Paul , MN 55101 RE: King Plant Dear Mr. Haar, The City has been notified by Xcel Energy's Judy Poferl that Xcel has completed is final draft cost allocation for the MERP and has provided the same to your office and members of the service list for commentary. The City of Oak Park Heights where the King Facil is located is pleased to inforin you that Xcel Energy has received. City Council approval of the necessary Conditional Use Permit, with specific conditions, for its pending MERP upgrades. However, this is the first step in Such process, the actual Conditional Use Permit document which will include such conditions must be issued by the City Attorney Office and signed by the proper parties within. Xcel Energy. Once executed by Xcel, the City must also sign such document and have recorded with Washington County agahast such property. Until all of these elements are completed, Xcel Energy would not hold an authorization to proceed with such improvements in the City of Oak Park Heights. Please review and insert for your file this letter and the attached communication dated July 29 h , 2004 as delivered to Xcel Energy - Mr. Ron Elsner. The approval was granted with specific conditions that were as outlined in the original Council Resolution - a copy of which is attached hereto. As you will recall, Item 9 was removed by the Council, over the next several days the City Attorney's Office shalt be drafting the actual Conditional Use Pe document which will incotporate such conditions. Once the Permit is drafted, both Xcel Energy and the City must execute the Permit and such Permit must then be recorded with Washington County in proper format before the Permit actually becomes valid and "in- effect ", regardless of the terms of its approval. And, until such process is completed, Xcel Energy would not hold any authorization to proceed. Accordingly if Xcel Energy has an intention to proceed with its project prior to the required completion of the necessary Conditional Use Permit documents please advise the City immediately. Hopefully this will clarify any process questions.
