CITY OF OAK PARK HEIGHTS—WEEKLY NOTES for: November 23rd,2018 TO: City Council Members& Staff FROM: Eric Johnson,City Administrator Zoning and Development Items: 1. No New applications have been received. 2. The METROPOLITAIN COUNCIL has responded to the City's submitted Comprehensive Plan,see the attached comments dated 11113118. Staff will be reviewing and responding. We speculate that many of these comments are boiler-plate and/or simply need some further clarifications. 3. A cigar 1 tobacco store is planning to locate in OPH, see the enclosed letter outlining their required licensure under City Ord 1409. OTHER ITEMS: • TENNIS Sanitation has provided the City a compiled listing of the"EXTRAS"that they have had to bill out and where those homes have not paid. These total$773.87. This amount is consistent with past years and ultimately the Council will need to consider if it desires to attempt a direct billing. We do simply ask TENNIS to pick-up all garbage and attempt a billing,but to then please provide the City a list of any outstanding amounts. For the most part, the self-policing of this has worked fine as has public awareness. Compared to the $120,000 annual cost,the$773 is fairly small. • The MN Correctional Facility—STILLWATER will be hosting their annual Holiday Event on 12/11 —See Enclosed. • Similarly, there will be an OPEN HOUSE for the watershed district on 12112 See enclosed. • A final copy of the communication to Sen. In the preliminary review, staff focused on whether the draft Plan appeared to be complete and contained any major system issues or policy conflicts. Time did not permit as thorough of a review as will occur when the Plan is officially submitted for Council review. A more detailed review may reveal other important matters that were not identified during this preliminary review. We offer the below advisory comments for your consideration. Surface Water Management (Jim Larsen, 651-602-1159) The City lies within the oversight boundaries of the Middle Saint Croix Watershed Management Organization, and the Valley Branch and Browns Creek Watershed Districts. The City submitted a draft Local Water Management Plan (LWMP) update in September 2018. Council staff reviewed and commented on the draft LWMP to the City and Watersheds in a letter dated September 12, 2018. ` �.- e - ., METROPOLITAN An C O U N C I L Scott Richards, Consulting Planner November 13,2018 Page 2 of 10 _Advisory Comments If available at the time the City submits its formal Plan, the City should provide the complete final LWMP in an Appendix in the Plan and a Water Resources summary in the body of.the Plan (as was done with the draft LWMP in this preliminary review submission), incorporating any recommended revisions from the Council and Watershed reviews of the draft LWMP. If available at the time the formal Plan is submitted, we also request that the City provide to the Council.the dates the three Watersheds approved the LWMP and the date the City adopted the final LWMP. Incomplete for Review The following sections of the draft Plan are considered incomplete. Forecasts (Todd Graham, 651-602-1.322) The Plan is incomplete for the City forecasts and land supply for future growth. The Plan includes the forecasts for the City (p. 57). There is an apparent error in the table provided: the 2040 households number should be 2,600 (not 6,800). The Plan states (p. 57): "These forecasts are accepted by the City as the basis for growth, with the exception of the employment numbers, which the City projects will be less than what is provided by the Metropolitan Council."Council staff and the City's planner have discussed substitute employment numbers. The Plan does not sufficiently describe how land supply for future development(or redevelopment) accommodates the community's growth forecast. An inventory of potential . development and redevelopment sites is notprovided:°The planned land use table descbes ri�ef-dsn , y, 5 acre, of F;�e�ium-density only minimal additions of new land supply: 7 acres of lo and 5 acres of high-density land. This falls short of the expectation of guiding enough land to accommodate the growth forecast: 343 additional households during 2017-2040. Advisory Comments • The TAZ forecast table on p. 99 should reflect the revised employment forecast, as discussed above. • The employment figures in the Comprehensive Sewer Plan should reflect the revised employment forecast, as discussed above. I I 3 of 61 Scott Richards, Consulting Planner November 13,2018 Page 3 of 10 Land Use (Freya Thamman, 651-602-1750) The Plan is incomplete for land use.Additional information is also needed to ensure consistency with Council policy of planning for forecasted residential growth at a density of at least 5 units/acre for Suburban communities.To be complete for review;tie.Plan needs to address the following issues' Community Designation The Plan needs to include a map acknowledging the City's Community's.designation. Future Land Use + The future land use section needs to include discussion of each future land use category, allowed uses for each category (i.e.. for residential uses, allowed housing types such as single-family, duplexes, townhomes, etc.), and the minimum and maximum densities for all categories that allow residential uses. It appears that some categories may allow a mix of uses (i.e. Business/Residential Tranpition). For each "mixed use" category,the Plan needs to define an expected share of individual land uses and identify the permitted density range, if there are residential uses. The future land use categories shown in the text, as well as associated to le (pre land use figure (p.80) need to be consistent throughout the Plan. For-example, thefigure has Business/Residential Transition, but the table does not include this category. Density. To be consistent with Council policy,-the City's Plan needs to:support forecasted growth and at a density of at least.5 units/�acre..To do so,.the land use plan needs demonstrate that residential-development wilt occur M appropriate densities-to accommodate the forecasted growth and is.consistent with the density policy of 5 units/acre for the.Suburban planning area designation. Currently there are 17 acres shown for new residential land (supporting 67-121 residential units at approximately 3.9 units/acre). The Plan needs to identify where forecasted residential growth will happen on your Future Land Use Map, showing new development and re-development areas, associated residential density range, and when residential development is anticipated to happen. IncOmglete items Existing Housing Needs • Number of publicly subsidized housing units are noted on p. 70, but are not described by type. The Plan should clearly indicate the housing needs of existing residents and at a minimum address the components of the existing housing assessment, including households experiencing housing cost burden. Projected Housing Need • Land guided to address the City's allocation of affordable housing need for 2021-2030 is not sufficiently described for review. The land use table on page 75 does not show land guided for development within periods of time that fit within the required decade of 2021-2030. • The Plan states that there are 56 acres of undeveloped land. The table on page 75 shows 5 acres.guided for high density residential. Guiding more land as High Density Residential in the 2021-2030 decade or some other land use category with a density of at least 8 units/acre are needed to meet the City's allocation. Implementation Plan • Please list the specific public programs, fiscal devices, and other specific actions that Washington County CDA to meet the need of rehabilitating aging property and any other housing needs identified. This may include Washington County CDA's Gap Financing for Redevelopment and Rental Owner Occupied Housing (GROW): Include in what circumstances this would be used (specific property conditions, areas of the community, to serve households of a specific AMI, after a City resolution or policy is passed, etc.) To learn more about the powers of EDAs and HRAs, please see the City Development Powers to Create Legal Entities in the Local Planning Handbook htt s.//metrocouncil.or andbook/Files/Resources/Fact-Sheet/HOUSING/Cit - Develo ment Powers-ta-Create-Le al-Entitle-q.as x • LCA programs are discussed in detail, however, there is very little detail on what types of Projects, serving what °/a AMI and special populations, would be served with these programs. Circumstances of when this funding will be applied for and how it will be used, as best as the community knows now, is required. • Rental license and inspection programs as well as ground maintenance regulations described on page 74 require more context about when they will be implemented (if not already). Inconsistent Items Projected Housing Needs • Based on minimum units per acre, it appears that High Density Residential is the only residential land use that is guiding minimum residential densities that can support the City's total allocation of affordable housing need for 2021-2030. The table describes that it is likely that 5 acres of land will develop as High Density. Rather, a local fair housing Policy ensures the City is aware of fair housing requirements with regard to housing decisions and provides sufficient resources to educate and refer residents who feel their fair housing rights have been violated (this can be as simple as having links to resources on the City's website). The Metropolitan Council will require a local Fair Housing policy as a requirement to draw upon Livable Communities Act(LCA) awards beginning in 2019. To be complete for review, the Plan needs include the following: • A table that details adopted community severed forecasts in 10-year increments to 2040 for 'households'and employment. This data needs-to be broken down-by areas served by the Metropolitan Disposal System and subsurface sewage treatment systems (SSTS). • An electronic map or maps (GIS shape files or equivalent) showing the following information regarding the existing sanitary sewer system. o Lift stations. o Existing connections points to the metropolitan disposal system. o Future connection points for new growth if needed. o Local sewer service districts by connection point. o Intercommunity connections. • Copy of intercommuhity service agreements entered into with an adjoining community, including a map of areas covered by the agreement. • Table or tables that assigns 2040 growth forecasts by Metropoiitan interceptor facility. • Describe the requirements and standards in your community for minimizing inflow and infiltration (lil): 7 of 61 Scott Richards,Consulting Planner November 13,2018 Page 7 of 10 o Include a copy of the local ordinance or resolution that prohibits discharge from sump pumps, foundation drains, and/or rain leaders to the sanitary.Sewer system: o Include a copy of tha'-lodal ordinance or resolution requiring-the disconnection of existing foundation drains, sump pumps, and roof leaders frorri'the-sanitary sevlrer system. v Describe the sources; extent, and significance of existing inflow and infiltration in both the municipal and private sewer systems: o Include a breakdown of residential housing-stock age within the community into pre-and post- 1970 era, and what percentage of pre-1970 era private services have been evaluated-for III susceptibility and repair, o Include the measured or estimated amount of clearwater flow generated from the public municipal and private sewer systems. o Include a cost summary for remediating the 1/1 sources identified in the community. Describe the implementation plan for preventing and eliminating excessive inflow and infiltration from entering both the municipal and private sewer systems. o Include a list of priorities for I/1 mitigation projects based on flow reduction, budget, schedule, or other criteria. o Include a schedule and the related financial mechanisms planned or needed to implement the UI mitigation strategy. • For new trunk sewer systems that require connection to the Metropolitan Disposal System: o A table that details the proposed time schedule for the construction of the new trunk sewer system.- o Type and capacity of the treatment facilities, whether municipally or-privately owned. o Copies of the associated National Pollutant.Discharge Elimination System (NPDES) or State Disposal System (SD,S) permits. • Map or maps (GIS shape files or equivalent) showing the following information: (6 SSTS) o Location of sub-surface sewage treatment systems. o Location of nonconforming systems or systems with problems Subsurface Sewage Treatment Systems (SSTS) (Jim Larsen, 651-602-1151) The Plan is incomplete for SSTS review. The Plan will need to include a map depicting the location of the six remaining individual SSTS in the City. Council staff suggests adding their locations"to the Comprehensive Sewer Plan Appendix G Sanitary$ewer System Map. Aggregate Resources (Jim Larsen,651-602-1151) The Plan is incomplete for aggregate resources. The Council's aggregate resources in information contained in Minnesota Geological Survey Information Circular 46 indicates that there are several small isolated sand and gravel deposits in the City, but no aggregate resource deposits that are likely to be of sufficient size to be economically viable for mining in the nearly fully urbanized community. The.formal Plan needs to indicate that there are no aggregate resources available for mining in the City or provide a'summary of any known, potentially available resources or active mining operations within the City. 8 of 61 Scott Richards,Consulting Planner November 13,2018 Page 8of10 Transportation (Heidi Schallberg, 651-602-9729) The Plan is incomplete for Transportation. To be complete for review, the-Plan needs to address the following: • Identify the existing and future number of lanes for principal and A-minor arterials. The existing number of lanes was only identified for Highway 36 as a principal arterial. if no changes to the number of lanes are planned, this should be specified in the Plan. • Forecasted traffic volumes must be for 2040. The draft Plan includes forecasted numbers for 2030. • For transit, the Plan must describe the community in relationship to the transit market areas (III and V for Oak Park Heights) and describe the appropriate level of service for these market areas. • For transit, the Plan needs to include that Highway 36 is an express bus corridor in the TPP. • For bicycling, the Plan needs to map and describe the Tier 2 Regional Bicycle Transportation Network (RBTN) alignments in the City. The map should also show the relationship of the RBTN to the local bicycle network, including all existing and planned connections and local activity centers. Advisory Comments Roadways • If heavy commercial average annual daily traffic (HCAADT) is available for the principal and A-minor arterials in the City, the data should be included on the map of current traffic volumes. • On the functional classification map, Council staff suggest Including local streets in the map legend. Transit • Because the City is within two transit market areas, Council staff suggest including a map of those transit market areas in relationship to the City. Bicycling and Walking. • The transportation chapter refers to the parks chapter for discussion of bicycling and walking. Biking and walking are transportation modes, not just recreation. Including more discussion of these modes in transportation would help integrate planning for these modes as part of transportation to help the community reach its stated goals of making connections to pedestrian destinations, schools, etc. It would be useful to map pedestrian facilities in relation to these types of'destinations, not just parks. • Clarify if on-street trails as described on page 130 are intended and marked for use by both pedestrians and bicyclists. • It is generally preferred to use people-first language in relation to people with disabilities. On pages 130 and 933, the phrase "disability accessible" is used in relation to trails. Suggest changing this to"accessible for people with disabilities." 9 of 61 Scott Richards,Consulting Planner November 13,2018 Page 9 of 10 Regional Parks and Trails (Freya Thamman, 651-602-1750) The Plan is incomplete for Regional Parks and Trails. To-be complete for review, the.Plan needs to map and identify the Middle St. Croix Valley Regional Trail Search Corridor. The regional trail search corridor travels through Stillwater, Oak Park Heights, Bayport, Baytown Township,West Lakeland Township, and Lakeland as it connects to the Browns Creek State Trail. Advisory Comments The City may want to consider updating Plan's Introduction, which states that the City will be updating its Comprehensive Park and Trail System Plan. Solar (Cameran Bailey, 651-602-1?12) ; The Plangs�Incomplete and inconsistent with statutory requirements (Minn. Stat. 473.859. Subd. 2; Section 1038.235)'and Council policy regarding planning for the protection and development of access to direct sunlight for solar energy systems as required by the Metropolitan Land Planning Act (MLPA). The Plan needs to include the solar resource map's corresponding calculations of the community's gross solar and rooftop solar resource. These calculations can be found on the community's Community Page on the Local Planning Handbook. Advisory Comments There are very good solar policies and goals in the Plan. Council staff recommend enrolling in the following cost-free programs, which are designed to provide planning,technical, and policy assistance to local Minnesota governments, as additional"solar implementation strategies" in your Plan: . • U.S. Dept. of Energy's SolSmart Program -Solar Permitting, Zoning, and Development • MN GreenStep Cities Program—Sustainability Best Practices • Xcel Energy's Partners in Energy Program—Energy Action Plan Development Implementation (Freya Thamman, 651-602-1750) The Plan is incomplete for implementation. Additional implementation information,`as discussed above in the Housing and Wastewater sections, is required. The implementation chapter lists possible improvement projects and indicates that the chapter should be reviewed and updated each year at the beginning.of.annual financial.planning. Additional detail is suggested schedule for the preparation, adoption, and administration of needed changes to official controls. Advisory Comments • The City may want to consider indicating in the Plan that it will review and update official controls within 9 months of adopting the 2040 Plan. The Plan indicates that the Implementation chapter should be reviewed and updated each year at the beginning of its financial planning. For clarity, Council staff suggest that the above sentence indicate that the Plan will be reviewed and updated each year. The Implementation section indicates that there are no current or projected mid and high density residential projects planned in the City; however, the land use table in five-year stages indicates anticipated medium and high-density development 2020-2025. 10 of 61 Scott Richards,Consulting Planner November 13,2018 Page 10 of 10 As a reminder, when the City's 2040 Plan is submitted for formal review, to be complete for review, the submittal materials need to include the list of all the affected jurisdictions that were sent a copy of the City's 2040 Plan for review, the date the City's 2040 Plan was provided for review, and the comments received by jurisdictions. Your subsequent response to review comments from adjacent jurisdictions must also be included with the submittal materials. If no comments were provided within the six-month review period, please note this as well. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS DOES HEREBY ORDAIN AS FOLLOWS: 1409.010 Purpose. Stat.,144.391. 1409.020 Definitions and Interpretations. Except as otherwise be provided or clearly implied by context, all terms shall be given their commonly accepted definitions. B. "Tobacco Related Devices"means any tobacco product as well as a pipe, rolling papers, or other device used in a manner which enables the chewing, sniffing, or smoking of tobacco or tobacco products. C. "Self-Service Merchandising"means open displays of tobacco,tobacco products, or tobacco related devices in any way where any person shall have access to the product without the assistance or intervention of an employee of the premises maintaining the self-service merchandising. Self-service merchandising shall not include vending machines. D. "Vending Machine"means any mechanical, electric or electronic,or other type of device which dispenses tobacco,tobacco products,or tobacco related devices upon the insertion of money,tokens,or other form of payment directly into the machine by the person seeking to purchase the tobacco,tobacco product,or tobacco related device. E. "Individually Packaged"means the practice of selling any tobacco or tobacco product wrapped individually for sale. Individually wrapped tobacco and tobacco products shall include,but not be limited to, single cigarette packs, single bags or cans of loose tobacco in any form, and single cans or other packaging of snuff or chewing tobacco. Cartons or other packaging containing more than a single pack or other container described in this subdivision shall not be considered individually packaged. F. "Loosies"means the common term used to refer to a single or individually packaged cigarette. G. "Minor"means any natural person who has not yet reached the age of eighteen(18)years. 2 21 of 61 u "Retail Establishment"means any place of business where tobacco, tobacco products,or tobacco related devices are available for sale to the general public. Retail establishments shall include, but not be limited to, grocery stores, convenience stores,restaurants, and bars. I. "Moveable Place of Business"refers to any form of business operated out of a truck,van, automobile, or other type of vehicle or transportable shelter and not a fixed address store front or other permanent type of structure authorized for sales transactions. J. "Sale"means any transfer of goods for money,trade,barter, or other consideration. K. "Compliance Checks"mean the system the City uses to investigate and ensure that those authorized to sell tobacco,tobacco products, and tobacco related devices are following and complying with the requirements of this Ordinance. Compliance checks may involve the use of minors as authorized by this Ordinance. j 1409.030 License. No person shall sell or offer to sell any tobacco,tobacco product,or tobacco related device without first having obtained a license to do so from the City. A. Annlication. An application for a license to sell tobacco,tobacco products,and tobacco related devices shall be made on a form provided by the City. The application shall contain the full name of the applicant,the applicant s residential and business addresses and telephone numbers,the name of the business for which the license is sought, and any additional information the City deems necessary. Upon receipt of a completed application,the City Clerk shall forward the application to the Council for action at its next regularly scheduled Council meeting. If the Clerk shall determine that an application is incomplete,he or she shall return the application to the applicant with notice of the information necessary to make the application complete. B. Action. The Council may either approve or deny the license,or it may delay action for such reasonable period of time as necessary to complete any investigation of the application or the applicant it deems necessary. If the Council shall approve the license,the Clerk shall issue the license to the applicant. If the Council denies the license,notice of the denial shall be given to the applicant along with notice of the applicant❑s right to appeals the Council❑s decision. 3 22 of 61 C. Term. All licenses issued under this Ordinance shall be valid for one (1)calendar year from the date of issue. D. Revocation or Suspension. Any license issued under this Ordinance may be revoked or suspended as provided in the Violations and Penalties section of this Ordinance. E. Transfers. All licenses issued under this Ordinance shall be valid only on the premises for which the license was issued and only for the person to whom the license was issued. No transfer of any license to another location or person shall be valid without the prior approval of the Council. F. Moveable Place of Business. No license shall be issued to a moveable place of business. Only fixed location businesses shall be eligible to be licensed under this Ordinance. G. Display. All licenses shall be posted and displayed in plain view of the general public on the licensed premises. H. Renewals. The renewal of a license issued under this section shall be handled in the same manner as the original application. The request for a renewal shall be made at least thirty(30) days,but no more than sixty (60)days before the expiration of the current license. The issuance of a license issued under this Ordinance shall be considered a privilege and not an absolute right of the applicant and shall not entitle the holder to an automatic renewal of the license. 1409.040 Fees. No license shall be issued under this Ordinance until the appropriate license fee shall be paid in full. Fees shall be set from time to time by the City Council by resolution. Fees shall be divided into two (2)classes. A Class"Tobacco 4 5 License shall be required for any retail establishment which sells tobacco,tobacco products, or tobacco related devices in cartons or other packaging containing more than a single pack or other container as described in Section 200, Subd. 5. A Class `B" Tobacco License shall be required for any retail establishment selling only individually packaged tobacco or tobacco products wrapped individually for sale. 1409.050 Basis for Denial of License. 4 23 of 61 8 The following shall be grounds for denying the issuance or renewal of a license under this Ordinance, and if a license is mistakenly issued or renewed to a person, it shall be revoked upon the discovery that the person was ineligible for the license under this Section. A. The applicant is under the age of eighteen(18)years. B. The applicant has been convicted within the past five(5)years of any violation of a Federal, State, or local law, ordinance provision, or other regulation relating to tobacco,tobacco products,or tobacco related devices. C. The applicant has had a license to sell tobacco,tobacco products, or tobacco related devices revoked, in the City or at any other place,within the preceding twelve (12)months of the date of application. D. The applicant fails to provide any information required on the application, or provides false or misleading information. E. The applicant is prohibited by Federal, State,or other local law, ordinance, or other regulation,from holding such a license. 1409.060 Prohibited Sales. It shall be a violation of this Ordinance for any person to sell or offer to sell any tobacco,tobacco product, or tobacco related device: A. To any person under the age of eighteen(18)years. B. By means of any type of vending machine. C. By means of self-service methods whereby the customer does not need to make a verbal or written request to an employee of a licensed premises in order to receive the tobacco,tobacco product, or tobacco related device. D. By means of❑loosies❑ as defined in Section 200, Subd. F of this Ordinance. E. Containing opium,morphine,jimson weed,bella donna, strychnos, cocaine,marijuana, or other type of deleterious,hallucinogenic, or toxic or controlled substance except nicotine and not naturally found in tobacco or tobacco products. F. By any other means or to any other person,prohibited by Federal, State, or other local law, ordinance provision,or other regulation. 5 24 of 61 1409.070 Vending Machines. It shall be unlawful for any person licensed under this Ordinance to allow the sale of tobacco, tobacco products, or tobacco related devices by the means of a vending machine. 1409.080 Self-Service Sales. It shall be unlawful for a license under this Ordinance to allow the sale of tobacco,tobacco products, or tobacco related devices by any means whereby the customer may have access to such items without having to request the item from the licensee or the licensee's employee. All tobacco,tobacco products, or tobacco related devices shall be stored behind a counter or other area not freely accessible to customers. 1409.090 Responsibility. All licensees under this Ordinance shall be responsible for the actions of their employees in regard to the sale of tobacco,tobacco products,or tobacco related devices on the licensed premises, and the sale of such a item by an employee shall also be considered a sale by the license holder,and each can be held responsible for any criminal and/or civil penalties imposed herein. 1409.100 Compliance Checks and Inspections. All licensed premises shall be open to inspection by the City Police or other authorized City official during regular business hours. From time to time, but at least once per year,the City shall conduct compliance checks by engaging minors to enter the licensed premises to attempt to purchase tobacco,tobacco products, or tobacco related devices. Minor used for the purpose of compliance checks shall not be guilty of unlawful possession of tobacco,tobacco products, or tobacco related devices when such items are obtained as a part of the compliance check. Retail establishments possessing a Class "A"License shall be subject to at least two (2) compliance checks per year. 1409.110 Other Illegal . Unless otherwise provided,the following acts shall be a violation of this Ordinance. A. Illegal Possession. It shall be a violation of this Ordinance for any minor to have in his or her possession any tobacco,tobacco product, or tobacco related device. This subdivision shall not apply to minors lawfully involved in a compliance check on behalf of the City. B. Illegal Use. 6 25 of 61 3 It shall be a violation of this Ordinance for any minor to smoke,chew, sniff, or otherwise use any tobacco,tobacco product, or tobacco related device. C. Illegal Procurement. It shall be a violation of this Ordinance for any minor to purchase or attempt to purchase or otherwise obtain any tobacco,tobacco product, or tobacco related device, and it shall be a violation of this Ordinance for any person to be sell or otherwise provide any tobacco,tobacco product,or tobacco related device to any minor, and it shall further be a violation for any person to coerce or attempt to coerce a minor to illegally purchase or otherwise obtain or use any tobacco,tobacco product,or tobacco related device. This subdivision shall not apply to minors lawfully involved in a compliance check on behalf of the City. D. Use of False Identification. It shall be a violation of this Ordinance for any minor to attempt to disguise his or her true age by the use of a false form of identification, whether the identification is that of another person or one on which the age of the person has been modified or tampered with to represent an age older than the actual age of the person. This subdivision shall not apply to minors lawfully involved in a compliance check on behalf of the City. 1409.120 Violations and Penalties. A. Criminal Penalty. Any person, firm, or corporation violating any of the provisions of this Ordinance shall be guilty of a misdemeanor. Each violation and every day in which a violation occurs or continues shall constitute a separate offense. B. Civil Penalty. The provisions of the City of Oak Park Heights Civil Penalty Ordinance, Chapter 208, shall apply to any and all licenses issued hereunder. If a retail establishment has its tobacco license suspended pursuant to a hearing conducted under the City❑s Civil Penalty Ordinance,that retail establishment shall, during the period of suspension,remove all tobacco, tobacco products, or tobacco related devices away from public view. 1409.130 Exceptions and Defenses. Nothing in this Ordinance shall prevent the providing of tobacco,tobacco products, or tobacco related devices to a minor as part of a lawfully recognized religious, spiritual, or cultural ceremony. It shall be an affirmative defense to the violation of this Ordinance for a person to have reasonably relied on proof of age as described by State Law. 7 26 of 61 1409.140 Severability and Savings Clause. If any section or portion of this Ordinance shall be found unconstitutional or otherwise invalid or unenforceable by a Court of competent jurisdiction,that finding shall not serve as an invalidation or effect the validity and enforceability of any other section or provisions of this Ordinance. 1409.150 Restriction on Age of Clerks. It shall be illegal for a retail establishment to cause or permit a minor to sell tobacco,tobacco products, or tobacco related devices. It shall also be illegal for any minor to sell tobacco,tobacco products,or tobacco related devices. 1409.160 Signage. Anyone holding a tobacco license under the provisions of this Ordinance shall post and display, in plain view of the general public, on the licensed premises a sign indicating that it is illegal to sell tobacco,tobacco products,or tobacco related devices to anyone under the age of eighteen(18)years and that the possession and use of such items by minors is also illegal under both State law and local ordinance. Said signs shall be of a type approved by City staff and issued to a retail establishment at the time that a license is obtained. The cost of said sign shall be included within the licensing fee. 8 27 of 61 1404 AN ORDINANCE LICENSING AND REGULATING THE RETAIL SALE OF CIGARETTES, CIGARETTE PAPERS,AND CIGARETTE WRAPPERS,AND PROVIDING A PENALTY FOR VIOLATION THEREOF. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS,WASHINGTON COUNTY, MINNESOTA,DOES ORDAIN: 1404.01 License Required. No person,firm,or corporation shall directly or indirectly,or by means of any device keep for retail sale, sell at retail, or otherwise dispose of any cigarette, cigarette paper, or cigarette wrapper at any place in the City of Oak Park Heights, unless a license therefor shall first have been obtained as provided in this Ordinance. 1404.02 Application and Issuance. Application for such license shall be made to the City Clerk on a form supplied by the City. The application shall state the full name and address of the applicant, the location of the building and the part thereof to be used by the applicant under the license,the kind of business conducted at such location,and such other information as shall be required by the application form. The completed application shall be presented to the City Council for its consideration and,if granted by the Council, a license shall be issued by the City Clerk upon payment of the required fee. 1404.03 License Fee. The fee for every license shall be as established by Council resolution,from time to time. Every license shall expire on December 31 st next after its issuance. We look forward to working with you. geg d ry oi�lber 39 of 61 MAOSC NOVEMBER FEDERAL UPDATE FALL CONGRESSIONAL ACTION In the months leading up to the midterm elections,a number of large bipartisan bills were passed through Congress and signed into law by President Trump.Much of this legislation is the culmination of long-term negotiations that had taken place in the Senate over months and even years. Opioids Legislation: President Trump signed Congress' bipartisan opioid plan into law in October,2018.This marked the end of a months-long legislative debate over how to curtail this significant drug problem and is the result of a compromise reached between Members of both parties in both Chambers.The compromise bill(HR 6)approves new grants for treatment programs and expanding Medicaid. The legislation includes$8 billion in funding for grant programs,including targeted-response grants for states,grants for residential treatment programs for pregnant women with substance-use disorders,and grants to support tracking and treating hepatitis C infections, and reimbursement for inpatient drug rehabilitation services. Water Resources Development Bill:President Trump signed a sprawling water policy bill into law in October, 2018 that authorizes water resource projects and policies nationwide to be administered by the US Army Corps of Engineers.The bill received strong bipartisan support from Congress.The final law is the product of months of back and forth negotiations between the House and the Senate. The water resources law green-lighted numerous mega- projects across the country and reinstated a`Buy America' clause for those projects.The primary purpose of this bill is to grant the Army Corps authority to move forward on dams,locks,reservoirs,and other mega-projects that require congressional approval,but it also goes far beyond that.The bill contains an extension of a new Environmental Protection Agency water loan program and establishes a study over the best way to organize the Army Corps of Engineers. FAA Reauthorization: The President signed legislation to reauthorize federal aviation programs into law in October.The bill(HR 302),which enjoyed bipartisan support in Congress,also includes the Disaster Recovery Reform Act,the National Transportation Safety Board Reauthorization Act,and the Transportation Security Administration reauthorization,among other non-aviation provisions.The measure includes a large number of provisions including expanding eligible uses of federal grants at airports,creating new protections for passengers on commercial airlines,expanding oversight of the Next Generation(NextGen)technology upgrade program, streamlining aircraft certification procedures,and further regulating the use of drones.The measure extends FAA authorities for five years. POTENTIAL LAME DUCK ACTIONS IN CONGRESS Following the Nov.6 election,the 115th Congress will reconvene for about a month to complete a few outstanding items. While some issues,such as government funding for the remainder of FY 2019 must be completed,action on other items may be taken up in the`lame duck' Congress or postponed until the 116th Congress in January. The day after the election,Senate Majority Leader Mitch McConnell(R-KY)expressed willingness to work with Democratic House Leadership on a new infrastructure package,which President Trump has cited as a priority throughout his Administration. Several other pieces of legislative could become bipartisan priorities in the next Congress if they are not fust addressed in the final weeks of the current session,including an overdue reauthorization of the farm bill and potential movement on a major criminal justice reform bill. Appropriations:Before the elections,Congress passed and the President signed five of the 12 annual spending bills for Fiscal Year 2019(FY19)into law accompanied by a continuing resolution(CR)extending government funding for all other agencies through Dec.7,2018.Congress must now reach agreement on final spending bills or a new CR by that date to avoid a partial government shutdown.President Trump has suggested he could seek a shutdown if the final spending agreement does not include certain provisions,including funding for a wall along the southern border. 40 of 61 Farm Bill: After months of work,the House and Senate are still in negotiations over the 2018 Farm Bill after both Chambers have passed their own version of the legislation.Now that the election is over,farm bill conference committee members are expected to meet again in early November.Among the negotiators working on the final Farm Bill are House Agriculture Committees Ranking Member Collin Peterson(D-MN)and Congressman Tim Walz (D-MN).House and Senate Leaders have said they plan to have a farm bill ready for a final vote after the November midterm elections. This legislation is wide reaching and includes energy,trade,commodity, conservation,nutrition and forestry titles. The current Farm bill is passed the deadline of the current law on September 30,but some programs can still continue until the end of the current crop year.Programs like the Supplemental Nutrition Assistance Program(SNAP)are permanently authorized and will continue without a new farm bill in place.The negotiators are still working out issues.The biggest divide is over Supplemental Nutrition Assistance Program work requirements,with House lawmakers proposing to tighten restrictions and add a mandatory training program and Senate negotiators opposing changes. With the Democrats gaining control of the House beginning in January,there are two paths forward for farm bill reauthorization:Congressional Leadership may resolve differences between the two bills,or,the Democrat- controlled House will introduce a new farm bill and begin the process anew next year. Criminal Justice Reform:With a renewed push by Congress and the Administration, criminal justice reform could see action during the lame duck session.The cornerstone piece of legislation,the First Step Act(HR 5682),was passed by the House in May and is considered a top priority in the Senate following the return of lawmakers in November. The legislation would change criminal sentencing rules and provide new assistance to some ex-convicts, including$50 million annually through 2023 for programs aimed at curbing recidivism. The Senate Majority Leader Mitch McConnell said that there is currently no consensus on the bill,and that the Senate must have a deal before he will gauge whether there's enough support to hold a vote during the`lame duck' session. Senate Judiciary Chairman Chuck Grassley(R-IA)and Senator Dick Durbin(D-IL),the ranking Democrat on the Committee,said in a joint statement that the President's endorsement was an"important step in our shared effort to promote safe communities and improve justice."If it isn't taken up in the`lame duck' session,a more comprehensive package could be addressed in the 116th Congress. INCOMING CONGRESS: NEW PRIORITIES,NEW LEADERS Democrats secured more than the 218 seats in the 2018 Midterm Elections needed to win control of the U.S.House, with the current number of Democrats in the House at 227 Members with some House races still too close to call. Meanwhile Republicans maintained a Majority in the Senate and increased their numbers by winning races in states including Indiana,Missouri and North Dakota. This election will end four years of bicameral Republican Majorities in both Chambers of Congress in January.The split election result will yield a divided 116th Congress that could be marked by heightened partisan contention. Infrastructure,immigration,and taxes are among the issues that could be taken up in the upcoming 116th Congress with a Democratic majority in the House and a Republican majority in the Senate.The new majority in the House has stated that they have a long to-do list which includes an ambitious infrastructure program,fixes to the Affordable Care Act(ACA),and an initiative to reform election law.Leaders in the House may also work to strike early bipartisan deals on trade,prescription drug prices,and possibly changes to the budget and appropriations process. Congressional Leadership Outlook:Minority Leader Nancy Pelosi(D-CA)is expected to return as Speaker of the House with the new Democratic majority.Leader Pelosi has said that she's ready to serve as a`transitional' speaker to lay the groundwork for future leaders,although she has not said how long a transitional period would be. Congressman Kevin McCarthy(R-CA)was elected to replace outgoing Congressman Paul Ryan(R-WI)as the House Minority Leader in the next Congress. With Democrats now in control of the House,they will take the helm of the 21 House Committees. Committee chairs have control over what topics are taken up in hearings and what bills are voted on in the committee:This means that the hearings in the House of the I I6`h Congress will feature issues that highlight priorities of the Democratic Majority. Among the Members taking up leadership positions are a number of Minnesota Members: • Congressman Collin Peterson(D-MN)is set to become Chair of the House Agriculture Committee. The House Agriculture Committee has jurisdiction over agriculture,forestry,nutrition such as the Supplemental Nutrition Assistance Program(SNAP),and water conservation. • Congresswoman Betty McCollum(D-MN)is expected to become the Chair of the House Appropriations Subcommittee on the Interior and Environment.The Interior and Environment Appropriations Subcommittee appropriates more than$30 billion annually to various agencies including:the Environmental Protection Agency(EPA),the Department of the Interior,the Bureau of Indian Affairs,the U.S.Forest Service,and the National Endowments for the Arts and the Humanities. • Congressman Tom Emmer(R-MN)was elected to lead the National Republican Congressional Committee (NRCC),putting Congressman Emmer in charge of his party's effort to retake the U.S.House in 2020. • Senator Amy Klobuchar(D-MN)was chosen to head the Senate Democrat Steering and Outreach Committee.The Committee is responsible for building coalitions with Democrats at all levels of government, and with advocacy organizations in pursuit of the policy objectives of the Senate Democratic Conference. Each year,the Steering Committee hosts numerous meetings with advocates,policy experts,and elected officials to discuss key priorities and enlist their help in the development of the Senate Democratic agenda. WHAT TO WATCH IN THE 116TH CONGRESS Tag Legislation:Lawmakers in the new House Democratic Majority have said that one of their major priorities is the new Congress will be middle-class tax cuts and changes to the 2017 tax overhaul. Congressman Richard Neal(D- MA).who is exnected to chair the Ways and Means Committee in the 116 'Congress_has nromised to hold hearings to scrutinize the tax law.Those hearings could produce legislation to change the law,focusing on raising taxes on upper income levels,repealing the cap on the state and local tax deduction(SALT),and ending the tax break for carried interest.Lawmakers in the House Majority have also said they plan to propose expanding the earned income tax credit and the child tax credit and establishing new education tax credits. With a divided government,it is unclear whether or not lawmakers will be able to reach an agreement on any tax proposal that could make it through the Congress and be signed into law. Infrastructure Legislation: Infrastructure proponents are hoping that a new Congress could result in a new start for addressing deficits in highways,roads,bridges, airports and more.Members from both political parties have said that infrastructure legislation remains on the top of their list of legislative priorities and that they want to pursue a transportation and infrastructure package in the next Congress.The President,Senate Majority Leader Mitch McConnell,and House Democratic Leader Nancy Pelosi have all spoken about the possibility for cooperation on infrastructure in 2019.House Democrats have stated they plan to advance a package reflecting their priority in the first half of 2019,and the Administration is also expected to review and refresh the proposal they put forward next year.Provisions could include stabilizing the Highway Trust Fund(HTF)and providing federal funds to address the national backlog of infrastructure repair.The major disagreement among lawmakers with infrastructure legislation is over how to fund it.One option on the table is whether to back a gas tax increase,which was endorsed by the President. 42 of 61 Spending Limit: Efforts to invest in federal programs,boost infrastructure spending,or decrease middle class taxes are set to conflict with a growing federal budget deficit that is likely to hit$1 trillion next year.The deficit and federal debt are likely to be center stage this spring,when Congressional leaders will have to start negotiating a new agreement to raise the nation's borrowing authority.Congress has suspended the debt ceiling until March 1,2019.At the same time,the two-year budget cap deal(Public Law. 115-123)that gave appropriators a generous framework for the fiscal year 2018 and 2019 spending bills is set to expire,requiring lawmakers to negotiate a new deal.Without a new budget agreement,the battle over military and domestic spending will be back on the table and complicate the outlook for next year's appropriations bills. Immigration Legislation:Lawmakers are also considering making another attempt to negotiate a bipartisan immigration overhaul package,including a solution for the Deferred Action for Childhood Arrivals(DACA) program. Complicating any deal,however,are the Presidents' demands for$25 billion in border wall money and more recent threats to do away with birthright citizenship. While immigration reform could prove to be one of the most divisive issues of the 116th Congress,a split Congress could produce an environment conducive to bipartisan efforts on immigration. Waters of the US(WOTUS)Legislation: In 2015,the Obama Administration finalized a controversial new"Waters of the U.S."definition under the Clean Water Act that was immediately challenged in the courts.Currently,the 2015 WOTUS definition is rule-of-law in 22 states; in the other 28 states,there is a one-year delay on implementation to allow the cases to move through the courts.In the meantime,the Trump Administration has been working to withdraw and rewrite the rule, and a proposed rule to replace the 2015 WOTUS definition is expected by the end of the year. Critics have expressed concerns with the Environmental Protection Agency(EPA)rule due to its broad interpretation of what constitutes US waters and the potential impact it could have on state,local,and privately owned roads and roadside ditches,bridges,flood control channels,drainage conveyances and wastewater and stormwater systems. In the next Congress,Democrats are likely to introduce WOTUS-related bills to keep the 2015 rule in place,while the Administration and the Senate will continue work to rewrite the 2015 version of the rule. CDC Approves 2018 Livable Communities Demonstration Account Funding Recommendations The CDC approved nine projects in six cities for Livable Communities Demonstration Account funding this week.The projects support a range of improvements and end uses including housing,workforce development,public infrastructure,stormwater management,placemaking,and tax capacity increases. Nine of 10 applications were approved.Projects are in Brooklyn Park,St.Louis Park Eden Prairie, Richfield,Minneapolis and St.Paul. The committee waived the 40/60 guideline in order to more fully fund requests for projects in Minneapolis and St.Paul.The award guideline states the Council may issue up to 40%of available funds to projects located in Minneapolis and Saint Paul.
