GENERAL CONDITIONS
Application Review:
The undersigned acknowledges that before this request can be considered and/or approved, all required
information and fees, including any deposits shall be paid to the City. An incomplete application will be
returned to the applicant. The application approval process commences and an application is considered
complete when all required information and fees have been submitted appropriately to the City.
Professional Fee Responsibility:
It is the understanding of the undersigned that all City incurred professional fees and expenses associated
with the processing of this request(s)will be promptly paid upon receipt. If payment is not received from
the applicant,the property owner acknowledges and agrees to be responsible for the unpaid fee balance
either by direct payment or a special assessment against the property.
Applicants will be billed on a monthly basis for Planning, Engineering, Legal and Community Development
fees as they are accrued. It is understood that interest will be charged on the account at the maximum
rate allowed by the Fair Credit Act if it becomes thirty (30) days past due. Failure to pay administrative
and processing fees in a timely manner may result in denial of the application. All fees must be paid at
the time of the application and shall be paid prior to the issuance of a building permit.
The undersigned applicant further acknowledges and consents that all unpaid fees owing the City of Oak
Park Heights shall be treated as unpaid utility fees and may be certified for collection as with delinquent
utility billings and may be assesses against the subject real property if unpaid by October 31st of each year.

Scope:
Desire to split the existing two lots into two parcels,and keep the existing Garage on the one lot with
currently-sited house.
The garage has steel"I-Beam"substructure inside it;I would add a new steel roof,replace existing
garage doors,and put a concrete floor within the garage.
I have been cleaning up much debris and excess vegetation. Also,I am upgrading the house while trying
to maintain some of the historical"1868"vintage feel in the process.

F. Building Permits.
No building permits shall be considered for issuance by the City of Oak Park
Heights for the construction of any building or structure or improvements to
the land or to any lot in a subdivision as defined herein,until all requirements
of this Ordinance have been complied with fully.
G. Minor Subdivisions:
a. Qualification: This section apply to the following applications:
1. In the case of a request to divide a portion of a lot where the
division is to permit the adding of a parcel of land to an
abutting lot so that no additional lots are created and both
new lots conform to Zoning Ordinance lot size minimum
standards
2. In the case of a request to combine two (2) existing platted
lots.
3. In the case of a request to divide a lot from a larger tract of
land and thereby creating no more than two lots, both of
which conform to Zoning Ordinance lot size minimum
standards. To qualify,the parcel of land shall not have been
part of a minor subdivision within the last five (5)years.
4. In the case of a request to divide a base lot which is a part of a
recorded plat on which has been constructed a two-family
dwelling,townhouse or quadraminium,where the division is
to permit individual private ownership or a single dwelling
unit within such a structure and the newly created property
lines will not cause any of the unit lots or the structure to be
in violation of this Chapter, the Zoning Ordinance, or the
State Building Code.
a. Content and Data Requirements:
1. Certificate of Survey: The requested minor division shall be
prepared a registered land surveyor in the form of a
Certificate of Survey.
2. Property Description and Submission Information: The data

and supportive information detailing the proposed subdivision
shall be the same as required for a preliminary plat as
described in Section 402.06 of this Chapter. Exceptions, as
stipulated in writing, may be granted by the Zoning
Administrator.
b. Design Standards. The minor subdivision shall conform to all design
standards as specified in this Chapter. Any proposed deviation from
said standards shall require the processing of a variance request.
c. Processing:
1. If the land division involves property which has been
previously platted, or the total property area included is
greater than ten (10) acres, the Zoning Administrator may
approve the subdivision, provided that it complies with
applicable provisions of this Chapter.
2. In the case of applications involving property which has not
been previously platted,and is less than ten(10)acres in total
area, applicable processing provisions of Section 402.04,
Preliminary Platting shall be followed.
H. Separability.
If any section,subsection,sentence,clause or phrase of this Ordinance is for
any reason found to be invalid,such decision shall not affect the validity of
the remaining portion of this Ordinance.
I. Conflict.
Wherever there is a difference between minimum standards of dimensions
specified herein and those contained in other official regulations,resolutions
or ordinances of the City,the most restrictive standards shall apply.
402.02 Rules.
For the purpose of this Ordinance,words used in the present tense shall include the
future;words in the singular shall include the plural,and the plural the singular;and
the word shall is mandatory and not discretionary.
402.03 Definitions.
For the purpose of this Ordinance,certain words and terms are hereby defined as set
forth in the subdivisions which follow.

Pursuant to City Ordinance 402.01 G.the City may permit a minor parcel subdivision via an administrative process.Based on review of the proposal and the comparison with such
ordinance the City does not object to the proposed minor subdivision resulting in two lots so described above,subject to four conditions:
1. An additional 10'Drainage and Utility Easement is to be granted and dedicated to the public surrounding the perimeter of the newly created Parcels.
(5'on each side of the lands between Parcel A and B).The Applicant shall provide to the City a separate Drainage and Utility Easement documents
to create such 10'easements,in recordable form,which shall be affixed hereto as Exhibit B and which legally describes such easement areas.
The City will execute this Agreement upon being supplied correct the Drainage and Utility Easement Documents and which shall be recorded by
the City once the new lots are created through Washington County.Any discrepancies that arise that may preclude the City from recording the
Drainage and Utility Easements—or which fail to accurately legally describe the easements-shall be promptly addressed and corrected by the
Applicant and/or at the Applicant's expense.The easement areas are additionally shown in Exhibit A for reference.
2. No other subdivision is approved.A garage encroachment being conveyed to the property lying to the south of Parcel B,shall be recorded upon
the newly created lot,but only after the City'easements are duly recorded.Such encroachment shall be secondary to the City's easements.The
Applicant shall take all necessary steps to ensure the City's easement(s)are correctly created.
3. The City does not waive any other term,condition,ordinance or requirements with the approval of this subdivision and no land use permits are
granted hereby.The Parcels being created are irregularly shaped and must also meet th-80'lot-width requirement at the front yard setback line.

EASEMENT AGREEMENT
THIS EASEMENT AGREEMENT("Agreement") is entered into by and between
Little Red Hen Properties, Inc., a Minnesota corporation(Grantor) and Douglas R. Van
Dyke, Jr. and Jennifer L. Van Dyke, husband and wife, ("Grantees") on this )q4 day of

WHEREAS, Grantor is the owner of the real property located in the Sate of
Minnesota, County of Washington, legally described as follows:
The South Twenty feet of Lot Four(4),Lots Five,Six, Seven,(5,6,7)and Lot Eight(8),except the South 1.2
feet thereof,in Block Thirteen(13)of Elfelt's Addition to Oak Park, according to the plat thereof on file and of record in
the office of the Register of Deeds of Washington County, Minnesota. (Grantor's Property).
WHEREAS, Grantee is the owner of real property located in the State of
Minnesota, County of Washington, legally described as follows:
The South 1.2 feet of Lot 8 and all of Lots 9 and 10,Block 13, Elfelt's Addition to Oak Park,according to the
plat thereof on file and of record in the office of the Register of Deeds of Washington County, Minnesota(Grantees'
Property")
WHEREAS, it has been determined that the Existing Garage on the Grantees'
Property encroaches upon the Grantor's Property by approximately /— ,,$ -/ ; and
WHEREAS, Grantor has agreed to grant an easement to Grantees in order to
clear any discrepancies as to the encroachment upon the Grantor's Property.
NOW, THEREFORE, in consideration of$1.00 and other good and valuable
consideration, the parties agree as follows;
1. The above recitals constitute an integral part of this Agreement and are
incorporated herein by reference.
2. Grantor hereby grants to Grantees an encroachment easement for the above
described encroachment.
3. The owner of the Grantees' Property shall have the easement in perpetuity
provided; however,that in the event the garage that currently encroaches upon
the Grantor's Property is ever destroyed or removed, then in that event the
easement shall terminate.
4. The owner of the Grantees' Property shall be responsible to maintain the
Garage.
5. The easement granted herein shall run•with the land provided,however, it
shall terminate as provide herein.
6. The owner of the Grantees' Property shall indemnify, defend and hold
harmless the owner of the Grantor's Property from and against any and all
claims, demands, injuries, expenses and damages caused by the structure,
which is on the Easement Area. Said indemnification shall include all costs
and attorney's fees incurred by the owner of the-Grantor's Property.
7. This Agreement shall be interpreted pursuant to the laws of the State of
Minnesota. This Agreement shall bind and inure to the benefit of the
respective heirs, personal representative, successors and assigns of the parties.
8. The Agreement may be executed in multiple counterparts, each of which shall
be an original.
