HomeMy WebLinkAbout1983 Resolutions L w EXTRACT OF MINUTES OF A MEETING OF THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, MINNESOTA HELD: December 12, 1983 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Oak Park Heights, Washington County, Minnesota, was duly called and held at the City Hall in said City on the 12th day of December, 1983, at 7:00 P.M., for the purpose of awarding the sale of an $80,000 General Obligation Improvement Bond of 1983 of the City. The following members were present: Frank Sommerfeldt, Mayor; and Councilmembers Richard Seggelke, Jack Doerr, Joseph Carufel and Barbara O'Neal; and the following were absent: none. Member O'Neal introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR THE ISSUANCE AND SALE OF AN $80,000 GENERAL OBLIGATION IMPROVEMENT BOND OF 1983 WHEREAS: A. The City Council of the City of Oak Park Heights has heretofore determined that it is necessary and expedient to issue an $80,000 General Obligation Improvement Bond of 1983 pursuant to Minnesota Statutes, Chapters 429 and.475 to finance the construction of sanitary sewer, water, storm sewer and street improvements in the Heights Business Park in the City (hereinafter referred to as the "Improvements "); and B. No other obligations have been sold pursuant to a private sale within the last three (3) months, which when combined with this issue would exceed $300,000, as required by Minnesota Statutes, Section 475.60, Subdivision 2(2); NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Oak Park Heights, Minnesota, as follows: 1. The offer of The First National Bank of Still- water in Stillwater, Minnesota (the "Purchaser "), to purchase the $80,000 General Obligation Improvement Bond of 1983 of the City (hereinafter referred to as the "Bond "), in accordance L with the terms and at the rates of interest hereinafter set forth, and to pay therefor the sum of $80,000 plus interest accrued to settlement, is hereby accepted. 2. The Bond shall be dated December 15, 1983 as the date of original issue and shall be issued forthwith as a fully registered bond. The Bond delivered to the Purchaser shall be numbered R -1 and shall be in the denomination of $80,000. The Bond shall mature on February 1 in the years and installments as follows: Year Amount 1985 $9,000 1986 9,000 1987 9,000 1988 9,000 1989 9,000 1990 9,000 1991 9,000 1992 9,000 1993 8,000 3. The Bond shall provide funds to finance the con- struction of the Improvements. The total cost of the Improve- ments, which shall include all costs enumerated in Minnesota Statutes, Section 475.65, is estimated to be at least equal to • the amount of the Bond herein authorized. Work on the Improve- ments shall proceed with due diligence to completion. 4. The Bond shall mature in the years and shall bear interest payable August 1, 1984, and semiannually thereafter on February 1 and August 1 of each year at the respective rates per annum set forth opposite the maturity years as follows: Maturity Years Interest Rates 1985 8.15% 1986 8.30 1987 8.40 1988 8.50 1989 8.60 1990 8.70 1991 8.80 1992 8.90 1993 9.00 5. Any or all installments of principal due on the Bond are subject to prepayment at the option of the City on any date in multiples of $1,000 at par plus interest accrued to the date of prepayment. Notice of any such optional prepayment -2- shall be given prior to the prepayment date by mailing to the registered holder of the Bond a notice fixing such prepayment date and the amount of principal to be prepaid, and published notice of redemption shall be given if and in the manner required by law. 6. The City Clerk- Treasurer of the City of Oak Park Heights, in Oak Park Heights, Minnesota, is appointed to act as bond registrar and transfer agent (the "Bond Registrar ") and shall do so unless and until a successor Bond Registrar is duly appointed. The Bond Registrar shall also serve as paying agent and shall do so unless and until a successor paying agent is duly appointed. Principal and interest on the bonds shall be paid to the registered holders (or record holder) of the Bond in the manner set forth in the form of Bond and paragraph 12 of this resolution. 7. The Bond to be issued hereunder, together with the Bond Registrar's Certificate of Authentication, the form of Assignment and the registration information thereon shall be in substantially the following form: • -3- UNITED STATES OF AMERICA STATE OF MINNESOTA WASHINGTON COUNTY CITY OF OAK PARK HEIGHTS R -1 $80,000 GENERAL OBLIGATION IMPROVEMENT BOND OF 1983 KNOW ALL PERSONS BY THESE PRESENTS that the City of Oak Park Heights, Washington County, Minnesota (the "Issuer "), certifies that it is indebted and for value received promises to pay to The First National Bank in Stillwater, in Stillwater, Minnesota, or registered assigns, in the manner hereinafter set forth, the principal sum of EIGHTY THOUSAND DOLLARS on the first day of February in the years and installments as follows: Date of Year Amount Interest Rates Original Issue 1985 $9,000 8.15% December 15, 1983 1986 9,000 8.30 1987 9,000 8.40 1988 9,000 8.50 1989 9,000 8.60 1990 9,000 8.70 1991 9,000 8.80 1992 9,000 8.90 1993 8,000 9.00 unless called for earlier redemption, and to pay interest on the balance of said principal sum from time to time remaining unpaid, from the date hereof until the principal is paid at the rates per annum specified above, payable semiannually on May 1 and November 1 of each year (each, an Interest Payment Date ") commencing May 1, 1984 (calculated on the basis of a 360 -day year of twelve 30 -day months) until the principal sum is paid or has been provided for. This Bond will bear interest from the most recent Interest Payment Date to which interest has been paid or, if no interest has been paid, from the date of original issue hereof. The installments of principal of this Bond are payable upon presentation and surrender hereof at the principal office of City Clerk - Treasurer of Oak Park Heights, in Oak Park Heights, Minnesota (the "Bond Registrar "), acting -4- as paying agent, or any successor paying agent duly appointed by the Issuer. Interest on this Bond will be paid on each Interest Payment Date by check or draft mailed to the person in whose name this Bond is registered (the "Holder" or "Bond- holder") on the registration books of the Issuer maintained by the Bond Registrar and at the address appearing thereon at the close of business on the fifteenth day of the calendar month next preceding such Interest Payment Date (the "Regular Record Date "). Any interest not so timely paid shall cease to be payable to the person who is the Holder hereof as of the Regular Record Date, and shall be payable to the person who is the Holder hereof at the close of business on a date (the "Special Record Date ") fixed by the Bond Registrar whenever money becomes available for payment of the defaulted interest. Notice of the Special Record Date shall be given by mail to the Bondholder not less than ten days prior to the Special Record Date. The installments of principal of, and interest on this Bond are payable in lawful money of the United States of America. In addition to the installments of principal required to be paid by the Issuer as hereinabove set forth, the Issuer shall have the right to prepay on any date the entire principal amount hereof then remaining unpaid, or such lessor portion thereof as it may determine upon, in multiples of $1,000 at par and interest accured to the date of prepayment. Notice of any such optional prepayment shall be given prior to the prepayment date by mailing to the Holder of this Bond a notice fixing such prepayment date and the amount of principal to be prepaid, and published notice of redemption shall be given if and in the manner required by law. This Bond has been issued pursuant to and in full conformity with the Constitution and laws of the State of Minnesota and pursuant to a resolution adopted by the City Council on December 12, 1983 (the "Resolution "), for the purpose of providing money to finance the construction of sanitary sewer, water, storm sewer and street improvements in the Heights Business Park in the City, and is payable out of the General Obligation Improvement Bonds of 1983 Fund of the Issuer. This Bond constitutes a general obligation of the Issuer, and to provide moneys for the prompt and full payment of the installments of principal and interest when the same become due, the full faith and credit and taxing powers of the Issuer have been and are hereby irrevocably pledged. The Bond is issuable solely as a fully registered Bond in the denomination of $30,000. Reference if hereby made to the Resolution for a description of the rights and duties of the Bond Registrar. Copies of the Resolution are on file in the principal office of the Bond Registrar. -5- This Bond is transferable by the Holder in person or by his attorney duly authorized in writing at the principal office of the Bond Registrar upon presentation and surrender hereof to the Bond Registrar, all subject to the terms and conditions provided in the Resolution. Thereupon the Issuer shall execute and the Bond Registrar shall insert the date of authentication of, and deliver, in exchange for this Bond, one new fully registered Bond in the name of the transferee or transferees (but not registered in blank or to "bearer" or similar designation) of an authorized denomination, in principal amount equal to the principal amount of this Bond, bearing the same maturities and bearing interest at the same rates. The Bond Registrar may require payment of a sum suf- ficient to cover any tax or other governmental charge payable in connection with the transfer or exchange of this Bond. The Issuer and the Bond Registrar may treat the per- son in whose name this Bond is registered as the owner hereof for the purpose of receiving payment as herein provided and for all other purposes, whether or not this Bond shall be overdue, and neither the Issuer nor the Bond Registrar shall be affected by notice to the contrary. IT IS HEREBY CERTIFIED AND RECITED that all acts, conditions and things required by the Constitution and laws of the State of Minnesota to be done, to happen and to be per- formed, precedent to and in the issuance of this Bond, have been done, have happened and have been performed, in regular and due form, time and manner as required by law, and this Bond, together with all other debts of the Issuer outstanding on the date of original issue hereof and the date of its issu- ance and delivery to the original purchaser, does not exceed any constitutional or statutory limitation of indebtedness. Dated: Notice: The assignor's signature to this assignment must correspond with the name as it appears upon the face of the within Bond in every particular, without alteration or any change whatever. Signature Guaranteed: Signature(s) must be guaranteed by a national bank or trust company or by a brokerage firm having a membership in one of the major stock exchanges. The Bond Registrar will not effect transfer of this Bond unless the information concerning the transferee requested below is provided. Name and Address: (Include name and address for all joint owners if the Bond is held by joint account) -9- 8. The Bond shall be executed on behalf of the City by the signatures of its Mayor and City Clerk- Treasurer and be . sealed with the seal of the City. In the event of disability or resignation or other absence of either such officer, the Bond may be signed by the manual signature of that officer who may act on behalf of such absent or disabled officer. In case either such officer whose signature shall appear on the Bond shall cease to be such officer before the delivery of the Bond, such signature shall nevertheless be valid and sufficient for all purposes, the same as if he had remained in office until delivery. 9. The Bond Registrar shall insert the date of authentication in the space provided, except that for purposes of the Bond delivered to the original purchaser, the Bond Registrar shall insert as a date of authentication the date of original issue, which date is December 15, 1983. 10. The City will cause to be kept at the principal office of the Bond Registrar a bond register in which, subject to such reasonable regulations as the Bond Registrar may prescribe, the Bond Registrar shall provide for the registra- tion of the Bond and the registration of transfers of the Bond entitled to be registered or transferred as herein provided. Upon surrender for transfer of the Bond at the princi- pal office of the Bond Registrar, the City shall execute and the Bond Registrar shall insert the date of authentication of (in the space designated Date of Authentication), and deliver, in the name of the designated transferee or transferees, one new Bond of any authorized denomination of a principal amount, having the same stated maturities and interest rates, as requested by the transferor; provided, however, that no Bond may be registered in blank or in the name of "bearer" or similar designation. At the option of the holder, the Bond may be exchanged for a Bond of any authorized denomination of a like principal amount and stated maturities, upon surrender of the Bond to be exchanged at the principal office of the Bond Regis- trar. Whenever any Bond is so surrendered for exchange, the City shall execute and the Bond Registrar shall insert the date of authentication of (in the space designated Date of Authenti- cation), and deliver the Bond which the holder making the exchange is entitled to receive. The Bond surrendered upon any exchange or transfer provided for in this resolution shall be promptly cancelled by the Bond Registrar and thereafter disposed of as directed by the City. is -10- . The Bond delivered in exchange for or upon transfer of Bond shall be a valid general obligation of the City evi- dencing the same debt, and entitled to the same benefits under this resolution, as the Bond surrendered for such exchange or transfer. Every Bond presented or surrendered for transfer or exchange shall be duly endorsed or be accompanied by a written instrument of transfer, in form satisfactory to the Bond Registrar, duly executed by the holder thereof or his attorney duly authorized in writing. The Bond Registrar may require payment of a sum suf- ficient to cover any tax or other governmental charge payable in connection with the transfer or exchange of any Bond. 11. Each Bond delivered upon transfer of or in exchange for or in lieu of any other Bond shall carry all the rights to interest accrued and unpaid, and to accrue, which were carried by such other Bond. 12. Interest on the Bond shall be paid on each inter- est payment date by check or draft mailed to the person in whose name the bond is registered (the "Holder ") on the regis- tration books of the City maintained by the Bond Registrar and at the address appearing thereon at the close of business on the fifteenth day of the calendar month next preceding such interest payment date (the "Regular Record Date "). Any such interest not so timely paid shall cease to be payable to the person who is the Holder thereof as of the Regular Record Date, and shall be payable to the person who is the Holder thereof at the close of business on a date (the "Special Record Date ") fixed by the Bond Registrar whenever money becomes available for payment of the defaulted interest. Notice of the Special Record Date shall be given by mail by the Bond Registrar to the Holder not less than 10 days prior to the Special Record Date. 13. The City and the Bond Registrar may treat the person in whose name the Bond is registered as the owner of such Bond for the purpose of receiving payment of installments of principal of and interest (subject to the payment provisions in paragraph 12 above) on such Bond and for all other purposes whatsoever, whether or not such Bond shall be overdue, and neither the City nor the Bond Registrar shall be affected by notice to the contrary. 14. The Bond when so prepared and executed shall be delivered by the Clerk- Treasurer to the Purchaser thereof upon receipt of the purchase price, and the Purchaser shall not be obliged to see to the proper application thereof. -11- S 15. There is hereby created a special fund to be designated the "General Obligation Improvement Bond of 1983 Fund" (the "Fund ") to be held and administered by the City Clerk - Treasurer separate and apart from all other funds of the City. The Fund shall be maintained in the manner herein speci- fied until the Bond herein authorized and any other general obligation bonds hereinafter issued and made payable from said account and the interest thereon have been fully paid. There shall be created and maintained in the Fund two separate accounts, to be designated the "Construction Account" and the "Debt Service Account," respectively. The proceeds of the sale of the Bond herein authorized, less any accrued interest received thereon, and less capitalized interest in the amount of $9,450 (together with investment earnings thereon and sub- ject to such other adjustments as are appropriate to provide sufficient funds to pay interest due on the Bond on or before August 1, 1985), plus any special assessments levied with respect to Improvements financed by the Bond and collected prior to completion of the Improvements and payment of the costs thereof, shall be credited to the Construction Account, from which there shall be paid all costs and expenses of making the Improvements listed in paragraph 16, including the cost of any construction contracts heretofore let and all other costs incurred and to be incurred of the kind authorized in Minnesota Statutes, Section 475.65; and the moneys in said Account shall be used for no other purpose except as otherwise provided by law; provided that proceeds of the Bond may also be used to the extent necessary to pay interest on the Bond due prior to the anticipated date commencement of the collection of taxes and special assessments herein levied or covenanted to be levied are first received; and provided further that if upon comple- tion of the Improvements there shall remain any unexpended balance in the Construction Account, the balance (other than any special assessments) may be transferred by the Council to the account of any other improvement instituted pursuant to Minnesota Statutes, Chapter 429; and provided further that any taxes and special assessments credited to the Construction Account are hereby pledged and shall be used only to pay princi- pal and interest due on the Bond. There is hereby pledged and there shall be credited to the Debt Service Account (a) all collections of special assessments herein covenanted to be levied and either initially credited to the Construction Account and required to pay any principal and interest due on the Bond or collected subsequent to the completion of the Improvements and payment of the costs thereof; (b) all accrued interest received upon delivery of the Bond; (c) capitalized interest in the amount of $9,450 (together with investment earnings thereon and subject to such other adjustments as are appropriate to provide sufficient funds to pay interest due on the Bond on or before August 1, 1985); (d) any collections of all taxes which may hereafter be levied for payment of the -12- Bond; (e) all funds remaining in the Construction Account after completion of the Improvements and payment of the costs thereof, not so transferred to the account of another improve- ment; and (f) all investment earnings on funds held in the Debt Service Account. The Debt Service Account shall be used solely to pay principal and interest and any premiums for redemption on the Bond issued hereunder and any other general obligation bonds of the City heretofore or hereafter issued by the City and made payable from said account as provided by law. Any sums from time to time held in the Debt Service Account (or any other City account which will be used to pay principal or interest to become due on the Bond) in excess of amounts which under the applicable federal arbitrage regulations may be invested without regard as to yield shall not be invested at a yield in excess of the applicable yield restrictions imposed by the arbitrage regulations on such investments after taking into account any applicable "temporary periods" made available under the federal arbitrage regulations. 16. It is hereby determined that no less than 100% of the cost to the City of each Improvement financed hereunder within the meaning of Minnesota Statutes, Section 475.58, Subdivision 1(3), shall be paid by special assessments to be levied against every assessable lot, piece and parcel of land benefited by the Improvements. The City hereby covenants and agrees that it will let all construction contracts not hereto- fore let within one year after ordering each Improvement financed hereunder unless the resolution ordering the Improve- ment specifies a different time limit for the letting of construction contracts and will do and perform as soon as they may be done, all acts and things necessary for the final and valid levy of such special assessments, and in the event that any such assessment be at any time held invalid with respect to any lot, piece or parcel of land due to any error, defect, or irregularity, in any action or proceedings taken or to be taken by the City or this Council or any of the City officers or employees, either in the making of the assessments or in the performance of any condition precedent thereto, the City and this Council will forthwith do all further acts and take all further proceedings as may be required by law to make the assessments a valid and binding lien upon such property. The assessments have not heretofore been authorized, and accord- ingly, for purposes of Minnesota Statutes, Section 475.55, Subdivision 3, the assessments are hereby authorized. Subject to such adjustments as are required by conditions in existence at the time the assessments are levied, it is hereby determined that the assessments shall be payable in equal, consecutive, annual installments, with general taxes for the years shown below and with interest on the declining balance of all such assessments at the rate of at least 12 % per annum: -13- i • Improvement Designation Amount Levy Years Improvements - Heights $80,000 1984 -1992 Business Park At the time the special assessments are in fact levied the City Council shall, based on the then current estimated collections of the assessments, make any adjustments in any ad valorem taxes required to be levied in order to assure that the City continues to be in compliance with Minnesota Statutes, Section 475.61, Subdivision 1. 17. The special assessments are such that if col- lected in full they, together with the estimated collection of other revenues herein pledged for the payment of the Bond, will produce at least five percent in excess of the amount needed to meet when due the installments of principal and interest pay- ments to become due on the Bond. 18. For the prompt and full payment of the install- ments of principal and interest on the Bond, as the same respec- tively become due, the full faith, credit and taxing powers of the City shall be and are hereby irrevocably pledged. If the balance in Debt Service Account is ever insufficient to pay all installment of principal and interest then due on the Bond pay- able therefrom, the deficiency shall be promptly paid out of any other funds of the City which are available for such pur- pose, and such other funds may be reimbursed with or without interest from the Debt Service Account when a sufficient bal- ance is available therein. 19. The City Clerk- Treasurer is hereby directed to file a certified copy of this resolution with the County Aud- itor of Washington County, Minnesota, together with such other information as he shall require, and to obtain from the Auditor his certificate that the Bond has been entered in his Bond Register. 20. The officers of the City are hereby authorized and directed to prepare and furnish to the purchaser of the Bond, and to the attorneys approving the legality of the issu- ance thereof, certified copies of all proceedings and records of the City relating to the Bond and to the financial condition and affairs of the City, and such other affidavits, certifi- cates and information as are required to show the facts relat- ing to the legality and marketability of the Bond as the same appear from the books and records under their custody and control or as otherwise known to them, and all such certified copies, certificates and affidavits, including any heretofore furnished, shall be deemed representations of the City as to the facts recited therein. -14- A The motion for the adoption of the foregoing resolu- tion was duly seconded by member Carufel and after full discussion thereof, and upon vote being taken thereon, the following voted in favor thereof: Sommerfeldt, Seggelke, Doerr, Carufel and O'Neal; and the following voted against the same: none. C� City Clerk- Treasurer (SEAL) • -16- • RESOLUTION NO. 83 -11 -47 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING THE DAY AFTER THANKSGIVING AS A HOLIDY FOR NON -UNION EMPLOYEES WHEREAS, Section 203.10 establishes legal holidays granted to public employees for the City of Oak Park Heights, and WHEREAS, The City Council has reviewed current established legal holidays for the non -union public employees of the City of Oak Park Heights and, WHEREAS, The City Council in reviewing the established legal holidays for non -union and public employees is determined as an additional holiday should be granted. NOW, THEREFORE, be it resolved by the City Council of the City of Oak Park Heights that effective in calendar year 1984 and thereafter, the day after Thanksgiving shall be treated as a holiday • for non -union employees within the City of Oak Park Heights and will be observed pursuant to the provisions of Section 203 of the Code of Ordinances of the City of Oak Park Heights. PASSED BY THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS THIS 14TH DAY OF NOVEMBER, 1983. rank Sommerfeldt, ayor ATTEST: �Laonne Wilson, City Clerk RESOLUTION NO. 83 -10-44 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION AMENDING THE ASSESSMENT ROLL WHEREAS, the notice of hearing on assessments for the Anderson - Linquist sewer and water extension project within the City of Oak Park Heights, Washington County, Minnesota was duly mailed and served in the manner prescribed by law, setting forth the hearing date of October 24, 1983 at 7:30 o'clock p.m. to receive public comment and all oral and written objections, if any, to proposed assessment with regard to said project and, WHEREAS, Pursuant to law, proposed assessment • roll was prepared by the City's Engineer was on file and open to public inspections by all persons interested pursuant to the directive of said notice and, WHEREAS, The City Engineer having received the comments from the public as to the nature of the proposed assessments has recommended an amendment to the proposed assessment roll and, WHEREAS, The City Council of the City of Oak Park Heights hereby determines that the amendment proposed by the City Engineer to the proposed assessment roll is just and equitable and necessary to a fair assessment for a payment all costs of the said improvement. • f v NOW, THEREFORE, be it resolved by the City Council of the City of Oak Park Heights as follows: 1. That the proposed assessments for the Anderson- Linquist sewer and water extension project improvement should be and are hereby amended in the manner and form set forth in Exhibit A attached hereto and incorporated by reference herein. CROIX VALLEY WATERSHED MANAGEMENT ORGANIZATION AND CREATION OF A JOINT POWERS AGREEMENT WITH THE EFFECTED COMMUNITIES BY THE CITY OF OAK PARK HEIGHTS WHEREAS, the Minnesota Legislature is duly required that all cities located within the Metropolitan counties join or form a water management organization or watershed district prior to June 30, 1983; and, WHEREAS, interest has been expressed in forming a water management organization by the civil communities effected within the Middle St. Croix Valley Water Management Organization consisting of the communities of Stillwater Township, City of Stillwater, City of Bayport, City of Oak Park Heights, City of Baytown Township, West Lakeland Township, City of Lakeland, City of Lakeland Shores, City of St. Mary's Point, City of Lake St. Croix Beach, City of Afton; and, WHEREAS, the City Council of the City of Oak Park Heights deems it to be in the best interest of its populous to join in the creation of the Middle St. Croix Valley Water Management Organization through a Joint Powers Agreement with the effected communities. NOW, THEREFORE, be it resolved by the City Council of the City of Oak Park Heights as follows: That the City of Oak Park Heights hereby approves of the creation of a Middle St. Croix Valley Watershed Management Organization consisting of the communities above - referenced further consents to the creation of a Joint Powers Agreement by the effected communities governing all the terms and conditions of their respective responsibilities within the organization and hereby resolves to appoint members to work with the various members of the other effected communities in the creation of such a Joint Powers Agreement and negotiations over the creation of such a Watershed MAnagement Organization. WHEREAS, Section 1001.07 of the Code of Ordinances of the City of Oak Park Heights vests in the Oak Park Heights City Council the authority to establish by resolution water rates and sewer usage rates, building regulations and penalties for failure to pay; and WHEREAS, the City Council of the City of Oak Park Heights has received from the City Engineer a written report as to the financial needs of the City's utility system, both as to water and sewer services currently being provided to residents of the City of Oak Park Heights, which report is on file in the office of the City Clerk; and WHEREAS, a public hearing was held by the City Council of the City of Oak Park Heights on April 25, 1983, at which time the public was given an opportunity to comment on the proposed water and sewer rates and also upon the written engineering report above - referenced. That the Conditional Use Permits and Planned Unit Development renewal is hereby granted subject to and conditioned upon the following: a) That all past and overdue municipal utility and garbage charges, connection charges and assessments, if any, with interest thereon as specified upon the records of the City Clerk in and for the City of Oak Park Heights be paid in full to the City Clerk of the City of Oak Park Heights. That no building permit or Certificate of Occupancy shall be issued by the City Council until such time as the City Clerk has certified payment in full as to these amounts. • b) That all engineering concerns and problems as indicated in the letter of Bonestroo, Rosene, Anderlik and Associates, dated March 29, 1983, be resolved by the applicant to the satisfaction of the City Engineer, Bonestroo, Rosene, Anderlik and Associates, who shall then certify completion of same to the City Council. c) That all planning concerns and problems as identified in the letter of Northwest Associated Consultants, Inc., dated March 21, 1983, be resolved by the applicant to the satisfaction of the City's Planning Consultant, who shall then certify completion of same to the City Council. d) That the applicants shall grant Gerald Kane an easement over and across road accesses to Sunnyside on the St. Croix Development should Mr. Kane not have a present recorded easement or other documented right of access over those private roads for the purpose of ingress and egress to and from his property. e) That certain fencing existing in the northern portion of the Sunnyside on the St. Croix Development blocking or inhibiting access to the City fire hydrants and /or municipal utilities be removed by the applicant. f) That no Certificate of Occupancy shall be issued nor any sale of any unit within the proposed development be per- mitted until such time as the City of Oak Park Heights has approved -2- • the applicants' proposed Restrictive Covenants, Bylaws and Articles of Association or Incorporation of any homeowners or condominium association. Such documents shall be coordinated with the existing Homeowners Association's Bylaws and Restrictive Covenants so as to provide continuity in use and planning of the property within the entire development as well as incorporating within same a reasonable procedure for the resolution of disputes, sharing of costs and expenses and other matters required by statute or municipal ordinance. g) Compliance with all existing City Ordinances. WHEREAS, Section 1407 of the Code of Ordinances for the City of Oak Park Heights provides that no person shall keep or maintain or permit to be operated or maintained upon the premises owned or leased by him any amusement device as defined in Section 1407.01 without first having obtained a license from the City Clerk; and WHEREAS, Section 1407.04 of said ordinance provides that a fee for said license shall be established by council resolution from time to time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota, that the annual permit fee for each amusement device shall be in the amount of $ 5.00 per machine. BE IT FURTHER RESOLVED that all mechanical amusement device licenses shall be issued for a period not to exceed one year and shall expire on the last day of December in each year. If a portion of the license year is elapsed when the application is made, the annual permit fee established in the amount of $5.00 shall still be paid unless the license is issued on or after July 1 of the license year in which case the amusement device permit fee shall be in the amount of $2.50. Applications for renewal of an existing license shall be made at least sixty (60) days prior to the date of expiration of the license. Each license shall be issued to the applicant only and shall not be transferable to another holder. Each license shall be issued only for the premises described in the application and no license may be transferred to another place without the approval of the City Council. The engineer assures me that there will be no obstructions of your driveways affecting your property during the time of construction in terms of excavation as the only portion of your property affected is the very corner thereof which is shown on his map as being some distance away from your presently located driveways. As far as your questions which were communicated to this office on the 14th of January, we have again verified through the engineer's office that there will be no above ground pump station located on the property nor shall there be any above ground pipe on the property except in that area of the permanent easement where the pipe will surface for the purpose --� of entering and emptying its contents into a thirty inch CMP which is located under the existing railroad track. Again, I am enclosing herewith for your review an additional photocopy of the map which we left with you when we last discussed the matter for your review in the event you have misplaced yours indicating that it is only the very northeast corner of your property which is affected by the proposed improvement. • Mrs. Dora A. Dear Don: Mrs. Koller is the only individual aside from Mr. Beaudet who has yet unsigned on granting easements for the project and I assume that you will have redrawn the legal description for Mr. Beaudet and will be forwarding same here forthwith. Additionally, on the Anderson /Linquist project, Mr. and Mrs. Dielentheis are the only parties unsigned that I am aware of as to that matter. We have also now completed and have received the utility easement and agreement from the State of Minnesota and, additionally, I would anticipate that easement agreement should be drawn up for Mr. Junker with regard to the improvement to be made to his property and if you would review that file as well and draw up any necessary legal description, we will have him sign same. C � La Vonne Wilson • • i RESOLUTION NO. 83 -2 -3 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING ANNUAL AND RENEWAL FEES FOR HOME OCCUPATIONS WITHIN THE CITY OF OAK PARK HEIGHTS. WHEREAS, Section 401A of the Zoning Ordinance of the City of Oak Park Heights provides for the establishment of Home Occupations by residents of the City of Oak Park Heights under the terms and conditions and restrictions set forth within that section; and WHEREAS, Section 401.18 of the Zoning Ordinances of the City of Oak Park Heights provides for the collection of fees by the City to defray the cost of processing applications with regard to such applications and recuping all administrative costs with regard thereto; and WHEREAS, the City Council of the City of Oak Park Heights is determined the need for annual supervision with regard to home occupation permits issued within the City of Oak Park Heights. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: That as it regards home occupation permits to be issued within the City of Oak Park Heights, each applicant shall pay an initial annual fee in the amount of $25 with regard to obtaining the home occupation permit. Thereafter, annually, such permit will be renewed for a fee of $10 to be collected by the City Clerk. BE IT FURTHER RESOLVED that all such conditional use permits shall expire on the last day of December in each year. Each license shall be issued for a period of one year, except that if a portion of the license year has elapsed when the application was made, a license may be issued for the remainder of the year on a pro -rated fee. WHEREAS, Section 1202.03 of the Ordinances of the City of Oak Park Heights provides for the applicant for liquor licenses within the City of Oak Park Heights to provide certain information to the City Clerk within the application; and, WHEREAS, Chapter 528 of the Laws of Minnesota for 1982 have amended Section 340.11 of the Minnesota Statutes by adding a Subdivision 21 thereto, requiring proof of liability insurance to be filed with the Commissioner of Public Safety further amending Section 340.12 affecting applications for liquor licenses to municipalities; and WHEREAS, the City of Oak Park Heights deems it to be in the best interest of the residents of the City of Oak Park Heights and to the benefit of the general health, welfare and safety of the citizens of Oak Park Heights to require certain additional information to be made with every filing for renewal or original application for liquor licenses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights as follows: 1. That every holder of a liquor license in the City of Oak Park Heights, be it on -sale or off -sale, shall, prior to • i • the commencement or continuation of operation after March 1, . 1983, file with the City of Oak Park Heights proof of insurance as will be required on that date by Minnesota Statute 340.11, subdivision 21 and 340.12. Failure to comply with the provisions of the statutes above cited and with the terms of this Resolution shall be grounds for immediate revocation of the license. Proof of insurance coverage as required herein shall be deemed complied with, by the providing to the City of Oak Park Heights a certificate of insurance reflecting the terms and the conditions of the policy of insurance required by the above - referenced statute. WHEREAS, Section 601.03 of Chapter 601 of the Code of Ordinances of the City of Oak Park Heights regulates the operation of kennels within the municipal limits of the City of Oak Park Heights; and WHEREAS, the ordinances of the City of Oak Park Heights define a kennel to mean any place where three or more dogs over four months of age are owned, boarded, breed or offered for sale; and WHEREAS, the aforementioned ordinances of the City of Oak Park Heights require any person who keeps and operates a kennel, in lieu of a license for each dog, to apply for a kennel license for which that individual should pay a fee; and WHEREAS, the aforementioned ordinances of the City of Oak Park Heights authorize the City Council to establish by resolution fees for kennel licenses. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights that there shall be established a kennel license fee in the amount of $100 to be paid by each and every person keeping or operating a kennel within the City of Oak Park Heights, which fees shall be paid to the City Clerk upon application for a kennel license to be issued by the City Clerk of Oak Park Heights.
