HomeMy WebLinkAbout1981 Resolutions v EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL OF CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA HELD DECEMBER 14, 1981 A regular meeting of the City Council of the City of Oak Park Heights, Washington County, Minnesota, was held at the City Hall in the City of Oak Park Heights on Monday, the 14th day of December, 1981, at 7:00 o'clock p.m. The following members were present: Frank 0. Sommerfeldt William D. Westphal Barbara O'Neal John C. Lang Richard Seggelke . and the following members were absent: None. Also present was LaVonne Wilson, City Clerk /Treasurer. Member Lang introduced the following Resolution and moved its adoption: RESOLUTION NO. 8153 A RESOLUTION OF THE CITY OF OAK PARK HEIGHTS, WASHINGTON COUNTY, MINNESOTA, AMENDING PRIOR RESOLUTIONS ESTABLISHING LICENSE FEES UNDER SECTION 601.01 AND ALSO ESTABLISHING FEES FOR CAPTURE, TRANSPORTATION AND /OR CARE OF ANIMALS PURSUANT TO SECTION 601.06 OF THE CODE OF ORDINANCES FOR THE CITY OF OAK PARK HEIGHTS. WHEREAS, Ordinance No. 601.01 of the Code of Ordinances for the City of Oak Park Heights establishing a licensing system for any dogs owned, kept or harbored within the City of Oak Park Heights, empowers the City Council to establish application fees for licenses for such animals; and, WHEREAS, the City Council for the City of Oak Park Heights has determined that the purposes of Chapter 601 of the Code of Ordinances for the City of Oak Park Heights may be served by allowing said licenses to be issued free of cost; and, WHEREAS, Section 601.06 of the Code of Ordinances for the City of Oak Park Heights empowers the City Council to pass, by Resolution, and establish additional fees reasonably related to the necessary and reasonable expenses incurred by the City for capture, transportation and /or care of animals; and, WHEREAS, the City Council for the City of Oak Park Heights deems it to be in the best interests of the citizens of the City of Oak Park Heights that fees and fines be established to discourage dog owners from allowing their animals to run at large within the City, and further, be established to reimburse the City for the necessary and reasonable expenses incurred by the City for the capture, care and transportation of such animals apprehended in violation of Chapter 601 of the Code of Ordinances for the City of Oak Park Heights. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The City Council for the City of Oak Park Heights directs the City Clerk to issue licenses pursuant to . Section 601.01 of the Code of Ordinances for the City of Oak Park Heights without expense or fee to the owner or keeper of any dog within the City of Oak Park Heights. 2. That there shall be imposed upon any owner or keeper of a dog captured within the City of Oak Park Heights a fee in the amount set forth below for the purpose of reimbursing the City for the necessary and reasonable expenses incurred by the City for the capture, transportation and /or care of the animal. Such fees shall be in the amounts as follows: a. $35.00 for any dog which has been issued a license by the City Clerk pursuant to Section 601.01 of the Code of Ordinances; b. $50.00 for any dog which has not been issued a license by the City Clerk pursuant to Section 601.01 of the Code of Ordinances, or for any animal transportated to the St. Croix Animal Shelter, Inc., whether the dog be licensed or unlicensed. BE IT FURTHER RESOLVED, that this Resolution shall be effective with its adoption. • The motion for adoption of the foregoing Resolution was duly seconded by Member Westphal, and upon vote being taken - 2 - • thereon, the same was passed unanimously by all present. CITY OF OAK PARK HEIGHTS Mayo ATTEST: City Clerk i 3 - RESOLUTION #8149 CITY OF OAK PARK HEIGHTS, MINNESOTA WHEREAS, the City Council of the City of Oak Park Heights has established that fees are to be charged to applicants for property improvement requests and such fees are to cover the full costs of processing such requests, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS, that the following fees and procedures be established for the pro- cessing of Comprehensive Plan Amendments. FEES To defray administrative and technical review costs of.processing of requests for comprehensive plan amendments, a base fee of twenty dollars ($20.00) per application shall be paid by all applicants. In order to defray the additional cost of processing comprehensive plan amend- ments for developments, all applicants shall pay the total cost of staff and /or consulting time and direct expenses spent exclusively in producing materials for the applicant's request, all materials for said request. a. ' "Materials" shall include, but not be limited to, maps, graphs, charts, drawings, etc. and all printing or reproduction of same. Legal notification and publications shall also be included. b. "Staff and /or Consulting Time" shall include any time spent in either researching for or actual production of materials. C. The hourly rate for "staff and /or consulting time" shall be established and made available to the applicant by the City Clerk prior to production of any materials and the applicant shall be given a reasonable estimate of project time and /or materials cost. The base fee shall be payable at the time applications are filed with the City Clerk and are not refundable. A deposit to cover staff or consulting time and special materials will be established and required by the City Clerk prior to formal acceptance of the application. PROCEDURE 1. An applicant contacts the City Clerk, discusses his requests and completes the request and informational forms. 2. The applicant pays the base fee ($20.00) and makes a cash deposit, to be held in escrow, and charged against the time and materials necessary for processing the request. A deposit of two hundred fifty ($250.00) dollars will be charged. 3. The applicant's request is processed according to procedure established by governing ordinances of City and State. . 4. If difficulties are encountered in the review and evaluation of the request as a consequence of lack of information, unexpected site problems and questions, etc. and the escrow deposit is exceeded, all processing of request will be halted until another estimate for completion is determined and deposit made. 5. Following the City Council's decision on the request, the City Clerk will notify the applicant of the outcome and refund any portion of the escrow deposit remaining. 6. The request will be subsequently referred to the Twin Cities Metropolitan Council for their review and action. He was subsequently elected to that office in November of 1978 and re- elected in November of 1980, and served in that capacity until his untimely death; and WHEREAS, Dewey Mondor rendered invaluable service to the City of Oak Park Heights and to the entire community of the St. Croix Valley during his terms as councilman and mayor of the City of Oak Park Heights. His accomplishments include the development and improvement of the park system of the City, the enlargement of the City Hall and facilities to provide proper working space for the • personnel of the City and storage of City equipment, and during his term the Raymie Johnson highrise for the elderly was built within the City; and WHEREAS, Dewey Mondor was a kind, considerate and concerned person, and was constantly performing service to the community in many capacities and did much to improve the quality of life of the people of the City of Oak Park Heights and the St. Croix Valley. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Oak Park Heights, Washington County, Minnesota, that by this Resolution the members of the City Council individually and collectively express their sorrow for the loss of Dewey Mondor as an esteemed friend, associate and mayor; their appreciation for his dedicated service to the community, and their condolences to the members of his family and all others who with us mourn his death. BE IT FURTHER RESOLVED, that the City Clerk be and hereby is authorized and directed to spread this Resolution upon the official record of the proceedings of the City of Oak Park Heights and deliver a certified copy thereof to the family of Donald (Dewey) Mondor. • Passed this 14th day of September, 1981. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS: The Comprehensive Plan dated December 1979 and supportive documents, copies of which are attached and incorporated herein, are established as the official development guide of the City of Oak Park Heights. ORDINANCE NO. 401 - 8110 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA • AN ORDINANCE AMENDING THE 1980 CODE OF ORDINANCES FOR THE CITY OF OAK PARK HEIGHTS BY AMENDING CHAPTER 400 RELATING TO ZONING BY AMENDING SECTION 401.07 D.2 AND ADDING SECTIONS 401.14 B. ll.d., 401.14 B. ll.e. Page Two • Section 2. Amendment. Section 401.14 of the 1980 Code of Ordinances for the City of Oak Park Heights is hereby amended by adding the following section, reading as fol Iows: "401 .14.8.11. The following requirements shall be imposed in addition to the general requirements set forth in this section with regard to any applications for condominium conversions: 401.14. B. l l .d . Condominium development and conversions shall be in compliance and adhered to the Uniform Condominium Act Laws of Minnesota - 1980 Chapter 582 as may be amended. 401.14.B.11.e. 1 . Application. No application for permit for condominium conversion shall be accepted by the City Clerk without the written verification of the applicant on a form to be prescribed by the City Clerk, of the following • information: 0. That there have been no increases in rent with regard to rental units proposed to be converted to condominiums by the applicant within one hundred twenty (120) days immediately preceding the filing of the application. b. That there have been no evictions of tenants for reasons other than waste, non - payment of rent, or willful damage to property from rental units proposed to be converted to condominiums within one hundred twenty (120) days immediately preceding the filing of the 's application. c. The names and addresses of all tenants or sub - tenants occupying rental units proposed to be converted to condominiums by the app) scant. d. A statement by the applicant identifying the fee owner, or owners of the premises to be converted into condominiums, further identifying all lien holders and /or persons having or claiming to have an interest of record in and to the structure . 2. Building Standards. Any structure proposed to be converted into a condominium shall be made to comply with the building code of the City of Oak Park Heights, and no sale or transfer of any unit therein for the purposes of occupancy or otherwise shall be allowed without the written certification by the building official for the City of Oak Park Heights that the proposed condominium structure and all dwelling units contained therein comply with all applicable building code specifications of the City of Oak Park Heights. 3. Notice and Hearing. In addition to the notice and hearing requirements otherwise set forth herein, the applicant shall provide to the City Clerk written verification that written notice has been supplied to each occupant or lessee of the dwelling unit or apartment, stating the time, place and purpose of all hearings to be held with regard to his request for condominium conversion. The applicant shall also provide notice to the occupants and lessees of any dwelling unit or apartment building proposed to be converted into condominium use with notice that they shall be provided, upon their request, with access to all data in the possession of the applicant to be presented to the City Council by the applicant in advance of any hearing to be held thereon. 401.14.B. 11 J. No application for condominium conversion shall be approved where the proposed conversion is not in compliance with the City's adopted Compre- hensive Plan and adopted Housing Plan. + 401 .14.8.11 .g. In addition to the rights and priviliges of occupants, tenants, or sub - tenants as set forth in Minnesota Statutes 515A 4 -110, the applicant shall be required as a condition of any condominium conversion approved by the City of Oak Park Heights that all tenants or subtenants in possession of any structure proposed to be converted to condominium use who are sixty -two (62) years of age or older or ` handicapped, as that term is defined in Minnesota Statutes 129A.01, who do not elect to purchase that or any unit in the building as a condominium or who do not ' enter into a separate agreement extending their tenancy with the owner and /or applicant beyond the time of actual conversion to condominium units shall be a 9 provided by the applicant with relocation benefits to defray tile betual expense i:� of relocating or moving up to on amount not to exceed three hundred dollars (5300.0• Page Four • Section 3. Effective Date This Ordinance shall take effect and be in full force from and after its passage and publication according to law. Y Donald Mondor, Mayor La Vonne Wilson, City Clerk • OL % • EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL OF CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA HELD MARCH 23, 1981 #8106 Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Oak Park Heights, Washington County, Minnesota, was held at the City Hall for the City of Oak Park Heights on Monday, March 23, 1981, at 7:00 o'clock p.m. The following members were present: Donald Mondor William D. Westphal Barbara O'Neal John Lang Richard Seggelke and the following members were absent: None Member Richard Seggelke then introduced the following Resolution and moved its adoption: RESOLUTION NO. #8106 CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA WHEREAS, the City Council for the City of Oak Park • Heights has been advised as to proposed legislation known as House File No. 671, currently pending in Committee before the Minnesota House of Representatives; and, WHEREAS, the City of Oak Park Heights has consistently opposed legislation which effectively vacates the authority and ability of local government to enact and administer local • w i ��, �'� III I � II I i �i � i I I • • 4 b Ob • • development and land use planning standards; and, WHEREAS, specific portions of H.F. 671 would provide that all mobile and manufactured housing meeting federal standards be considered permitted single family use notwithstanding local ordinance or development plan to the contrary; and, WHEREAS, the City Council for the City of Oak Park Heights recognizes the significant impact on community planning and development that all forms of housing and building can have and the need of each community to be able to coordinate and control development for all purposes within its borders in order to have a well planned and orderly community meeting the needs of all its residents. NOW, THEREFORE, be it resolved by the City Council as • follows: 1. That the City Council of the City of Oak Park Heights go on record as opposing H.F. 671 and all proposed legislation effectively vacating the authority of local government to control and plan its own community's development. 2. That manufactured and mobile housing are subjects of valid concern of local government and should be left to comply with the individual guidelines of the local authority in order to preserve the orderly development of each community. 3. LaVonne Wilson, Clerk 3 - • p 1 R E S O L U T I O N = WHEREAS, during the last several years there has been considerable progress in the City of Oak Park Heights in developing its park system; and WHEREAS, RICHARD SHERRARD has served on the park board for several years; and WHEREAS, the said RICHARD SHERRARD has unselfishly :I+ devoted many hours without compensation to the development of the park system; and • WHEREAS, the park system is one that the citizens of the City of Oak Park Heights can be proud of, and is one • that serves the needs of the citizens of the City of Oak ` Park Heights in many respects. BE IT FURTHER RESOLVED, that pursuant to Section 203,09A, the City shall grant to each.employee paid vacation a,s per the following schedule: 0 5 years of service 10 working days per year 6 - 10 years of service 15 working days per year �7 and over years of one additional day service per year to a maxi- mum of 20 days per year BE IT FURTHER SOLVED that pursuant to Section RE , p 203.17 of the Employee Relation Ordinance, all employees who have completed ten years of service with the City shall be entitled to 50% of their unused sick leave as severance pay, such payment not to exceed 75 days maximum upon retire- ment or if they become disabled so that they must terminate their employment.
