The Low bid was$585,047 out of a total of three bids received. These would be costs to the Developer for the required streets,water,sanitary and storm systems.The City should take a formal action to rated any bids as received at this time. Staff would recommend the rejection of the bids.Bid Tab is enclosed. ISSUE#2 A second issue is that the developer is requesting that the City rebid these elements in hopes of receiving a more favorable price. However,this in-effect would be fourth project extension as the last extension granted by the City in January 2017 required that the Developer was obligated to move forward after the receipt of the bids and its°immediate construction thereafter".This timing and information was also relayed to the public. Moving forward,rebidding of the project has no material economic effect on the City as these costs are those of the developer; however,Staff would recommend considering that a communication be made to the neighborhood inviting them to a public hearing on what is essentially a fourth project extension and to determine if there are any new issues or matters that have arisen since the initial Council approval in 2014. Reasonably,the City would be well within Its rights to require the Developer to proceed through the development review process again and re-open the project to public engagement,as the City has provided three extensions in the past. However,practically- if the Developer resubmitted a similar package for the City's plan review process,it is likely that the outcome would be similar as the land uses remain compatible with the Comprehensive Plan and Zoning elements. Accordingly,Staff iS suggesting!a middle around between a stately atowance of a fourth extension and an entirely new process which iS: Hold a public hearing on June 12,2018 and invite the neighborhood to comment on a fourth extension and see if there are any new elements or concerns that have arisen;and,if there are,that these either be addressed immediately by the Developer as deemed reasonable by the Council or perhaps—based on that feedback-the Council may then determine to reject the fourth extension and require the developer to re-submit its plans and under MN Stat 15.99 and the City's review process. Either way,Staff is suggesting some further public engagement before any extension is granted. (Note: In the interim:The Developer has requested that the City Engineer issue the re-bid package, which may include some adjustments to sanitary sewer routing and construction,and the Developer has acknowledged that this re-bid cost is entirely at the developer's own financial risk and does not circumvent any action that may take place as discussed above. This is a separate track that may offer some faster timing if the City allows a re-bid or a further extension of some form. Provide Plan B-Letter of Credit-$731,309.71. This is amended to be 125%of the final Plan B bid(Part 4. 2.B)that is to be accepted and awarded by the City.Now estimated at$585,047.77 X 125.00%=$731,309.71 2. Provide Plan A-Letter of Credit elements now estimated at$406,042.00 Please provide a to me a letter with your companys intention by 2 pm-May 17th as any award will need to be made by the City Council on May 22nd,and we do need some time to prepare the documentation.Thereafter,we will need to have these two Letters of Credit in the approved form not later than 2 pm-May 23dd so that the City may assemble and issue a Notice of Award prior to the deadline of June 2nd,2018.Without these Letters of Credit by such date of 5/23/18, the City will not issue the Notice of Award and the bids will lapse. There are likely other commitments and documents needed,Including the Waiver and Consent document for the large earth piles;however,these are the most critical in terms of the contract award at this time. Enclosed is a copy of the raw bid tabulation, the City Engineer is verifying these over the next few days. The City would need to know how you wish to proceed in the near future as these bids are generally valid for 60 days from Bid opening. The City would need to issue a NOTICE OF AWARD within this timeframe. Also, the Developer's Agreement outlines that the Developer is required to supply the City a Letter of Credit of $525,175. This is to be amended to be 125% of the final Plan B bid (Part 4. 2.B) that is accepted and awarded by the City. Now estimated at $585,047.77 X 125.00 % _ $731,309.71 F This is the revised amount of the Letter of Credit. Please also execute the Consent and Waiver document I provided earlier, provide the Letter of Credit for the PLAN A elements and provide final permits from the MSCWMO. So, please provide these documents and your firms intention as soon as possible as any award will need to be made by the City Council which only meets twice per month. A pre-construction meeting, etc. can and should then be scheduled with relevant parties as I am sure there will need to be significant coordination and dialogue. Finally, the City will be required to retain the FINAL PLAT mylars until we have a determination of how you may wish to proceed. Generally, if you do not wish to proceed the City cannot release the plat- rejecting the platting of the property. Similarly, the City would likely be required to refund any connection fees or park dedication costs that you have paid as the platting and development would not be occurring now.
