This letter will confirm that the City of Oak Park Heights has received payment from Secure Mini Storage, LP for the
payment of the connection charges for water, sewer and stormwater sewer relative to the property referenced above.
These payments relative to connection charges, reflect a one-time fee that the City assesses with connection charges
for facilities of this nature.
In 2007 the City of Oak Park Heights had initiated a lawsuit against the then-owner of the property, Secure Mini Storage,
LLP and Public Storage, Inc. relative to the payment of those of those fees. The Court at that time determined that as
it related to the limited facilities that had already been hooked up at that stage, that the City was not going to be allowed
to collect the fees at that time. Since that date, the City has adjusted and increased its connection charges over several
years to where they are considerably more presently than they were at the previous time.
As a compromise your company agreed to pay the fee that was outstanding back in 2007, that being in the amount of
$102,714.00 without adjustment or cost of living increases which the City accepted as full and final payment for the
connection charge fees authorized under ordinance. This letter reflects that those fees have been paid in full, and the
property has paid its obligation under the City’s ordinances for the connection fees for municipal water, sanitary sewer
and storm sewer.
This further confirms that the City of Oak Park Heights waives any and all claims relating to the 2007 water, sewer and
storm water fees, charges, liens or levies relating to the Property and any claims that were brought or could have been
brought in the Lawsuit.
