As the Council will recall, last summer the City required Xcel Energy to update the fencing and
driveway at the Baytown Substation, adjacent to Lowes. Specifically, the City asked that they install a
more aesthetically pleasing wood fence and remove the chainlink 1 barbed wire and blacktop the
driveway. These improvements are to be installed this spring.
Xcel Energy has provided the enclosed fencing plans. Staff has reviewed them and found them to be
generally compliant with the City's Fencing Ordinance. Additionally, Staff is also recommending that
some additional landscaping and screening be installed at the various point around the outside of the
fence to additionally soften the exterior.
The City's authority to require such fencing and screening, stems from the Conditional Use Permit as
issued in 1990.
Pursuant to the then issued CUP, the City, may revoke this CUP and require that this substation be
removed as there has been a material change in the condition of the neighborhood since the 1990
issuance. However, at this time Staff is not recommending such action, rather only that appropriate
steps be taken to make the site more compatible with the surroundings, and which may be
accomplished by this new screening and landscaping.
Recommendation: Approve the general concept of the enclosed fencing plan and require that
additional landscaping items be installed on the outside perimeter of the fence. Final design of
the fence and landscaping shall be subject to the final review and approval of the City Planner
and Arborist. The City may require more stringent rules on this fencing and landscaping
because of the existence of the CUP.

RE: Bayport Substation — 60 Street North 1 Oak Park Heights.
Dear John,
Thank you for taking the time to meet with myself and other City staff last week Wednesday to discuss the needed
visual upgrades at the Bayport Substation. For your reference 1 have enclosed some photographs of the site.
As you are now aware, this site was once off the "beaten-path" and the visual aspects of this land use were not critical.
However, because the material nature of the neighborhood is changing, your property will now be directly adjacent to a
significant development including a Lowe's and other retail centers and now must be upgraded:
Generally, the City requires the following (minimum) facility upgrades:
1. The replacement of the current chain-link & barbed-wire fencing with an appropriate wood fence —
subject to final City review.
2. The area lying between the current fence line and the new road that is to be installed this season must be
paved.
3. Provide written clarification on the traffic generated at/from this site. We notice that there are trucks
other than Xcel's parked at this location. This site is not permitted for use as a staging area and/or may
not be used for truck storage or for any other operation. Only vehicles directly essential to the property's
use may be parked at this site.
These improvements are required per the Conditional Use Permit as issued for this site by the City on November 26
1990, as enclosed.
These improvements shall be completed prior to December 31, 2006 and shall be at Xcel's expense.
Lastly, 1 would ask that a plan be prepared in accordance with the above and submitted to my attention not later than
June 15 2006 so that we can proceed in a timely fashion. Upon the receipt of this information, 1 will suggest we meet
again to solidify these improve nts.

Dear John:
As I emailed to you last week, the City Council approved the fencing plans as submitted subject to the
following conditions:
1. Follow all of the Arborist's Kathy Widin's comments and directions from her review of the
landscaping plans -- I emailed this to you the other day.
2. The posts holding the fencing up shall be on the inside perimeter, so that the fence is "neighbor
friendly".
3. Removal of all barbed wire and chain --link elements.
4. Any other directives or comments that may be applicable from the City Planner. The only item at
this time is to ensure that any lights that are currently installed or that are to be installed —if any -
are fully shielded with full "cut- off" shielding.
So you may proceed with the above sentiments.
A fence permit is required and may be pulled by your contractor generally pursuant to these approved plans.
We did not review from a structural standpoint, I will assume that this will be ok at the time of such review
when the permit is pulled.

RE: Baytown Substation
In response to the request by Xcel Energy to remove ALL lighting from the Baytown Substation site as
opposed to installing City compliant (full cut-off) lighting systems; at this time the City is willing to allow
that no lights be operated at the Baytown Substation site, except for those lights needed in an emergency
situation. The use of "emergency lighting" shall not exceed four times per month. However, the City does
explicitly reserve the right to reconsider this position at any time and for any reason and reinstate the full
cut-off requirements.
Generally, if should it become apparent that the site is being lit in any fashion (there may be no lights
whatsoever) except for 'emergency operations' or demonstrate-ably exceeds the four times per month
emergency condition, the City will immediately require full-cut off lighting. Please note that if there are
continual errors (human or mechanical) that accidentally leave lights on, this may also result in the City
reinstating the full-cutoff conditions for all lighting.
As I have already communicated on several occasions, Xcel Energy's alternative is to seek a formal
amendment to the CUP which at this time Xcel has chose not to pursue as I am not in receipt of an
application. Xcel may also remove the sub-station as the site operates under a Conditional Use Permit and
may be revoked by the City for non-compliance. The City will be commencing spot inspections on August
1s 2007 on this lighting.
To date there has not been a submission for a building permit for the fence, what is the status? Please
respond to this question. This fence, as approved by the City Council, must be installed not later than
August 1 2007.
