PLANNING COMMISSION MEETING MINUTES
Wednesday, December 12, 2018 —Oak Park Heights City Hall
I. Call to Order/Pledge of Allegiance:
Chair Freeman called the meeting to order @ 6:00 p.m. Present: Commissioners
Giovinazzo, Kremer, VanDyke and White; City Administrator Johnson, City Planner
Richards, and City Councilmember Dougherty.
II. Approval of Agenda:
Commissioner Kremer, seconded by Commissioner VanDyke, moved to approved the
Agenda as presented. Carried. 5-0.
III. Approval of November 8, 2018 Meeting Minutes:
Commissioner Giovinazzo, seconded by Commissioner VanDyke, moved to approve the
Minutes as presented. Carried 5- 0.
W. Department/Commission Liaison / Other Reports:
City Councilmember Dougherty did not have anything to report. City Administrator
Johnson briefly discussed the open book process for property assessment and noted that the
Washington County Assessor does schedule dates and locations for review, though the City
has not yet received information on the dates and locations.
V. Visitors/Public Comment: None.
VI. Public Hearings:
A. Oak Park Heights Comprehensive Plan - 2018: Review and consider approval of the
2018 Oak Park Heights Comprehensive Plan.
City Planner Richards reviewed the December 6, 2018 Planning Memorandum
regarding the preliminary comments received from Metropolitan Council as to the
Comprehensive Plan and discussed changes made to the plan to address those
comments.
Commission discussion ensued as to the land use designations, including potential
changes along the riverway, housing needs and issues with regard to transportation
needs and current volume
Chair Freeman opened the public hearing at 6:18 p.m. and invited public comment.

There being no visitors for comment to the public hearing, Commissioner Kremer,
seconded by Commissioner White, moved to close the public hearing at 6:20 p.m.
Carried 5-0.
Commission discussion ensued, with Commissioner Kremer expressing several
thoughts came to mind when reading Metropolitan Council's response. Kremer stated
that he felt that the costs associated with the plan update relative the City's population
is excessive and that he does not feel that the plan is a plan devised by the City and that
it is basically Metropolitan Council telling the City of Oak Park Heights what they need
to do. Kremer acknowledged that planning is essential for the City, but that he did not
necessarily feel that this process is the best or the most beneficial for the City and its
citizens.
Chair Freeman asked the Commission if they felt that the plan should be moved
forward to the City Council or held for further Commission review. Consensus was
that the plan should be moved forward. Commissioner White did not a duplication of
data in the two tables on page 71 of the draft plan, within the Livable Communities
section. City Planner Richards thanked him for that notice and will correct the data.
Commissioner White, seconded by Commissioner Giovinazzo, moved to
recommend City Council approval of the final plan draft, subject to the data in the
tables on page 71 of the plan draft, within the Livable Communities section being
corrected.
Carried 5 — 0.
City Administrator Johnson noted that if Commissioner Kremer wanted to reach out to
Metropolitan Council that longtime District Representative Harry Melander would be a
source of contact to express his concerns.

Commissioner Kremer noted the visitor in the audience and invited her to introduce herself
to the Commission. Carly Johnson introduced herself as a newly elected Councilmember,
taking office in January, 2019.
Chair Freeman clarified which meeting date Planning Commission information would be
before the Council. January 22"d was clarified to be the date for Council Representative
attendance from the Planning Commission.

RE: Vacate Drainage 4
Recently, the City has worked with the develoWof the Ridgecrest Development (Panera) to manage and exchange
properties that are advantageous to both parties in order to re -develop this area and relocate the frontage roadway.
This also included a platting of lands to create new parcels and boundaries and to establish new City Drainage and
Utility Easements.
These efforts were accomplished in
late 2018 and the site is under
construction. One item that was
omitted (in error) was the vacation of
a public D&U easement that ran
north -south across the property. See
MAP #1
This area is not anticipated to be
necessary by the public and is
requested to be vacated by the
Developer. In order to vacate such
easement, the City must hold a
public hearing on the matter.
Enclosed is a copy of the Notice of
Public Hearing and the related Draft
resolution with Exhibit.
Staff recommends that the D&U
easement be vacated as shown in
Map 1 as it is not anticipated to be
required by the public. Further,
this has been replaced by new
easements at the perimeter of
each new parcel as required by
City Ord 402.07. DA.

NOTICE OF PUBLIC HEARING
TO
CONSIDER VACATION OF PUBLIC DRAINAGE AND UTILITY EASEMENT
CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
On January 10th, 2019, the Planning Commission will hold public hearing pursuant to Minn. Stat. §
462.358, subd. 7 and §412.851 regarding the vacation of a public Drainage and Utility Easement controlled
by the City of Oak Park Heights as was conveyed to the City with the associated Plat. The City seeks to
determine if the vacation of such easement is in the interest of the public, inasmuch as the Easement is in
conflict with the approved Ridgecrest Development, has been replaced by other easements and is located,
north of 58" street, west of Norell Ave. and South of STH 36, upon Parcel #s: 0502920210013 and/or
0502920210025 and is finther described below.
Legal Description of Easement to Be Vacated by the City:
That part of the drainage and utility easements as dedicated on and lying on the West 5.00 feet of Lot 1,
Block 2, WAL-MART ADDITION, according to the recorded plat thereof, Washington County,
Minnesota, lying south of the North 32.00 feet of said Lot 1 and lying northerly of the following
described line:
Commencing at the northeast corner of said Lot 1; thence South 01 degrees 11 minutes 01 seconds
West, assumed bearing along the east line of said Lot 1, a distance of 337.26 feet to the southerly
line of MINNESOTA DEPARTMENT OF TRANSPORTATION RIGHT OF WAY MAP
NUMBER 82-84, according to the recorded plat thereof, said Washington County and the point of
beginning of the line to be described; thence North 88 degrees 49 minutes 16 seconds West to the
west line of said Lot 1 and said line there terminating.
The public hearing shall be held before the Planning Commission on Thursday, January 10th, 2019 at 6:00
o'clock p.m. at the City Hall, 14168 Oak Park Blvd. N., Oak Park Heights, Minnesota 55082. All written and
oral comments will be considered.
Review of the findings and recommendation of the Planning Commission is anticipated to be held by the City
Council on Tuesday, January 22nd, 2019 at 6:00 o'clock p.m. at the City Hall

A RESOLUTION VACATING CERTAIN CITY UTILITY EASEMENT
Whereas, the City and the Developer (Ridgecrest Oak Park Heights I LLC), the "Owner" of lands hereby
further identified by County Parcel # 0502920210013 and/or 0502920210025 have entered into a
Developer's Agreement dated October 4', 2018 that outlines specific parameters related to the
redevelopment of such lands as well as the location and maintenance of both public and private utilities;
and,
Whereas, the Owner has sought amendments to the site and utility plans to accommodate site alterations
and which were duly approved by the City for certain phases of development; and
Whereas the Owner has now duly petitioned the City to vacate a drainage and utility easement as
described herein and as shown in Exhibit A to this Resolution:
