2. Staff has responded to the MET COUNCIL related to their proposal to refundW - �
the City the$463,620.35 due to their overbilling-ion short the City has sought
a lump-sum payment as a continued deferment will cost the City several
thousand dollars in lost interest. Please see the enclosed letter to the MCES.
3. The City Council did request that a letter be sent to Washington County -. Z
inquiring about the installation of a pedestrian signal at Upper 55th Street and j n
Osgood Ave. That letter is enclosed. A follow-up email was sent that further
outlined that visibility of pedestrians would also be aided for cars traveling
southbound by such an installation.
4. A pre-construction meeting is planned for 8114 with the Palmer Station
developer. ' r

5. Sunnyside Marina has submitted a letter requesting the City Council consider
supporting a NO-Wake Zone.Staff will be reviewing this request and will have
a background memo together for the Council agenda on 8/28.
Other Items:
• MNDOT—Adam Josephson did respond to Boutwells resident,Joan .
Fogelberg sent a letter to MNDOT and State Elected representative
regarding the limited green-time to cross STH 36. See his enclosed
EMAIL response dated 8/6/18.
• Public Works staff and I took a trip over to Rivard stone to"pick-out"
the anticipated slab of limestone,now estimated to b 9'wide x 7'tall;
I guess it is shown under Andy Kegley's feet in the picture above. A
resolution to MNDOT will be required an addressed on 8/28.
• The goats have been picked-up from Valley View Park; overall,
certainly less underbrush,but not buckthorn free; it will require some removal by staff to excise the thicker materials—which
will simply grow back next year. On a related note; the City did purchase a BUCKTHORN Puller and will be available for
check-out here at City Hall.Park Commissioner Aaron Bye initiated the idea.

Dear Mr. Patrick:
As you recall, I sent you a letter on July 25, 2018 indicating that the application you
submitted for setback and rear yard coverage conditional use permits at 5737 Peller
Avenue North was not complete. The letter stated that we needed that information by
July 1, 2018 which included the following:
1. Provide the dimensions of the back yard, starting at the rear of the house to
the rear lot line and including the width of the lot.
2. Have the north property line marked by a surveyor along that area in front of
the existing garage and the garage addition. If possible, take pictures and
include the dimensions from the existing garage to the property line.
3. Provide any easements that you are aware of for access through your
property to 57th Street North.
Without this information, we deem the application incomplete and cannot consider this
at the Planning Commission meeting on August 16, 2018. The information listed above
must be submitted no later than August 31, 2018 to be placed on the September 13,
2018 Planning Commission meeting.
Pursuant to Minnesota Statutes 15.99, Sub. 3(f), the City of Oak Park Heights is
herewith extending the period of time for agency/city review of the application for an
additional 60-day period (for a total of 120 days from the date of application) inasmuch
as the City has determined that additional research and study by the City staff relative to
the complexity of the project as proposed will be required.

Dear Mr. Smith,
The City Council has reviewed your letter dated July 9,2018 and the calculation of the credit due for the
correction to the MCES billed amounts. The City appreciates the identification of the defect and the
follow-through to bring this matter to closure.
At this time the City requests a lump-sum refund of the amount due through 2018 totaling$463,620.25
instead of the credit being applied to future billings as offered in your letter as this avoids such
payments being a "de-facto" loan to the MECS at the further expense to our ratepayers.
If this is not workable,we would expect to add accrued interest on the past amounts due and on the
future installments equivalent to not less than 2.0% based upon current investing rates. Lastly, In
addition to the amount due,the City should be paid past interest that would have been earned during
that time of an estimated $14,900.00
Please let us know how you might wish to proceed.We would like to complete this matter in the next
thirty days.

there may be pedestrians in the crossing. E

This advanced warning would occur as the slope of the road
prevents an ideal line of sight for drivers to see pedestrians in the
road, but as these signals would be at a higher elevation, would
be seen earlier—and allowing more reaction timing. '
We would believe that there are solar apparatus that could be installed that would prove quite affordable and would be
similar to those the City has on 58th street at Nova Scotia Ave and near Boutwell's Landing.To date,these have been
maintenance free and well received. We have enclosed the data sheets. These costs —as I recall were less than
$8,000.The City would also promptly consider a cost sharing on these if found favorable.

Dear Eric,
This letter is being written on behalf of the Port of Sunnyside Club, Inc. dba Sunnyside Marina.
The Sunnyside Marina Board of Directors asked me to contact you to request that the Oak Park
Heights City Council consider a resolution requesting a "No Wake"zone be established
extending the full length of Sunnyside Marina.
The reason for this request is 100%based on the safety of our boaters,their children and our
emnlovees working on our fuel dock.Although all boat nnerators are resnnnsihle fnr the wake
their boat creates and the damage that may result from that wake, large boats running past
Sunnyside Marina continue to create the worst possible kind of wake.They do this by running
their boats at speeds where the largest wake possible is created. For the most part,these boat
operators are simply unaware what their wake is causing. When they are running on the
Wisconsin side of the River,they do not believe their wake could possibly effect our marina.
Our Board of Directors continues to hear horror stories about people in the marina being
tossed around inside their boats when these type of wakes go through the marina. Our Fuel
Dock employees have a very difficult time fueling boats when the boat is rocking violently up
and down and side to side while they are attempting to add fuel, perform pump outs or ad
fresh water to the boats.

Joan,this response is to you July 25,2018 letter concerning the signal timing at Hwy 36 and Oakgreen/Greeley.
I had our signal operations engineers review the signal timing plans their response is as follows:
The minimum green time for the northbound Oakgreen Ave left turn and through movements at the Hwy 36
signal is 7 seconds and the green time is extended up to the maximum green time depending on if there are
vehicles detected by pavement loop detectors at the stop bar. Following the green time,there is a yellow
indication time period and an all-red time period that allows vehicles to clear the intersection with all
movements being red before the next conflicting movement gets a green indication.
The signals on Hwy 36 from Lake Elmo Ave to Osgood Ave are coordinated and there are 8 different
coordination timing plans that are run throughout the day. The signal coordination timing was implemented
and analyzed earlier this year by a consultant using updated counts that were taken after the bridge opening. In
order for the signals to stay in sync,the maximum green time needs to be limited and this maximum value will
be different for each movement and each timing plan throughout the day.
If there is a specific time of day you feel there is a problem please note the time,date and issue and contact Metro
Traffic Signal Operations Engineer, Mike Fairbanks at 651-234-7819 or mike.fairbanks@state.mn.us directly. There is a
camera at the intersection so they are able to watch specific time-of-day issues to observe the extent of the problem
and make adjustments to the coordination timing plan that is running at that time.
