Present: Commissioners Caspers and Liljegren. City Administrator Johnson, City Planner Richards and Commission Liaison McComber. Absent: Commissioner Dwyer. Commissioner Wasescha arrived at 7:09 p.m. Approval of Agenda: Vice Chair Liljegren, seconded by Commissioner Caspers, moved to approve the Agenda, as presented. Carried 3 -0. Approve Minutes of June 9, 2005: Chair Runk, seconded by Vice Chair Liljegren, moved to approve the Minutes with amendments noted by Commission Liaison McComber. Carried 3 -0. St. Croix Crossing Update: Commission Liaison McComber announced that a draft final copy of the St. Croix Crossing Environmental Impact Study has been received and will be one subject of discussion a the upcoming Stakeholders Committee meeting on July 19, 2005 from 9:00 a.m. to 4:30 p.m. at Stillwater City Hall. C. Other: Visitors /Public Comment: There being no visitors to the meeting, Chair Runk moved to the Public Hearings portion of the Agenda. Public Hearings: A. Ron Gullickson: To consider a request for Conditional Use Permit, allowing a 4 -plex residential dwelling in an R -2 zoning district, located at 5480 Stagecoach Trail, N. City Planner Richards reviewed the July 6, 2005 Planning Report to the request, provided an issue analysis and recommended conditions in the event the Planning Commission elected to recommend City Council approval. Discussion as to the report content and recommendations ensued between City Planner Richards and the Planning Commission. Chair Runk opened the public hearing for comment. Planning Commission Minutes July 14, 2005 Page 2 of 8 Ron Gullickson — 5480 Stagecoach Trail, N. introduced himself as the applicant, provided the Commission with a materials board for their review and discussed, with them, the proposed project and conditions of planning report. Commissioner Wasescha arrived at 7:09 p.m. Discussion ensued as to the conditions of the report and Mr. Gullickson addressed questions from the Commission as to the project. There being no other visitors to the public hearing, Vice Chair Lilj egren, seconded by Commissioner Wasescha, moved to close the public hearing. Carried 4 -0. Chair Runk, seconded by Vice Chair Lilj egren, moved to recommend City Council approval of the request for Conditional Use Permit, subject to the amended conditions of the July 6, 2005 Planning Report, specifically: 1. Proposed uses of additional rooms, approximate additional square footage of floor area are submitted. 2. The new addition and existing structure shall be made compliant with MN State Building Code and Standards Division per section 1306.003.E.(1), regarding fire sprinkler systems and MN Building Conservation Code per section 104 as required by the Building Official. 3. Wall and floor plan is submitted and subject to Building Official approval. 4. Location of the expansion meets R -2 standards for setbacks. Permission must be granted from adjoining property owner to the north to construct retaining wall and driveway less than five (5) feet from the property line. 5. Expansion construction is consistent with the architecture and materials of the existing home. 6. Landscape plan is subject to City Arborist approval. Plan must include demarcation of screening/plantings in accordance with Section 401.15.E. 7. Purchase Agreement is submitted from Xcel Energy for the parcel acquisition of seven thousand five hundred and seventy -five (7,775) square feet. 8. Grading and drainage plan is submitted and subject to approval of the City Engineer and the Middle St. Croix Watershed District. 9. Utility plan is submitted and is subject to approval of the City Engineer and the Public Works Director. Planning Commission Minutes July 14, 2005 Page 3 of 8 10. Construction and occupancy must be complete within nine (9) months of City Council Conditional Use Permit approval. 11. No work may commence until all real estate parcels /lots are legally joined through the City's minor subdivision process into one unified tax parcel. This process requires the submission of a Certified Survey depicting the current and final property lines and final legal description. 12. A site plan shall be submitted indicating location of at least four (4) outdoor parking spaces, in compliance with the Zoning Ordinance, subject to review and approval of City staff. Carried 4 -0. B. Stillwater Motors: To consider requests for Signage Variance and Conditional Use Permit, allowing retail, service and parking expansion to Stillwater Motors, located at 5900 Stillwater Blvd. N. City Planner Richards reviewed the July 7, 2005 Planning Report to the request, provided an issue analysis and recommended conditions in the event the Planning Commission elected to recommend City Council approval. Chair Runk opened the public hearing for comment. Ward Sessing — Sessing Architects addressed the Commission on behalf of the applicant. Mr. Sessing provided the Commission with materials samples, a rending of the completed project proposed and made himself available for questions. Brief discussion ensued among the Mr. Sessing and the Commission as to the planning report and its conditions. There being no other visitors to the public hearing, Vice Chair Lilj egren, seconded by Commissioner Wasescha, moved to close the public hearing. Carried 4 -0. Commission review and discussion ensued as to the planning report and its conditions. Commissioner Wasescha, seconded by, Vice Chair Lilj egren, moved to recommend City Council approve the requests for Conditional Use Permit and Signage Variance, subject to the conditions of the July 7, 2005 planning report as amended, specifically: 1. The Planning Commission recommends that all parking and curbs and an updated stormwater system be constructed and brought into compliance as part of the current building and parking expansion project. Revisions to the landscape plan showing shade trees along 59 St., the frontage road to Hwy. 5, and in appropriate places around the parking area. Revision to the landscape plan shall be subject to review and approval of the City Arborist. 3. The grading, drainage and utility plans shall be reviewed and approved by the City Engineer. 4. Customer, employee and display parking shall be delineated on the site plan and all customer parking stalls shall be appropriately signed. 5. Detailed and completely labeled building elevations shall be resubmitted to show all building materials and colors. A materials board shall be submitted for City Council review. 6. A detailed photometric plan showing the lot perimeter and street centerline foot candles shall be provided. All lighting shall be installed or retrofitted to be in compliance with the lighting standards of the Zoning Ordinance. 7. An approval of the sign variance allowing a total of ten wall signs and eliminating the two 34 square foot "showroom" signs as proposed on the building elevations. The applicant shall provide an accurate rendering of all wall signs for review and approval of the City Council. The City Council shall approve the overall number and square footage of allowable wall signage for the project. 8. The applicant shall remove the large pylon sign at the northwest comer of the site and all checkered banners, prior to issuance of a building permit for the project improvements. 9. The materials utilized for the proposed trash enclosure shall be the same as materials used upon principal structure. 10. All automobile repair activities shall be limited to within the principal structure and the doors to the service bays shall be kept closed except when vehicles are being moved in or out of the service areas. 11. There shall be no exterior storage of automobile parts or related items on the site. All storage shall be internal to the building. Any vehicles stored outside of the building shall be in full working order. 12. All noise created from operations on this site shall be in conformance with Section 401.15.B.11 of the Zoning Ordinance. Planning Commission Minutes July 14, 2005 Page 5 of 8 13. The outdoor paging system shall be replaced with a personal communication that is non- audible beyond its property lines. 14. Applicant shall secure and retain, if required, a Hazardous Waste Generators License from Washington County for the Stillwater Motors business operation. Carried 4 -0. C. Fox Hollow: To consider requests for Planned Unit Development Amendment and Minor Subdivision, allowing construction of one office building to replace previously approved design plan for two office buildings, located south of 60 St. N. and East of Osgood Ave., N., known as Fox Hollow PUD. City Planner Richards reviewed the July 7, 2005 Planning Report to the request, noting that the request eliminates the smaller office structure and increases the larger office structure upon the formerly approved footprint. Richards provided an issue analysis and recommended conditions in the event the Planning Commission elected to recommend City Council approval. Chair Runk opened the hearing for public comment and invited the applicant to speak. Jeff Hause of J.G. Hause Construction introduced himself and stated that he had no comments as to the report and made himself available for questions. Steve Ward of Stevens Engineering along with Jeff Hause discussed questions related to landscaping, roadway travel and interaction of roadway users, parking stall design, drive aisle requirements and traffic flow directional signage and pavement markings. Kevin Grube of Grube Architects clarified signage allowance and requirements with City Planner Richards. There being no other visitors to the public hearing, Vice Chair Lilj egren, seconded by Commissioner Wasescha, moved to close the public hearing. Carried 4 -0. Vice Chair Lilj egren, seconded by, Chair Runk, moved to recommend that the City Council approve the request for Planned Unit Development — General Plan Amendment approval, subject to the amended conditions of the July 7, 2005 Planning Report, specifically: 1. The Planning Commission and City Council find that the 25 foot front yard setback for the office buildings is acceptable as part of the general plan of development approval. 2. Lot 1, Block 1 shall be merged with the adjacent lots for tax purposes and deed restrictions shall be placed upon the lot so that no construction can occur on the property in the future. The lot merger and deed restriction documents shall be subject to review and approval of the City Attorney. 5. The utility plans are subject to review and approval of the City Engineer. Planning Commission Minutes July 14, 2005 Page 6 of 8 3. The parking lot drive aisles shall be properly signed as one -way where applicable. The parking lot signage plan shall be subject to review and approval of the City Engineer. 4. The grading and drainage plans shall be subject to review and approval of the City Engineer and applicable watershed district. 6. The landscape plans, tree removal plans, and preservation plans are subject to review and approval of the City Arborist. 7. All lighting fixtures shall be in compliance with the lighting requirements of the Zoning Ordinance. 8. The proposed monument sign shall be provided with a landscaped base or planter and the signage portion of the sign must be no more than eight feet in height. 9. The Planning Commission finds that the building design is consistent with the Design Standards. 10. A development agreement amendment as required by the City Attorney, between the City and applicant, subject to review and approval of the City Attorney. 11. All conditions approved by the City Council on August 24, 2004 for the Fox Hollow development general plan of development approval. 12. All other conditions of City staff and the City Council. Zoning — B -4, Limited Business District: To consider a Zoning Ordinance Text Amendment to replace the CBD, Central Business District Zone with B -4, Limited Business District Zone and a Comprehensive Plan Amendment and Rezoning of the area currently zoned CBD, Central Business District to Limited Land use and B -4, Limited Business District. City Planner Richards reviewed the July 7, 2005 Planning Report and revised B -4, Limited Business District draft, noting that the revised document reflected comments of the City Council and Planning Commission from their June 28, 2005 workshop. Richards stated that the B -4, Limited Business District is intended to replace the current CBD, Central Business. District. Chair Runk opened the public hearing for comment. Planning Commission Minutes July 14, 2005 Page 7 of 8 Bart Montanari —13481 60 St. N. discussed parking permitted along 60 St. N. and clarified that the proposed zoning district change would not affect the parking arrangement for his business. Brief discussion was had by Commission as to zoning area from the Eagle's Aerie 94 Club to McCormack's B -2, General Business rather than B -4, Limited Business District. Mr. Montanari thank the Commission for their consideration along that line and indicted that it would be his preference to see his business zoned B -2. Pete Houser — 940 E. Hennepin Ave., Mpls. introduced himself to the Commission as a land owner of property near Wal -Mart. He stated that his property, when purchased, was intended for a Midas Auto operation. After his purchase the area was zoned CBD, Central Business District. He discussed his attempts to have a business operation put in place and stated that he feels the larger businesses have been accommodated with their requests for rezoning and would like to receive similar consideration and would desire to see his parcel zone B -2, General Business rather than the B -4, Limited Business District proposed. Charles Pingel - 5840 Oakgreen Ave. N. expressed concern as to increased traffic upon Oakgreen Avenue with any new development to the area and asked what was going to be done about the roadway. He stated that it is a speedway and is very dangerous as it is presently. City Administrator Johnson discussed the issues affecting any changes to the roadway and that the bottom lines falls to funding for roadway alterations and that presently the City is bound by the MnDOT process. Pat Estes — Oakgreen Ave. N. also expressed concern about the amount of traffic on Oakgreen Ave. stating that adding more traffic to the road did not make sense. He also expressed concern that his nice residential neighborhood is disappearing. He stated that the neighborhood has been kept in limbo for five years with potential development possibilities affecting them and no roadway improvements. He would like to see a decision made one way or the other for his neighborhood. Discussion ensued among the audience, Planning Commission, City Administrator and City Planner as to the number of proposals that have been around, affecting the neighborhood along Oakgreen Ave. and at Pondview Condominiums. City Administrator Johnson summarized activity to the area in the way of tax increment financing applications and if an application were to be granted by the City Council, what he understood the process of activity for the same to be. There being no other visitors to the public hearing, Vice Chair Lilj egren, seconded by, Commissioner Wasescha, moved to close the public hearing. Carried 4 -0. The Planning Commission discussed sign regulations for the proposed district. Hultman Planning & Code Enforcement Officer Approved by the Planning Commission: PLANNING REPORT TO: Eric Johnson FROM: Scott Richards DATE: August 4, 2005 RE: Oak Park Heights — eq life — Site Plan, Design Standards Review, And Signage Variance FILE NO: 798.02 — 05.08 BACKGROUND Eq life has made an application for a site plan review, Design Standards review, and sign variance for a portion of the former Rainbow Foods store located at the Oak Park Ponds Shopping Center on 58 Street and Neal Avenue North. Eq life will take the remaining 26,367 square feet of the former Rainbow Foods store for a health, wellness and technology center. The primary exterior changes are to the entrance portion of the front facade and the addition of a loading dock and trash compaction area at the rear of the space. The parking lot in front of the store will not be changed. The site plan and Design Standards review will focus on the front facade changes and the rear loading dock/compactor addition. The sign variance is requested to allow a total of five wall signs where two would be permitted. The Rainbow Foods and Oak Park Ponds development approvals were granted in 1997. At that time, the City granted variances to allow for the Rainbow wall signs and the three monument signs for the development. The original pylon sign was in conformance with the sign requirements in place at that time. In 2001, a conditional use permit, an amendment to the planned unit development, and a sign variance was granted to allow the construction of a fuel service center in the parking lot in front of the Rainbow Foods store. Following the closure of the Rainbow Foods store, the fuel service station and tanks were removed and the parking lot was restored. The conditional use permit has expired for the fuel station and signage allowances. Kowalski's Market was granted approval for a site plan, Design Standards review, and sign variance in November of 2004. The sign variance was granted to allow a total of four signs from the allowable two signs. At that time, approval was granted to allow the facade update to the portion of the building that will be occupied by eq life. Project Proposal. Eq life is a health, wellness and technology center catering to primarily women. The space will be occupied by PrairieStone Pharmacy, Geek Squad, Caribou Coffee and an eq life salon that will provide beauty and hair treatments as well as pedicure and manicure stations. An eq life spa will have treatment rooms to provide full body and facial massages. Eq life will modify the store front slightly to provide a more prominent front entrance to the facility. The materials and colors will be similar to what currently exists with the most recent remodels. A truck dock and compactor will be added at the rear of the building. A new screening wall will be added to match the existing materials. The site plan also indicates truck turning radius which demonstrates that delivery and waste trucks can easily access this area. Comprehensive Plan. The Proposed Land Use Map guides the subject property for commercial use. Zoning. The site is zoned PUD, Planned Unit Development. The PUD, as approved, utilizes the B -2, General Business District as the basis for land use and performance standards approvals. Retail sales and service businesses such as what will be provided by eq life are permitted in that district. Parking /Access. The Oak Park Ponds Shopping Center was originally constructed with a total of 611 parking stalls. When the fuel station was constructed, 32 parking stalls were lost. Additionally, the seasonal garden center occupies approximately 50 stalls. With restoration of the parking lot after the fuel station removal, the stall count is back to 611 stalls. A total of 443 stalls are required by Zoning Ordinance for the Oak Park Ponds development. There are no parking issues with replacement of the Rainbow Foods store with a Kowalski's Market and eq life. Site Changes /Front and Rear of Building. The site plan /elevation plans for the building indicate the front entrance will be built out with a prominent entrance. Awnings would be placed above each of the glass windows and signage would be placed above the entrance /window areas. The plans also show the truck door and screen wall that will be placed to the rear of the structure for deliveries. Adjacent to the truck door will be an enclosed compactor screened with a gate. The applicant should provide additional details on the gate and 2 what materials it will be constructed of. The applicant shall also be required to provide additional information on noise generation from the compactors. Lighting. The elevations of the building indicate the existing decorative Tight fixtures that were added as part of the Kowalski's approval. The approvals granted by the City Council indicated the allowance for the decorative fixtures. All lighting at the rear entrance /loading dock shall be required to be full cut off and compliant with the Zoning Ordinance provisions. Signage. Eq life would be allowed, by ordinance, two wall signs with a total of 500 na square feet of total si e. The elevation plans indicate five wall signs with a total of q 9 g 162 square feet. It is expected that eq life will also advertise on the Oak Park Ponds pylon sign which is expected to be replaced in coming months. All of the proposed wall signs are on the front facade and include the following: eq life Geek Squad eq life Spa and Salon Caribou Coffee PrairieStone Pharmacy 92 square feet 14 square feet 15 square feet 18 square feet 25 square feet Section 401.04.A.5 of the Zoning Ordinance states that a variance from the terms of this ordinance shall not be granted unless it is demonstrated that: a. Undue hardship will result if the variance is denied due to the existence of special conditions and circumstances which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district. b. Literal interpretation of the provisions of this Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this Ordinance or deny the applicant the ability to put the property in question to a reasonable use. c. The special conditions and circumstances causing the undue hardship do not result from the actions of the applicant. d. Granting the variance requested will not confer on the applicant any special privilege that is denied by this Ordinance to other lands, structures or buildings in the same district under the same conditions. e. The request is not a result of non - conforming lands, structures or buildings in the same district. The request is not a use variance. The variance requested is the minimum variance necessary to accomplish the intended purpose of the applicant. h. The request does not create an inconvenience to neighboring properties and uses. f. g. Staff recommends that a maximum of three wall signs be allowed for this business. The main sign over the front entrance could remain with two others on either side. The additional two signs could be incorporated as permanent window signs which is allowed by the Sign Ordinance. The City has in the past granted variances for Rainbow and Kowalski's to allow additional size and number of signs to address the lack of visibility of 3 the shopping center. The overpass of Highways 36 and 5 provide a significant visible barrier for businesses in this shopping center thus justifying a variance. Staff feels that a variance to add an additional sign from what is allowed can be justified. Moving two of the signs down as allowable window signage would lessen the overall variance. Design Standards Review. The Design Standards require that office and commercial buildings contain at least three Grade 1 materials and be at least 65 percent Grade 1 or Grade 11 materials. Glass must make up at least 20 percent of the building facade. The facade that had been installed last year had Grade 1 materials that consisted of brick and glass. The front entrance will also feature cast stone trim. The facade from both the Kowalski's and eq life will have Grade 1 materials totaling 60.7 percent of the facade. Glass will be 36 percent of the total facade. Staff finds the design in keeping with the overall standards. Seasonal planters will be placed at the front entrances. CONCLUSION /RECOMMENDATION Based upon the preceding review, City staff recommends that the following requests be approved for the proposed eq life located at the Oak Park Ponds Shopping Center on 58 Street and Neal Avenue North: • Site Plan Review • Design Standards Compliance • Signage Variance for Number of Signs With the following conditions: 1. The variance for signage shall be approved to allow one additional wall sign over the two allowable wall signs. 2. The applicant shall provide additional details on the gate for the trash compactor enclosure and noise information for the compactor. 3. All lighting at the rear entrance /loading dock shall be required to be full cut off and compliant with Zoning Ordinance provisions. 4. The Planning Commission and City Council make a finding that the facade design and materials are in compliance with the Design Standards. 5. We are taking a space of approximately 26,367 square feet of what was once a 64,367 square foot Rainbow Foods store. The Property Management Group, United Properties, has split this space and the adjacent tenant, Kowalski's has built in the remaining square footage. Eq life is a Health, Wellness & Technology center catering to primarily women who can serve all the health and wellness issues at one location. This space will be occupied by PrairieStone Pharmacy, who is partnered with Park Nicollet and will have a full -time pharmacist on staff, Geek Squad who will serve to resolve computer issues and teach technology, eq life salon to provide beauty and hair treatments as well as pedicure and manicure stations and eq life Spa that will have luxurious treatment rooms to provide full body and facial massages. This locations will also have a cafe corner occupied by Caribou Coffee that will have individual seating, including a fireplace, in a relaxed and informal setting. Eq life is modifying the storefront slightly to better locate the entrance to this facility. We will be matching similar colors and materials that will compliment the existing Kowalski's portal and meet with the surrounding aesthetics. Some large potted plants will decorate the storefront in various locations. A truck dock and compactor pad will be added to serve receiving merchandise at the Southeast corner of the building. A new screening wall that matches building materials is being erected as required by the city codes. As shown with the truck turning radius identified on sheet AS -1, plenty of room is provided for receiving of this merchandise. For our spa and package guests, a luxurious robe and slippers will be provided for your use. In addition, our hair clients will be provided with a robe to be worn over their garments to protect them from chemical staining. Do I have to be naked? It is important that you feel comfortable while receiving any massage or facial treatment. Under garments may be worn during your treatments if desired. Your technician is a trained professional and well- versed in draping techniques that protect your modesty. Our goal is make you feel at ease. Is tipping appropriate? Yes. A general guideline would be between 10% and 20 %. May I request a male or female therapist? Please let us know if you have a preference. We will do our best to accommodate you. What if I need to cancel my appointment? We understand that circumstances out of your control can arise and cause the need to cancel or reschedule an appointment. The Metropolitan Council is working on several items to assist you in this process. Here is what to expect from the Council in the next few months: • Now that all metropolitan systems plans have . been adopted, systems statements will be issued in late August or early September. Systems statements are customized summaries of the systems plans for each community, and describe local planning requirements that local units must address to satisfy the 2008 update required by the MLPA. Each community will have sixty days to review and discuss with Council staff potential issues regarding the contents of its systems statement. If these issues cannot be resolved, the community may request a hearing to consider amendments to the systems statement. • A redesigned Local Planning Assistance Handbook will be available in late September. It will provide guidance on comprehensive plan content and the Council's plan review process. The new Handbook will be unveiled at the American Planning Association `s Upper Midwest Conference, September 28 in Alexandria, MN. Shortly thereafter, the Metropolitan Council's website will have on an online version of the Handbook, and paper copies will be available. • In October, the Council will host seven local planning information forums. There will be one in each County to discuss the 2008 plan update process. The Council's Planning and Operating Division staff will be available to answer questions about specific elements and requirements.
