O fficelwarehouse in Oak Park Heights, MN Conditional Approval Expiration and Outstanding Permit Fees Dear Mr. Zintl; The Brown's Creek watershed District 3CwD) received your permit application for the W.A.T.E. Leff cefwarehouse located at Lot 3, Block 2 of the Kenn Center Second Addition in the City of Oak Park Heights on November 29, 2006_ The Board gave conditional approval on February 12, 2007. All of the conditions were not Wait and the permit was not issued. The conditional approval has expired on February 12, 2008, Todd Erickson, Folz, Freeman, Erieksoza, contacted me a couple months ago regarding a potential forth - coming amendment of your project for Board 'consideration, No amendment or request for conditional approval extension has been received. Amy additional work on this project will require a new permit application and submittals for Board consideration. Our records indicate a fee of $ 4,171.59 owing from you for District costs related to Permit No. 06 -30. An iteamnized statement of costs incurred and payments received is enclosed for your preference, Please remit p ayment by check in this amount to "Brown's Creek watershed Distrlct" within 30 days of the date of this letter. Under state law, Minnesota Statutes § 103D.345, subdivision 2, and District Rule 8.0, a permittee must pay a fee to the District' equal to the actual costs of District staff, engineor and legal counsel time, as well as any direct costs incurred, in processing the pernsit application and monitoring permit compliance after the permit is issued. This obligation is stated as a condition of Permit No. 06 -30. Fees are authorized by Minnesota Statutes § 103D.345 for recovery of actual cosh the District incurs - in permitting and compliance monitoring. The District implements this authority through District Rule 8,0 and District Resolution 07-11. Failure to pay outstanding fees when due is a violation of District Rules subject to legal enforcement under Minnesota Statutes §103D.545. That statute provides for the District's recovery of attorney fees and costs if legal action is necessary. In addition, on January 14, 2008 the District Board of Managers adopted Resolution 08 -01 providing that outstanding permit fees will be subject to interest at the rate of 0.5 percent per month, reflecting the actual cost to the District of untimely payment.
