HomeMy WebLinkAbout1984 Resolutions RESOLUTION NO. 84- 12 -43A CITY OF OAR PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE HIRING OF OFFICER MICHAEL HAUSKEN AS A FULL -TIME POLICE OFFICER IN THE CITY OF OAK PARK HEIGHTS WHEREAS, the Chief of Police of the City of Oak Park Heights has reviewed available positions and candidates for the hiring of full -time police officers within the police department of the City of Oak Park Heights; and WHEREAS, the Chief of Police has made his report and recommendations to the City Council in this matter; and WHEREAS, the City Council after due deliberation has decided to hire additional police officers to fill the anticipated r vacancies within the police department. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: 1. That effective January 1, 1985, office Michael Hausken shall forthwith be hired as a full -time police office of the City of Oak Park Heights. 2. That the City Clerk is hereby authorized to transmit copies of this Resolution to the appropriate agencies and city staff notifying them of the appointment and employment of officer Michael Hausken. Sommerf a dt • Attest: LaVonne Wilson -i RESOLUTION NO. 84 -12 -42 CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FROM THE INTERIM CONSTRUCTION FUND THE ANDERSON /LINQUIST POND FUND TO THE COMPLETED CONSTRUCTION FUND WHEREAS, the City's Auditor has reviewed the City's records for the calendar year 1984, and WHEREAS, as a result of said review the auditor has made certain recommendations to the City Council of the City of Oak Park Heights affecting the transfer of miscellaneous and surplus funds from accounts to other accounts in order to effect a more proper accounting. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights that the City Clerk be and is hereby authorized to transfer Eight Hundred Dollars ($800.00) from the Interim Construction Fund - Anderson /Linquist Pond to the Completed Construction fund. WHEREAS, the City's Auditor has reviewed the City's records for calendar year 1984, and WHEREAS, as a result of review, the auditor has made certain recommendations to the City Council of the City of Oak Park Heights affecting the transfer of miscellaneous and surplus funds from accounts to other accounts in order to effect a more proper accounting, and . WHEREAS, the High Security Facility Fund No. 512 currently has a fund balance of Seventeen Thousand Four Hundred Dollars ($17,400.00) and the 1979 Utility Fund No. 513 currently has a balance of Twenty -one Thousand Six Hundred Dollars ($21,600.00), and WHEREAS, the City Council has determined it to be in the best interest of the City to transfer those funds to the Completed Construction Fund. WHEREAS, the City's Auditor has reviewed the City's record for the calendar year 1984, and WHEREAS, as a result of said review the auditor has made certain recommendations to the City Council of the Cit of Oak Park Heights affecting an intra -fund loan to Brekke Park Fund No. 402 and Storm Sewer Drainage Improvement Fund No. 403 from the Closed Bond Fund using an interest rate of ten percent (10%), and WHEREAS, the amount of the loan required pursuant to the recommendations of the City's Auditor to the Brekke Park Fund No. 402 is in the amount of Twenty -two Thousand One Hundred Dollars ($22,100.00), and WHEREAS, the amount of the intra -fund loan to the Storm Sewer Drainage Improvement Fund No. 403 is in the amount of Twenty - eight Thousand Eight Hundred Dollars ($28,800.00), and WHEREAS, it is feasible to make such a loan between the funds in this matter. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights that the City Clerk by and is hereby authorized to transfer and effect an intra -fund loan to the Brekke RESOLUTION 84 -12 -39 CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS FROM FUNDS NUMBERED 511, 501 AND 509. WHEREAS, the City of Oak Park Heights has embarked upon a program of cash defeasence affecting previously existing bond funds No. 501, 511 and 509, and WHEREAS, the cash defeasence program has been duly approved by the City Council of the City of Oak Park Heights, and WHEREAS, the City Auditor's office has reviewed the City's record affecting calendar year 1984 and made recommendations with regard to the cash defeasence program and the • transferring of funds in order to implement same. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights that the City Clerk be and is hereby authorized to transfer funds from account Nos. 501, 509 ad 511, to the Closed Bond Fund in order to effect the purposes of the cash defeasence program. Passed by the City Council of the City of Oak Park Heights, this 10th day of December, 1984. 7�r'�an O. ommerfeldt, Mayor ATTEST: LaVonne Wilson City Clerk /Administrator RESOLUTION NO. #84 -1 1 -36 RESOLUTION ACKNOWLEDGING RESIGNATION OF POLICE OFFICER AL COTE AND ESTABLISHING POST- RETIREMENT BENEFITS IN THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA WHEREAS, police officer Al Cote has forwarded to the City his written resignation effective December 15, 1984, from the Police Department of the City of Oak Park Heights; and WHEREAS, Al Cote has served within the City of Oak Park Heights as its police officer over a period of fourteen (14) years; and WHEREAS, the City Council of the City of Oak Park Heights finds it to be in the best interest of the City to • contribute to the cost of Al Cote's medical insurance until such time as he is eligible for medicare; and WHEREAS, during the term of his service to the City of Oak Park Heights, Al Cote has earned and received the respect of the residents of the City of Oak Park Heights and associated City staff as a result of his dedicated service, NOW, THEREFORE, BE IT RESOLVED by the City of Oak Park Heights as follows: 1. That the resignation submitted by police officer Al Cote is hereby accepted with his retirement to be effective December 15, 1984. 2. That the City Council of the City of Oak Park Heights shall pay to officer Al Cote the sum of One Hundred Fifty Dollars ($150.00) per month commencing January, 1985, to be • contributed to the cost of his private medical insurance policy with said payments to be made monthly until such time as he becomes eligible for medicare. 3. That police officer Al Cote is hereby commended for his fourteen (14) years of dedicated service to the City of Oak Park Heights and the City also hereby extends its best wishes to Al Cote for a long and prosperous retirement. Sommerreldt, Mayor ATTEST: LaVonne Wilson, City Clerk I I 2 - I i c ' RESOLUTION NO. #84 -10 -34 RESOLUTION APPROVING DEFEASANCE PROGRAM FOR CERTAIN GENERAL OBLIGATION BONDS OF THE CITY WHEREAS, the City has duly issued and presently has outstanding the issue of general obligation bonds (hereinafter called the "Refunded Bonds ") identified in Exhibit A, and has a substantial asset balance in the debt service funds for said Refunded Bonds; and WHEREAS, it appears that by (i) the purchase of government securities which are general obligations of the United States or agencies thereof in an amount sufficient so that the receipts of principal and interest thereon will be adequate to pay all principal and interest on the Refunded Bonds as such becomes due, and (ii) the deposit of such government obligations, together with any required beginning cash balance, with an independent escrow agent, the security of the holders of the Refunded Bonds will be enhanced, the remaining taxes heretofore levied for payment of the Refunded Bonds may be cancelled, and the remaining asset balances in said debt service funds will be available for general expenditure by the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Minnesota, as follows: 1. The defeasance program, as prepared by Juran & Moody, Inc. is approved. The Clerk - Treasurer is authorized to proceed, at such time as she deems appropriate, with the purchase of the securities necessary for the program. 2. The form of Escrow Agreement between the City and First Trust Company of Saint Paul, a copy of which has been presented to the Council, is approved, and the Mayor and City Clerk- Treasurer are authorized and directed to execute said Escrow Agreement on behalf of the City. The approval hereby given to the Escrow Agreement includes approval of such additional details therein as may be necessary and appropriate and such modifications, thereof, deletions therefrom and additions thereto as may be necessary and appropriate and approved by the City Attorney and the City officials authorized • herein to execute the Escrow Agreement and said City officials are hereby authorized to approve said changes on behalf of the City. The execution of the Escrow Agreement by the Mayor and the City Clerk- Treasurer shall be conclusive evidence of the approval of the Escrow Agreement in accordance with the terms hereof. Sommerfe dt, Mayor a Vonne Wilson, Administrator As • EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY MINNESOTA HELD: October 9, 1984 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Oak Park Heights, Washington County, Minnesota, was duly held at the City Hall in the City on the 9th day of October, 1984, at 7:00 o'clock _.m. for the purpose of amending the adopted schedule of repayment by tax levy for the Oak Park Heights Storm Sewer Tax Improvement District No. 1. The following members were present: Seggelke, Doerr, Carufel and O'Neal Member, Doerr , introduced the following resolution and moved its adoption: #84 -10 -28 RESOLUTION AMENDING THE ADOPTED SCHEDULE • OF REPAYMENT BY TAX LEVY FOR THE OAK PARK HEIGHTS STORM SEWER TAX IMPROVEMENT DISTRICT NO. 1 WHEREAS, the City of Oak Park Heights did create by Ordinance, a Storm Sewer Improvement District No. 1 to deal with storm water problems and to construct storm sewer systems within the area affected by reference within Ordinance 1600 of the Code of Ordinances of the City of Oark Park Heights, and WHEREAS, the City Council of the City of Oak Park Heights has previously conducted public hearings on the con- struction of the proposed improvements affecting said district, thereafter has ordered said improvements following public debate and discussion which were held at duly noted public hearings held pursuant to Statute, and • WHEREAS, the City Council has previously adopted with regard to the payment of all construction costs, miscellaneous administrative costs and other costs incurred with regard to said project, schedule of repayment to be completed by tax levy, and WHEREAS, the City Council of the City of Oak Park Heights has been duly advised by the City's financial consultant and the City's auditor and engineers that the schedule of repayment should be amended to include certain changes and costs creating increases which have been incurred by the City affecting said project, and WHEREAS, the schedule of repayment has been completed and projected by the City's financial consultant, previously being annexed to past Resolutions of this body, and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: 1. That the City Clerk of the City of Oak Park Heights is hereby directed and authorized to certify to the County Auditor in and for Washington County for calendar years 1985 and 1986 an additional tax levy of $21,650 for each year. The amount of this special additional tax levy shall be collected upon Storm Sewer Tax Improvement District No. 1 and shall be collected in addition to the tax levy previously authorized by this body. 2. That the City Council of the City of Oak Park Heights has identified Storm Sewer Tax Improvement District No. 1 to consist of property indentified within Ordinance No. 1600 and a copy of the same has also been transcribed and forwarded to the I Office of the Washington County Treasurer and Auditor along with a copy of the Resolutions previously certifying these funds for collection. 3. That the City Clerk of the City of Oak Park Heights shall also transcribe and forward to the Office of the Washington County Treasurer and Auditor a copy of this Resolution certifying the additional tax levy to be collected in calendar years 1985 and 1986 by the Washington County Treasurer. The motion for the adoption of the foregoing resolution was duly seconded by member � and upon vote being taken thereon, the following voted in favor thereof: Seggelke, Doerr, Carufel and O'Neal. and the following voted against the same: None • Whereupon said resolution was declared duly passed and adopted. WITNESS my hand the seal of said City this 10th day of October , 1984. • A LaVonne Wilson City Clerk (SEAL) • • • • SECTION 504 GRIEVANCE PROCEDURE O e City f Oak Park He' y ar fights has adopted an internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by the Office of Revenue Sharing's (ORS) regulations (33 C.F.R. 51.55 (d) (2) implementing Section 504 of the Rehabili- tation Act of 1973, as amended (29 U.S.C. 794) Section 504 states, in part that "no otherwise qualified handicapped individual shall, solely by reason of his handicap, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any pro- gram or activity receiving federal financial assistance." Complaints should be addressed to: City of Oak Park Heights La Vonne Wilson, Administrator 14168 North 57th Street Oak Park Heights, MN. 55082 612 - 439 -4439 who has been designated to coordinate Section 504 compliance efforts. 1. A complaint should be filed in writing or verbally, contain the name and address of the perso filing it. and briefly describe the alleged violation of the regulations. 2. A complaint should be filed within ten days after the complainant becomes aware of the alleged violation. (Processing of allegations of discrimination occuring before this grievance procedure was in place will be considered on a case -by -case basis.) 3. An investigation, as may be appropriate, shall follow a filing of a complaint. The investi- gation will be conducted by La Vonne Wilson, Mayor and Councilmembers. These rules contem- plate informal but thorough investigations, affording all interested persons and their represen- 0 .55 ives, if any, an opportunity to submit evidence relevant to a complaint. Under 31 (C.F.R. (d)(2), the City of Oak Park Heights need not process complaints from applicants for employment or from applicants for admission to post- secondary educational institutions. 4. A written determination as to the validity of the complaint and description of resolution, if any, shall be issued by La Vonne Wilson and a copy forwarded to the complainant no later than thirty days after its filing. 5. The Section 504 coordinator shall maintain the files and records of the City of Oak Park Heights relating to the complaints filed. 6. The complainant can request a reconsideration of the case in instances where he or she is dissatisfied with the resolution. The request for reconsideration should be made with thirty days to La Vonne Wilson. 7. The right of a person to a prompt and equitable resolution of the complaint filed hereunder shall not be impaired by the person's pursuit of other remedies such as the filing of a Section 504 complaint with the Office of Revenue Sharing, U. S. Department of the Treasury. Utiliz- ation of this grievance procedure is not a prerequisite t6 the pursuit of other remedies. 8. The assessment against each such parcel, together with interest at the rate of 11 percent per annum, accruing on the full amount thereof from the time unpaid, shall be a lien IL • concurrent with the general taxes upon said parcel and all • thereof. The total amount of each such assessment shall be payable in equal annual principal installments extending over a period of 10 years, the first of said installments, together with interest on the entire assessment from the date hereof to December 31, 1984, to be collectible with the general taxes commencing in the year 1985, and one of each of the remaining installments together with one year's interest on that an all unpaid installments, to be payable with general taxes in each consecutive year thereafter until the entire assessment is paid. 4. Prior to certification of the assessment to the County Auditor, the owner of any lot, piece or parcel of land assessed hereby may, at any time, pay the whole such assessment with interest to the date of payment to the City Treasurer but no additional interest shall thereafter be charged if such payment is made within 30 days of the date of this Resolution. 5. The City Clerk shall, as soon as may be, prepare and transmit to the County Auditor a certified duplicate of the assessment roll with each installment and the interest on each unpaid assessment set forth separately to be extended upon the property tax list of the county and the County Auditor shall thereafter collect said assessments in the manner provided by law. 6. The City Clerk shall also mail to each owner a right- of-way or public property included within the assessment roll notice specifying the amount payable by such owner as required by Minn. FUND ESTIMATED AMOUNT RECEIVABLE AMOUNT ENCUMBERED Township of Baytown $4,205.55 None • County of "tashinaton $4,205.55 Otherwise covered THIS AGREEMENT made and entered into by and between the State of i Minnesota, Department of Transportation, hereinafter referred to as the "State ", . and the County of Washington, hereinafter referred to as the "County ", and the City of Stillwater, hereinafter referred to as the "City ", and the Township of Baytown, hereinafter referred to as the "Town ", WITNESSETH: WHEREAS, it-is considered mutually desirable to install• a traffic control signal with street lights and signing on Trunk Highway No. 212 at County Road No. 66 (GreeWley Street) - Oakgreen Avenue in accordance with the plan and specifications for State Project No. 8214 -71 made a part hereof by reference; and WHEREAS, it is anticipated that the traffic control signal work Is eligible for seventy -seven percent (77 %) Federal Aid Funds; and WHEREAS, the County, City, Town, and State will participate. in the cost, maintenance and operation of said traffic control signal with a street lights and signing as hereinafter set forth; • NOW, THEREFORE, IT IS AGREED AS FOLLOWS: I. The State shall prepare the necessary-plans, and specifications and proposals and shall perform the engineering and inspection required to complete the items of work hereinafter set forth. Such work as described immediately above shall constitute "Engineering and Inspection" and shall be so referred to hereinafter. 2. The contract cost of the work or, if the work is not contracted, the cost of all labor, materials, and equipment rental required to complete the work, except the cost of providing the power supply to the service pole or pad shall constitute the actual "Construction Cost" and shall be so referred to hereinafter. • 59387 3. The State with its own forces and equipment or by contract shall provide a traffic control signal with street lights in accordance with State Project No. 8214 -71 on Trunk Highway No. 212 at County Road No. 66 (GreeXley Street) - Oakgreen Avenue. Participation in the Construction Cost of that amount remaining after deducting any Federal -aid participation approved for said State Project is 50 percent State, 25 percent County and 25 percent Town. Based on the estimated Construction Cost of $69,000.00 which cost includes $9,000.00 for State force account work and anticipated Federal -aid participation of approximately 77 percent, the share of the total Construction Cost is 11.5 percent State, 5.75 percent County and 5.75 percent Town. 4. The State shall install or cause the installation of overhead signing and shall maintain said signing all at no cost to the Town, City or County. • 5. Upon execution of this agreement and a request in writing by the State, the County and the Town shall each advance to the State an amount equal to their share of the cost based on the actual bid price and actual Federal -aid share plus the estimated cost for State force account work plus 6 percent of such amount for the County's and the Town's share of the cost for Engineering and Inspection, 6. Upon final payment to the Contractor and computation of the Town's and the County's shares for the work provided for herein, that amount of the funds advanced by the Town and the County in excess of the Town's and the County's shares will be returned to the Town and the County without Interest and the Town and the County each agree to pay to the State that amount of the Town's and County's share which are in excess of the amount of the funds advanced by the Town and the County. 7.. The City and the Town shall install or cause the installation • of an adequate electrical power supply to the service pad or pole including 59387 any necessary extensions of power lines, and upon completion of said traffic control signal with street lights installation the City and the Town shall • provide necessary electrical power for its operation and maintain the street lights at the cost and expense of the City and the Town. 8. Upon completion of the work-contemplated in Paragraph 3 hereof, the State shall maintain and keep in repair the traffic control signal except for relamping, cleaning and painting at its cost and expense; and the County shall relamp, clean and paint the traffic control signal at its cost and expense. 9. Any and all persons engaged in the aforesaid work to be performed by the"State shall not be considered employees of the'County, Town or City and any and all claims that may or might arise under the Worker's Compensation Act of this State on behalf of said employees while so engaged, and any and all claims made by any third party as a consequence of any act or omission • • on the part of said e to ees while so engaged on any of the work contemplated herein shall not be the obligation and responsibility of the County, Town or City. The State shall not be responsible under the Worker's Compensation Act for any employees of the County, Town or City. 10. All timing of all traffic control signals provided for herein shall be determined by the State, through its Commissioner of Transportation, and no changes shall be made therein except with the approval of the State.
