Commissioner Valessa Caspers was appointed to a partial term in June, 2005 to complete the un expired term of former Commissioner Oswald. At the March 9 meeting, Commissioner Caspers stated that she was uncertain as to whether or not she wished to seek rea ointment to the Pla ring Commission for a full 3 -year term, which would run May 31, pp 2006 through May 31, 2009. Regretfully, Commissioner Caspers has since provided written notice of her desire to not seek reappointment. Commissioner John Dwyer has consecutively served as a Planning Commissioner since 2. C wy Y 1999 and an Officer for four of those years. Regretfully, Commissioner Dwyer has provided written notice of his desire to not seek reappointment to the Commission. 3. Commissioner Mike Runk was appointed to a partial term in January, 2001 to complete the unexpired term of former Commissioner Dahlquist. Commissioner Runk received his first full 3-year term appointment in 2003, which culminates this May. If Commissioner Runk so desires, the Planning Commission Bylaws allow him to seek reappointment to the. Ply Commission for a second full 3 -year term, which would run May 31, 2006 through g May 31, 2009. At this time, Commissioner Runk is requested to assert whether or not. he wishes to seek reappointment to the Plug Commission. If he does not, he is requested to provide written notice to that effect, to City Administrator Johnson. In the event Commissioner Runk does not seek reappointment, a new Chair will need to be elected. Commissioner Wasescha is currently in his first appointed term, which will culminate in May of 2007. Press Releases were provided to the St. Paul Pioneer Press, the Stillwater Courier and the Stillwater Gazette. The Stillwater Courier ran a paid advertisement in their April 6 edition. Additionally, Administrative Secretary, Julie Johnson has placed the announcement on the City web page; it is anticipated that she will also place the announcement in the City Newsletter if timeliness permits. Kathy Cinnamon of the Central St. Croix Valley Joint Cable Commission has been asked to place an abbreviated announcement on the local community y channel. Now is the time to connect with your community and let those you know, who may be interested or those who you feel would be interested in the opportunity available. A copy of the announcement is attached for your reference as is a Commissioner application for you to share. Applications are being accepted until the end of the day, Monday, May 1 St and it is anticipated that interviews will be conducted prior to the regular May meeting of the Commission so that City Council appointment can be made for introduction at the June Planning Commission meeting. Call Annual Meeting to Order: Chair Runk noted that the purpose of the Annual Meeting was to learn whether or not Commissioners with terms scheduled to expire have interest in seeking reappointment and to elect the Chair and Vice Chair if needed. He pointed out that the Chair and Vice Chair were elected in 2005 and since the terms were for two years, there was nothing needed for item Be Chair Runk called the Annual meeting to order. A. Brief discussion was had. Commissioner Wasescha, seconded by Commissioner Dwyer, moved to continue the Annual Meeting to April 13, 2006. Carried 4 -0. Approve Minutes of February 9, 2006: Commissioner Caspers, seconded by Commissioner Dwyer moved to approve the Minutes with typographical corrections. Carried 4 -0. Jacob Holdings of 60 St. LLC Conditional Use Permit Amendment and Variance - -14738 60 St. N. City Planner Richards reviewed his planning report of the applicants request for amended conditional use permit relative their auto sales operation. Richards noted that amendments to the requirements of the conditional use permit approved in December 2003 was being sought as the applicant does not wish to improve upon an area that is presently shown as an area to be taken as party of the Hwy. 36 bridge project and in light of timeline changes with the MPCA issue being handled b y the owner of the parcel they currently lease and are using as part of their business operation. Richards noted that the applicant has expressed redevelopment of the site into a new auto dealership once the plan for Hwy. 36 becomes known. Chair Runk opened the hearing for public comment and invited the applicant to speak. Dan Boivin, Attorney for Hecker Automotive and Bill Rambo, Hecker Automotive Project Manager, addressed the Commission and discussed with them the basis for their request. Discussion was had as to the MPCA situation at the leased parcel as was the uncertainty of alterations to Hwy. 36. Mr. Rambo discussed the lighting concern for the existing site and stated that he would look into it. Mr. Rambo stated that the goal was to build a new store at the site and they didn't want to have to expend any more than necessary. There being no other visitors to the public hearing, Commissioner Dwyer, seconded by Commissioner Wasescha, moved to close the public hearing. Carried 4 -0. Discussion ensued as to the proposed alterations to Hwy. 36 and the bridge as being an element to this project consideration, timelines, reasonable time frames, new store versus compliance deadlines to existing site and the MPCA matter's progress and facilitation. It was noted that Hecker Automotive was leasing the parcel and that the owner was facilitating the MPCA matter for the parcel and that at such time it is resolved Hecker Automotive will purchase the parcel so that the two lots may be combined. Commissioner Dwyer expressed that without information as to the MPCA soil clean up effort he didn't feel that they had adequate information to make and informed recommendation on the matter being requested and noted that he would like to see information on the clean up and have someone present who can speak to what is happening with it. Commissioner Dwyer, seconded by Commissioner Wasescha, moved to continue the public hearing to the next regular Planning Commission meeting with the understanding that the Commission would receive information as to the MPCA soil clean up situation and that someone that could speak to the situation would be present at the continued hearing. Carried 4 -0. Planning Commission Minutes March 9, 2006 Page 3 of 8 B. W.A.T.E. Enterprises, Inc. ,Will Zint1) P.U.D. Amendment & Site Plan Review -- 5670 Memorial Ave. N. City Planner Richards reviewed his planning report of the applicants request for amended planned unit development: concept and general plan and site plan review. Richards noted that the amendment requested would connect the existing principal building with an existing storage facility and add 3,870 sq. feet of cold storage to the building. Richards briefly discussed the site history and reviewed the proposed conditions of the planning report. Chair Runk opened the hearing for public comment. There being no visitors to the hearing, Commissioner Dwyer, seconded by Commissioner Wasescha moved to close the public hearing. Carried 4 -0. Commissioner Dwyer, seconded by Commissioner Caspers moved to recommend City Council approval of the request for amended concept and general planned unit development, subject to the following conditions: 1. The grading and drainage plan shall be subject to the review and approval of the City Engineer. 2. The utility plan shall be subject to the review and approval of the City Engineer. 3. The lighting plan shall be subject to the review and approval of City Staff. 4. The location(s) of fire hydrant(s) shall be subject to the review and approval of the Fire Chief. 5. A revised Development Agreement, if necessary shall be subject to the review and approval of the City Attorney. Carried 4 -0. C. Anchobgaro, Inc. (Tim Nolde) Conditional Use Permit for fill placement in area located north of 58 St. and West of Oakgreen Ave. N. City Planner Richards noted that the request was relative to the proposed Oakgreen Village project and reviewed his lannin report as to the applicants request for conditional use permit to stockpile p g re p topsoil and granular material within the second phase of the Oakgreen Village project. It was noted that the material would come from the Lowe's site and that it would equal approximately 40,000 cubic q ards of topsoil and an equal amount of granular material, necessitating the requirement of a Y p conditional use permit. Richard reviewed proposed conditions and noted an additional proposed condition from the City Attorney of security ensuring compliance with the conditions of any approval. Planning Commission Minutes March 9, 2006 Page 4 of 8 Chair Runk opened the hearing for public comment. Todd Erickson of Folz, Freeman, Erickson, Inc. -- 5620 Memorial Ave. N introduced himself as the Project Engineer and stated that they are working with Lowe's developer to take their extra site material and make it useable at the proposed Oakgreen Village development. Erickson discussed how the fill material would be used within the project phasing and how it would be seeded, planted, maintained and how drainage would be facilitated. Discussion ensued as to which properties on Oakgreen Ave. were under the developments control, the berm to the rear of those properties, method of silt fencing and safeguarding of the adjacent properties from runoff. Lisa Anderson - -13991 60' St. Ct. N. questioned where the vehicles moving the fill would be driving and wanted to know if the fill being moved was non - contaminated. Mr. Erickson addressed the questions, stating that the fill would be moved across the development site and that there would be no on -road driving activity. The soil has been tested and contaminates will not be moved to the fill pile and that all fill activity will be managed in compliance with the MPCA requirements. Discussion ensued as to timing and maintenance. Mr. Erickson noted that they were looking at an approximate 3 -week window for fill movement and placement, after which the seeding and maintenance process would commence. He explained this process and what method and seeding they proposed to use on the fill berm. Bill Boland —13981 W' St. Ct. N. expressed his concerned as to any additional drainage onto the Pondview Condominium neighborhood as a result of the berm height and slope. Mr. Erickson discussed swale placement and drainage routing, planting of the berm and noted that the berm proposed will have a 3 to 1 slope ratio, making. it a maintainable berm. Lisa Pingel -- 5830 Oakgreen Ave. N noted that the field to the rear of her home already receives an abundant amount of moisture and expressed her concern of increasing water to the area. Discussion ensued as to water runoff routing and water diversion mechanisms as well as plans for the tree line between her property and the proposed development. There being no other visitors to the public hearing, Commissioner Caspers, seconded by Commissioner Dwyer moved to close the public hearing. Carried 4 -0. Discussion ensued as to water routing, conditions of planning report, status of development agreement between City and adjacent development to proposed Oakgreen Village and Lowe's, and possibilities of project monitoring in relation to potential soil contamination issues. Planning Commission Minutes March 9, 2006 Page 5 of 8 Commissioner Dwyer, seconded by Commissioner Caspers moved to recommend City Council approval of the conditional use permit request, subject to the following conditions: 1. The fill material, upon its placement, shall be immediately surrounded by silt fencing as provided in the plans submitted as part of this conditional use permit application. 2. The fill material shall be explicitly limited to those areas and elevations as approved by the City Council. Any variance from the plan shall be approved in writing by the City Engineer. 3. The plans shall be subject to the review and approval of the City Engineer. 4. The fill shall be moved and final graded within 30 days following commencement of activity at either site. Seeding and landscaping shall be completed within 45 days from commencement of fill activity at either site. A landscape plan and specifications for seeding shall be provided by the applicant and approved by the City prior to the movement of any fill material onto the site. 5. The applicant shall provide a dust containment plan, prior to the movement of any fill PP p material onto the site, subject to the review and approval of the City Engineer. 6. The applicant shall provide a security in the form of a letter of credit in the amount of $20,000 for completion of all conditional use permit conditions within one year of City Council approval and subject to the approval of the City Engineer. 7. The drainage plan shall be revised, subject to review and approval of the City Engineer, to incorporate changes so as to eliminate runoff onto Oakgreen Avenue properties. 8. The applicant shall secure a licensed environmental specialist, subject to the approval of the City Engineer, to be on site at all times during fill excavation and placement to ensure that there are not findings of inappropriate buried material or containments. Should any inappropriate materials be found during excavation, all work shall cease and the City shall be immediately notified. Upon completion of excavation, the specialist will provide written comments to the City that no inappropriate, inconsistent or hazardous materials were found. Carried 4 -0. D. AnchobWro, Inc. (Tim Nolde) P.U.D. — Concept Plan, Subdivision & Site Plan Review for Oakgreen Village located north of 58 St. and West of Oakgreen Ave. N. City Planner Richards reviewed his planning report as to the applicants request for a revised planned unit development concept plan, subdivision and site plan review and discussed the history of the project before the Planning Commission and City Council. Plannin g Commission Minutes March 9, 2006 Page 6 of 8 Chair Runk noted that the planning report asks for comment as to residential or retail being the best use for the area and stated that any comment on the use, from the audience would be beneficial. Chair Runk opened the hearing for public comment. Todd Erickson of Folz, Freeman, Erickson, Inc. -- 5620 Memorial Ave. N introduced himself as the Project Engineer and briefly discussed the changes made to the plan and road alignments. He noted that he believed the plan to be good both functionally and marketwise for the current phase and for its future phase for the area. Mr. Erickson made himself available and addressed questions throughout the remainder of the public hearing. Lisa Anderson —13 991 60 th St. Ct. N. questioned as to whether or not the entry at Novak Ave. had to run through to Oakgreen Avenue or it could be ended at the first commercial property. Lisa Pin el -- 5830 Oak green Ave. N. requested clarification of the ponding plans within the phasing, drainage and runoff control. Bill Boland - -13981 60 th St. Ct. N. expressed his concerned as to the condition of the existing storm sewer manholes at Pondview Condominiums and questioned whether or not the existing system would be able to accommodate additional use. Discussion ensued as to Novak entry roadway, ponding location and design, drainage and runoff control, right -of -way, setbacks from homes closest to the roadway, residential versus retail use of the area, private versus public roadways and issues of concern such as snow removal, grading, signage design and maintenance and the conditions proposed within the planning report. Commissioner Dwyer, seconded by Commissioner Wasescha, recommended City Council approval of the revised planned unit development concept plan, subject to the following conditions: 1. B -4 District standards are compliant with the proposed project application. 2. The applicant provides a property appraisal, acceptable to the City Attorney to calculate park dedication. ri for Novak Avenue 59 Street and Oak 3. The plat shall dedicate gr een Avenue as required by the City Engineer and the City Attorney. 4. The Plannin g Commission recommends that the City acquire the right -of -way for 59 Street as part of the Oakgreen Village plat but not construct the roadway at this time. 5. The Planning Commission is favorable to the design of Novak Avenue including the screening, landscaping and berms proposed on the preliminary plan. r r Planning Commission Minutes March 9, 2006 Page 7of8 6. The Planning Commission recommends a public street network for this development. 7. The Fire Marshall and the Police Chief should review the plans and determine the accessibility of emergency vehicles throughout the development. 8. The Park Commission should comment on the proposed private and public trail system. 9. All required setbacks to conform to zoning and wetland ordinance requirements and shall be incorporated in the general plan of development. 10. All perimeter units must maintain a 20 -foot setback to the lot lines. 11. The applicant shall provide vehicle count information and projections as required by the City Engineer. 12. Detailed tree inventory, tree preservation and landscape plans shall be provided for general plan of development. 13. Detailed park plans will be required for general plan of development review. 14. Detailed grading, drainage and utility plans shall be provided for general plan of development review. 15. Detailed architectural plans for the proposed buildings in the project shall be required for general plan of development review. Carried 4 -0. New Business: A. Commission Vacancy Direct Advertisement and Schedule Date for Interview Chair Runk noted that there would be at least once Commission vacancy at the end of May. He discussed commencing advertisement immediately, with interviews to be held sometime prior to the May Commission meeting, so that a recommendation could be made to the City Council for their May meeting and having the new member or members seated for the June Planning Commission meeting. The report from the environmental consultant indicates that a clean up s will be installed on site and then operate for 12 to 18 months. The final closure letter from the MPCA ma take an additional 12 months. What is the clean -up methodology, what is the timeline for completion? As stated at the meeting, Planning Commission asked that this information be provided by the fun actually performing the work, either in writing or in person at the April meeting to be held at 7pm on April 13 2006 at City Hall. King Ash Disposal Facility FILE NO: 798.02 — 06.04 BACKGROUND Darrell Knutson, representing Xcel Energy, has made application for an amended conditional use permit to allow modification to the existing conditional use permit approvals for the A.S. King Plant Ash Disposal Facility. The ash disposal facility, also known as the Moelter Landfill has been reviewed by the MPCA and the minor modifications, as proposed, have been approved. The changes shall be less intensive to the adjacent neighbors to the east. The post closure access road would be moved to connect to the existing cul -de -sac at 58 Street North. The City Council approved a conditional use permit in October of 1996 to expand the ash disposal facility. That expansion also included vacating significant roadway right -of- way in areas that had been platted but never developed. The plan, approved in 1996, has been followed although Xcel Energy has proposed these minor modifications as part of the final phase of construction. The property is zoned I, Industrial which accommodates the use as permitted. The existing conditional use permit was requested to allow mining and land reclamation in excess of 400 cubic yards. Any changes to the approved plan require an amended conditional use permit. The proposed Land Use Plan designates this area as Park Facilities /Open Space. When the Concept Plan was completed in 1998, it was anticipated that the ash disposal site would be filled within 10 years and that the area would remain as open space with the potential for park and trail development. Zoning. As noted, the area is zoned I, Industrial. The ash disposal site is a permitted use and the conditional use permit granted in 1996 adopted the final cell development plan that included mining and land reclamation in access of 400 cubic yards. Any changes to that plan, as now being proposed, requires an amended conditional use permit. Proposed Amended Conditional Use Permit. The project's applicant has provided the following narrative to describe the changes in the final plan: "The final phase of construction, Phase 6, Cell 5, and the capping of the current operating area of the facility, Phase 6, Cell 3, will be occurring during the summer months of 2006. Xcel Energy, A.S. King plant, is proposing a minor modification to the existing permitted construction of these areas as identified in the Minnesota Pollution Control Agency (MPCA) permit number SW -54. The modification will develop the site in a less intrusive way. The footprint of the proposed construction area will be shifted further to the west than currently permitted, reducing the impact on the closest neighbors. The long term, post - closure access road will be changed to reduce traffic nearest these neighbors to eliminate the need for a long term site driveway access from Beech Road. To allow this modification to meet the needs of the A.S. King plant capacity requirements, both the base elevation and the final elevation of the phase will be raised. The upper elevation increase will dampen the currently permitted valley that was originally proposed, making the ground surface more useable for long- term e nd -use options. The MPCA has reviewed this Minor Modification request and has approved these changes. The immediate and most impacted neighbors have been contacted. They have reviewed the changes and find them acceptable. 2 The proposed modification will utilize the existing cul -de -sac at the west end of 58 Street in Oak Park Heights as the post - closure access point which will allow Xcel Energy to access the monitoring station for monthly inspections and leachate management in the event of equipment failure. The 58 Street access point will not be used during the remaining operating life of the site. The existing Beach Rd haul road will continue to be the access point for both this construction event and remaining fill /operating activities of the facility. The operating life expectancy for this facility is anticipated to be the end of 2009 or early 2010." Roadway Access. As indicated in the applicant's narrative, the long term access road into the site would be from the cul -de -sac at 58 Street North. That roadway would not be utilized until final capping of the site in 2009/2010. Until that time, all haulin ty operations will be from the current Beech Road access. The access road from 58 Street would permit access by Xcel employees for required long term maintenance and monitoring. Emergency vehicle access would need to be provided at this location. Trees /Landscaping. Information submitted from Xcel indicates that 12 significant trees would be removed as a result of the change in plans. The trees are located near the access road on the north side of Phase 6, Cell 5. Xcel has proposed to pay the replacement fee instead of planting new trees. The City Arborist has expressed a preference for tree replantings in this area. The City Arborists comments are found in an attached memorandum. Trails. As part of the previous approvals, Xcel has installed a trail system within the closed areas of the landfill site. The proposed changes to the plan will not impact the trail system. Payments in Lieu of Taxes. City staff has suggested that Xcel consider a payment in Y Y gg lieu of taxes for the landfill site. The site is currently tax exempt. The City will incur ongoing costs for police protection and other emergency services for the site. It is suggested that a condition be added to the conditional use permit for consideration by the Planning Commission and City Council. CONCLUSION / RECOMMENDATION Based on the revious review, City staff recommends approval of the amended p Y conditional use permit to allow for a modification to the existing conditional use permit for the A.S. King Plant Ash Disposal Facility. The amended conditional use permit is recommended with the following conditions: 1. All ash hauling to the site shall continue to be from the Beech Road access. No access for fill operations shall be from the 58 Street access. Access to 58 Street shall be not be allowed until such time as the access from Beech Road is discontinued. Emergency vehicle access shall be provided in the long term from 58 Street. 3 r 2. Xcel shall replant and maintain trees, according to a plan approved by the City Arborist, to satisfy the City's tree replant requirements. 3. The City Council shall consider a payment in lieu of taxes for the landfill site. The fee amount and terms shall be determined by the City Council. 4. Johnson; Jim Butler; Scott Richards; Mark Vierling Cc: Julie Johnson Subject: Xcel Fly Ash Site - Tree Replacement OPH Staff - Today I met with Sharon Sarappo, senior environmental analyst with Xcel Energy regarding the additional tree removal and tree replacement for the final phase of construction at the fly ash landfill west of the 58th St. cul -de -sac. Sharon's memo of 4/5/06 listed the removal of 12 significant trees on the west side of the chain link fence. There are two more oak which are down to the south west of these trees which will also have to be removed for grading. Since all the trees on the west side of that fence will now be removed, it will further compromise screening of the landfill site from the adjoining residential properties. Rather than have Xcel pay a fee "in lieu of planting ", I think the replacement trees should be planted on the Xcel property to provide additional screening. Ms. Sarappo and I also discussed numerous trees in the area which planted in past years by Xcel and have died due to lack of care. There are also 3 red pine (approx. 12 ft. tall) which will need to be moved with a tree spade since they are in the path of the proposed access road. Consequently, the tree planting and replacement recommended consists of replacement of 7 of the evergreen and deciduous trees which previously died (most on the east side of the trail from the cul -de -sac), planting of 7 trees as replacement for the significant trees being removed in this current phase of construction, and transplanting of the 3, 12 ft. red pine mentioned above. At the site review meeting 4/5, Mr. Knutson also stated that they could plant 3, 6 ft. "Black Hills" spruce in the area northwest of the trail to replace screening provided by the large cottonwood which will be removed in this phase. After planting, the trees should each be watered and mulched with 4 -6 inches of wood chip mulch in an area several feet out from the trunk on all sides. Supplemental watering will need to be done for the first season after planting to ensure that the trees get established well. There is ample area to plant trees around the cul- de -sac, including the eastern side to provide some screening for the tan house. The species recommended for planting include: river birch, red maple, bicolor oak, bur oak, basswood, honeylocust and "Black Hills" white spruce.
