GENERAL CONDITIONS
Application Review:
The undersigned acknowledges that before this request can be considered and/or approved, all required
information and fees, including any deposits shall be paid to the City. An incomplete application will be
returned to the applicant. The application approval process commences and an application is considered
complete when all required information and fees have been submitted appropriately to the City.
Professional Fee Responsibility:
It is the understanding of the undersigned that all City incurred professional fees and expenses associated
with the processing of this request(s)will be promptly paid upon receipt. If payment is not received from
the applicant,the property owner acknowledges and agrees to be responsible for the unpaid fee balance
either by direct payment or a special assessment against the property.
Applicants will be billed on a monthly basis for Planning, Engineering, Legal and Community Development
fees as they are accrued. It is understood that interest will be charged on the account at the maximum
rate allowed by the Fair Credit Act if it becomes thirty (30) days past due. Failure to pay administrative
and processing fees in a timely manner may result in denial of the application. All fees must be paid at
the time of the application and shall be paid prior to the issuance of a building permit.
The undersigned applicant further acknowledges and consents that all unpaid fees owing the City of Oak
Park Heights shall be treated as unpaid utility fees and may be certified for collection as with delinquent
utility billings and may be assesses against the subject real propertypif unpaid

Approval and Agreement for Minor Subdivision

The City has been petitioned by Thomas J.Thiets and Lisa G Thiets,(collectively the
"Owner")husband and wife,who are the owners of parcel of land in the City of Oak
Park Heights with a current County Property Identification Number of 0302920240029
to grant a Minor Subdivision splitting the property into two smaller parcels known as
the Parcel A and Parcel B;(also See Exhibit A for depiction of proposed subdivision)

PARK HEIGHTS,Washington County,Minnesota.Subject to
easements of record,if any.
PROPOSED Legal Descriptions:

Pursuant to City Ordinance 402.01 G.the City may permit a minor parcel subdivision via an
administrative process. Based on review of the proposal and the comparison with such
ordinance the City does not object to the proposed minor subdivision creating a single lot split
resulting in two lots so described above,subject to four conditions:
1. An additional 5'Drainage and Utility Easement is to be granted and conveyed to the City
surrounding the perimeter of the newly created Parcels as shown in Exhibit A,except only
10'Drainage and Utility Easement on-center between the two parcels—5'each.
The Applicant shall provide to the City a separate Drainage and Utility Easement
documents in recordable form—upon both parcels to create such 5' perimeter drainage
and utility easements, which shall be affixed hereto as Exhibit B and which legally
describes such easement areas.The City will execute this Agreement upon being supplied
the fully executed and notarized Drainage and Utility Easement Documents and which
shall be recorded by the City once the new lots are created through Washington County.
Any discrepancies that arise that may preclude the City from recording the Drainage and
Utility Easements—or which fail to accurately legally describe the easements-shall be
promptly addressed and corrected by the Owner at the Owner's expense.
2. Applicant shall sign necessary all documents with Washington County to establish Parcel
A and Parcel B as each having their own Property Identification Number. Future re-
Subdivision of either Parcel A or B is not allowed and each parcel is established to
support one single family residential structure.
3. The City does not waive any other term, condition, ordinance or requirements with the
approval of this subdivision and no land use permits are granted hereby.
4. Subject to existing easements, declarations and restrictions of record.
5. This Agreement shall be recorded against both Parcels A & B established hereby.
