls. In addition, the stalls on the lot line adjacent to
the drainage pond should be reconfigured so that the paving is off of the easement
area.
3. Building plans have been updated indicating the revised elevations incorporating the
Planning Commission recommendations. A revised floor plan of the building interior
has also been included.
4. No changes to the landscape plans were presented with the revised plans. The
increased setback area adjacent to Highway 5 would allow for more groupings of
landscaping material similar to what was approved for TCF in this area. The applicant
should work with the City Arborist in finalizing an appropriate plan.
5. No significant changes to the grading and drainage plan was required with the new
plan. The City Engineer is reviewing the drainage issues associated with the car wash
site as it relates to the existing ponding area. He will provide a report for discussion at —the City Council meeting. The applicant has been advised to contact the Brown's Creek
and Valley Branch Watershed Districts and receive any approvals if necessary from
those organizations.
6. The freestanding monument sign shall be relocated at least 10 feet from the property
line on Neal Avenue.
7. More noise information for both the car drying equipment and the vacuums has been
provided by the applicant for review by the City Council(see attached).
Based upon the conditions of approval recommended by the Planning Commission with the
revisions that reflect the new site and building plans, please find the following
recommendation:
The site plan, Design Guideline review and conditional use permit approval to allow
construction of a car wash on Neal Avenue is subject to the following conditions:
1. The City Council approves the vacation of drainage and utility easements on Block 2,
Lot 2, Jacob Addition and preliminary and final plat for Lots 1 and 2, Block 1, Jacob 2nd
Addition.
2. The applicant provide a minimum of sixteen (16) off-street parking stalls on site. All of —
the parking stalls shall be configured so as to be located off of the drainage area.
3. The final landscape plan is subject to review and approval by the City Arborist.
4. All exterior lighting shall be hooded to direct light toward the ground and away from
adjacent rights-of-way at not greater than 90 degree angle.
5. The freestanding monument sign shall be located at least 10 feet from the Neal Avenue
rig ht-of-way.
6. The applicant shall submit grading and drainage plans that incorporates all drainage
systems and parking areas with curb and gutter. All grading, drainage and utility plans
are subject to review and approval of the City Engineer.
7. The applicant is advised that City approval is not inclusive of other necessary
governmental permits and approvals, including but not limited to, State and County
Highway Departments,Watershed Districts and others that may apply.

whether or not this site Is located within your watershed boundaries.
The site is Lot 2, Block 1 of Jacob's Second Addition, located in the City of Oak Park Heights at the
intersection of Highway.5 and Highway 36.
Please let us know if this site is within your boundaries. If it Is, we will discuss with you further, what
process and permits need to be completed for watershed approval of this site.
