Parapet/Strip Lighting is not permitted by City Ordinance 401.15.8.7 Outdoor Lighting. There are white lights placed at the roof line of the dealership building. I have addressed communications to your attention in January requesting their removal. 2. Exterior Storage/Stockpiling accumulations are considered a nuisance per City Ordinance 1109 Nuisance,section I. There is a stockpile of light poles to the rear of the property, which were removed from the site parking areas with your redevelopment. There is also an accumulation of tires, auto parts and such in and around the trash enclosure area. Please note that your 2014 CUP approval did not allow for exterior storage of any kind and stated that all materials, parts and supplies were to be stored to the interior. We have spoken with regarding to these and their removal requested. Additionally,there is a stock pile of tires at your trash enclosure area,to the rear of the building,such storage is required to be within an enclosure area. 3. Special Event Advertisement Signs require a special event permit per City Ordinance 401.15.G.7. There are signs placed upon several of the parking area poles,advertising vehicle sales. This type of sign display is considered special event signage and may be placed only with a special event permit as your development has not requested or received approval for display of such signs beyond City Ordinance regulations. 4. Trash Enclosure is required at your trash area. The one to the rear of your property is in a state of disrepair and needs to repaired so that it adequately screens the trash containers and other items placed within it for disposal collection. Tree City U.S.A. For your convenience, I have enclosed: A. A copy of the October 28, 2014 Conditional Use Permit and Variance document for the site; B. City Nuisance Ordinance 1109; C. A Special Event Permit Handout and City Ordinance 401.15.G.7 related to the same; and D. A Trash Enclosure Handout containing City Ordinance 401.15.D.12 and 401.16 regulations for them. This also pertains to an enclosure for tire disposal collection. With the above in hand,the City requests that you take the necessary steps to bring the site into compliance, including the approval conditions within the October 28, 2014 CUP/Variance as follows: Prior to Monday, March 18, 2019 • Remove parapet/strip lighting. If you cannot remove these parapet lights by the date noted, please provide a very near-term date upon which we may rely. Otherwise we are left to speculate that these will remain unaddressed. • Remove the signs from the parking lot light poles. • Remove all exterior store items to and around the trash enclosure. Prior to Monday, May 20, 2019 • Have an adequate trash and/or tire disposal enclosure constructed that complies with City Ordinance. The enclosures do require a work permit from the City of Oak Park Heights, shall be installed by a City licensed contractor. A plan for the structure construction shall be remitted with the work permit for the City Code review. • Remove all of the light poles stockpiled to the rear yard of the site. • Verify that all October 28, 2014 CUP/Variance conditions of approval are met and being complied with. We have communicated on the above items over the past year, compliance has been requested and not met. CONDITIONAL USE AND VARIANCE PERMIT:Automobile dealerships are a conditional use in the B-2 zone. Additionally applicant has requested variances to allow a freestanding light fixtures at 28 feet (code allows 25). Variances have also been requested for a freestanding sign at 40 feet (code allows 30) and for the number of allowed wall signs from 2 to the now 11 proposed. Any new mechanical equipment that is located on the roof or ground level and visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building facade materials. 6. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 7. The City Council was favorable to the building design and building materials. 8. Plans shall be provided for the trash enclosure gates subject to review and approval of City staff. 9. The Applicant shall provide a snow removal plan or indicate if the snow will be hauled off site. 10. The City Council was favorable to the Variances required for the size,height and number of freestanding signs,for the number of wall signs,and for the total square footage of requested signage. 11. Building entrance plantings shall be required. The Applicant shall revise the landscape plan or provide seasonal planters at the main entrance to the building. 12. A bike rack should be identified on the site plan and placed on site. 13. Sound levels generated from the site shall be in compliance with Section 401.15.B.I 1 of the City Zoning Ordinance. 14. The use of an exterior announcement system shall not be allowed. 15. All storage of materials,parts and supplies shall be interior to the building. 16. All auto repair activities shall be conducted indoors and the overhead doors to service bays shall be kept closed at all times except when moving vehicles in and out. 17. Automotive sales and service shall not be conducted between the hours of 10:00 PM and 6:00 AM unless otherwise allowed by formal action of the City Council. 18. Variances are also requested related to the numbers, size height, and total amount of signage. The intent is to operate a Chrysler Jeep Dodge and Ram dealership and service operation out of the existing building on the former Denny Hecker dealership site on 60u1 Street North. The property is zoned B-2, General Business District in which automotive sales and service is a Conditional Use. The Applicant plans to occupy the existing building and update the interior and exterior of the structure. The site layout will remain essentially as it is today,with updated signage,light fixtures,pavement and landscaping. A detailed description of the project by Mr. Phillips is found as Exhibit 1 to this report. Leonard Investments has purchased the property and plans to relocate the current dealership at Osgood Avenue and Highway 36 to this location. The dealership will sell new Chrysler, Jeep, Dodge and Ram vehicles and provide sale and service of new and used vehicles. The site has been vacant for a number of years and the project will include new interior and exterior building remodeling. The site will also undergo improvements to the pavement, lighting, landscaping and signage. Comprehensive Plan. The Comprehensive Plan designates this area as Commercial on the Proposed Land Use Map. The use of the property for automotive sales and service is consistent with this land use designation. Zoning Ordinance. The property is zoned B-2, General Business District in which automotive sales and service is a Conditional Use. The Applicant has applied for a Conditional Use Permit to allow the site to be used as a dealership and a Conditional Use Permit to allow 28 foot freestanding light fixtures that exceed the allowable 25 foot height limitation. Variances have been applied for to allow for a freestanding sign at 40 feet (30 foot allowed), for the number of allowed wall signs from two to the eleven proposed, and for the size and total amount of signage. Review of the criteria for the Conditional Use Permit and Variances is found later in this report. Subdivision. The property is platted as Lot 1, Block 1 Jacob Addition. There are no changes requested related to the lot or easements. Setbacks. The building and parking areas are compliant with all setback requirements. There are no changes planned to the building or parking setbacks with this project. Traffic Circulation/Curb Cuts. The existing curb cuts will remain for access to 60th Street North and Neal Avenue North. Snow Storage. The plans do not indicate an area for snow storage. The applicant shall indicate where the snow is to be stored or if it will be hauled off site. Parking. The proposed site plan shows a total of 637 parking spaces which is a reduction in five spaces from what currently exists. The parking calculation for this use as retail sales is as follows: 58,657 sq ft x .9 = 52,791 /200 =264 parking spaces. There is adequate parking for a car dealership, customers and employees. 2 Landscaping. The landscape plans indicate that the existing planting beds will be restored and planting replaced as necessary. There is a new planting bed on the west side of the parking lot near the main entrance.The submitted landscape plan Is subject to City Arborist review and approval. City Arborist comments are found as an Exhibit to this report. Lighting. The lighting plan indicates that many of the existing parking lot light locations are to remain with other fixtures moved or added to address the site lighting. New poles and fixture heads on both the new and existing locations will be installed with LED lights and will be full cut off. The new wall mounted building lights will also be LED lights and full cut off. The plans indicate that the poles to be used will be 28 feet in height except for those under the power lines will be 25 feet In height. The lighting requirements of Section 401.15.6.7. of the Zoning Ordinance requires the parking lot fixtures to be 25 feet or less to the top of the fixture. The Applicant has indicated that the taller fixtures are required to achieve a more balanced spread of light. The Zoning Ordinance allows the review of the taller light fixtures by Conditional Use. City Staff does not see any issues with allowing the fixtures to exceed the height limitations for the reasons provided by the Applicant. A photometric plan had been provided for City review. The light levels exceed the requirement of four-tenths(0.4)foot candles at the property line at certain locations on the site. Of most concern is the east property line adjacent to the motel. The Applicant will be required to revise the photometric plan so that it is compliant with the lighting requirements of the Ordinance. Trash Storage. The existing trash storage enclosure, located on the east side of the site will be used. New gates will be installed. Plans for the gates shall be provided for approval by City Staff. Mechanical Screening. Any exterior mechanical equipment, either on the roof or ground mounted will need to be screened in accordance with Section 401.15.E.10.e.of the Zoning Ordinance. Grading,Drainage,Erosion Control and Utilities. The surface of parking areas will be repaired but no changes are planned to the grading,drainage or utilities. Grading, drainage,erosion control,and utility plans are subject to review and approval by the City Engineer. Storm water issues are also subject to review and approval by the Valley Branch Watershed District,which has been deemed unnecessary for this project. Design Guidelines. The changes to the building will not be significant. The Applicant has provided the following explanation of the remodeling: `The exterior of the building consists of painted decorative concrete block,EFIS,glazing and doors including overhead doors. The renovation will include re-painting the painted surfaces to the Chrysler specified neutral gray. The EFIS will be restored and recoated 3 the same gray color. The overhead doors facing the streets will be replaced with full vision glass doors. The glazing will remain. Chrysler requires the addition of an ACM (Aluminum Composite Material) at the entry element and above the service entry doors. This is the same material recently installed at the Chevrolet dealership in Oak Park Heights. The basic color is metallic silver. There is a polished silver line around the arched form at the entry. Please refer to the elevations. We would qualify this material as an architectural metalwork accent material under the Design Guidelines. The remaining overhead doors will be replaced with glass or opaque panels." Sustainable Guidelines. The Planning Commission will question the Applicant on how the project has been designed to achieve at least a certain degree of sustainability. The Applicant will need to discuss the methods in building construction and site design with the Planning Commission of how these issues have been addressed. Architectural Guidelines. Facade Treatments The building was designed with a definite base, middle and top on the facades facing the roadway. This will continue with the updated building design. The facades feature differences in materials and colors to provide architectural interest. Ground Level Expression This is a two story building with a raised tower feature at front entrance facing Neal Avenue North. The main entrance is well defined by the tower and signage. Transparency The building uses glass on all of the facades. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The north elevation is proposed at 43 percent glass, the west elevation is 45 percent glass. Entries The building features a prominent entry with a raised parapet, tower and signage. Roof Design The roofline is broken by various building and parapet heights. The rooftop mechanical equipment will need to be completely screened. Building Materials and Colors The applicant has provided color elevations for review. The building will be a combination of painted decorative block, EFIS, glazing and doors. Much of the building material is not being replaced with this remodel. The aluminum composite material is limited to only the front entrance feature and has been 4 allowed in other buildings in Oak Park Heights. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building is not a franchise design. Site Design Guidelines Building Placement The proposed building has a well-defined entrance. The front entrance will be orientated to the west. Parking Areas The parking area will be significantly improved with repaired pavement. Storm water Storm water will be addressed by the City Engineer. Pedestrian and Common Space Currently, there is a trail along 60th Street and Neil Avenue. Landscaping Building entrance plantings are required. The plans do not show any addition of plantings at the front entrance. This should be addressed by the Applicant. Trees/Shrubs The plantings used in the landscape plan shall be subject to the review and approval of the City Arborist. Utilites/Service/Loading/Drive-Through/Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. Pedestrian/ Bicycle Routes A bike rack will be required. The applicant should identify a location. Signage. Freestanding Signs. The applicant has proposed a 40 foot pylon on the north side of the site. The plans indicate that size of the sign is 160 square feet. The property is within the Destination Retail Highway Sign District which would allow one freestanding sign of 150 square feet and a maximum height of 30 feet. The sign would require a sign 5 height and size variance. Another freestanding sign is proposed on the west side of the site and will be 20 feet in height and 68 square feet. This would also require a variance for the additional freestanding sign. The sign bases will be landscaped. The Design Standards recommend the use of ground or monument signs rather than pylon signs. Most of the new signs constructed along the Highway 36 frontage in recent years have been monument signs. The Planning Commission should discuss this issue. Wall Sionaoe. The total allowable sign area on site, with the freestanding signs, would be 500 square feet. The applicant has proposed a total of 11 wall signs with a total of 420 square feet. The proposed freestanding signs total 228 square feet for a site signage total of 648 square feet. The Planning Commission will need to consider a variance for the size, number and height of the freestanding and the total site signage that exceeds the total allowable by 148 square feet. Sian Illumination. The signs appear to be internally lit but that is not highlighted on the plans. The signs will be required to comply with the Zoning Ordinance lighting requirements. Staff will approve the lighting specifications for the signs at the time of permitting. Sign Variance. Variance criteria are provided in Section 401.04 of the Oak Park Heights Zoning Ordinance. The Planning Commission and the City Council should 6 review the following criteria and conditions to determine if the sign variances are justified. Review Criteria. The Planning Commission and City Council should make a finding of fact that the proposed action will not: a. Impair an adequate supply of light and air to adjacent property. b. Unreasonably increase the congestion in the public street. c. Have the effect of allowing any district uses prohibited therein, permit a lesser degree of flood protection than the flood protection elevation for the particular area or permit standards which are lower than those required by State law. d. Increase the danger of fire or endanger the public safety. e. Unreasonably diminish or impair established property values within the neighborhood, or in any way be contrary to the intent of this Ordinance. f. Violate the intent and purpose of the Comprehensive Plan. g. Violate any of the terms or conditions of Item 5, below. h. Conditions for Approval. A variance from the terms of this Ordinance shall not be granted unless it can be demonstrated that: a. Undue hardship will result if the variance is denied due to the existence of special conditions and circumstances which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district. 1) Special cases may include exceptional topographic or water conditions or, in the case of an existing lot or parcel of record, narrowness, shallowness, insufficient area or shape of the property. 2) Undue hardship caused by the special conditions and circumstances may not be solely economic in nature, if a reasonable use of the property exists under the terms of this Title. 3) Special conditions and circumstances causing undue hardship shall not be a result of lot size or building location when the lot qualifies as a buildable parcel. b. Literal interpretation of the provisions of this Ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same district under the terms of this ordinance or deny the applicant the ability to put the property in question to a reasonable use. c. The special conditions and circumstances causing the undue hardship do not result from the actions of the applicant. d. Granting the variance requested will not confer on the applicant any special privilege that Is denied by this Ordinance to other lands,structure or buildings n the same district under the same conditions. e. The request Is not a result of non-conforming lands,structures or buildings in the same district. f. The request is not a use variance. g. The variance requested is the minimum variance necessary to accomplish the intended purpose of the applicant. h. The request does not create an inconvenience to neighboring properties and uses. Due to the location of this business in that the building will have limited visibility from Highway 36, the applicants have indicated that allowing only a 30 foot freestanding would cause an undue hardship for their business and the ability of customers to locate the building. Please note the sighttine diagrams provided by the Applicant in the Exhibits. A number of other businesses in the Highway 36 conidor have asked for and received variances for signage. Granting a variance request will not create an inconvenience to neighboring properties and uses. The Planning Commission may want to consider the precedence of allowing a 40 foot sign. Most of the other sign variances have been related to number of signs and not sign height. 7 Conditional Use Criteria: 401.30.E Conditional Uses: As indicated, please find below the review of the conditional use standards for automotive sales and service. 6. Open and outdoor services, sale, and rental as a principal or accessory use and automobile repair minor as an accessory use including new or used automotive, trucks, boats, or motorized vehicles and related accessory sales and provided that: a. Outside sales areas are fenced or screened from view of neighboring residential uses or an abutting residential district in compliance with Section 409.15.E of this Ordinance. Comment: The outdoor sales areas will not be required to be fenced. b. All lighting shall be hooded and so directed that the light source shall not be visible from the public right-of-way or from neighboring residences and shall be in compliance with Section 401.15.B.7 of this Ordinance. Comment: All of the lighting will be LED full cut off. The pole height shall be subject to review and approval of a Conditional Use Permit. The photometric plan will be required to be consistent with Zoning Ordinance standards. c. Sales and storage area is blacktopped or concrete surfaced and all paved areas are surrounded by concrete curbing. Comment: The sales and storage areas are already paved. d. The architectural appearance, scale, construction materials, and functional plan of the building and site shall not be dissimilar to the existing nearby commercial and residential buildings, and shall not cause impairment in property values, or constitute a blighting influence within a reasonable distance of the site. Comment: The existing building and site has functioned previously as a dealership and is not incompatible with the surrounding commercial areas. e. Adequate analysis and provisions are made to resolve issues related to demand for services. No use shall be allowed that will exceed the City's ability to provide utility, police, fire, administrative or other services to the site. Comment: There should be no service issues with this use. f. All islands in the parking lot shall be landscaped. Comment: Not required at this time but would be with a redeveloped site. 8 g. A strip of not less than ten (10) feet shall be landscaped at the edge of all parking/driveway areas adjacent to lot lines and the public right-of-way. Comment: The site plan reflects conformance with this. h. All automobile repair activvities shall be conducted within the principal structure and the doors to the service bays shall be kept closed except when vehicles are being moved in or oat of the service areas. Comment: This will be a condition of approval. i. Facilities on a site contiguous to any residential district shall not be operated between the hours of 10:00 PM and 6:00 AM unless otherwise allowed by formal action of the City Council. Comment: This will be a condition of approval. j. Provisions are made to control and reduce noise in accordance with Section 401.15.8.11 of this Ordinance. Comment: Appropriate conditions will be added to the approval. k. Vehicular access points shall create a minimum of conflict with through traffic movement, shall comply with Section 401.15.F of this Ordinance and shall be subject to the approval of the City Engineer. Comment: There should be no issues with the current vehicular access points. 1. A drainage system subject to the approval of the City shall be installed. Comment: The drainage system is in place. m. All signing and informational or visual communication devices shall be minimized and shall be in compliance with Section 401.15.G of this Ordinance. Comment: The numbers, size, height and amount of signage are subject to review of a Variance. n. The provisions of Section 401.03.A.7 of this Ordinance are considered and satisfactorily met. Comment: The criteria are found below. The conditional use permit criteria, found in Section 401.03.A.7 of the Zoning Ordinance, are found as follows: 9 1. Relationship to the specific policies and provisions of the municipal comprehensive plan. 2. The conformity with present and future land uses in the area. 3. The environmental issues and geographic area involved. 4. Whether the use will tend to or actually depreciate the area in which it is proposed. 5. The impact on character of the surrounding area. 6. The intent is to relocate the Chrysler Jeep Dodge Ram new car franchise from the current location at Osgood and Highway 36 in Oak Park Heights. The project will require the selective interior demolition and extensive remodeling. This request is for a conditional use permit to re-open the facility with the previous use as an automobile dealership for the sale and service of new and used vehicles. Building Remodeling The exterior of the building consists of painted decorative concrete block,EFIS,glazing and doors including overhead doors.The renovation will include re-painting the painted surfaces to the Chrysler specified neutral gray.The EFIS will be restored and recoated the same gray color. I also briefly visited the site to inspect existing plantings of trees and shrubs, most of which are indicated on the plan to remain. Below are my observations and recommendations: 1. The plan is minimal, basically cleaning up and incorporating existing trees and shrubs and planting several existing and new beds with daylilies and ornamental grasses. This is probably sufficient for an existing business where the original landscape plan was already approved and accepted. 2. The building official, Julie Hultman, did state that they would need to plant the areas at the bases of the free-standing business signs. They should provide a design and plant list for those areas. 3. Any existing trees or shrubs with dead branches or dead areas should be pruned of dead wood. 4. Any dead existing trees, shrubs or perennials should be replaced if they are proposed on the plan to remain part of the landscaping. 5. I do not see a "Planting Detail" for trees and shrubs, but this would only be needed if they ended up replacing any existing woody plants. Please send my comments to the developer. THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS,WASHINGTON COUNTY, MINNESOTA,DOES ORDAIN: 1109.01 Public Nuisance Defined. A public nuisance is a thing,act,or use of property which shall: A. Annoy,injure,or endanger the health,safety,comfort or repose of the public; B. Offend public decency; C. Unlawfully interfere with the use of,or obstruct or tend to obstruct,or render dangerous for passage,a public water,park,square,street, alley,or highway; D. Depreciate the value of the property of the inhabitants of the City of Oak Park Heights or of a considerable number thereof;or E. In any way render the inhabitants of the City of Oak Park Heights,or a considerable number thereof,insecure in life or in use of property. 1109.02 Definitions. A. It shall be a nuisance for any person to cause or permit a domesticated animal to be on any property,public or private,not owned or possessed by such person, unless such person has in his/her immediate possession a device for the removal of excrement to a proper receptacle located upon property owned or possessed by such person; P. It shall be a nuisance for any person in control of,causing or permitting any domesticated animal to be on any property,public or private,not owned or possessed by such person,to fail to remove excrement left by such domesticated animal to a proper receptacle located on the property owned or possessed by such person. Q. The provisions of Subparagraphs 0 and P of this Section shall not apply to the ownership or use of seeing eye dogs by blind persons,dogs when used in police activities by the City or County Sheriffs Department,or tracking dogs when used by or with the permission of the City. 1109.04 Public Nuisances Affecting Peace and Safety. The following are declared to be nuisances affecting public peace and safety: A. All snow and ice not removed from public sidewalks twelve(12)hours after the snow and ice have ceased to be deposited thereon; a. Snow,ice or any other debris may not be placed into or upon City street surface by any party without a Permit issued from the City. b. Snow,ice or other debris generated from private lands may not be plowed or dragged across a City street for purposes of snow storage and/or snow wasting. c. Depositing of snow generated from private lands upon a public right of way that is not immediately adjacent,contiguous and on the same side of the street is also prohibited. B. All wires which are strung less than fifteen(15)feet above the surface of any public street or alley; 3 C. All buildings, walls, and other structures which have been damaged by fire, decay or otherwise as to an extent exceeding one-half(1/2)of their original value or which are so situated so as to endanger the safety of the public; D. All explosives,inflammable liquids and other dangerous substances or materials stored or accumulated in any manner or in any amount other than that provided by law or ordinance; E. All use of display or fireworks except as provided by law or ordinance; F. All of the following activities are hereby declared to be public nuisances: 1. Any snow removal activities on private property located within 500 feet of any residential district of the city, using plows, dump trucks, payloaders or any mechanized equipment between the hours of 10:00 o'clock. p.m. and 600 o'clock a.m.This provision shall not apply for any time period in which the City has declared a snow emergency. 2. Any parking lot sweeping,paving,or seal coating activities occurring between the hours of 10:00 o'clock. p.m.and 6:00 o' clock a.m. 3. All construction activities where the use of power nailers,power saws, earth moving equipment,bulldozers,or any power equipment is being used between the hours of 10:00 o'clock p.m. and 7fl0 o'clock a.m. 4. The owning,keeping, crharboring of any animal which shall,by any noise, unreasonably and/or excessively disturbs the peace and quiet of any person in the vicinity. The phrase "unreasonably and/or excessively disturb the peace and quiet" shall include, but is not limited to, the creation of any noise by an animal which can be heard by any person, including an Animal Control Officer or law enforcement officer,from a location off the dog or cat owner's property where the animal is being kept, and which noise occurs repeatedly over at least a five (5)minute period of time with one (1) minute or less lapse oftimebetweeneach animal noise during the five(5)minute period,This provision shall not apply to dogs and cats which are regulated under Chapter 601 Section 601.13 A. (5). 5. The removal of commercial waste and refuse, emptying or removal of dumpsters and drop boxes from any non-residential zoned area within the city between the hours of 1000 o'clock p.m.and 6:00 o'clock ani. 6. No person shall use or operate, or permit the use or operation of any electronic sound system or audio equipment including but not limited to any compact disc player, cassette tape player, a.m. FM radio, citizen band radio, paging system, musical instrument, phonograph, or any other device design for the production or reproduction of sound in a distinctly loud and audible manner as to unreasonably disturb the peace quiet and comfort of a 4 reasonable person or reasonable persons nearby. a. It shall be presumed that a violation of this section has occurred when any electronic sound system or audio equipment is operated in a manner in which it is plainly audible, at a distance of 50 feet or more from its source between the hours of 10:00 p.m. and 6:00 a.m. It shall be presumed that a violation of this section has occurred when any electronic sound or audio equipment is operated in a manner which is plainly audible from its source at a distance of 100 feet or more between the hours of 6:00 a.m. and 10:00 p.m. b. When noise of violating this section is produced by an electronic sound system or audio equipment that is located in or on a vehicle, the driver the vehicle and the person who owns or is in control of the vehicle is guilty of the violation. c. This section shall not apply to sound produced by the following: i. amplifying equipment used in connection with the with activities which are authorized,sponsored or permitted by the city, so long as the activity is conducted pursuant to the conditions of the license, permit or contract authorizing such activity; ii. church bells,chimes,carillons, school bells, or emergency civil the fires warning signals. iii. antitheft devices iv. machines or devises for the production of sound on or in authorized emergency vehicles 7. No person shall scale,climb or otherwise circumvent any safety railing or fencing located upon the St.Croix River Bridge structure,its abutments, trails, ramps or appurtenances. It is a further violation to stand, sit or place one's self upon the outer surface of any such railing or fencing so as to position themselves at risk of falling or alarming the public that they are at the risk of injury, death or attempted suicide. G. All buildings and all alterations to buildings made or erected in violation of fire ordinances and building codes concerning manner and materials and construction; H. Obstructions and excavations affecting the ordinary use of the public of streets, alleys, sidewalks or public grounds, except under such conditions as are provided by ordinance, and any other excavation left unprotected or uncovered indefinitely or allowed to exist in such manner as to attract minor children; 5 I. Radio aerials strung or erected in any manner except that provided by law or ordinance; J. The piling, storing or keeping of old machinery, wrecked, junked, or inoperative vehicles, and other junk or debris; K. The use of property abutting on a public street or sidewalk, or any use of a public street or sidewalk, which causes large crowds of people to gather obstructing traffic and the free use of public streets or sidewalks; L. All hanging signs,awnings,and other similar structures over public streets or sidewalks or so situated as to endanger public safety, not constructed or maintained as provided by law or ordinance, or without proper permit; M. The allowing of rain, water, ice, or snow to fall from any building or any public street or sidewalk or to flow across any public sidewalk; N. All dangerous, unguarded machinery, equipment, or other property in any public place, or so situated or operated on private property so as to attract minor children; 0. Throwing,dropping,or releasing printed matter,paper,or any other material or objects over and upon the City from an airplane,balloon or other aircraft or in such a manner as to cause such materials to fall on land in the City; P. Placing entrance culverts or doing any act which may alter or affect the drainage of public streets or alleys or the surface or grade of public streets, alleys, or sidewalks without proper permit; Q. Making repairs to motor vehicles,or tires in public streets or alleys excepting only emergency repairs when it will not unduly impede or interfere with traffic; R. Throwing, placing, depositing, or burning leaves, trash, clippings, weeds, grass, or other materials in the streets, alleys or gutters; S. Erecting, painting, or placing of unauthorized traffic signs or advertising signs in streets, or alleys or on sidewalks; T. All unnecessary interferences and disturbances of radios or TV sets caused by defective electrical appliances and equipment or improper operation thereof; 6 U. Driving motorized scooters,bicycles,motorcycles,or any type of motorized vehicle on any sidewalk, walkway or private property of others, and the driving of said vehicles in a loud, noisy, or unsafe manner or in groups of more than two(2)on any public street, alley, or roadway; V. To operate any private parking lot without keeping the same reasonably free from dust; W. To operate any artificial lighting devices upon any residential,commercial or industrial premises so as to cause a distraction to passing motorists or to operate said artificial lighting devices upon any residential, commercial or industrial premises without some effective device so as to protect adjacent premises from being adversely affected thereby; X. The maintenance of any tree or shrub,the roots of which are causing damage to any public sewer,sidewalk,pavement,or other public property,or setting out or planting any tree or bush in the public street or any portion thereof; Y. All other conditions, acts, or things which are liable to cause injury to the person or property of another; Z. Any use of the public beach or public areas of Oak Park Heights after the hour of 10:00 p.m. 1109.05 Enforcement. It shall be the duty of the City Council by and through the Oak Park Heights Police Department to enforce the provisions of this Ordinance and the City Council may by resolution delegate to such other officers or agencies power to enforce particular provisions of this Ordinance,including the power to inspect private premises and the officers charged with enforcement of this Ordinance shall take all reasonable precautions to prevent the commission and maintenance of public nuisances. 1109.06 Powers of Officers. A. Whenever in the judgment of the officer charged with enforcement, it is determined upon investigation that a public nuisance is being maintained or exists within the City, such officer shall notify in writing the person committing or maintaining such nuisance and require him to terminate and abate said nuisance and to remove such conditions or remedy such defects. Said written notice shall be served upon the person committing or maintaining said nuisance in person or by registered mail. If the premises are not occupied and the address of the owner is unknown,service on the owner may be had by posting a copy of the notice on the premises. Said notice shall require the owner or occupant of such premises, or both, to take reasonable 7 steps within a reasonable time to abate and remove said nuisance,said steps and time to be designated in said notice, but the maximum time for the removal of said nuisance after service of said notice shall not in any event exceed thirty (30) days. Service of notice may be proved by filing an affidavit of service with the City Clerk setting forth the manner and time thereof. B. When an order so given is not complied with,such non-compliance shall be reported forthwith to the City Council for such action as may be necessary and deemed advisable in the name of the City to abate and enjoin the further continuation of said nuisance. 1109.07 Abatement of Nuisance/Recovery of Costs. A. Abatement by Enforcing Official/Recovery of Costs. If,at the end of the time period allowed for correction of a nuisance violation,the violation still exists, the enforcing official may cause the following enumerated violations to be corrected by private or public means and pursuant to the provisions of Minnesota Statutes, Section 429.101, as amended, the City may collect any and all unpaid special charges derived from the costs of the abatement work plus administrative fees as a special assessment. The conversion of unpaid special charges into special assessments is allowed for the following nuisance abatements: (1) Snow, ice, or rubbish removal from sidewalks; (2) Weed elimination from or streets or private property; (3) Removal or elimination of public health or safety hazards from private property, excluding any structure included under the provisions of Minnesota Statutes,Sections 463.15 through 463.26,as amended; (4) Installation or repair of water service lines; (5) Trimming and care of trees; (6) Treatment and removal of insect infested or diseased trees on private property, and the repair of sidewalks and alleys; (7) Operation and maintenance of a fire protection system; (8) Nonpayment of charges for inspections relating to a municipal housing maintenance code violation; or (9) Recover of delinquent vacant building registration fees under any program designed or enacted by the City to identify and register vacant buildings. B. Emergency Abatement by Enforcing Official. The enforcing official may cause any nuisance that is a present or immediate danger to public health or safety to be corrected by public or private means without notice to the owner and, for the nuisances enumerated in subparagraph(A),the city may collect 8 any and all unpaid special charges derived from the cost of the nuisance abatement work plus administrative fees as a special assessment. C. Civil Action. The owner of the premises on which a nuisance has been abated by the city shall be personally liable for the costs incurred by the city to abate the nuisance, including administrative costs. As soon as the nuisance abatement work has been completed and the costs determined,the city clerk or other official designated by the city council shall prepare a bill for the costs due and mail it to the owner. Such amount shall be immediately due and payable at the office of the city clerk. If the bill remains unpaid,the city clerk may commence a civil action to collect said bill, or undertake the process described in subparagraph(A). If undertaken as a special assessment process, the bill provided to the owner may take the form of mailed notice of the special assessment under Minnesota Statutes, Chapter 429, as amended. 1109.08 Penalties. Any person who shall cause or create a nuisance or permit any nuisance to be created or placed upon,or to remain upon any premises owned or occupied by him,and any person who shall fail to comply with any order made under the provisions of this Ordinance, upon conviction thereof shall be guilty of a misdemeanor and shall be punished by a fine of not more than Seven Hundred Dollars ($700.00) or by imprisonment in the County Jail for not more than ninety(90)days, or both. 1109.09 Separability. Every section,provision, or part of this Ordinance is declared separable from every other section,provision or part; and if any section,provision or part thereof shall be held invalid, it shall not affect any other section,provision or part. 1109.10 Conflicting Ordinance Repealed. Sign Permit Required. No special event shall be held without first obtaining a sign permit. b. Number of Events. The business or applicant in all business and industrial zoning districts, as well as each public and institutional use in residential districts (except for the areas within the Destination Retail Highway District as indicated in Section 401.15.G.7.c), shall be a total of fifty(50)special event days in a calendar year. Once the time period has expired for a special event, the applicant shall wait the same number of days that the sign permit was issued to start a new special event. c. Events in the Destination Retail Highway District. The business or applicant in the Destination Retail Highway District shall be allowed a total of one hundred eighty(180)special event days in a calendar year for any applicant, business, or public and institutional use. Once the time period has expired for a special event, the applicant shall wait two (2) days before starting a new sales event. All other special event requirements, as found in Section 401.15.G.7 of this Ordinance, shall be adhered to within the Destination Retail Highway District. d. Permitted Signs and Displays. The signs and displays described below are permitted for special events in addition to the maximum allowable sign area, provided they are professionally done and the following standards are met and complied with: 1) Balloons. 2) Tents. 3) Bannerettes and Pennants. 4) Banners. 5) Search lights. a) Search lights as regulated in Section 401 .15.B.7.g.1 ) of this Ordinance. b) Ribbons, Streamers and Air Inflatable Devices — limited to three (3) special event days per calendar year, each no longer than ten (10) days per event. e. Prohibited Signs and Displays for Special Events. The signs or displays described below are prohibited for special events: 1 ) Animated signs, dynamic display signs, electronic graphic display signs, Multivision signs, video display signs, light bulb strings, and portable signs. 2) Displays or special features on any landscaped areas or on roofs. 3) Aerial rides. 4) Additional lighting that does not meet this Ordinance. 5) Any sign or display in the public right-of-way. f. Sign Permit Requirements for Special Event Lot Decorations. Before any special event signs or decorations shall be permitted to be used for an event, the responsible property owner or organization shall submit a completed application for a sign permit with the City. In addition to other requirements, the applicant shall show that when the event is held, adequate parking area will continue to exist, even though a portion of required parking spaces may be used to celebrate the event. Only after the City issues the sign permit, may a business display the special event signs and decorations. g. Violations. 1 ) It is a violation for any person, company, or organization to provide, erect or display any beacons, balloons or other advertising device which is not in conformity with the provisions of this Section. 2) Special event signs and decorations not removed by the last day of the special event.
