LOCATION
This project is located west of Memorial Avenue North at Lots 4, 5, 6, and 7 of Kern Center 2nd
Addition in Oak Park Heights. It is in the northwest quarter of Section 6, Township 29 North, Range
20 West, g
A site location map is attached.
Most of the site is legally within Valley Branch watershed District. However, a small P ortion of it
legally lies within Browns Creek Watershed District (I3CWD). Under most storm events, the site
will drain to BCWD. To simplify the permitting process for the applicant, the original permit was

submitted to VBWD and the Board of Managers approved the Pert 2000 -09 for the ro s ect.

Comments were solicited from the BCWD for the original W.A.T_E. Addition permit request.
DESCRIPTION
The '.A.T.E. Addition lies within the Kern Center. Kern Center first received a VBWD permit in
1989. The Kern Center 2 Addition received a VBWD permit in 1994. At the time a P and was
designed to conform to the then existing watershed pules and it was sized for 65% impervious
surfaces over the site. Since the Kern Center was permitted, the area has been annexed from
Baytown Township into Oak Park Heights: Oak Park Heights allows for 80% impervious surfaces,

but the existing pond does not conform to the current VBWD rules and regulations.
The District has allowed for development within the Kern Center (after the annexation to Oak Park
Heights) only if the site remains with 65% or less impervious, More impervious surfaces are
allowed, but only if the site will conform to the current VBWD rules and regulations. (To g conform
to the current rules, the existing regional pond would need to reconstructed and made larger or
stormwater ponds would need to be constructed on individual lots. The post office site, which was
permitted by the District two years ago created more than 65% impervious surface coverage, gage, bit a
stormwater pond was constructed on -site to handle the additional runoff. BCWD is currently
working with the City of Oak Park Heights to modify the Kern Center Pond.)
For the w.A. T.B. Addition, the applicant was granted permit 2000 -09. Permit 2000-09 allowed the
applicant to subdivide 3 lots into 6 lots and construct office /warehouse g
type buildings and associated
parking lots on the lots. However, the Board withheld permission for the applicant to construct

Later, the applicant wished to construct an office/warehouse building and associated parking lot on
the vacant lot. To stay within the 65% impervious limit, the applicant purchased anther 23 acre-lot
(Lot 4) With the increase in the overall site size and the proposed construction, about 57% of the
site was proposed to be in impervious surface. A VBWD permit revision was granted for this
request.
Now, the applicant wishes to construct another offieelwarehouse building and associated parking lot
on part of Lot 4_ The proposal will have the effect of impervious surfaces over about 63% of the.
total site.
The site conforms to the Kern Center permits granted 1989/1994. The following conditions are
suggested.
SUGGESTED CONDITIONS OF APPROVAL
1_ This permit allows for development on the front of Lot 4 as indicated on the June 2, 2002 PPD
plans, but withholds approval of construction of the back portion of Lot 4. The remainder of Lot
4 can be developed after documentation is received that indicates the proposed ultimate land
coverage conditions as of the Kern Center are consistent with the design assumptions made for the
Kern Center pond and /or B C D gives approval.
2. All other conditions, except Condition IA, of Permit 00O -O9 remain valid.
