PLANNING COMMISSION
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION ESTABLISHING FINDINGS OF FACT AND
RECOMMENDING TO THE CITY COUNCIL THAT THE
REQUEST BY MADISON HOSPITALITY GROUP FOR CONDITIONAL
USE PERMITS AND DESIGN GUIDELINES/SITE PLAN REVIEW TO
CONSTRUCT A HOLIDAY INN EXPRESS AT 5921 MEMORIAL
AVENUE NORTH SHOULD BE APPROVED WITH CONDITIONS
WHEREAS, the City of Oak Park Heights has received a request from Madison
Hospitality for a Conditional Use Permit for a reduced front yard setback, a Conditional Use
Permit for a reduction in the number of parking stalls, a Conditional Use Permit to exceed the
building height limit, a Conditional Use Permit for number of wall signs, and Design
Standards/Site Plan review to construct a Holiday Inn Express at 5921 Memorial Avenue North
and after having conducted a public hearing relative thereto, the Planning Commission of the
City of Oak Park Heights makes the following findings of fact:
1. The real property affected by said application is legally described as
follows, to wit:

2. The applicant has submitted an application and supporting documentation to the
Community Development Department consisting of the following items:

and
3. The property is zoned B-3, Highway Business and Warehouse District which
allows hotels as a permitted use; and
4. A Conditional Use Permit shall be required to allow a reduction in the front yard
setback to 25 feet from the property line to the canopy structure; and
5. A Conditional Use Permit shall be required to allow a reduction of parking stalls
to 105 and seven additional proof of parking stalls for a total of 112; and
6. A Conditional Use Permit shall be required to exceed the building height limit to
a maximum of 48 feet; and
7. A Conditional Use Permit shall be required to allow one additional wall sign for a
total of four wall signs, each on a separate facade of the building; and
8. Design Guideline/Site Plan approval is required for the new building and site
improvements; and
9. City staff prepared planning reports dated April 5, 2018 and May 2, 2018
reviewing the request; and
10. Said report recommended approval of the request for Conditional Use Permits and
Design Guideline/Site Plan review with conditions; and
11. The Planning Commission held a public hearing at their April 12, 2018 and May
10, 2018 meeting, took comments from the applicants and public, closed the public hearing, and
made the following recommendation:
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING
COMMISSION FOR THE CITY OF OAK PARK HEIGHTS THAT THE PLANNING
COMMISSION RECOMMENDS THE FOLLOWING:
A. The application submitted from Madison Hospitality for a Conditional Use Permit for a
reduced front yard setback, a Conditional Use Permit for a reduction in the number of parking
stalls, a Conditional Use Permit for number of wall signs and Design Standards/Site Plan review
to construct a Holiday Inn Express at 5921 Memorial Avenue North affecting the real property as
follows:

The Planning Commission recommends to the City Council of the City of Oak Park Heights
approval of the following:
• Conditional Use Permit for Reduced Front Yard Setback
• Conditional Use Permit for Reduction in Number of Parking Stalls
• Conditional Use Permit for Number of Wall Signs
• Design Guidelines/Site Plan Review
The Planning Commission did not make a recommendation on the request to exceed the building
height to a maximum of 48 feet. A motion to recommend allowing the building height as
proposed failed on a two/two vote. The members opposed to the motion expressed concern that
the structure was too tall and out of context with the surrounding buildings. They cited the
criteria for approval of Conditional Use Permits, Section 401.03.A.7.e, which states "The impact
on character of the surrounding area."
Be and the same is hereby recommended by the Planning Commission of the City of Oak Park
Heights subject to the conditions as follows:
1. The Applicant shall agree to escrow sufficient funds, as specified by the City Engineer, to
complete the improvement of Memorial Avenue North to an urban section, including all

trails or sidewalks or agree that the City will complete the work and petition for the
public improvement, waiving notice of public hearing and assessments, as required under
Minnesota Statute 429.
2. The sidewalk from the main entrance to the hotel should be extended at this time to the
roadway pavement. When Memorial Avenue North is reconstructed, a sidewalk will be
added along this roadway.
3. All grading, drainage, erosion control, and utility plans are subject to review and
approval of the City Engineer. Storm water plans are also subject to review and
approval of the Browns Creek Watershed District.
4. All light factures shall be full cut og compliant with the height requirements, and be
consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to
lighting requirements.
5. The Planning Commission was favorable to the proposed lighting of the building's
architectural features and the proposed light fixtures.
6. All signs shall be designed to comply with the Zoning Ordinance requirements for
internal illumination.
7. The Planning Commission was favorable the building design and building materials.
8. All mechanical equipment on the roof or on the site shall be fully screened in
accordance with the provisions of the Zoning Ordinance.
9. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled
off site. No parking stalls shall be used for snow storage.
10. The landscape plan shall be subject to the review and approval of the City Arborist.
11. A bilce rack should be identified on the site plan and placed on site.
Recommended by the Planning Commission of the City of Oak Park Heights this 10th
day of May 2018.
