Page 7 of 146 CITY OF OAK PARK HEIGHTS CITY COUNCIL WORKSESSION NOTES TUESDAY,MAY 22,2018 Present: Mayor McComber, Councilmembers Dougherty, Liljegren, Runk, and Swenson; City Administrator Johnson; City Attorney Sandstrom; Police Chief DeRosier; Public Works Director Kegley; City Engineer Mann; and City Clerk Pinski. 1. Call to Order: Mayor McComber called the meeting to order at 5:00 p.m. 2. Update on Frontage Road Study at Norell Ave.and Related Storm Water Issues: City Engineer Mann provided concept drawings for a roundabout and backage road alignment. He provided a cost estimate of just over two million dollars which included contingences and engineering but did not include land acquisition and utilities. City Administrator Johnson stated staff had conversations with Walmart, and they seem amenable. He stated that there was a concept to demo the Eagles building and build two buildings. He stated the City would like to swap land to benefit both parties. Johnson stated there was a potential for acquisition costs for the McCormick's site. Engineer Mann reported that Brown's Creek Watershed District had requirements that developments bring rates to pre-settlement conditions. He submitted a scope for the study, and said there was a meeting with Brown's Creek Watershed District representatives set for May 23 to determine how the site would need to be designed to comply with requirements. Approval of the study was to be added to the City Council Agenda. No action was taken. 3. Update on 2018 Goals: City Administrator Johnson reviewed a spreadsheet with the 2018 goals. He stated that Xcel Energy would be at Party in the Park; he was waiting for the Memorandum of tJnderstanding from MNDOT for Lookout Trail; and he received quotes for the monument sign. Mayor McComber suggested the sign be similar to the City of Lake Elmo's sign with the base and Oak leaves on both sides. Johnson stated he would have them do a couple renderings. McComber suggested adding security cameras to City parks on the goals list. Johnson stated they could possibly add park cameras as an addendum to the request for bids for security at City Hall. No action was taken. 4. Discussion on Data Received at Bayport Fire Department Quarterly Meeting: City Administrator Johnson reported that Bayport Fire was asking to open their contract and was seeking significantly more money. Mayor McComber stated they should maybe have a committee to review services and options to make sure City residents' best interests were met. Johnson stated they may need to do a study and some fact-finding. Chief DeRosier stated they may want to review their policy on which calls they really need to respond to. Johnson stated the City could create a response policy. Councilmember Swenson suggested City Administrator Johnson meet with Chief Eisinger,Jon Muller of Lakeview EMS,and Chief DeRosier to talk about what they want the City to do. No action was taken. 5. Call to Order/Pledge of Allegiance/Approval of Agenda: Mayor McComber called the meeting to order at 6:06 p.m. Present: Councilmembers Dougherty, Liljegren, Runk, and Swenson. Staff present: City Administrator Johnson, Public Works Director Kegley, City Attorney Sandstrom, City Planner Richards and City Engineer Mann. Absent: None. Mayor McComber added "Norell Avenue&Highway 36 Drainage and Water Quality Study" as New Business Item H. Councilmember Swenson, seconded by Councilmember Liljegren, moved to approve the Agenda. Carried 5-0. II. Council/Staff Reports: A. Mayor McComber: She reported she met with the League of Minnesota Cities staff that day regarding the Minnesota Mayor's Association Conference set for the following year; she reported a worksession was scheduled for May 24 with the City of Bayport Council and the City of Stillwater Council at Oak Park Heights City Hall; the LMC Conference was set for June 20—22; and Party in the Park was set for June 7 from 4:30—6:30 p.m. at Brekke Park. B. Councilmember Dougherty: He reported he attended the CVB kickoff. C. Councilmember Lilje ren: He reported he was not able to attend the Parks Commission meeting the previous evening. City Administrator Johnson said they held the Ceremonial Tree USA tree planting prior to the meeting. D. Councilmember Runk: He reported he attended the CVB kickoff and the Middle St. Croix Watershed Management Organization meeting. E. Councilmember Swenson: No report. F. Staff. City Clerk Pinski reported that Gerald and Marlene Shelley of 14920 Upper 55th Street North were chosen as the recycling award winners. III. Visitors/Public Comment: None IV. Consent Agenda: A. Public Hearings: None VI. Old Business: A. St. Croix River Crossing—Railing Safety and Enforcement: City Administrator Johnson reported that staff researched the issue of the City's enforcement abilities for people who scale the railing on the St. Croix River Crossing bridge. He said that the City may amend its City Ordinances to implement penalties. He reported that if the City Council would like to consider a revision of City Ordinance 1109.04 to add a new subsection,that action could take place at the next City Council meeting after posting the requisite ten days. Councilmember Liljegren, seconded by Councilmember Dougherty, moved to move forward with the Ordinance amendment process. Carried 5-0. VII. New Business: A. Consider Special Event Permit—Food Truck Extrava anza: City Administrator Johnson reported that Stillwater Area School District would like to host the Chamber of Commerce's Food Truck Extravaganza on June 16, 2018. He stated there was a draft permit in the meeting packet which included a provision that someone from the School District must be at the corner of 58' Street and Neal Avenue and at the Oak Park Ponds Shopping Center entrance directing people to cross at 58th Street and Neal Avenue. Councilmember Runk expressed concerns about people potentially parking across the street from the school. Robin Anthony, Executive Director of the Greater Stillwater Chamber of Commerce, was present at the meeting and stated she understood the parking concerns, and they had a shuttle and many volunteers for that reason. Palmer Station—Reject Bids for Public Elements—Developer Request: City Administrator Johnson reported that the developer requested the City reject the bids and go out for a re-bid. Mayor McComber stated she had no problems with a re-bid, but she felt the developer needed to interact with the public. Councilmember Swenson suggested the City mandate that the developer hold an open house with the neighborhood. Councilmember Swenson, seconded by Councilmember Dougherty, moved that the developer have a community meeting at City Hall at the Planning Commission meeting on June 14 before approval of rebid. Carried 5-0. Councilmember Swenson, seconded by Councilmember Dougherty, moved to reject the bids from April 4, 2018. Carried 5-0. C. Conditional Use Permit&Design Guidelines Review—Holiday Inn Express, 5921 Memorial Ave.: City Planner Richards reviewed his planning report which was included in the meeting packet. He reported that the Planning Commission Resolution failed with a 2-2 vote on building height. He said the approval was unanimous on all other elements. Councilmember Swenson stated he could not support a four- story building. Councilmember Dougherty stated he did not have a problem with four stories because it was not a residential area and is set back from the highway. Councilmember Liljegren stated he was more concerned with parking. Mayor McComber stated she did not think height would be much of a concern after the area was developed. Councilmember Dougherty, seconded by Councilmember Runk, moved to approve the Resolution. Roll call vote taken. Carried 4-1, Swenson opposed. Councilmember Dougherty suggested the Planning Commission look at the height requirements for that area. D. Public Storage—5710 Memorial Ave—Planned Unit Development Conditional Use Permit and Design Guidelines Review: City Planner Richards reviewed his planning report. He reported that the applicant was requesting that the connection charges be based upon the time of the last improvements in 1999 and not the current rates. City Administrator Johnson stated that the connection charges were not collected at that time in error. Roll call vote taken. Carried 5-0. Dan Matula, Vice-President of Development for Public Storage, requested that condition 1 of the Resolution be removed. Mayor McComber responded that condition was standard and always included in Resolutions. E. Consider Request Regarding Noise Ordinance for Concert at Stillwater Bowl on July 13. 2018: City Clerk Pinski reported that Randy Urtel of Stillwater Bowl had received a special event permit for an outdoor concert on July 13, 2018 but was requesting that the concert be allowed to go until 11 p.m. instead of 10 p.m. as required by City Ordinance. Councilmember Dougherty, seconded by Councilmember Liljegren, moved to schedule a Public Hearing as part of the June 26 meeting and notify residents. Carried 5-0. F. Consider Amendment to City Ord 401.15.D.11 —Temp Structures: Councilmember Sewnson, seconded by Councilmember Dougherty, moved to forward to the Planning Commission. Carried 5-0. G. Adopt Oak Park Heights' Water Supply Plan: Councilmember Runk, seconded by Councilmember Liljegren, moved to approve the plan. Carried 5-0. H. Norell Avenue and Highway 36 Drainage and Water Quality: Councilmember Swenson, seconded by Councilmember Liljegren, moved to approve the study. Carried 5-0. VIII. Mayor City Administrator Page 24 of 146 Oak Park Heights Request for Council Action Meeting Date June 26, 2018 Time Required: 1 min Agenda Item Title: Approve Budget Adjustment Agenda Placement Consent Originating Department/Requestor Betty Caruso -Finance Director Requester's Signature A:�al Action Requested Approve budget adjustment for Minnesota Association of Small Cities dues Background/Justification (Please indicate if any previous action has been taken or if other public bodies have advised): During 2016 budget process the council approved a new membership with the Minnesota Association of Small Cities. The payment was made to them on 1/1/16 for the 7/1/15-6/30/16 membership. The city has continued to budget for this in the 2017 and 2018 budget, however, we remain behind by 6 months on the annual invoices due to timing of the budget. I would like to request that this be corrected in 2018 which would require a double payment on the expenditure (1 paid on 1/1/18 for 7/1/17-6/30/18; 1 paid on 7/1/18 for 7/1/18-6/30/19). The annual dues are $2,389.00. Because only one amount is budgeted for, the additional payment would reflect an over budget for the council's Membership budget. The funding for this expense could come from the council's Travel Conference School budget which has a $14,000 budget and historically spends around $4,00045,000. This would require a budget adjustment of$2,400 from the Travel Budget to the Membership Budget. Action Request: Adjust the budget for $2,400 to correct the membership for Minnesota Association of Small Cities $2,400 to be in line with the due date of the membership. As you are aware, the City Council amended Section 401.15.D.11 in October of 2017 to allow temporary accessory structures with the issuance of a special use permit for a maximum of 50 days in a calendar year. Since then it has been recognized that there is a need to allow additional time for placement of these structures. Typically, they are a fabric or tarp structure and are not placed on a permanent foundation. The City Council was favorable to the following language addition found in (e) below and asked the Planning Commission to consider this issue. At their June 14, 2018 meeting, the Planning Commission held a public hearing and recommended the language as follows. 401.15.D Accessory Buildings Uses and Equipment 11. Temporary Accessory Structures. Temporary accessory structures shall be allowed in all zoning districts with the issuance of a special event permit for a maximum of 50 days in a calendar year subject to the following.- a. ollowing.a. The structure shall be securely fastened to the ground, subject to the safety requirements of the manufacturer. b. The structure shall be kept in good condition and its appearance shall not be detrimental to the area or adjacent properties. Page 28 of 146 C. The temporary use does not involve the erection of a substantial structure or require any other permanent commitment of the land. d. The temporary structure shall be removed at the end of the permit period. If not removed within 10 days thereafter, the City shall have the right to remove the structure at the permittee's expense. e. Temporary structures may be permitted for up to 24 (twenty-four) continuous months in the R 1 and R-2 Residential Districts with City Council approval of an Interim Use Permit as provided for in Section 401.05. The application fee for an Interim Use Permit for the purposes found in subsection (e)shall not exceed$100.00. The value of this amendment would: • Permit the structure for up to two years. • Provide an opportunity for neighborhood comment with a Planning Commission public hearing. • Allow a process should the structure fall into disrepair. • Limits the application fee to $100.00 which will ensure that those applying for a temporary structure are committed to the process. The officer will receive critical training on investigating mobile devices and computers. This course provides computer equipment and software along with the hands-on training. Upon return the officer will be able to investigate and pull critical information from computer devices such as cell phones lawfully preserving this evidence for court. The department has seen a dramatic increase in this type of evidence and the need to be able to recover this from electronic devices. Data that is commonly recovered is evidence of threats,photographs illegal to possess or evidence of other crimes,phone call and text metadata such as location and times. In our age of computer devices this has become a standard required for many investigations. Approve the cost of the course which includes tuition, hardware and software, lodging,meals, and transportation to and from the airport to the facility. There are two noise ordinances that must be deviated from to allow such a proposal: • Per City Ordinance 1109.04.F.6.a. any sound system cannot be"operated in a manner which is plainly audible from its source at a distance of 100 feet or more between the hours of 6:00 a.m. at 10:00 p.m. • Additionally, Per City Ordinance 1109.04.F.6.a, any sound system cannot be "operated in which it is plainly audible, at a distance of 50 feet or more from its source between the hours of 10:00 p.m. and 6:00 a.m." Randy Urtel from Stillwater Bowl is requesting the City Council consider authorizing an extension of one hour allowing the concert to go until 11:00 p.m. and allow a deviation from the noise"audibility"matter. The City Council may consider a reasonable deviation under the City Special Event permitting process for the event to deviate from the noise restrictions. We experienced an outdoor concert there three years ago. I could not begin to describe what it was like. The sound was deafening. This was during the day with just a small number of customers present. We were luck that a sudden storm forced the band to stop. followed up with City Hall the next day and was told they would need a permit for a band and they did not have one. I was assured they would be notified of this requirement. In spite of this, they again had a band there two weeks later. I assume there were many calls to the police department; I know of five neighbors nearby that called. The officer only drove through the parking lot at first. But a short time later he returned and the band was closed down. The Stillwater Bowl regularly violates the ordinance with games and loud music through outdoor speakers on their patio. I see no reason to expect they would honor an extended time and do not believe they should be allowed to have live music outdoors at all. Thank you. There, the Council did reject the bids (at the request of the Developer)that were received and directed that the Planning Commission hold a public hearing with the neighborhood so as to offer a forum to determine if there are any new or unforeseen issues that have arisen since the project original approval in 2014 and which received three extensions. The question at hand again was does the City allow another extension or require a re-submission. (This was summarized in the enclosed memo dated 5/18/18) As directed, the Planning Commission held the specified public hearing on 6/14/18 and the following is a summary of the comments received: 1. Four residents spoke about continued concerns related to storm water and generally thought that the Developer should re-submit a new plan.Similarly, residents felt that the site was not maintained very well. 2. One resident further desired that the project simply move along as the site was becoming an eyesore. 3. The Planning Commission did discuss the comments and did review the City Staff notes(as above) on the matter relating to the historical context,the past plan reviews related to utilities as well as the current relationship with the Comprehensive Plan and Land Use requirements. Ultimately, the Planning Commission concluded that a granting of a 60-day extension is reasonable, but not longer but should be contingent upon: i. That the City Engineer first re-affirm and further clarify their findings in which they essentially find that the Project does propose a sound plan to address storm water that will not result in impacts to the adjacent properties and that the City Engineer shall also re-affirm that there is downstream capacity in the sanitary sewer as well. (1 have asked that the City Engineer provide this documentation for the Council and is pending as of the date of w►rting this memo) Page 58 of 146 ii. That the City implement further enforcement upon the site—to be sure it is better maintained-prior to any construction beginning, as well as during and after. At this time, the Council certainly has the legal authority to not provide an extension as the Developer has exceeded their one-year deadlines and/or not complied with the terms of the last extension. Three previous extensions have been granted. It would seem unreasonable to suggest the City has not been flexible with the Developer to date. In fact,the City has even granted easements to the Developer connecting to Oak Park Blvd. Despite the lack of moving forward to date, requiring a re-submission may result in a very similar if not identical project and the effort could largely be an administrative exercise. There are not materially new City Codes or watershed rules that would appear to alter the site concepts as currently proposed. But,sometimes re-engagement itself can be valuable when things are looked at with a fresh perspective, it is hard to say. Finally, in either case the City, at the request and expense of the Developer, has re-bid the project with the possibility that the City Council may authorize the project to move forward. If the Council believes that the Developer can move forward without a re-submission,then the Council is asked to award the bid as outlined in the City Engineer's letter dated 6/20/as enclosed. The City is now advised by the Developer that they are now fully prepared to move forward with the new bids and sign any necessary documentation and provide all necessary escrow funds/letters of credit. So... a decision is required-generally: 1. Allow the Developer to move forward at this time—with a 60-day extension and Award on the New Bid. 2. These would be costs to the Developer for the required streets,water,sanitary and storm systems. The City should take a formal action to reject any bids as received at this time. Staff would recommend the reiecHon of the bids,Bid Tab is enclosed. ISSUE#2 A second issue is that the developer is requesting that the City rebid these elements in hopes of receiving a more favorable price. However,this in-effect would be fourth project extension as the last extension granted by the City in January 2017 required that the Developer was obligated to move forward after the receipt of the bids and its"immediate construction thereafter".This timing and information was also relayed to the public. Moving forward, rebidding of the project has no material economic effect on the City as these costs are those of the developer, however,Staff would recommend considering that a communication be made to the neighborhood inviting them to a public hearing on what is essentially a fourth project extension and to determine if there are any new issues or matters that have arisen since the initial Council approval in 2014. This is the 7+/- acre site located at the southeast corner of Oakgreen Ave and 58th Street. At that time a number of public hearings were held and while there were some concerns, the Project was viewed as generally favorable by the neighborhood and was subsequently approved by the Council. Since that time, the Developer has obviously not moved forward with their project and has continuously sought extensions to their approvals, with three extensions being granted. In early 2017, the City informed the Property Owner that if it did not complete the necessary steps to commence the project by October 318, 2017—by executing the necessary Developer's Agreements and posting required financial securities AND proceeding promptly with construction following any bidding that such approvals would lapse and the Council would not consider any further extensions precipitating a new application. The Developer did post such securities and the Project was bid for a Spring 2018 construction. But as we see the Developer has not moved forward as they have indicated that the bids received for the public elements(roads&utilities)exceeded their anticipated budget. The Developer has now sought to have these rebid by the City with possible construction later this summer, but essentially is another extension with no assurance as to when the project may proceed. Considering the history,the City may certainly require the Developer to re-submit for a new full development application under MN Stat. 15.99 rules and is something the City Council is considering or it could simply allow another extension. Prior to making such a decision the Council has directed that a Public meeting be held with the neighborhood on Thursday, June 14th, 2018 at 6:00 PM to take input on what is essentially a fourth timeline extension for the Developer. This will be held at the Oak Park Heights City Hall with the Planning Commission and notices were sent. The Planning Commission is requested to: 1. Receive any commentary relative to the timelines noted above, and or any other comments that it may deem relevant or reasonable about the Project. 2. Consider giving direction to the City Council if the City should allow a fourth extension OR require the Developer resubmit the project in its entirety. Page 61 of 146 Staff would note that the underlying zoning of the site has not changed (R-1), nor has the City's comprehensive plan directing the land use as low-density residential which the Development remains in compliance with. Theoretically, an entirely new application will need to be reviewed under the same zoning codes and their guidance and may result in a very similar, if not identical Project However, there could be new concerns or other unknown issues that have arisen in the past 48 months that the City is unaware of. Please note the City did allow a re-bidding of the project at the request and expense of the developer with bids due on June 29th. If the Council allows an extension, it is possible the bids if received are favorable to the Developer that the project may proceed. If the Council determines that new application is necessary then these bids will be rejected in total regardless of their costs. The enclosed maps generally show the approved layout which remains the only approved layout as well as the Planned Land Use Map showing Low Density residential. On June 26m, 2018 the Council will review any comments received will determine Na new development application is to be required under MN Stat M99 or if it will allow the rebid to continue and allow construction under another extension,presumably this summer. Following are our comments and/or recommendations. Storm Water Construction Permit Comments(provide previously on June 6,2014): As the development creates 1.24 acres of new impervious area, construction activities will be subject to the requirements of the MPCA NPDES Construction Permit. • Per the Construction Permit, "Where a project's ultimate development replaces vegetation and/or other pervious surfaces with one (1) or more acres of cumulative impervious surface, the Permitee(s) must design the project so that the water quality volume of one (1) inch of runoff from the new impervious surfaces created by the project is retained on site." o Based on 1.24 acres of impervious area,4501 cf of volume must be retained. This required volume is achieved in the larger infiltration basin (6 100 cf capacity), • However, as shown in the City of Oak Park Heights Wellhead Protection Plan Part 2,the project area is located in the City's High Vulnerability DWSMA (see attached DWSMA Figure). Section III.D.I.j.vi(. of the Construction Permit states "Infitration is prohibited when the infiltration system will be constructed in areas with a Drinking Water Supply Management Area (DWSMA) as defined in Minn.R.4720.5100,subp. 13.,unless allowed by a local unit of government with a current MS4 permit. (See attached ERA Figure) • As infiltration will not be allowed,the City recommends that the plans be revised to treat the required water quality volume of one inch over the impervious (4501 cf) through filtration. Any filtration system should be designed based on the most recent update of the MN Stormwater Manual. Sheet C1.2-Demolition Plan 1. Clearly label and identify all trees being removed as well as all site clearing areas. 2. For the installation of the sanitary sewer,full width removal of the street will be required at the intersection of Oak Park Boulevard and Oakgreen Avenue North. 3. Remove and replace curb and gutter along Oak Park Boulevard per City standard detail STR-31. Sheet C3.1 -Grading Plan 1. Provide detail on the emergency overflow for Wetland 1. Is the overflow planned to be to the north into the proposed infiltration basin? 2. Due to existing storm water drainage concerns to the south between the properties of 5523 Oakgreen Place North and 5519 Oakgreen Place North,please provide details on how the storm water overflows will be controlled. a. The current proposed design of the emergency overflow from the redevelopment site continues to the south,and the City is requiring the installation of a storm sewer pipe between the properties to address a 100- year storm event (see attachment for the general installation location of this pipe) b. All easements for the properties to the south of the redevelopment need to be identified on the plans. c. As discussed in the stormwater construction permit comments above. the infiltration basins must be redesigned to filter the storm water.Therefore,the infiltration basin identified to the north of Wetland 1 will require redesign and may require a drain file pipe and outlet. 3. The mill and overlay patch shown on Oak Park Boulevard needs to be shown for the full width (end rade) of the proposed Oak Cove street. Following storm water filtration revisions this detail and the remaining storm sewer can be reviewed. 2. Sanitary sewer MH-2 needs to be located in the center of the roadway alignment, while maintaining 10' separation between the new water main and sewer. 3. Water main shall be installed at a minimum cover of 8.5'. 4. Pipe materials: a. Water Main: CL 52 DIP with polywrap b. Storm Sewer: RCP 5. The connection to the water main on Oak Park Boulevard via wet tap is not allowed. The new water main shall be connected with a sleeve and tee, and gate valve to be located at the end radius of Oak Cove. 6. Staff and Stantec worked to immediately correct the issue as not adjusting the structures will leave the large dips and bumps in the roads at several manhole locations after the new asphalt lift is installed. The change order breaks down unit pricing for the work required, totaling $27,060, which equates to about 3.6% of the $746,780 project. The unit pricing is in line with current rates which is to say there are no penalty charges for adding the line items after the bid. In other words,the contractor is not attempting to price gouge for the addition. Adjusting structures is necessary to achieve a quality mill and overlay. The lot and building were previously the Eagles Club. It is situated at Highway 36 and Norell Avenue North. The site will be redeveloped with two buildings, one which will be a freestanding Penera Bread with a drive thru and the second as a retail building with no tenants identified at this time. Over the past year, the City has been In preliminary planning for improvements and realignment of the 601' Street North (frontage road) and Norell Intersection. This plan would accommodate the current plan for that realignment. A copy of the conceptual plan layout Is found as Exhibit 13. The Planned Unit Development will allow a multi building shopping center with joint signage, access and parking. The site is currently zoned B-4 Limited Business District that allows retail and restaurant development. The Panora Bread plan would require a Conditional Use Permit for a drive thru. A Preliminary/Final Plat is required to subdivide the parcels into the respective lots for the two building sites and the buildings/site will require Design Standards and Site Plan review. The northern building features a freestanding restaurant with a drive thru. Ample car stacking is provided within the development. PaNdng is provided at a ratio suitable for highlevel, restaurant type uses Pylon signs are located at the main entrance and off Norell. The signs are designed to match building architecture with a brick base. One pylon sign is proposed for each of the two future lots. The building architecture utilizes brick with soldier course patterns. Storefront glass is maximized at the front elevation and turns the comers. The use of spandrel glass on Me street facades gives the appearance of the front while disguising back of house elements The use of multiple styles of awnings and placement of brick elements helps to differentiate tenants. 2 Page 91 of 146 Signage is consistent with individually mounted back lit channel letters and located in designated sign band area. Two trash enclosures are located for convenient access and are of matching materials to the buildings with landscape screening and softening. Landscaping around the site Includes a variety of deciduous and coniferous tree plantings with complementary shrubs and perennial plants Native pants and with a seasonal color change are used to provide interest throughout the year. All non-paved areas of the site will be covered with plant material. ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The use of the site as retail and restaurant buildings is consistent with the Comprehensive Plan. Zoning. The property is zoned B-4 Limited Business District that allows retail and restaurant use as a permitted use. Shopping centers with joint signage, access and parking require a Planned Unit Development overlay. The Concept and General Plan phases of the process can be_combined for this development in that all the General Plan Information has been submitted and deemed complete. A conditional use permit has been requested to allow a drive thru for the Panora Bread. Section 401.301.E of the Zoning Ordinance provides the review criteria for this request. The drive thru as designed complies with the criteria. Subdivision. The property is to be subdivided as IZdgecrest Oak Park Heights I with one lot for each of the buildings. The plat will be subject to review and approval of the City Attomey and City Engineer. The park dedication fees have been paid for this area. Lot 1, Block 1 will have an area of 1.01 acres and Lot 2, Block 1 will have an area of 1.26 acres. The lots will comply with the minimum lot size of 15,000 square feet and lot width of 100 feet. Easements around lot lines shall be dedicated as required by the Subdivision Ordinance and the City Engineer. A Final Plat shall be prepared for review by the City Council. The plat includes moving the north and east property lines Into property owned by the City to accommodate the development. In exchange, the City would take the land to the south in fee or as an easement to allow for the potential construction of the frontage road to the south. The Site Plan, found as Exhibit 6, indicates how this frontage road would fit with the plan for the Ridgecrest development. Setbacks. Building setbacks required in the 5-4 District are a 40 foot front yard setback, 10-foot side yard setback and 204bot rear yard setback. Norell would be considered the front yard for the two lots. The Lot 1 which includes the Panera Bread building, will have a 44-foot building setback to the property line and Lot 2 with the retail building will have a 30foot setback. To 60th Street North,the Panera Bread building will have a 32-foot setback. The Planned Unit Development would allow flexibility in the setback requirements. 3 Page 92 of 146 All parking and drive aisles must be set back at least ten feet from the property line. The parking lot setback to 60th Street North is at the narrowest point five feet. The Planning Commission should comment on the proposed setbacks. Traffic Circulation/Curb Cuts. The site will be accoss©d by 60"' Street North at the north side of the property. This access is shared with the office building to the west. The site plan also indicates the potential for a southern access if the frontage road is constructed in this area. The City Engineer shall review the locations of the access for their acceptability. A turning movement plan has been provided. The plan shall be subject to review by the Fire Marshal for emer!nency vehicle access. Pedestrian Access. There is an existing sidewalk on the south side of 60th Street North that ends at Norell Avenue. With the potential for reconstruction of the 60th Street and Norell intersection, the sidewalk could be extended south along Norell Avenue. The City will condition approval of the project on the Applicant agreeing to escrow sufficient funds, as specified by the City Engineer, to complete the sidewalk improvement or agree that the City will complete the work and petition for the public improvement, waiving notice of public hearing and assessments, as required under Minnesota Statute 429. Additional easement for the sidewalk may be required. The City Engineer should consider this as part of the approvals. Parking. The following table provides an analysis of proposed and required parking spaces. Building Parking Requirements and Calculation Required Spaces Lot 1 Building Shopping Center. 6 Spaces per 1,000 24 Square Feet 4500x.9=4,050 1166=24 Lot 2 Building Shopping Center. 6 spaces per 1,000 36 Square Feet 6,720 x.9=6,0481166 =36 TOTAL 60 Per ordinance, based upon the shopping center parking requirements, the site would require 60 parking spaces. The proposed site plan indicates a total of 108 spaces, 53 spaces on Lot 1 and 55 stalls on Lot 2. There will be cross easements for parking and access throughout the development. The plans indicate six disability stalls adjacent to the front entrances of the two buildings, which will be adequate for the site. Drive-Thru for Restaurants. The Panora Bread building has been designed with a circulation lane to allow for a restaurant drive-thru. The stacking distance would be adequate, but there would not be room for an alternate lane around the queue. The restaurant drive-thru requires a conditional use permit. The plans include a drive through clearance bar, a canopy with order box, and-the menu board. 4 Page 93 of 146 Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored. Snow storage shall not interfere with parking stalls. Landscaping. The submitted landscape plan is subject to City Arborist review and approval. City Arborist comments are found as Exhibit 26. Lighting. The lighting plan indicates the locations of the parking lot and site fixtures. The lighting specifications indicate that the fixtures to be used in the parking lot will be full cut off and LED and compliant with height requirements. The building light fixtures indicate the use of all full cut off fixtures. The photometric plan has been provided and will need to be revised so that the foot candles do not exceed a one candle meter reading as measured from the centerline of a public street and not exceed 0.4 foot candles at an adjacent property line. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as it relates to lighting requirements. Trash Storage. The plans show the location and design of the two trash enclosures. The brick colors will match.the buildings. The doors will be constructed of composite wood and painted to match the brick color. The sides and rear of the trash enclosures will be landscaped. Mechanical Screening. The plans for the Panera Bread and retail buildings indicate that the parapet walls are designed to screen the mechanical equipment. The Applicant shall provide a site line diagram for Panera Bread to indicate that the mechanical equipment will be screened from view from Highway 36 and Norell Avenue. All mechanical equipment shall be required to be screened as provided in accordance with the Zoning Ordinance requirements. Grading, Drainage, Erosion Control and Utilities. Grading, drainage, erosion control, and utility plans are subject to review and approval by the City Engineer. Storm water issues are also subject to review and approval by the Brown's Creek Watershed District. Signage. Freestanding Sign. The plans indicate two pylon signs, both of which are on Lot 1, The Ordinance allows for one freestanding sign per lot and two additional freestanding signs on the same lot if constructed as a monument. The first freestanding sign can be a maximum of 100 square feet in size and be no more than 20 feet in height. The second monument sign can be eight feet in height and 60 square feet. The freestanding signs will need to be setback at least five feet from the property lines. 5 Page 94 of 146 The proposed freestanding sign is 20 feet in height and 48 square feet. The plan should be updated so that the second sign meets the size requirements for a monument sign. If the Applicant places the second sign on Lot 2, it can be constructed to the same size requirements as the freestanding sign. The bases of the two signs are proposed to be landscaped and included on the landscape plan. Wall Signage. The Zoning Ordinance would allow for three wall signs, each on a separate fagade for the Panera Bread building. The elevation plans indicate the Panora Bread logo on all four facades. There are two signs that indicate the availability of a drive thru. These signs are considered as informational and no not count in the total of numbers or square footage. The Ordinance would allow a total of 150 square feet of wall signage and the four signs total 92 square feet. The fourth sign can be allowed through Planned Unit Development approvals. The Planning Commission should discuss this request. The plans indicate potential tenant signage for the retail building. The signs would need to comply with the Zoning Ordinance requirements as the tenant spaces are leased. For the retail building, the Ordinance specifies a maximum of 200 square feet of signage per wall and maximum of 600 square feet per building. Sign Illumination. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. The building signage will be individual lit channel letters, attached to the face of each elevation. The sign lighting should be designed such that only the text and logo portions of the signs are to be lit at night. The sign background will need to be dark. Design Guidelines. Sustainable Guidelines. The applicant will need to discuss the methods In building construction and site design with the Planning Commission of how sustainability has been addressed. Architectural Guidelines. Fa de Treatments The two buildings will have a definite base, middle and top. The fagades feature differences in materials, strong comer elements and a varied roof line on the retail building to provide architectural interest. Ground Level Expression The buildings are one story with excellent visibility to Highway 36. The buildings will be constructed such that the brick materials and detailing will be featured on each elevation. The entrances are prominently featured with metal canopies or canvas awnings. 6 Page 95 of 146 Transoarencv The Design Guidelines requires at least a 20 percent glass on ground floor, street facing facades. The Panera Bread building will feature glass of 25 percent on the west elevation, 27 percent on the south, 8 percent on the east, and 11 percent on the north (Highway 36). Staff has worked with the Applicant to improve the appearance of the two street facing facades and increase the amount of glass. The retail building will have a 38 percent transparency on the west elevation, 15 percent on the east and 16 percent both on the south and the north elevations. The Planning Commission should comment on those facades of the Panera Bread and the retail building not meeting the transparency requirements. Entries Both buildings feature prominent entries with canopies or awnings. Roof Deslan The roofline of the retail building features varying parapet heights to break up the roofline. The roofline of the Panera Bread is of a consistent height. The rooftop mechanical equipment will be completely screened within the parapet of the buildings. The buildings are one story and less than 35 feet in height. Buildina Materials and Colors The applicant has provided color elevations for review. The primary building materials of both buildings are brick, EIFS and glass on all facades of the structures. None of the prohibited building materials will be used. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building is a franchise design, but the design and materials comply with the Design Standards. This should be discussed by the Planning Commission. Site Design Guidelines Buildin Placement The proposed buildings are well placed on the site and will be a prominent feature of the intersection at 60th Street North and Norell Avenue. Parkin Areas The parking area is landscaped with perimeter plantings as well as plantings within the parking lot. Storm water Stormwater will be addressed by the City Engineer. 7 Page 96 of 146 Pedestrian and Common Space Addressed elsewhere in the planning report. Landscaping Building perimeter plantings are provided for both buildings. Trees/Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist Utilites/Service/Loadinc/Ddve-Throucah/Storane Areas Addressed elsewhere in the planning report. The applicant should identify locations. Development Agreement A Development Agreement would be required between the Applicant and the City related to the transfer of property and other development issues. The development agreement shall be subject to review and approval of the City Attorney. CONCLUSION/RECOMMENDATION Subject to the preceding review, City staff recommends approval of the following listed requests subject to the conditions that follow: • Planned Unit Development, Concept and General Plan • Preliminary and Final Plat • Conditional use permit(CUP)for Drive Thru Restaurant • Design Guidelines/Site Plan Review 1. The preliminary and final plat shall be subject to review and approval of the City Attorney and City Engineer. A Final Plat shall be prepared for City Council approval. 2. The Planning Commission should comment on the-proposed building, driveway and parking setbacks. 3. The site plan shall be subject to review and approval of the Fire Marshal. 8 Page 97 of 146 4. Additional easements for the sidewalk may be required subject to review and approval of the City Engineer. 7. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. 8. The landscape plan shall be subject to the review and approval of the City Arborist. All required landscape plan details shall be submitted to the satisfaction of the City Arborist. 9. All mechanical equipment on the roof or on the site shall be fully screened In accordance with the provisions of the Zoning Ordinance. Panora Bread shall provide a site line study from Highway 36 and Norell Avenue demonstrating how the parapets will screen the mechanical units. 10. All light fixtures shall be full cut off, compliant with the height requirements, and be consistent with Section 401.15.B.7 of the Zoning Ordinance as It relates to lighting requirements. The freestanding signs shall be limited to one per lot, unless designed as a monument sign. 11. All signs shall be designed to comply with the Zoning Ordinance requirements for size, number, placement and internal illumination. 12. The Planning Commission should discuss the fourth wall sign on the Panora Building. 13. The Planning Commission shall comment on the building design and building materials. The Applicant will provide building material samples for Planning Commission review. 14. The preliminary review by the Metropolitan Council will provide comments and check consistency with regional plans prior to final draft completion. Adjacent and affected jurisdiction review is required as part of the process. Open House/Public Hearing The Planning Commission scheduled an Open House for the Comprehensive Plan on April 12, 2018. The Open House was advertised through the City Newsletter that was distributed to every household in the community in March. Several residents attended the open house and comments on the plan were received. The Planning Commission also held a Public Hearing on the Comprehensive Plan through 2017 and 2018 at each of its meetings to encourage public comment. Introduction, Social Inventory, Issues identification, Mission Statement and Goals, Land Use, Transportation, Administration, Community Facilities, Parks and Trails, and Implementation Sections The revised Introduction, Social Inventory, Issues Identification, Mission Statement and Goals, Land Use, Transportation, Administration, Community Facilities, Parks and Trails, and Implementation sections of the Comprehensive Plan are found as attached. These sections had been updated with the comments from the Planning Commission and City Council members to date. Page 144 of 146 Utility Plans Lee Mann of Stantec, the City Engineer has provided draft copies of the utility elements of the Comprehensive Plan for review. With the Introduction, Social Inventory, Issues Identification, Mission Statement and Goals, Land Use, Transportation, Administration, Community Facilities, Parks and Trails, and Implementation sections of the Comprehensive Plan, this completes the draft for submittal to the adjacent and affected jurisdictions and the Metropolitan Council. The utility plans include: • Comprehensive Sewer Plan • Water System Master Plan • Local Surface Water Management Plan Due to the number of pages, these drafts will only be available online and paper copies will not be distributed at the meeting.
