Callahan Xcel Energy 414 Nicollet Mall. Minneapolis, MN 55082 Dear Mr. Callahan: At this time the City Council has clarified needed amendments to the Baytown Substation to better reflect the neighborhood in which the substation exists, see attached letter of May 15 2007. Should Xcel Energy fail to comply with the terms and conditions of this recent clarification, all of which are entirely reasonable, the City be left with little choice but to begin the examination of the requiring the removal of the substation which may be accomplished by the revocation of the Conditional Use Permit as issued in the early 1990s. Should Xcel not desire to install the correct lighting systems, Xcel must apply and attain a variance from the City's ordinances. Until such time as a variance is applied for and received, required compliance with lighting systems remains. Please let me know how you wish to proceed. X would ask that all further communication, including my own correspondence on this matter, be through Mr. John Wertish. Sin -rely, Eric Jo innsoxn r. City Administrator ..
